00:24:50.000 They even run their own candidates who are members of the Mays family on machines that they control and they magically win here in Austin. 0.91

00:25:17.000 And we've got convicted felons caught running the computer systems for Diebold, who were convicted of computer crimes and hacking, and they're vice presidents for them.

00:25:30.000 And it just goes on and on and on, hundreds and hundreds and hundreds of articles all over the country that never make national news, where Diebold and others are caught stealing elections on purpose with wireless transmitters inside the computers and everything else, and they say you shouldn't be able to have a paper trail, you shouldn't be able to have a record of how you voted, how dare you ask for that, but are you a conspiracy theorist?

00:25:56.000 An influential employee of voting machine maker Diebold Elections Systems left the company recently to take a job as elections manager.

00:26:08.000 And it says, uh, Deborah Seller, a sales representative for the beleaguered voting company, was hired a week ago and started Monday in Salino County, northeast of San Francisco and California's wine country.

00:26:21.000 The position puts her second in command of elections in the county under the Registrar of Voters.

00:26:27.000 Now, it's funny there's an article about this in a newspaper, because, in a magazine, because here in Austin, I have a lot of friends who are, you know, involved politically.

00:26:38.000 I've had a whole bunch of top election judges pointed out to me who were Hart InterCivics employees.

00:26:46.000 We have these former and current employees of Hart InterCivics, where all of our ballots are cast in Travis County, most of them in Hayes and Williamson, 83% for those three counties, this congressional district.

00:27:59.000 This is just a total runaround of the democratic process, said Douglas MacDonald of the Community Labor Alliance, an activist group that pressured Salino County to end its contract with Diebold.

00:28:08.000 There was an open debate and discussion and the county supervisor decided that Diebold is not the company, it is not the philosophy we want behind the running of elections in Salino County.

00:28:20.000 They go out and hire the person who was advocating that philosophy.

01:08:27.000 And from my understanding, this new Patriot Act amendment, or Patriot Act 2, Um, kind of removes even more checks and balances to the sneak and peek provision, where the FBI can go in and search your home without even telling you that they were there.

01:08:50.000 So there's even less checks and balances on that kind of invasive procedure.

01:08:55.000 But I mean, when you mention the Patriot Act, The first patriarch, we hear the same line again and again regurgitated whenever it's mentioned that neocons will respond by saying give me an example of where this is used against anyone other than non-American terrorist suspects.

01:09:16.000 And we've got another prime example today out of the Jackson Citizen Patriot and the Associated Press, which circulates around a teenager at a high school who was charged with terrorism for swearing at a teacher.

01:09:32.000 Now granted, you know, he made threats to kill somebody, which should have some retribution, but they're talking about a 20-year prison sentence under the Patriot Act for terrorism.

01:09:44.000 Well, you know, Paul, every week I think of some new subsection for you to build.

01:09:50.000 There are hundreds of examples, not just the ones we always use of the Las Vegas Review Journal, you know, the topless bar owner pays a county commissioner $4,000 to zone him for more parking spaces or, you know, a pot dealer with an ounce of marijuana.

01:10:05.000 There's a Washington Times article from two years ago where the Justice Department spokesman goes in there and says, of course we're using it for all misdemeanors and all crime.

01:10:20.000 I mean, I don't say post the 500 that are there, but can you just find 30, 40 maybe, and post those, and then show maybe a few quotes of neocons?

01:10:32.000 And there's no one there to debate them, when the Justice Department says they're using it against the general public.

01:11:10.000 Yeah, and there's another portion of that which is in fact more interesting than the program itself, which is the adverts, which we can talk about later, but with the draft, his reaction and people of his ilk say at one end of the spectrum, one portion of them say it's a total conspiracy theory, no such proposal exists.

01:11:30.000 And at the other end, people like Hannity will admit to it, but then say it's a completely democratic proposal.

01:11:36.000 You know, Rangel introduced the bill as a kind of joke.

