00:00:46.580 The United States Supreme Court voted 9-0 to overrule the Supreme Court of the state of Colorado
00:00:55.740 when they barred President Donald Trump from the ballot in that state.
00:01:01.080 Here to help me break this and other political stories down is my co-host, Troy Smith.

00:01:16.400 Mark, historic ruling today, and right off the bat, we just want to get your opinion on this.
00:01:22.960 I want you to tell America what you're thinking immediately hearing this 9-0 ruling.
00:01:27.680 Well, it is good news for Trump and the Trump campaign.
00:01:31.200 It is, however, very, very narrowly drawn.
00:01:34.500 I mean, I read the 20-page decision very quickly, but basically the court ruled that the states do not have the authority
00:01:43.740 to bar a federal candidate from the ballot.
00:01:47.320 Therefore, the states never spoke to the larger question of whether Trump had engaged in insurrection.
00:01:55.340 Very specifically, Troy, while this ruling does rule that Trump cannot be barred from the ballot,
00:02:03.000 it does not speak to the question of his eligibility to be president.
00:02:08.360 Now, we would argue that since he's not been convicted of insurrection anyplace,
00:02:14.200 because the 14th Amendment of the Constitution, Article 3, specifically does not regard presidents and vice presidents,
00:02:23.440 it speaks to its regulation of officers of the United States,
00:02:29.380 which there's a previous Supreme Court decision holding the president and vice president are not officers,
00:02:36.440 but it does not speak to the question of his eligibility.
00:02:40.460 And indeed, Trump's lawyers didn't argue that, although I think they should have.
00:02:45.660 Here's my prediction.
00:02:47.300 While this is a great victory, and it means that the effort to bar Trump from the ballot in many states
00:02:53.440 now collapses, if he is elected, which I believe he will be,
00:02:58.940 they will come back and file new litigation claiming that he's ineligible to be sworn in.
00:03:06.160 This will be just one of the many efforts in the toolbox that they are now openly speaking about.
00:03:13.380 Mary McCord, the woman attorney who seems to be the Forrest Gump
00:03:17.560 of the Trump derangement syndrome movement.
00:03:20.780 She was up to her hips in the Russian collusion hoax.
00:03:26.880 She surfaces in both of the phony Ukrainian impeachment attempts,
00:03:32.080 or both impeachment attempts, I should say.
00:03:34.640 She then surfaces hip deep in the questions about the legitimacy of the last election.
00:03:42.760 And now they're openly talking about stripping President Donald Trump,
00:03:47.560 should he be elected, of his control, civilian control of the military.
00:03:54.280 That's so when this election is won by Donald Trump and Black Lives Matter and Antifa start
00:04:01.960 burning down past half the country, they would like to withhold from Donald Trump the ability
00:04:07.460 as commander-in-chief to secure order.
00:04:11.680 This is insidious.

