00:02:54.660 It is actually shocking how much the White House is now trying to protect this Biden interview audio with special counsel her,
00:03:06.220 and apparently it's so damning they don't want any of us to ever hear it.
00:03:11.300 No, that is exactly right, and I want you to understand how absurd the legal position of the White House is.
00:03:19.280 So the House of Representatives is trying to get the audio of the interview between special counsel Robert Herr and President Joe Biden,
00:03:28.420 and we learned this week the Biden White House is claiming executive privilege to block the release of that audio.
00:03:36.660 By the way, at the same time, a whole consortium of media outlets, including ABC, NBC, CBS, CNN, Washington Post, New York Times,
00:03:46.020 all of the corporate media, they're actually suing trying to get this audio as well.
00:03:50.320 So the media is trying to get it.
00:03:52.160 The House of Representatives is trying to get it.
00:03:54.340 And we saw this week the Biden White House claim executive privilege.
00:03:58.840 Now, listen, if you're not a lawyer, you may think, okay, well, that seems like, I don't know, I've heard those terms, executive privilege.
00:04:05.380 What does that mean? I guess that's a reasonable claim.
00:04:07.680 They're fighting back. Okay, that's fine.
00:04:10.440 I've got to tell you, as a lawyer, as a constitutional litigator, this is one of the most absurd legal claims I've ever heard.
00:04:19.800 So let me tell you what executive privilege is.
00:04:23.000 Executive privilege is a privilege that is attached to the law for a long time,
00:04:26.920 and it is it protects conversations between the president and his senior advisors.
00:04:33.340 So if a president is talking with his chief of staff, if a president is talking with his national security advisor,
00:04:39.120 and they're talking about what do we do in Israel?
00:04:44.120 What do we do in Ukraine?
00:04:45.320 What do we do in South America?
00:04:46.760 What do we do on a particular issue?
00:04:49.560 Executive privilege protects forcing those employees to disclose what they've talked about with the president.
00:04:58.520 And there's a very important reason for that.
00:05:00.800 You want a president, whoever the president is, Republican or Democrat,
00:05:04.280 you want a president to get candid advice, real advice, straightforward advice.
00:05:09.980 And if every employee of the president is worried, holy cow, I could be forced to testify in front of Congress on this,
00:05:16.600 I could be forced to testify in court on this, you will end up having people giving the president advice that is CYA,
00:05:23.440 that is covering their own rear end, that is trying to protect themselves,
00:05:26.960 and it's deeply damaging to the executive operating effectively.
00:05:32.400 So executive privilege is a real, it is a very important privilege.
00:05:36.520 Now, let me stop here and point out that the Democrats and the court system and the media
00:05:44.500 have not given a damn about executive privilege if it concerns Donald Trump.
00:05:51.000 Yeah, that's, I mean, you have a hundred examples you could use to prove that point.
00:05:55.380 And let me give you two, Peter Navarro and Steve Bannon.
00:05:58.940 Again, Peter Navarro is in prison right now because the Democrat House of Representatives subpoenaed him,
00:06:07.460 tried to force him to testify.
00:06:08.740 He claimed executive privilege because he was a senior advisor to the president.
00:06:12.360 He didn't want to testify by what he talked about to the president.
00:06:15.660 He's in jail right now.
00:06:17.060 Steve Bannon is headed to jail right now for the same reason.
00:06:20.220 So when it came to Republicans, they did not care.
00:06:25.320 The Democrats, the media, the court system did not care about executive privilege.
00:06:29.120 Those decisions are outrageous.
00:06:31.560 But what happened this week, I want you to understand,
00:06:35.220 the Biden White House claimed executive privilege not concerning his discussion
00:06:40.120 with senior advisors in the White House,
00:06:43.000 not concerning Biden's discussions with cabinet members, his senior team.
00:06:48.500 That would be appropriate.
00:06:51.100 Instead, they focused on Robert Hurt.
00:06:54.420 Robert Hurt is the special counsel appointed to investigate allegations that Joe Biden committed crimes,
00:07:00.760 committed felonies.
00:07:02.660 And Robert Hurt was investigating him.
00:07:05.640 He interviewed him.
00:07:06.860 And the Biden White House claimed executive privilege for the audio of the interview
00:07:12.480 between Joe Biden and the special counsel.
00:07:14.280 Now, under no way, shape or form was that conversation a conversation between Joe Biden
