00:05:00.000 Hello, everybody, and welcome to Shadow at Night.
00:05:09.800 This is Thursday, February 22nd, 2024.
00:05:13.380 On the show tonight, Marco Van Heugenbos,
00:05:17.020 he's got a bombshell from the Coutts pretrial
00:05:19.260 that's happening in Alberta right now.
00:05:21.420 I found out about this this afternoon.
00:05:24.000 Marco and I had been in touch,
00:05:25.160 And essentially, the Emergencies Act plays into what's going on right now.
00:05:33.140 Marco is going to explain it all to us in just a few moments.
00:05:37.520 I'm not sure, and I'm going to press him.
00:05:40.560 Not that I need to, because he wants to reveal everything he possibly can, Marco does.
00:05:45.120 But we're going to ask him if there's any more information that's been revealed
00:05:50.020 in regards to what actually happened with the RCMP,
00:05:53.960 the crown prosecution and the judge because that in itself could blow this thing sky high
00:06:01.640 and the corruption of our judicial system now is very very much in play possibly possibly so marco
00:06:09.860 is coming up in just a second we're going to find out everything we can let's remember two of the
00:06:16.140 four men are still in lockup without trial i'm not sure how many days it's been for them now
00:06:22.540 740? Is it 750? Marco will know that. He's coming on in just a second. Hello, Ruby, watching tonight

00:08:47.360 These toothpaste flavors are absolutely amazing.
00:08:50.880 When's the last time you had cinnamon toothpaste?
00:08:54.320 I know spearmint is kind of a regular flavor amongst all the big toothpaste brands in the stores,
00:08:59.680 but cinnamon? Come on. No, it's not.
00:09:01.460 And bubble berry, if you want to get...
00:09:03.660 And this is the beautiful thing about this, no fluoride, right?
00:09:06.380 You want to keep the fluoride away from the kids especially.
00:09:08.720 I mean, we've already been dumbed up for the past 20, 30, 40 years.
00:09:12.800 But protect the children, please.
00:09:16.020 Naturally whitening helps keep teeth clean with triple action nano silver.

00:09:41.400 And again, there is no fluoride in this stuff.
00:09:44.960 To recap, it helps clean teeth and promote healthy teeth and gums using triple action natto silver.

00:10:41.360 There is, oh, that's me.
00:10:43.620 There's been some confusion about the website.
00:10:47.520 People are, they're emailing me to give me heck
00:10:52.700 about the fact that I am now charging for the show.
00:10:55.980 Well, yes, that is partially true.

00:11:05.460 after 9 Central, we move to the website for the extension.

00:12:20.840 see you there the show is running there right now as well all right marco van hugenboss is our guest
00:12:25.960 tonight hello marco thank you for coming on the show tonight on short notice i know you've been
00:12:30.340 busy you've been in pre-trial with with i guess the coots too now this week are you down in
00:12:35.840 lethbridge right now or you back home uh back home i live um just over half hour away from
00:12:42.060 lethbridge to the west for mcleod so okay so i commute every day yeah correct so uh can you
00:12:49.260 give us an update first of all we know that i'm gonna throw these this western standard piece up
00:12:55.400 on the screen for people right now uh this came out a couple of weeks ago Chris Carbert Anthony
00:13:01.080 Olenek still in lockup Jerry Morin and Christopher Lysak are out now have you had any contact with
00:13:08.180 the two that are that are out and how are they dealing with life in real society again
00:13:12.540 so I haven't had any contact with Jerry Morin but I have had considerable contact with Chris Lysak
00:13:21.140 I actually went for lunch with him today, and I went for lunch with him yesterday, and I've probably seen him almost half a dozen or probably over a half a dozen times.
00:13:35.440 Considering what he's gone through, 723 days of remand, that's the amount of time that Chris Lysak served.
00:13:45.620 He's doing, in my view, phenomenal.
00:13:48.080 um i'm almost a little concerned as to how well he's doing he's um integrating back into society
00:13:55.340 and um is it like nothing ever happened marco i wouldn't say that i wouldn't say that he's uh
00:14:03.620 um but it's like has he has he intimated to you any kind of ptsd from all of this does he wake
00:14:11.460 up at night like looking around for something or anything no no none of that and
00:14:17.300 And to be fair, I haven't had a lot of private time with him.
00:14:22.420 Just the first day I went with him to get his, he had issues with his cell phone provider that were unresolved.
00:14:30.960 So I had a spare and I went to a provider and got that working for him so that he could deal with business and get in contact with people.
00:14:41.260 You know, we do live in a day and age where a cell phone is critical.
00:14:44.280 That was the only time I've really spent with him privately.
00:14:47.300 Most everything else has been in a group, so it's not a topic that's been on the table in relation to, you know, how are you really doing.
00:14:55.760 But not that I'm aware of. I think some of this may come, some of the potential trauma, anger, and mental side effects that have to do with the experience and the injustice of the experience that he has been part of.
00:15:24.140 so there are people his friends and myself included that are definitely keeping a bit of
00:15:30.060 an eye on that to make sure that when when when this stuff you know he's still working on bringing
00:15:36.260 things back to a normal setting right there's there's work to be done but once the the modane
00:15:41.960 of of light you know just happens then he could start to experience some of this when um at that
00:15:51.020 time so we want to make sure that the resources are there and that there are people there for him
00:15:55.320 um if that ever presents itself so but at this point he's doing um and he wouldn't want me
00:16:02.100 talking about him and he definitely doesn't want to be talked about because that's who chris is
00:16:05.560 he he texted me yesterday he's like i'm coming for lunch when court was adjourned for lunch and
00:16:11.640 we went across the street to a restaurant and he showed up and i had said oh there's a few other
00:16:16.340 people here and he just said you know i'm nothing special he says and i'm like well i understand
00:16:21.220 what you're saying uh and i've interacted with him on to some degree on the daily for a long
00:16:28.060 a long long time so um you know but a lot of people rightfully so but they view him as as a
00:16:36.520 hero of sorts and he just doesn't really know what to do with that attention so uh um i guess
00:16:43.340 if that's the worst thing he's experiencing at this point the extra extra attention and the
00:16:47.960 unwanted attention then we can be thankful but i do believe there will be some uh side effects
00:16:54.360 or consequences that that he will have to deal with um either i would like to get him on the
00:17:00.100 show marco what one of these uh you know and i understand that he doesn't want his face out there
00:17:05.240 and i'm nothing special and all that and some people don't handle the public adulation all
00:17:08.960 that well but people do want to hear from the horse's mouth you know what they went through
00:17:15.800 in there and maybe i mean like you say it's going to take some time for that kind of thing to come
00:17:21.140 out um why no why no contact with jerry is is that a whole separate issue that you can't talk about
00:17:27.640 no i i never did i never had contact with jerry okay so i've mentioned this before but
00:17:34.700 Chris and Chris were friends since elementary, since grade school.
00:17:40.000 Chris Carver and Chris Lysak, they're both from Lethbridge, from the north side.
00:17:45.560 And they were locals to Lethbridge.
00:17:49.940 Tony Olenek is from Claire's home.
00:17:51.480 It's about an hour away from Lethbridge.
00:17:54.080 And Jerry Morin was further north, north of Calgary.
00:17:57.960 So not somebody I would have known or even known associates of him.
