00:03:51.280 Donald Trump calls to remove Harvard's tax-exempt status.
00:03:55.700 Let's explain exactly why he's saying that and what made this all become such a big deal so quickly.
00:04:01.900 Well, Harvard is the oldest university in America.
00:04:04.480 It was founded in 1636.
00:04:06.620 It is the wealthiest university in America.
00:04:08.800 It has a $53 billion endowment.
00:04:12.040 And for a long time, it's been the most prestigious university in America.
00:04:15.420 And I think President Trump is exactly right going after Harvard because it is the birthplace of woke.
00:04:24.160 As you know, my last book, Unwoke, How to Defeat Cultural Marxism in America,
00:04:29.300 I describe colleges and universities, and especially Harvard, as the Wuhan lab of the woke virus.
00:04:36.740 It's where it was invented.
00:04:38.400 It's where it mutated.
00:04:39.840 And it's where it spread.
00:04:40.800 Now, going after Harvard and denying them their tax-exempt status, what does that mean?
00:04:46.760 If their 501c3 status is revoked, it means Harvard pays taxes, just like a for-profit institution.
00:04:53.640 It also means contributions to Harvard are no longer tax-deductible.
00:04:59.560 So if you give money to Harvard, you can't deduct them from your taxes.
00:05:02.400 Because both of those are a huge, huge deal.
00:05:06.920 If that happens, if the Trump administration follows through, Harvard will litigate.
00:05:11.340 They will go to court.
00:05:12.580 And this will be a battle that will go to the U.S. Supreme Court.
00:05:15.740 And on one level, the Trump administration's legal arguments are very strong.
00:05:21.300 But at another level, it's an uphill fight given who the Supreme Court is.
00:05:25.300 So we're going to break down both pieces of that.
00:05:27.960 Why is the legal argument strong?
00:05:29.820 Well, I'll tell you the case that would be front and center if this goes to the court
00:05:36.100 is a case called Bob Jones University v. United States.
00:05:39.900 And it was decided by the Supreme Court in 1983.
00:05:43.040 And what happened in 1983 is the IRS revoked the 501c3 status of Bob Jones University
00:05:51.180 because Bob Jones University had a policy that prohibited interracial dating.
00:05:58.260 There was another school, Goldsboro Christian Schools, that had a racially discriminatory admissions policy.
00:06:05.500 And likewise, the IRS revoked Goldsboro's 501c3 exception.
00:06:11.360 That case went all the way to the Supreme Court.
00:06:13.660 The Supreme Court ruled 8 to 1 that the IRS could revoke the 501c3 exception.
00:06:19.780 And they did so by concluding that it was contrary to public policy.
00:06:25.060 To promote racial discrimination was contrary to public policy objectives in the United States.
00:06:32.360 And that will be the basis.
00:06:34.280 It was 8-1.
00:06:35.600 Chief Justice Berger wrote the majority opinion.
00:06:38.220 There was only one dissent.
00:06:39.560 The dissent was William Rehnquist, who wrote a dissent and said,
00:06:42.180 look, under the terms of 501c3, under the statute, they don't specify whether the purposes are good or bad.
00:06:49.020 And so we shouldn't allow them to do that.
00:06:51.400 But eight justices said, well, yes, we should.
00:06:53.960 And that's what we do.
00:06:55.400 That will be the basis.
00:06:57.460 Now, under that case, Harvard has a real difficult time.
00:07:02.800 And it has a real difficult time because it has, for a long time, openly and brazenly discriminated based on race.
00:07:12.060 And it has also openly and brazenly created an environment that discriminates against Jewish students and promotes anti-Semitism.
00:07:22.260 Both of those are huge, huge factual problems.
00:07:25.900 And the facts, particularly at Harvard, there was just a scathing report on anti-Semitism that walked through the incredible pattern of anti-Semitism that Harvard has promoted, welcomed, and used to persecute Jewish students.
00:07:47.660 And that, on the face of it, is contrary to federal civil rights laws.
00:07:51.660 And so the Trump administration's legal argument on the merits is quite strong.
00:07:57.180 You look at the legal arguments here, and there's a lot of people that are going to just be angry about the story itself.
00:08:02.780 And the fact that you're rewarding people for going after Jewish students.
00:08:09.420 I mean, how is this not an award to the student by saying, hey, we're sanctioning what you did.
00:08:15.620 We know you're taking a bag of rap.
00:08:16.820 But, hey, here's a bunch of money for you to go ahead and say we're behind you.
00:08:20.960 That seems to be what the university is saying.
00:08:23.240 Otherwise, why on earth would you give this cash?
00:08:27.000 Yeah, look, and there are twin issues here.
00:08:29.540 The Trump administration has already cut $2 billion, frozen $2 billion in direct federal funds that it was sending to Harvard.
00:08:36.560 That's a big deal.
00:08:37.840 The 501c3 status is an even bigger deal.
00:08:41.060 And so both of those, the basic principle is if a university is violating federal civil rights law, if they're discriminating based on race, if they're discriminating against Jewish students, if they're discriminating against Anglo students, if they're discriminating against Asian students, all of which Harvard has been doing, why should the federal government be giving them money?
00:09:02.800 And why should they get a special benefit under the tax laws?
00:09:05.580 Now, why is it that I say this is an uphill fight?
00:09:09.260 Because the Supreme Court is an institution that is elite and that is very much birthed of the establishment.
00:09:18.120 Let me ask you, Ben, of the nine Supreme Court justices, how many of them do you think went to Ivy League schools?
00:09:26.400 I'm going to go with eight of the nine.

