IRS Whistleblowers have accused Merrick Garland of lying under oath and obstructing justice. If what they're saying is true, a special counsel should be appointed in the Department of Justice to consider bringing charges against him.

00:01:45.960Does the Delaware U.S. attorney lack independent charging authority over certain criminal allegations against the president's son outside of the district of Delaware?

00:02:02.660But as I said, I have promised to ensure that he's able to carry out his investigation and that he be able to run it.

00:03:08.900Has the Delaware U.S. attorney sought permission from – permission of another U.S. attorney's office, such as in the District of Columbia or in California, to bring charges?
00:03:24.860I do – and I don't want to get into the internal elements of decision-making by the U.S. attorney.
00:03:29.980But he has been advised that he is not to be denied anything that he needs.
00:03:35.720And if that were to happen, it should send to the department's ranks that I have not heard anything from that office to suggest that they are not able to do everything that the U.S. attorney wants to do.

00:03:50.420Number one, the IRS whistleblowers have specifically alleged that Weiss asked the U.S. attorney in D.C. to bring charges and asked the U.S. attorney in the Central District of California to bring charges.

00:04:07.440In our last podcast on Friday, we went – and last week's podcast, Monday, Wednesday, and Friday, did a deep dive into these facts.

00:04:19.880But on last Friday's podcast, we walked through how the U.S. attorney in D.C. was a political donor to Joe Biden, how the U.S. attorney in the Central District of California was a political donor to Kamala Harris,
00:04:33.220and at least what the IRS whistleblowers are saying, those U.S. attorneys said no, we will not prosecute Hunter Biden.
00:04:40.760The other avenue is Weiss could have been named a special U.S. attorney able to bring charges outside of Delaware, in other words, in D.C. or in the Central District of California.
00:04:52.760The reason that matters is the most serious of the charges Hunter faced were for conduct in 2014 and 2015 where the violations were committed either in D.C. or the Central District of California.
00:05:05.540So the Delaware U.S. attorney can't bring it in Delaware because he wasn't in Delaware when he committed the crime.
00:05:11.800He's got to bring it where the crime occurred.
00:05:14.520If the IRS whistleblower is right, then what Merrick Garland said is flat-out wrong.

00:05:46.700The DAG is what she's called internally in DOJ parlance, the DAG, the deputy attorney general, that as a typical matter, U.S. attorneys report up through the DAG.
00:05:57.880It is possible that Lisa Monaco denied the request and never even let Merrick Garland know.
00:06:03.820If that's the case, then he's still lying because he's responsible.
00:06:09.180If his henchmen under him are acting directly contrary to what he said, then he doesn't get to go lie to Congress just because he remains willfully unaware of what's going on.
00:06:25.160On June 30th, David Weiss sent a letter back to Jim Jordan.
00:06:29.000Jim Jordan had sent an oversight letter asking about the investigation.
00:06:32.520And Weiss right now is sticking with Merrick Garland.
00:06:35.760So Weiss says several things in the letter.
00:06:37.440He says, number one, I'm not at liberty to provide you the materials you seek about the investigation.
00:06:42.300I am required to protect confidential law enforcement information, deliberative communications.
00:06:48.840Thus, I will not provide specific information related to the Hunter Biden investigation at this time.
00:06:54.180Secondly, he says, I will provide some general insight on two issues.
00:07:00.540First, the Department of Justice did not retaliate against an Internal Revenue Service criminal supervisory special agent and whistleblower as well as his entire investigative team for making protective disclosures to Congress.

00:08:06.140Second, Weiss says, in my June 7th letter, I stated, quote, I've been granted ultimate authority over this matter, including responsibility for deciding where, when and whether to file charges and for making decisions necessary to preserve the integrity of the prosecution, consistent with federal law, the principles of federal prosecution and departmental regulations.
00:08:25.880I stand by what I wrote, and I wish to expand on what it means.
00:08:31.540He says, as the U.S. attorney for the District of Delaware, no charging authority is geographically, my charging authority is geographically limited to my home district.
00:08:41.440If venue in the case lies elsewhere, common departmental practice is to contact the U.S. attorney's office for the district in question and determine whether it wants to partner in the case.
00:08:52.460If not, I may request special attorney status with the attorney general pursuant to 28 U.S.C. Section 515.
00:08:58.700Here, I have been assured that, if necessary, after the above process, I would be granted 515 authority in the District of Columbia, the Central District of California, or any other district where charges could be brought in this matter.

00:10:06.940They ran while David Weiss was allegedly investigating this.
00:10:10.560And this letter is saluting to the attorney general and saying, sir, yes, sir, I'm still on the team.
00:10:16.540But it is a fact that the charges were not brought.
00:10:20.480It is a fact that this sweetheart deal, which the Biden White House desperately, desperately, desperately wants to close the door on all investigations on Joe Biden, provides that Hunter Biden served not a minute in jail, not a day in jail, served no jail time at all for millions of dollars in tax fraud.
00:10:38.920And David Weiss nowhere addresses the most serious allegations in the whistleblower's claims, which are that DOJ blocked any and all investigations into Joe Biden's corruption.
00:10:56.880And in fact, the DOJ tipped off Hunter Biden over and over and over again to thwart search warrants, to thwart investigations.
00:11:04.560This, at this point, the statements between Merrick Garland and David Weiss on one side and the two IRS whistleblowers on the other side are entirely in conflict.
00:11:18.840The whistleblowers, as I've noted, we have no reason to think they're lying.
00:11:22.140One of them is a gay Democrat who's married to a man.
00:11:25.800Both of them are career IRS employees.
00:11:29.360Neither of them have any indication that they're in any way, shape or form Republican.
00:11:33.500And they've come over and risked their entire careers by calling out what appears to be a pattern of felonies.
00:11:43.420The House of Representatives needs to have a hearing with Merrick Garland at the table, with David Weiss at the table and with the IRS whistleblowers at the table.
00:11:51.840Every one of them needs to raise their hand and take an oath and testify under oath.
00:11:56.060And you need real people who know how to cross examine, find out who's telling the truth and find out who's lying.
