00:00:28.840 Well, in the last 48 hours, the situation has gotten far more perilous for Joe Biden,
00:00:35.540 for the White House.
00:00:36.800 As we discussed on Monday's podcast, we did a deep dive into the allegations from the two
00:00:42.240 IRS whistleblowers that came to Congress, came to the House Ways and Means Committee.
00:00:47.380 In the 48 hours that have followed, several things have happened.
00:00:50.580 Number one, one of those whistleblowers has gone public and CBS News has reported on it.
00:00:56.780 And it is a big deal for the corporate media, which has spent the entire Biden presidency
00:01:02.300 shilling for and covering for Joe Biden and the Democrats to suddenly be reporting on these facts.
00:01:08.480 Now, I will point out where's ABC, where's NBC?
00:01:12.600 But the fact that CBS is doing this, that's a big deal.

00:01:17.560 Apparently, none of the rest of them cover news.
00:01:20.960 But CBS, you're starting to see the first rats fleeing from the sinking ship.

00:01:38.340 of exactly what is in those allegations and why it poses big, big trouble for Joe Biden.

00:02:08.320 Gary Shapley since he spoke with lawmakers last month.
00:02:12.320 A lead investigator in the Hunter Biden case tells CBS's Jim Axelrod that he felt the president's
00:02:17.820 son received preferential treatment and in a stunning claim says that he was blocked
00:02:22.340 from pursuing leads that could have led to the president himself.
00:02:26.380 If this was any other person, they likely would have already served their sentence.
00:02:30.360 Gary Shapley was a lead IRS supervisory agent in Operation Sportsman, the investigation
00:02:36.560 into Hunter Biden.
00:02:38.500 Shapley said he uncovered conduct that warranted more serious charges.
00:02:43.020 There were personal expenses that were taken as business expenses.
00:02:48.120 Prostitutes, sex club memberships, hotel rooms for purported drug dealers.
00:02:54.220 How much did Hunter Biden owe in taxes?
00:02:56.200 So from 2014 to 2019, it was $2.2 million.
00:02:58.880 The back taxes were paid off.
00:03:01.480 And last week, the Trump appointed U.S. attorney in Delaware, David Weiss, reached an agreement
00:03:07.000 with Hunter Biden.
00:03:08.180 The president's son would admit to a firearm charge and plead guilty for his failure to
00:03:12.920 pay taxes.
00:03:13.900 If a judge signs off, the deal means no jail time.
00:03:17.580 Testimony we have just released details a lack of U.S. attorney independence.
00:03:22.800 And Shapley told lawmakers that U.S. attorney Weiss was blocked from bringing stronger charges.
00:03:29.400 But U.S. attorney general Merrick Garland said last week that Weiss was not.
00:03:34.740 I would say he was given complete authority to make all decisions on his own.
00:03:38.860 I documented exactly what happened.
00:03:41.260 And it doesn't seem to match what the attorney general or the U.S. attorney are saying today.
00:03:45.640 Shapley provided lawmakers this contemporaneous email he wrote after an October meeting last
00:03:51.560 year.
00:03:52.520 Shapley says Weiss told him the opposite, that Weiss is not the deciding person on whether
00:03:59.240 charges are filed.
00:04:00.880 It was just shocking to me.
00:04:02.880 Shapley, who is still working for the IRS, told us that even before President Biden took
00:04:08.120 office, he was directed to avoid leads involving Hunter's father.
00:04:12.860 There were certain investigative steps that we weren't allowed to take that could have
00:04:17.900 led us to President Biden.
00:04:20.660 And you wanted to take them.
00:04:22.240 We needed to take them.
00:04:23.640 And you weren't allowed to take them.

00:04:26.320 It is important to point out that at that point in Shapley's investigation, Donald Trump
00:04:31.400 was still president.
00:04:32.520 And his attorney general, William Barr, had rules in place that may have limited what Shapley
00:04:37.480 could pursue.
00:04:38.860 The U.S. attorney's office in Delaware had no comment.
00:04:41.240 As for Hunter Biden, his attorneys did not respond to us, but he said before in a statement
00:04:46.580 that he is taking responsibility for mistakes he made during a period of turmoil in his
00:04:51.620 life.