01:11:41.000 But then, you know, in reality you've got people like Chuck Hagel, a Republican, supporting the bill.

01:11:48.000 And you know, he's an influential Republican.

01:11:51.000 And they never mention that, so it's the lie of omission again.

01:11:55.000 They use the same thing with the Patriot Act by failing to recognize these numerous examples where it's used against American citizens for things like swearing at a teacher at a high school, as is the example today.

01:12:07.000 Well, I mean, you know, they say he didn't have guns, didn't have the capacity, that he has learning disabilities and likes to threaten people.

01:12:16.000 So take him and put him in jail for a year and then let him bust some rocks.

01:12:23.000 If he didn't have guns and wasn't planning to shoot anybody, but even if the guy came and shot people, God forbid, that would be a crime punishable by execution.

01:38:34.000 Marlin's fan spends a night in jail for curfew violations out of the Palm Beach Post from a few weeks ago.

01:38:41.000 And it says Marcos Gonzalez started the evening Tuesday in his regular seat behind home plate at Pro Player Stadium, but ended it standing for 11 hours in a hot, crowded jail cell where he was detained for breaking the Palm Beach County curfew.

01:38:59.000 Gonzalez, a 35-year-old attorney and a Marlins season ticket holder, watched his team beat the Mets with his brother-in-law and his two kids.

01:39:09.000 The game ended after 9 p.m.

01:39:10.000 toward the Wellington to join his wife and son at his sister's house.

01:39:19.000 After exiting at Interstate 95, he was stopped three times by law enforcement officers enforcing the curfew.

01:39:26.000 Two of them told him to have a good night and allowed him to pass after he explained he'd been at the game and showed them his ticket stubs.

01:39:34.000 But later he was pulled over And the deputy said, I don't care where you were, I'm going to arrest you and put him in plastic handcuffs.

01:39:45.000 Now here's the problem with this.

01:39:46.000 You had hurricanes down there and they passed and they would arrest people randomly who were out after dark.

01:39:53.000 But the problem is, is I see articles five years ago out of Cloverport, Kentucky where they have a curfew for adults after dark and it's selectively enforced.

01:40:03.000 New York's talking about an adult curfew.

01:40:06.000 All these other places are talking about curfews, and quote, we'll just search you after dark.

01:40:11.000 You know, oh, we've got this new threat of terrorism, or whatever.

01:40:14.000 Folks, this isn't America.

01:40:16.000 We've all seen the video of the father trying to get back to his property after five days of not being in it.

01:40:22.000 Hurricane's long gone.

01:40:23.000 He argues with them, so they taser him in front of his family.

01:40:27.000 We see all the different reports and videos, stuff like this happening.

01:40:30.000 This didn't, they didn't used to behave like this.

01:40:32.000 This isn't the way this country used to operate.

01:40:35.000 But with the backdrop of terrorism, all these petty things now are being treated as these huge crimes.

01:40:51.000 Describe what happened to you and why you think it was wrong.

01:40:55.000 Well, first of all, I didn't know that there was a curfew in place after the hurricane because I had no way of knowing.

01:41:01.000 I had no power in my house.

01:41:03.000 I didn't have access to the Internet.

01:41:05.000 So I spent most of my days after the hurricanes cleaning up debris in my backyard.

01:41:11.000 And I decided to take a break and go to the Marlins game.

01:41:14.000 This was three days after the hurricane.

01:41:16.000 I had a great time at the game.

01:41:18.000 Didn't think anything of the curfew.

01:41:20.000 And then I started making my way back home.

01:41:23.000 And at the first roadblock is where I realized that there was a curfew in place.

01:41:27.000 And I showed the officers the ticket stubs.

01:41:30.000 My wife and son decided not to go to the game with me because they just didn't want to go to Miami after everything that we had gone through.

01:41:39.000 We didn't have power at our house.

01:41:40.000 We were staying at my sister's house.