00:07:21.360 and his senior advisors about a policy issue or substantive issue.
00:07:25.240 Listen, if Joe Biden were talking with Merrick Garland about what the administration's policy
00:07:30.480 should be on immigration, what the administration's policy should be on any issue,
00:07:35.560 on abortion and what have you,
00:07:36.860 that is something that is properly covered by executive privilege
00:07:41.540 because the president is entitled to talk to a senior team without it being forced to be made public.
00:07:47.540 But in this case, Robert Hurt was not operating in the role as an employee,
00:07:55.260 as someone reporting to Joe Biden.
00:08:00.260 And rather, he was a special counsel.
00:08:02.420 The reason he was appointed special counsel is because there was credible and serious evidence
00:08:08.640 that Joe Biden had committed multiple felonies.
00:08:11.560 And so Robert Hurt was in the position of a prosecutor.
00:08:14.860 He was investigating a potential criminal defendant.
00:08:19.300 He was interrogating a potential criminal defendant.
00:08:22.680 And by the way, the report from Robert Hurt concluded that Joe Biden committed multiple serious felonies,
00:08:30.600 that he violated the law, particularly concerning the treatment of classified documents,
00:08:35.500 that he did so in a way that was knowing, that was repeated, that was brazen.
00:08:43.780 And then Robert Hurt's recommendation is, even though he's committed multiple felonies,
00:08:47.680 and by the way, for the same thing on which the Biden Justice Department is right now prosecuting Donald Trump,
00:08:56.360 Robert Hurt ultimately recommended we cannot prosecute Joe Biden
00:09:00.220 because he is so old and senile that he is not competent to stand trial.
00:09:08.140 And what the recommendation from Robert Hurt was...
00:09:10.420 Can we just pause there and go back?
00:09:12.060 Because I think a lot of people forgot about that.
00:09:14.060 Yes.
00:09:14.200 I mean, the excuse for not prosecuting Joe Biden for having classified documents that he'd had for decades, right?
00:09:23.540 Dating back to when he was a senator, was that he's just too old and feeble,
00:09:28.180 and we couldn't get a conviction because the excuse would be he's too old to convict
00:09:33.280 and doesn't know what he's doing anymore.
00:09:35.160 Yet he's the president of the United States of America with the nuclear codes.
00:09:39.340 Well, that's exactly right.
00:09:40.800 So to convict someone of a criminal crime, you've got to make the case that they have the mens rea.
00:09:47.600 Mens rea is the legal term for the intent that they're knowingly and willingly violating the criminal law.
00:09:54.520 What Robert Hurt said is you could not convince a jury that Joe Biden had the mens rea to violate the law,
00:10:03.100 even though he did so repeatedly, knowingly, that he was openly, brazenly, shamelessly.
00:10:10.780 But what Hurt said is, and by the way, he said this on behalf of the Biden Justice Department,
00:10:16.780 he said any jury would conclude that the Biden was too old and senile and forgetful,
00:10:23.020 that he could not realize he was committing felonies, and so you couldn't prosecute it for him.
00:10:28.000 It's amazing that's the excuse for the president of the United States of America.
00:10:32.740 Yet he's apparently in good enough shape to run for re-election and be president for another four years.
00:10:39.100 Like you mentioned a minute ago that he has the nuclear codes.
00:10:43.440 Understand the Biden Department of Justice has publicly maintained to the American people,
00:10:48.800 Joe Biden is not competent to stand trial.
00:10:52.540 And yet he is competent to be the commander in chief, to have the nuclear codes.
00:10:58.580 And let's be clear, if Joe Biden tonight decided to annihilate humanity
00:11:03.980 and to fire nuclear weapons at our enemies, he could exterminate human beings from existence.
00:11:11.120 And yet, according to the Biden DOJ, he's not competent to stand trial.
00:11:16.340 Only in Biden's America is this possible.
00:11:18.840 The Speaker of the House, by the way, he has come out and said he is very concerned about this issue as well.
00:11:27.100 From the House side, here is what he said earlier.
00:11:30.400 But first, I want to address the breaking news from this morning.
00:11:34.560 About an hour ago, we learned that President Biden has invoked executive privilege
00:11:38.900 to prevent the American people from hearing the audio recordings of his testimony with Special Counsel Robert Herr.
00:11:44.840 The American people will not be able to hear why prosecutors felt the President of the United States
00:11:52.220 was, in Special Counsel Robert Herr's words, a, quote,
00:11:56.600 elderly man with a poor memory and thus shouldn't be charged.
