00:04:21.100 The context of your offending is that it arises out of the civil unrest and disorder in many parts of the United Kingdom.
00:04:33.320 On the night of the 2nd and 3rd of August, the Britannia Hotel in Leeds was attacked by people who threw missiles,

00:04:45.780 The police were called, and on the 3rd of August, the hotel was locked down for the protection of those who were living there.
00:04:54.740 At the time, there were 210 occupants, many of whom were foreign refugees and asylum seekers.
00:05:04.480 Similar attacks to the hotel were launched on the 4th of August.
00:05:08.440 The police attended on each occasion, and units were deployed to safeguard the hotel and to provide an increase in the police presence in the area.
00:05:22.740 In between the two attacks, you took to social media in order to encourage others towards participation in the attacks upon the hotel.
00:05:34.840 As is recognized on your behalf, this offense is so serious that an immediate custodial sentence is unavoidable.

00:05:47.320 The sentence that I pass has been reduced by one-third to reflect your guilty plea.
00:05:53.560 The sentence is one of 20 months' imprisonment.
00:05:56.400 You will serve up to one-half of your sentence in custody before you are released on license.
00:06:04.500 If you fail to abide by the conditions of your license, you can be returned to prison to serve some or all of the remainder of the custodial term.

00:11:11.980 Now, to be clear, in an article, quote, the crackdown on social media includes a threat by the British government to extradite American citizens from the U.S. to be jailed in the U.K. for violating the rules about political free speech.

00:11:27.100 If I tweet something in America about the U.K., could they then come after me based on what they're now saying because that offended somebody in the U.K.?

00:15:20.640 I don't think we're that far off, especially if you look at Harris and what she says as well.

00:15:32.820 You know, a few years ago, if I would have said the U.K. is going to lock people up for making social media posts, you probably would have dismissed that as, come on, that they still respect individual liberty too much to do that.

00:15:52.200 In the last few years, one of the greatest concerns I've had is the Democrat Party.
00:15:58.380 There used to be principled, passionate defenders of free speech in the Democrat Party.

00:16:08.300 And today's Democrats have decided that free speech, the First Amendment, is incompatible with their desire to control you and to silence speech they don't like.
00:16:18.180 And today's Democrats being in bed with big tech, they view it as a machinery of censorship and oppression because power matters more to them than free speech.
00:16:31.260 You know, there's a great article Jonathan Turley, the great law professor, wrote just a few days ago in The Hill.
00:16:37.860 And it's entitled, A Harris-Waltz administration would be a nightmare for free speech.
00:16:43.740 And I want you to look at Kamala Harris and Tim Waltz's record on free speech because this is the most extreme and radical record on free speech of any ticket that has ever run for president with a major party.
00:16:56.220 So you look at Joe Biden. Joe Biden has made censorship a critical part of his legacy.
00:17:02.980 He has accused social media companies of, quote, killing people.
00:17:07.340 That's Joe Biden for not censoring more.
00:17:11.080 So that's his position. If you don't censor, you're killing people.
00:17:14.660 The administration created an office like, quote, the Disinformation Governance Board.
00:17:20.000 Remember, oh, yeah, the disinformation czar led by that wacko who loved musical theater and who had these these bizarre, smarmy singing things on Twitter who wanted to silence anyone she disagreed with.
00:17:32.720 Thankfully, that disbanded because the pushback was was so significant.
00:17:37.640 But but I want you to listen to Tim Waltz on MSNBC, what he says about free speech.
00:17:45.240 Give a listen. Years ago, it was the little things telling people to vote the day after the election.
00:17:50.800 And, you know, we kind of brush them off. Now we know it's intimidation at the at the ballot box.
00:17:55.600 It's it's undermining the idea that mail in ballots aren't legal.
00:18:00.060 I think we need to push back on this. There's no guarantee to free speech on misinformation or or hate speech and especially around our democracy.
00:18:07.820 Tell the truth where the voting places are, who can vote, who's able to be there.
00:18:11.620 And I, you know, watching some states continue to weaken the protections around the ballot, I think, is what inspiring us to to lean into this.
00:18:20.360 Again, all we're asking is is to make it as easy and simple as possible to exercise their right to vote and participate in our democracy.
00:18:28.940 And I'm in 100 percent agreement with you. That makes it so that more people are there.
00:18:33.140 You get more opinions brought in. And I think it it tempers that that extremes that we get, because, again, I can't imagine someone going and standing in line for eight hours to try and vote and then being told that, you know, maybe the votes didn't count or maybe something's wrong.
00:18:49.920 You have these candidates who lose and are on these ridiculous court cases that they keep bringing up and losing on here in Minnesota.
00:18:59.120 We're going to bring faith back into that system. It's already been here. We were very proud that we're near the top in voter turnout.
00:19:05.100 But there's more that we can do. So I want you to hear those words because that is radical.
00:19:12.020 It is idiotic and it is wrong. So here's a quote that he just said, quote, there's no guarantee to free speech on misinformation or hate speech and especially around our democracy.
00:19:24.240 Now, that is utter garbage. There is a guarantee to free speech. It's called the First Amendment to the Constitution.
00:19:29.920 It is in the Bill of Rights. And listen to what he said. There's no guarantee on misinformation, by the way.
00:19:35.860 And he said, look at these candidates who filed lawsuits challenging elections.
00:19:40.500 So apparently he wants to go after you and prosecute you if you file a lawsuit challenging an election.
00:19:46.040 And he says, for example, misinformation. He says, we just want to make sure everyone has the right to vote.
00:19:53.640 Well, you know what, Mr. Walts, I charge that as misinformation because your party tried to throw Donald Trump off the ballot in Colorado, Illinois and Maine.
00:20:03.820 Yeah. You don't just want to make sure everyone has the right to vote when you're trying to stop them from voting for your opponent.
00:20:11.460 And understand, the only reason that didn't succeed is because the Supreme Court unanimously rejected your party's assault on democracy.
00:20:20.500 And when he says, I can't imagine waiting eight hours in line to vote and then being told that your vote somehow matters less.
00:20:29.320 OK, are you planning to prosecute Hillary Clinton when she said that the election where Donald Trump beat her was rigged?