00:04:57.540 And there was also something else interesting that came out, Senator.
00:05:01.380 Not only did Hunter Biden get invited to a state dinner this week, but apparently he left
00:05:05.540 with his dad after the second whistleblower comes out to go to Camp David.
00:05:10.140 And we were told, at least through some in the media, that lawyers were there as well.
00:05:16.420 That doesn't sound like a normal response to whistleblowers.
00:05:20.180 I'm being sarcastic, right?
00:05:21.720 It's like they said, all right, we got to go to Camp David now.

00:05:24.740 Well, it is difficult to overstate how bad the developments have been for Joe Biden and
00:05:29.520 the White House in the past several days.
00:05:31.520 These allegations, if what the whistleblowers are saying is true, then Joe Biden flat out
00:05:37.200 lied and is very likely guilty of serious criminal conduct, guilty of multiple felonies.
00:05:43.640 If what the whistleblowers is saying is true, then Merrick Garland, the attorney general
00:05:49.400 of the United States, likely committed both perjury or actually lying under oath to Congress
00:05:56.100 and obstruction of justice, both serious felonies.
00:06:00.020 On the podcast on Monday, I called for a special counsel to be appointed to investigate Merrick
00:06:06.320 Garland as to whether he lied under oath to Congress in response to questioning that
00:06:10.860 I asked him before the Senate Judiciary Committee and also whether he personally committed
00:06:17.380 or at his direction had committed obstruction of justice.
00:06:21.620 I have also on this podcast repeatedly called for Merrick Garland to be impeached.
00:06:27.480 In the last 48 hours, the House of Representatives took a major step forward in doing so.

00:06:42.900 by July 6th because of the allegations from the IRS, because of the whistleblowers and
00:06:48.940 the DOJ Garland, what he is saying and what David Weiss are saying privately are two different

00:06:56.000 And if it comes true what the IRS whistleblower is saying, we're going to start impeachment

00:07:31.020 had all power and you did not.

00:07:37.760 And I will say when you watch this IRS whistleblower on CBS, you see that this is, by all appearances,
00:07:48.700 not a partisan, not a Republican, not someone with an ax to grind.
00:07:52.840 Instead, this is a career IRS employee, a supervisor who certainly appears to be horrified at what he saw.
00:08:07.260 And it's important.
00:08:10.420 This is something Kevin McCarthy emphasized.
00:08:13.380 If what he is saying is true, then both the attorney general and the president of the United States are flat out lying because it is completely inconsistent.
00:08:24.320 It's possible that that the whistleblower is lying.
00:08:29.980 But I'll tell you what, there's a second whistleblower.
00:08:33.120 There's a second whistleblower who who from the IRS who came forward, who stayed anonymous.
00:08:39.500 He calls himself Mr.
00:08:40.620 X. But let me tell you what what the second whistleblower, how he described himself in his testimony.
00:08:46.840 He says, quote, I'm an American and my allegiances are to my country and my government.
00:08:52.740 I'm also a gay man.
00:08:54.660 I have a husband, two dogs, a home and a life full of family and friends.
00:09:01.280 But above else, I'm a human being.
00:09:03.300 My sexuality doesn't define me as a person.
00:09:05.760 It's just who I love.
00:09:07.040 I'd like to say one more thing regarding this topic of sexuality, especially since it's the start of Pride Month.
00:09:14.200 But people have said that I'm gay and people have said because I'm gay and that I'm working on the case agent in this investigation that I must be a far left liberal perfectly placed to fit some agenda.
00:09:26.200 This was the stuff that was on social media regarding me.
00:09:29.480 I can tell you that I am none of these things.
00:09:31.860 I'm a career government employee, and I've always strived to not let politics enter my frame of mind when working cases.
00:09:40.380 I've also tried to stay so nonpolitical that in the last presidential election I voted, but I decided to not vote for the presidential candidate because I didn't want to be asked that question in a court proceeding in the future.
00:09:55.500 And I didn't want to show any potential bias.
00:09:58.400 My political beliefs are simple.
00:10:00.160 I'm as middle of the road as they come, but would consider myself to be a Democrat.
00:10:06.700 Now, that's one of the two whistleblowers, a gay man with a husband who's a Democrat.
00:10:12.640 The other, they're both career IRS employees.
00:10:18.400 And I got to say on the face of it, their testimony has very significant credibility.
00:10:24.640 If what they're saying is true, Merrick Garland in all likelihood committed at least one felony, if not multiple felonies.
00:10:34.980 And, Ben, let's walk through specifically what those allegations are.
00:10:40.260 Kudos to CBS for saying the allegations are there and saying, well, there were steps they wanted to take.
00:10:45.980 But but let's walk through specifically what was what was stated before you get through those steps.