00:04:21.980 Well, Roger, and I think the most surprising part to me was that we had a 9-0 ruling.
00:04:26.300 And if you listen to the people in the mainstream media,
00:04:28.520 they were kind of throwing it out there that this was being led by Trump's appointees
00:04:32.980 to the Supreme Court.
00:04:35.440 The Trump justices, is what they claim, were leading this effort.
00:04:39.280 And a 9-0 ruling puts that completely to bed, Roger, does it not?
00:04:43.380 No, look, I think we all understand that Norm Eisen and his organization, Crew,
00:04:49.200 which is not about ethics but about being against Donald Trump,
00:04:52.960 fostered all of these legal efforts in the various states.
00:04:56.100 They are baseless.
00:04:57.440 Those who file them actually should be sanctioned.
00:04:59.720 There is no basis in law for their filing.
00:05:03.280 They're frivolous.
00:05:04.460 They should have been slapped down.
00:05:05.800 In many courts, they were.
00:05:07.340 Take Massachusetts, for example.
00:05:08.900 Even there, the state Supreme Court said, no, the state could not bar Trump from the ballot.
00:05:13.960 Also true in Michigan, Minnesota.
00:05:16.780 These are not conservative states.
00:05:19.020 But I also think that you're half right, where the left has really gone crazy,
00:05:25.560 accusing the Supreme Court justices of being partisans, is in agreeing to hear the immunity question,
00:05:34.380 which is an entirely different issue.
00:05:36.660 Now, what's interesting about leftists is they love the federal judiciary.
00:05:41.340 They love all federal judges as long as those judges rule the way they want them to.
00:05:47.320 But when any judge rules contrary to what they think, that judge is unqualified.
00:05:52.740 That judge is political.
00:05:54.600 That judge is corrupt.
00:05:56.420 No, that judge is honest.
00:05:58.000 That's their real problem.
00:05:59.940 They like judges who are really, might as well be members of the prosecution.
00:06:04.020 Those are the kind of judges they like, the kind of judges you get in liberal enclaves like D.C. and New York.
00:06:12.260 So just the fact that the Supreme Court decided to hear the issue of immunity,
00:06:19.540 that is immediately blamed on the Trump justices for agreeing to even hear that question.
00:06:25.800 I still don't think there is, by any means, any guarantee that the U.S. Supreme Court is going to rule for Trump on the immunity question.
00:06:36.400 My guess is if they ruled on the basis of the law, they would.
00:06:40.280 But as we saw in the federal, the judicial decisions surrounding Nixon and executive privilege,
00:06:49.040 because of the atmosphere in the country, the U.S. Supreme Court reversed 200 years of precedent regarding executive privilege
00:06:57.660 to rule that Richard Nixon's tapes could be released.
00:07:01.140 That's because of hysteria in the country.
00:07:03.620 I think that was wrongly decided, by the way.
00:07:05.700 So you have the same hysteria in the country today, this same Trump derangement syndrome.
00:07:12.940 I would not make any bets on what the U.S. Supreme Court is going to do on any issue.
00:07:19.340 I'm glad they're hearing it.
00:07:21.000 On the other hand, I would hope that Trump's lawyer will make a better presentation than he made to the appeals court,
00:07:29.300 because the question of whether Trump, as president, could order SEAL Team 6 to assassinate his political opponent
00:07:38.780 and then have them assassinate any senator who wanted to impeach and convict him,
00:07:45.100 he would not have immunity for that because it falls outside his responsibilities as president.
00:07:51.260 It's a ludicrous, hypothetical question that his lawyer answered, I think, incorrectly.
00:07:59.400 His lawyer said that his answer was a qualified yes, that he would have immunity for such an act.
00:08:04.820 No, the answer is no, he would not.
00:08:07.140 But it's an absurd question.
00:08:09.480 Well, Roger, you highlighted something in one of your first responses there,
00:08:12.600 where this ruling sets up something where they could take away power from Trump.
00:08:17.080 And I think there's an effort across the country where the establishment almost seems like they know that Trump's going to win.
00:08:22.780 They almost seem like they feel that Trump is going to win, and they're setting the deck.
00:08:26.960 So just in case that happens, maybe we could call it a Peter Strzok insurance policy.
00:08:31.460 Just in case that happens, they're going to have mechanisms available to them to squash dissent, to squash support for the president.
00:08:38.460 And that was most evident in a show that we had last week with Greg Stentrum.
00:08:43.120 I hope people go check that out. Just a brilliant, brilliant guy.
00:08:47.800 But he was talking about Pennsylvania and Gettysburg.
00:08:50.720 And we actually saw news this weekend that we talked about a little bit,
00:08:55.280 that there is actually a partnership going on in Pennsylvania,
00:08:59.200 where they're going to be coming after people who question elections and spread, quote, election misinformation.
00:09:07.360 And they're partnering here with several government agencies.
00:09:11.280 I'd like you to talk about that for a second, because it seems like, like you said, a setup for the next election.
00:09:16.280 Yeah, this is shocking.
00:09:17.780 First of all, I think it's very important to establish that Greg Stentrum and Leah Hoops,
00:09:23.080 in that Delaware County Pennsylvania litigation,
00:09:26.860 absolutely established as an undisputable fact in court that there was corruption in the Pennsylvania election.
00:09:34.240 So I think this is why Governor Josh Shapiro, a dedicated leftist,
00:09:41.700 has announced last week that the state would partner with state and federal agencies,
00:09:45.700 including Homeland Security and the Cyber Security Infrastructure Security Agency,
00:09:52.380 to essentially censor any speech that is regarding the integrity and safety and honesty of elections.
00:10:01.520 This is unconstitutional, but they need to be challenged.
00:10:07.960 This is one of the most chilling things I have ever seen,
00:10:12.420 which means you would deny people their First Amendment rights to question election results.
00:10:18.080 Governor Shapiro has a problem.
00:10:19.660 We have proof that your elections are corrupt.
00:10:23.060 The judge, the courts have now recognized our evidence last week,
00:10:28.000 and therefore, I think his actions are unconstitutional and they need to be challenged.
00:10:33.500 On the other hand, good luck suing Homeland Security.
00:10:36.960 This is the ongoing problem.
00:10:38.960 You may remember I had Dr. Robert Steinberg on, who's an expert,
00:10:43.940 pardon me, Dr. Robert Epstein on,
00:10:45.680 who's an expert on Google's manipulation of information in an election year.
00:10:51.360 So, just as they seek to recycle the Russia, Russia, Russia fraud, that hoax,
00:10:58.700 they will also try to reiterate that level of censorship they had in the 2020 election.
00:11:07.120 Remember, Donald Trump was barred from the ballot in that election.
00:11:11.880 His supporters, pardon me, barred from the Internet, barred from Twitter in that election.
00:11:16.640 His supporters were barred from many social media platforms.
00:11:22.380 They're seeking to reassert their control over all public discourse
00:11:26.940 so that no one can raise the question of the legitimacy of the elections.
00:11:33.720 Well, Roger, it's such a huge problem,
00:11:36.580 and I think the ultimate goal here is that they want people in power to be able to silence the American people.
00:11:42.780 And that's just, like you said, it's so blatantly unconstitutional.
00:11:45.860 It's so unconstitutional that you wouldn't be able to question something.
00:11:49.480 But that's where we are with the Democrats.
00:11:51.420 And, you know, conflation is a big part of this, Roger,
00:11:54.900 because they love to take two pieces that really have nothing to do with each other
00:11:58.460 and conflate them so the American people that aren't paying attention to the news cycle,
00:12:02.620 they get confused and they mix things up.
00:12:05.340 And I also think deception is a big part of this.
00:12:07.880 They want to make it seem like they are trying to prevent some kind of, you know,
00:12:13.460 election rigging or something like that,
00:12:14.900 when in reality they're protecting themselves as we've proven that the elections are corrupt.
00:12:20.880 They're protecting themselves by squashing dissent,
00:12:24.160 and it's just there's nothing more anti-American.
00:12:26.660 And speaking of things that are anti-American, Roger,
00:12:29.600 over the weekend we had big news.
00:12:31.520 Jill Biden, First Lady Jill Biden, was in Tucson, Arizona,
00:12:35.900 and she was shouted down by a protester who came into where she was speaking there in Tucson,
00:12:41.880 and it was a pro-Palestine protester.
00:12:45.120 Now, we talked about this last week.
00:12:46.880 Joe Biden on the issue of Ukraine, on the issue of the Middle East,
00:12:49.860 is plummeting with approval ratings in his own party.
00:12:53.800 The people of the Democrat Party look at his handling of Israel and Hamas,
00:12:57.960 and they're disgusted by it.
00:12:58.900 He's shed nine points of support within his own party since November.
00:13:03.400 And that's kind of flaring up every time they go into public.
00:13:06.220 So let's play the video so you can see this, Roger,
00:13:08.160 of Jill Biden getting shouted down in Tucson.
00:13:09.940 Jill, when are you in the best you're going to call for a free trial?

