00:00:00.000 This is an iHeart Podcast.
00:00:02.660 Guaranteed human.
00:00:04.260 Welcome.
00:00:04.920 It is Verdict with Senator Ted Cruz, Ben Ferguson with you.
00:00:07.940 Nice to have you with us wherever you are around the country,
00:00:10.180 especially if you're listening on radio right now as well.
00:00:13.260 We've got a packed show.
00:00:15.140 And Senator, I don't even know if you thought that it was going to be all about you
00:00:19.660 with the James Comey indictment.
00:00:22.560 He has been indicted for alleged false statements,
00:00:24.900 obstruction of congressional proceedings.
00:00:26.620 This is obviously, as you would say, a big damn deal.
00:00:31.060 And the clip of you talking to James Comey is what everyone's playing on TV right now.
00:00:36.780 Well, Ben, it's a momentous day.
00:00:38.480 The former director of the FBI, James Comey, has been indicted on two counts
00:00:41.960 of lying to Congress under oath.
00:00:45.040 And lying to Congress under oath, to be clear,
00:00:47.840 in response to questioning from me in front of the Senate Judiciary Committee.
00:00:52.240 The grand jury has indicted him.
00:00:54.020 He's facing prosecution, and we are seeing the media losing their minds.
00:00:58.580 The media is letting out a primal scream of horror.
00:01:03.060 The Democrats are horrified.
00:01:05.360 We're going to break down exactly why James Comey has been indicted.
00:01:09.340 We're going to give you the factual predicate.
00:01:10.860 We're going to give you the legal predicate.
00:01:13.040 And I will tell you, James Comey is defending himself,
00:01:16.240 and he's defending himself as a partisan, as someone who hates Donald Trump.
00:01:19.960 He is defending himself as if he were Chuck Schumer or Nancy Pelosi,
00:01:23.760 rather than actually addressing the facts that I believe demonstrated he committed,
00:01:29.080 deliberately committed felonies when he testified and falsely testified under oath to the United
00:01:34.200 States Senate.
00:01:35.240 We're going to give you all those details.
00:01:37.240 We're also going to talk about the tragic shooting that happened when a deranged
00:01:40.980 sniper targeted an ICE facility in Dallas, Texas.
00:01:44.540 I was on the ground there moments after the shooting occurred.
00:01:48.780 This is yet the latest instance of politically motivated violence and violence directed against
00:01:54.620 ICE agents and CBP and law enforcement.
00:01:58.480 This is getting worse and worse, and this must stop.
00:02:02.100 We're going to tell you exactly what happened and give you all the facts.
00:02:05.500 Yeah, it's certainly a very, very, very big story.
00:02:08.320 All of you know that I am a pro-Second Amendment guy.
00:02:11.560 I've shared on numerous occasions how carrying my firearms saved my life from a gang-related attack.
00:02:17.620 But for those of you out there with family members who may not be comfortable having a gun,
00:02:22.120 by their side, you still want them to be able to protect themselves and others in times of danger.
00:02:27.240 And that's where the Berna launcher comes in.
00:02:30.380 Berna is a handheld pistol that fires both kinetic rounds and chemical irritants to separate you from an attacker.
00:02:36.520 Berna is a handheld pistol that fires both kinetic rounds and chemical irritants to separate you from the attacker.
00:02:44.700 I'm here today with Josh Sherrard from Berna to share the true story of how a California homeowner
00:02:50.460 used a Berna launcher to stop a home intruder.
00:02:54.140 Josh, tell us what happened.
00:02:55.740 You know, Bob Brayton was one of the earliest adopters of Berna back when we first started.
00:02:59.580 He lived in California in a residential suburb of L.A. that was pretty prone to a lot of vagrancy,
00:03:05.540 a lot of homeless walking up and down the street.
00:03:07.720 He kept a Berna in his living room, and one of these vagrants wandered in his home,
00:03:11.440 just confused, probably drunk and intoxicated, in the wrong house.
00:03:15.560 Bob was able to pull his Berna out, point it at the intruder,
00:03:19.240 who promptly backed out of the home, back into the yard.
00:03:22.440 And, of course, it was all caught on surveillance.
00:03:24.140 He didn't even have to use the Berna, and he was able to ward off this intruder
00:03:28.840 in a situation that could have ended incredibly badly had more force been used.
00:03:34.400 This is a great demonstration of how the lowest level of force can be used to rectify a situation.
00:03:39.600 And, of course, it was all caught on video,
00:03:41.380 which makes for a great illustration of how that Berna can be used on a day-to-day basis.
00:03:46.500 There's a lot of people that are going to say,
00:03:47.640 well, why wouldn't the homeowner just use a gun in this case?
00:03:50.540 Yeah, well, one, it comes down to legality.
00:03:52.440 You know, in this part of California, it may be very difficult to use a gun.
00:03:56.740 And then, two, we saw this intruder literally just stumbled into the wrong home
00:04:02.440 in an altered state of mind.
00:04:04.340 Nobody wants to kill anybody that doesn't need killing,
00:04:07.900 that they absolutely don't have to.
00:04:10.000 So this is a great instance where the Berna was able to be used,
00:04:12.960 the lowest level of less lethal force was able to use to rectify the situation
00:04:16.420 without bringing a gun into that situation.
00:04:19.220 Yeah, I tell you, I have one of these.
00:04:21.280 My family members do as well.
00:04:22.720 A lot of my friends, if you want more information on how you or a family member
00:04:27.400 can protect themselves with a Berna launcher, go to BernaByrna.com.
00:04:33.600 That's Berna.com, B-Y-R-N-A.com.
00:04:36.980 Again, protect yourself and your family.
00:04:39.580 Berna, B-Y-R-N-A.com.
00:04:41.920 All right, so Senator, I want to start with this clip,
00:04:46.140 and I think this is a great starting point for this indictment of the former FBI director, James Comey.
00:04:52.200 This is you questioning, Comey, back in September of 2020.
00:04:58.640 This is the back and forth between the two of you, everyone listening.
00:05:02.600 This is really an important part of history now and going to probably be an important part of this case.
00:05:07.540 Let's go to another topic.
00:05:09.760 On May 3rd, 2017, in this committee, Chairman Grassley asked you point blank,
00:05:15.880 quote, have you ever been an anonymous source in news reports
00:05:19.520 about matters relating to the Trump investigation or the Clinton investigation?
00:05:24.040 You responded under oath, quote, never.
00:05:27.740 He then asked you, quote,
00:05:29.440 have you ever authorized someone else at the FBI to be an anonymous source
00:05:33.340 in news reports about the Trump investigation or the Clinton administration?
00:05:38.100 You responded again under oath, no.
00:05:41.100 Now, as you know, Mr. McCabe, who works for you,
00:05:44.200 has publicly and repeatedly stated
00:05:46.540 that he leaked information to the Wall Street Journal
00:05:50.160 and that you were directly aware of it
00:05:52.260 and that you directly authorized it.
00:05:54.780 Now, what Mr. McCabe is saying
00:05:58.340 and what you testified to this committee cannot both be true.
00:06:02.060 One or the other is false.
00:06:04.440 Who's telling the truth?
00:06:06.400 I can only speak to my testimony.
00:06:08.260 I stand by what the testimony you summarized
00:06:10.760 that I gave in May of 2017.
00:06:12.860 So your testimony is you've never authorized anyone to leak.
00:06:16.580 And Mr. McCabe, if he says contrary, is not telling the truth.
00:06:19.680 Is that correct?
00:06:20.840 Again, I'm not going to characterize Andy's testimony,
00:06:22.860 but mine is the same today.
00:06:24.780 All right, I'm going to make a final point because my time has expired.
00:06:28.400 This investigation of the president was corrupt.
00:06:31.120 The FBI and the Department of Justice were politicized and weaponized.
00:06:35.580 And in my opinion, there are only two possibilities.
00:06:38.720 That you were deliberately corrupt or woefully incompetent.
00:06:42.780 And I don't believe you were incompetent.
00:06:45.220 This has done severe damage to the professionals
00:06:48.960 and the honorable men and women at the FBI
00:06:51.120 because law enforcement should not be used as a political weapon.
00:06:56.180 All right, so you listen to that
00:06:58.380 and then you look at the indictment.
00:07:00.560 Count one, false statement to the U.S. Senate
00:07:02.620 that he had not, quote,
00:07:04.300 authorized someone else at the FBI to be an anonymous news source.
00:07:08.580 Count two,
00:07:09.720 Comey obstructed the Senate Judiciary Committee's investigation
00:07:12.080 investigation through his, quote,
00:07:13.740 false and misleading statements.
00:07:16.540 That is a big smoking gun.
00:07:19.240 Well, it is.
00:07:20.200 It's the basis of the indictment.
00:07:21.820 And this will be the central focus of the trial.
00:07:25.740 Now, James Comey put out a statement tonight on Instagram.
00:07:28.720 And his statement is striking in that it is a political statement.
00:07:32.480 It is not a statement about the facts or the law.
00:07:35.560 So give a listen to what James Comey said this evening
00:07:38.080 in response to the indictment.
00:07:39.980 My family and I have known for years
00:07:42.140 that there are costs to standing up to Donald Trump.
00:07:46.140 But we couldn't imagine ourselves living any other way.
00:07:50.220 We will not live on our knees.
00:07:52.440 And you shouldn't either.
00:07:54.580 Somebody that I love dearly recently said
00:07:57.400 that fear is the tool of a tyrant.
00:08:00.520 And she's right.
00:08:02.460 But I'm not afraid.
00:08:04.540 And I hope you're not either.
00:08:06.320 I hope instead you are engaged.
00:08:09.120 You are paying attention.
00:08:10.760 And you will vote like your beloved country depends upon it.
00:08:15.700 Which it does.
00:08:17.640 My heart is broken for the Department of Justice.
00:08:21.280 But I have great confidence in the federal judicial system.
00:08:24.940 And I'm innocent.
00:08:25.560 So let's have a trial.
00:08:28.360 I love how he is a victim there
00:08:32.000 and acting like he's above all of this.
00:08:34.600 But Senator, let's just go back to 3.30 of 23.
00:08:39.020 James Comey tweeted out,
00:08:41.120 quote,
00:08:41.480 It's been a good day.
00:08:43.680 That is how he reacted to Trump being indicted
00:08:45.960 in the Alvin Bragg hush money case.
00:08:48.340 So to act like he's some sort of guy that's above all this,
00:08:51.340 look at his own words.
00:08:52.280 Well, his statement he put out in response to this,
00:08:55.740 that could have been given by Chuck Schumer or Nancy Pelosi
00:08:58.700 or Keem Jeffries or any other political Democrat.
00:09:02.080 And in fact, he makes a call,
00:09:04.320 come out and vote.
00:09:05.100 It's a get out the vote message.
00:09:06.480 This is a former director of the FBI.
00:09:09.400 But to give you a sense of just how much he loathes Donald Trump,
00:09:14.060 this is a former director of the FBI who tweeted out to the world
00:09:17.320 a picture of shells spelling out 8647,
00:09:22.040 in other words, slang for kill,
00:09:23.760 the current president of the United States, Donald J. Trump.
00:09:26.120 To say calling for the murder of the sitting president
00:09:30.000 is not appropriate for the former FBI director,
00:09:33.300 in an ordinary time,
00:09:34.940 that would be such an obvious statement
00:09:36.700 that no one would even think to say it.
00:09:39.640 But that's just how much James Comey loathes Donald Trump.
00:09:44.700 And understand,
00:09:45.780 when Trump became president the first time,
00:09:49.500 in January of 2017,
00:09:51.100 President Trump unfortunately made a serious mistake,
00:09:55.500 which is he left James Comey in office.
00:09:58.420 In hindsight,
00:09:59.760 on January 20th, 2017,
00:10:02.320 President Trump should have called James Comey
00:10:04.140 and said,
00:10:04.540 thank you for your service to the nation.
00:10:06.000 Your services are no longer required.
00:10:08.200 I am certain President Trump wishes he had done that.
00:10:12.140 I think the White House team believed
00:10:14.320 that Comey could focus on law enforcement,
00:10:16.840 could not be politicized.
00:10:18.420 And that assumption proved to be in error.
00:10:23.560 James Comey presided over weaponizing
00:10:26.460 and politicizing the FBI.
00:10:28.580 He was part of weaponizing
00:10:30.100 and politicizing the Department of Justice.
00:10:33.120 And it was because they hated Donald Trump.
00:10:36.840 And frankly, they were angry at the American people
00:10:39.060 for electing him in 2016.
00:10:41.140 And so the FBI set out
00:10:43.240 to try to attack
00:10:46.060 and to try to ultimately remove from office
00:10:48.500 the President of the United States.
00:10:50.740 Now, again,
00:10:52.000 this should not bear saying,
00:10:55.760 but it is not the job of law enforcement
00:10:58.020 to determine the will of the voters is wrong
00:11:01.100 and the elected president
00:11:02.840 should no longer be president.
00:11:04.200 But that's what Comey presided over.
00:11:06.400 And so when I listen to him say,
00:11:07.920 I weep for the Department of Justice,
00:11:10.300 it really is,
00:11:11.660 you know,
00:11:11.880 there's a Yiddish word,
00:11:12.900 chutzpah.
00:11:13.440 And I got to say,
00:11:14.640 James Comey really ought to have a T-shirt
00:11:16.700 with that printed on it
00:11:17.940 because he is grieving
00:11:20.280 for the Department of Justice.
00:11:21.800 Why?
00:11:22.740 Because he has been indicted
00:11:24.200 for what I think is clearly a felony.
00:11:26.940 And we're going to break down
00:11:28.160 in just minutes
00:11:28.900 why exactly this is a felony,
00:11:31.700 what the crime is.
00:11:32.660 And I want to point out,
00:11:34.400 nowhere in his statement
00:11:35.720 does Comey get into the actual facts.
00:11:38.880 Nowhere in the statement
00:11:39.740 does he get into what he did.
00:11:40.940 Nowhere in the statement
00:11:42.460 does he get into the law.
00:11:44.040 He just gives a political statement.
00:11:46.400 He will not be on his knees.
00:11:48.100 He calls Trump a tyrant
00:11:49.400 who is ruling by fear.
00:11:51.420 Look,
00:11:51.860 this is an indictment
00:11:52.940 that was returned
00:11:53.720 by a grand jury
00:11:54.780 in the Commonwealth of Virginia.
00:11:56.660 And it was returned
00:11:57.780 because of,
00:12:00.360 I believe,
00:12:01.080 clear evidence
00:12:01.700 demonstrating Comey
00:12:02.720 committed felonies.
00:12:04.400 Canadian women
00:12:05.160 are looking for more.
00:12:06.500 More out of themselves,
00:12:07.560 their businesses,
00:12:08.480 their elected leaders,
00:12:09.280 and the world around them.
00:12:10.680 And that's why we're thrilled
00:12:11.640 to introduce
00:12:12.280 The Honest Talk Podcast.
00:12:14.320 I'm Jennifer Stewart.

