00:05:25.720 Freedom Convoy leaders' phone records were released accidentally, Crown Lawyer says.

00:05:36.120 A Crown lawyer is pushing back on allegations he deliberately made public

00:05:42.360 a huge volume of personal cell phone data belonging to an organizer of the so-called Freedom Convoy protests

00:05:49.440 who argues his criminal charges should be dropped over what he sees as an unfair invasion of privacy.

00:05:56.700 In an affidavit filed in court this week, the pant load assistant Crown attorney, Moise Karimji,

00:06:02.480 says he was unaware of the cell phone records he asked for in the case.

00:06:06.560 Communications between convoy leaders Chris Barber and Tamara Leach

00:06:10.080 also included a trove of personal and business-related messages

00:06:15.040 from Barber's cell phone.

00:06:18.480 Those records were briefly available to the public through the court.

00:06:30.120 After realizing this, Karimji helped Barber's defense lawyer get a publication ban

00:06:34.580 and sealing order to keep the communications private, but the damage had already been done.

00:06:42.660 I was only interested in communications between Ms. Leach and Mr. Barber, the affidavit says.

00:06:48.180 I did not have any expectation that all the text messages on Chris Barber's phone would be attached to the report.

00:07:19.580 Barber's lawyer, Diane Magus, is pushing for his charges to be stayed or dropped without a guilty or not guilty finding.

00:07:25.700 She alleged the public disclosure was an abusive process that violated her client's constitutional right to privacy.

00:07:33.400 In an argument attached to the affidavit, Dallas Mack, the deputy crown attorney at the Ottawa courthouse, said Barber's abusive process motion should be dismissed.

00:07:42.640 The disclosure of the entire data trove was inadvertent, Mack said, and the records that Karimji actually sought communications between Barber and Leach were clearly relevant to the crown's case.

00:11:47.100 against a court order and in with each of those charges carries a counseling charge as well so

00:11:51.740 So six in total, the Crown Prosecutor seeking a total sentence of two to ten years in federal prison for both Tamara and I.

00:15:50.880 And the next thing I know, there was a slow roll at the Manitoba border, and then all of a sudden trucks were congregating in British Columbia and Alberta and kaboom.

00:16:34.580 Freedom Corp and she was asked to remove herself and said after the political run you can come back

00:16:40.140 it's free game um and in that time she decided to tear into Tamara publicly online and it got

00:16:46.260 really nasty um Tamara was obviously arrested and jailed and there was accusations of Tamara

00:16:51.000 being involved with the reason she was arrested um Tamara's to this day not really happy about that

00:16:56.560 um and the fight just continued on from there so she she kind of pitted herself against Tamara

00:17:03.120 when it comes to funding for the GCCF and the Freedom Corp there was a rift there and she was

00:17:07.300 not asked back and she lost her funding for it of course so I wish I could have done things

00:17:12.240 different at the inquiry I gave Bridget you know the recognition that she needed at the first

00:17:18.440 beginning of my testimony and that really made her quite happy I thought we were good but she

00:17:22.340 just we just continue with the nastiness and the divisiveness and the fighting and i'm fighting back

00:19:05.680 bank account so i had i was able to see the balances too we had one million dollars in that

00:19:09.840 bank account and about four hundred thousand dollars in transfers and on the beginning part

00:19:19.920 fifteen thousand dollars and we put fuel and trucks with that money uh everything's all been
