00:00:02.500 Guaranteed human.
00:00:05.180 Welcome to Verdict with Senator Ted Cruz.
00:00:08.240 Ben Ferguson with you, Senator.
00:00:09.760 We've got some victories to talk about that are big for this country coming up in just a moment.
00:00:15.740 But before we get to that, an FBI special agent has come forward as a whistleblower,
00:00:23.300 along with several other whistleblowers who have now gone before Congress on the House side, Jim Jordan's committee.
00:00:31.660 I want to get your just initial reaction to finally getting to see what these whistleblowers are saying.
00:00:38.180 Well, the evidence keeps coming out every day about just how politicized and how weaponized the FBI and the Department of Justice has become under Joe Biden.
00:00:48.140 And yesterday in the House of Representatives, in a hearing chaired by Jim Jordan,
00:00:52.940 there was testimony from multiple FBI whistleblowers who who heroically came forward at enormous risk to themselves,
00:01:01.860 at enormous risk to themselves, to their careers, to their livelihoods, to the ability to feed their families.
00:01:08.500 And and among other things, they testified that that risk was not theoretical, but it was it was very real.
00:01:15.760 And yet they were so disturbed by the politicization, by the corruption that they had witnessed at the FBI,
00:01:24.000 that they felt obliged to come forward.
00:01:26.840 And and it really was striking.
00:01:28.720 This was a continuation of the two podcasts we did last week, the special interview with Jim Jordan,
00:01:35.240 where Jim previewed this testimony with us on the two podcasts last week.
00:01:39.520 And if and if you didn't listen to them last week, you should go back and listen to Jim walking through the evidence of weaponization that that has been developed by the House to date.
00:01:49.860 But the hearing yesterday.
00:01:51.580 Well, it started with Jim Jordan giving a warning to the FBI whistleblowers who could come forward.
00:01:58.760 Listen to to what Jim warned them as the hearing began.
00:02:02.240 We've talked to over two dozen whistleblowers, people have come to us, we've interviewed several of those, and today, three of them,
00:02:09.780 three of those brave whistleblowers and a lawyer who represents them will tell us their story.
00:02:15.800 They will tell us what happened, what they saw, and then what happened to them because they were courageous enough to report it to Congress.
00:02:23.720 And I just want to tell you guys, get ready.
00:02:26.120 Get ready because these guys are going to come after you.
00:02:29.940 You know they are.
00:02:31.540 Last hearing we had, last hearing we had, we had two journalists, Democrats, two Democrat journalists set right where you guys did.
00:02:39.980 And these guys tried to get them to divulge their sources.
00:02:43.060 Someone needs to tell them how the First Amendment works.
00:02:45.520 And oh, while Mr. Taibbi, one of those award-winning journalists sitting right where you're sitting, was testifying, guess what else was happening?
00:02:51.960 The IRS was knocking on his door.
00:02:55.980 So get ready.
00:02:57.280 But I know you're up to the task because you came for it in the first place.
00:03:01.120 Senator, you listened to Jim Jordan's warning, and it's clearly accurate based on what these whistleblowers have experienced,
00:03:08.080 including the fact that this FBI whistleblower testified for the first time publicly
00:03:12.780 that not only did he swear to defend this country from enemies both foreign and domestic,
00:03:17.340 but he didn't realize that he was going to have to sacrifice his entire career after being a whistleblower
00:03:25.320 when the FBI retaliated against him.
00:03:28.460 And that's not what the law says is supposed to happen.
00:03:32.800 That's exactly right.
00:03:34.020 Under federal law, if you come forward as a whistleblower, you're entitled to the protection of law.
00:03:38.720 And it is illegal, it is a crime for your employer to retaliate against you for being a whistleblower,
00:03:47.320 for exposing corruption, especially when you're taking it to the United States Congress.
00:03:52.840 The Congress has a responsibility under our Constitution to engage in oversight,
00:03:57.680 and yet the FBI, sadly, they're so brazen in how politicized they are
00:04:04.020 that they didn't hesitate to go after these guys directly and immediately.
00:04:08.920 Well, here, listen to the testimony from one of the witnesses about how they went after him very directly.
00:04:18.620 ...currently in place at the FBI are clearly inadequate
00:04:21.280 and must be reworked to protect whistleblowers and others who are inappropriately targeted.
00:04:26.780 The FBI can extract whatever they want from me.
00:04:29.580 I'm willing to bear that burden.
00:04:30.780 I've sworn to defend this country from enemies, both foreign and domestic,
00:04:34.860 even if that means sacrificing my life.
00:04:37.120 I've lived that oath out since first enlisting in the Army,
00:04:39.740 consistently saying,
00:04:41.020 Here am I. Send me.
00:04:42.800 My oath, however, did not include sacrificing the hopes, dreams, and livelihood of my family,
00:04:48.000 my strong, beautiful, and courageous wife,
00:04:50.780 and our four sweet and beautiful daughters who have endured this process along with me.
00:04:55.280 In weaponized fashion, the FBI allowed me to accept orders to a new position halfway across the country.
00:04:59.400 They allowed us to sell my family's home.
00:05:02.120 They ordered me to report to the new unit when our youngest daughter was two weeks old.