00:13:34.940 Troy, this is a serious schism in the Democratic Party coalition.
00:13:40.380 This is because Joe Biden seeks to have it both ways.
00:13:43.640 In other words, while his administration is ostensibly supporting Israel,
00:13:48.460 it's also funneling hundreds of billions of dollars to Iran.
00:13:52.500 That money is used not only to reinvigorate their nuclear weapons development program,
00:13:59.460 but they're also continuing to fund both Hamas and Hezbollah,
00:14:03.680 who are obviously in combat with the IDF.
00:14:07.480 So this is a foreign policy that makes no sense to me.
00:14:11.780 We are supporting Israel, who we give $1.4 billion a year.
00:14:18.440 There's some indications that Biden is seeking to restrain Netanyahu
00:14:24.260 in terms of attacks on civilians that are alleged.
00:14:28.400 But at the same time, he is trying to have it both ways.
00:14:33.560 Muslim Americans, very, very important part of the Democratic voter coalition,
00:14:39.620 particularly in the state of Michigan.
00:14:41.640 In the recent Michigan Democratic primary, last time I looked, 15% of voters voted for non-committed.
00:14:50.820 In other words, there was no viable challenge to Biden, so they cast their vote for uncommitted.
00:14:58.340 That is the block of voters, I tell you, who are not going to vote for Joe Biden in the fall.
00:15:05.120 There really is no way for him to resolve this issue, in my opinion.
00:15:11.740 The president has an opportunity here,
00:15:14.480 but I also think we have to be very careful in terms of looking at public attitudes towards Israel's conduct of their defense.
00:15:26.660 It's interesting when you hear voices like Judge Andrew Napolitano, Mike Adams, the health ranger,
00:15:34.320 and others beginning to question the tactics of Israel.

