00:02:33.120 in 2016, just simply listening to the logic of the war room, the facts and evidence, the

00:06:11.840 some up days, even as most of America now has down days every time they go to try to feed

00:07:38.500 The authors of a new conservative-led report out today, debunking each and every legal claim
00:07:44.800 of election fraud made by Trump and his team as it relates to the 2020 vote.

00:07:53.140 I was talking about Republicans who call themselves conservatives but still believe in the big
00:07:59.420 lie.
00:08:00.080 And so that's why you are here.
00:08:02.400 I first want to ask you about this report that the two of you have put together.
00:08:08.400 Who is it for?
00:08:09.840 Ben first.
00:08:13.300 We wrote this report for conservatives who may believe the allegations that elections
00:08:21.380 are fraudulent and rigged.
00:08:23.620 And what we wanted to do was gather a group of conservative jurists and political operatives
00:08:30.820 to take a look at every single charge Donald Trump or his supporters filed in any of the six
00:08:37.860 battleground states.
00:08:39.260 And so we have looked at all 64 cases and 187 counts and confirmed that he did not make his case.
00:08:50.320 Okay.
00:08:51.860 Guess that election was fair, according to Mr. Ginsburg.
00:08:57.280 So where shall we start?
00:08:59.380 I remember back in the old days when I was a professor at the University of California,
00:09:05.280 Irvine, teaching business school students about how to read the newspaper, which you would think
00:09:16.320 that that's pretty easy to do.
00:09:17.700 But one of my first admonitions was simply that you have to look at who wrote whatever it is
00:09:26.320 you're writing, because that's your first tell.
00:09:29.080 That's your first takeaway as to whether or not what you're reading has a hidden or in this
00:09:38.600 particular case, a not so hidden bias.
00:09:41.680 So if you start with the presumption that there's a report out that alleges that it purports to
00:09:50.140 represent Republican conservatives and comes to the conclusion that Trump lost the election
00:09:58.860 fair and square to Joe Biden, the first thing you want to do is look a little bit more carefully
00:10:05.220 at the resumes and writings and thought of the people who wrote that article.
00:10:13.680 And when you do that, you quickly come to the conclusion that not only are these folks
00:10:21.480 avidly never Trump from the get go, and I'm not talking about the day after the 2020 election,
00:10:29.660 I'm talking back when Trump got elected back in 2016, not only are they those kind of Republicans,
00:10:38.640 but they're also the worst kind of bushy rhino Republicans that hate what Donald Trump does.
00:10:47.880 So let me break that down for you.
00:10:49.360 I just give you a couple examples.
00:10:50.660 And one of them, former Senator John Danforth is one of the authors of this 2022 report.
00:11:03.140 In 2017, Danforth said that Trump had, quote, corrupted the Republican Party,
00:11:13.340 and they must break with him in order to save it, meaning the party.
00:11:20.440 And the op-ed by Danforth was titled, Trump is exactly what Republicans are not.
00:11:28.720 And so you and I should immediately think to ourselves, oh, really?
00:11:33.900 What Donald Trump did when he got elected over the course of four years,
00:11:40.000 building the strongest economy in modern history, having peace in the Middle East and in Asia
00:11:46.880 with North Korea, Iran, China, Russia, is transform that conservative Republican Party
00:11:58.480 of the silk stockings and Wall Street, the folks like Danforth,
00:12:04.100 into a working class rainbow coalition of black, brown, Asian, white people
00:12:14.340 who work hard for a living, who are proudly where the deplorables sign on their chest.
00:12:22.700 And here's the thing, what this, and if I may crib a little bit from my Taking Back Trump's America book,
00:12:30.200 what I do in that book is explain how what Trump had in common with the 16 or 17 people he ran against in 2016
00:12:41.600 as Republican candidates was a love for low taxes for the middle class,
00:12:49.640 an insistence on reduced regulations to make us more cost competitive,
00:12:56.040 law and order, a strict interpretation of the Constitution, and strategic energy dominance.
00:13:07.100 I'll give that also to the RINOs.
00:13:12.580 But what differentiates Trump, it's the Make America Again MAGA principles.
00:13:20.960 I call it in the Taking Back Trump's America book, the Iron Triangle of MAGA principles.
00:13:28.560 It's an end to the endless wars.
00:13:31.160 It's fair as well as free trade and secure southern borders.
00:13:39.460 This is what differentiates Trump.

00:13:46.400 And today, the party of Trump, contrary to what Dantworth is saying, is exactly what Republicans are.

00:13:56.960 There's 75 million of them went to the ballot box and voted for Donald Trump in the 2020 election.
00:14:06.320 And Ginsburg, I mean, you look at the seven or so authors of that report.
00:14:11.860 I can go chapter and verse and show you how every one of them has an axe to grind dating back from the day Trump got elected.