00:12:25.160 of their journey.

00:12:33.600 Senator,
00:12:36.480 I want to bring up
00:12:37.720 a point
00:12:38.320 that like
00:12:39.300 no one in the media
00:12:40.820 has brought up
00:12:41.700 so far
00:12:42.420 about this indictment.
00:12:44.740 And I brought it up
00:12:45.620 on CNN
00:12:46.100 and they were like
00:12:47.240 all deer in headlights.
00:12:49.300 There is something
00:12:50.220 about this case
00:12:51.440 and they were saying,
00:12:52.000 oh,
00:12:52.100 this is just political retribution
00:12:53.640 by Donald Trump
00:12:54.620 that clearly
00:12:56.120 they weren't going
00:12:57.220 to bring this case.
00:12:58.220 He had to fire
00:12:58.880 the person in charge
00:12:59.840 of this office
00:13:00.600 in Virginia,
00:13:01.460 had to put in somebody
00:13:02.680 that would weaponize
00:13:03.800 the DOJ.
00:13:05.660 Here's a fact
00:13:06.480 that most people
00:13:07.000 don't know.
00:13:08.480 James Comey's
00:13:10.040 own son-in-law
00:13:11.440 was literally
00:13:12.140 inside the prosecutor's
00:13:13.880 office
00:13:14.420 that was tasked,
00:13:17.000 just think about this,
00:13:18.100 with indicting
00:13:18.860 his father-in-law.
00:13:21.640 And so
00:13:22.080 when you sit there
00:13:23.100 and I look at this,
00:13:23.900 I'm like,
00:13:24.180 man,
00:13:24.460 the deep state
00:13:24.980 got together
00:13:25.620 to protect James Comey
00:13:26.800 at all costs.
00:13:27.820 And as soon as
00:13:28.820 the indictment came out
00:13:30.300 later in the day,
00:13:31.060 James Comey's
00:13:32.900 son-in-law
00:13:33.500 then gave his
00:13:34.700 resignation letter
00:13:35.880 because I guess
00:13:36.480 he just couldn't
00:13:37.080 stop what was
00:13:37.740 inevitable.
00:13:38.940 Well,
00:13:39.480 and look,
00:13:40.020 I think what should
00:13:40.640 govern this case
00:13:41.660 is the facts
00:13:43.100 and the law.
00:13:44.080 And I believe
00:13:45.200 James Comey
00:13:45.760 should have been
00:13:46.220 indicted five years ago.
00:13:48.380 And indeed,
00:13:48.860 I called upon him
00:13:49.820 to be indicted
00:13:50.440 five years ago.
00:13:51.260 So let me lay out
00:13:51.820 the facts.
00:13:52.460 And in December
00:13:53.260 of 2020,
00:13:54.540 so the questioning
00:13:55.400 that we played
00:13:56.160 in the first segment
00:13:57.220 was from September
00:13:58.500 30th of 2020.
00:13:59.580 And by the way,
00:14:00.300 the reason
00:14:00.900 the indictment
00:14:02.040 was brought right now
00:14:03.060 is the statute
00:14:03.620 of limitations
00:14:04.180 was going to run
00:14:05.040 next week.
00:14:05.740 And so they had
00:14:06.400 to bring it
00:14:06.880 before the end
00:14:07.460 of the statute
00:14:07.920 of limitations
00:14:08.520 or they would not
00:14:09.660 be able to charge him.
00:14:10.980 But on December
00:14:12.220 10th of 2020,
00:14:13.500 here's the letter
00:14:14.180 that I sent
00:14:14.940 to Bill Barr,
00:14:16.660 then the Attorney
00:14:17.160 General of the
00:14:17.780 United States,
00:14:19.120 and Christopher Wray,
00:14:20.520 who was then
00:14:21.160 the director
00:14:21.960 of the FBI.
00:14:24.320 Days before
00:14:25.100 the presidential
00:14:25.700 election in 2016,
00:14:27.740 a Wall Street
00:14:28.420 Journal article
00:14:29.140 quoted an anonymous
00:14:30.080 source confirming
00:14:31.020 the existence
00:14:31.720 of a probe
00:14:32.580 into Hillary Clinton's
00:14:34.140 use of a private
00:14:35.060 email server
00:14:35.920 while serving
00:14:36.920 as Secretary of State.
00:14:38.500 An investigation
00:14:39.400 that up to that point,
00:14:40.980 Mr. Comey
00:14:41.520 and the FBI
00:14:42.120 declined to confirm.
00:14:44.000 We now know
00:14:44.920 that this leak
00:14:46.100 was authorized
00:14:46.820 by then Deputy Director
00:14:48.840 of the FBI,
00:14:50.360 Andrew McCabe.
00:14:51.860 Mr. McCabe
00:14:52.580 initially told
00:14:53.340 FBI agents
00:14:54.140 under oath
00:14:54.720 that he did not
00:14:55.840 authorize the leak
00:14:56.780 and he did not
00:14:57.640 know who did.
00:14:59.340 But when confronted
00:15:00.280 later with contrary
00:15:01.540 evidence,
00:15:02.720 he confessed
00:15:03.320 both to knowing
00:15:04.160 about
00:15:04.560 and authorizing
00:15:06.680 the leak.
00:15:07.980 We do not know,
00:15:09.280 however,
00:15:10.160 whether
00:15:10.440 and to what extent
00:15:11.820 then FBI Director
00:15:13.100 Comey
00:15:13.540 was aware of
00:15:15.020 and authorized
00:15:15.600 this leak
00:15:16.300 after the fact.
00:15:17.880 Mr. McCabe
00:15:18.720 has repeatedly stated
00:15:20.000 that Mr. Comey
00:15:21.740 knew of
00:15:22.500 and effectively
00:15:23.160 authorized the leak
00:15:24.400 by approving it.
00:15:25.920 He told the Office
00:15:27.080 of Inspector General
00:15:28.140 that,
00:15:28.840 quote,
00:15:29.400 he and Comey
00:15:30.040 discussed the
00:15:30.960 October 30th
00:15:31.860 Wall Street Journal
00:15:32.540 article in person
00:15:33.520 on October 31st,
00:15:35.580 2016,
00:15:37.020 and that at that
00:15:38.740 meeting,
00:15:39.240 quote,
00:15:39.920 he told Comey
00:15:40.880 that he had
00:15:41.900 authorized
00:15:42.680 AD slash OPA
00:15:44.280 and special counsel
00:15:45.260 to disclose
00:15:46.560 the account
00:15:47.320 of the August 12th
00:15:48.320 call
00:15:48.620 and did not
00:15:49.980 say anything
00:15:51.020 in any way
00:15:51.760 to suggest
00:15:52.860 that it was
00:15:53.280 unauthorized.
00:15:54.880 According to
00:15:55.660 Mr. McCabe,
00:15:56.920 Mr. Comey,
00:15:57.700 quote,
00:15:58.320 did not react
00:15:59.160 negatively,
00:16:00.380 just kind of
00:16:01.040 accepted it,
00:16:02.180 and, quote,
00:16:02.980 thought it was
00:16:03.620 a good idea
00:16:04.860 that they presented
00:16:07.080 this information
00:16:07.940 to the media.
00:16:09.420 He again reiterated
00:16:10.880 Mr. Comey's
00:16:11.560 involvement
00:16:11.980 at a hearing
00:16:12.620 last month
00:16:13.360 at the Senate
00:16:14.140 Judiciary Committee.
00:16:15.740 I asked Mr. McCabe,
00:16:17.680 according to
00:16:18.200 The Washington Times,
00:16:19.940 April 18th,
00:16:20.820 2018,
00:16:22.580 Mr. McCabe
00:16:23.260 insisted that he
00:16:24.080 told his boss
00:16:24.780 that he had
00:16:25.280 authorized disclosure
00:16:26.440 about the
00:16:26.920 Clinton investigation,
00:16:28.240 but Mr. Comey
00:16:29.460 has denied
00:16:30.000 this claim,
00:16:31.060 and Mr. McCabe
00:16:32.300 told investigators
00:16:33.260 that Mr. Comey
00:16:34.120 knew he had
00:16:35.280 authorized disclosure
00:16:36.300 and agreed it
00:16:36.900 was a good idea.
00:16:38.520 Is that accurate?
00:16:40.640 Is that your
00:16:41.380 testimony to this
00:16:42.380 committee?
00:16:43.640 Mr. McCabe
00:16:44.440 replied,
00:16:45.380 that is my
00:16:46.780 recollection.
00:16:48.360 Mr. Comey,
00:16:49.240 however,
00:16:50.100 has sworn under
00:16:51.040 oath that he
00:16:51.900 has neither
00:16:52.440 authorized the leak
