00:00:14.760 The Joe Biden auto pen pardon scandal could be perhaps the greatest single scandal in
00:00:22.020 American history.
00:00:23.200 Now, the House Oversight Committee, chaired by James Comer of Kentucky, has submitted
00:00:28.840 a report to the Attorney General, Pam Bondi, arguing that the cognitive state of former
00:00:34.220 President Joe Biden was so severe that he was unaware of pardons and other measures
00:00:39.800 signed via auto pen that they ought to be deemed, therefore, null and void.
00:00:46.060 Individuals, as you may recall, pardoned in the final days of Biden's administration,
00:00:50.700 included his crack-addled son, Hunter, the tranny-loving former head of the Joint Chiefs,
00:00:57.960 Mark Milley.
00:00:58.820 He's the general that contacted the Chinese to assure them that before carrying out any
00:01:04.320 order of the commander-in-chief regarding China, he would warn them in advance.
00:01:09.420 I think that's treason.
00:01:10.840 The baby-killing mad scientist, Anthony Fauci, along with every member of the disgraceful
00:01:18.020 January 6th Committee who fabricated for an investigation and committed treason against
00:01:24.920 the United States and their efforts to weaponize the government against President Donald Trump
00:01:30.320 and his supporters.
00:01:32.180 But beyond that, for reasons I never understood, Biden also pardoned a series of hardcore criminals,
00:01:39.820 drug traffickers, murderers, child molesters, and others, many of whom never applied for
00:01:46.880 clemency.
00:01:47.940 Who was behind those pardons and why they were granted has never been determined.
00:01:54.000 The president agrees with Congressman Comer.
00:01:57.060 Comer said the Biden auto-pen presidency will go down.
00:02:00.540 It is the biggest scandal in U.S. history.
00:02:02.500 Comer believes that Biden's aides sought to deceive the public about the true nature of

00:02:09.100 I think we've seen more than sufficient evidence of that.
00:02:11.760 And according to Chairman Comer, they colluded to mislead the public, taking the extraordinary
00:02:17.800 measures they took to sustain the appearance of presidential authority as Biden's capacity
00:02:23.120 to function independently continued to diminish.
00:02:27.420 Now, President Trump has, could, some say, invalidate the pardons of these criminals.
00:02:33.500 I'm not an attorney, but I don't believe that he has that unilateral authority.
00:02:38.240 I think the way this has to work is the Justice Department has to prosecute somebody rightfully
00:02:45.180 based on facts and evidence before, placed before a grand jury who is on the pardon list.
00:02:52.240 I would nominate Dr. Fauci.
00:02:54.880 Clearly, charges of lying under oath to Congress, that's what they prosecuted me for.
00:02:59.660 That's what they're currently prosecuting James Comey, the former FBI director for.
00:03:05.100 Obviously, the left thinks it's an important crime because they had to fabricate it against
00:03:10.480 me, but he could at a minimum be charged with that.
00:03:14.000 He would then respond through his lawyers saying that he was not subject to prosecution because
00:03:19.800 he has a blanket pardon.
00:03:22.840 That question could then be adjudicated in the courts.
00:03:26.240 Trial court would rule on it.
00:03:28.580 It could then potentially go to appeal and then ultimately go to the Supreme Court who could then
00:03:33.680 decide whether all of Joe Biden's pardons, including those against members of the January 6th
00:03:39.060 committee like Liz Cheney and Adam Schiff, Jamie Raskin and others, are valid or invalid.
00:03:49.700 Biden's brain was mush at the time.
00:03:52.120 These pardons were made, so I think it's abundantly clear.
00:03:56.060 Even if his brain was functioning well, Biden was never a legitimate president to begin with.
00:04:00.440 My opinion, he came into office because of a tsunami of fraud that washed over inner city
00:04:07.120 voting centers and crucial battlegrounds on the night of election 2020.
00:04:11.980 I'm sorry, but I'm skeptical that the counting stopped at exactly 3 a.m. in multiple states and
00:04:17.720 out of nowhere came 300,000 plus printed mail-in ballots, many of whom, at least in Michigan,
00:04:25.760 based on eyewitnesses, had never been folded.
