00:00:32.920 and that is Justice Clarence Thomas.

00:00:38.460 Talk about the Democrats and their game plan for this, quote,

00:00:45.340 Well, we're witnessing an historic assault on the court,
00:00:48.840 and what the Democrats are doing is launching a frontal attack
00:00:53.460 on the Supreme Court itself on the legitimacy of the court.
00:00:57.340 They're trying to tear down the institution altogether.
00:01:00.740 The reason they are doing that is that the Supreme Court is the one institution
00:01:06.200 that the hard left does not control,
00:01:08.820 and there is right now a majority of justices on the court
00:01:13.240 who are committed to the Constitution, who are constitutionalists,
00:01:17.560 and that drives the left crazy.
00:01:20.120 It is one of the very few checks that remain on out-of-control left-wing assaults
00:01:26.580 on our basic rights, on free speech, on religious liberty, on the Second Amendment,
00:01:29.980 that you have justices on the Supreme Court willing to be faithful to the Constitution
00:01:36.000 and not to leftist political ideology.
00:01:39.340 But the assault is not just directed at the court itself.
00:01:44.460 The assault is very deliberately directed at one justice in particular, Clarence Thomas.
00:01:50.700 You may have noticed in the last several weeks,
00:01:54.500 article after article after article attacking Justice Thomas,
00:01:59.380 accusing him of being unethical, accusing him of being corrupt,
00:02:03.580 accusing him of being bought and paid for.
00:02:05.520 All of this is designed to try to wear Justice Thomas down,
00:02:12.500 and the objective of the left, I believe, is they hope to drive him away from the court.
00:02:19.080 Now, let me be clear.
00:02:20.360 They will not succeed.
00:02:23.960 But if you take a moment to enter the fevered minds of the radical left,
00:02:31.880 they have a hatred for Justice Thomas,
00:02:34.440 that is unique.
00:02:37.280 There are other conservative justices.
00:02:39.680 There have been other conservative justices over the years.
00:02:43.100 But the left has a special loathing for Justice Thomas

00:02:57.140 is that a black man cannot dare to be a conservative.

00:03:30.300 every bit as conservative as Clarence Thomas.

00:03:56.840 Chief Justice Rehnquist's impact on the Supreme Court
00:03:59.680 is monumental and historic,
00:04:02.160 and yet the left does not despise him,
00:04:04.500 even a fraction of what they despised Justice Thomas.
00:04:08.500 And the important thing to understand
00:04:11.460 about this assault on Justice Thomas,
00:04:14.360 this is not a fair-minded inquiry

00:04:43.980 attacking, smearing, maligning Justice Thomas.