00:05:06.180 Then, on my first day on the new assignment, they suspended me, rendering my family homeless.
00:05:11.380 They refused to release our goods, including our clothes, for weeks.
00:05:18.720 All I wanted to do was serve my country by stopping bad guys and protecting the innocent.
00:05:23.540 To my chagrin, bad guys have begun running parts of the government,
00:05:26.820 making it difficult to continue to serve this nation and protect the innocent.
00:05:30.520 But I, for one, will never stop trying.
00:05:32.740 And I'll never forget my oath.
00:05:34.060 Senator, you hear him there.
00:05:37.000 He gets choked up because it's obvious the FBI knew what they were doing.
00:05:40.620 They decided, okay, you're going to whistleblow.
00:05:43.120 You're not going to be one of us.
00:05:44.600 You're going to tell the truth.
00:05:46.380 Fine.
00:05:46.760 We'll sip you off to a new job.
00:05:48.580 And then when you get there, on day one, we are going to suspend you,
00:05:53.020 leave you homeless, and hold your goods hostage.
00:05:56.440 Is that not the definition of retaliation?
00:05:58.980 Well, it's petty, it's vindictive, and understand the timeline he laid out,
00:06:05.020 that they did this after he had come forward as a whistleblower.
00:06:08.900 So they transfer him, he sells his house, he moves his family,
00:06:12.640 and then, boom, when he gets there, the job that he was transferred to do,
00:06:17.960 he's prevented from doing.
00:06:19.260 And that, you know, it reveals a lot that his supervisors seemingly have no fear
00:06:27.280 of any consequences for this retaliation.
00:06:30.560 They're in a culture.
00:06:31.980 Look, this is the same culture that pervaded the FBI,
00:06:35.240 that led the FBI to target Donald Trump when he was the Republican nominee for president,
00:06:39.980 and to feel like they needn't worry about whether there was any evidence of collusion with Russia.
00:06:46.760 They needn't worry about whether the thing they were investigating,
00:06:50.720 the Steele dossier, was a fraudulent piece of opposition research paid for by the Hillary Clinton campaign,
00:06:57.220 which it was, and which they had every reason to know that it was,
00:07:00.860 because, unfortunately, it appears that these corrupt partisans,
00:07:08.460 in senior positions at the FBI,
00:07:12.340 believe they are impervious to the strictures of law,
00:07:18.580 or to any accountability.
00:07:20.580 It's the same arrogance that pervaded the IRS,
00:07:25.960 that led the IRS to come knocking on the door of journalist Matt Taibbi,
00:07:31.400 literally, while he is sitting testifying before Congress.
00:07:35.740 They didn't even have the good sense to wait a day or a week and make it seem coincidental.
00:07:40.620 They wanted you to know,
00:07:42.520 you rat on us,
00:07:43.840 we're coming after you.
00:07:45.760 That's the same vindictiveness the FBI is demonstrating here.
00:07:49.360 You look at this testimony from this former FBI agent, Senator,
00:07:52.980 and not only did he serve in the U.S. Army as an infantryman in Iraq and Afghanistan for a year each,
00:07:58.660 but according to his testimony in the report,
00:08:00.920 he received the Combat Infantryman Badge.
00:08:03.560 This is a man that believes in this country.
00:08:05.920 He also, the report alleges that the whistleblower testimony reveals,
00:08:10.140 quote,
00:08:10.480 that the FBI's partisan leadership is currently engaged in a purge of agents who hold conservative beliefs.
00:08:20.080 And I want to get your reaction to that,

00:09:26.660 Senator,
00:09:27.100 you hear this whistleblower allege that the FBI's partisan leadership is currently engaged in a purge of agents who hold conservative beliefs.
00:09:36.900 The whistleblower even disclosed that many of their jobs,
00:09:40.140 their career paths have been basically stunted on purpose to get them frustrated,
00:09:45.600 so they'll maybe just leave on their own.
00:09:47.360 Well, unfortunately, I think this is a pattern we're seeing throughout the Biden administration,
00:09:52.820 but particularly in areas of the military and law enforcement.
00:09:56.900 I think they're doing everything they can to try to drive conservatives out of government.
00:10:02.120 We've talked on this podcast before about,
00:10:05.060 I think that was one of the major objectives of the Biden vaccine mandate for government employees,
00:10:12.840 is that they knew that those men and women who refused to take the vaccine were much more likely to be conservative,
00:10:19.180 and their view was good riddance, get them out of the FBI, get them out of DOJ,
00:10:23.320 get them out of the military, get them out of the Border Patrol, get them out of the federal government,
00:10:27.780 and it is part of turning all of the enforcement mechanism of the government into a weapon,
00:10:37.540 a weapon to be used to target your enemies, and so that weapon is used against the individual employees
00:10:44.380 who happen to be conservative, and it's also used against American citizens,
00:10:50.060 because when you've driven all the conservatives out,
00:10:53.480 those who remain appear far more willing to be complicit in the abuse of power.
00:11:00.120 And I've got to tell you, as I am in D.C., as I'm back in Texas, as I travel around,
00:11:06.540 I regularly speak to employees at the Department of Justice, employees at the FBI,
00:11:12.180 whether special agents, whether prosecutors,
00:11:14.460 who are deeply dismayed at what they're seeing in the department.