00:04:27.840 Therefore, they had never clearly been mailed.
00:04:30.500 We've seen the audio, the video footage of ballots being delivered to the counting center
00:04:36.380 in Detroit.
00:04:37.940 Then, of course, the January 6th committees, Mark Milley, Hunter Biden, especially the genocidal
00:04:43.560 tyrant, Anthony Fauci, all deserve to be tried and convicted in a court of law.
00:04:47.660 They deserve a fair trial, something I didn't get in Washington, D.C.
00:04:50.800 But the time for excuses is really over.
00:04:54.060 It's time to challenge these pardons.
00:04:56.400 I have laid out here how the attorney general and the deputy attorney general can do so by
00:05:01.220 charging someone who will then use their auto pen pardon as their defense, and this matter
00:05:08.400 can become adjudicated.
00:05:09.820 Meanwhile, James Comey, the FBI director charged in the Eastern District of Virginia, has asked
00:05:17.760 that the charges against him in a formal motion be dismissed, claiming in the motion that questioning
00:05:23.260 from Senator Ted Cruz was fundamentally ambiguous and that Comey's answers were literally true,
00:05:30.340 so therefore Comey should not be charged.
00:05:32.420 I disagree with that determination.
00:05:34.920 The question centered around Comey's knowledge and direction of others to leak classified information
00:05:41.940 that was detrimental to President Donald Trump, and he very clearly said he did not do so,
00:05:49.100 and he very clearly did do so, both directing Andrew McCabe to do so and directing an attorney
00:05:56.820 associate of his named Richmond, who had worked for, had represented Comey in the past,
00:06:02.940 but in this capacity was a special government employee, which is an arrangement under which
00:06:09.720 you work for the government, being paid nothing, but you do retain governmental authority in
00:06:16.200 these positions.
00:06:18.060 Comey's lawyers are arguing that the Department of Justice under Trump is creating confusion
00:06:22.920 by posing an imprecite question and then seeking to exploit that confusion by placing an
00:06:28.660 after-the-fact nevarious interpretation on the ensuing benign answer.
00:06:34.000 That is, of course, gibberish.
00:06:36.440 I would point out that James Comey has a previous motion pending in which he challenges the authority
00:06:43.080 of the interim U.S. attorney in the Eastern District of Virginia, Lindsay Halligan,
00:06:49.220 who gets denigrated constantly in the mainstream media as just an insurance lawyer,
00:06:53.360 when in fact she was a partner of a major law firm where she headed their civil litigation
00:06:58.440 department and has very substantial experience in front of civil juries, probably more experienced
00:07:06.040 in front of a jury than many currently at the Justice Department.
00:07:09.460 She was appointed to this position by President Donald Trump after it was learned that the previous
00:07:15.480 Eastern District Virginia U.S. attorney, appointed by Donald Trump, but not confirmed by the Senate,
00:07:22.160 ultimately confirmed by the federal judges in the district, originally recommended, it turns out,
00:07:28.260 by Governor Glenn Youngkin, a Republican, but approved by the two U.S. senators from Virginia.
00:07:36.500 That's a hint right there.
00:07:38.700 He never disclosed the fact, broken right here on the Stone Zone, that he had a material conflict of interest.
00:07:45.760 You see, James Comey's father-in-law, that is to say his wife's father, is the godfather to James Comey's children.
00:07:55.340 The man in question, Richard Cullen, an attorney, had also represented Comey in the past, yet another material conflict of interest.
00:08:06.540 The law says that if there is a conflict of interest or even the appearance of a conflict of interest,
00:08:11.660 a prosecutor must recuse, but he didn't do so.
00:08:14.800 Instead, he prepared a 51-page report arguing as to why James Comey should not be held to the same standards
00:08:22.320 that others have been held to when it comes to lying to Congress.
00:08:26.700 Now, I stress to you that this is just one narrow area of vulnerability for Comey.
00:08:33.020 I think he has broader vulnerability in the seditious conspiracy that began in July of 2017 in a White House meeting
00:08:43.500 chaired by Barack Obama himself in which Joe Biden, Susan Rice, the National Security Advisor,
00:08:51.260 FBI Director Comey, CIA Director John Brennan, the Director of National Information at the Time,
00:08:57.480 General General James Clapper, and others began the phony Russian collusion hoax conspiracy.