00:16:23.520 So, Judge Griffith, if you could explain, if you look at all of these cases, what is it about the way you conducted this investigation, this report, that might help bring those who are still believing this election was stolen to reality?

00:16:44.740 Well, we started with the assumption that we were not going to rely on anyone else's account of what took place.
00:16:53.700 The president of the United States made these serious charges of election fraud.
00:16:58.240 And out of respect for the office of the presidency, we thought those claims deserve investigation and analysis.
00:17:06.060 So we weren't going to rely on anyone else.
00:17:08.380 We did a deep dive ourselves into every claim of fraud or irregularity in all the battleground states.
00:17:17.340 I think it's highly significant that three of the members of this group are former federal appeals court judges appointed by Republican presidents.
00:17:26.020 Michael Ludig, Michael McConnell.
00:17:28.480 These are two of the most highly respected conservative jurists actually in American history.
00:17:33.720 And they joined in this process, and we took a deep dive, a fresh look at all of the allegations, and we came up with the conclusion that Ben just mentioned.
00:17:47.480 There is no evidence of fraud that would have changed the outcome in any single precinct, let alone the nation.
00:17:56.740 So our hope is that when conservatives hear this from fellow conservatives, when they hear this from people who hold their same values about limited government, religious liberty, judicial conservatism, that they'll see what the truth is.
00:18:17.500 And hopefully, and this is the thing that I learned most from this process, other than the fact that it confirmed that the election was lost, not stolen.
00:18:28.040 What I learned most from this process is that we have in the United States of America today an election administration system of which we can be very proud.
00:18:38.080 The bad old days of stuffed ballots and dead people voting, those are old days.
00:18:44.040 They were bad days.
00:18:45.500 They're not today.
00:18:46.340 American people should have great confidence in the election administration system.
00:18:51.840 It held up well in this instance.
00:18:55.820 And those who claim that there was fraud in this election that changed the outcome without any evidence are actually doing great damage to our election system.

00:19:11.900 And I haven't seen anything since the election that changes my mind on that.

00:19:18.720 Well, maybe you can assess that, 2,000 mules, and people are talking about that.
00:19:27.420 Well, I mean, just in a nutshell, you know, I just think that the GBI was unimpressed with it.
00:19:34.540 And I was similarly unimpressed with it.
00:19:36.640 Because I think if you, because I was holding my fire on that to see what the photographic evidence was.
00:19:44.080 Because I thought, well, hell, if they have a lot of photographs of the same person dumping a lot of ballots in different boxes, you know, that's hard to explain.
00:19:52.640 All right, well, that is the rhino Republican defense of the Democrats' stolen election, effectively.
00:20:11.020 But let's drill down.
00:20:12.020 Let me talk just quickly about Bill Barr.
00:20:14.200 I've told you this before on The War Room, but it's a story worth telling again.
00:20:19.000 When I was in the White House, I called Bill Barr after the November 3rd election and after I had done my Navarro report, which we'll talk a little bit more about shortly.
00:20:31.960 And I said, Bill, it's like, look, I'm finding all sorts of not just fraud, but these massive election irregularities that I think probably need to be looked at.
00:20:45.580 And Bill, Bill was very firm about this.
00:20:48.500 He said, look, it's not the Justice Department's responsibility to contest that election.
00:20:54.240 And he goes back to the history of Bush v. Gore in 2000, and he said it was up to the campaign, the Trump campaign itself, to carry that water.
00:21:05.880 And he stood away by it.
00:21:07.180 So I thought at the time, I say, OK, that's a principled position.
00:21:10.720 He's going to stay out of this.
00:21:12.640 And then lo and behold, just days later, he claims that the Justice Department looked in the election and found no fraud.
00:21:20.360 That was the start of the big lie from the rhino wing.
00:21:27.440 Now, the problem I've got with this guy popping off and pontificating about his claims is, first of all, remember what he said?
00:21:37.700 He said every claim of fraud and irregularities was investigated.
00:21:42.260 OK, well, look, I think it's accurate to say and historical to say that the definitive first analysis of election of fraud and irregularities was the report I myself prepared between the time the election took place on November 3rd and the events of January 6th.
00:22:08.260 And if we could pull up slide one here, Denver, what we have were my findings, OK, which were pretty clear, that this election was determined in six battleground states.
00:22:27.880 And it was Arizona, Georgia, Michigan, Pennsylvania, Nevada and Wisconsin.
00:22:34.840 Those are the same states, by the way, this report by these alleged conservatives claim they looked at.
00:22:41.980 And what I found at the time was uniformly small alleged Biden victory margins absolutely dwarfed, dwarfed by possible illegal ballots.
00:22:57.540 For example, in Arizona, that election was won with about 11,000 votes, according to the Biden victory margin.
00:23:07.380 And I found well over 100,000 in Georgia was about 12,000 votes.
00:23:14.000 I found over 400,000 possibly illegal votes.
00:23:17.640 I could go on the other states.
00:23:19.580 But what's what's interesting to me, and here's one for the chat room right now.
00:23:24.620 Guess how many times the Navarro report was cited in that conservative piece of trash.
00:23:31.360 And remember, they claimed they looked at every claim of election fraud and irregularities.
00:23:36.360 Okay, chat room, you got it?
00:23:38.780 All right.
00:23:39.240 The answer is zero.
00:23:41.640 Zero.
00:23:42.360 They don't dare.
00:23:43.720 They don't dare to footnote my report because what I put in that report is irrefutable.
00:23:52.000 And if you look at that chart again, what I found most interesting in analyzing the data was, you know, outright fraud.
00:24:04.100 You know, they just like stuff the ballot box in the middle of the night with with fake ballots.