00:11:20.240 And they're dismayed, but they're afraid to speak out.
00:11:23.140 They're afraid because the consequences, because they believe in their mission.
00:11:26.220 Look, most people that are at DOJ or the FBI, they sign up because they want to stop bad guys.
00:11:31.380 They want to lock up child predators.
00:11:34.560 They want to lock up terrorists.
00:11:35.960 They want to keep America safe.
00:11:37.540 And there are thousands upon thousands of honorable heroes at DOJ and the FBI,
00:11:43.700 but many of them right now are scared to speak.
00:11:46.380 And I've got to say, one of the more chilling exchanges in the testimony today
00:11:51.620 was when one of the witnesses was asked, would he advise another whistleblower to come forward?
00:11:59.900 Listen to his answer.
00:12:02.140 Mr. O'Boyle, we just heard from your interaction with Mr. Gates
00:12:06.800 and how all of this occurred and all of the hardships you've gone through.
00:12:10.620 If one of your really good friends, your former colleagues, came to you and said,
00:12:14.560 I have this thing that is being covered up, and I think the American people need to know about it.
00:12:21.700 What advice would you give them?
00:12:24.760 I would tell them first to pray about it, long and hard.
00:12:28.960 And I would tell them I could take it to Congress for them,
00:12:32.220 or I could put them in touch with Congress, but I would advise them not to do it.
00:12:36.420 So you would legitimately try to protect one of your colleagues from doing what you have done?
00:12:41.000 Absolutely.
00:12:41.440 And how do you think that solves being able to shine light on corruption, weaponization,
00:12:46.920 any kind of misconduct that exists with the American people?
00:12:49.720 It doesn't solve it.
00:12:51.000 But the FBI will crush you.
00:12:52.980 This government will crush you and your family
00:12:55.740 if you try to expose the truth about things that they are doing that are wrong.
00:13:00.540 And we are all examples of that.
00:13:03.400 I can't think of a more sobering way to end a hearing.
00:13:05.840 I yield back.
00:13:06.900 I mean, you hear that, and I do think it's shocking,
00:13:10.040 but I think Democrats are proud of this moment, Senator.
00:13:12.920 They're like, good.
00:13:13.840 You should be scared.
00:13:14.820 You should be terrified.
00:13:16.760 This is intimidation.
00:13:18.380 This is what they want.
00:13:20.760 And I've got to say, one of the more disappointing aspects of yesterday's hearing
00:13:24.940 was the Democrat congressmen and women who were perfectly happy
00:13:30.180 to attack these FBI whistleblowers.
00:13:33.100 They treat this as a partisan battle, our team versus their team.
00:13:39.660 And in their view, if you dare dissent from the brutal repression of dissent,
00:13:48.980 then you're suddenly the enemy.
00:13:52.060 And I've got to say, look, I get that there are partisan battles in Washington,
00:13:57.740 but I have to admit, if the shoe were on the other foot
00:14:02.460 and this were testimony about the weaponization of the FBI
00:14:10.060 to target people because of their political views on the left,
00:14:13.200 I'm quite confident I would be every bit as dismayed.
00:14:17.720 And I wonder, where is the Democrat who cares about the rule of law?
00:14:23.560 Even if the Democrat happens to not like the conservatives
00:14:29.440 who are the target of this persecution,
00:14:32.140 is there not a single Democrat congressman who says,
00:14:36.120 well, gosh, if the DOJ and FBI can be turned to attack
00:14:41.180 the political opponents of the White House,
00:14:44.240 that could happen to us too.
00:14:46.480 Now, mind you, their rhetoric, they claimed it happened under Trump all the time.
00:14:51.320 But if you actually look to evidence, the Department of Justice didn't do that.
00:14:55.040 It didn't go out and persecute the political opponents of the president.
00:15:00.120 In fact, they should have done much more going after Antifa and violent criminals,
00:15:05.260 but not for their political views.
00:15:07.000 Look, you can be a leftist or an anarchist if you want.
00:15:10.260 That's not criminal.
00:15:11.240 But when you light cities on fire and you loot stores and you assault people and murder people,
00:15:16.440 that is criminal.
00:15:17.880 And if anything, I think the Trump DOJ should have been much more vigorous
00:15:21.460 in going after violent criminals.
00:15:22.960 But that's not politicization.
00:15:25.880 That's actually doing your job.
00:15:27.440 Where is the Democrat willing to defend the rule of law?
00:15:32.160 And I'll point out, when Congress, a generation before,
00:15:38.780 heard the evidence of Richard Nixon trying to politicize the Department of Justice,
00:15:45.160 trying to politicize the FBI, trying to politicize the IRS,
00:15:48.660 numerous Republicans stood up and said,
00:15:53.640 this is beyond the pale, this is too much, this is not acceptable.
00:15:57.240 Is there not one Democrat member of Congress with the same level of integrity
00:16:03.620 that you saw Republican after Republican who called for Richard Nixon's investigation
00:16:10.400 and ultimately resignation?
00:16:12.140 Like, is there not one Democrat who cares about rule of law?