00:09:06.120 That's where they planned to use totally fabricated evidence, the so-called Steele Dossier,
00:09:12.940 which John Brennan knew as CIA Director, CIA Director had been commissioned and fabricated by Hillary Clinton's campaign,
00:09:20.740 as the rationale for both FISA warrants, warrants from the FISA court to spy on Donald Trump and his campaign,
00:09:30.180 as well as the rationale later for the appointment of Robert Mueller to conduct an investigation,
00:09:37.020 which there really was no probable cause, meaning despite their overwhelming legal power
00:09:43.460 and their unlimited budget and their unlimited manpower and staff of attorneys,
00:09:49.100 they could find no Russian collusion against Donald Trump.
00:09:53.600 Ultimately, after James, pardon me, after Robert Mueller's final report became public,
00:09:59.760 they tried to shift the accusation from Russian collusion to obstruction of justice,
00:10:04.920 saying that Trump had sought to obstruct their investigation,
00:10:07.960 but if their investigation was never legitimate to begin with, that argument didn't work.
00:10:14.920 You may remember when Robert Mueller, in an attempt to reinflate the credibility of his failed investigation,
00:10:21.640 after he himself admitted that he'd found no evidence of Russian collusion,
00:10:25.040 they had him testify before Congress, and that was an unmitigated disaster.
00:10:29.320 It became very clear that not only did he not write his final report,
00:10:33.200 he probably never read it, that he was in some type of Joe Biden-type mental decline.
00:10:39.560 When asked about Fusion GPS, the company that fabricated the phony steel dossier,
00:10:46.660 he said he had never heard of them.
00:10:48.900 When he was asked whether he knew that the prosecutor in my case had previously worked for Hillary Clinton,
00:10:58.880 he said he was unfamiliar with that, even though she was his law partner.
00:11:04.540 So it is abundantly clear here that James Comey will first try to question the appointment of Lindsay Halligan.
00:11:12.900 I believe Lindsay Halligan, who was appointed to prosecute this case by President Trump,
00:11:18.920 is, I believe her appointment is valid under the federal law that governs vacancies.
00:11:27.040 You see, the president appoints the U.S. attorney.
00:11:30.880 That U.S. attorney is theoretically supposed to be confirmed by the U.S. Senate.
00:11:35.420 When Joe Biden was president, Republican senators voted regularly to confirm his U.S. attorney appointments,
00:11:41.740 even in states that had two Republican senators.
00:11:44.340 Democrats now have not returned that courtesy.
00:11:47.120 In fact, virtually none of, I think, three or four of Donald Trump's U.S. attorney appointees
00:11:52.040 have now been formally confirmed by the Senate.
00:11:54.860 They can hold that position for 120 days until the Senate acts.
00:12:00.520 If at that point the Senate has not acted, the federal judges in the district do have the authority to appoint somebody,
00:12:08.320 but the president has the authority to fire that person and appoint yet another interim U.S. attorney
00:12:14.900 who can, again, serve for 120 days until the U.S. Senate acts.
00:12:20.500 This is, I think, all valid under the Government Vacancies Act,
00:12:26.260 and I think the president's appointment of Halligan is solid,
00:12:29.340 but Comey seeks to knock out his entire indictment based on a question to her authority.
00:12:34.940 Now, it's possible, by the way, the trial court judge could rule wrongly on that, incorrectly.
00:12:39.580 The appeals court, this is a very liberal district, could also rule incorrectly,
00:12:45.660 but that could ultimately be decided in the U.S. Supreme Court.
00:12:51.540 The blue slip problem, the problem of U.S. senators who are Democrats just refusing,
00:12:56.960 based on nothing other than politics, to approve Donald Trump's appointments to the U.S. attorney,
00:13:01.740 is a level of dysfunction from the Democrat Party that we have never seen,
00:13:06.280 and demonstrates that they will do anything possible to stop Donald Trump.
