00:00:30.920 classified documents that were not located in boxes but rather were located in the desks in the
00:00:36.400 45 office were also sealed, end quote. The DOJ also included a picture, this photograph,
00:00:43.360 of the documents seized during the FBI's search of the former president's Florida estate,
00:00:48.400 several of which clearly are marked top secret. In all, the filing says more than 100 unique
00:00:54.680 classified documents were seized and some of the documents were so sensitive, FBI agents and DOJ
00:01:01.080 attorneys needed additional security clearance just to review them. The DOJ filing reveals the FBI
00:01:08.220 recovered twice as many classified documents than were returned by the Trump team, casting doubt over
00:01:15.980 their claim that there had been a diligent search following the grand jury subpoena in May.

00:02:20.340 It is, but I think that, you know, when you're making a prosecutorial decision, typically in
00:02:24.320 these cases, there has to be some sort of aggravating factor. And I think that the aggravating factor
00:02:29.640 here, which the Department of Justice's memo last night speaks to, is the idea that there was
00:02:35.700 interference with an ongoing investigation. And that seems to be what they're solely focused on.
00:02:40.840 You know, there was some, I think that getting back the documents was an important component of
00:02:44.840 this investigation. But clearly from the filing last night, that's not solely what this is about.

00:02:55.600 an obstruction of justice investigation, because Donald Trump had all of that warning. He had
00:03:01.100 ample warning over months and months that these documents did not belong to him. Even after
00:03:05.840 receiving a grand jury subpoena, he continued to hold on to a boatload of classified documents.

00:07:09.520 the Presidential Records Act is the only stat that applies to the, a president and dot, dot, dot
00:07:16.880 presidential records. Okay. So they say this is all into the Presidential Records Act. Then they try to
00:07:22.500 do this mental jujitsu, as we've talked about, to take the Presidential Records Act and bolt on
00:07:26.480 enforcement mechanisms from others, because the Presidential Records Act, my dear friends, does not
00:07:31.400 have an enforcement mechanism. So they concede that the Presidential Records Act applies. Then they go
00:07:37.860 through a history, which by the way, if read correctly, shows President Trump's full compliance
00:07:42.100 and cooperation. Then they throw a couple of nuggets in there. Oh, we may have seen something on video
00:07:47.380 and we thought maybe something just isn't right. But under the Presidential Records Act, that's when you
00:07:52.680 continue dialogue, continue, continue, continue conversations and say, okay, what else may there be?
00:07:57.660 Let's, let's, let's take a look. And President Trump, remember, at the end of the June 3rd meeting

00:08:06.360 Instead, they wait two plus months and they go and raid and ransack his house, take a bunch of
00:08:11.720 documents. And by the way, Time Magazine covers, because that's some other top secret information.

00:08:22.720 spread them all over the floor, and then take pictures of them and put them out to the world.
00:08:25.800 So the bottom line is this, this filing was an embarrassment for the United States government.

00:08:34.840 agent in charge being walked out, perp walked out of the FBI embarrassments, like the unsealing of

00:08:45.320 which is the raid and break-in of President Trump's home. So this filing was just another long line
00:08:49.820 of embarrassment for this weaponized law enforcement. And it shows that they don't have a leg to stand on.

00:08:58.960 mind think that if the government had a real, a real reason, had backing for raiding the president's
00:09:05.620 home, that they would have, they would release this ridiculous picture? Absolutely. And a thousand
00:09:11.020 percent not. That picture was released because the government knows they are off balance, they're
00:09:16.840 off base, and they're wrong. And they were wrong to break into the president's home.