00:16:15.440 Well, one of the whistleblowers also said, Senator, that the FBI is, quote,
00:16:20.440 currently cancerous and has let itself become enveloped in the politicalization
00:16:27.620 and weaponization.
00:16:29.160 And the example was the FBI classified every single, this is the testimony,
00:16:35.960 January 6th case as a domestic terrorism case.
00:16:40.420 According to the whistleblower, despite, quote, hundreds of them being resolved,
00:16:44.940 resolved, resolved, as petty crimes like trespassing and or disorderly conduct,
00:16:52.260 you were labeled as a domestic terrorist in a domestic terrorism case.
00:16:57.400 Well, and that's politics.
00:16:59.820 Mind you, this is the same FBI that apparently has no resources to go after the people
00:17:05.920 who are firebombing crisis pregnancy centers,
00:17:08.080 that apparently has no resources to go after the people who are breaking federal law brazenly
00:17:15.680 night after night, protesting outside the homes of Supreme Court justices
00:17:20.240 and implicitly threatening their lives and their families.
00:17:24.640 They can't be bothered to devote their resources to doing that.
00:17:28.200 But when it comes to criminalizing peaceful speech, that the FBI and DOJ have unlimited resources for.
00:17:38.200 And to be clear, there's a fundamental difference between violence and peaceful speech.
00:17:42.700 If you engage in violence, whether I agree with you or not, if you engage in violence,
00:17:47.420 you should be prosecuted and go to jail.
00:17:49.640 But if you're engaged in peaceful speech, whether I agree with you or not,
00:17:55.040 that is protected by the First Amendment.
00:17:57.420 And this Department of Justice under Joe Biden and this FBI under Joe Biden
00:18:01.840 wants to treat them as exactly the same and criminalize the speech of those who showed up
00:18:10.680 on January 6th to support President Trump.
00:18:13.740 But more broadly, the tens of millions of Republicans who vote on the other side,
00:18:19.220 these are the same people that want to criminalize the speech of moms and dads going to school boards.
00:18:23.580 And indeed, the same FBI agents, they've got ample resources to go and interview
00:18:28.680 dozens of parents for exercising their First Amendment rights.
00:18:33.180 It's political intimidation and it is deliberate and it is from the very top.
00:18:38.380 It is from Merrick Garland, the most political attorney general this country has ever seen.
00:18:42.560 The good news is, and I hope that what happens is other whistleblowers will be inspired
00:18:47.920 by these people that have come forward and do the exact same thing,
00:18:52.160 because this is how we change the tide of what's happening in Washington.
00:18:56.460 Which brings me to another big story, Senator.
00:18:59.600 A Biden-appointed U.S. attorney for Massachusetts,
00:19:03.520 someone that you warned America about is now resigning after a special counsel investigation.
00:19:10.040 And before we get into that good news, let me tell you about our friends over at Chalk.
00:19:14.560 If you're a guy and you have noticed a difference,
00:19:18.320 you've noticed that you're starting to get tired and fatigued, having weakness and complacency,
00:19:23.680 it's probably not your fault.

00:21:01.960 Senator, this Biden-appointed U.S. attorney, news broke about the special counsel's investigation
00:21:08.500 and what they found.
00:21:09.980 And this is how NBC News reported it.
00:21:12.620 It was obviously big news.
00:21:14.240 We have an update for you on Massachusetts U.S. attorney Rachel Rollins.
00:21:18.120 A brand new report just out moments ago finds that she, quote, willfully violated the Hatch
00:21:24.060 Act on multiple occasions during her time as U.S. attorney.
00:21:27.880 Now, the report published by the U.S. Office of Special Counsel comes one day after Rollins
00:21:33.340 announced that she plans to resign from her post by the end of the week.
00:21:37.760 So, let's explain what this means here.
00:21:39.260 The Hatch Act is critically important to our government.
00:21:42.220 And certain parts of our, certain branches of our government being nonpartisan.
00:21:45.940 It's designed to limit certain political activities of federal employees to ensure federal programs
00:21:52.840 remain nonpartisan and not biased.
00:21:55.640 Rollins is accused of attending a political party fundraiser while in office.
00:21:59.720 The report also saying she tried to sabotage the campaign of a political candidate by leaking
00:22:05.680 non-public information to the media.
00:22:08.700 I mean, Senator, the worst part is Democrats did everything they could to save her.
00:22:12.300 And finally, after violating the most egregious Hatch Act violations, she's now going to resign.
00:22:21.700 Well, she has resigned.
00:22:23.320 And I have to say, this is an enormous victory for the rule of law.
00:22:27.100 Number one, we're talking about weaponizing the Department of Justice and abusing power.
00:22:31.500 Rachel Rollins did all of that.
00:22:33.240 And the report that came out is stunning.
00:22:38.640 There were two reports that actually came out.
00:22:40.700 One from the Office of the Special Counsel.
00:22:43.100 That's an office that has exclusive jurisdiction investigating allegations concerning prohibited
00:22:49.840 political activities under the Hatch Act.
00:22:52.060 The Hatch Act specifically prohibits most government employees from engaging in partisan politics.
00:22:57.840 So that was one report.
00:22:59.620 And there was a second parallel investigation from the Department of Justice, Office of
00:23:04.340 the Inspector General.