00:13:10.260 You've seen the tsunami of tyranny from federal judges arguing that he can't negotiate tariff deals,
00:13:16.100 that he can't deport dangerous illegal immigrants.
00:13:19.420 Of course, once those get to the Supreme Court, he has literally won them all.
00:13:23.460 But it is just another demonstration that they will use the judicial branch of government to the extent that they possibly can
00:13:33.180 to try to detract, to water down or delay Donald Trump's America First agenda to make the country great again.
00:13:41.500 It is nothing less than tyranny.

00:18:09.540 Well, I think it should be apparent to anyone who's watching that Illinois' billionaire Governor
00:18:15.680 J.B. Prisker, a rather rotund individual, sees himself as the 2028 Democrat candidate for
00:18:26.460 president, and evidently thinks he can get there essentially by thwarting the will of
00:18:32.680 the American people in the last election and doing everything humanly possible to stop President
00:18:38.880 Donald Trump and ICE agents from deporting dangerous illegal criminals from the windy
00:18:46.560 city of Chicago.
00:18:48.260 He is aided in this endeavor by Mayor Brandon Johnson.
00:18:52.380 Last time I looked, his approval rating as mayor was at 6%, something I've never seen in
00:18:57.720 American politics.
00:18:59.320 Clearly, Prisker believes that kowtowing to the most radical left wing of the Democrat Party
00:19:06.760 is the way to capture their hearts.
00:19:09.560 There is no better observer of J.B. Prisker and his political antics, which endanger the
00:19:17.740 public as well as federal agents, than Mark Vargas.
00:19:21.360 He is the editor-in-chief of the Illinois Review, and he joins us now.

00:19:27.540 Great to be with you, Roger.
00:19:28.920 So, I'm going to take this in order.
00:19:33.760 Several weeks ago, you reported that Governor J.B. Prisker and Chicago Mayor Brandon Johnson
00:19:39.880 had issued an order to the Chicago police specifically prohibiting them from protecting or defending
00:19:52.380 ICE agents who may have been in danger during the performance of their duties to arrest in
00:20:02.700 preparation for deportation dangerous illegals in Chicago.
00:20:07.380 And you further made the point, after consulting with a number of legal experts, that they could
00:20:12.020 both personally face legal liability over this policy.
00:20:18.640 So, tell us what's going on.
00:20:19.720 Yeah, Roger, since 2022, Chicago has welcomed over 52,000 illegal aliens under Joe Biden's
00:20:28.940 open border policy, and over $2.5 billion have been spent, taxpayer money, to make sure
00:20:36.620 that these illegal aliens have free health care.
00:20:39.740 But what Prisker and Johnson have been doing, the executive orders that they've signed that
00:20:44.980 put federal ICE agents, their lives in grave danger, this stand-down order, where local
00:20:52.220 police, local law enforcement cannot participate and assist federal ICE agents.
00:20:58.400 I've spoken to numerous legal experts and attorneys on both sides of the aisle, and they all agree
00:21:04.960 that there is a strong case for Governor Prisker and Mayor Johnson's actions that could land them
00:21:09.940 up to 20 years in federal prison.
00:21:13.560 Let me just highlight just very briefly a few of these.
00:21:16.060 Eight U.S. Code 1324, it's a felony to conceal, harbor, or shield illegal aliens from detection.
00:21:23.240 Eight U.S. Code 1373 prohibits local governments from restricting communication between local law
00:21:29.200 enforcement and federal immigration authorities.
00:21:31.440 And finally, 18 U.S. Code 111 makes it a crime to forcibly assault, resist, impede, or intimidate,
00:21:38.880 or interfere with federal officers engaged in their duties.
00:21:42.640 And we're seeing that happen in real time.
00:21:45.260 It's why there's over 1,000 percent increase in assaults on federal ICE agents.
00:21:50.880 It's because it's a combination of both Prisker and Johnson's dangerous and vile rhetoric aimed
00:21:56.840 at federal ICE agents.
00:21:58.140 And it's also because of these executive orders that they've signed that prohibit local law
00:22:01.760 enforcement from providing any assistance should they be in trouble.
00:22:06.300 This is really quite extraordinary.