01:41:42.000 And as the paper states, as I was making my way home, I was stopped at two roadblocks before the third and last roadblock where I was arrested.

01:41:51.000 The cops thought that going to a Marlins game was a good excuse, but when I got to the third officer, In his discretion, there's no basis for me to be out on the street.

01:42:02.000 Well, here's a question I've got.

01:42:03.000 I mean, I always have pointed this out.

01:42:07.000 You've got bars all over downtown Austin or any other city, everybody getting drunk, but then they let you go out and get in your car and leave.

01:42:14.000 Why don't they just shut down the bars? 0.85

01:42:16.000 And I'm not saying we should do that.

01:42:17.000 Well, it's the same thing with this Marlins game.

01:42:20.000 They let you have a Marlins game, And the restaurants are all open, but then when you try to drive on the streets, they arrest you. 0.94

01:42:28.000 You know, the argument they try to make was that the game was in Miami and we live in Palm Beach County.

01:42:33.000 It's only an hour drive, and the Marlins cater to fans in Palm Beach County, so I'm in agreement with you.

01:42:39.000 If there's this curfew, in my opinion, they shouldn't have the game.

01:42:42.000 Well, it just shows that they're not reasonable.

01:42:46.000 This is not reasonable.

01:42:49.000 I mean, Florida, there's a Florida statute that allows them to place this curfew.

01:42:54.000 And the statute, if I may read from the statute for your benefit, says whenever the sheriff or designated city official determines that there has been an act of violence or a flagrant and substantial defiance of or resistant to a lawful exercise of public authority and that on account thereof there is reason to believe that there exists a clear and present danger of a riot or other general public disorder.

01:43:18.000 Widespread disobedience of the law and substantial injury to persons or property may occur.

01:43:25.000 Those are the conditions that have to exist in order for the sheriff to enact a curfew.

01:43:29.000 It's my opinion that three days after the curfew, those conditions don't exist.

01:43:34.000 And the sheriff put this curfew in place when there shouldn't have been a curfew.

01:43:41.000 Can you describe what it was like at the third checkpoint?

01:43:45.000 What they said to you?

01:43:47.000 It was no different than the other two.

01:43:49.000 It's just that the law is put in place so it gives the discretion to the officer.

01:43:53.000 And this officer, obviously, in my opinion, abused his discretion.

01:43:59.000 I have no idea what was wrong with the guy.

01:44:01.000 He could have been having a bad day.

01:44:03.000 For all I know, I don't know what was troubling the guy.

01:44:06.000 Well, let me describe what happened.

01:44:07.000 You go, here's my ticket stub.

01:44:08.000 They just let me through two checkpoints.

01:44:10.000 Exactly.

01:44:10.000 I pulled up to where he was.

01:44:13.000 By the way, he was letting people go.

01:44:15.000 Uh, left and right before I got there, so I have no idea why he decided to keep me and let the other people, uh, go by.

01:44:22.000 Uh, he asked me what I was doing on.

01:44:24.000 I said, listen, I'm coming back from the Marlins game.

01:44:26.000 Here's my ticket stub.

01:44:28.000 I've already been stopped at two other curfews.

01:44:30.000 Uh, and, uh, I'm on my way to my sister's house.

01:44:34.000 She's two minutes from here.

01:44:35.000 And he basically said, get out of the car.

01:44:37.000 I didn't tell him that I was an attorney because frankly, I didn't think that was necessary.

01:44:41.000 Now that can go either way with sheriff's officers to tell you the truth, but I didn't think that was necessary.

01:44:46.000 I wanted the same treatment that any other citizen would have gotten.

01:44:50.000 And essentially what he told me was, get out of the car, that's not an emergency.

01:44:53.000 He handcuffed me and threw me in the back of a police car and then took me down to another place where they were holding all the curfew violators.

01:45:01.000 And then they took me to jail and I spent 11 hours there while they processed me.

01:45:07.000 And I was eventually released.

01:45:09.000 Well, Mr. Gonzalez, did they charge you with anything?