00:18:04.020 there was no connection before coots and there's been very little connection after coots other than
00:18:09.900 the fact that he's one of the four and i have as much as possible advocated for all four and
00:18:15.180 continue to i still some people are saying coots do i disagree it's coots four we're talking about
00:18:20.420 two men still remanded of the coots four but we are it's always been coots four and it should be
00:18:25.360 remain coots four um because there's still there's still threats hanging over their heads which is
00:18:31.520 at this point threats but i mean i don't think that'll materialize but i just never had can you
00:18:37.480 talk about those threats marco no at this time i can't no no i i i can't i don't want to speculate
00:18:44.240 and i definitely don't want to give them any kind of ideas or feel that because it's now out there
00:18:48.360 that they're obligated to follow up on this so um it's uh yeah anyways back to jerry
00:18:56.340 he has a support group he has his family has his friends i was not one of them not for any reason
00:19:02.700 whatsoever um he has had tremendous support and that being said um i know there's people that
00:19:09.300 have seen him have met with him and i hope that he that he is integrating as well as uh chris
00:19:18.960 is back into society back into the the life that he previously had um or what's left of that life
00:19:27.520 and um i hope i wish jerry all the success but i do believe that uh even for jerry i don't think
00:19:35.140 that this is completely finished just yet right so that's um and that brings me back to your
00:19:41.120 question about having chris on there have been a lot of interview requests um i'm close to chris
00:19:47.040 I have a lot of media contacts.
00:19:48.780 I've taken a lot of those requests.
00:19:51.220 And in being in contact with Chris, the advice that Chris was given and the position that we have taken and he has taken based on this advice is that until the prosecutions of all four have been completed, it is advised, they have been advised not to do any interviews, not to do any media, etc.
00:20:13.740 There's no conditions on their pleas or on their release, but at this point, they want to be safe.
00:20:22.040 That's the position that council has advised.
00:20:24.980 So Daniel Song has advised Chris to take, and Chris is more than willing to take that position at this time.
00:20:32.200 He does understand that there will come a time where his story will, you know, people will want to hear parts of the story about him or get to know him.
00:20:43.840 But he is doing that.
00:20:45.460 He has met with a lot of people one on one, right, or people come to meet him, things like that.
00:20:50.220 But there is a large audience provincially, nationally and even internationally that I think would like to have to some degree some closure on this.
00:21:00.420 And kind of a, here's a bit of an example.
00:21:05.840 Chris Lysak did daily updates.
00:21:08.040 If you follow his Facebook page, he did daily updates.
00:21:12.640 And he documented at times small details throughout his day from what was for lunch, what was for breakfast, what he did, the calls he made, things like that.
00:21:21.280 And it was, it became part of our day.
00:21:25.400 It became part of my day to read about Chris's updates.
00:21:29.480 Sometimes they were lengthy. Sometimes I didn't have all the time in the world.
00:21:32.840 If I talked to him for 20 minutes, I didn't necessarily need to read his update.
00:21:35.700 But depending on where I was, I did.
00:21:37.800 But a lot of people religiously followed these men and their updates.
00:21:43.520 And in the last couple of weeks, there's been almost no news.
00:21:49.180 It leaves a hole, doesn't it?
00:21:51.460 Absolutely. And I've had people comment how in the morning they would always have coffee and read Chris's update.
00:21:57.780 and there's a part of their life missing so um i'm thankful he's out but there are some people
00:22:03.720 that uh that are missing a bit of their life at this moment and there's some well maybe he could
00:22:08.760 still do a daily update just tell us that he woke up he went and had a leak he had a cup of coffee
00:22:13.540 didn't have any problems just a regular guy on a regular day maybe yeah yeah it's uh there have
00:22:21.080 been some updates just uh just how he's doing right people are curious and um but at this point
00:22:26.240 he's uh he's not hiding and but he is um he's not looking for uh he's not looking for a lot
00:22:33.840 of attention he he prefers not to have that but yeah what about what about tony and uh chris
00:22:41.020 carbert they're still in there yeah so they're they're still incarcerated um they're still
00:22:46.720 remanded we're currently in another week of pre-trial and i believe we're leading up to i
00:22:52.840 I think we have, after tomorrow, we have another two weeks scheduled before June, before the trial in June.
00:23:01.420 But, yeah, nothing has changed for them.
00:23:06.440 A lot has changed, right?
00:23:08.020 A lot of things have come to light.
00:23:09.620 There's a lot of things being revealed.
00:23:12.180 There's a lot of exposure to this, even just what happened today.
00:23:15.840 and that the big reveal that we'll get to is on the other side of the country.
00:23:23.160 It is so connected to these men, not by name,
00:23:30.200 but to what these men were alleged to have done and alleged to have had
00:23:35.180 and how that all transpired, that indirectly,
00:23:38.960 you know being that the EMA is such a such a high profile issue still is um it indirectly
00:23:47.360 brings a lot of attention to these these remaining two men of coots four so that's
00:23:52.320 that's great you know I was just on the phone with Chris um he uh you know we talked once or
00:23:58.760 twice a day and uh during court one so he called me and I took the call because I knew I wasn't
00:24:03.460 going to have time before 9 30 so and I said hey I'm going on a show and kind of told him the
00:24:08.260 details is okay cool and um they live through the people that call at this point you understand like
00:24:14.340 you know a day in court is great because it's a change in scenery but most days are very systematic
00:24:20.780 so they live through the 20 minute phone calls that they're allowed to make and little details
00:24:25.160 that are like okay i went to go do chores he'll ask like five questions about what that all entails
00:24:30.600 because to him he's visualizing that these men are visualizing what we're doing what things look like
00:24:36.540 Because for them, it's become a very boring, very not dreadful, but I mean, well, it is a dreadful place, but it's it's limited.
00:24:44.520 There's no. They don't need to focus on anything. Everything gets done for them.
00:24:48.640 They have their they have their rule. They have their schedule. That's it.
00:24:51.640 It's very essentially it's boring. Right.
00:24:53.760 So are they are they like sweeping floors? Do they have jobs to do or is it just a matter of sitting in a cell all day long?
00:25:00.520 Well, jobs, well, there's a schedule, but jobs are, there's not as many jobs as are necessarily inmates. So jobs is something that an individual longs for, but isn't always available. I think Chris, based on his seniority, being in remand.
00:25:19.160 seniority it's funny you should well it's on court it's it's it's it's true he's been in there
00:25:25.660 738 days yeah right he's been there 738 days he's been there he's he's the one he's the longest one
00:25:33.420 there so um the guards have tremendous respect for him as you know outside of their their role as
00:25:41.500 guard versus inmate but i mean he uh he has roles he has things to do he leads a bible study he does
00:25:49.780 things but again those phone calls that he makes are are uh are his his way out or his his daily
00:25:59.060 ability to to leave those four walls even if does does he have internet access is there any way that
00:26:04.940 he can just go on to some social media and see what's going on in the world is that allowed
00:26:11.080 No, Re-Man is very restrictive.
00:26:15.680 He does have access to a tablet, which then allows him to have access to a messaging app.
00:26:21.580 So I can message him back and forth, but that is very controlling.
00:26:26.340 Messages get approved.
00:26:27.600 Any media is most of the time declined.
00:26:31.760 You know, pictures and things like that, vice versa.
00:26:34.220 It's about anywhere from 20 to 40 cents per message, which the cost doesn't matter.