00:22:08.820 President Trump himself has said that based on their illegal orders, Prisker and Brandon
00:22:14.080 Johnson should be in jail.
00:22:16.180 The president's comments came after reports that Chicago police officers had actually been
00:22:21.240 ordered to stand down as ICE agents faced a hostile crowd in the Brighton Park area of
00:22:27.960 Chicago, according to CWB.
00:22:32.580 Chicago, one ICE agent urgently radioed for backup, warning he was being surrounded.
00:22:37.600 Instead of authorizing assistance, the Chicago Police Department leadership allegedly ordered
00:22:42.120 city officers to retreat from the area entirely, leaving federal agents to fend for themselves.
00:22:49.180 This is truly disgraceful.
00:22:54.060 I don't understand the politics of this.
00:22:57.460 In other words, who do Prisker and Johnson think they are appealing to?
00:23:01.700 We saw that when the president moved the National Guard into Washington, D.C., when the crime rates
00:23:06.800 just got untenable, when the city was just incredibly dangerous for its residents, as well as anyone
00:23:15.020 who was visiting or working there, that the local residents, regardless of whether they were African
00:23:20.980 American, Hispanic, or whether they were Caucasians, overwhelmingly approved the president's move to
00:23:29.480 bring safety and security to their neighborhoods and communities.
00:23:33.780 So who do Pritzker and Johnson think they're appealing to here?
00:23:38.500 Well, Pritzker doesn't have a constituency.
00:23:41.020 It's important for your listeners to know that he's spent nearly $400 million of his own money.
00:23:47.040 He's a billionaire of his own money to be elected governor twice.
00:23:50.540 So he doesn't have a constituency.
00:23:52.760 He's literally bought the governor's seat.
00:23:56.060 But he's playing to the far-left, progressive George Soros types of the Democratic Party, the AOCs,
00:24:02.720 the progressive liberals that hate America, that prioritize lawbreakers over law-abiding citizens.
00:24:10.800 And he's losing support across the city of Chicago.
00:24:14.200 We're seeing evidence of that.
00:24:15.460 The streets are a war zone.
00:24:16.780 Yet Pritzker likes to get up early in the morning and take video of a park at 6 o'clock in the morning,
00:24:23.680 talking about how peaceful it is.
00:24:25.700 Well, Pritzker, all the violent criminals are asleep because they've created chaos between the hours of 1 and 3.30 a.m.
00:24:33.080 And he's also not telling you that he's surrounded by about a dozen heavily armed bodyguards and a bulletproof SUV.
00:24:40.520 But the residents know in Chicago that the city is a war zone.
00:24:45.020 The streets are dangerous.
00:24:45.780 There's 150,000 gang members and only 11,000 police officers.
00:24:52.260 They're far outnumbered.
00:24:54.340 But yet Pritzker likes to think that it's okay to prioritize illegals over law-abiding citizens.
00:25:00.320 And what the sad part is is that critical programs, maternal health programs, hospitals in the south and west sides of Chicago,
00:25:08.080 in predominantly black neighborhoods, they're shutting down because of little or no funding.
00:25:14.560 We have Chicago has some of the highest infant mortality rates in the country.
00:25:18.120 And instead of allocating money to save the lives of little black babies, Pritzker and Johnson instead want to put $2.5 billion to make sure that illegal aliens, lawbreakers, have free health care.
00:25:30.120 It's an unpopular perspective.
00:25:32.220 Nationally, Americans are against this.
00:25:34.460 They support the present and his actions going into these democratic cities.
00:25:37.520 And Pritzker and Johnson are on the wrong side of the law on this issue.
00:25:41.280 And lastly, they're on the wrong side of history on this issue.
00:25:44.340 Doing away with a cash bail has proved to be an enormous mistake in the city of New York.
00:25:51.120 The city of New York's crime statistics are heavily doctored.
00:25:54.580 So they really, the crime statistics that the New York City Police Department, the once great New York City Police Department,
00:26:00.700 which is now a woke agency, reports to the FBI are heavily, heavily manipulated.
00:26:07.140 Cash bail has not worked out for New York State at all.
