00:08:29.060 I want to talk about relevance. From February 14th to February 23rd, 2022, the federal government
00:08:43.240 under Justin Trudeau invoked the Emergencies Act against Canadian citizens protesting federal
00:08:49.620 COVID-19 mandates in Ottawa. As required by law, the Public Order Emergency Commission
00:08:55.440 is taking place in Ottawa. It began October 13th and continues until November 25th.
00:09:02.180 I have been in attendance throughout the commission so far, and this short video is
00:09:06.980 meant to explain some of the nuances of what is happening. This video is not about who is right
00:09:13.000 or wrong. I think you know my position on that already. The freedom rights movement was peaceful
00:09:19.120 and the Emergency Act was another grotesque government overreach with a very violent outcome
00:09:26.020 against Canadians. Before I share my thoughts about how it is going so far, I'd like to share
00:09:31.940 with you what I know about the intent and the structure of the inquiry. First, under the current
00:09:38.640 legislation, after the Emergencies Act is invoked by the federal government under Section 63 of the
00:09:45.160 Act, two things must happen. Section 63.1 says there must be an inquiry into the circumstances
00:09:52.320 that led to the declaration being issued and the measures taken for dealing with the emergency.
00:09:58.980 Currently, we are participating in the inquiry phase. Second, Section 63.2 says a report of the
00:10:06.900 inquiry must be given to each House of Parliament within 360 days after the revocation of the
00:10:14.980 Emergencies Act. There are 20 separate groups of legal teams, all participating in the inquiry.
00:10:20.820 It is presided over by a judge, Justice Rouleau, and while he has similar powers to a judge,
00:10:27.280 he is acting as a commissioner in this particular inquiry. Of note, this is new legal territory.
00:10:34.660 Since its inception in 1988, the Emergencies Act has never been invoked, and therefore there has
00:10:42.700 never been an inquiry into its use. Justice Rouleau has a team of lawyers that are referred to as the
00:10:48.940 Commission lawyers who are extremely professional. Their job is to find the truth and to complete the
00:10:55.500 final report. From my perspective, I have seen nothing but professionalism and a desire to
00:11:01.660 only determine the facts. Various other groups are also participating, including the Freedom
00:11:07.420 Corps and protesters. We are represented by a brilliant team of lawyers named
00:11:12.580 Brendan Miller, Bathsheba Vandenberg, Eva Cipiuk and Keith Wilson. The Justice
00:11:19.040 Center and the Democracy Fund are also participating together as a separate
00:11:23.700 group. Now I'd like to talk about something important that Brendan, Bathsheba
00:11:28.680 and Keith had to explain to me in terms of relevance. Like many of you, I'm not a
00:11:35.080 a lawyer, so my understanding of what I'm seeing is very unsophisticated in terms of the law and
00:11:41.000 legal proceedings. Initially, as I've been listening to the testimony, my passion and enthusiasm for a
00:11:48.620 good argument and counter-argument got the better of me. I was driving the lawyers crazy. To me,
00:11:54.840 I view it like winning a debate or an argument with a friend. It's not. At various times,
00:12:01.900 these great lawyers have also refocused my attention to the issue of relevance and I hope
00:12:08.320 that I can explain it for you like they were finally forced to explain it to me here's what
00:12:13.960 they mean about relevance under the CSIS Act section 2 there are four specific conditions
00:12:20.440 that if any are met the government may invoke the Emergencies Act the four sub paragraphs are
00:12:27.100 summarized as follows. Espionage or sabotage, foreign influence, terrorism, or subversion.
00:12:34.580 Again, these are summaries of the four conditions which you can find publicly under Section 2 of
00:12:40.160 the CSIS Act. If any of these four conditions are met, the Emergencies Act can be invoked.
00:12:47.360 However, as you may have seen in Brendan Miller's opening remarks, he rightfully anticipated there
00:12:53.980 would be no evidence given that satisfies any of the four conditions the emergencies act requires
00:13:00.540 several things one it could be invoked due to espionage and sabotage are you going to hear any
00:13:08.060 evidence about espionage and sabotage the answer to that is no two it could be invoked on the basis
00:13:15.820 of clandestine or deceptive foreign influence or foreign influence that involves the threat to a
00:13:21.020 person are you going to hear evidence about that the answer that is no it also could be invoked on
00:13:27.740 the basis of threats or use of acts of serious violence against persons or property are you going
00:13:34.380 to hear evidence of violence against persons or property the answer is no lastly it can also be
00:13:41.740 invoked if there is a group or persons trying to destroy or overthrow by violence the system
00:13:50.220 of government of canada are you going to hear evidence about individuals trying to do that
00:13:57.340 the answer is no and the answer is is that there was no reasonable and probable grounds to invoke
00:14:03.180 the emergencies act and that the government exceeded their jurisdiction both constitutionally
00:14:09.420 and legislatively in doing so this was later confirmed by the ontario provincial police
00:14:15.980 intelligence chief superintendent who also verified while under oath, none of the four
00:14:22.460 conditions were ever met.

00:15:51.100 because like many i was deeply invested in the arguments that i wanted to come to light
00:15:56.860 but what i've learned is that many of my questions are not relevant to the purpose of the inquiry
00:16:02.780 nor does it support the relevance of the four conditions in the CSIS Act.

00:16:09.980 Absolutely, yes, it is.
00:16:12.780 But are my questions and personal arguments while listening to the testimony relevant?
