00:00:12.660 The Texas Bar application has actually added a couple of questions

00:00:22.960 This in wake of what happened at Stanford Law School.

00:00:26.100 And this is because of a letter that you wrote.

00:00:30.200 This is something that I would argue every state in America should be modeling

00:00:34.460 after what the Texas Bar application is doing with adding these basic questions.

00:00:39.440 Well, Ben, you're right.

00:00:40.700 We've had a big victory in the last week for free speech.

00:00:44.620 Everyone who listens to Verdict was appalled.

00:00:48.140 And we discussed at length what happened at Stanford Law School

00:00:51.880 where Fifth Circuit Federal Court of Appeals judge Kyle Duncan

00:00:55.880 went to give a speech on campus at Stanford Law School.

00:00:59.140 And a group of law students screamed him down, cursing, cursing profanities,

00:01:05.540 yelled, were just – they shouted him down and prevented him from speaking.

00:01:12.200 And some of the explicit profanities they yelled at him,

00:01:17.840 I've never in my life seen a federal judge treated the way these Stanford law students that did.

00:01:24.200 Then, of course, the associate dean for diversity, equity, and inclusion came in,

00:01:30.240 and the judge understandably appealed to the dean, to the administration,

00:01:34.380 for help enforcing Stanford's free speech policy.

00:01:37.040 And the dean proceeded to side with the mob, to side with the people screaming down the judge.

00:01:42.880 And she read from a seven-minute prepared lecture attacking the judge.

00:01:49.400 In the wake of that, across the country, people were rightly horrified.

00:01:55.660 I did two things.

00:01:56.620 Number one, I wrote to the president of Stanford and the dean of the Stanford Law School

00:02:01.000 calling on Stanford to fire the dean and to discipline the students.

00:02:06.540 And we ended up getting a meaningful victory in that regard.

00:02:09.400 That dean is on leave.

00:02:12.200 We don't know if she's ultimately going to be fired, but astonishingly enough,

00:02:16.920 Stanford stepped forward, condemned what the dean did, said it violated their policy,

00:02:21.560 and put her on leave. 0.99

00:02:22.760 That's a big deal.

00:02:24.160 That is a victory.

00:02:25.560 But then a second victory that I think is even more significant.

00:02:29.940 A month ago, I sent a letter to the Texas State Barred,

00:02:33.460 in particular to Chief Justice Nathan Hecht of the Texas Supreme Court.

00:02:37.460 I know Chief Justice Hecht very well.

00:02:39.960 I've argued in front of the Texas Supreme Court and in front of Chief Justice Hecht many,

00:02:44.320 many times.

00:02:45.220 The letter I sent to the Texas Bar, I urged the Bar to do something about it.

00:02:50.900 Anyone who's a member of the Bar, you have to take a bar exam.

00:02:54.760 In Texas, it's three days long.

00:02:57.240 And it's extensive.

00:02:58.640 It deals with knowledge of the law, knowledge of the law generally,

00:03:01.740 knowledge of Texas law in particular, if you're going to be an attorney in the state of Texas.

00:03:06.360 So, for example, there are questions on the Texas Bar about oil and gas law,

00:03:11.220 which I suspect if you take the New York Bar,

00:03:14.540 you don't get questions about oil and gas law because they don't actually let you drill for oil and gas.

00:03:18.920 Well, in Texas, you have to know at least something about it if you're going to be a member of the Texas Bar.

00:03:24.580 But there is also, you take an ethics exam,

00:03:27.500 and there is also an element of every bar exam,

00:03:30.460 which is character and fitness to practice law.

00:03:33.940 And the notion is, if you're going to be an attorney,

00:03:36.200 if you're going to represent clients,

00:03:37.900 if you're going to be able to go before court and represent clients,

00:03:41.080 you have to have sound character,

00:03:43.400 you have to be fit to practice law.

00:03:44.820 And so what I asked a month ago of Chief Justice Hecht,

00:03:48.420 I'll read a paragraph from the letter I sent him.

00:03:52.140 I would ask that the Texas Board of Bar Examiners,

00:03:55.920 in discharging their duties of assessing the character and fitness of prospective bar applicants,

00:04:01.640 take particular care with students who have graduated from Stanford Law

00:04:05.860 in class years 2023, 2024, or 2025.