00:23:05.400 Both released reports.
00:23:06.700 And the reports were damning.
00:23:09.400 So what they found she did is, number one, and I'm quoting from the OIG report,
00:23:16.480 Rollins assisted a candidate in a partisan political election and sought to influence an election
00:23:20.760 by, among other things, disclosing non-public, sensitive DOJ information to the press.
00:23:25.280 Rollins made false statements under oath and lacked candor about the disclosure during her
00:23:31.060 OIG interview.
00:23:32.360 And this concern, she had been the Suffolk DA, district attorney, before she was named U.S.
00:23:38.480 attorney.
00:23:39.360 And there was a race to succeed her.
00:23:41.640 And she wanted one really left-wing Democrat candidate, Ricardo Arroyo.
00:23:47.640 That's who she wanted in the primary.
00:23:49.040 And in order to help her guy, she was trying to smear the other Democrats.
00:23:55.620 So she was willing to break the law, not even to smear a Republican, to smear a Democrat
00:24:00.660 who wasn't sufficiently left-wing for her.
00:24:04.540 And according to the OIG, she used her position as U.S. attorney and information available to
00:24:12.360 her as U.S. attorney in an ultimately unsuccessful effort to create the impression publicly before
00:24:17.480 the primary election that DOJ was or would be investigating Hayden, the other Democrat,
00:24:23.840 for public corruption.
00:24:25.280 These efforts included but were not limited to Rollins trying unsuccessfully to convince
00:24:29.200 her first assistant U.S. attorney to issue a letter that would have created the impression
00:24:33.340 that DOJ was investigating Hayden.
00:24:36.020 And when that effort failed, disclosing non-public, sensitive DOJ information directly to a Herald
00:24:41.740 reporter before the primary election, afterwards, she falsely testified under oath during her
00:24:49.320 OIG interview.
00:24:50.520 She made false statements, which is a felony under 18 U.S.C.
00:24:54.500 Section 1001.
00:24:56.380 And on top of that, she's the sitting U.S. attorney.
00:24:59.260 And she attended a Democrat fundraiser on July 14th, 2022 with Jill Biden, Joe Biden's wife.
00:25:09.120 Now, before she went to that fundraiser, she asked the Executive Office of U.S. Attorneys,
00:25:16.400 the General Counsel's Office, could she go to the fundraiser?
00:25:18.580 And they said, no, she can't go to the fundraiser.
00:25:20.540 They said, if you want, you can meet Jill Biden outside of the location of the event in a brief
00:25:26.940 meet and greet outdoors, but you can't go into a politically partisan fundraiser because you're
00:25:32.440 the sitting U.S. attorney.
00:25:33.640 And that is against the rules for a federal prosecutor to engage in partisan politics.
00:25:37.800 Well, even after she'd received that explicit instruction from the General Counsel's Office,
00:25:45.120 contrary to the advice she gave, and I'll just read what the OIG concluded, quote,
00:25:51.440 our investigation revealed that, contrary to the advice she received,
00:25:55.340 Rollins attended the fundraising event.
00:25:57.220 Based on Rollins' own account of what she did after she arrived at the fundraising location,
00:26:03.180 Rollins went inside the home, mingled with the guests, and stood in the same receiving line
00:26:08.320 as the other fundraising guests to meet Dr. Biden.
00:26:12.180 Rollins' interactions with Dr. Biden was identical to that of the other fundraising guests
00:26:18.160 whose primary purpose for being at the event was to get in line and meet Dr. Biden.
00:26:22.860 That is stunning.
00:26:25.060 It is a pattern of illegality.
00:26:26.700 It is a pattern of a sitting U.S. attorney committing multiple felonies so bad and abusing her power
00:26:34.460 as a federal prosecutor to try to influence an election, in particular to try to smear a Democrat,
00:26:43.840 not even a Republican, a Democrat who wasn't sufficiently left-wing and radical.
00:26:48.160 This report came out, and Rachel Rollins has resigned.
00:26:52.480 That's a big deal.
00:26:53.940 It is a big deal, and you warned the American people about Rachel Rollins,
00:27:00.540 and this was back, gosh, over a year ago when you warned America,
00:27:05.820 I want people to hear what your warning was.
00:27:08.780 And before I play that for everybody, I want to tell you about our friends over at Patriot Mobile.

00:28:26.740 Or patriotmobile.com slash verdict.
00:28:28.820 Senator, you blasted Democrats for confirming Rachel Rollins,
00:28:32.780 and this is part of your warning, which, well, all became true.
00:28:38.160 Listen.
00:28:39.780 Rachel Rollins has been vocal and aggressive against prosecuting crime.
00:28:46.520 She has been very clear that she came into the job of district attorney as a crusader.
00:28:52.320 She has said, and these are her words,
00:28:54.040 If you want to change the criminal legal system,
00:28:58.040 become a prosecutor.
00:29:00.780 Because they have the power to determine charges,
00:29:04.700 what crimes to decline to prosecute about a prosecutor.
00:29:10.300 It's not taking bad guys off the street.
00:29:13.340 It's not seeking justice for the victims of crime.
00:29:16.640 No, it is the power to say,
00:29:20.680 I won't prosecute these crimes.