00:12:01.180 Just think about that for a moment.
00:12:03.440 President Biden is apparently afraid for the citizens of this country and everyone to hear those tapes.
00:12:09.600 They obviously confirm what the Special Counsel has found and would likely cause, I suppose,
00:12:15.820 in his estimation, such alarm with the American people that the President is using all of his power
00:12:21.000 to suppress their release.
00:12:24.620 And rather than defend our closest ally at war,
00:12:27.920 President Biden is using his authority to defend himself politically.
00:12:33.980 I mean, it adds up, doesn't it?
00:12:36.420 It's so damning that we've got to do this at all costs, protect it, make sure it never gets out there,
00:12:42.220 make sure we don't see the light of, this is the light of day.
00:12:44.840 And the next question is, Senator, for you is, okay, well then what happens next on this?
00:12:49.640 Is there a way to get these recordings out there?
00:12:53.160 So the Speaker of the House is precisely right.
00:12:57.320 What this tells us is these recordings are bad.
00:13:01.080 They are damning.
00:13:02.820 They are embarrassing.
00:13:04.100 They are the sorts of things that if you listen to them,
00:13:06.800 the natural inference from the fact that they're fighting so hard
00:13:11.440 and they're making a demonstrably frivolous legal claim to protect them
00:13:15.940 is that the White House has determined, holy cow, people heard this,
00:13:21.940 they would say Joe Biden is utterly incompetent to be president.
00:13:24.960 But that Robert Hur, the special counsel, was right.
00:13:30.000 He's not competent to stand trial.
00:13:31.940 If you're not competent to stand trial, you're not competent to be president of the United States.
00:13:36.060 You're not competent to be the commander-in-chief of the United States military.
00:13:40.280 So it's not just you're saying what they were talking about on the recording,
00:13:43.520 which would be damning enough on the substance and the subject matter,
00:13:46.980 but it's also about the incompetency that then can be used against him
00:13:51.000 and the American people would see basically pull back the curtain
00:13:53.720 and this is what the guy running your country really is like right now.
00:13:57.420 Are you going to give him a chance to run it for another four years?
00:14:00.440 Right.
00:14:00.640 Look, my assumption is the audio is incredibly damning.
00:14:06.000 Remember, we talked about when Robert Hur was appointed.
00:14:08.640 Robert Hur had been the right hand to Rod Rosenstein, the deputy attorney general,
00:14:15.220 who had been Barack Obama's U.S. attorney in Maryland.
00:14:19.360 Rod Rosenstein is responsible for much of the abuse of power we saw in the DOJ.
00:14:25.200 He's responsible for appointing Robert Mueller as the special counsel to investigate Russia, Russia, Russia.
00:14:32.880 And when Robert Hur was first appointed, we said, look,
00:14:36.740 what will reveal whether Mr. Hur is actually doing his job
00:14:41.300 is whether he's willing to go after Joe Biden.
00:14:44.120 And if he just if if he walls off any evidence of criminality from Joe Biden,
00:14:50.580 that will be an incredibly damning conclusion.
00:14:53.380 Now, I will say his report was frankly better than you and I expected.
00:14:58.220 Yeah, because because his report on its face concluded, yes, Joe Biden is a criminal.
00:15:03.240 He's a felon.
00:15:03.960 He violated the criminal law over and over and over again.
00:15:08.340 He knew he was violating.
00:15:09.500 He said he was violating.
00:15:10.760 He didn't care.
00:15:11.660 He was brazen.
00:15:14.160 But then the reason that that Mr.
00:15:18.780 Hur said he was not going to recommend charges against Joe Biden,
00:15:23.240 exactly like the charges that were being brought against Donald Trump for the same offense,
00:15:28.160 is because he said Joe Biden's not competent to stand trial.
00:15:33.120 Now, Democrats were horrified at the second part of that conclusion because they're like,
00:15:37.580 no, don't reveal pay no attention to the man behind the curtain.
00:15:41.960 Do not reveal that the Wizard of Oz is a fake and a fraud.
00:15:46.320 Now, listen, you and I have talked about we're three and a half years into the Biden presidency.
00:15:51.740 You know how many times I've talked to Joe Biden since he became president?
00:15:55.060 I'm assuming it's still zero.
00:15:57.340 Zero.
00:15:58.280 Not once.
00:15:59.040 And that's not normal.
00:16:00.200 So people understand how it normally works.
00:16:02.200 It is absolutely weird and bizarre.
00:16:05.860 When Barack Obama was president, I talked to him regularly.
00:16:09.560 When Donald Trump was president, I talked to him every week and sometimes every day.