00:10:25.580 The only one that doesn't have an Ivy League degree is Amy Coney Barrett, who went to Rhodes College in Notre Dame.
00:10:31.240 But if you look at it, this is an institution that is steeped, steeped in Harvard and the institution.
00:10:40.580 In fact, Elena Kagan was the former dean of the Harvard Law School.
00:10:44.320 And so I think they are going to be highly resistant to the notion that Harvard's 501c3 status can be revoked.
00:10:53.440 And I will tell you, they're also going to be concerned about the slippery slope of what happens with the next administration.

00:11:00.280 So, Senator, here's the question that I think a lot of people listening are going to want me to ask.
00:11:03.820 And that is, it sounds like this would be much of an uphill battle for the president.
00:11:07.880 I think he probably knows that his staff does.
00:11:10.580 But is this also as much about sending a message to other universities that if you think that we're going to turn a blind eye to this, you're wrong and we're going to be watching you closely?
00:11:20.680 Of course it is.
00:11:21.720 Look, Harvard is the big kahuna.
00:11:23.120 And so going after Harvard is meant to send a message to every other school that violating the civil rights law, discriminating based on race, discriminating against students on their skin color, on their race, on their religion, is contrary to federal law and there will be real consequences.
00:11:42.660 You look, for example, Harvard just released a scathing report on anti-Semitism on campus and it found that politicized instruction in four Harvard schools had, quote, mainstreamed and normalized what many Jewish and Israeli students experience as anti-Semitism.
00:12:03.180 And the four schools were the Graduate School of Education, the T.H. Chan School of Public Health, the Divinity School, because, of course, if you're studying divinity, you're going to be a racist, and the medical school, all of which have been targeted by the Trump administration for, quote, egregious records of anti-Semitism or other bias.
00:12:24.040 And the report concluded that at those schools, Jewish students and Israeli students were routinely ostracized and subject to instruction, quote, that effectively made a specific view on the Israel-Hamas conflict a litmus test for full classroom participation.
00:12:44.560 And let me give you one example, a required school course in the school of education taught something called the Pyramid of White Supremacy.
00:13:00.600 And this document is really, it's a chart, if you look at it on Twitter or online, it'll blow your mind, but it's a Pyramid of White Supremacy.
00:13:09.880 And here are all the things that it's describing as white supremacy.
00:13:14.100 At the top is the KKK.
00:13:15.840 Okay, we're agreed.
00:13:16.780 KKK, very bad.
00:13:18.660 I'm against.
00:13:19.920 Lynching, terrible.

00:13:22.440 Burning crosses, very, very bad.
00:13:25.700 Racial slurs, jokes, terrible.

00:13:29.520 Anti-Semitism, kind of interesting.

00:13:33.520 Japanese incarceration.
00:13:36.500 Operation Wetback.
00:13:37.860 Now, Operation Wetback was an Eisenhower federal government program deporting illegal aliens.
00:13:43.580 So that is now white supremacy to deport illegal aliens.
00:13:47.240 And the Muslim ban, which was President Trump's policy in the first term that was restricting immigration from countries with high percentages of radical Islamic terrorism.
00:13:59.180 All right, so that's the first part of the triangle.
00:14:01.640 You can agree with some of it, you can disagree with some of it, but then it starts to get really loony.