00:50:21.060 dinner with Justice Thomas's

00:50:25.180 mother's home this is the
00:50:26.820 home that she lives in which
00:50:27.860 is his grandfather's where
00:50:29.440 Justice Thomas moved when he
00:50:31.820 was seven and his life was
00:50:32.900 transformed from this abject
00:50:34.340 poverty of growing up in
00:50:36.200 pinpoint and then into
00:50:37.700 Savannah with his mom in a
00:50:39.940 one tenement into this
00:50:41.880 humble but solid home in
00:50:44.980 Savannah and she's living
00:50:46.860 there now but Harlan had
00:50:48.400 renovated the Carnegie Library
00:50:50.400 which was during segregation
00:50:52.080 the all black you know
00:50:53.020 library in Savannah where
00:50:55.500 Clarence Thomas first learned
00:50:56.700 to kind of love reading and he
00:50:58.880 gave a donation to renovate it
00:51:01.400 and name a wing after Justice
00:51:02.520 Thomas nothing ran to Justice
00:51:04.100 Thomas in that regard there was
00:51:06.620 a oyster and crab factory which
00:51:10.940 was in pinpoint which Clarence
00:51:12.560 Thomas grew up right next to and
00:51:15.840 and Harlan renovated that into a
00:51:18.600 museum so he's down there in 2014
00:51:21.380 and he's near his mom's neighbor in
00:51:23.620 the neighborhood and he sees that
00:51:25.520 it's it's it's a lot of drug
00:51:28.760 dealers and just you know just a
00:51:31.660 bad place not safe and Harlan asked
00:51:36.080 Justice Thomas what are you going to
00:51:38.220 do with this home when your mom
00:51:39.720 passes and her his mom at the time
00:51:42.240 was 85 and Justice Thomas said I'm
00:51:44.300 going to bulldoze it and and Harlan
00:51:46.300 said that would be terrible like this
00:51:48.640 should be a museum so he wanted to
00:51:51.280 buy it in order to preserve it and
00:51:55.140 you know at the time he talked to
00:51:57.420 Justice Thomas but he didn't know
00:51:58.720 that Justice Thomas even owned an
00:52:00.080 interest in it the house had passed
00:52:02.000 from his grandfather when his
00:52:03.180 grandfather died in 84 through his
00:52:05.420 mother his brother who passed away in
00:52:07.520 2000 so his brother's estate now and
00:52:11.420 and his mother and Harlan Crowe's team
00:52:15.700 he's in real estate he's a developer
00:52:17.960 looked at the fair market value and
00:52:21.920 offered a price of 133 for that home
00:52:24.260 plus two other plots lots that used to
00:52:27.760 have homes on them that his
00:52:29.680 grandfather owned their one one house
00:52:32.120 over on the same street so they entered
00:52:34.900 into a you know a contract and in in
00:52:38.800 the and part of that contract was to
00:52:41.380 give a life occupancy agreement to
00:52:45.080 Justice Thomas's mother so she could
00:52:47.180 live there for the rest of her life
00:52:49.340 she's you know fortunately still living
00:52:51.640 at 94 but at 85 had entered into this
00:52:54.300 contract to purchase the home this way
00:52:56.220 he could own the property so that he
00:52:58.880 could preserve it and it wouldn't be
00:53:00.340 sold to somebody else it wouldn't bulldoze
00:53:02.120 it was a beautiful story when he bought
00:53:06.040 the crab and oyster factory the cannery
00:53:10.520 several years earlier the people who
00:53:13.840 owned that Harlan wanted to buy that
00:53:16.600 too to be able to preserve it so he
00:53:18.280 gave them a life occupancy agreement in
00:53:21.460 in that home so it's the same thing
00:53:23.740 people are saying oh you know they're
00:53:25.660 letting Harlan Crowe is letting his
00:53:27.440 mother live there rent-free there's
00:53:28.920 nothing of the sort it was an agreement
00:53:30.740 that made a lot of sense so Harlan could
00:53:32.660 buy the property to preserve it and
00:53:35.480 then allow his mom to live there
00:53:36.600 because he's in no rush he just wanted
00:53:38.040 to have this home so that he could
00:53:39.940 he you know he can preserve it and
00:53:42.340 make it into a museum at the
00:53:43.420 appropriate time beautiful story now
00:53:46.540 when Justice Thomas had you know in
00:53:48.540 supporting his mother and and helping
00:53:51.900 her with the home down there he had
00:53:53.260 poured a lot of money into this home
00:53:54.680 and so his capital costs and the
00:53:57.060 improvements to the home were such
00:53:58.960 that one that when the transaction
00:54:00.580 happened and Justice Thomas only got a
00:54:02.500 third of that 133 so it's around 40
00:54:06.220 44 thousand dollars his capital costs
00:54:10.180 were above that and so when he was
00:54:13.600 doing the you know thinking about this
00:54:15.660 transaction he thought it's a loss
00:54:17.560 that's not income for me so I'm not
00:54:20.020 reporting any income on it but then
00:54:24.180 there's this section that's called
00:54:25.700 transactions called the it's called
00:54:27.580 investments and trusts on the form and I
00:54:31.340 think he inherited this home and years
00:54:33.120 ago hadn't really thought of it as a
00:54:34.960 investment or trust and didn't put down
00:54:37.960 on that part of the form it says any
00:54:39.640 transaction over a thousand dollars so
00:54:41.720 on that part he didn't put it down
00:54:43.540 there because he thought I didn't make
00:54:44.820 any money I'm thinking of that section
00:54:46.760 and didn't put it down I think he's
00:54:49.760 reviewing his forms and he's
00:54:51.300 anticipated I think to to amend that
00:54:53.600 part of the form but that's nothing
00:54:55.600 amendments happen all the time right as

