00:03:32.000 I want to tell you about Eric Swalwell.
00:03:34.800 You may remember he is the former congressman, disgraced gubernatorial candidate in California,
00:03:40.000 that was excommunicated by Democrats, not because of what he did,
00:03:44.280 but because they believed he couldn't win the race in California.
00:03:49.080 Now, this part of the story and the details I'm going to tell you,
00:03:52.540 you're going to understand instantly now just how serious things have become
00:03:56.420 since the Democrats have taken their hands off of Eric and protecting him.
00:04:01.540 The former congressman, once a presidential candidate, one of Donald Trump's loudest critics
00:04:08.600 in Congress, and until just a couple months ago, the candidate for governor of California
00:04:13.560 has now had his electronic devices seized by the FBI as part of a criminal investigation
00:04:21.520 and allegations of sexual misconduct.
00:04:24.520 Here's more about the seizure on Fox News.
00:04:27.600 Breaking news. We have just learned that the FBI has seized former Congressman Eric Swalwell's
00:04:34.260 electronics, and this happened on Saturday. They took those electronics from him at San Francisco
00:04:40.380 International Airport on Saturday and then from his Washington, D.C. home on Sunday.
00:04:47.400 Eric Swalwell was not detained or arrested, and we're told the federal investigation
00:04:51.880 involves sexual misconduct allegations against him. Two women who have spoken publicly about
00:04:57.580 sex misconduct allegations against Swalwell we know about. The FBI is not commenting further
00:05:04.620 details on this case and Fox News has contacted Swalwell's attorney. We're waiting to hear back.
00:05:09.880 Now to be clear the agents didn't simply ask or send a letter to his attorney asking him to turn
00:05:17.700 over his phones. According to these reports the FBI agents confronted Swalwell at the San Francisco
00:05:24.560 airport and served him with a search warrant for his cell phone and other electronic devices
00:05:29.700 then ABC News went on to report the agent seized the devices at the airport and then the investigators
00:05:36.300 had another search warrant for Swalwell's Washington DC home the San Francisco Chronicle
00:05:42.800 reports the device seized at the airport included his iPhone as well as his MacBook computer now
00:05:50.040 you got to think about the significance of that. This isn't simply a political ethics investigation
00:05:55.160 any longer. This isn't an embarrassing congressional hearing. You have federal
00:05:59.880 investigators obtaining a search warrant, allowing them to take possession of the electronic devices
00:06:05.500 of a former member of Congress and then searches home. Now, Swalwell has not been convicted of a
00:06:12.320 crime, but the allegations against him, well, they remain clearly extremely serious. Obtaining a
00:06:18.600 federal search warrant generally requires investigators to convince a judge that there
00:06:23.740 is probable cause and it exists and they believe evidence of a crime will be found in the place or
00:06:29.800 property that they are searching. And the underlying allegations are extraordinarily serious.
00:06:35.740 Reuters this morning reporting that the federal investigation involves allegations, multiple
00:06:40.940 allegations of sexual misconduct against Swalwell. It follows accusations from multiple women that
00:06:48.180 surfaced earlier this year, including allegations of sexual assault and unsolicited explicit images.
00:06:55.540 Swalwell has denied all the allegations and has said he intends to fight them as well.
00:07:00.380 Now, according to CalMatters, four women initially accused Swalwell of sexual misconduct. 0.66
00:07:06.100 One former congressional staffer has also alleged that Swalwell sexually assaulted her
00:07:11.360 not once, but twice when she was too intoxicated to consent 0.98

00:07:30.040 You got to remember where Eric Swalwell was heading.
00:07:32.260 He had represented California in Congress since 2013.
00:07:36.140 He briefly ran for president in 2019.
00:07:38.560 He became one of the most recognizable Democratic faces during the Trump years,
00:07:43.760 appearing consistently on television and emerging as one of Trump's fiercest congressional antagonists.
00:07:50.480 Then he decided his next move would be the governor's mansion in California.
00:07:54.820 That's when Swallow launched his campaign for governor in November of last year
00:07:58.740 and entered the race as a major Democratic contender.
00:08:02.680 Then everything collapsed.
00:08:04.820 When the sexual misconduct allegations became public in April, after the poll numbers showed
00:08:10.820 there was a chance that Eric may not be able to beat the Republican candidate, that is
00:08:15.300 when the Democrats started taking care of one of their own.
00:08:18.180 And I'm not talking about protecting them.
00:08:19.940 I'm talking about politically taking them out.
00:08:22.680 The political fallout was immediate.
00:08:25.020 The media who protected him was now covering the stories.
00:08:28.340 And that is when Swalwell suspended his campaign for governor.
00:08:31.520 just days after the allegations were published.
00:08:35.560 He continued, of course, denying them while apologizing to his family
00:08:38.860 for what he characterized as a quote-unquote mistake in judgment.
00:08:43.260 And it didn't end with his campaign, as I'm sure he was hoping.
00:08:47.020 Swalwell subsequently announced he would resign from Congress,
00:08:51.140 bringing an end to the career of a politician
00:08:54.040 who only months earlier was positioning himself to run the largest state in America.
00:08:59.320 And now, just four months later, this story has moved from political scandal into a dramatically different arena.
00:09:07.140 Search warrants, federal agents, seized electronics, and a search of his Washington home.
00:09:14.260 The FBI action is especially significant because electronic devices can potentially contain enormous amounts of evidence.
00:09:22.140 Texts, emails, photographs, location information, communications with witnesses, and other digital records.
00:09:29.320 Now, we don't yet know specifically what investigators believe they will find.
00:09:33.600 And the seizure itself does not establish, of course, that Swalwell is actually guilty.
00:09:39.160 But investigators clearly want access to these devices badly enough to seek judicial authorization, to literally seize them.
00:09:46.880 And apparently, they weren't willing to wait for Swalwell to voluntarily hand them over.
00:09:52.680 Now, finally, there's also a broader irony here, and it's impossible to ignore.
00:09:57.720 For years, Eric Swallow was one of the most aggressive voices in Washington, demanding countless investigations and impeachments of Donald Trump and the people around him.