00:26:39.600 even on my end to send you know to send a picture that's worth 40 cents to me that's that's that i
00:26:45.200 don't care if i can send him a picture of you know something like a house or we're at the mountains
00:26:52.080 or something that that's he can live through that but he doesn't have access to internet for
00:26:58.320 any other purposes they have i believe they have tv or they have an area where they can watch tv 0.59
00:27:05.600 or the news but i you can just imagine that what they're seeing there is uh garbage uh yeah you
00:27:12.460 know your your corporate what do you call this like what marxist corporate media my friend there
00:27:17.620 you go that's all they're allowed to watch so yeah it's very limited it's remand it's not
00:27:23.860 they're not in a correctional center you mentioned um the guards having tremendous respect and i can
00:27:30.060 understand that i mean these guys have probably these guards have probably never seen anything
00:27:35.300 like this before anything close to anything like this before when it came to the release of the
00:27:41.140 other two and i just want to get back to that for a second was there any kind of you know relationship
00:27:48.900 that was built up between chris lisak jerry and the guards did you hear any stories about handshakes
00:27:55.560 or even hugs or are these guys not allowed to show that kind of thing um i i haven't i haven't
00:28:05.440 heard anything in specific but i do know they're they have they have relationship with the guards
00:28:13.940 as much as that as far as like as as when i say relationship after a while you interact with this
00:28:22.240 individual on the daily multiple times a day you're going to build a relationship i think
00:28:26.120 there's still protocol that that kind of um determines how big of a relationship you can
00:28:31.580 have i don't think they can be friends necessarily but they can be friendly and when i say when i say
00:28:38.140 this the these guards have never experienced this in relation to the details of you know the length
00:28:45.240 why all the details around these the these men but then you take into account these men themselves
00:28:53.420 they're not criminals right they're not coming in all drugged up and just disgusting and not
00:29:01.620 like just they have tremendous social skills solid morals um and and that builds you know um
00:29:13.380 respect yeah it builds respect right yeah the guards have the authority and at times depending
00:29:19.940 on how they're feeling they can execute that authority in a manner that isn't necessarily
00:29:23.760 fair and these men aren't they're they're treated the same as others it's not like they're always
00:29:29.380 an exception no but um since they first come there i'd say in the last half year to now
00:29:38.460 these men they they they get treated differently not as an exception but differently based on
00:29:48.760 the view that the guards have towards these men right so that's yeah i don't have specific
00:29:57.200 examples but they have there is respect for the chris's and there is respect for the chris's
00:30:02.940 they're well known like different units in lethbridge and jerry and tony uh weren't in
00:30:09.600 lethbridge chris and chris work but we now know that james salary that trucker that hit the pylon
00:30:15.120 he he's now remanded or he's now incarcerated in lethbridge as well serving his his sentence
00:30:20.220 on a different unit and when he got there he was talking about the christmas and everybody
00:30:26.060 knew the christmas like even people that have never seen him everybody knows about the christmas
00:30:30.020 but james is not in remand though he's actually in a provincial prison right yeah there is a unit
00:30:36.840 yeah it's a different part of the prison with no interaction with chris's unit but
00:30:41.820 the whole the whole building knows about the chris's how is james doing um i think he's he's
00:30:51.200 doing he's doing okay he's he's adjusting it's a good day bad day um he's still living
00:30:57.340 based on what I'm reading
00:31:00.140 on his timelines
00:31:01.480 on his updates as well
00:31:03.380 is he's still
00:31:04.020 living through
00:31:07.840 his connections in the outside world
00:31:11.360 and I think he might have a few more privileges
00:31:13.000 being that he's not in remand
00:31:14.900 but
00:31:16.840 it can be easy
00:31:18.420 I think by the time that he may have
00:31:21.100 actually adjusted to it, if he ever will
00:31:22.880 his
00:31:24.100 release date is a date
00:31:26.940 that he can actually look forward to.
00:31:31.860 And that's without comments on his appeal
00:31:35.840 or what that looks like.
00:31:37.500 And if that appeal is granted,
00:31:39.460 then he may be released pending appeal.
00:31:41.760 I don't know.
00:31:42.400 I'm not involved in his case that much.
00:31:46.080 I do know his mom and I see his mom often,
00:31:48.220 but I think he's doing okay.
00:31:51.040 As okay as anybody can be recently incarcerated, right?
00:31:56.240 Especially for running over a pylon and being accused of what you were accused of. 0.59
00:32:00.360 I mean, that whole thing was absolutely ridiculous with James Sowery, by the way.
00:32:05.860 So you did a thing with MOCA this afternoon that you sent me on X,
00:32:11.740 and I was mind blown by that.
00:32:14.560 I had to watch it, I think, three times before I got the complete message
00:32:18.760 as to how the Emergencies Act, now the illegal invocation of the Emergencies Act,
00:32:24.240 could possibly and should affect the outcomes of trial
00:32:31.980 for these two men who were still in remand awaiting trial
00:32:35.640 and even the other two who were now released.
00:32:40.420 Yeah, the connection in relation to their prosecution is difficult.
00:32:50.700 It's definitely there.
00:32:54.240 So the evidence that is being presented through pretrial, through witnesses on the stand, I'm not disputing any of that necessarily at this point in relation to the connection that I drew to Ottawa.
00:33:11.360 What I've done today and what I've been on for a while, and I think you've followed some of that in the last couple of weeks, is that Ottawa used this for more than what it was.
00:33:22.460 If you follow what I'm saying?
00:33:23.480 you mean you mean the blockade yeah the coots yeah the situation let's call it the situation
00:33:31.420 in coots uh the the the guns all of that they what may come out in the wash through trial
00:33:41.760 is we hope the truth and the facts of the situation and and such and that there was 0.99
00:33:48.320 no conspiracy and that um at best there was justified anger among other things well shit
00:33:56.700 i can relate to that you can too everybody could that's what was happening at that time in
00:34:01.660 in this country but what ottawa has done and to some degree is still doing and is still allowed
00:34:10.900 to stand um even though it's slowly falling apart is the fact that this was terrorism
00:34:18.600 the volatility of the coots situation the threat of dead rcmp officers all of that that's what
00:34:29.120 ottawa did and then some to and we'll work our way through this to then justify invoking the
00:34:37.060 one of the strongest pieces of legislation any government in this in this country has available
00:34:43.360 at their disposal the strongest piece of legislation basically uh you you referred
00:34:48.620 to the public order emergency commission a couple of times during your interview with
00:34:52.240 with mocha and correct all of the all of the findings of that particular commission while
00:34:58.360 not binding were absolute bs let's be completely honest and what justice rulo said at the end of
00:35:04.380 that again was nothing but a pile of steaming manure. We have a ruling from the federal court
00:35:12.200 of Canada that says the invocation of the Emergencies Act was in fact illegal. The government
00:35:18.320 says they are going to be appealing that. We haven't even heard if the appeals court is going
00:35:24.340 to hear it. First of all, I understand that even if you're the government, you still have to have
00:35:29.360 some kind of new piece of evidence or another way of looking at this case before they'll even
00:35:34.300 grant an appeal and then if they lose that appeal it's possible they could go to the supreme court
00:35:39.780 of canada and all of this could take a year in the meantime we have an illegal ruling which means
00:35:46.220 it should be treated as such especially in court cases that involve it so can you can you take us
00:35:54.900 back to what you were talking about with mocha earlier today because you you went back and forth
00:36:02.040 a lot so that's why i had to go back and listen to it a couple of times so if we can do it in
00:36:06.640 sequence that would be cool yeah so what i became aware of today and um i'm gonna be careful but i'm
00:36:15.780 not gonna restrict i'm not gonna i'm gonna make sure that it becomes very clear i want people to
00:36:22.040 be able to follow what i'm saying and i know that my video my interview with mocha um it was longer
00:36:29.420 but it was cut for the sake of, you know, attention span and you name it.
00:36:33.600 But it definitely lays it out.
00:36:35.820 I do go back and forth a few times.
00:36:37.360 But since looking at it, I'm able to expand and clarify on some of this.
00:36:43.520 And seeing as we have a bit more time, I'm also going to do that.
00:36:47.540 Today I became aware of evidence, and I'm not going to use names.
00:36:55.160 It's not relevant at this point.
00:36:56.400 But I became aware of evidence or testimony of RCMP officers or members of the RCMP, and it's not about them, but it's about what the evidence is.
00:37:11.740 And the evidence is that the RCMP had no visual, factual, or sorry, visual, physical, and factual proof of weapons slash or firearms at the Coutts blockade until they executed, until the ERT, Emergency Response Team, executed warrants.
00:37:41.740 So when they actually executed their search warrants, that is when they had physical proof of their being legal.
00:37:52.120 But, you know, Ottawa termed it as weapons, but legal firearms.
00:37:56.320 That is when they were able to claim and to prove to the public, and not that they need to prove it, but to then follow through with their charges and their arrests that, yes, there were guns at Coutts.