00:04:11.760 Specifically, I suggest that students graduating from those years

00:04:17.100 be made to answer in writing

00:04:20.960 whether they participated in the shameful harassment of Judge Duncan on March 9th, 2023.

00:04:29.100 And then I went on to say I would leave it to the considered judgment of the Texas Supreme Court

00:04:33.280 and the Texas Board of Bar Examiners

00:04:34.960 as to what the proper remedy should be for any students who answer in the affirmative.

00:04:39.220 Well, last week I got a letter back from Chief Justice Hecht

00:04:44.000 and it is a terrific letter, it is a terrific response.

00:04:48.900 Let me tell you what Chief Justice Hecht said and I'm going to read it to you.

00:04:52.960 Dear Senator Cruz, thank you for your letter of March 16th, 2023.

00:04:57.300 I am, of course, very familiar with the disruption of Judge Kyle Duncan's

00:05:00.840 invited presentation at Stanford Law School

00:05:03.260 as well as, I'm sorry to have to say, similar occurrences at Yale Law School.

00:05:10.540 It goes on to say, I'm going to skip a little bit of it,

00:05:12.900 but it goes on to say the board has historically relied on law schools

00:05:16.440 to report disciplinary matters that should be considered

00:05:20.100 in determining an applicant's character and fitness for admission to the Texas bar.

00:05:24.720 School reactions to recent violations of free speech policies

00:05:29.300 suggests that reliance is not justified.

00:05:34.700 The board is planning to add questions to the bar application

00:05:38.920 to inquire of applicants directly

00:05:42.020 concerning incivility and violations of school policies.

00:05:47.360 Texas lawyers are expected to adhere to the Texas lawyers' creed

00:05:51.260 promising to treat counsel, opposing parties,

00:05:55.680 the court, and members of court staff

00:05:57.840 with courtesy and civility.

00:06:00.340 The admissions process should examine

00:06:02.900 whether applicants could be expected to fulfill this promise. 0.82

00:06:18.520 as a hooligan, as an Antifa rioter,

00:06:27.440 this has got to make them think twice.

00:06:33.520 The behavior of those students was utterly unacceptable

00:06:36.700 for anyone who wants to be a lawyer.

00:06:38.680 And so I congratulate Chief Justice Hecht.

00:06:41.840 He did exactly the right thing.

00:06:43.960 And this is meaningful in terms of a victory for free speech.

00:06:48.520 How many other states do you think could actually look at this

00:06:52.440 and go, oh, wow, we should do the exact same thing?

00:06:56.000 There are a lot of states that have different universities,

00:06:59.380 a lot of states that dealt with protests on college campuses.

00:07:03.820 We see it almost weekly now where conservative speakers

00:07:07.240 are attacked and even assaulted,

00:07:09.240 as we saw one conservative swimmer who was attacked just last week.

00:07:13.820 We witnessed this happen,

00:07:15.740 and there's got to be a higher standard,

00:07:18.980 as you said, for those practicing law that are going to be in our courts

00:07:22.620 and not treating people this way.

00:07:26.160 Do you believe that other states will look at this

00:07:30.020 and say what Texas just did? 0.99

00:07:32.880 This was such a big victory for not just free speech,

00:07:36.640 but free speech and decorum for everyone.

00:07:39.280 This is saying it's unacceptable no matter who's doing it.

00:07:43.660 How quickly do you think others could jump on board?

00:07:46.740 You know, I think it's likely that you will see other states follow suit.

00:07:50.660 I think it is more likely in red states than blue states.

00:07:54.760 So Florida is a natural place to think about that could follow suit,

00:07:58.600 and Florida is a big deal.

00:08:00.380 Look, Texas has 30 million people.

00:08:02.340 We have nearly 10 percent of the population of the United States.

00:08:05.240 I guarantee you there are Stanford law students

00:08:08.540 who hoped and intended to practice law in the state of Texas.

00:08:11.720 I don't know if any of them were in that room harassing and screaming at Judge Duncan.

00:08:18.660 There are other states.

00:08:20.120 I mean, the states that would be most significant

00:08:22.120 would be the California State Bar or the New York State Bar,

00:08:24.860 because you've got a ton of Stanford law graduates

00:08:27.700 planning to practice either in California or New York.

