00:00:22.180 brought by special counsel Jack Smith against Donald Trump. Now, Fisher is seeking to dismiss
00:00:27.440 that count, the central question before the Supreme Court, according to the New York Times,
00:00:31.880 quote, can the government charge defendants in those cases under a federal law that makes it a
00:00:37.140 crime to corrupt corruptly obstruct an official congressional proceeding? And here's how the
00:00:41.820 Times lays out the stakes of this move by the Supreme Court today, quote, the decision to hear
00:00:46.360 the case will complicate and perhaps delay the start of Mr. Trump's trial now scheduled to take
00:00:51.440 place in Washington in March. The Supreme Court's ultimate ruling, which may not arrive until June,
00:00:57.440 will likely address the viability of two of the main counts against Mr. Trump and could severely
00:01:02.760 limit efforts by the special counsel Jack Smith to hold the former president accountable for the
00:01:07.640 violence that his supporters committed at the Capitol. Whatever the justices decide could also
00:01:12.940 have a major impact on what has become the largest investigation in DOJ history. Prosecutors have
00:01:18.640 also charged more than 300 defendants with obstruction of an official proceeding. Some of them have already
00:01:24.420 been convicted. The Supreme Court's decision today, just one of many factors that could end the case.
00:01:29.880 I'll add something here because, you know, one of the things about this statute, and I hadn't focused
00:01:34.380 on Fisher's cert petition until today, one of the things people have been focused on about this
00:01:39.400 statute is the meaning of the word corruptly. But that's not what Fisher's appeal is about, as Tim just
00:01:44.020 explained. His appeal is about whether or not it's lawful to charge him with otherwise obstructing or
00:01:50.620 impeding the congressional proceeding on January 6th because it's not tethered to documents.
00:01:55.260 And here's where it's sort of, pardon the expression, kind of stinks to be a textualist,
00:01:59.420 right? We've seen from the conservative movement that what should matter when we're looking at the
00:02:04.140 meaning of the statute is the plain meaning of the statute. But here, the plain meaning is pretty
00:02:09.080 clear. Aside from this mutilating or concealing a record, they are prohibiting otherwise obstructing a
00:02:16.500 proceeding. What did these people do? They blocked doors. They prevented members of Congress in both
00:02:22.060 chambers from safely voting on January 6th. I can't think of any clearer meaning of obstructing a
00:02:28.460 proceeding than the one that applies to these cases. Whether that applies to Donald Trump might
00:02:34.260 be a little bit different, but at least it should apply to the conspiracy count to obstruct a proceeding
00:02:38.920 on the face of the indictment.

00:03:49.000 vote, at least scheduled for 530. We're also going to go to Coralville, Iowa. President Trump is having
00:03:55.480 a caucus event. Our own Ben Burkham's there. We'll go there in a minute. But I've got to start in this
00:04:01.080 blockbuster news. Julie Kelly is going to join us a minute. I got Mike Davis for a few minutes now.
00:04:06.100 Mike, I'm not a lawyer. Help me out here. The thing the other day with Jack Smith going right to the
00:04:12.080 Supreme Court and then today, this in appeals, it just strikes me that the prosecution of Trump is
00:04:21.840 trying to go so fast. There's so many things about all of this that are quite uncertain and people
00:04:28.660 trying to feel their way through it. Walk me through that. Is this another example? Because
00:04:33.600 you see there, they're petrified. They're already getting vicious on MSNBC about, oh my gosh, this
00:04:38.700 might slow it down to pass the election. Can you make this make sense for us?
00:04:43.740 Yeah. President Biden's railroading of President Trump is starting to derail.