00:29:24.880 And with Ms. Rollins, it's not hypothetical.
00:29:28.800 Because she is a district attorney.
00:29:31.820 And as the Boston DA,
00:29:33.400 she went so far as to write down,
00:29:37.760 in quote,
00:29:39.340 the Rachel Rollins policy memo,
00:29:42.020 a list of 15 crimes
00:29:46.440 whose prosecution,
00:29:50.080 quote,
00:29:51.240 should always be declined
00:29:55.100 or, quote,
00:29:57.800 dismissed without conditions.
00:30:00.620 Charges on this list of 15 crimes
00:30:03.140 should be declined or dismissed
00:30:05.320 pre-arraignment
00:30:06.220 without conditions.
00:30:07.960 The presumption is the charges
00:30:11.100 that fall into this category
00:30:12.740 should always be declined.
00:30:16.920 So you've got a DA saying,
00:30:18.920 these are the crimes we don't prosecute.
00:30:21.980 Always be declined.
00:30:24.520 Dismissed without conditions.
00:30:26.880 So you may say,
00:30:27.880 okay,
00:30:28.820 maybe this is like some sort of criminal justice reform.
00:30:32.140 Maybe this is
00:30:33.060 low-level,
00:30:35.460 non-violent,
00:30:36.640 marijuana possessions.
00:30:40.340 Teenager got caught with a joint.
00:30:42.500 We're not going to prosecute those.
00:30:43.960 Look, reasonable people
00:30:44.660 can actually disagree on that.
00:30:45.840 We can have
00:30:46.440 an intelligent conversation
00:30:48.240 back and forth about that.
00:30:51.500 But the beauty of it is
00:30:52.720 we don't have to speculate
00:30:53.900 because she put it in writing.
00:30:56.340 These are the 15 crimes.
00:30:58.800 They're upside down.
00:31:01.680 As are her policies.
00:31:02.980 These are the 15 crimes
00:31:06.800 where charges should be dismissed
00:31:10.240 pre-arraignment
00:31:10.900 without condition.
00:31:13.360 Number one,
00:31:14.320 trespass.
00:31:15.860 So I want you to think about it.
00:31:17.540 If you
00:31:17.980 don't want to see people
00:31:20.280 trespassing on your property,
00:31:23.100 well,
00:31:23.400 under Rachel Rollins,
00:31:24.560 the Democrats'
00:31:25.320 U.S. Attorney,
00:31:26.020 we don't prosecute trespass.
00:31:30.240 What else?
00:31:31.180 Shoplifting.
00:31:32.300 Does anyone watch the videos
00:31:34.020 of the people
00:31:34.780 breaking into stores
00:31:36.020 and stealing and stealing
00:31:37.260 and stealing and looting?
00:31:38.680 You know what?
00:31:39.380 Joe Biden
00:31:40.080 and Senate Democrats,
00:31:43.120 they're bringing that
00:31:44.980 to a neighborhood near you.
00:31:47.400 Shoplifting.
00:31:47.960 We don't prosecute.
00:31:50.140 That's what she says.
00:31:51.300 Shoplifting.
00:31:52.600 Olly olly oxen free.
00:31:55.740 You see a TV you like,
00:31:57.740 pick that damn thing up
00:31:58.960 and run out of the store.
00:32:02.080 Because your friend,
00:32:03.640 the fake prosecutor,
00:32:04.760 is not going to charge you
00:32:05.840 larceny.
00:32:07.680 Really?
00:32:08.440 Larceny?
00:32:09.980 Larceny.
00:32:10.700 We don't prosecute.
00:32:11.780 Disorderly conduct.
00:32:14.680 You're a single mom
00:32:16.000 coming home at night.
00:32:17.000 A drunk vagrant
00:32:19.980 is yelling,
00:32:21.740 screaming,
00:32:22.320 cursing at your kids.
00:32:23.320 You know what?
00:32:23.900 Not a crime here.
00:32:25.760 We don't prosecute that.
00:32:27.100 What else?
00:32:28.820 Receiving stolen property.
00:32:30.300 Okay, this is at least
00:32:31.280 intellectually consistent.
00:32:33.580 You're going to legalize
00:32:34.420 shoplifting,
00:32:35.260 rob the hell out of the stores.
00:32:37.700 At least the fence
00:32:38.620 can be on the back end.
00:32:40.340 So you can steal that TV,
00:32:41.680 go straight to the fence.
00:32:42.600 By the way,
00:32:43.300 I guess you could do it
00:32:44.120 in the parking lot.
00:32:45.700 Set up a van right there.
00:32:47.240 We fenced stolen property.
00:32:48.560 You run in and grab it.
00:32:49.460 I'll fence it right here.
00:32:51.640 DA,
00:32:52.460 all good by us.
00:32:55.180 Driving with a suspended license.
00:32:58.660 Well,
00:32:59.200 sometimes that might be okay.
00:33:00.900 What was it suspended for?
00:33:02.780 Was it suspended for DWI?
00:33:04.820 Was it suspended
00:33:06.000 because you're a drunk
00:33:07.200 who's killed people?
00:33:09.740 Was it suspended
00:33:10.760 because you're this
00:33:11.700 homicidal maniac in Milwaukee
00:33:13.740 who murdered six people?