01:45:12.000 Did they drop the charges?

01:45:14.000 No, they haven't dropped the charges.

01:45:16.000 They offered most of the people that were arrested the same plea deal, which was plead no contest and withhold adjudication and pay court costs.

01:45:24.000 And sadly, most of the people that I saw in the courtroom at the time of the arraignment accepted that plea deal.

01:45:31.000 I plead not guilty and I'm waiting for a court date essentially.

01:45:35.000 Well this is why I had you on because they can claim oh we got hurricanes we've got to do this.

01:45:40.000 But I wanted to illustrate how it's number one selectively enforced and number two they're talking about there's a big flu outbreak shutting the whole country down and then this will be martial law training us how to live under this and I don't know if you're aware sir that other cities are doing this for adults 365 days a year without some type of crisis happening.

01:46:01.000 Were you aware of that?

01:46:02.000 No I wasn't and frankly if I hadn't been arrested perhaps I never would have been I'm concerned with curfews, but it definitely has brought an awareness that wasn't there before.

01:46:13.000 I'm an immigrant from a country where martial law exists all the time.

01:46:18.000 That's the country of Cuba.

01:46:20.000 And I certainly don't want the same type of laws in the country that I love so much.

01:46:49.000 Well, because in Britain, we're under a state of emergency, a permanent state of emergency, since 9-11.

01:46:56.000 In the Civil Contingencies Bill, that's exactly what it outlines.

01:47:00.000 But, to emphasize, this thing in Palm Beach is nothing about any kind of hurricane, because

01:47:06.000 There's another article that I've just found two minutes ago, out of the Palm Beach Post, which is, um, Tired Deputies Meet Tall Tales on Curfew Beat, and it says, It's already 1.30am Friday and the paddy wagon has made the rounds twice, picking up an eclectic array of vagrants up to no good miscreants and the curious who chose to ignore the 11pm to 6am curfew in St.

01:47:33.000 By the end of the seven-hour operation, there will be 37 curfew arrests.

01:47:38.000 But then it goes on to talk about the one case that it makes an example of.

01:47:43.000 So they're still doing this?

01:47:45.000 That's dated Saturday, October 2nd, two days ago.

01:47:49.000 Sure, that's after Hurricane Jean.

01:47:51.000 I'm not sure if Port St.

01:47:52.000 Lucie, which is north of Palm Beach, still has a curfew in place.

01:47:56.000 So it's discontinual?

01:47:58.000 But this doesn't even mention any kind of hurricane, it's just the regular policy, an 11 p.m.

01:48:03.000 curfew.

01:48:05.000 Let me tell you something that perhaps you don't know.

01:48:07.000 The same statute that authorizes the curfew says that a curfew can only be extended once you have an emergency declaration.

01:48:15.000 A curfew can only last for 72 hours.

01:48:18.000 If after those 72 hours a sheriff wants an extension, he has to go in front of the county commissioners and request that extension.

01:48:26.000 That extension has to be granted by the county commissioners.

01:48:29.000 That was never done in my case, in the case of the Palm Beach County Curfew.

01:48:32.000 So as usual, it's color of law, they're not even operating under a lawful order.

01:48:38.000 No, so in fact, the only guy that broke the law that day was our sheriff.

01:48:42.000 He arrested me and other people roughly 100 hours after the curfew was enacted.

01:48:50.000 But again, he kept enforcing this curfew.

01:48:53.000 And so they're still charging people when it wasn't even a law being broken?

01:48:57.000 Absolutely.

01:48:57.000 That was my case.

01:48:59.000 Again, it just gets worse and worse.

01:57:20.000 I mean... Well, I got an internal document from a Hilton employee a few months ago where they say, well, we have these high security threats all over the country and we secretly search people's cars when they're in the parking garage or when the valets park them.

01:57:37.000 And, you know, it's the same thing over and over and over and over and over again, and none of it has to do with fighting the terrorists.