00:18:07.180 It does seem pretty clear that they believe that they're never going to be touched.
00:18:11.900 And even if they are, their endowments are so big that they think they're probably going to be just fine and liberals will continue to give.
00:18:21.660 Does that not go back to the point the president's bringing up, which is why the hell are we giving all of these places this money?
00:18:28.860 They're fine on their own.
00:18:30.520 They're acting like they don't need us.
00:18:33.080 They are hardcore against conservatives and others who don't basically go with this pyramid of hate of conservative ideals.
00:18:40.740 So, let's just decouple and say, you guys do you, and we'll keep our tax dollars.

00:18:49.000 I will say that there is research money that is spent in colleges and universities that is worthwhile, that is useful.

00:18:57.000 There's research, say, at medical schools where you're trying to research the cure for cancer.
00:19:01.400 You're trying to research a cure for Alzheimer's.
00:19:03.720 You're trying to cure deadly diseases.
00:19:05.340 There is scientific research that the Department of Defense pays for, for example, that is developing high-tech lasers or other equipment that has significant defense needs.
00:19:17.960 And so, there is a role for scientific research.
00:19:21.580 And much of the scientific research that happens in our nation happens in research universities.
00:19:26.980 All of that would be fine if, and this is a big if, universities were not flagrantly violating federal civil rights laws.
00:19:38.620 Let me give you more from this report at Harvard.
00:19:41.700 At the Divinity School, Jewish students were subject to, quote, the embrace of a pedagogy of de-Zionization, in which instructors attribute to Jews two great sins.
00:19:58.560 First, in the Levant, the establishment of the State of Israel and the Palestinian Nakba.
00:20:06.140 And second, in the United States, participation in white supremacy.
00:20:12.220 So, the Harvard Divinity School teaches Jews the existence of the State of Israel is racist.
00:20:21.280 And Jews also, they teach, are white supremacists.
00:20:26.700 That is flagrantly in violation of federal civil rights laws.
00:20:30.520 And sadly, it is something that Harvard openly embraces.
00:20:36.940 As they fight this, final question, is there an opportunity through this legal challenge for us to even be able to find out more about what Harvard is doing?
00:20:46.520 Is that part of what could happen?
00:20:48.100 And the upside here is, hey, we get to ask more questions.
00:20:50.820 We get to see more behind the books.
00:20:52.560 We get to see more of the propaganda that we are talking about right now.
00:20:57.600 That is absolutely right.
00:20:59.520 And I'm going to say the facts are going to get worse and worse as they come out.
00:21:02.720 Harvard doesn't want people to know the facts.
00:21:05.080 So, for example, there were a whole series of stories that came out about the Harvard Law Review.
00:21:11.820 Now, what is the Harvard Law Review?
00:21:13.040 The Harvard Law Review is a legal journal that's at Harvard Law School that has 80 students who are student editors.
00:21:20.040 And getting on the Law Review is incredibly prestigious.
00:21:23.640 It is incredibly difficult to do.
00:21:25.360 Typical Harvard Law School class is about 560 people.
00:21:29.160 So you have about 40 people out of 560 that make it on the class, make it on the Law Review.
00:21:33.580 When I was there, I was on the Law Review.
00:21:35.780 When I was there, roughly half of the editors on the Law Review made it from a combination of grades
00:21:43.700 and a week-long, incredibly arduous writing competition.
00:21:49.280 Another roughly half made it from purely the writing competition.
00:21:53.120 But when I say roughly half, at the time, it was 32 were grades in writing, 32 were just writing,
00:21:59.340 and then eight were reserved for affirmative action.
00:22:02.040 That's when I was there.
00:22:03.420 Now, by all appearances, it has gotten much worse.
00:22:06.120 It was brazen then.
00:22:07.100 It was racially discriminatory then, but it is now much worse.
00:22:11.600 The Harvard Law Review now uses race explicitly to, number one, select their editors.
00:22:20.080 And by the way, becoming an editor at the Law Review increases your chances of getting a judicial clerkship dramatically,
00:22:25.940 increases your chances of getting a Supreme Court clerkship dramatically,
00:22:30.120 increases your chances of getting hired by a big, prestigious law firm that pays lots of money dramatically,
00:22:35.540 increases your chances of becoming a professor at a prestigious university dramatically.
00:22:40.900 So the Law Review is a major gateway to elite success in the legal world.
00:22:46.700 And the Harvard Law Review now, in writing, they are quite open in saying that they will discriminate for editors based on race,
00:22:55.800 and they will also discriminate on the articles they pick.
00:22:59.800 So, for example, in a 2024 memo, one journal article argued that the fact that the author was, quote,
00:23:07.460 not from an underrepresented background was a negative when it came to evaluating the piece for publication.
00:23:14.480 There is a, quote, holistic review committee, which now selects nearly half the student editors,
00:23:22.080 and has made the inclusion of, quote, underrepresented groups its first priority.
00:23:28.840 So, to be clear, what you're saying is...
00:23:31.260 This on the face of it violates Title VI.
00:23:32.480 So, to be clear, you're saying there's a chance now that if you were at Harvard you wouldn't get picked?
00:23:37.420 Is that what you're telling me?
00:23:40.160 You know, I don't know.
00:23:42.060 And you don't know...
00:23:42.840 So, I say that what's interesting about it is you genuinely don't know.
00:23:48.020 It was one of the things that they're very clever in how they discriminate,
00:23:51.180 because you don't know on what basis you were admitted.
00:23:54.420 I had the grades to get in on grades, and I think I did well in the writing competition,