00:16:53.620 nor knew of
00:16:54.340 Mr. McCabe's
00:16:55.120 involvement.
00:16:56.500 At a May 2017
00:16:57.500 hearing before
00:16:58.360 the Senate
00:16:58.700 Judiciary Committee,
00:17:00.360 Senator Grassley
00:17:01.080 asked Mr. Comey,
00:17:03.220 have you ever
00:17:03.700 been an anonymous
00:17:04.420 source in news
00:17:05.680 reports about
00:17:06.380 matters relating
00:17:07.180 to the Trump
00:17:07.700 investigation
00:17:08.400 or the Clinton
00:17:09.540 investigation?
00:17:10.980 Mr. Comey
00:17:11.860 replied,
00:17:12.980 never.
00:17:14.640 Senator Grassley
00:17:15.760 then asked,
00:17:16.900 have you ever
00:17:17.480 authorized someone
00:17:18.560 else at the FBI
00:17:19.580 to be an
00:17:20.460 anonymous source
00:17:21.320 in news
00:17:21.820 reports about
00:17:22.440 the Trump
00:17:22.780 investigation
00:17:23.500 or the
00:17:24.460 Clinton
00:17:24.680 administration?
00:17:26.000 He testified,
00:17:27.720 no.
00:17:28.960 And this
00:17:29.640 October,
00:17:30.440 at a Senate
00:17:30.820 Judiciary
00:17:31.280 Committee
00:17:31.600 hearing,
00:17:32.760 Mr. Comey
00:17:33.280 testified in
00:17:34.020 response to
00:17:34.640 my questioning,
00:17:35.800 quote,
00:17:36.480 I stand by
00:17:37.660 the testimony
00:17:38.280 that you
00:17:38.800 summarized that
00:17:39.540 I gave in
00:17:40.120 May of
00:17:40.440 2017.
00:17:42.280 Mr. Comey's
00:17:43.200 denial in
00:17:44.020 front of the
00:17:44.460 Senate is
00:17:44.940 consistent with
00:17:45.800 his statement
00:17:46.280 to the OIG.
00:17:46.980 He told
00:17:48.500 the OIG
00:17:49.160 that,
00:17:49.880 quote,
00:17:50.520 he recalled
00:17:51.240 seeing this
00:17:51.900 article,
00:17:52.680 but he did
00:17:53.200 not know
00:17:53.820 how the
00:17:54.200 disclosure
00:17:54.720 about the
00:17:55.280 paydag call
00:17:56.100 in the
00:17:56.740 October 30
00:17:57.500 article
00:17:58.060 happened.
00:17:59.260 He said
00:17:59.980 that he
00:18:00.200 was,
00:18:00.740 quote,
00:18:00.780 very concerned
00:18:01.680 about that
00:18:02.460 part of
00:18:02.800 the article.
00:18:04.400 Comey
00:18:04.660 told OIG
00:18:05.480 he considered
00:18:06.220 the disclosure
00:18:06.920 about the
00:18:07.440 paydag's
00:18:07.960 call problematic
00:18:08.840 because it
00:18:10.080 related to
00:18:10.720 sensitive FBI
00:18:11.700 information.
00:18:13.080 The OIG
00:18:14.100 report
00:18:14.600 continues,
00:18:15.480 quote,
00:18:15.760 according to
00:18:17.100 Comey,
00:18:17.800 he discussed
00:18:18.560 the issue
00:18:18.980 with McCabe
00:18:19.560 after the
00:18:20.040 article was
00:18:20.520 published,
00:18:21.360 and at the
00:18:21.940 time,
00:18:22.900 McCabe,
00:18:23.600 quote,
00:18:24.440 definitely did
00:18:25.620 not tell me
00:18:26.440 that he
00:18:26.800 authorized the
00:18:27.800 disclosure of
00:18:28.560 the paydag
00:18:29.040 call.
00:18:30.460 Comey said
00:18:30.980 that McCabe
00:18:31.560 gave him
00:18:32.140 the exact
00:18:32.900 opposite
00:18:33.740 impression.
00:18:35.520 Mr. Comey
00:18:36.080 asserted that
00:18:36.660 he took
00:18:37.080 from whatever
00:18:37.620 communication
00:18:38.300 they had
00:18:38.860 that Mr.
00:18:39.340 McCabe
00:18:39.680 wasn't involved
00:18:40.460 in the
00:18:41.220 leak.
00:18:42.180 And here's
00:18:42.740 what's
00:18:42.940 critical.
00:18:43.240 Mr.
00:18:44.620 Comey
00:18:44.900 and Mr.
00:18:46.160 McCabe's
00:18:46.620 statements
00:18:46.960 are
00:18:47.480 irreconcilably
00:18:49.000 contradictory.
00:18:50.700 Mr.
00:18:50.980 McCabe
00:18:51.320 says that
00:18:51.820 he told
00:18:52.240 Mr.
00:18:52.640 Comey
00:18:52.860 of the
00:18:53.080 leak
00:18:53.340 and that
00:18:53.820 Mr.
00:18:54.140 Comey
00:18:54.380 approved,
00:18:55.440 effectively
00:18:56.020 authorizing
00:18:56.960 the leak
00:18:57.340 after the
00:18:57.800 fact.
00:18:58.900 Mr.
00:18:59.180 Comey,
00:18:59.480 on the
00:18:59.640 other hand,
00:19:00.580 has said
00:19:01.100 that he
00:19:01.360 neither
00:19:01.620 authorized
00:19:02.300 the leak
00:19:02.760 nor knew
00:19:03.360 of Mr.
00:19:03.980 McCabe's
00:19:04.460 involvement.
00:19:05.900 One of
00:19:06.480 them is
00:19:07.540 lying under
00:19:08.400 oath,
00:19:08.860 a federal
00:19:09.300 crime,
00:19:10.280 18 U.S.C.
00:19:11.260 Section 1621.
00:19:13.320 The
00:19:13.540 American
00:19:14.080 people
00:19:14.680 deserve
00:19:15.280 to know
00:19:16.260 who.
00:19:17.800 Those are
00:19:18.340 the facts,
00:19:19.220 and it
00:19:19.740 is a
00:19:20.040 simple
00:19:20.460 binary
00:19:21.520 choice.
00:19:23.000 Either
00:19:23.240 James
00:19:23.680 Comey
00:19:24.120 lied
00:19:25.000 under
00:19:25.260 oath
00:19:25.500 and
00:19:25.660 committed
00:19:25.900 a
00:19:26.100 felony,
00:19:26.740 or
00:19:27.320 Andrew
00:19:27.720 McCabe
00:19:28.260 lied
00:19:28.920 under
00:19:29.200 oath
00:19:29.460 or
00:19:29.620 committed
00:19:29.900 a
00:19:30.100 felony,
00:19:30.360 because
00:19:30.660 what
00:19:30.860 they
00:19:31.020 said
00:19:31.320 is
00:19:31.480 precisely
00:19:32.000 opposite.
00:19:32.760 There
00:19:32.840 is
00:19:32.980 not
00:19:33.200 a
00:19:33.320 world
00:19:33.580 in
00:19:33.760 which
00:19:33.960 neither
00:19:34.300 of
00:19:34.520 them
00:19:34.660 committed
00:19:34.940 a
00:19:35.120 felony,
00:19:35.400 and
00:19:36.200 the
00:19:36.320 only
00:19:36.540 choice
00:19:36.980 is
00:19:37.280 which
00:19:37.800 one
00:19:38.180 broke
00:19:38.640 the
00:19:38.860 law.
00:19:39.560 By
00:19:39.940 bringing
00:19:40.220 this
00:19:40.500 indictment,
00:19:41.000 obviously,
00:19:42.460 of
00:19:42.640 justice
00:19:42.940 has
00:19:43.160 determined
00:19:43.540 it
00:19:43.800 was
00:19:44.040 James
00:19:44.760 Comey
00:19:45.220 who
00:19:46.220 lied
00:19:46.720 under
00:19:47.080 oath
00:19:47.420 and
00:19:47.580 broke
00:19:47.800 the
00:19:47.980 law,
00:19:48.220 and
00:19:48.280 that's
00:19:48.460 what
00:19:48.580 the
00:19:48.720 trial
00:19:48.960 will
00:19:49.100 be
00:19:49.200 all
00:19:49.340 about.
00:19:50.240 You've
00:19:50.680 got a lot
00:19:51.000 of
00:19:51.140 choices
00:19:51.480 for
00:19:51.760 cell
00:19:52.060 phone
00:19:52.280 service
00:19:52.720 with
00:19:53.060 new
00:19:53.320 ones
00:19:53.560 popping
00:19:53.940 up
00:19:54.160 all
00:19:54.340 the
00:19:54.520 time,
00:19:55.040 but
00:19:55.400 here's
00:19:55.640 the
00:19:55.760 truth,
00:19:56.120 there's
00:19:56.300 only
00:19:56.520 one
00:19:56.940 that
00:19:57.140 stands
00:19:57.440 boldly
00:19:58.020 in
00:19:58.120 the
00:19:58.240 gap
00:19:58.480 for
00:19:58.700 every
00:19:59.180 American
00:19:59.660 that
00:20:00.260 believes
00:20:00.580 that
00:20:01.020 freedom
00:20:01.520 is
00:20:02.020 worth
00:20:02.220 fighting
00:20:02.560 for,
00:20:03.240 and
00:20:03.300 that's
00:20:03.560 Patriot
00:20:04.040 Mobile.
00:20:04.800 And
00:20:04.900 every
00:20:05.160 time,
00:20:05.700 if you're
00:20:05.960 a member
00:20:06.340 of
00:20:06.520 Patriot