00:26:09.720 Yet Illinois Democrats and J.B. Pritzker have done away with cash bail, which I think adds to the problem in the city of Chicago.
00:26:20.580 As I recall, Pritzker is fabulously wealthy.
00:26:23.860 Pritzkers are, of course, the famous Hyatt Hotel family.
00:26:27.180 He spent his own personal money to buy the governorship twice.
00:26:32.000 Mark, you told me recently that he basically funds the entire Democrat Party as well as the Democrat ticket.
00:26:38.380 In a state that has unfortunately become redder and redder.
00:26:44.280 Do you believe that it is still possible?
00:26:48.280 Pardon me, bluer and bluer.

00:26:50.180 Do you believe it is possible that Illinois could yet elect a Republican governor?
00:26:55.880 Absolutely.
00:26:56.560 And what my favorite part of this, Roger, is, yes, he is an heir to the Hyatt Hotel fortune and he's worth almost $4 billion.
00:27:02.560 But he hates paying property taxes.
00:27:05.620 And in fact, when he was running for governor, it was revealed that he bought a mansion next to his in the Gold Coast neighborhood of downtown Chicago.
00:27:14.540 And he had instructed the plumbers to rip out all the toilets in the mansion so that it could legally be uninhabitable.
00:27:20.560 Because he didn't want to pay over $300,000 in property taxes.
00:27:26.880 This is the same guy who bought the governor's seat by spending nearly $4 million of his own money.
00:27:33.840 But what Pritzker and Johnson have done has destroyed our city.
00:27:38.100 You talk about no cash bail, 67,000.
00:27:40.540 Here's a specific number for you.
00:27:41.540 67,000 criminals are free and out on the streets today because of no cash bail.
00:27:48.440 And how do we know that?
00:27:49.260 Because they've all missed their court hearings.
00:27:51.100 67,000 criminals missed their court hearings.
00:27:53.620 What did Chicago do?
00:27:54.500 They sent them a postcard in the mail and said, sorry, we missed you at your hearing.
00:27:58.120 Hopefully you come back next time.
00:27:59.560 And so we're seeing this 90% of violent and dangerous criminals are out on the streets along with the 67,000.
00:28:06.400 Why?
00:28:06.640 Because they've never been identified or charged.
00:28:08.900 If you want to create a violent crime, if you want to create murder or be involved and participate in mass shootings, you've got to do it in the city of Chicago.
00:28:18.040 Because the justice system is not for the victim.
00:28:21.920 The justice system is for the criminal.
00:28:24.220 And it is so backwards.
00:28:25.960 But Governor Pritzker has presidential aspirations.
00:28:29.980 A national poll had him polling at just 2%.
00:28:33.680 He's wildly unpopular.
00:28:35.820 But it is possible that Chicago can turn red.
00:28:38.180 Because of what's happening, the money being reallocated to illegal aliens, while they want to raise taxes in order to make up for the difference.
00:28:46.860 The black community is outraged that they're burying black babies because of high mortality rates because there's no funding.
00:28:54.080 We are going to see – I think we're seeing a realignment of politics in America.
00:28:57.920 And it's going to start in the city of Chicago.
00:28:59.360 And mark my words, I believe we will, under President Trump's leadership and his strong-to-fund crime policies, we will flip Chicago red.

00:29:14.200 I mean, assuming a field that could include California Governor Gavin Newsom.
00:29:21.520 Just this past week, former Vice President Kamala Harris told us that she's not finished.
00:29:27.300 And she would, for the Democrat nomination, be extraordinarily formidable, having just spent $400 million between her campaign and PAC money to be a candidate for president.
00:29:38.080 But Bernie Sanders, I don't know if he's going to try yet again.
00:29:42.380 He skimmed so much money in media placement fees for he and his wife, which is not illegal.
00:29:48.900 But without disclosing that to your donors, I'm not sure he's ethically skimmed millions from his two presidential campaigns.
00:29:56.200 So he may be in for yet another grift.
00:29:59.920 But it seems to me that their bench is very, very thin.
00:30:03.740 I would think that Newsom and Kamala Harris, both having a base out of California, that is initially problematic, probably for both of them, but more so for Newsom, who is trying to reinvent himself yet again.