00:24:34.940 And out of the 80 students, there were maybe 8 or 10 of us that were conservatives.

00:24:40.700 So, I was like, look, we ain't going to win the vote, but all right, that's fine.

00:24:45.220 So, we're having the debate, and I was sitting in the back.
00:24:47.400 It was fairly quiet.
00:24:48.840 And I remember this one supercilious liberal stood up and said,
00:24:54.460 if we eliminate affirmative action, the Harvard Law Review will be nothing but white men.
00:25:04.140 And I have to admit, I was kind of a little bit checked out in the back of the room,
00:25:07.160 and I heard that, and that pissed me off.
00:25:09.120 And I said, you know what?
00:25:10.660 You want to understand why affirmative action is so insidious?
00:25:14.140 The arrogance of that imbecile just showed it.
00:25:18.000 His belief, as an enlightened leftist, is that if merit were the only criterion,

00:25:26.260 That no one who is African American would get in.
00:25:28.460 No one who is Hispanic.
00:25:30.200 And let's be clear, I'm Hispanic.
00:25:32.680 He's sitting there, and in fact, I told him, I said,

00:25:43.360 But there was something even more dripping in his leftist condescension,
00:25:49.060 which is at the time, the Harvard Affirmative Action Program did not include gender.
00:25:54.860 So there was not affirmative action for women.
00:25:58.320 And I said to all the women editors, do you hear what he just said to you?
00:26:01.580 He believes if it's pure merit, no women would make it.
00:26:05.940 And by the way, historically, all the women editors who were liberals
00:26:08.880 voted against adding gender to affirmative action
00:26:12.000 because they recognized that if it was added to it,
00:26:15.820 that people, it would devalue what they had accomplished.
00:26:19.560 But it showed the absolute arrogance of the left when it comes to embracing racism
00:26:27.900 because at the end of the day, they look down on the poor, benighted people
00:26:33.160 that will only succeed in life with their beneficence.
00:26:36.900 And by the way, the price for that beneficence is for them to be loyal and obedient for the rest of their lives.
00:26:43.340 I mean, that is the very explicit left-wing charter that affirmative action is based on.
00:26:49.720 Which brings us to another story where this stuff started on college campuses
00:26:53.960 and now it's made our way into courtrooms.
00:26:56.980 The Tesla arson suspect, one of them, and there's a lot of them out there, right?
00:27:01.820 But this one specifically, and we'll get to the story of what happened here in a second,
00:27:06.040 but has been, quote, released because of gender transition would be at risk if they didn't release.
00:27:14.820 So if you're going to jail, just say you're doing a gender transition
00:27:19.100 and apparently then the law cannot hold you accountable for your terrorist actions.
00:27:23.820 So there's an individual named Owen McIntyre who was on spring break in Missouri
00:27:28.920 and he firebombed two Tesla Cybertrucks.
00:27:34.240 He threw Molotov cocktails, he firebombed it, he got caught, and he was charged, charged with domestic terrorism.
00:27:41.900 And then what happened is his federal public defender argued that going to jail
00:27:47.820 will disrupt his gender-affirming medical care, which began in March of this year
00:27:54.320 and is likely to be interrupted or terminated entirely if he remains in pretrial detention.
00:27:59.440 And the federal magistrate judge bought that argument and let him go.
00:28:05.040 And let me say one of the craziest things about this story.
00:28:10.500 You and I, Ben, spent 20 minutes trying to figure out if this defendant is male or female.