00:04:48.720 And it's for the reasons we have been discussing for 16 months. It is not a crime to object to a
00:04:55.260 presidential election. It's allowed by the Electoral Count Act of 1887. Democrats would be in jail for
00:05:01.300 objecting to Republican wins in 1968, 2000, 2004, and 2016 if it were a crime. Al Gore, Hillary Clinton,
00:05:09.540 and John Kerry would be in jail if it were a crime. It's not a crime to twist arms politically. And
00:05:14.540 there are several issues that need to be resolved. First of all, they're trying to jam through this
00:05:19.500 trial to have this trial start on March 4th and have President Trump sit in a courtroom for six
00:05:25.620 or seven months before the presidential election instead of being on the campaign trail and then
00:05:29.940 put President Trump in prison for the rest of his life after the election. And Judge Tanya Shutkin,
00:05:34.820 this Obama judge, was going along with this deranged Biden special counsel Jack Smith to railroad
00:05:41.700 President Trump. And President Trump filed a motion to dismiss these indictments on two different
00:05:46.640 grounds. Number one is presidential immunity. What the president did in his official capacity or
00:05:52.500 the outer perimeter under Supreme Court case law of his official capacity is covered by presidential
00:05:59.540 immunity. You cannot charge people civilly or criminally, government officials civilly or criminally
00:06:06.460 when they have government immunity. That's been established with Congress, with the speech or debate
00:06:11.840 clause. That's been established with judicial immunity. And the civil part of that has been
00:06:16.040 established for the president of the United States. But the criminal part has not yet been established
00:06:21.760 because these are the first indictments ever of a president of the United States brought by Jack
00:06:27.940 Smith and Alvin Bragg and Fannie Willis down in Georgia. This is unprecedented. And the fact that
00:06:35.040 Jack Smith is trying to railroad this through, when they have like 13 million pages of documents,
00:06:40.560 they have several hundred witnesses, there's no chance this can go to trial on March 4th anyway,
00:06:46.280 because of the discovery in this case. But separate from that, this case can't go forward
00:06:50.800 until the Supreme Court ultimately decides presidential immunity. Now, what Jack Smith is trying to do is
00:06:56.520 skip the D.C. Circuit Court of Appeals and see he's seeking cert before judgment by the D.C. Circuit,
00:07:02.780 which is an extremely rare thing to seek. And I hope the Supreme Court does not go along with this,
00:07:08.220 because this is a novel issue, whether the president of the United States enjoys immunity
00:07:13.880 from criminal prosecution like judges do and like Congress does. That should be resolved first by the
00:07:18.720 D.C. Circuit, the three-judge panel, through the regular process. And then the Supreme Court can take
00:07:24.480 that if they want to take it. They have the discretion to take it or not to take it. But if you rush and get
00:07:29.940 this wrong, this has major implications for all presidents of the United States. For example,
00:07:35.140 does that mean that President Obama can be charged criminally by the Trump 47 Justice Department
00:07:41.600 for his extrajudicial murder of a 16-year-old American citizen? Remember, he ordered a drone
00:07:48.640 strike and killed a 16-year-old American citizen abroad. Can he be charged for murder now? Does he
00:07:53.780 not enjoy presidential immunity? Is that the game the Democrats now want to play?
00:07:57.700 What about this issue today on J6? I know you only got a couple of minutes, but this was another
00:08:06.220 thing coming in. And they're saying, hey, this could slow it down to at least this appeal wouldn't be
00:08:11.220 known till June. And they're losing their minds right now. What happened with the Jack Smith
00:08:17.240 situation on Monday or Tuesday? Now this, because they see the March 4th date slipping away from them.