00:38:15.960 And I'm not going to go into that.
00:38:17.580 This was not necessarily at the blockade in its proximity, but I won't specify that either.
00:38:22.460 That's not what we're discussing here today.
00:38:24.420 This was not proven until, I don't have the exact time, but between 1230 and 1 o'clock a.m. on February the 14th, Mount Standard Time.
00:38:43.260 So at 12.30 in the morning, somewhere between 12.30 and 1.30, they executed the search warrant at the location where these firearms were found.
00:38:56.900 At that time, they would have had physical proof, evidence of firearms.
00:39:04.400 okay so now that we've established that from there on okay they have their proof they have
00:39:09.900 their evidence they go through documentation bagging tagging you name it and here we are
00:39:14.640 738 days later but what happened
00:39:20.300 a day and even a more than a day before that on the other side of the country in ottawa was
00:39:29.660 What was happening was the sequence of events that led toward the invocation of the Emergencies Act and the steps that had to be taken by those involved leading up to the 1.41 p.m. Eastern Standard Time announcement, press announcement by Justin Trudeau.
00:39:54.420 You know, the infamous, it will be infamous, it is infamous, announcement by Justin Trudeau, flanked by his masked warriors, sorry, not relevant, but at 1.41 p.m. Eastern Standard Time, where the public became aware that this government, this prime minister had invoked the Emergencies Act.
00:40:21.400 so 1 41 eastern standard time is 11 41 um mountain standard time we're two hours behind
00:40:34.220 ottawa right and that that that you know real time here is two hours ahead there or
00:40:39.160 two hours behind if you're in ottawa that's what i got you okay i just want to establish these
00:40:43.780 details so the time that the rcmp first had or had their physical evidence when they executed
00:40:56.580 these warrants it would have been from midnight to 1 1 30 on the 14th mountain standard time
00:41:05.880 that that would have been um 12 hours or 11 hours before the invocation of the emergencies act
00:41:16.240 correct correct no no no it would have been um 11 41 mountain standard time february 14th
00:41:27.160 1.41 Eastern, 1.41 Eastern, 1.41 Mountain, right?
00:41:34.440 Correct.
00:41:35.540 And all of these times are absolutely important.
00:41:38.820 So they found or they executed their search warrant between midnight and 1.30 Mountain Standard Time, and they found the guns.
00:41:47.800 Correct.
00:41:48.080 So they would have had that proof 11 hours before the public announcement, before the press conference.
00:41:53.900 But that is hardly relevant anymore. That's just me. That's just extra information that we're all aware of. What has since become public information through the public inquiry, which is automatically triggered when you invoke, it's built into the legislation of the Emergencies Act is that you have to have a public inquiry.
00:42:12.660 And that public inquiry has to be tabled in Parliament 300 and almost a little less than two years after the invocation of the Act.
00:42:23.880 I think it was, they would have had to table it February 20th, 2023, and they tabled it February 17th, 2023.
00:42:31.220 Also not necessarily critical information, but it's there.
00:42:34.440 What's really critical is the evidence and the testimony that was made by officials, cabinet ministers, bureaucrats in Ottawa in the lead up to the invocation of the Act and the actual invocation of the Act and what was all done, what steps were all taken in that process.
00:43:03.840 And I'm going to start it in, I'm going to start on February the 13th in Ottawa.
00:43:13.780 And it doesn't necessarily specify the time here, but through this event, it does at certain times.
00:43:23.100 But there is a phone call.
00:43:27.580 Oh, sorry, I got to get the right thing here.
00:43:29.240 There is a phone call by past, so previous Commissioner Brenda Luckey, to previous, these people have all been removed and demoted, which tells you something as well, previous Emergency Management Minister Marco Medicino.
00:43:52.740 And the purpose of this call, sorry, I want to get word for word here.
00:44:00.000 I'm just scrolling up.
00:44:00.680 There's a lot of documents here.
00:44:02.080 The purpose of this call was, oh, here we go,
00:44:09.320 or was Commissioner Brenda Luckey updating Marco Medicino on the situation in Coutts?
00:44:20.200 incident response
00:44:22.440 and just bear with me one second
00:44:23.960 okay
00:44:24.440 and the update
00:44:30.440 was that
00:44:31.820 was so serious
00:44:33.240 that Marco
00:44:35.940 Medicino immediately
00:44:37.480 Brenner Lucky mentioned that
00:44:40.120 this was highly confidential
00:44:41.360 due to them having
00:44:43.880 undercovers in the field
00:44:47.060 in operation in coots
00:44:48.920 which, understandably, that's sensitive information.
00:44:52.420 But he did instruct her that he was going to have to inform the Prime Minister of this information, this critical information.
00:45:00.760 And I'm not the legal expert on this, but interestingly enough,
00:45:08.580 the ITOs that were submitted for judicial authorization by officers in Coutts to then...
00:45:17.520 What's an ITO?
00:45:18.920 information to obtain okay that's that's the explanation that acronym that's all the information
00:45:24.880 to then present to a judge who will then authorize a search warrant you can't like you can't just
00:45:31.980 break the door down there is there is process to this they have to get authorization from a judge
00:45:36.180 to be able to get a search warrant so in these itos the last piece the last request in in this
00:45:44.360 ITO that was brought before a judge on February the 13th in Alberta in relation to COOTS was that
00:45:53.880 there be a full publication ban on everything in relation to the search warrants, the ITO,
00:46:02.620 and anything that came out of the search warrants. So Brenda Luckey, being RCMP, might have been 0.97
00:46:12.260 privy to this without breaking a publication ban but i believe that by by her informing
00:46:19.100 marco medicino of this information in relation to these itos and these these search warrants that
00:46:25.680 had not been executed yet i don't even think i don't believe the search warrant had even been
00:46:30.040 authorized yet would have been a breach of a request of a publication ban it's the minor
00:46:38.060 issue here but it is definitely something that i feel is is relevant anyways the um
00:46:48.860 information here we go okay brenda lucky called minister medicino to update him on the situation
00:46:58.140 in coots this is on february the 13th it doesn't necessarily specify the time but
00:47:01.820 the next chain of events does specify time so you can work your way back and know that this was
00:47:06.780 in the morning or early afternoon at the earliest on the 13th,
00:47:10.300 which would have definitely been still in the morning of the 13th here in Alberta.
00:47:16.140 The call was private because the RCMP, and this is all public information,
00:47:19.920 the call was private because the RCMP had undercover personal deployed in the field
00:47:23.260 and they were concerned about it informationally.
00:47:25.800 Commissioner Luckey told Minister Medicino that Coutts involved, quote,
00:47:29.440 a hardened cell of individuals armed with firearms.
00:47:34.300 Did you hear what I just said?
00:47:35.720 hardened cell of individuals armed with firearms how would they know any of that
00:47:40.220 how do they know there was firearms when we're still hours away from arrest warrants being
00:47:49.020 executed in alberta and then having both visual physical and factual evidence so at this point
00:47:55.240 it's nothing but rumor speculation suspicion you name it that is what is happening on the ground
00:48:02.500 here in alberta in coots there is speculation suspicion talk but there's no proof there's no
00:48:10.760 evidence yet so how can a liberal cabinet minister quote and use and say that
00:48:19.880 there are individuals armed with firearms
00:48:22.580 that's false what about the reports of the embedded rcmp officers
00:48:29.400 and mind you they had no recordings right of the conversations they had with uh a couple of the
00:48:36.460 guys but the guys were talking but hearsay nothing but hearsay but that hearsay could have been
00:48:42.660 enough for lucky to tell mendocino who then went ahead and told trudeau it's all hearsay we don't
00:48:47.800 know for sure right which plays in terms go ahead correct but the rcmp here since and at that time
00:48:58.020 never executed search warrants in relation to the offense, to firearms offenses.