00:15:41.520 Well, and Roger, I wanted to note here that Jill Biden, a mainstay on your worst-dressed list,
00:15:47.840 and I wanted to ask you, what do you think goes through her mind when she put—
00:15:52.240 I mean, it's just unbelievable, isn't it, to see what this woman actually wears out in public?
00:15:56.520 Look, the entire Biden family is extraordinarily dysfunctional.
00:16:01.280 Anyone who tried to follow that hearing last night, last week, pardon me,
00:16:07.260 Hunter Biden's excuse for most things was, well, I was high.
00:16:11.520 So the famous text message in which he says,
00:16:13.760 I'm sitting here with my father, and we're going to be very disappointed if you don't send us the money,
00:16:18.440 and then they send the money.
00:16:20.040 He's now saying, well, he was high and his father was not really there.
00:16:23.580 Who knows whether his father was really there or not.
00:16:26.220 He continues to get caught in multiple lies regarding his businesses.
00:16:32.360 He continues to get caught in multiple lies, as does Joe Biden, about what Biden knew and when he knew it.
00:16:37.920 Oh, I never met with any of my son's or my brother's business clients, but we know that he met with many of them.
00:16:44.800 So it is that whole, that whole escapade last week was not good news for Joe Biden.
00:16:53.480 Biden continues to trail Trump in the national surveys.

00:17:10.680 I saw Peter Baker of the New York Times yesterday saying, Trump confusing Biden and Obama.

00:17:20.260 One is pulling the strings for the other.
00:17:23.260 But more precisely, this is an effort to distract from the mental deterioration of Joe Biden.

00:17:31.960 Well, we accuse Trump of being, of slipping mentally, even though there's no evidence that that is the case.

00:17:41.180 No, actually, it wasn't Donald Trump who couldn't remember his wife's name.

00:17:46.260 It was actually Joe Biden who mistook his own sister for his wife.

00:18:06.240 And they're playing the Biden campaign game, which is to throw shade on Donald Trump's age and his mental acuity when there is no issue there.