00:10:23.680 their tune on what the charges were. Remember that first it was classified information and
00:10:30.280 it was national security information. And now it's an obstruction of justice. They don't
00:10:36.620 know what they're doing at DOJ. They are grasping at straws. And, you know, this is the same crowd
00:10:42.720 that told us Russian collusion, the FISA warrant, Hunter Biden's laptop was Russian disinformation.
00:10:49.680 Look, I'm glad to see that the rank and file FBI agents that I know well, that I have looked in the
00:10:56.580 eye to say, did you classify this information? Did you redact this information? And they would look at
00:11:02.020 me and say, nope, I didn't do it even though my name's on it. My bosses did it. And so there is a
00:11:08.040 belief that we need a gut renovation at DOJ and FBI leadership. The leadership is not serving the actual
00:11:17.200 agents and the actual employees who really want to do good work, who don't want to be partisan.
00:11:22.920 I'll just say on this Tim Tebow case, the FBI agent who's now suddenly Chris Ray is finding
00:11:30.000 that his politics is too much. We've known that this individual was partisan and manipulating
00:11:38.260 government for years. Chris Ray knew this for years. The only difference now is that the pressure
00:11:44.940 on Chris Ray is so much that he's going to have to start throwing some of these individuals under the
00:11:51.980 bus. And that's exactly what Chris Ray is doing. He's trying to save his job like all people in
00:11:56.340 Washington when they finally have enough. Let's be very clear. Chris Ray knew that FBI agents were
00:12:03.360 being very partisan and weaponizing the FBI, and he didn't care until it impacted his job. And that's
00:12:10.940 what's happening right now. Now, in terms of the classified information, hope, what I have to say is
00:12:17.720 it's very clear that these documents are all paper documents, not digital. And I think that's a very
00:12:24.040 big deal. The staged photo shows paper, paper documents. And what I would say, Steve, is that
00:12:33.380 the DOJ has been so reckless. Whoever staged this photo and whoever approved it to be released
00:12:42.300 is so unprofessional and so reckless that they should actually be fired. Congress should get
00:12:49.860 involved in to say, we do not want FBI agents who stage photos and then release them to the public
00:12:57.060 like a spin document. This is dangerous. We need to understand that all of these documents were
00:13:06.680 declassified and held in a former president's office. By the way, former presidents have US government
00:13:15.020 funding in their offices. Therefore, their offices are government property. This stack of declassified
00:13:25.240 paper documents were guarded by the US Secret Service. All of the kvetching that we hear on NBC and MSNBC
00:13:35.340 and the legacy media. There are examples of people saying, you know, you and I would be arrested if
00:13:41.540 we handled classified information like this. Well, yeah, you weren't the president of the United
00:13:47.080 States. All of these people comparing them to the president of the United States is laughable.
00:13:52.860 You would get arrested if you did this because you don't have the authority to declassify the
00:13:57.920 information like the president of the United States did. So we're dealing with declassified information,
00:14:04.020 paper documents, not digital, like Hillary Clinton's problem. Hillary Clinton was never

00:18:30.960 it, that in the Russia hoax, there was no underlying crime and there was no obstruction. No underlying
00:18:38.800 crime, no obstruction. So the play they ran with the Russia hoax is the same exact play they're
00:18:44.240 trying to run now, and they are failing miserably at it. This, ladies and gentlemen, is just another
00:18:50.380 political sad attempt by weaponized law enforcement to get President Donald J. Trump, but he's not going
00:18:57.340 to back up one inch. He's going to continue fighting and standing for the American people.

00:31:26.120 No. This is the same legal analysis I've had since this raid happened. This response to
00:31:34.960 the motion by the government confirms to me that the Biden Justice Department has a fundamental
00:31:41.920 misunderstanding of the law and the facts here. The president has the absolute constitutional
00:31:47.320 authority to declassify anything he wants. President Trump absolutely declassified these
00:31:53.460 records, both the January 19, 2021 declassification memo for crossfire hurricane and Russian collusion.
00:32:01.440 He had made statements prior to that for a broader classification, and he declassified these records
00:32:06.920 through his actions. The Biden Justice Department also has a fundamental misunderstanding of the law
00:32:12.880 law and the law that is well related to presidential records. There is specifically a presidential records
00:32:17.840 act that applies to former presidents and no one else. So these general statutes about government property
00:32:25.520 are trumped by the presidential records act. The presidential records act specifically contemplates that
00:32:33.440 former presidents can take records, make them personal, and there's no timeline for the president,
00:32:40.320 former presidents to give back these records to the national archives. Even if they're not personal,
00:32:45.600 there's also not a criminal component to the presidential records act. So for the Biden Justice Department to push these
00:32:53.360 legal theories that the president didn't declassify these records, or doesn't have the power to declassify these records,
00:33:00.160 or that the presidential records act is not squarely on point here, or the president doesn't have the absolute power as the
00:33:08.160 as the executive to handle records however he wants. They're going to create a collision course with the Constitution.
00:33:14.960 And at the third point about the obstruction, it is not possible for President Trump to obstruct justice
00:33:21.520 into these nine crimes. And so the final point is, is why is the government opposing a special master here?
00:33:28.640 They're saying that they've already done the review, there's nothing to see here. What's the problem with having an independent
00:33:35.280 special master appointed by Judge Cannon, an Article III judge, review their homework? If there's nothing to hide,
00:33:41.920 why are they trying to hide it? Why are they so opposed to a special master? Why are they having amicus briefs
00:33:47.840 filed from all these uniparty people in DC to oppose this? Why are they so scared of this special master?
00:33:54.960 And I think it's because they know that they went into this raid because President Trump took a
00:34:01.120 declassified personal copy of the Crossfire Hurricane Russian collusion documents, and those are highly
00:34:08.320 damaging politically to Obama, Biden, Hillary, Susan Rice, Clapper, the FBI, the intel community.
00:34:16.160 I just want to make sure we get to the signal in this entire thing. You said,
00:34:20.880 all this is going to fade away because they don't really have a case here. You know, the nuclear codes,
00:34:26.560 you know, the the Q documents, all of it. And eventually they'll get down to the to the last
00:34:33.120 refuge of a scoundrel, a prostitution of justice. Is that what they're going to try to sell now?
00:34:39.040 Because they basically understand your arguments are ironclad. Is what they're going to try to sell now
00:34:44.320 is an obstruction of justice case? This is what they do every time. It's always about the process