00:49:04.480 They never had the proof to be able to build an ITO to request a search warrant in relation to firearms.
00:49:11.120 It was always mischief.
00:49:12.800 All these ITOs, all the search warrants leading to the arrest and everything they found
00:49:18.920 was always in relation to mischief charges.
00:49:22.580 Other than people staying there, well, there are guns in southern Alberta.
00:49:26.080 There was no way that anybody in Canada could say for sure, especially not the RCMP or even the RCMP, that there were firearms and coups.
00:49:37.240 What do you need to get an ITO, though, for a search?
00:49:40.440 Do you need just hearsay?
00:49:42.940 Do you need some kind of...
00:49:45.320 No, you need to have some pretty clear evidence to be able to breach charter rights.
00:49:50.600 You've got to remember that search warrants and wiretaps and things like that breach Charter Section 8.
00:49:57.200 We have rights.
00:49:59.180 They can't just break your door down.
00:50:01.520 They have to have reason.
00:50:02.860 They have to either have something on social media or something that they have proof of.
00:50:09.060 So you're suggesting then that this ITO was gained illegally and the judge granted it illegally?
00:50:15.700 No, this ITO is in relation to the charge of mischief.
00:50:22.240 Well, there was a blockade that could be deemed as mischief.
00:50:24.500 So they went in on a mischief.
00:50:29.240 They went in to look for evidence in relation to a mischief offense,
00:50:33.740 not a firearms offense, even though there was talk of firearms.
00:50:38.300 Well, there was talk about firearms in Ottawa too, wasn't there?
00:50:40.840 Wasn't there a truck stolen?
00:50:43.080 Wasn't there? I imagine this was a concern for all police services around the country at that time.
00:50:48.180 The worst case scenario was that there were firearms in place.
00:50:51.200 But until there's proof of that, how can you use information that isn't factual to implement the highest legislation in the country?
00:51:01.000 Right. How can you use something that isn't factual?
00:51:03.280 And then the fact that they did that, they testified about it in November, at the end of November of 2022.
00:51:11.200 suit and that testimony they were still using that as factual and that and that ruling still
00:51:17.360 stands that there was firearm coots on february the 13th well proof of that wasn't confirmed
00:51:27.060 till february the 14th right now people say oh yeah well what i'm saying is that ottawa
00:51:34.720 used false information this isn't about what happened in coots this is about what ottawa
00:51:40.400 and those involved in enforcement across the country
00:51:44.060 from Alberta to Coutts or to Ottawa
00:51:46.360 used to justify not only what we now know
00:51:51.400 as an illegal, unconstitutional invocation of the Act.
00:51:57.600 Right?
00:51:58.260 So, you're talking about appeal.
00:52:01.720 They want to appeal this decision.
00:52:03.560 You want to talk about they want to appeal the Mosley decision.
00:52:07.320 But the Mosley decision still took into account
00:52:10.340 the information under the POEC as factual.
00:52:14.560 Well, it's not true.
00:52:16.280 This information right here is not factual.
00:52:19.400 On February the 13th,
00:52:21.140 there was no firearms in Coutts.
00:52:24.000 How could they take the information
00:52:25.760 from that commission as factual?
00:52:28.240 Because that was not a court of law. 0.97
00:52:30.100 That's ridiculous.
00:52:32.020 Well, but it was a public, well, I mean... 0.84
00:52:34.700 Public order commission, not a court of law.
00:52:38.540 Yeah, and I don't know,
00:52:39.280 I don't know how Justice Mosley and such took that information, but they still, I believe the POEC was considered and the testimony of the POEC was taken into account.
00:52:54.660 because i testified and you did swear an oath to testify uh according to uh well to to affirm or to
00:53:03.780 to swear um on the bible what you're on the bible that what you're like what you're testifying is
00:53:10.720 truthful and i'm not saying that it was either dude i mean like i gotta stop you here and say
00:53:17.080 look at justin trudeau said he never lied to canadians about the vaccine during that commission
00:53:21.920 so i mean there i'm sure there were lies flying all over the place therefore when you talk about
00:53:28.780 lies flying all over the place in this public order emergency commission you can't take any
00:53:33.140 of that stuff seriously and use it to get we are they are taking it seriously and right credibility
00:53:38.820 of this government like good me we know there's no credibility we like if anything we know this
00:53:45.260 government shouldn't even be here but there are still uh canadians that believe there is and
00:53:51.000 apparently there hasn't been a scandal big enough yet to to take down this government well the way
00:53:56.920 i see this is this is a huge scandal this is bigger than the arrive cam issue this is members
00:54:06.180 of cabinet using false information and i'm not saying that justin trudeau used what he was 0.95
00:54:11.580 informed on but i'm sorry in this case shit runs uphill if it this is justin trudeau's
00:54:17.940 responsibility to make sure that he has the right people in the right position to make sure that the 0.91
00:54:21.880 information he gets is factual especially when it comes to to undermining the constitutional
00:54:27.840 rights of canadians they're using they're using fake guns non-existent weapons at a time
00:54:35.720 based on the timeline people say oh well six hours later they did find them that doesn't matter
00:54:40.340 when we go back like this this this inquiry was going back in time to establish if the
00:54:47.220 justification was was real it wasn't they used coots they used the volatile quote volatile
00:54:54.360 situation in coots as a catalyst as not the only not exclusively but as one of the main catalysts
00:55:02.520 to implement the emergencies act and if i work my if i work my way through this here so then you
00:55:08.000 know marco medicino now hears about the hardened cell armed to the teeth with firearms who will go
00:55:13.600 down for the cause. What cause? Well, that's not relevant at this point, but a cause.
00:55:18.760 Minister Minocino testified that this was most serious, and this was the most serious and urgent
00:55:24.140 moment in the blockade so far. Okay, that says something. Minister of Emergency Management saying
00:55:30.100 this is the most critical moment in the blockades and protests so far. He told Commissioner Lucky
00:55:36.700 that he could not keep the information entirely to himself. He had to at least inform the Prime
00:55:41.500 Minister. How he did that was
00:55:45.760 by reaching out to Katie Telford, Chief of Staff, to the Prime Minister. I had said
00:55:49.520 Secretary initially in my interview, Chief of Staff. So he reached out
00:55:53.600 to the Chief of Staff for the Prime Minister, who would have immediately
00:55:57.340 updated the Prime Minister. This is where we get a timestamp
00:56:01.680 after the Prime Minister becomes aware of this hardened cell
00:56:05.600 of individuals with guns that are not
00:56:09.340 real at this point they're they're not real nobody in in in coots nobody in the rcmp
00:56:16.880 has physically laid hands or eyes on any kind of firearms and i'm not going to say weapons anyways
00:56:25.780 wait a minute when when this is this is the day before he declared the emergency act
00:56:32.360 Correct. This is the 13th. This is the 13th of February 2022. And here's a timestamp. So the IRG, the incident group, sorry, the incident response group, this was a group set up of senior officials, cabinet ministers, etc. I think on February the 7th in relation to all the protests across the country.
00:56:53.000 This was kind of the group set up to deal with the national crisis that in some way maybe we were experiencing as a result of the Trudeau leadership.
00:57:04.220 Anyways, they may disagree with me on my explanation of that.
00:57:07.320 But there was an incident response group.
00:57:11.440 That group convened on February 13th at 4 p.m., right?
00:57:17.460 So this is 2 p.m. on February 13th.
00:57:19.640 So this is a Sunday at 2 p.m. in the afternoon.
00:57:21.440 I believe it was beautiful weather, and it was a calm, calm Sunday in Coutts, Alberta.
00:57:29.160 Nothing happening.
00:57:30.080 Sun was shining.
00:57:31.040 It was February the 13th at 2 p.m.
00:57:34.760 Families are doing their thing, and there's nothing happening.
00:57:38.420 Not a, yeah, there's nothing happening in Coutts, Alberta anyways.