00:33:17.280 You know what?
00:33:19.380 This DA says,
00:33:20.420 hey, driving with a suspended license.
00:33:22.060 No problem at all.
00:33:23.360 No longer a crime.
00:33:26.660 Breaking
00:33:27.260 and entering
00:33:28.980 into a vacant property
00:33:31.160 without property damage.
00:33:35.540 So any property that's vacant,
00:33:37.320 you can break in
00:33:38.120 and you're fine.
00:33:41.080 Locks don't matter.
00:33:42.160 Burglar alarms don't matter.
00:33:43.640 By the way,
00:33:44.840 burglar alarm goes off.
00:33:46.100 What the hell do you do?
00:33:46.920 You show up.
00:33:47.440 Hey, you don't prosecute it.
00:33:48.480 I'm staying right here.
00:33:52.100 You may say,
00:33:52.980 well, at least there's
00:33:53.740 something reasonable.
00:33:54.460 It's without property damage, right?
00:33:56.160 Well, no,
00:33:56.760 except the problem is
00:33:57.540 number eight on the list.
00:33:58.400 Breaking and entering
00:33:59.000 into a vacant property
00:34:00.020 with property damage.
00:34:03.460 So it doesn't matter.
00:34:04.480 Break into the place.
00:34:07.860 Loot it.
00:34:09.000 Trash it.
00:34:09.720 Destroy it.
00:34:12.260 All is good
00:34:13.580 in Joe Biden's
00:34:16.360 criminal-friendly America.
00:34:19.340 Number nine,
00:34:21.660 wanton or malicious
00:34:22.820 destruction of property.
00:34:25.440 By the way,
00:34:26.420 don't believe
00:34:26.960 the Democratic talking points.
00:34:28.620 This stuff isn't violent, really.
00:34:30.480 Wanton or malicious
00:34:31.280 destruction of property?
00:34:32.500 Not a crime
00:34:35.480 in Joe Biden's America.
00:34:37.320 Threats.
00:34:39.060 Threats of violence.
00:34:43.100 I want you to imagine
00:34:44.620 right now
00:34:45.260 you've got an angry vagrant
00:34:46.940 making threats of violence
00:34:49.020 against your children.
00:34:51.140 You call the DA saying,
00:34:53.120 my family's being threatened.
00:34:54.460 Protect our safety.
00:34:55.860 And what does she say?
00:34:57.340 Not a crime.
00:34:58.380 Oh, well.
00:35:03.520 Stinks to be you.
00:35:07.240 Threats are just A-OK.
00:35:09.900 Minor in possession
00:35:10.860 of alcohol.
00:35:11.720 Hey, great.
00:35:13.660 Kids, drink up.
00:35:15.940 Actually, the beauty of it
00:35:17.080 is in Joe Biden's America,
00:35:18.400 the kids can get drunk.
00:35:20.960 They can drive.
00:35:22.420 They can have
00:35:22.820 their license suspended.
00:35:24.660 And apparently,
00:35:25.700 they'll get a gold star
00:35:26.680 at the end of it.
00:35:27.840 Minor in possession
00:35:28.620 of alcohol.
00:35:29.360 We've got Senate pages here.
00:35:31.540 Just go down
00:35:32.160 to the U.S. Attorney's Office.
00:35:33.520 They're serving margaritas.
00:35:37.800 Marijuana possession.
00:35:38.860 Okay, I said,
00:35:39.740 we can debate
00:35:40.300 marijuana possession.
00:35:42.400 Reasonable people
00:35:43.180 can disagree on that now.
00:35:45.500 Doesn't specify the quantity.
00:35:49.420 Teenager with a joint.
00:35:51.480 You could say
00:35:52.100 that that may be
00:35:53.020 a good candidate
00:35:53.820 for diversion
00:35:54.540 to something else.
00:35:55.560 Drug dealer
00:35:57.060 with several kilos
00:35:58.400 of pot in the back.
00:35:59.840 Maybe you ought to be
00:36:01.040 prosecuting that.
00:36:03.520 Oh, and by the way,
00:36:05.180 how do we know
00:36:06.740 she doesn't just limit it
00:36:07.820 to the kids with a joint?
00:36:09.000 Well, what's number 13
00:36:10.400 on the list?
00:36:11.480 Possession
00:36:12.000 with intent
00:36:13.500 to distribute.
00:36:15.460 So drug dealers,
00:36:17.620 in Joe Biden's America,
00:36:20.480 drug dealers,
00:36:21.300 it is legal.
00:36:22.260 You can sell booze
00:36:25.580 to kids.
00:36:26.380 You can sell drugs
00:36:27.600 to kids.
00:36:31.020 You can sell
00:36:31.960 stolen televisions
00:36:33.100 to kids.
00:36:34.760 She doesn't prosecute
00:36:36.060 drug dealers.
00:36:38.020 But look,
00:36:39.000 at least it's just pot.
00:36:40.480 And come on,
00:36:41.040 we know,
00:36:42.060 you know,
00:36:42.500 in states,
00:36:43.100 a lot of states,
00:36:43.640 pot's not that bad,
00:36:44.500 right?
00:36:44.640 It's just pot.