00:20:07.600 you make
00:20:08.100 a phone
00:20:08.420 call,
00:20:08.800 you send
00:20:09.080 a text,
00:20:09.600 you pay
00:20:09.920 your bill,
00:20:10.700 you're
00:20:11.100 making a
00:20:11.600 difference
00:20:11.940 setting up
00:20:12.320 for what
00:20:12.840 you and
00:20:13.600 I believe
00:20:14.100 in.
00:20:14.720 Because
00:20:15.080 Patriot

00:20:17.920 each
00:20:18.580 and
00:20:18.880 every
00:20:19.200 month,
00:20:19.560 and they
00:20:19.740 give it
00:20:19.980 back
00:20:20.260 to
00:20:20.480 organizations
00:20:21.120 and
00:20:21.480 causes
00:20:21.920 that
00:20:22.540 support
00:20:22.940 our
00:20:23.120 First

00:20:23.920 rights,
00:20:24.340 our
00:20:24.420 Second

00:20:26.840 our

00:20:27.780 our
00:20:27.900 wounded
00:20:28.260 warriors.
00:20:28.800 That is
00:20:30.080 why I
00:20:30.480 love
00:20:30.760 being
00:20:31.220 with
00:20:31.420 Patriot

00:20:32.420 And if
00:20:32.620 you're
00:20:32.740 worried
00:20:32.900 about
00:20:33.100 coverage,
00:20:33.760 don't
00:20:34.200 be.