00:16:17.860 And by the way, you might say, OK, Cruz, he's a right winger.
00:16:21.460 Maybe maybe just Biden doesn't talk to him.
00:16:23.320 But Biden has talked to virtually zero Republican senators.

00:16:52.000 We talk regularly at lunch about how weird it is that none of us have talked to Joe Biden.

00:17:03.160 We were sitting there at lunch talking and the only senator at the table with me who had spoken with Joe Biden was John Kennedy.
00:17:10.120 John is a great friend.
00:17:11.280 He's a fantastic guy.
00:17:12.400 Amazing sense of humor.
00:17:14.180 John told the story at lunch.
00:17:15.860 He said, listen, I spoke with Biden once and it was fairly early on in the Biden presidency.
00:17:21.500 And there was a bill that John had authored that passed.
00:17:25.620 And it was a bipartisan bill.
00:17:27.360 And John said, look, they wanted to do a signing ceremony in the Oval Office.
00:17:31.980 You know, presumably to show they were bipartisan.
00:17:35.980 Look what we're doing together in this grade.
00:17:38.120 And so John said he went to that signing ceremony.
00:17:40.720 He was in the Oval.
00:17:41.520 And and he said Biden in the middle of the conversations in the middle of the signing ceremony struck up a conversation with John.
00:17:49.960 And and Biden said, hey, hey, John, have you ever been to the cabinet room?
00:17:54.560 And John Kennedy being John Kennedy, he said, I lied.
00:17:58.540 And I said, no.
00:17:59.260 And Biden immediately says, well, come on, let me take you over there.
00:18:04.200 So he goes over to the cabinet room and John said, but Biden begins telling war stories.
00:18:09.620 And they were from 40 or 50 years ago.
00:18:12.640 And he's just talking about things that happened decades ago.
00:18:15.900 And he's telling it, telling them on and on and on.
00:18:18.620 And the the Biden White House staff is freaking out.
00:18:22.900 And they're going, Mr. President, Mr. President, you need to go.

00:18:25.660 They were really worried that Biden is talking to John Kennedy and and Biden apparently like gave him the back of the hand and said, shut up.

00:19:08.780 So it is weird that the White House staff keeps him hidden from us.
00:19:14.280 And the natural assumption is that his mental diminishment is so great that they cannot let him speak to us.
00:19:22.160 And so you put that in the context of this Robert Herr interview.
00:19:26.360 Understand the claim of executive privilege is absurd because Robert Herr was not meeting with him as a subservient employee discussing the administration's policy.
00:19:38.140 Rather, Robert Herr was appointed as special counsel to investigate.
00:19:42.320 Did the president commit criminal conduct?
00:19:44.820 By the way, he concluded the answer is yes.
00:19:47.400 Well, and he testified to that on Capitol Hill.

00:21:46.360 So, you have audio recording from his ghostwriter where the president acknowledges that the information he has is classified and he's sharing with his ghostwriter.
00:21:55.980 We have an audio recording capturing a statement from Mr. Biden saying to his ghostwriter in February of 2017, quote, I just found all the classified stuff downstairs, end quote.
00:22:07.560 And then again, reciting passages from a meeting in this situation.

00:22:15.300 Right, so he's, and the ghostwriter has no classified, no, he has no clearance, no classified clearance to anything, correct?

00:22:28.380 Now, that was, he said in 17, so he knew he had classified data, classified documents 17, 18, 19, 20, 21, 22, 23, when they started to find these things in his garage right by the Corvette.

00:23:08.480 So, the prosecution against Donald Trump for the classified documents was always weak on its face.
00:23:14.400 But then the Democrats had this enormous political problem, because they were gleeful.
00:23:18.860 They're like, ha-ha, classified document, you have them, okay, we got you, finally, we finally have something we can charge you on.
00:23:25.820 And then the news broke that Joe Biden had done the exact same thing.
00:23:29.820 And then the news broke that it wasn't once, it was twice, it was three times, it was four times, it was five times.
00:23:35.740 It was over and over and over again.
00:23:37.860 And then the news broke that Joe Biden seemingly had classified documents stored just about everywhere, as you noted, by his garage, in his garage next to his antique Corvette, all over the place, in one house, in another house.
00:23:50.420 And by the way, it wasn't just from his time as vice president, and to be clear, Joe Biden as vice president had no legal authority to declassify anything, so he could not have done what Trump could have done.
00:24:01.760 It is also the case that there were multiple classified documents from Joe Biden's time as a senator.
00:24:08.360 Now listen, I've spent 12 years as a senator.
00:24:09.980 I've read a lot of classified documents.
00:24:13.920 I can tell you, I'm sitting right now in my D.C. apartment, we have a little apartment by Capitol Hill, I can tell you with absolute certainty there's not a classified document in my apartment.