00:55:03.780 they did something they need to amend it

00:55:17.200 and and accommodations Justice Jackson
00:55:21.500 forgot to mention got to disclose her
00:55:24.520 husband's malpractice consulting fees for
00:55:27.320 many years on her forms and she put that
00:55:29.800 down belatedly on her Supreme Court forms
00:55:33.040 so nothing unusual to do that so so again
00:55:37.380 that it was this transaction where you know
00:55:40.040 Harlan Crowe because as you've described
00:55:42.320 and he's an incredible patriot he is in
00:55:45.160 and sort of preserving the Clarence Thomas
00:55:48.240 story right this amazing and I won't go
00:55:51.220 through it you did a beautiful job in the
00:55:53.000 intro of where Justice Thomas was born and
00:55:55.920 how he came you know sort of came through
00:55:58.220 life it's just this inspiring story and so
00:56:01.340 Harlan has over the years long before he
00:56:04.200 he purchased Justice Thomas's mother's
00:56:06.340 home had purchased several things in the
00:56:09.600 Savannah pinpoint area to preserve this
00:56:11.840 heritage and and the life story of Justice
00:56:14.440 Thomas so so let me underscore two things
00:56:17.520 you said because I think that there was a
00:56:18.980 lot of very important information you said
00:56:20.920 number one that that Harlan Crowe purchased
00:56:25.520 this home in order to preserve it in order
00:56:30.140 to turn it into a museum now if you think
00:56:32.660 about it there are museums to practically
00:56:36.660 every former president of the United States
00:56:39.140 there are museums to Supreme Court justices
00:56:42.640 there are museums to senators and members of
00:56:45.160 Congress there are museums to governors
00:56:46.840 we normally think of erecting museums to
00:56:50.280 recognize people who have been historically
00:56:52.220 significant as a public service as
00:56:55.340 recognizing their impact by any measure
00:56:58.780 Clarence Thomas's life has been historically
00:57:01.560 significant you also take this home in the
00:57:04.640 context Justice Thomas's autobiography is
00:57:07.000 entitled my grandfather's son it's a beautiful
00:57:09.480 autobiography I have actually given Justice Thomas's
00:57:13.560 autobiography to teenagers in particular to
00:57:17.480 African-American teenagers to inspire what is
00:57:25.060 possible the journey that he traveled facing
00:57:29.060 real and serious discrimination facing real and
00:57:32.780 serious hardship and rising to the very pinnacle
00:57:36.480 of the legal profession is is powerful and inspiring
00:57:42.060 it's inspiring to all of us and and so you know I for
00:57:45.860 one am grateful that that Harlan is stepping forward to
00:57:49.940 commemorate that history to to to provide for a museum
00:57:54.380 but but it is a fairly bizarre concept that by by creating a
00:58:00.140 museum there's somehow something untoward or corrupt on that
00:58:04.880 particularly a museum where Justice Thomas lost money
00:58:07.780 and and the sort of related notion that well but Harlan
00:58:12.580 Crowe didn't evict his 94 year old mother from the home if
00:58:16.480 you're going to turn it into a museum you know what he
00:58:20.440 might have been the mustache twirling villain if he'd thrown
00:58:23.800 the 94 year old out and said sorry you're on the street lady good
00:58:27.080 luck like like it's not a strange notion to say we're going to buy
00:58:31.920 this and turn it into a museum but we're going to allow you to
00:58:34.320 live in your home and until the time comes that you pass that
00:58:37.240 that is a a normal step and then so the one the one little
00:58:43.400 attack they have that has a tiny purchase is is you said that
00:58:47.220 that well technically he he should have reported it now I
00:58:51.460 will note as you did Supreme Court justices amend their
00:58:56.060 disclosures all the time I will tell you as a senator I have
00:58:59.900 to file a financial disclosure every year every senator does every
00:59:04.000 house member does the directions on those financial
00:59:07.620 disclosures are complicated they're arcane there's a whole
00:59:10.860 team of lawyers in the senate who advise you and so you'll have a
00:59:15.440 question about a particular transaction how do I record it and
00:59:18.340 by the way that team of lawyers sometimes changes their mind so one
00:59:22.400 year they'll tell you to record a particular transaction one way and the
00:59:26.200 next year they say no no no we've decided you record it another way and so
00:59:29.220 it it is arcane there's a lot of gray area and so justices and justices also
00:59:36.040 have lawyers at the Supreme Court who advise them on that Justice Thomas has
00:59:40.540 said he relied on the advice of the lawyers at the Supreme Court for how to
00:59:44.740 fill out his form and if it is the argument of the left that amending your
00:59:50.840 form shows aha you did something wrong or corrupt I'm willing to wager
00:59:55.440 something I can't prove this but you could actually research it and find out
00:59:59.720 the answer pretty quick but I'll wager you 20 bucks Ben that every single
01:00:06.260 Democrat on the Judiciary Committee who has been on the committee five years or

01:00:59.780 Bill Clinton museum the standard by the way Thurgood Marshall's childhood home is

01:01:15.640 this attack is a nakedly hypocritical political attack it is not a a