00:20:37.620 so if
00:20:37.940 you've
00:20:38.140 got
00:20:38.280 service
00:20:38.700 right
00:20:38.980 now,
00:20:39.600 well,
00:20:39.880 you're
00:20:40.000 going
00:20:40.080 to
00:20:40.120 have
00:20:40.280 as
00:20:40.440 good
00:20:40.620 or
00:20:40.780 better

00:20:41.580 coverage
00:20:41.960 with
00:20:42.220 Patriot
00:20:42.640 Mobile.
00:20:43.120 And if
00:20:43.480 you think
00:20:43.860 switching
00:20:44.280 is a
00:20:44.640 hassle,
00:20:45.140 not
00:20:45.480 anymore.
00:20:46.340 When
00:20:46.620 you switch,
00:20:47.220 it's
00:20:47.380 easy.
00:20:47.720 You keep
00:20:48.060 your
00:20:48.200 same

00:20:49.520 you've
00:20:49.720 got,
00:20:49.920 or
00:20:50.040 upgrade
00:20:50.380 to
00:20:50.540 a
00:20:50.660 new
00:20:50.780 one.
00:20:51.440 And
00:20:51.520 Patriot
00:20:51.960 Mobile
00:20:52.180 has a

00:20:57.240 minutes from
00:20:57.820 the comfort
00:20:58.200 of your
00:20:58.480 home or
00:20:59.060 your office.
00:21:00.100 And if
00:21:00.340 you're stuck
00:21:00.680 in a
00:21:00.880 contract or
00:21:01.500 owe money
00:21:01.840 on your
00:21:02.100 phones,
00:21:02.520 no worries.
00:21:03.580 Patriot

00:21:06.540 This is
00:21:07.240 how we
00:21:07.620 win,
00:21:08.000 folks,
00:21:08.280 by aligning
00:21:08.760 our spending
00:21:09.420 with our
00:21:09.800 values and
00:21:10.560 every dollar
00:21:11.160 we spend
00:21:11.740 matters.
00:21:12.880 So make
00:21:13.460 the switch
00:21:14.060 and stand
00:21:14.400 up for
00:21:14.600 what you

