00:02:19.380 is picking a fight with Russia in Eurasia.

00:02:25.580 Then you had people who were, every single one of these religious men,
00:02:30.380 or excuse me, religious exemptions in many of these cases was denied.

00:04:53.600 There was one person who said that he would reinstate them in full with time served,
00:04:58.600 and that is Donald J. Trump.

00:06:58.540 There were 47 Republicans who voted for this.

00:07:03.520 But I think I actually went a little bit further.

00:07:06.100 But I think one of the things that was most surprising to me was the the the head of the
00:07:12.280 House Freedom Caucus, Scott Perry out of Pennsylvania, was one of the people that voted

00:07:18.580 Tell us what's going on and what this all means.
00:07:22.460 Yeah, I think on this one, it's helpful to kind of give a linear account, which is how
00:07:25.740 you and I lived it, which is earlier in this week, we found out that the Democrats were
00:07:30.880 going to do a flash vote.
00:07:32.300 They didn't put this on the schedule.
00:07:33.540 They didn't tell anyone this was coming.
00:07:35.700 You and I were texting to figure out how to respond most effectively.
00:07:39.880 And so what they did was they put a bill on the floor and it would attempt to try to move
00:07:44.480 away from where they believe they're vulnerable on the rumor issues and tie this back to, you
00:07:49.960 know, the definition of marriage and an affirmation of Obergefell.
00:07:53.420 But they went further and they also included essentially an ability for any state's definition
00:08:00.340 of marriage will be recognized federally, which has grave implications because you could
00:08:06.100 have a polygamy decision at the state court that now has to be recognized federally across
00:08:13.520 the country.
00:08:14.760 Very, very problematic.
00:08:16.220 This is something that the members voted on as well.
00:08:20.000 They tried to tie in things like interracial marriage, which is literally no one is talking
00:08:24.440 about messing with that at all.
00:08:27.880 It's an equal protection violation in and of itself.

00:08:37.400 And if I'm not mistaken, this whole thing is related to the opinion drafted by Clarence

00:08:51.680 And so they are so they are so reeling in the cultural wars, which everyone needs to understand
00:08:56.660 and the viewers know we are in a culture war.
00:08:58.540 They're reeling that they have to go back to the fact that somehow create a protection issue

00:09:05.520 And that has to be included in a bill that is largely about the definition of marriage.
00:09:10.960 And so you had members having to vote on this.
00:09:14.360 You and I put out statements immediately to run to the sound of the gun because we knew
00:09:18.200 that you cannot allow the debate to be set as Republicans overwhelmingly go back on the
00:09:25.760 definition of traditional marriage.
00:09:27.240 We have to stand for truth.
00:09:28.380 And culture may be against us, but culture was against us in the early 1970s.
00:09:32.780 And people got out of the wreckage of Roe v. Wade and started a movement and changed hearts
00:09:37.060 and minds over a period of time.
00:09:38.420 And that's what we need to do on this as well.
00:09:40.980 So fast forward to the vote.
00:09:42.620 You have a lot of people working it.
00:09:44.340 We were working it.
00:09:45.080 You were working it.
00:09:45.860 Members on the floor were as well.
00:09:47.940 And we got to a fairly good result.
00:09:50.180 I was encouraged by most of the Republicans, about 140 plus, stayed strong on the definition
00:09:56.560 of marriage as a union between man and woman.
00:10:00.740 Unfortunately, we lost the chairman of the House Freedom Caucus.
00:10:03.780 We didn't lose a single other member of the House Freedom Caucus, but we lost Scott Perry,
00:10:07.080 gravely disappointed.
00:10:08.820 He knows I'm disappointed in his vote.
00:10:11.680 But it is very troubling.
00:10:13.780 And that's really one of the main flaws of this week's largely success in being able to
00:10:21.000 keep Republicans on board.
00:10:22.660 But this bill is dangerous.
00:10:23.960 It's now going to the Senate.
00:10:25.480 The Senate, it could pass it.
00:10:26.960 And we've got a lot of work to do.
00:10:29.660 And people might be thinking, why are we talking about this right now?
00:10:33.780 It's because we are in a culture war.
00:10:36.180 And when you are in a culture war, you've got to be able to articulate truth in the midst of that
00:10:41.140 and do your best even when the culture and the society is against you.
00:10:47.280 Because with confrontation, you have the ability to educate the country about what is true and what
00:10:52.820 is not true.
00:10:53.560 And you can't go out there as a leader in Congress and say, this untruth is something
00:10:59.280 we're going to embed in our laws.
00:11:01.060 That's not what leadership looks like.
00:11:04.040 No, no, that's exactly right.
00:11:05.760 I mean, look, from my perspective here on this vote, I think, one, it upsets me because it was
00:11:12.960 a missed opportunity.
00:11:14.360 What's happened since Obergefell, right?