00:57:43.180 What happens here, and it says a good portion of the meeting minutes are redacted for reasons of cabinet confidence.
00:57:51.820 Well, that's great.
00:57:53.160 But what comes out of this meeting is what we know now due to the inquiry.
00:58:02.300 One second here.
00:58:03.400 is a
00:58:06.660 is a
00:58:07.900 unanimous
00:58:08.520 consensus
00:58:09.140 that
00:58:11.940 the EMA
00:58:14.840 needed to
00:58:15.360 be invoked
00:58:16.300 Department of
00:58:20.040 Finance
00:58:20.640 the long
00:58:22.900 long
00:58:23.280 meeting
00:58:23.860 so this is
00:58:24.560 a big huge
00:58:25.320 cabinet meeting
00:58:26.100 where they all
00:58:26.860 go yep
00:58:27.500 yep yep
00:58:28.320 we've got to
00:58:28.760 invoke the
00:58:29.180 emergency
00:58:29.560 exactly
00:58:29.920 yes
00:58:30.160 exactly
00:58:30.920 yeah they
00:58:31.480 talk about
00:58:31.820 Ottawa
00:58:32.060 they talk
00:58:32.380 about this
00:58:32.720 but
00:58:33.380 They went in, it was triggered, and they probably met every day
00:58:36.800 or maybe even multiple times a day.
00:58:39.020 But it says in the evidence here, by the end of February the 13th,
00:58:46.160 but by the end of the IRG meeting on February the 13th,
00:58:49.940 there was consensus around the table that the Emergencies Act was necessary.
00:58:54.840 So this is still February the 13th.
00:58:56.660 So this is still not the 14th.
00:58:59.300 So it's still not the 14th in COOTS either, right?
00:59:03.380 So I'm not going to go into too much detail what was all said, but the conclusion coming out of the meeting was that the prime minister should call a meeting of the full cabinet to discuss the possibility, even though, and then that meeting was called for 8.30 p.m. that evening.
00:59:17.780 So we're still in the 13th of February.
00:59:21.320 And this is the next step.
00:59:24.160 even though he didn't need to get cabinet approval,
00:59:30.740 this is a decision he could make.
00:59:32.380 I do believe that for the sake of whatever the reasons are,
00:59:37.040 he wanted to have consent of his cabinet, right?
00:59:40.240 The people around him.
00:59:41.540 So he got that.
00:59:43.840 And that cabinet meeting ended.
00:59:48.180 and then the next step uh that they took um was a setting up a first ministers meeting but that
01:00:01.620 didn't happen until the 14th in the morning so it would have been the premiers right first
01:00:06.080 ministers all the premiers that's a requirement they have to do that they have to alert all of
01:00:10.380 the premiers they're going to be invoking the emergency act it's not about getting their
01:00:13.660 permission they have to let them know right yeah yeah anyways that's not that's not relevant to
01:00:18.560 this anymore what i've now late what i've now explained is that the decision to invoke the
01:00:25.980 emergencies act on february the 13th in ottawa was made with information that has just been
01:00:34.680 that that that has now been debunked as false recently debunked as false due to information
01:00:44.300 that has been sworn to that claims otherwise by incident command officers on the ground in coups
01:00:52.860 so who who gave uh these individuals these these cabinet ministers um the wrong information
01:01:03.960 well that's something that could be looked into and could be you know figured out but i believe
01:01:09.760 that the the desire to have this information as factual as possible would have been greater in
01:01:16.900 ottawa than in coots in relation to the guns being real right i think that ottawa would want these
01:01:23.500 guns to be real more than anybody in coots you know enforcement etc they had to deal with the
01:01:33.620 fact that they could be real but it's not like they wanted there to be guns but i believe this
01:01:39.020 point a simple conversation between officials at some point even potentially between brenda lucky
01:01:47.840 they're testifying to their comments there's not notes on their comments at that time
01:01:52.240 and at that and what they're testifying to is that there were guns so is this the belief that
01:01:57.480 they had or is this what they or did they feel that well wait a minute wait a minute hold on
01:02:03.580 Their testimony is based upon hearsay because they had no actual evidence of what they were talking about.
01:02:09.980 Just a lot of speculation.
01:02:12.380 Yeah.
01:02:12.700 Their testimony is based on hearsay at this point.
01:02:14.720 Unless they have some kind of notes or some kind of emails that prove otherwise.
01:02:20.140 I wouldn't put it past them to make something up and then reverse timestamp it.
01:02:26.360 Because we see all kinds of crazy things happen.
01:02:28.740 and they're probably gambling to some degree at that point that what they're making up may
01:02:34.780 or will become true based on what they are hearing they are hearing that there's a good
01:02:39.400 chance that there are guns and coots so they're gambling with this but the time stamp is is what's
01:02:45.640 what's that what's what we're discussing here we are now seeing a government gambling
01:02:51.700 or using information on the speculation that this information in the very near future becomes
01:02:59.220 factual information to utilize as justification for the invocation of the highest authority any
01:03:08.140 government in this country has like i am sorry that that's a constitutional crisis to some degree
01:03:13.880 that there's a government willing to take away rights of Canadians
01:03:19.240 on hearsay, on something that isn't proven,
01:03:23.360 on something that isn't real?
01:03:26.540 Well, no, you've lost me a little bit
01:03:28.740 because they invoked the Emergencies Act at 1.41 p.m. Eastern time.
01:03:34.760 They announced it.
01:03:36.760 Okay, so that's when the announcement happened.
01:03:39.060 Do we know when the actual invocation came?
01:03:41.600 Because that's key.
01:03:43.880 The conclusion coming out of the IRG meeting, this is testified, was that the Prime Minister, oh sorry, by the end of the February 13th IRG meeting, there was consensus around the table that the Emergencies Act was necessary.
01:04:00.140 Prime Minister Trudeau noted that although consensus was not necessary, it was significant.
01:04:04.180 um and here's quote i would have said thank you i would have taken that into account but i didn't
01:04:12.040 need uh i didn't need full consent consensus in order to make the determination
01:04:18.460 and in this case there was consensus around the table that invoking the emergencies act
01:04:24.440 was what we needed to do what happened after that was just the steps which took some time
01:04:30.040 you know this being now 8 30 p.m it would have i believe by the next morning 8 30 there's the
01:04:38.920 first minister's meeting the decision's made he's announcing it the public isn't aware of it yet he's
01:04:44.000 now taking the steps to announce it to the premiers to announce it to the the caucus right
01:04:48.860 the liberal caucus was made aware but the decision's been made right do we have notes to that
01:04:55.120 effect do we have proof to that effect that's where this is going to be key right because the
01:04:59.480 announcement and and this is very good point that you make just just now marco when you said that
01:05:04.460 he made the announcement at 1 41 p.m eastern time on february the 14th he had already decided that
01:05:11.460 he was going to invoke this the day before the day before they found the or hours before they
01:05:16.440 found the gun stash correct correct yeah so i'm just looking for that right here so what we need
01:05:24.100 now is is the smoking gun if you'll pardon the expression and this is a report this is a write-up
01:05:34.000 on on everything there is all the evidence you know this is a public inquiry there's a there's
01:05:39.720 a there's a pile of evidence this evidence is here so to bring the receipts you know to say
01:05:47.740 prove it well based on this in in in a different part of this you know there will be proof
01:05:55.340 written testimony um actual time stamps layouts of what happened because before the first minister's
01:06:05.160 meeting before the caucus meeting before the cabinet meeting the decision was made
01:06:10.280 to invoke the Emergencies Act.
01:06:13.980 Now, somebody will argue, well, it's not official until there's some sort of document signed.
01:06:22.000 Okay, I'm pretty sure there is a document in here.