00:21:36.160 I hope that all members recognize that there is speech that is not constitutionally protected, referencing hate speech in particular.
00:21:44.140 Ben Cardin, Democrat senator from Maryland, said, quote,
00:21:48.400 If you espouse hate, you're not protected under the First Amendment.
00:21:55.460 Now, if he wrote that, he's a lawyer.
00:21:57.980 If he wrote that as a first year law student in constitutional law, he would flunk.
00:22:02.740 That's not even a D answer. That's an F answer.
00:22:05.120 By the way, Howard Dean, member, former governor of Vermont, Democrat, ran for president.
00:22:09.380 Here's what he said. Quote, hate speech is not protected by the First Amendment.
00:22:15.480 By the way, the Supreme Court is a famous case, the Skokie case, where they upheld the right of Nazis to march in Skokie, Illinois,
00:22:23.460 because the First Amendment protects the right to speak, even if what you're saying is hateful.
00:22:28.080 And to be clear, I despise Nazis.
00:22:30.500 They are bigoted, evil idiots.
00:22:33.060 Yes. The First Amendment protects the right of bigoted, evil idiots to speak their idiocy.
00:22:38.880 And the response, by the way, is not for government to censor them, not for government to lock them up for 20 months as they're doing in the United Kingdom.

00:23:20.420 Quote, this position, rather, this position that hate speech is not protected by the First Amendment.

00:23:32.900 Speech that demeans on the basis of race, ethnicity, gender, religion, age, disability, or any other similar ground is hateful.
00:23:48.180 But the proudest boast of our free speech jurisprudence is that we protect the freedom to express the thought that we hate.

00:24:26.060 Well, let's look at Kamala Harris.
00:24:27.220 Kamala Harris, on her disastrously failed 2020 presidential campaign, here's what she said.
00:24:35.380 She ran on censorship and she pledged, quote, that her administration will hold social media platforms accountable for the hate infiltrating their platforms because they have a responsibility to help fight against this threat to our democracy.
00:24:49.720 In 2019, Kamala Harris said directly to Mark Zuckerberg, the lead owner of Facebook, quote,
00:24:58.280 This is not a matter of free speech.
00:25:00.040 This is a matter of holding corporate America and these big tech companies responsible and accountable for what they are facilitating.
00:25:08.540 Understand, Kamala Harris and Tim Walz, if they win, they intend to go after your free speech.