00:18:21.780 Two excellent events this past weekend, one in Virginia.
00:18:25.740 Interestingly enough, Virginia state, Trump lost twice, lost in 2016, lost in 2020, now appears he is narrowly ahead there.
00:18:36.420 And a victory in Virginia may actually be possible.
00:18:39.880 Very good strategic move, I think, for the Trump campaign to go to Virginia, taking the fight to a state that, frankly, they thought would be firmly in their column.
00:18:51.700 Well, Roger, and it's important to point out here that we just had a primary last night.
00:18:56.920 And if you've watched the mainstream coverage, you actually probably thought that Nikki Haley won something legitimate.
00:19:02.460 Because I got to tell you, Roger, I get news alerts from everybody.
00:19:06.180 I mean, every source of news you could imagine, because that's my job here.
00:19:10.160 And Nikki Haley winning the primary, it might as well have been the Super Bowl.
00:19:13.760 Because every single outlet reported on it, they were saying, oh, Nikki Haley's notch is this top-notch primary victory in D.C.
00:19:20.980 She finally defeats Trump.
00:19:23.320 So I wanted to ask you your opinion, because I took a look at what we were, you know, the D.C. primary results the last couple elections.
00:19:29.280 In 2016, Marco Rubio carried the state, or carried the territory, with John Kasich coming in second.
00:19:36.100 Obviously, neither of those guys had a chance in the 2016 election, yet they won the D.C. primary in 2016.
00:19:43.420 So it kind of highlights what Haley's victory means here.
00:19:46.940 But I wanted to get your opinion on the D.C. primary, because it's just unbelievable.
00:19:51.280 First of all, go back.
00:19:52.260 If you put that chart back up, what you will see is fewer than 5,000 people voted in the entire primary.
00:20:00.380 I don't even think it hits 3,000.
00:20:02.720 So we're talking about 3,000 people in the District of Columbia.
00:20:07.460 The Republican registration in the District of Columbia is certainly in the teens.
00:20:13.800 Most of these people work on Capitol Hill or work for some lobby firm.
00:20:21.660 This is the swamp.
00:20:22.700 This was the swamp primary.
00:20:24.500 So Nikki Haley won the swamp primary, a jurisdiction that has a very small number of delegates and a tiny, minuscule Republican Party, which is rock-ribbed establishment swamp.
00:20:41.980 These people are lobbyists or they work on Capitol Hill.
00:20:45.680 There are no other large Republican neighborhoods, to say the least.
00:20:49.660 So the D.C. primary is essentially meaningless, which is why Donald Trump didn't spend any time or any money on it.
00:20:59.100 Well, he's been to D.C. and he knows what that area is like, and he knows what those people are like.
00:21:03.140 And I don't think anybody would blame him for not putting any resources in.
00:21:07.140 And I would ask Nikki Haley, you know, why does she love to put – she really loves putting her resources into useless races that she can use with the media to kind of hype up her campaign.
00:21:14.940 We saw it in Nevada.
00:21:16.420 There was, you know, a primary that awarded no delegates.
00:21:19.540 She put all of her resources into it.
00:21:21.500 D.C., a few thousand votes.
00:21:23.300 She puts resources into it.
00:21:24.620 The media picks it up.
00:21:25.460 I think as we're going forward here, Roger, it's important to highlight that, you know, the mainstream media, Nikki Haley kind of working in concert.
00:21:33.580 Anyway, we have Tulsi Gabbard.
00:21:35.660 I wanted to talk about Tulsi Gabbard a little bit here, Roger, because you keep bringing this up and it keeps getting a lot of traction across the media.
00:21:42.200 Why are you continuing to talk about Tulsi Gabbard for vice president with so many others here?
00:21:47.680 Well, first of all, let me be very clear.
00:21:49.500 I haven't endorsed anyone for vice president.
00:21:52.060 I just like to talk politics.
00:21:54.060 There's a number of candidates that I would be satisfied with.
00:21:56.820 And in the end, I'm going to support whoever Donald Trump selects.
00:22:00.940 I do think that politics is kind of like chess, meaning the person who controls the center of the board wins the game.
00:22:08.100 In all of these national polls, while President Trump is leading, it's very rare that you see him over 50 percent, which for someone who has any experience in reading polls is a crucial milestone.
00:22:23.340 So it's clear to me that in order to win, he has to hold his base and he has to win some votes outside of his base.
00:22:32.200 Because candidates like Ben Carson, who I like very much, I don't think, for example, get you any votes beyond the votes that you already have.
00:22:44.320 Some have proposed Tim Scott.
00:22:46.780 You know, frankly, had he not run for president and shown what a weak campaigner he was, his prospects might be better.
00:22:53.140 But I also think on the more important issues, he is a neocon who votes more like Lindsey Graham than he does the MAGA Republicans.
00:23:03.560 I also don't I also question whether at his age and with his experience, he is ready to be president.
00:23:11.100 I think, for example, that the governor of South Dakota, Christy Noem, brings you West Virginia, a state that you're going to, pardon me, brings you South Dakota, pardon me, a state you're going to win anyway.
00:23:26.940 Also question whether she has the depth to be president.
00:23:31.040 So, yes, I admit that I'm intrigued by the Tulsi Gabbard question for several reasons.
00:23:36.180 One, she is a combat veteran in both Iraq and Kuwait, served her country with distinction.
00:23:43.520 She's currently a lieutenant colonel in the U.S. Army Reserve.
00:23:49.760 She is a pro-life.
00:23:51.660 She has radically, I think several years ago, changed her position on guns.
00:23:58.840 She's committed to opposing the war machine.
00:24:02.660 She's against more funding for Ukraine.
00:24:07.000 She's against more endless foreign wars.
00:24:10.360 So in that sense, she's a non-interventionist like Trump.
00:24:14.380 She would like to seal the border.
00:24:17.260 Now, is she ideal as a candidate?
00:24:19.760 No, but I do think that she has an appeal to women and to millennials.
00:24:24.740 We are gaining among African-Americans.