01:06:25.500 There is evidence submitted that will stay at a time in relation to some hard copy, fancy document
01:06:33.660 that justin trudeau had to sign and some some some commissioner of some sorts had to sign as
01:06:40.060 witness that then put this country uh into a emergency even though nobody knew about it
01:06:48.540 right even though nobody knew about so that there would be the actual
01:06:54.520 final time stamp but leading up to the decision the information that we're seeing here
01:07:02.680 The information that they're using to lead up to this decision and the information they're using to make their decision, right?
01:07:08.420 He still made a decision mentally, is false information.
01:07:14.560 They used false information based on the timestamps that we have in relation to the information,
01:07:19.280 the phone call from Brendan Lockheed to Marco Medicino and the arrest in Coots and the evidence in Coots.
01:07:25.600 They're using false information.
01:07:27.020 okay so let me ask you this then would the rcmp have used the emergencies act to gain
01:07:33.840 the warrant to search for the guns okay and this is where i'm going to bring and this wasn't
01:07:39.520 possible earlier this afternoon so you're trying to now determine you know where did this happen
01:07:46.180 who was willing to push something that wasn't quite proven yet correct well we knew brenda
01:07:51.540 lucky knew that he that trudeau was going to invoke the thing and brenda lucky could have
01:07:55.380 told her guys in coots she might not have lied she might not have lied but she may be responsible
01:08:00.960 for somebody who who did provide false information but because you know she's the commission she was
01:08:07.380 the commissioner at that time she's kind of the boss right she's kind of the most you know my guy
01:08:11.640 hey you're a truck well he works for me i'm gonna have to pay that's the way it works well here is
01:08:16.920 something that speaks to what the direction in ottawa was in relation to coots and in relation
01:08:23.640 to what they were looking for it might take me a little bit i've said this before and i'm not sure
01:08:29.300 if i've said it on this show um okay here it is here this is quote this is quote this is this is
01:08:38.340 a transcript of a conversation or this is a transcript of comments made by a investigator
01:08:46.000 our cmp investigator that was involved in the coots blockade and that was definitely involved
01:08:51.240 in the bronze level.
01:08:54.700 So bronze would have been command, ground team, all of that.
01:08:58.160 The ground level side of things in relation to Alberta and the Coutts blockade.
01:09:04.580 This is the transcript.
01:09:06.300 So his comments are transcribed.
01:09:08.760 Quote, there was some political pressure from the federal government at some level.
01:09:14.220 And whether it was an actual conversation that say they were directed, I can't say that.
01:09:20.340 but I mean there was a lot of pressure because let's face it they had this thing going on in
01:09:25.780 Ottawa at the same time and they needed tools to be able to shut that down so there was a
01:09:32.280 poet there was pressure from Ottawa to give them the tools but what would you think is in in this
01:09:40.900 whole conversation what do you feel is the description of them using the word tool to me
01:09:47.240 that would be evidence or information that is so serious in nature that it gives them reason
01:09:53.180 or justification to implement the emergencies that so these guns and the story around the guns
01:10:00.900 and the hardened cell of individuals and the volatility of the coups blockade i was there i
01:10:05.720 survived it's a miracle i survived you know based on this testimony of of our leaders it's a miracle
01:10:11.900 we all survived um but i mean they were aware that ottawa was was looking for tools they wanted
01:10:22.560 tools ottawa what was happening in ottawa was embarrassing for ottawa they didn't give a rat's 0.92
01:10:28.060 ass about coots that was kenny's problem they probably had a good chuckle about it but it was 0.97
01:10:32.120 serious enough right it's an international border the americans weren't happy about it they're pissed
01:10:36.800 off but in comparison to the ambassador bridge or emerson or sorry the ambassador bridge or
01:10:42.520 windsor or ottawa or emerson for that matter emerson's number four crossing in the entire
01:10:47.480 country coots is kind of a relatively small one compared to all of the others you just mentioned
01:10:52.140 exactly it's 10 million dollars less or there's there's 10 million dollars less of goods that
01:10:59.320 flow between through coots than emerson but it's a big one for alberta it's a big one for the west
01:11:04.520 and it's still a national POE port of entry but it was a problem for Kenny and the and the and
01:11:12.820 Ottawa but if there was an order it would be number three or four on the list but based on
01:11:18.180 its length volatility and things like that it became number one at times and at this time it
01:11:25.560 was definitely number one because it gave them reason to be able to effectively deal with Ottawa
01:11:31.400 because we know that's what happened the authority given to the government under the ema was not used
01:11:37.600 in coots none of it none of it there was nothing bank accounts weren't seized nothing like that
01:11:42.940 there was no extra officers we agreed to on the morning of the 14th to lift the blockade and to
01:11:48.860 be completely gone uh by the morning of the 15th and inhabit that it looked like we were never there
01:11:57.480 other than an oil stain on the highway.
01:12:00.480 But Ottawa, later that week on the 16th or 17th, no, 18th,
01:12:05.560 they definitely used the powers given to them under the Act
01:12:09.200 to stomp, literally, on the constitutional rights of Canadians.
01:12:14.660 So we knew this for a while, that Coutts was the catalyst,
01:12:19.760 a main cause or a main reason on the implementation of the Act.
01:12:23.340 But now we're seeing and we're hearing that the reasons and the evidence that the liberal government used to sell to themselves and to others to validate the act was false.
01:12:47.260 At that point in time, at that time, that was false information.
01:12:52.000 So we've already now, two years later, yes, the Rulo Commission justified it, which no surprise there, Commissioner Rulo said it wasn't a clear, there wasn't clear reasons, but it was definitely clear enough that it was justified and I won't, I don't have his comments in front of me.
01:13:12.960 Is there any way, Marco, that we can use this information in the upcoming, well, the current pre-trial and the possible trials that are going to be in June? Would this information help all four of the Coutts guys?
01:13:30.200 I don't believe so.
01:13:31.300 I don't believe that because what happened in Coutts happened.
01:13:36.700 And that will, like I said, I'm not going to speak to some of that,
01:13:39.920 but that's coming out in the wash through pretrial, through trial.
01:13:43.280 It didn't happen the way the Crown and the media and the government said it happened.
01:13:50.580 That's become quite apparent three weeks ago.
01:13:54.040 We've seen a conspiracy charge, a mischief charge, and a uttering threats charge dropped, completely dropped. All the charges on the initial indictment for Chris Lysak were dropped, and he pled guilty to the improper storage of a restricted firearms charge.
01:14:12.420 he pled guilty to a mistake a mistake that if he would have made outside of coots would have never
01:14:21.220 had him spend one day in jail it would have been a fine it would have been a license suspension on
01:14:27.500 on restricted or even non-restrict or non-restrict or restricted and non-restricted firearms but it
01:14:32.200 never landed him in jail but he was he what he did do he spent 723 days in in remand on charges
01:14:41.360 that were fabricated and bogus.
01:14:43.660 So is there something that will come at us?
01:14:46.220 I believe that the Crown, through this,
01:14:50.640 and in consultation, I believe that this is a conspiracy.
01:14:55.440 This is a scandal of its own.
01:14:57.480 But I believe that Ottawa, the DOJ, Department of Justice,
01:15:01.700 Crown Attorneys in Alberta, the RCMP in Alberta,
01:15:04.440 And others conspired to, not to create, you know, not to fabricate the guns, but they conspired around slightly factual information and built on that with the tallest tail that Canadians would never question, or, you know, for long periods of time, never questioned.
01:15:32.040 because that's serious like wow these people were crazy they're looking you know this was such a big
01:15:37.160 charge and such a big narrative that there's no way they made this up they would never dare do
01:15:43.160 that that's what we all thought i thought it too i thought holy moly now is there some truth to it
01:15:49.900 yes maybe five or ten percent and they built off of that and we now see that falling apart
01:15:55.640 So now the truth that they used to justify everything they've done in Ottawa is falling apart.
01:16:06.160 So what they did in Ottawa is not only unconstitutional based on the Mosley ruling, but we're talking scandal.
01:16:18.800 We're talking criminal.