00:36:45.180 Uh-oh.
00:36:48.280 Number 14,
00:36:50.080 non-marijuana
00:36:52.160 drug possession.
00:36:54.780 So for any Democrats
00:36:56.000 ready to go home
00:36:57.060 saying,
00:36:57.700 hey,
00:36:58.120 we just like pot
00:36:59.380 because we're Democrats.
00:37:01.200 Nope.
00:37:02.280 Heroin,
00:37:03.380 cocaine,
00:37:05.140 LSD,
00:37:06.040 fentanyl,
00:37:07.900 drug dealers
00:37:08.620 who are poisoning
00:37:09.660 our kids
00:37:10.700 in Joe Biden's America,
00:37:13.260 we don't prosecute you.
00:37:16.120 And number 15
00:37:17.460 is really
00:37:17.960 the crowning jewel
00:37:19.720 of this.
00:37:21.480 Resisting arrest.
00:37:25.380 So I want you
00:37:26.500 to envision
00:37:27.120 what this says.
00:37:28.040 You can break
00:37:28.680 and enter
00:37:29.040 into vacant property
00:37:30.080 and do damage.
00:37:31.880 You can have
00:37:32.780 a homeless person
00:37:33.880 trespass
00:37:34.860 on your front lawn,
00:37:36.040 set up a tent,
00:37:38.040 threaten your children,
00:37:40.260 sell them drugs,
00:37:41.440 and if a police
00:37:45.980 officer shows up
00:37:46.940 and tries to arrest
00:37:48.020 them,
00:37:49.760 they can violently
00:37:51.100 resist arrest.
00:37:54.260 And what does
00:37:55.020 the DA say?
00:37:56.900 All good by me.
00:37:59.460 Senator,
00:38:00.200 that policy memo
00:38:01.360 is shocking,
00:38:02.260 but it is the
00:38:02.740 Democratic Party.
00:38:04.220 Well,
00:38:05.020 Rachel Rollins
00:38:05.960 was the single
00:38:06.880 most extreme
00:38:07.840 U.S.
00:38:08.340 attorney in the country.
00:38:09.660 She was a
00:38:10.120 George Soros
00:38:10.740 prosecutor.
00:38:11.340 She effectively
00:38:12.440 abolished the police
00:38:13.740 for those 15 crimes.
00:38:16.240 Joe Biden
00:38:17.080 nominated her.
00:38:18.060 He's nominated
00:38:18.600 a total of three
00:38:19.580 of the leading
00:38:20.040 advocates of
00:38:20.640 abolishing the police
00:38:21.540 to senior positions
00:38:22.460 in the Department
00:38:22.980 of Justice,
00:38:23.580 including Rachel Rollins.
00:38:25.060 That speech
00:38:25.740 you just played,
00:38:26.400 I gave on the
00:38:27.060 Senate floor.
00:38:28.160 I don't know
00:38:28.980 how you read
00:38:29.820 that memo,
00:38:30.380 how you look
00:38:30.800 at those facts,
00:38:31.460 and how you vote
00:38:32.180 to confirm
00:38:32.900 this person
00:38:34.120 as the chief
00:38:35.020 U.S.
00:38:35.540 prosecutor
00:38:35.940 in the state
00:38:36.580 of Massachusetts,
00:38:37.280 other than
00:38:38.280 if you're a
00:38:39.920 Democrat,
00:38:40.600 you believe
00:38:41.140 you'll never
00:38:41.600 be held to
00:38:42.080 account because
00:38:42.580 no reporter
00:38:43.100 will ever ask
00:38:43.720 you about it.
00:38:44.240 Well,
00:38:44.360 you know what?
00:38:45.540 Every single
00:38:46.860 Democrat,
00:38:47.780 all of them,
00:38:48.480 100% voted
00:38:49.660 to confirm
00:38:50.200 Rachel Rollins.
00:38:51.060 Joe Manchin,
00:38:52.140 the supposed
00:38:52.620 moderate,
00:38:53.520 voted to confirm
00:38:54.280 Rachel Rollins
00:38:55.040 because they know
00:38:56.300 the press will
00:38:57.040 never,
00:38:57.420 ever,
00:38:57.740 ever hold them
00:38:58.380 to account,
00:38:59.120 and then after
00:38:59.660 they voted
00:39:00.080 for this radical,
00:39:01.040 she went and
00:39:02.080 lawlessly abused
00:39:03.600 the office,
00:39:04.460 committed crimes
00:39:05.360 in the office,
00:39:06.100 and now she's
00:39:07.220 resigned.
00:39:07.720 So it's a victory
00:39:08.320 for the rule of law
00:39:09.300 and it's reason
00:39:10.400 to celebrate.
00:39:11.440 It's reason to
00:39:12.060 celebrate.
00:39:12.480 It's also reason
00:39:13.140 to keep fighting
00:39:14.220 and that's why
00:39:14.780 you did that
00:39:15.280 over a year ago,
00:39:16.160 reminding people
00:39:16.960 of what we're
00:39:17.420 up against.
00:39:18.540 Don't forget,
00:39:19.380 we do verdict
00:39:20.120 three days a week,
00:39:21.240 Monday,
00:39:21.500 Wednesday,