00:12:09.520 Senator, I want to go through that list you just mentioned because it's so important that people understand these allegations and what they're accusing.
00:12:16.780 Not only those under Garland, but the cover up with the Bidens clearly have to be involved in this.

00:12:24.820 Here's how the House Ways and Means Committee described the evidence.
00:12:28.300 They said, quote, whistleblowers describe how the Biden Justice Department intervened and overstepped in a campaign to protect the son of Joe Biden by delaying, divulging and denying an ongoing investigation into Hunter Biden's alleged tax crimes.
00:12:42.160 The testimony shows tactics used by the Justice Department to delay the investigation long enough to reach the statute of limitations.
00:12:51.180 Evidence they divulged sensitive actions by the investigative team to Biden's attorneys and denied requests by the U.S. attorney to bring charges against Biden.
00:13:02.340 House Ways and Means Committee continued.
00:13:04.300 IRS employees who blew the whistle on this abuse were retaliated against, despite a commitment IRS Commissioner Werfel made before the Ways and Means Committee to uphold their legal protections.
00:13:15.780 They were removed from this investigation after they responsibly worked through the chain of command to raise these concerns.
00:13:22.920 Now, what did the whistleblowers' testimony reveal?
00:13:26.320 It revealed that the IRS removed the whistleblowers from the Hunter Biden investigations, and in fact, they were punished, as Mr. Shapley was not selected for a promotion after he blew the whistle, and when he was more qualified than the candidate who was selected.
00:13:44.660 And specifically, the whistleblowers stated that agents sought to perform a physical search of Joe Biden's guesthouse where Hunter Biden was staying.
00:14:00.560 However, the assistant U.S. Attorney on the case, named Leslie Wolf, questioned, quote, whether the juice was worth the squeeze, and noted that, quote, optics were a driving factor in the decision on whether to execute a search warrant.
00:14:18.020 She further indicated that, quote, a lot of evidence in our investigation would be found in the guesthouse of former Vice President Biden, and she concluded that, quote, there is no way we will get that approved.
00:14:38.100 Now, beyond that, assistant U.S. Attorney Wolf went even further in obstructing the investigation, and Shapley noted that, quote, if there was a, quote, big guy in the transcript, Wolf was either going to directly berate you, or she was probably going to give you the silent treatment, which was one of her tactics, for a couple of weeks and talk behind your back.
00:15:05.900 Now, who is this assistant U.S. Attorney Wolf?
00:15:10.480 Well, her husband, Daniel, donated 14 times to Obama for America during both the 2008 and the 2012 campaigns, seven times in 2008, seven times in 2012.
00:15:25.620 To be clear, that's a hardcore donor.
00:15:27.540 People need to understand that.
00:15:28.500 That's not just like, hey, you got a family friend, and they say, hey, give a little donation, come over to the house for an event.
00:15:34.160 That's hardcore activism.
00:15:35.900 He gave a total of $1,175, so a little less than $100 each time for the 14 times.
00:15:43.040 The two of them were married in 2000.
00:15:45.780 The contributions occurred during their marriage.
00:15:47.660 And actually, assistant U.S. Attorney Wolf herself donated to ActBlue in 2020 in a donation earmarked for Senator Amy Klobuchar's Democrat presidential campaign.
00:16:00.780 She also donated to Josh Shapiro, a Democrat, in his 2022 bid to become Pennsylvania governor.
00:16:07.420 So you've got a prosecutor who is a Democrat donor married to another Democrat donor who's refusing search warrants because she says, quote, the juice is not worth the squeeze.
00:16:23.180 And I've got to say, by the way, that's the same damn phrase the administrator at Stanford Law School said when she was siding with the mob that was heckling Judge Kyle Duncan.
00:16:34.060 She says, is the juice worth the squeeze?
00:16:36.420 I wonder, do leftists, is this some lingo in leftist world that they're using when they're doing something wildly improper?

