00:03:32.440 Let's explain exactly what jury nullification even means from the outset.
00:03:37.600 And then I think people really understand, oh, so that's why Democrats are now pushing this so hard,
00:03:42.200 and the dark money is coming in from the big mega donors in the Democratic Party.
00:03:46.700 Well, look, jury nullification is the ability of a jury to disregard the instructions given to the jury by the judge,
00:03:54.680 to disregard the law, and to disregard the facts,
00:03:57.820 and simply to say we are going to find the defendant not guilty.
00:04:01.840 Even if they are guilty, right?
00:04:03.700 I want to be clear.
00:04:05.360 It's only jury nullification if they are guilty.
00:04:08.020 If they're not guilty, then it's actually the jury finding them not guilty.
00:04:12.460 Nullification is specifically when the prosecution has proven that the individual committed the criminal offense,
00:04:19.640 the judge has instructed the jury, here's what the law is, here's what you must do,
00:04:23.520 and the jury nonetheless says we're not going to apply it.
00:04:27.240 And what's happening here, I want to give some of the details of what these left-wing groups are doing,

00:04:34.180 So here's one story that was published by Alpha News in Minneapolis.

00:04:41.380 Minneapolis Anti-ICE Activist Groups Promote Jury Nullification Training Amid High-Profile Cases.
00:04:47.360 And here's what the story reports.
00:04:50.400 A Minneapolis-based activist network is now openly advertising, quote,
00:04:54.960 jury nullification training,
00:04:57.140 raising new concerns about the integrity of jury trials in the Twin Cities.
00:05:01.620 Defend 612, which seeks to support, quote,
00:05:05.620 resistance to the ICE occupation in Minneapolis,
00:05:08.800 is promoting two virtual sessions titled
00:05:11.400 The People's Pardon or Jury Nullification scheduled in the coming weeks.
00:05:16.000 One description frames the effort, quote,
00:05:19.740 because when systems fail to deliver justice, the people must.
00:05:25.020 Quote,
00:05:25.980 jury nullification is a legal tactic that has been used to protect one another
00:05:30.280 from unjust laws and political persecution.
00:05:32.860 This is the description of the advertisement.
00:05:35.260 We will learn about jury nullification or The People's Pardon,
00:05:37.980 how it's been used, ways it can stem authoritarian overreach,
00:05:41.320 and how we can use it today.
00:05:43.240 In an email to supporters, Defend 612,
00:05:45.500 defended the trainings as a means of protecting our local heroes
00:05:49.260 through jury nullification.
00:05:51.660 Jury nullification occurs when jurors vote to acquit a defendant,
00:05:55.060 despite believing the law was broken,
00:05:57.040 often because they oppose the law itself or how it is enforced.
00:06:00.760 Last month, Alpha News reported on a Minnesota Democratic Party officials
00:06:04.380 urging his followers to use jury nullification in a federal case
00:06:08.700 involving an assault against an immigration officer.
00:06:12.200 Nick Cruz, a former vice president of the Minnesota Young DFL
00:06:17.200 and a current at-large director of Stonewall DFL,
00:06:21.020 wrote in a since-deleted post on X that, quote,
00:06:24.200 no one should be going to prison for defending our city against ICE.
00:06:29.400 Cruz was referring to the federal case of Claire Louise Fang,
00:06:32.360 who is accused of biting off the tip of a U.S. border agent's finger
00:06:38.400 during a struggle in Minneapolis.
00:06:40.680 So understand this.
00:06:41.620 A federal law enforcement officer has the tip of his finger
00:06:45.120 bitten off by an activist,
00:06:46.720 and these lunatics are saying,
00:06:48.560 don't convict the person who bit off part of his finger.
00:06:52.920 By the way, you can see that picture on X.
00:06:55.280 It went viral.
00:06:56.160 They actually showed the baggie of the fingertip
00:06:59.160 and the agent's finger.
00:07:01.300 If you just want to see, like, how violent these attacks are,
00:07:04.460 that went viral because people thought they were lying.
00:07:06.740 And so then someone took the picture and was like,
00:07:08.700 okay, you think we're lying?
00:07:09.900 Look at my finger that's missing.
00:07:11.680 Here it is in a bag, and we're going to the hospital now.
00:07:13.980 Just so you understand what they're up against to the left.
00:07:16.560 And this left-wing activist,
00:07:19.000 he encouraged followers to spread information
00:07:21.200 about jury nullification and to, quote,
00:07:23.640 act neutral during the voir dire,
00:07:26.620 the jury selection process, in order to get seated.
00:07:28.840 I'm going to take a brief digression to say,
00:07:33.000 two weeks ago I spoke at an event honoring Justice Scalia.
00:07:36.860 It was the 10th anniversary of his passing away.
00:07:39.720 And I described preparing for an oral argument
00:07:42.220 in a Supreme Court case
00:07:43.380 where jury selection was an aspect of that case.
00:07:46.920 And Justice Scalia was brilliant.
00:07:48.500 He was a remarkable person.
00:07:50.040 But he was also a stickler for language.
00:07:52.460 And the process of selecting jurors,
00:07:57.080 it's spelled V-O-I-R-D-I-R-E.