00:10:13.040 He became nationally famous during the Russia investigation.
00:10:16.820 He regularly appealed on television discussing those investigations and the subpoenas and the classified information and accountability and the rule of law was his thing.
00:10:26.520 Well, now Swalwell is the one facing the federal investigators, and this isn't even the first major controversy that's followed him.
00:10:34.880 You may also remember that years earlier, and we covered it here, Swalwell also faced intense scrutiny over his association with a Chinese communist spy known as Fang Fang.

00:10:48.100 Even more information came out and admitting that he actually did have a sexual relationship with a Chinese spy.

00:12:29.620 Now, this isn't some startup that had one good year and then collapse.
00:12:33.560 We're talking about Nike.

00:12:37.380 We're talking about Michael Jordan.

00:12:46.300 For decades, Nike wasn't merely selling shoes.
00:12:49.720 It was selling American sports culture.
00:12:52.860 And today, the company's market capitalization is hovering around $60 billion.
00:12:57.700 That is an extraordinary fall from its heights that it reached just five years ago.
00:13:02.040 Now, not only has Nike lost nearly 80% of its market cap over the last five years,
00:13:07.740 But when the stock was near its peak, it was put this way by Ethan Strauss.
00:13:13.440 He wrote the definitive take on how the company was fumbling the bag.
00:13:18.460 They were a brand, they said, quote, defined by Michael Jordan's competitiveness and machismo.
00:13:24.440 And with a heavily male customer base, they thought they could double in size if they could be that and also be Lululemon at the same time.
00:13:33.740 But instead, they stopped being that while failing to be Lululemon, and now they're nothing.
00:13:39.480 A bunch of upstart competitors ate their lunch while they destroyed their brand and reputation.
00:13:46.160 Now, what was it that caused their brand to collapse?
00:13:49.620 That is the biggest part of the story here that we all need to look at.
00:13:53.280 And this is going to be studied, I promise you, in college.
00:13:57.400 Because the decline of the largest American sports apparel brand, well, that's big.
00:14:02.760 Senator Ted Cruz put it this way when he said, sad and predictable.
00:14:07.140 For my whole life, I wore nearly 100% Nike for athletic wear.

00:14:13.400 But when they canceled the Betsy Ross shoe, it showed that their marketing plan was America hate.
00:14:19.440 I went out and bought brand new shoes, shorts, t-shirts.
00:14:23.200 Turns out I wasn't the only one.

00:15:13.120 Nike was swallowed by the HR and PR ladies from colleges like Vassar and Oberlin.
00:15:19.420 Now, this is why it is such a big moment to see Nike's decline
00:15:23.560 And the turn of events for a company that only five years ago posted a share price of $177.51, its highest ever.
00:15:34.160 The company made no friends when in 18 it decided to monetize the controversy.
00:15:38.500 And that is a clear data point.
00:15:41.120 They monetized the controversy surrounding the anthem kneeling demonstrations of Colin Kaepernick.
00:15:46.820 They signed him as a prominent figure in Nike's marketing campaigns.
00:15:51.100 Now, Kaepernick also played his last NFL game in 2016, and this led many to suspect that Nike's decision to sign him in 2018 was not because he was playing anymore.
00:16:03.100 He wasn't. It was solely to monetize the anger he created among those sympathetic to his cause.
00:16:09.880 Now, Kaepernick defenders long insisted that his anthem kneeling was not anti-American.
00:16:14.920 That case became much harder to make in 2019 when Kaepernick publicly criticized Nike for its Betsy Ross shoe.
00:16:24.220 Now, that shoe, which was created to be marketed to customers during the 4th of July celebration that year,
00:16:29.900 harkened back to the design of the famous Revolutionary War era Betsy Ross flag with 13 stars in a circle against a blue backdrop.
00:16:39.420 Kaepernick decided this symbol represented a time when blacks were still enslaved.
00:16:43.500 And then he went on a tantrum, demanding that it not be sold.
00:16:48.520 What happened?
00:16:49.540 Nike caved into his demands, and they pulled the shoe all together.
00:16:54.240 Now, the point of this story is pretty simple.
00:16:57.300 It was sad.
00:16:58.400 It was predictable.
00:16:59.840 Nike didn't just lose Cinder Cruz or Ben Ferguson or anybody else.
00:17:04.440 They just lost the entire country that loved Nike because they alienated their core market audience.
00:17:13.120 And when you go anti-American, you may not see it right away in your stock.

00:17:21.640 what has happened is Americans walked away from the woke agenda of Nike.