00:11:17.300 We're going after bakers.
00:11:18.780 We're going after florists.
00:11:19.820 We're shutting people's businesses down because they don't want to participate in gay weddings,

00:11:24.540 So that's huge.
00:11:26.140 But I think the even bigger thing is we now have transgender children who are getting sex
00:11:31.280 changes, hormone treatments.
00:11:33.300 They're putting boys and our girls' sports.
00:11:35.580 They're making billions of dollars a year off of all of this stuff, by the way.
00:11:39.660 And they're using the LGBT movement to literally eliminate Christianity from this country.
00:11:46.860 And so it's like, guys, all you have to say is in your, I mean, there's two things you
00:11:51.460 could actually say in voting down this is, I don't think that things have really progressed
00:11:56.680 in the best way since Obergefell, since we've mandated nationwide abortion or gay marriage.
00:12:02.400 But the other thing is, is what the Democrats say when we pass women's sports legislation.
00:12:07.300 This is a solution in search of a problem.
00:12:09.980 Why are we voting on this?

00:12:12.900 And just real quick, I just, sorry, you got me on a soapbox here.
00:12:18.040 The thing is, they're retreating though, right?

00:12:25.840 The noise is, is that this bill like really, I think changes that much, right?

00:12:35.140 The signal here though, what you need to pay attention to is Dems are losing on the other

00:33:12.500 And it surprised everyone because they only brought two witnesses.
00:33:15.180 And they had little more than one full day of testimony.
00:33:18.580 And those two witnesses, it was Kirsten Amling and then a special agent Hart.
00:33:22.840 And they said prosecution rests.
00:33:26.560 Now, with respect to today, we started at 11 o'clock.
00:33:30.160 The judge told us we're going to have a late start.
00:33:32.000 And he made reference at that time to, when we get started, the defense can bring their Rule 29 motion for judgment of acquittal.
00:33:44.140 So, under Federal Rule 29, when the prosecution rests, the defense has the opportunity at that time to ask the court to give, basically, a directed verdict that no reasonable jury could possibly find for a conviction.
00:33:59.340 And these motions are always made, and invariably they are granted.
00:34:04.780 But there are strategic reasons why attorneys bring it.
00:34:08.720 I'm saying this as a New York litigator who came down here to cover this trial and provide some insight, in that once you bring this motion, you lock in place all the information that the prosecution has put before the jury.
00:34:24.880 And anything that would come up down the road, which may somehow enhance the prosecution's possibilities of conviction, that would get excluded.
00:34:34.060 So, even though you know you're going to lose your motion, and everyone loses this motion, I can assure you that Steve is not going to win on this motion today.
00:34:41.800 But those are the motions that are brought.
00:34:45.180 The problem that came up this morning, though, is the judge realized that he said that in front of the jury.
00:34:51.260 And he is concerned, very concerned, that since he made reference to the defense bringing this motion, and then he's going to deny the motion, that the jury will misinterpret that as him weighing in with his opinion that they should convict him, that they should not acquit him, that they should convict him.
00:35:08.280 So, he's very concerned about that, and he was asking both sides what steps they want to take to cure it.
00:35:14.240 And he was thinking about saying, look, you might have heard me say yesterday that they're going to bring a motion to dismiss, but you need to understand my role in denying that motion or sitting on that motion is different than your role because I have to look at the facts and light most favorable to the prosecution, and that's not your role.
00:35:31.540 And what an interesting bit of strategy here is both the prosecution and the defense said, we don't want you to go through all that because if you go through that whole lengthy explanation, you're only calling more attention to it than if you say nothing and you just explain the difference in your roles without making reference to that Rule 29 motion.
00:35:50.460 It's a really interesting thing because the judge is arguing with them.
00:35:53.620 He doesn't think it's enough.
00:35:54.740 He's very concerned, and he's like, even though both sides are saying they don't want me to do it, I don't feel comfortable with just leaving it at your traditional instruction.
00:36:03.240 I really want to make sure I'm addressing this specific concern so they don't misinterpret what I said.