00:17:01.720 On December 8th, 2020, the IRS and FBI agents wanted to interview Hunter Biden in Los Angeles.
00:17:08.060 Now, Hunter Biden had Secret Service protection.
00:17:12.060 And so during the preparation for the Hunter interview, Assistant U.S. Attorney Wolf specifically prohibited the agents from asking about incriminating terms of previously released emails, specifically the, quote, 10 held by H for the big guy or asking any questions about, quote, dad or the big guy.
00:17:35.180 So she made clear you're not allowed to ask about Joe Biden.
00:17:38.260 And we are protecting if the whistleblower is what they're saying is true.
00:17:42.140 She was specifically building a wall to protect Joe Biden.
00:17:46.180 Now, before they embarked on the interview, the agents discovered that the night prior, on December 7th, 2020, FBI headquarters notified Secret Service headquarters and word of the plan reached Hunter Biden.
00:18:02.960 So the day before the interview, FBI tips off Hunter.
00:18:06.200 Hey, we're going to come by and question you tomorrow.
00:18:09.160 And as a result, on December 8th, they learned that their plan to interview Hunter Biden changed in the new plan, including providing the Secret Service and Hunter Biden's with the agent's telephone numbers if they wish to interview him.
00:18:25.120 Afterwards, the agents received phone calls from Biden's counsel, indicating that they were to contact Hunter through counsel.
00:18:33.220 So what it means is the agents were prevented from doing what's called a knock and talk, which is showing up.
00:18:39.480 And talking to Hunter Biden in a spontaneous way in which he could reveal critical information or falsehoods.
00:18:46.360 Instead, the FBI gave him the heads up to prepare with counsel so that he could he could work with lawyers to make sure they knew exactly what he said.
00:18:55.660 Two days later, on December 10th, agents met with prosecutors to discuss the fact that Hunter had vacated the Washington, D.C. office of Owosco and his documents went to a storage unit in Northern Virginia.
00:19:12.180 The IRS prepared a search warrant to search the storage unit, but the assistant U.S. attorney Wolf again objected.
00:19:21.120 The investigators pressed the issue with the U.S. attorney Weiss, who ultimately stated that, well, if the storage unit wasn't accessed for 30 days, agents could execute a search warrant on it.
00:19:33.440 However, after the investigators completed their call with the U.S. attorney Weiss, they discovered that assistant U.S. attorney Wolf had contacted Biden's counsel and told them about the storage unit.
00:19:51.720 In other words, if he has incriminating evidence, the Department of Justice gave his lawyers heads up in time to get rid of whatever incriminating evidence was there.
00:20:02.360 That is not how you conduct a criminal investigation, calling ahead and saying, hey, here's where we'd like to search.
00:20:08.200 We'll let you know what we're looking for. But but we're just giving you the heads up ahead of time in case there might be something there you don't want us to see.