00:35:02.400 constitutional power to declassify his commander in chief. There's a 1988 Supreme Court decision,
00:35:07.200 Department of the Navy versus Eagan directly on point. They know the Presidential Records Act is
00:35:11.520 applicable here. They know the Presidential Records Act allows the president to take personal copies of
00:35:16.880 the records as confirmed by a 2012 decision by the Obama judge and Tom Pitten and Judicial Watch's
00:35:24.160 lawsuit against Bill Clinton for his eight years of audio tapes and his sock drawer. They also know
00:35:30.320 with the OLC memo out of the Justice Department, what I'm saying is true, that you can, that President
00:35:36.240 Trump could not have obstructed justice with the investigations of these non-crimes. At best here,
00:35:42.720 what we have is a confusion on where the records were at Mar-a-Lago. Apparently, one of President
00:35:50.000 Trump's lawyers signed an affidavit saying that they've done it, they're doing a diligent search,
00:35:53.840 and they've got the records. There is no evidence that anyone intended to lie or obstruct here. And again,
00:36:00.560 these are non-crimes. Mike, what is your, thank you for carving time out, what is your social media

00:36:57.200 stage tomorrow night and literally trash in front of the whole nation. Their whole philosophy is to

00:37:14.000 crime, and wokeness. What do you think is going to happen there? Well, Steve, look,
00:37:20.220 it's a massive attempt at diversion, clearly, because he does not want to talk about the reality
00:37:25.400 of life in America right now, which particularly regarding the economy is frankly miserable.
00:37:30.980 And that's not my opinion. That's the opinion of millions upon millions of American citizens.
00:37:35.860 Consumer sentiment has never been lower in the post-World War II era. I mean, think about that.
00:37:41.240 Think about all the crises that our country has endured since World War II. Consumer sentiment
00:37:46.040 has never been lower than it is today. Why? Because of the two I's, immigration and inflation.
00:37:53.100 We have effectively an open southern border, and millions of unvetted and uninvited trespassers are
00:37:59.540 pouring into this country in an absolutely uncontrolled manner. At the same time, we have an absolute
00:38:05.360 inflation explosion. We have inflation right now at 40-year highs in the United States. We have small
00:38:11.740 businesses who are floundering, who are struggling simply to stay afloat. According to the latest
00:38:17.180 survey from Alignable, 40% of small businesses in the United States could not meet the rent
00:38:22.920 obligations for this month of August. 40% overall. Even worse than that for restaurants, 46% of
00:38:29.600 restaurants. Even worse than that for minority-owned businesses, the majority, 53%, could not afford
00:38:35.000 their rent. Now, within the United States, though, thankfully, there are zones of opportunity. There are
00:38:39.860 places, all of them red states, where growth is real, and where, thankfully, opportunity abounds.
00:38:45.580 And because of that, there's this great migration going on within the United States. So while Joe
00:38:49.840 Biden engages in diversion and tries to call us fascists, guess what? Americans are voting with
00:38:55.200 their feet, and they are going to those very states, to those very jurisdictions that Joe Biden claims
00:39:00.100 are fascist. They're going to places like the Florida of Ron DeSantis. And let me give you some of
00:39:06.060 these statistics here. And I lay all these out in my new Newsweek article, where I talk about the
00:39:10.260 iconic Chicago chain Portillo's, which specializes in Chicago food, Chicago hot dogs, Italian beefs,
00:39:16.720 still headquartered in Illinois, but not expanding there, expanding in Arizona, Texas, and Florida.
00:39:22.440 Why? Because opportunity abounds there. And this isn't just a Portillo story. It's much,
00:39:26.920 much bigger than that. Let me give you some of these statistics, which I cite in that Newsweek
00:39:30.720 article, just before the pandemic. So if we go back to February of 2021, excuse me, of 2020,