00:08:30.640 I don't know if they would follow suit.

00:08:33.440 I'm skeptical that they would, given the overall politics of those two states.

00:08:38.040 But I will note, Stanford law school, to the astonishment of a lot of us,

00:08:42.960 behaved a lot better than Yale law school did.

00:08:45.900 Stanford law school in particular suspended the dean,

00:08:49.520 unequivocally condemned the behavior of the students,

00:08:52.040 and made clear that it violated their free speech policy.

00:08:55.740 And let me be clear just to engage with some of the trolls that will say,

00:09:01.360 well, gosh, if you're punishing people for screaming and cursing

00:09:04.660 and shouting down a federal judge, that's anti-free speech.

00:09:08.520 No, no, it's not.

00:09:10.500 You have every right to engage in speech.

00:09:12.820 Those students would have been perfectly justified to show up,

00:09:15.840 to be outside with placards, to be making their views known.

00:09:20.000 What you don't have a right to do is silence the speech of another.

00:09:24.800 That's what the Supreme Court has called a heckler's veto.

00:09:27.100 You don't have the right to shout down and silence another speaker.

00:09:31.640 And part of it is, you're violating not only the free speech rights of the speaker,

00:09:36.200 you're violating the free speech rights of the other students who want to listen to that speaker.

00:09:42.000 And so, had the Stanford law students stood outside and protested in a way that did not disrupt the event,

00:09:49.620 that would have been entirely appropriate.

00:09:52.080 But their objective was to use force to shout down and make the judge's speech impossible.

00:10:01.580 That is directly antithetical to free speech.

00:10:04.320 And I would note, it is even worse when you are dealing with a federal appellate judge.

00:10:09.880 So, at Yale Law School, they did that to Kirsten Wagoner, 1.00

00:10:12.600 who's an attorney who had argued and won a major case at the Supreme Court.

00:10:16.240 That was bad, but it is qualitatively different to do so to a sitting federal appellate judge.

00:10:22.800 I'll tell you this, I've been a member of the bar for a couple of decades now.

00:10:27.760 If you did what they did in that classroom in any courtroom in America,

00:10:33.240 you better have your toothbrush with you because you would be found in contempt,

00:10:37.400 they would put handcuffs on you, and they would put you in jail. 0.86

00:10:40.480 You don't get to speak to a judge that way, even if you don't like the judge,

00:10:44.660 even if you disagree with the judge's ruling.

00:10:47.040 Our system is based upon some modicum of civility.

00:10:52.760 And sadly, those Stanford Law students seem not to have learned that,

00:10:56.080 to have learned the opposite with the encouragement of the DEI dean.

00:11:00.860 But kudos to the Texas State Bar for setting an example,

00:11:04.660 an example that I hope other bars follow.

00:11:07.440 And in particular, Florida should be the next bar to act,

00:11:11.420 because Florida, a lot of those students want to go to Florida, too.

00:11:15.260 And doing this will be a real deterrence to the next time this is happening.

00:11:20.380 If you're a law student, you're a lefty, you're a Marxist,

00:11:23.040 you're going to think twice about, well, wait a second,

00:11:25.640 I'd like to be able to admit, be admitted to the bar,

00:11:28.340 so maybe I won't shout down a speaker who comes to campus.

00:11:32.360 Yeah, it's a big victory, Senator, like you said,

00:11:34.940 and one that hopefully will go viral all over the country.

00:11:39.640 I want to also ask you about another issue.

00:11:43.400 And Ben, part of the reason for emphasizing Florida,

00:11:45.960 if I'm correct, there's an election happening next year

00:11:49.000 with two candidates out of the state of Florida?

00:11:53.680 So I just think it's a good opportunity.

00:16:01.580 because they didn't want people

00:16:02.600 to pay attention to it,

00:16:06.800 hiring the first 30,000

00:16:08.500 of those employees.

00:16:13.880 And in fiscal year 2024,

00:16:16.180 they're planning to double that

00:16:17.960 with 27,000 new hires.

00:16:20.920 Now, what does that mean?

00:16:24.720 a lot of different elements.

00:17:01.220 They're, in fact, 48 days late.

00:17:04.300 If you or I tried that with the IRS,