01:16:20.420 criminal so this is bigger you know this could eventually vindicate even these these guilty
01:16:29.480 police and completely you know destroy any kind of prosecution that is still ongoing in relation
01:16:37.780 to these coups for but this this should also make its way back to ottawa to become a full-blown
01:16:43.440 investigation an actual investigation into you mean a public investigation as opposed to
01:16:50.280 the liberals investigating themselves independent and independent investigation with this new
01:16:56.120 information that has come to light light over the last 738 days that proves that the information
01:17:03.220 that was testified to a year or 14 15 months ago is now false well you know i know there's at least
01:17:10.860 one guy in this country who would like to get his hands on this information so he can use it as
01:17:15.820 another way to attack Justin Trudeau. Have you contacted Pierre Polyev's office at all and let
01:17:22.440 him know about this? I have not. I have not. But there's still a lot of things being uncovered
01:17:28.500 every day. And, you know, some people say, oh, Mark, you need to get this out there. And, you
01:17:34.260 know, I'm in contact with a lot of people and I have a lot of contacts, but not that I'm looking
01:17:39.800 to protect us or anything.
01:17:41.040 This is public.
01:17:41.800 This is out there.
01:17:42.640 Who knows how many views
01:17:44.800 Mocha's tweet has by the morning?
01:17:48.280 150,000?
01:17:49.360 200,000?
01:17:50.080 Like this thing is going viral.
01:17:51.880 I believe 100%
01:17:53.760 that my simple explanation,
01:17:57.020 you know, it's a narrative.
01:17:58.980 It is a narrative based on
01:18:01.320 factual information
01:18:03.620 and that can be proven.
01:18:05.960 Here's something else for you to consider.
01:18:07.700 I've recently become aware of certain efforts by a group of conservative affiliated people in this country to quash any kind of grassroots movement or movements that happened in the last three years based upon the fact that provincial governments, including conservative ones, were complicit, as is the Alberta government,
01:18:31.060 in hiding certain information
01:18:34.800 and perpetuating other information
01:18:37.060 that was untrue to the left-wing corporate media.
01:18:41.440 So, you know, having thought about this
01:18:43.660 for a few more seconds after my initial suggestion
01:18:46.200 regarding getting it out to Pierre Polyev,
01:18:48.760 I don't think that...
01:18:49.420 They want to uncover this.
01:18:50.540 They don't.
01:18:51.520 Because...
01:18:52.980 There is no political party in this country
01:18:55.480 that wants to uncover this.
01:18:57.200 I think we're on our own here.
01:18:58.300 Well, this would possibly undermine any remaining, or this would undermine any remaining trust that there is in government period. And, you know, CPC, Liberals, they're all government. They're sitting, you know, they're complicit.
01:19:16.240 How was Pierre Poiliev privy to some of this?
01:19:19.980 Did he support some of this?
01:19:21.660 Yes, he was on the streets of Ottawa.
01:19:24.100 Yes, he was on Wellington Street and supported the truckers.
01:19:26.700 But they've turned their blind eye to a lot of corruption as well.
01:19:33.600 They're involved in, you know, I don't follow it too much federally, but even provincially here.
01:19:41.100 I was very involved in the Daniel Smith
01:19:43.820 campaign
01:19:45.100 and I know a lot of people in this government
01:19:47.740 still do and they're all
01:19:49.560 sympathetic and you know I resign as councillor
01:19:51.680 and I'm facing pre-trial Monday
01:19:53.500 Monday is the beginning of my
01:19:55.560 prosecution and I'm facing
01:19:57.220 you know anywhere well
01:19:59.280 maximum 10 years I don't think I'll get but
01:20:01.120 if they convict me I might get
01:20:03.100 3, 4, 5 years who knows you know the evidence
01:20:05.500 is there to some degree
01:20:06.600 of mischief
01:20:09.600 mischief right you know we we were an inconvenience there was a blockade and
01:20:14.280 they want to make an example of us so anyways speculation at this point but people sympathize
01:20:20.960 but who you know where is the you know we've had the interim decision in alberta that that deemed
01:20:32.140 a lot of the health uh the mandates and the health orders invalid based on a technicality
01:20:39.280 They've since legislated that if this were to happen again, it would be up to the politicians to make the final say.
01:20:47.520 But at that time, it was actually up to the CMOH, Chief Medical Health Office, CMHO.
01:20:55.800 We have a question from Carol who's watching right now, Marco.
01:21:00.080 It says, why hasn't the Crown Prosecutor excused himself from this case yet?
01:21:04.560 I think I know the answer to this, but I'm curious to hear what you think.
01:21:07.280 well there um why hasn't he yeah based on what information is i feel that there is there are
01:21:16.480 conflicts and i think there's conflicts being exposed he has recused himself at times there
01:21:22.120 was an application where he had to excuse himself and when i say the the crown prosecutor i mean
01:21:27.880 specifically stephen johnson special prosecutor special prosecution stephen johnson um but but
01:21:36.420 he's still currently on the file
01:21:38.300 and I'm not sure
01:21:40.460 if he is currently in conflict
01:21:42.140 he might be
01:21:43.400 he was involved
01:21:45.360 in
01:21:47.660 the incident response
01:21:50.500 no sorry the command triangle
01:21:52.480 as a 0.66
01:21:53.140 he was the crown
01:21:58.040 that was retained by the RCMP
01:22:00.760 or retained
01:22:02.340 that worked with the RCMP to
01:22:04.320 advise them in relation to their operations
01:22:06.400 that's pretty normal. Crown prosecutors advise
01:22:08.800 the RCMP to make sure they don't
01:22:10.700 break the law either.
01:22:13.280 But all those conversations
01:22:15.000 are
01:22:16.600 client-solicitor privilege,
01:22:18.820 which is such 1.00
01:22:20.520 bullshit. 0.99
01:22:22.460 Why is there client-solicitor 1.00
01:22:25.220 privilege between
01:22:26.280 Crown prosecutors and the RCMP?
01:22:30.040 That should be
01:22:30.680 like the way the RCMP behaves
01:22:33.000 should be on full display.
01:22:36.400 Like, and there could be sealing orders to make sure that the way they behave and such doesn't become public until a court hears this or uses this.
01:22:45.940 But for this to never become public, why would the conversation between the Crown and the RCMP never be available to the public?
01:22:53.140 So now we're talking about the contents of that envelope still.
01:22:56.180 That too, yeah, that application is one of those.
01:22:58.620 And that is something that I hope is getting challenged in the near future.
01:23:01.940 There is, in this case, there is Marxist Corporate Media, thankfully has some integrity left, but I have connections there, and they are actually very interested in this application.
01:23:14.080 And the fact that this was, what this was, and I'll quickly run through this, there was a witness on the stand in previous pretrial applications who was testifying on information relevant to their role.
01:23:33.900 and the defense realized that they never had the background information
01:23:42.320 that the testimony was alluding to.
01:23:46.540 Marco, I've got to break away here for a couple of minutes.
01:23:49.440 We're going to go to the all-access membership on my website.
01:23:53.740 You cool with hanging out for a couple of minutes and coming right back?
01:23:55.680 Absolutely, absolutely.
01:23:56.720 Okay, man.
01:23:57.720 Do what you need to do.
01:23:58.740 You've got two minutes to do it.
01:23:59.780 We'll be right back.
01:24:01.040 And you guys, if you're all Access members at ShadowDavis.com, you'll be able to continue following the conversation I'm having with Marco Van Heugenboss right now.
01:24:11.340 He's going to talk about, possibly talk about getting the contents of that envelope that's been sealed for the last while, opened somehow.
01:24:19.400 And if that does happen, this case will definitely fall apart.
01:24:24.000 So for those of you who are watching on Facebook right now or on X or on Rumble, come on over.
01:24:30.240 grab yourself an all access pass at shadow davis.com if you're not planning to do that i'll catch you