00:39:39.140 just before the pandemic. Since then, according to the Wall Street Journal, red states have added a net
00:39:44.800 of 341,000 total jobs. So with all the difficulties of the crisis of the CCP virus, red states have still
00:39:52.780 managed to add net since before, putting it as a starting point just before the pandemic, 341,000 jobs.
00:39:58.860 In contrast, blue states, places like Illinois, places like California, have lost 1.3 million jobs,
00:40:06.600 according to the Wall Street Journal.
00:40:08.160 Give that stat again to the audience. That's powerful.
00:40:12.680 So if we use as a starting point just before the pandemic, just before the lockdown,
00:40:16.780 since that time, red states, or the Wall Street Journal, have added 341,000 net jobs since then.
00:40:23.420 And blue states have lost 1.3 million jobs since then. And this is reflected in all kinds of
00:40:30.360 statistics, both macro ones, as well as more sort of micro, almost anecdotal ones. Let me give you
00:40:34.360 one anecdotal one, which I think is very telling. And I mentioned it before. That is U-Haul rates.
00:40:38.140 It's actually a great way to look at where people are going. Where is the demand? Right now today,
00:40:42.620 if you rent a small truck, a one-bedroom moving truck, and you're making the move from Chicago to
00:40:47.520 Central Florida, Chicago one way to Orlando, and I cite this again in the article, that costs you
00:40:52.420 just over $2,400 to go one way because there's so much demand. To go in the other direction,
00:40:58.220 to go from Central Florida back to Illinois, less than a third of that. That costs you $712.
00:41:04.000 $2,400 versus $700 for the same route in different directions. That right there shows you where is
00:41:11.240 the demand? Where are people moving? And they're moving there, again, for solid reasons.
00:41:16.200 They're moving there for opportunity. And it's not even just, for that matter, Florida. As I point
00:41:21.720 out in my chalk talk, just the neighboring states of a state like Illinois, the five states that touch
00:41:26.320 Illinois, they have, since J.B. Pritzker became governor of that state, they have a growth rate
00:41:31.800 that is seven times greater than Illinois. Illinois has barely grown since J.B. Pritzker became governor,
00:41:38.840 0.5% GDP growth overall. The surrounding states, the average, 3.86% growth rate.
00:41:45.920 Next door, Indiana has 12 times the growth rate of Illinois since J.B. Pritzker became governor. So
00:41:52.920 again, people are very rationally voting with their feet. They are leaving New York and Illinois and
00:41:57.860 California, and they are going to the very places where Joe Biden would have us believe that the
00:42:02.360 fascists are in charge. Well, we all know that he is the real fascist and that the left, the people
00:42:07.840 who want to control our lives, who want to take our guns, who threaten us with F-15s. Okay,
00:42:12.560 we're the fascists? I don't think so. The real fascists are people like Joe Biden. And by the way,
00:42:18.140 I think that's an important point for us to focus on as well. The president of the United States
00:42:22.800 stood up yesterday and said, hey, all of you people who believe in your Second Amendment, who
00:42:26.740 believe in arming yourselves so that you can protect yourselves and your family against any
00:42:30.640 tyranny, whether it's a home invader or whether it's a tyrannical government, your guns are useless
00:42:36.200 because we have the weapons of war. We have F-15s, so you might as well turn your guns over. Well,
00:42:41.040 hell no, Joe Biden. That is the definition of fascism. That is despotism. That is one of the
00:42:46.840 most divisive things any president has ever said in the history of the United States. Now, he's
00:42:52.100 floundering. It's a massive diversion. He's trying to find, he's grasping, trying to find something to
00:42:57.760 fixate on, something to talk about, something for the American people to focus on other than this
00:43:01.540 economy. And in part, Steve, it's because his own polling is falling apart. If I can go to chart
00:43:06.440 number two, folks, if we can pull this up. Steve, hang on. I want to hold that chart to that. Let's