00:08:00.000 And in many parts of the country,
00:08:01.700 that's pronounced voir dire.
00:08:03.600 In Texas, it's voir dire.
00:08:06.200 And actually, in preparing for the oral argument,
00:08:09.040 one of the questions I prepared for is,
00:08:11.520 when I said voir dire,
00:08:12.620 having Scalia ask,
00:08:13.980 counsel, I just heard you say words.
00:08:16.180 I'm sorry, I don't understand them.
00:08:18.360 And my response, which I was ready to give,
00:08:20.980 I would have said, Justice Scalia,
00:08:22.180 I understand that in other parts of the country,
00:08:24.520 there may be more Frenchified pronunciations
00:08:27.380 of those words.
00:08:28.240 But in the great state of Texas,
00:08:29.960 it is voir dire.
00:08:31.460 And representing Texas,
00:08:32.820 that's what I'll be using.
00:08:35.000 Understand, though, the relevance of voir dire here.
00:08:37.840 This leftist is saying,
00:08:39.320 lie during voir dire.
00:08:40.760 Tell the judge you'll be neutral
00:08:43.000 and then defy the law anyway.
00:08:45.840 This is blatantly undermining our justice system.
00:08:49.380 This is something that I think is a very scary moment.
00:08:53.960 It is Democrats now putting big money behind the idea
00:08:56.960 of advocating for juries to basically say,
00:08:59.780 even if you have someone that has broken the law,
00:09:01.920 if they've broken a law that you're in essence favor of,
00:09:04.780 then just don't find them guilty,
00:09:06.500 even though you're admitting they are guilty.
00:09:08.100 And now the Democratic Party is like, let's do this.
00:09:11.180 We're going to put real money behind it.
00:09:13.760 And look, understand,
00:09:15.460 jury nullification has always been part of the justice system.
00:09:19.940 And so there are numerous examples in history.
00:09:23.460 So, for example, in 1735,
00:09:25.680 John Peter Zenger was tried in New York.
00:09:27.920 He was charged with seditious libel
00:09:29.580 for criticizing the royal governor of New York,
00:09:32.680 William Cosby, in the New York Weekly Journal.
00:09:34.640 And under English law, truth was not a defense.
00:09:38.360 But the jury decided to acquit anyway.
00:09:40.860 That was a very early example of jury nullification.
00:09:45.620 The Fugitive Slave Act of 1850,
00:09:48.320 Northern juries sometimes refuse to convict individuals
00:09:51.500 charged with assisting escaped slaves.
00:09:55.860 That was another instance of jury nullification
00:09:57.700 where they'd say,
00:09:58.580 we're not going to participate in this unjust law.
00:10:00.460 There are really tragic and bigoted examples
00:10:05.940 of jury nullification.
00:10:07.080 For example, the Emmett Till murder trial in 1955,
00:10:10.880 the defendants were quickly acquitted
00:10:13.260 despite very significant evidence.
00:10:15.180 And it was an all-white male jury that nullified.
00:10:19.460 And it was simply racism.
00:10:21.500 They weren't going to hold the defendant guilty
00:10:24.100 for murdering Emmett Till.
00:10:25.960 And by the way, in the Vietnam War,
00:10:29.080 there were some juries that acquitted draft dodgers
00:10:32.040 and protesters and activists.
00:10:33.760 That is a check built in the system.
00:10:36.200 What is different here is you've got George Soros
00:10:39.520 and left-wing groups putting serious money
00:10:41.980 behind promoting this on a systemic basis
00:10:44.840 by trying to send leftists in to infiltrate jury pools
00:10:48.500 and to undermine it.
00:10:51.140 And understand the purpose of this.
00:10:53.680 This is really, it's a form of really jury tampering
00:10:57.080 because, look, Minneapolis is not a particularly
00:11:00.240 huge municipality.
00:11:01.640 And if they're able to push enough left-wing activists,
00:11:04.820 their objective is for their protesters
00:11:07.880 to be able to engage in criminal violence.
00:11:10.480 Understand, this is not like draft dodgers
00:11:13.380 and you disagree with the Vietnam War.
00:11:15.560 This is biting someone's finger off
00:11:18.500 and saying, we're going to refuse
00:11:21.860 to hold you criminally accountable.
00:11:23.420 And understand, this will also be
00:11:25.080 beating someone up, seriously injuring them.
00:11:28.100 And this is part and parcel
00:11:29.380 with the leftist agenda of abolishing the police.
00:11:33.660 That's one way that you eliminate
00:11:35.780 criminal penalties for violent conduct.
00:11:38.820 Another way you do so
00:11:41.440 is by electing George Soros prosecutor.
00:11:44.540 Soros has put millions of dollars
00:11:46.320 into electing radical prosecutors
00:11:48.900 who simply refuse to charge crimes.
00:11:51.680 And you know what?
00:11:52.260 If someone commits an act of violence
00:11:53.640 and the prosecutor won't charge them,
00:11:55.020 you've effectively abolished the police
00:11:56.660 because you've legalized violence.
00:11:58.680 And this is another strategy