00:30:19.500 All these candidates, however, seem to think that by grabbing the most left, most crazed, progressive agenda of the Democrat Party is the way to get nominated.
00:30:33.020 A Bill Clinton, if he existed today, within the confines of the Democrat Party, a moderate Democrat governor, Bill Clinton actually wanted to balance the federal budget.

00:30:52.960 And that clique is led by AOC, by Jasmine Crockett, by that pompous old socialist windbag, Bernie Sanders, and Democrats like Brandon Johnson.

00:31:42.240 The Republican Party has obviously a strong candidate in J.D. Vance, the sitting vice president, who's demonstrating the energy.

00:31:58.180 Marco Rubio is turning out to be a standout as secretary of state.

00:33:08.840 Mark, in the early mornings of this past Friday, Illinois lawmakers quietly passed one of the most dangerous and unconstitutional measures in the state's history, according to a piece that you have up today on the Illinois Review.
00:33:21.600 Cloaked in compassionate language about safe zones, this bill is nothing more than a political stunt, you say, that undermines the rule of law and puts federal law enforcement officers directly in the crosshairs.
00:33:32.780 H.B. 1312 designates so-called safe zones around schools, hospitals, and courthouses, and it gives private citizens the power to sue federal immigration officers for alleged violations of constitutional rights, including claims of false imprisonment or unlawful detention.
00:33:48.660 I think they would actually have that anyway.
00:33:50.500 But let's be clear what this really means.
00:33:52.380 If a federal immigration and customs enforcement agent, you write, makes a lawful arrest that an activist later disagrees with, that agent could be sued in state court simply for doing his or her job.
00:34:03.360 Tell us about what's going on here.
00:34:05.160 Isn't it just remarkable that you've got the Illinois Democrats who have a supermajority control in Springfield?
00:34:11.900 Their grip on power is so strong that they don't even need any input from a single Republican in either the House or Senate chambers.
00:34:18.640 And around 2 o'clock this morning, actually, is when they passed this bill, they'd like to talk about that this is protecting civil rights, when in fact, Roger, it's actually weaponizing state law to intimidate federal officers.
00:34:32.180 But more than that, I believe in talking with other legal experts and attorneys that this is completely unacceptable and unconstitutional.
00:34:40.540 Why?
00:34:41.200 Because of the Supremacy Clause of the United States Constitution, which makes federal law the supreme law of the land, and that states like Illinois cannot pass laws that obstruct, penalize, or interfere with federal operations.
00:34:55.920 And I want to make a particular point here.
00:34:58.120 Think about you or I or any other citizen, law-abiding citizen, Roger, citizens that listen to your show.
00:35:05.080 Imagine if we put together legislation or we put together policies or signed executive orders as private citizens that endangered the lives of federal officers, particularly federalized agents.
00:35:15.520 Where would we be?
00:35:16.440 We would be locked up.
00:35:17.720 We would be arrested and locked up in .003 seconds.
00:35:20.800 Yet the Illinois Democrats, led by Pritzker and Johnson, have created laws, have created executive orders that put federal agents' lives in grave danger.
00:35:30.260 And now, now they want to arrest them.
00:35:34.520 Pritzker has created, just last week, if you remember, Roger, he's created a new commission to document the names of all the federalized agents.
00:35:43.500 So that when a, at some point, when a Democrat is elected president of the United States, that they can prosecute every single one of them.
00:35:51.300 But the United States Supreme Court has been clear.
00:35:54.920 There are multiple cases going back to the early 1800s and as recently as 2012 that reaffirmed the same principle.
00:36:04.040 States may not obstruct federal authority.
00:36:07.140 Yeah, we've seen the same thing in New York, where New York Attorney General Letitia James has set up a portal so that people can report the identities of ICE agents.
00:36:16.580 My fear, of course, is that she's going to dox those agents and put their lives and the lives of their families in danger.
00:36:23.640 Again, I think that these activities are legal under federal law.
00:36:28.600 But it's the same playbook.
00:36:30.360 They weaponize the criminal justice system against Republicans, and they attempt to rig the system against ICE agents who are simply trying to keep their job.