00:21:34.880 All right,
00:21:35.180 Senator,
00:21:35.520 so here's
00:21:36.140 what I've
00:21:36.480 been hearing
00:21:37.180 online from
00:21:39.120 the media.
00:21:39.520 They're like,
00:21:39.940 hey,
00:21:40.380 Donald Trump
00:21:41.060 weighed in
00:21:41.440 on this
00:21:41.700 too much.
00:21:42.440 They're going
00:21:42.720 to get this
00:21:43.140 thing kicked
00:21:43.600 out before
00:21:44.060 it even
00:21:44.300 goes to
00:21:44.600 a judge.
00:21:45.420 This is
00:21:45.960 a waste
00:21:46.560 of the
00:21:46.840 American
00:21:47.120 taxpayers
00:21:47.640 dollars.
00:21:48.760 And then
00:21:49.040 if that's
00:21:49.660 not enough,
00:21:50.160 they say,
00:21:51.040 well,
00:21:51.380 no one
00:21:51.960 ever gets
00:21:52.620 indicted
00:21:53.120 and they
00:21:53.560 actually go
00:21:54.100 forward and
00:21:54.860 get a
00:21:55.080 conviction on
00:21:55.640 someone lying
00:21:56.060 to Congress
00:21:56.540 because,
00:21:57.260 well,
00:21:57.360 a lot of
00:21:57.620 people lie
00:21:58.060 to Congress
00:21:58.560 and even
00:21:59.020 if you
00:21:59.240 did lie,
00:21:59.660 it may
00:21:59.820 have been
00:21:59.980 a mistake.
00:22:00.560 This is
00:22:00.720 going to
00:22:00.800 be very
00:22:01.320 hard to
00:22:01.700 get a
00:22:01.900 conviction.
00:22:03.260 Break down
00:22:03.940 how this
00:22:04.400 could roll
00:22:05.020 out in
00:22:05.480 court.
00:22:05.900 What
00:22:06.040 could
00:22:06.200 happen?
00:22:07.540 Well,
00:22:07.800 at the
00:22:08.220 end of
00:22:08.460 the day,
00:22:08.840 the factual
00:22:09.300 predicate
00:22:09.880 behind this
00:22:10.740 crime is
00:22:11.540 not terribly
00:22:12.320 complicated.
00:22:13.020 As I
00:22:13.320 mentioned,
00:22:13.820 there's a
00:22:14.120 direct
00:22:14.380 contradiction
00:22:15.020 between
00:22:15.640 James Comey's
00:22:16.840 testimony under
00:22:17.960 oath before
00:22:18.640 the Senate
00:22:19.060 and Andrew
00:22:20.240 McCabe's
00:22:20.800 testimony under
00:22:21.700 oath before
00:22:22.440 the Senate.
00:22:23.720 They cannot
00:22:24.560 both be
00:22:25.380 true.
00:22:25.880 One or
00:22:26.440 the other
00:22:26.900 is deliberately
00:22:27.860 lying.
00:22:29.060 And how do
00:22:29.600 we know
00:22:29.900 which one
00:22:30.460 is likely
00:22:30.920 to be
00:22:31.220 lying?
00:22:31.720 Well,
00:22:32.160 the FBI
00:22:32.720 in all
00:22:33.820 likelihood
00:22:34.280 possesses the
00:22:35.280 information
00:22:35.820 that confirms
00:22:36.600 who's telling
00:22:37.140 the truth
00:22:37.640 and who's
00:22:38.800 lying.
00:22:39.320 Indeed,
00:22:39.580 if you
00:22:39.820 look at
00:22:40.380 the
00:22:41.000 account
00:22:42.400 of what
00:22:42.800 occurred,
00:22:43.840 McCabe
00:22:44.240 initially
00:22:44.800 told the
00:22:45.560 same lie
00:22:46.240 that Comey
00:22:47.440 did.
00:22:47.860 McCabe
00:22:48.120 initially
00:22:48.540 said he
00:22:49.560 didn't
00:22:49.780 leak the
00:22:50.140 information,
00:22:51.160 he didn't
00:22:52.040 authorize it,
00:22:52.800 and he
00:22:53.000 didn't know
00:22:53.380 who did.
00:22:54.120 But then
00:22:54.840 the FBI
00:22:56.360 Office of
00:22:57.100 Inspector
00:22:57.560 General
00:22:58.000 confronted
00:22:58.700 him with
00:22:59.840 contrary
00:23:00.460 evidence.
00:23:01.060 I don't
00:23:01.220 know what
00:23:01.500 the contrary
00:23:01.960 evidence is,
00:23:02.700 but they
00:23:02.940 put in
00:23:03.340 front of
00:23:03.720 him,
00:23:04.480 Mr.
00:23:04.740 McCabe,
00:23:05.140 you said
00:23:05.460 you didn't
00:23:05.740 leak this
00:23:06.160 information.
00:23:06.900 Well,
00:23:07.220 boom,
00:23:08.000 here's the
00:23:08.460 evidence to
00:23:08.920 the contrary.
00:23:09.480 And what
00:23:09.640 did McCabe
00:23:10.080 do?
00:23:11.080 Oh,
00:23:11.360 crap,
00:23:11.660 you got
00:23:11.920 me.
00:23:12.160 Okay,
00:23:12.420 you're
00:23:12.560 right.
00:23:13.280 I leaked
00:23:13.940 it.
00:23:14.620 I'm the
00:23:15.060 one who
00:23:15.300 did it.
00:23:16.340 And I
00:23:17.220 talked to
00:23:17.620 Comey about
00:23:18.120 it.
00:23:18.500 I told him
00:23:19.060 about it.
00:23:19.460 So he
00:23:19.780 admitted that
00:23:20.620 when he
00:23:20.880 was caught
00:23:21.440 in a
00:23:21.660 lie.
00:23:22.580 I don't
00:23:23.320 know
00:23:23.640 specifically
00:23:24.440 what
00:23:25.900 confirming
00:23:27.500 evidence the
00:23:28.260 FBI and
00:23:28.860 the Department
00:23:29.260 of Justice
00:23:29.740 has,
00:23:30.280 but they
00:23:30.540 have enough
00:23:31.340 that they
00:23:32.280 caused
00:23:32.860 McCabe
00:23:33.480 to reverse
00:23:34.240 his first
00:23:34.800 lie and
00:23:36.160 instead to
00:23:36.800 say,
00:23:37.080 yes,
00:23:37.500 he did
00:23:37.900 it and
00:23:38.580 Comey
00:23:38.900 knew about
00:23:39.340 it.
00:23:40.220 And so
00:23:40.600 between the
00:23:41.320 two,
00:23:42.140 you know,
00:23:42.400 it was
00:23:42.560 interesting when
00:23:43.060 I was
00:23:43.360 questioning
00:23:43.820 Comey,
00:23:45.200 he said a
00:23:45.740 couple of
00:23:46.100 times,
00:23:46.440 well,
00:23:46.600 I'm not
00:23:47.200 going to
00:23:47.440 characterize,
00:23:47.940 as he
00:23:48.440 put it,
00:23:48.780 Andy's
00:23:49.140 testimony.
00:23:50.200 Well,
00:23:50.480 I get
00:23:50.820 politically
00:23:51.360 that's a
00:23:51.820 smart move
00:23:52.360 not to
00:23:52.720 characterize
00:23:53.140 Andy's
00:23:53.720 testimony.
00:23:54.580 But you
00:23:55.120 know what?
00:23:55.560 His entire
00:23:56.340 legal defense
00:23:57.180 is going to
00:23:57.640 be McCabe
00:23:58.380 is lying
00:23:58.860 because he
00:23:59.540 doesn't have
00:23:59.860 an alternative.
00:24:00.540 That's his
00:24:01.100 only argument
00:24:01.720 is when
00:24:02.780 McCabe said
00:24:03.640 under oath
00:24:04.300 that I
00:24:05.940 knew about
00:24:06.400 it,
00:24:07.980 Comey's
00:24:08.300 defense team
00:24:08.860 is going to
00:24:09.200 have to
00:24:09.540 say McCabe
00:24:10.400 was lying.
00:24:11.020 And by the
00:24:11.280 way,
00:24:11.440 McCabe is going
00:24:11.980 to be the
00:24:12.240 star witness
00:24:12.820 at the
00:24:13.860 prosecution.
00:24:15.240 The prosecution
00:24:16.160 is going to
00:24:16.720 put Andy
00:24:17.140 McCabe
00:24:17.500 on the
00:24:18.460 stand.
00:24:19.460 And he's
00:24:20.120 going to
00:24:20.360 ask them,
00:24:21.500 did you
00:24:22.500 leak it?
00:24:23.340 Now,
00:24:24.000 I'm going to
00:24:24.440 predict Andy
00:24:25.020 McCabe is
00:24:25.420 going to
00:24:25.720 say yes.
00:24:27.660 Did you
00:24:28.300 talk to
00:24:28.720 James Comey
00:24:29.300 about it?
00:24:30.040 Yes.
00:24:30.780 Did he
00:24:31.160 authorize it?
00:24:32.300 Yes.
00:24:33.080 And the
00:24:33.560 reason I'm
00:24:34.000 going to
00:24:34.160 predict he's
00:24:34.560 going to
00:24:34.720 do all
00:24:35.040 of that
00:24:35.360 is because
00:24:35.760 Andy
00:24:36.000 McCabe
00:24:36.300 testified
00:24:36.900 to that
00:24:37.700 in front
00:24:38.540 of Congress.
00:24:39.760 And if
00:24:40.120 he gives
00:24:40.400 any other
00:24:40.820 answer,
00:24:42.020 he'll be
00:24:42.520 indicted
00:24:42.900 for
00:24:43.120 lying
00:24:43.360 to
00:24:43.520 Congress.
00:24:44.620 So he
00:24:45.480 can't
00:24:45.940 have it
00:24:46.160 both
00:24:46.360 ways.
00:24:47.460 And I
00:24:48.660 expect that
00:24:49.640 Comey's
00:24:50.540 lawyer will
00:24:51.260 try to
00:24:51.580 cross-examine
00:24:52.240 him and
00:24:52.540 will try
00:24:53.020 to argue
00:24:53.700 McCabe
00:24:54.840 is lying.
00:24:55.460 But it's
00:24:55.680 very difficult
00:24:56.280 to see why
00:24:56.960 McCabe would
00:24:57.520 have any
00:24:58.000 incentive
00:24:58.380 to lie.
00:24:59.780 He and
00:25:00.260 Comey were
00:25:00.780 thick as
00:25:01.300 thieves.
00:25:02.240 He was
00:25:03.020 only forced
00:25:04.000 to admit
00:25:04.520 the truth
00:25:05.200 when
00:25:06.560 confronted
00:25:07.240 with
00:25:07.720 contrary
00:25:08.240 evidence.
00:25:08.680 Again,
00:25:08.880 we don't
00:25:09.160 know what
00:25:09.540 that evidence
00:25:10.060 is,
00:25:10.760 but presumably
00:25:11.540 the FBI
00:25:12.240 and the
00:25:12.520 Department
00:25:12.820 of Justice
00:25:13.360 do.
00:25:13.980 So I
00:25:14.240 don't
00:25:14.360 know if
00:25:14.740 it is
00:25:15.200 contemporaneous
00:25:16.520 phone calls,
00:25:17.420 perhaps with
00:25:17.920 the reporters.
00:25:18.440 I don't
00:25:18.860 know if
00:25:19.240 it is
00:25:19.540 notes.
00:25:20.080 I don't
00:25:20.240 know if
00:25:20.460 it's
00:25:20.660 emails.
00:25:21.700 I don't
00:25:21.920 know if
00:25:22.120 it's
00:25:22.320 testimony
00:25:22.760 from
00:25:23.160 someone else
00:25:23.680 at the
00:25:23.940 FBI who
00:25:24.600 said,
00:25:24.900 hey,
00:25:25.540 Andrew
00:25:25.800 McCabe
00:25:26.200 told me
00:25:26.720 to do
00:25:27.000 this.
00:25:27.300 But it
00:25:27.580 is
00:25:27.800 something,
00:25:29.480 and it
00:25:29.840 was something
00:25:30.440 that was
00:25:30.940 compelling
00:25:31.420 enough that
00:25:32.840 it caused
00:25:33.700 Andrew
00:25:34.120 McCabe to
00:25:34.800 abandon
00:25:35.440 lie number
00:25:36.240 one.
00:25:36.580 And so
00:25:38.100 at the
00:25:38.780 end of
00:25:39.020 the day,
00:25:39.560 this is
00:25:40.100 not a
00:25:40.800 complicated
00:25:41.380 factual
00:25:42.000 case.
00:25:42.560 This is
00:25:42.880 not some
00:25:43.880 grand
00:25:44.320 tapestry.