00:20:50.200 You as a lawyer for people that maybe don't have context here and a lot of people don't have dealings with the FBI or with investigators in their entire life.
00:21:01.560 Does any other American I'm talking rich, poor, black, white, Republican, Democrat or anywhere in between, do they get tips normally from the FBI calling you saying, hey, we're going to come over and maybe look at something tomorrow or in the next couple of days or the next 30 days?
00:21:23.340 Whatever it may be. Maybe people say, well, that may happen to other people.
00:21:27.880 We don't know if that's necessarily just a perk of being the last name Biden.
00:21:32.060 How how abnormal is it, Senator, for that to happen to anyone in this country?
00:21:37.300 It's extraordinarily weird. Look, search warrants are typically obtained in secrecy specifically to avoid the destruction of evidence.
00:21:47.160 Think about it. If you're executing a search warrant on a drug dealer and you say, hey, we're going to search this warehouse tomorrow.
00:21:53.240 Well, you think you're going to find any drugs there?
00:21:55.560 I mean, only the stupidest criminal on Earth, if you tell them where you're going to search, will leave evidence there.
00:22:02.040 And the fact that the Department of Justice gave them a heads up, hey, here's where here's where they're planning to search.
00:22:08.060 That suggests possible obstruction of justice, because if you tell a witness who has evidence of a search ahead of time in order to enable that witness to destroy the evidence that constitutes obstruction of justice.
00:22:22.900 So let me ask you another question, and I know the answer, but just to put it in perspective, what's the point of investigating a person for any crime if you tell them in advance to hide and destroy the evidence of the crime that we're about to investigate?
00:22:39.240 Unless you're fixing that investigation to make sure purposely you find nothing.
00:22:44.980 Well, they don't quite want to find nothing. Nothing. And we've talked about this on the podcast at length.
00:22:50.020 With Hunter's being set up to be the patsy, to be the fall guy, so Merrick Garland can say, I indicted a Biden, I indicted a Trump, I'm very even-handed, now let's go after Trump with everything we got.
00:23:02.500 But he's being set up to be a patsy with a very soft fall, not a day in jail, so the serious crimes, nope, don't look at it, and especially, especially, especially, do nothing that implicates Joe Biden.
00:23:16.100 And so DOJ, assuming these allegations are correct, walls off Joe Biden, says nothing about the big guy.
00:23:23.400 But it's not just protecting Joe Biden, they're also making sure that Hunter Biden avoids the most serious consequences.
00:23:30.100 So, for example, U.S. Attorney Weiss, according to the allegations from the whistleblower, attempted to bring tax charges against Hunter Biden in the District of Columbia for alleged misconduct in 2014 and 2015.
00:23:46.740 And by the way, that included $400,000 in Burisma-derived income he never reported, Burisma being the Ukrainian natural gas company that is also alleged to have made a $5 million bribe to Joe Biden, the dad.
00:24:03.040 U.S. Attorney Weiss wanted to bring the case in D.C. around March of 2022, but he was denied.
00:24:12.100 U.S. Attorney Weiss sought special counsel status from DOJ in spring of 2022, and he was denied.
00:24:19.540 And he also attempted to bring charges in the Central District of California in the fall of 2022, which was denied in January 2023.
00:24:30.580 Now, why does that matter?
00:24:31.540 It matters because the District of Columbia in California, D.C. was the sole venue for Hunter's 2014 through 2015 tax crimes, and California was the sole venue for the 2016 through 2019 tax crimes.
00:24:49.700 And whistleblower number two, who would be the gay Democrat who's married to another man, maintains that venue was not proper in Delaware for any of these tax charges.
00:25:01.560 So what happened is the most potentially serious tax charges.
00:25:06.860 And we're talking about millions of dollars in tax evasion.
00:25:11.540 According to this allegation, DOJ prevented those charges from being filed until after the statute of limitations passed, until after the period at which Hunter Biden risked real jail time.
00:25:27.060 That also means that when you and when others have talked to Merrick Garland under oath at Congress, that he would have had to have been willfully and purposely lying to you.
00:25:43.300 So what does that mean, going back to the possibility, Kevin McCarthy talking about this from an impeachment standpoint, and how would that actually work?