00:25:53.480 So, if Joe Biden has committed the same crime Donald Trump has alleged to have committed,

00:26:43.680 Because when Joe Biden sat down with Robert Hurt, there is no arguable claim he was sitting down with a senior advisor.

00:27:37.200 Three, he didn't exert executive privilege over any contents of the report.
00:27:41.920 He was transparent.

00:27:46.860 And so, understand, Joe Biden arguably could have asserted executive privilege in the interview.
00:27:55.460 He could have said, I'm not going to answer a particular question about the conversations I had with my senior advisors because of executive privilege.

00:31:49.580 Hollywood lawyer and Hunter Biden's sugar brother, Kevin Morris, is said to be tapped out of cash after financially supporting Hunter's legal battles over the last four and a half years to the tune of $6 million.
00:32:03.360 Let me ask you, do you have any friends that are good enough friends that you give them $6 million?
00:32:07.900 No, and not only that, I love how the money apparently is supposed to be paid back after the election.
00:32:13.640 The Daily Mail continues.
00:32:14.780 The withdrawal of financial support for the president's son comes at the worst possible time for Hunter, with two trials looming, which could end up seeing him serve jail time.
00:32:25.820 I got to say, this is striking.
00:32:29.240 Nobody seemed to care.
00:32:30.600 The press didn't seem to care that there was this lawyer in California funding Joe Biden's son's legal defense up until this stage.
00:32:39.280 But the fact that he is bailing out, I got to tell you that there is the old phrase, the rats are running from the ship.
00:32:46.820 That starts to suggest that's exactly what happened here.

00:33:48.560 having loaned him more than $6.5 million, Morris is no longer willing to foot the bill.

00:36:54.920 Well, this is the third story we're covering today that deals with Biden cover-ups.

00:37:03.540 In this instance, they're covering up the likely terrorists and the criminal threats
00:37:09.620 that are crossing into this border illegally through Joe Biden and the Democrats' open borders.

00:37:18.000 Bill Malugian, as you know, is the heroic, the fantastic reporter for Fox News
00:37:23.400 who's done more reporting on the border than, I think, any reporter in the whole country.
00:37:27.100 So here's what Bill Malugian tweeted, quote,
00:37:30.840 New, six-plus months ago, I filed a FOIA request with CBP
00:37:35.160 seeking the nationalities of people on the terror watch list
00:37:39.120 arrested by Border Patrol in recent years.
00:37:42.320 CBP now says they will not turn over that data,
00:37:46.200 citing privacy and law enforcement sensitivity exemptions, telling me, quote,
00:37:51.060 The privacy interests of the individuals in the records you have requested
00:37:54.560 outweigh any minimal public interest in disclosure of the information.
00:37:59.300 Any private interest you may have in the information does not factor into the aforementioned balancing test.
00:38:05.920 Malugian continues, quote,
00:38:07.300 I did not ask for any names, IDs, addresses, anything that would breach privacy,
00:38:13.740 nor did I ask for any law enforcement sensitive information.
00:38:16.500 I simply requested only, and only as bracketed by asterisks on both sides,

00:38:26.280 so the public can have an understanding of where in the world they are coming from.
00:38:31.880 CBP acknowledges in the opening paragraphs of their response letter to me
00:38:35.420 that all I asked for was the nationalities of those arrested on the terror watch list.
00:38:39.880 But they then go on to cite exemptions that have nothing to do with what I requested,
00:38:45.020 including medical files, phone numbers, email addresses, home addresses, dates of birth, etc.
00:38:51.320 None of which I sought.
00:38:53.700 And they even cite an exemption regarding, quote,
00:38:57.620 records which could be reasonably expected to endanger the life or physical safety of any individual.
00:39:02.820 I disagree with CBP's withholdings of this data based on exemptions that have nothing to do with my FOIA request,
00:39:11.600 and I will be appealing immediately.
00:39:14.260 Let me ask you something, Ben.
00:39:16.280 What is Joe Biden, this administration, and the Democrats, what are they hiding?

00:39:22.940 And the question is, where are they hiding, and how is it affecting, most importantly,

00:41:06.520 they wouldn't release it.

00:41:13.080 They were overwhelmingly cities in Florida and Texas,
00:41:16.260 which is not surprising,