00:25:45.600 It's a
00:25:45.880 he said,
00:25:46.420 she said,
00:25:48.240 but you
00:25:50.240 have both
00:25:51.400 testimonies under
00:25:52.380 oath,
00:25:52.740 and it's
00:25:53.200 going to be a
00:25:53.580 question of
00:25:54.180 what additional
00:25:54.820 evidence is
00:25:55.580 there to
00:25:56.160 confirm who's
00:25:56.740 telling the
00:25:57.120 truth and
00:25:57.480 who's not.
00:25:57.980 I also
00:25:58.980 think I
00:25:59.500 will be
00:25:59.980 surprised if
00:26:02.660 James Comey's
00:26:03.540 lawyer puts
00:26:04.280 him on the
00:26:04.900 stand.
00:26:05.720 Now,
00:26:06.440 under our
00:26:07.200 justice system,
00:26:08.280 the prosecution
00:26:09.040 cannot force
00:26:10.460 a defendant
00:26:11.820 to testify.
00:26:13.480 But I'm
00:26:13.960 going to
00:26:14.180 predict James
00:26:14.880 Comey is not
00:26:15.500 going to take
00:26:15.860 the stand,
00:26:16.700 because if he
00:26:17.800 takes the
00:26:18.260 stand,
00:26:19.340 he can be
00:26:20.100 cross-examined.
00:26:20.960 He does not
00:26:21.720 want to be
00:26:22.360 cross-examined,
00:26:23.260 because this
00:26:23.860 is someone
00:26:24.460 who presided
00:26:27.060 over
00:26:27.500 weaponizing
00:26:28.560 the Department
00:26:29.160 of Justice
00:26:29.720 with the
00:26:30.160 objective of
00:26:30.900 taking out
00:26:31.640 Donald J.
00:26:32.360 Trump and
00:26:33.780 getting under
00:26:34.520 oath,
00:26:34.900 getting cross-examined
00:26:36.080 by a skilled
00:26:36.820 trial attorney,
00:26:37.700 and again,
00:26:38.160 under oath.
00:26:38.600 By the way,
00:26:39.400 if he lies in
00:26:40.260 his trial
00:26:40.620 testimony,
00:26:41.260 he can be
00:26:41.660 indicted and
00:26:42.200 prosecuted again
00:26:43.100 for lying under
00:26:43.840 oath again.
00:26:45.060 I don't think
00:26:45.880 his lawyer will
00:26:46.500 do that,
00:26:47.200 and so at
00:26:49.260 the end of
00:26:49.740 the day,
00:26:50.300 look, the
00:26:50.620 press is going
00:26:51.160 to go on
00:26:51.580 and on and
00:26:52.100 say, well,
00:26:52.960 Trump hates
00:26:53.560 James Comey.
00:26:54.260 That is
00:26:54.540 certainly true.
00:26:55.840 But being
00:26:56.780 hated by the
00:26:57.540 president is
00:26:58.200 not enough to
00:26:58.860 exonerate you
00:26:59.780 from criminal
00:27:00.340 conduct, and
00:27:01.040 in this
00:27:01.380 instance, I
00:27:03.520 believe Comey
00:27:04.200 should have been
00:27:04.600 indicted five
00:27:05.260 years ago because
00:27:06.080 it was clear he
00:27:07.680 had deliberately
00:27:08.680 lied to Congress,
00:27:09.840 and look, we
00:27:10.680 started by playing
00:27:12.340 my cross-examination.
00:27:13.700 This wasn't an
00:27:14.820 absent-minded lie.
00:27:16.980 This wasn't a,
00:27:17.840 oh, I'm not
00:27:18.240 paying attention.
00:27:19.480 This was careful.
00:27:20.880 This was deliberate.
00:27:22.280 This was strategic.
00:27:23.500 This was planned.
00:27:24.440 I believe this
00:27:25.620 was James Comey
00:27:26.420 saying, I face
00:27:27.440 no accountability
00:27:28.240 whatsoever.
00:27:29.220 I can lie under
00:27:30.140 oath, and no
00:27:31.300 one's going to
00:27:31.800 hold me to
00:27:32.320 account, and I
00:27:33.060 think he feels
00:27:33.760 clever, but he
00:27:36.200 also feels
00:27:37.020 vindicated.
00:27:37.780 Listen, James
00:27:38.320 Comey was
00:27:38.840 someone who I
00:27:40.940 think fancied
00:27:41.940 himself as J.
00:27:42.880 Edgar Hoover.
00:27:43.920 He fancied
00:27:44.820 himself as an
00:27:46.840 incredibly powerful
00:27:48.380 director of the
00:27:49.200 FBI, empowered
00:27:51.080 to remove the
00:27:53.500 tyrant.
00:27:53.980 That's what he
00:27:54.360 said in his
00:27:54.840 statement tonight,
00:27:56.480 that he thinks
00:27:57.620 Trump is a
00:27:58.220 tyrant, and I
00:27:58.940 think when the
00:27:59.460 American people
00:28:00.160 elected him in
00:28:01.020 2016, I think
00:28:02.100 Comey was angry,
00:28:03.620 and he decided he
00:28:05.360 would use the
00:28:06.100 power of the
00:28:06.660 FBI to remove
00:28:07.760 the president
00:28:08.420 elected by the
00:28:09.200 people, and so
00:28:11.160 I think it is
00:28:11.780 quite fitting that
00:28:13.200 he is facing
00:28:13.860 accountability for
00:28:15.280 committing criminal
00:28:16.000 conduct.
00:28:16.760 Let me repeat,
00:28:18.200 this indictment is
00:28:20.260 not for being an
00:28:21.260 opponent of
00:28:21.780 Donald Trump.
00:28:22.360 It is not for
00:28:23.100 being a political
00:28:23.880 figure on the
00:28:27.220 other side of
00:28:27.780 Donald Trump.
00:28:28.460 This indictment is
00:28:30.300 for deliberately and
00:28:31.580 knowingly lying under
00:28:32.880 oath to the United
00:28:33.860 States Senate, which
00:28:34.840 is a clear and
00:28:35.640 unmistakable felony,
00:28:37.380 and I think Comey,
00:28:40.320 I think the odds are
00:28:41.440 good that Comey will
00:28:42.960 be convicted, and I
00:28:44.800 think if he's
00:28:45.520 convicted, I think he's
00:28:46.640 going to serve jail
00:28:47.220 time.
00:28:47.940 How much of, very
00:28:49.500 quickly, of his past,
00:28:51.100 we'll come back to
00:28:51.640 Haunted, he is a
00:28:52.620 prolific guy when it
00:28:54.940 comes to leaking.
00:28:55.640 He's a pro at it.
00:28:56.540 He's not an amateur.
00:28:57.320 He knows how to
00:28:57.920 leak.
00:28:58.500 Hell, he leaked
00:28:59.060 information that was
00:28:59.880 apparently classified
00:29:00.720 to make sure that
00:29:01.960 there was a special
00:29:04.260 counsel that went
00:29:04.960 after Donald Trump.
00:29:05.900 We know that for a
00:29:06.740 fact, and it went to
00:29:08.020 one of his former
00:29:08.880 law friends at a
00:29:10.060 university that then
00:29:10.900 went to a newspaper.
00:29:12.280 That is a fact.
00:29:13.580 Will that come up?
00:29:14.500 And then the other
00:29:15.000 question I have for you
00:29:15.760 quickly is this.
00:29:17.040 Will the testimony he
00:29:18.480 gave before Congress be
00:29:19.720 used in court?
00:29:20.600 Or literally, will
00:29:21.440 senators that
00:29:22.380 interviewed him, would
00:29:23.760 you guys go to court,
00:29:24.680 or would they just use
00:29:25.440 the testimony video?
00:29:27.140 Yeah, I think they
00:29:27.740 would use the
00:29:28.300 testimony.
00:29:28.920 They would read or
00:29:29.560 play the testimony.
00:29:30.560 I don't think you're
00:29:31.300 going to see senators
00:29:32.280 testifying.
00:29:33.180 And the record is clear
00:29:35.080 and objective, and so
00:29:36.160 everyone knows exactly
00:29:37.240 what his testimony was.
00:29:39.580 In terms of his past
00:29:41.080 pattern, I think it
00:29:41.960 could certainly come in.
00:29:43.440 The prosecution might
00:29:44.780 try to bring it in to
00:29:46.400 establish a pattern.
00:29:47.340 That would be
00:29:47.940 difficult, but I
00:29:49.060 think if Comey's
00:29:49.980 lawyer argues, well,
00:29:51.420 he couldn't possibly
00:29:52.480 have approved this, he
00:29:53.580 never would have
00:29:54.160 approved a leak, then
00:29:56.000 I think the prosecution
00:29:57.080 would be able to get
00:29:58.060 all of that in as
00:29:58.980 rebuttal to the
00:30:01.080 defendant's argument.
00:30:01.980 So I think it's more
00:30:02.760 likely to come in as
00:30:03.660 rebuttal evidence than
00:30:04.780 directly proving a
00:30:06.820 pattern, but my guess
00:30:08.260 is one way or another
00:30:10.260 that evidence is going
00:30:11.080 to come in, and you're
00:30:11.720 right, there's a clear
00:30:12.420 pattern.
00:30:12.900 Comey has a long
00:30:13.720 pattern of relying on
00:30:14.880 media leaks to advance
00:30:16.160 his own personal agenda.
00:30:18.020 Do you have a dog?
00:30:19.340 If you've got one like
00:30:20.280 I do, my dog is 12
00:30:21.520 and a half, his name is
00:30:22.400 Memphis, and there's
00:30:23.880 nothing worse than
00:30:24.780 watching your dog age.
00:30:26.560 We're having to coach
00:30:27.340 him off the couch, we're
00:30:28.660 having to help pick him
00:30:29.340 up to get him on the
00:30:30.280 couch, and then I was
00:30:32.140 told about Rough
00:30:32.900 Greens.
00:30:33.480 It literally has added
00:30:35.280 the spunk back to
00:30:36.880 Memphis' life, and it
00:30:38.460 supports long-term health
00:30:39.980 by providing live,
00:30:41.740 bioavailable nutrients,
00:30:43.280 including essential
00:30:43.980 vitamins, minerals,
00:30:45.480 probiotics, digestive
00:30:47.000 enzymes, and omega
00:30:48.420 oils.
00:30:49.280 Now, it is ingredients
00:30:50.360 that work together to
00:30:51.260 improve your dog's life,
00:30:53.880 nutrition, absorption.
00:30:55.340 It maintains joint and
00:30:56.580 muscle health, and it
00:30:57.800 enhances his overall or
00:30:59.640 her overall vitality.
00:31:01.420 It also promotes
00:31:02.300 longevity by addressing
00:31:03.500 common nutritional
00:31:05.200 deficiencies found in
00:31:07.000 processed dog food.
00:31:08.640 And it's so easy.
00:31:10.280 It's not a diet.
00:31:11.220 It is literally you
00:31:12.560 sprinkle it on your
00:31:14.140 dog's food.
00:31:15.740 And after you give it
00:31:16.660 to them, not only do
00:31:17.440 they want to eat it,
00:31:18.200 they love it, but then
00:31:19.420 the effects happen where
00:31:21.140 your dog gets back to
00:31:22.180 the way they used to
00:31:22.840 be.
00:31:23.200 So don't change your
00:31:24.040 dog's food.