00:24:10.160 That would be fraud or machine stuff with and Steve and I have never, ever been machine guys.

00:24:16.980 It's like, even if you take that out of the equation to just take out any consideration of outright fraud, what I found was five other categories of problems, which included ballot mishandling, all sorts of process files, equal protection clause violations like mistreatment of the poll watchers.
00:24:40.360 And that, to me, was the basis of what should have been at that point in time, an investigation of what actually happened.
00:24:52.820 And what I find most interesting about that report that I did, and I want to thank a lot of people as well, you know, including the more than 5,000 affidavits I read from people outlining these irregularities,
00:25:10.460 was that the book, the 2,000 mules film kind of operates as a bookends now, along with Rigged, the great Dave Bossie movie, to what I originally speculated based on my look at the existing data at the time.
00:25:29.760 The 2,000 mules confirms, basically, in terms of the order of magnitude of fraud, what I thought there was.
00:25:41.680 And the rigged movie by Dave Bossie and Friends basically underscored the mischief that Mark Zuckerberg alone did with his illegal drop boxes and ballot harvesting and bundling of illegal votes.
00:26:04.320 And for anyone in this country to turn a blind eye to all of that, as these so-called conservatives has done, is to perpetuate what is the real big lie, which is somehow this election was fair.
00:26:23.080 And remember, the central premise of the Jan 6 kangaroo court that we are now watching in real time, is that the election was fair.
00:26:37.140 That's their whole premise.
00:26:39.300 Yet, we have never, ever gotten to the bottom of anything.
00:26:44.720 I mean, you look at that 2,000 mules movie, it's like, you can quibble with some of the statistical analyses, but you can only do it by saying, well, you don't know, you don't know if they were exactly at, at the ballot boxes, the drop boxes.
00:27:03.320 They could have been 10 feet away, picking their nose at the post office.
00:27:07.580 It's like, no, no, no, no, no, no.
00:27:09.400 If you watch the 2,000 mules film, you understand that there were bad dudes out there, and bad dudettes, by the way, systematically going time after time after time to these ballot boxes, often in the dead of frigging night, doing who knows what.
00:27:32.840 And we have their pictures.
00:27:35.260 And the question is, why has there been no effort to track those people down and at least ask them some things?
00:27:42.540 The only thing the FBI likes to do these days is to knock on doors in the middle of the night of Trump people and try to have their way with them.

00:30:41.520 about this alleged conservative report from a bunch of rhinos alleging a fair election.

00:32:06.240 And remember that there was a massive influx of absentee ballots into the 2020 election.
00:32:14.660 I mean, they dwarfed previous numbers of absentee ballots.
00:32:19.300 And Biden carried the absentee ballots by anywhere from a two-thirds to a three-quarters margin.
00:32:28.900 That is, for every 100 absentee ballots that came in, Biden was getting 66 to 75 of those

00:33:11.600 And so as just the poster child for this, I just always go back to what happened in the state of Georgia
00:33:21.820 with this illegal consent decree that Kemp and Raffensperger did with Stacey Abrams, the Democrat,
00:33:31.280 behind the backs of the people of Georgia.
00:33:33.580 And one of the things about that deal was to eliminate what's called signature match.
00:33:41.740 That is the ability of election officials to compare the signature on a ballot with the
00:33:49.680 signature on file.
00:33:51.000 And when that was operative in 2016, 6% of the absentee ballots in Georgia were rejected
00:34:03.020 for that and sometimes other reasons, 6%.
00:34:06.440 When you go to the 2020 election and you eliminate signature match, that rejection of ballots went

00:34:19.280 Now, if you've got hundreds and hundreds and hundreds and hundreds and hundreds of thousands