00:25:20.200 And what they define as hate is anything contrary to their agenda.

00:34:57.940 And it was wrongfully characterized that anybody was being whipped.

00:35:09.320 at the administration demonizing the brave men and women who risked their lives to keep us safe.

00:35:23.060 By the way, she's also supported defunding and abolishing the police when it comes to law enforcement.

00:35:29.620 And let's try to get people out of jail, by the way, in Minnesota who were involved in the riots while they were burning down the city.

00:37:26.440 And he said it at a rally and it just worked and it stuck.
00:37:30.440 And people loved it because he was a guy looking out for the little guy.
00:37:34.120 He was advocating for these hardworking people that rely on tips as part of their income.
00:37:38.500 And it obviously played well with many people in this country.
00:37:43.960 Fast forward to a few days ago, Kamala Harris says the same thing.
00:37:48.220 Well, and let me give a little more narrative on that.
00:37:50.500 So Trump announced it at the Vegas rally.
00:37:53.240 And I think the next week he was in D.C.
00:37:55.860 And I had lunch with him.
00:37:57.080 He had lunch with all the Republican senators.
00:37:58.760 He was actually telling us the back story of it.
00:38:01.280 And he said, well, you know, this was not an idea that came from a bunch of policy experts that had a bunch of white papers.
00:38:07.580 He said he was in Vegas right before the rally.
00:38:11.480 And he said he was having, I think, lunch or dinner.
00:38:13.180 I think it was lunch.
00:38:14.300 And he said there was a waitress who came up who complained about the really oppressive enforcement from Joe Biden and Kamala Harris.
00:38:24.200 of their efforts to tax tips and how it was really burdensome.
00:38:27.840 The record keeping, it was really hard.
00:38:30.080 And Trump says at dinner, pulled out a piece of paper and just wrote down, no taxes on tips.
00:38:35.540 And then he said he went to the rally and he just said it.

00:38:50.380 So the next week, I introduced legislation in the Senate to exempt tips from taxes because I heard that idea.

00:39:00.740 And the reason I introduced legislation, there are a lot of reasons, but one right at the heart is for over a decade, for as long as I've been in the Senate,

00:39:17.480 We should be the party of hairdressers and nail salon workers and taxicab drivers and everyone who has calluses on their hands because they're working hard.

00:40:18.940 I want you to give a listen first to Trump in Nevada announcing the policy proposal and then Kamala just shamelessly copying him.

00:42:22.740 The service industry tip compliance agreement program was to be a voluntary tip reporting system in which the IRS and the service industry companies cooperated, which is where they would crack down on the actual workers.
00:42:37.780 The program was meant to, quote, improve tip reporting compliance, reduce administrative burdens, and provide more transparency and certainty to taxpayers.
00:42:49.040 Again, going after the little guy here.
00:42:51.740 And the program feature included, quote, monitoring of employer compliance based on actual annual tip revenue.
00:43:00.660 So, big brother watching you and charge tip data from an employer's point of sale system.
00:43:07.280 So, now the computer's tracking you and allowance for adjustments in tipping practices from year to year to protect the employer from getting in trouble by turning in, in essence, their employees.

00:43:22.040 And now she's out there saying, I want you to not have to pay taxes on your tips.

00:43:43.980 You know, there was an interesting story, the same lunch where Trump was telling us the back story of this proposal.
00:43:51.280 The day before the lunch, Trump and Lindsey Graham had played golf.
00:43:55.960 And Lindsey told everyone, he said, look, the two of us were playing golf and they're both big golfers.
00:44:00.400 And, you know, look, your son is one of the best golfers in the world.
00:44:03.140 But Lindsey described how midway through the golf game, he said their two caddies came up and hugged Donald Trump because he had just made the proposal of no taxes on tips.
00:44:16.800 And listen, golf caddies like barbers, like bartenders, there are all sorts of professions where a big chunk of their revenue and many of them are just barely making ends meet.
00:44:27.160 They're just starting to climb the economic ladder and they literally came and hugged him for that proposal.
00:44:33.660 And so Kamala Harris is now trying to pretend, look, I'm glad she's supporting my legislation.
00:44:38.880 I got to say, this is a first.
00:44:40.880 I do not believe Kamala Harris has ever before publicly endorsed legislation that I filed and the lead author of.