00:31:52.120 Senator, you were in
00:31:53.160 Dallas when this
00:31:54.080 shooting happened.
00:31:55.100 It was eight hours
00:31:56.580 after we watched
00:31:58.100 Gavin Newsom go on
00:32:00.500 late night TV demonizing
00:32:03.120 ICE agents, saying that
00:32:04.740 they're authoritarian,
00:32:06.040 and then the liberals
00:32:06.900 are like, wait, wait,
00:32:07.800 we're not attacking ICE
00:32:09.600 agents.
00:32:10.400 Yes, they are.
00:32:11.240 They've undermined
00:32:12.060 them, they've demonized
00:32:13.040 them, and we are
00:32:13.600 watching attack after
00:32:14.740 attack happen against
00:32:15.900 ICE agents.
00:32:16.780 It's horrific.
00:32:18.080 Yeah, I was in Dallas
00:32:19.900 this week for a series
00:32:22.720 of unrelated meetings,
00:32:23.820 and the news broke that
00:32:25.540 this deranged gunman had
00:32:27.440 opened fire on an ICE
00:32:28.700 facility in Dallas, that
00:32:30.020 he had gone onto a
00:32:31.200 rooftop emulating
00:32:32.580 Charlie Kirk's assassin,
00:32:34.360 and with a bolt-action
00:32:35.740 rifle, fired multiple
00:32:37.840 rounds, ended up
00:32:39.260 killing two people
00:32:40.500 severely, injuring a
00:32:41.600 third, and then he
00:32:42.620 took the gun to
00:32:43.280 himself and took his
00:32:44.460 own life, and it was
00:32:46.200 horrific when the news
00:32:47.260 broke.
00:32:47.840 I canceled my morning
00:32:49.060 meeting and just drove
00:32:50.100 over to the ICE
00:32:50.720 facility that morning,
00:32:52.580 was there shortly after
00:32:55.180 the shooting had
00:32:55.840 occurred, and this has
00:32:57.680 happened far too often.
00:32:59.860 Here's what I had to
00:33:00.960 say at the press
00:33:02.760 conference that was
00:33:03.560 ongoing when I arrived
00:33:04.600 at the facility.
00:33:06.760 This needs to stop.
00:33:09.760 Violence is wrong.
00:33:12.080 Politically motivated
00:33:13.080 violence is wrong.
00:33:15.920 It was two weeks ago
00:33:16.940 today that we saw a
00:33:18.240 political assassination
00:33:19.200 in Utah that tore the
00:33:22.780 heart out of much of
00:33:23.680 this country.
00:33:25.280 This is the third
00:33:26.720 shooting in Texas
00:33:28.200 directed at ICE or CBP.
00:33:30.940 This must stop.
00:33:35.480 To every politician who
00:33:38.600 is using rhetoric,
00:33:40.160 demonizing ICE and
00:33:41.700 demonizing CBP, stop.
00:33:45.100 To every politician
00:33:47.000 demanding that ICE agents
00:33:48.740 be doxed and calling for
00:33:51.000 people to go after their
00:33:52.200 families, stop.
00:33:53.700 This has very real
00:33:56.340 consequences.
00:33:57.680 Look, in America we
00:33:58.700 disagree, that's fine,
00:34:00.020 that's the democratic
00:34:00.900 process, but your
00:34:02.280 political opponents are
00:34:04.360 not Nazis.
00:34:06.720 We need to learn to work
00:34:08.400 together without demonizing
00:34:10.140 each other, without
00:34:11.240 attacking each other, and
00:34:12.880 I want to say thank you.
00:34:14.240 I want to say thank you to
00:34:16.040 the brave men and women of
00:34:17.180 law enforcement.
00:34:18.020 I want to say thank you to
00:34:19.500 the brave men and women of
00:34:20.620 ICE and CBP and everyone
00:34:23.060 who puts their lives on
00:34:24.560 the line to keep us safe.
00:34:29.480 The divisive rhetoric
00:34:30.880 tragically has real
00:34:32.140 consequences.
00:34:34.500 I hope that every one of
00:34:36.060 us will, I hope that
00:34:37.440 every one of us will pray
00:34:39.220 number one, for the safety
00:34:42.020 of law enforcement that are
00:34:44.240 risking their lives to keep
00:34:45.480 us safe.
00:34:46.420 Number two, for the health
00:34:49.300 of those who were shot and
00:34:50.720 injured today, we still
00:34:52.120 don't know the full details
00:34:53.580 of who was injured, but for
00:34:55.500 the families also of the
00:34:56.880 victims of this shooting.
00:34:58.560 Violence has no place, it is
00:35:01.120 wrong, and we should come
00:35:04.000 together, if we want to have
00:35:05.260 a debate about immigration
00:35:06.360 policies, we can do so in the
00:35:08.740 halls of Congress without
00:35:10.160 demonizing each other, and
00:35:12.020 especially without demonizing
00:35:14.060 the men and women who every day
00:35:16.300 put on a badge and go risk
00:35:18.260 their lives to keep us safe.
00:35:20.600 And we should not be putting
00:35:23.020 language out there that inspires
00:35:26.140 madmen to commit evil crimes.
00:35:30.400 Our prayers are with the men and
00:35:31.920 women of law enforcement, and we
00:35:33.720 ought to come together and have
00:35:35.120 some decency across the
00:35:36.900 political aisle to say this
00:35:39.840 violence is wrong and it needs to
00:35:41.940 stop.
00:35:42.220 We know, Senator, a lot about
00:35:44.920 this gunman.
00:35:46.420 We know that he was
00:35:47.920 Googling the shooting of our
00:35:50.960 friend whose funeral we just
00:35:52.540 went to, Charlie Kirk.
00:35:54.300 We know that he was looking at the
00:35:56.720 app that they put out there and
00:35:59.160 these websites where you can
00:36:00.680 track ICE agents, doxing where
00:36:03.880 they are.
00:36:04.400 That is an app designed to
00:36:07.420 encourage violence against ICE
00:36:09.420 agents and law enforcement, and
00:36:11.380 whether it's Gavin Newsom or
00:36:12.740 Akeem Jeffries or any other
00:36:15.300 Democrat who is encouraging
00:36:17.300 this targeting of ICE agents, it
00:36:20.460 is fundamentally wrong and that
00:36:22.180 they need to stand up and stop
00:36:23.660 it.
00:36:24.300 You know, I will say this
00:36:25.360 shooter, it's the news has since
00:36:28.400 come out, this shooter, his
00:36:29.700 mother was a hard leftist who
00:36:31.780 actually had been vocally
00:36:32.740 critical of me and other Texas
00:36:35.300 Republicans for not embracing
00:36:37.000 gun control, and in fact, in May
00:36:38.740 of 2022, she posted the
00:36:40.900 following.
00:36:41.980 Governor Abbott, Senator Cornyn,
00:36:43.480 and Senator Cruz, how does it
00:36:44.840 feel that your action to open up
00:36:47.440 gun laws is responsible for the
00:36:49.120 killing of 21 more people?
00:36:50.960 Do you secretly sit in front of a
00:36:52.560 TV and smile with a demented
00:36:54.080 smile?
00:36:55.040 You must be proud of all the
00:36:56.580 money that sits in your bank
00:36:57.680 accounts from the gun lobby
00:36:58.880 support.
00:36:59.800 Was it worth it, Governor Abbott?
00:37:01.600 How about you, Senator?
00:37:03.320 When you prioritize money over
00:37:05.180 people, this is what you get.
00:37:06.940 And I will say the irony is
00:37:09.460 rich that this leftist mom who
00:37:11.760 was championing gun control, now
00:37:14.400 her son has committed a mass
00:37:16.280 murder as a sniper.
00:37:18.480 It is tragic, and it is a
00:37:20.260 consequence of extreme rhetoric,
00:37:23.900 extreme ideology that is poisoning
00:37:26.180 the minds of those who are driven
00:37:30.380 to violence.
00:37:30.880 And I will say this assassin wrote
00:37:34.980 on his shell casings anti-ice, very
00:37:38.440 much emulating what Charlie Kirk's
00:37:40.900 murderer did, writing pro-antifa and
00:37:43.940 pro-transgender propaganda on his
00:37:46.620 shell casings.
00:37:47.480 And we need to stop this violence
00:37:50.760 regardless of where your politics
00:37:52.800 are, but we need to stop the rhetoric
00:37:54.480 that is fueling this violence.
00:37:56.500 And there's a lot of Democrat
00:37:57.960 politicians engaging in this rhetoric,
00:38:00.300 no matter how many lives are lost.
00:38:02.240 And I want to be clear, I am not calling
00:38:05.020 them Nazis.
00:38:06.120 I am absolutely opposing any violence
00:38:09.700 or calls to violence.
00:38:11.100 I'm calling on them to tone down their
00:38:13.900 rhetoric and stop demonizing their
00:38:15.800 opponent, stop demonizing ICE, stop
00:38:18.460 demonizing law enforcement, because
00:38:20.820 it's dangerous and tragically lunatics
00:38:23.280 are acting on the rhetoric they're
00:38:25.080 hearing from these politicians.
00:38:26.920 No doubt about it.