00:08:23.120 What happened today? Well, I mean, first of all, it's going to slip away because Judge Tanya Shuck
00:08:28.140 issued a stay of the criminal proceeding. She finally relented because she saw the writing on
00:08:33.440 the wall that you cannot move forward with a criminal case or a civil case until the issue of
00:08:39.900 government immunity is resolved, whether sovereign immunity, whether it's presidential immunity or
00:08:44.460 speech or debate clause for Congress or judicial immunity, that halts the proceedings. And we've been
00:08:49.760 talking about this for a long time and people laughed at me for saying this, but of course I'm
00:08:53.700 right. And as Judge Tanya Shuckin just ordered, they have to resolve these issues. This is so much
00:09:00.020 bigger than Donald Trump. This is about the presidency, whether you can charge a president
00:09:05.580 for doing his official duties. He ordered, President Trump ordered his vice president not to certify
00:09:11.580 the election. You can't do that as a private citizen. You can only do that as the president of the
00:09:16.700 United States, right? So that's the issue of presidential immunity. And also on these January
00:09:20.920 6th cases, and Julie Kelly's going to go into this because she's been on this since day one,
00:09:25.700 they are using a bogus interpretation of a federal criminal statute related to financial crimes to go
00:09:32.200 after Trump and to go after Trump's supporters on January 6th, to go after his top aides like you
00:09:37.400 and Peter Navarro. It is a bogus theory, right? And so the Supreme Court will fix this. And what's the
00:09:43.060 rush with Jack Smith? They waited 30 months to bring these criminal charges, right? Why do they
00:09:48.080 need to get these resolved before the presidential election? Other than the fact that this is lawfare,
00:09:54.460 political lawfare by Democrats, and this is election interference. And that's exactly what we've been
00:09:59.240 saying from day one. There's no rush to get President Trump before the election other than
00:10:04.940 election interference. They want to convict President Trump before the election because they see
00:10:09.720 the polling that President Trump is beating Biden like a drum on November 5th, 2024. And the one
00:10:15.820 thing the polling shows that changes that is a criminal conviction of Trump.

00:17:36.360 It will take years to get this to trial. You saw Jack Smith try this, throw the long ball. And I knew
00:17:42.220 it was a Hail Mary because you could see kind of the long faces on MSNBC. But today blockbusters,
00:17:48.740 two blockbusters, right? Julie Kelly's having a good day. Two blockbusters. I think,
00:17:53.080 I think you tweeted that karma's a bitch or something. It was, it wasn't the normal ladylike
00:17:58.780 Julie Kelly. Tell us why today was such a big, what's going on? Two blockbuster decisions. Tell us
00:18:10.260 what they are. Right. So, I mean, basically, essentially for two reasons, the March 4th trial
00:18:16.240 date is gone. Number one is the Supreme Court agreeing this morning to take up this 1512C2
00:18:22.880 count. This is the felony charge that DOJ has weaponized, bastardized, flagrantly misinterpreted
00:18:30.020 the language and applied this to more than 320 January 6th defendants. It also represents half
00:18:37.540 of Jack Smith's four count indictment against Donald Trump. He charged him not only with the 1512C2
00:18:43.560 obstruction of an official, official proceeding, but also conspiracy to commit obstruction of an
00:18:52.080 official proceeding. So that really threw a big monkey wrench into Jack Smith's plans. Today,
00:18:57.360 we were sort of waiting for that to happen on Monday. The Supreme Court announced it today.
00:19:02.140 Look, there is no argument that the DOJ has misinterpreted that statute intentionally,
00:19:08.500 and they finally are going to get caught for doing so. Not only DOJ, Steve, 15 district court judges in
00:19:16.020 Washington who knew that this statute was being misapplied, was being used against how it was
00:19:22.620 originally intended to be, which this is the post-Enron Arthur Anderson scandal that dealt with
00:19:28.580 tampering or destruction of evidence. Fifteen judges have allowed this. Only one, Carl Nichols,
00:19:34.580 a Trump appointee, dismissed this count against three defendants. The delicious irony here,
00:19:40.820 Steve, is that the DOJ is the one who appealed Judge Nichols' dismissal of these counts. That's
00:19:48.620 what finally got it to SCOTUS. So let's just enjoy that as well. The DOJ, in their arrogance,
00:19:56.800 instead of letting three defendants off the hook on this count, appealed Judge Nichols,
00:20:01.880 and that's how it got to the Supreme Court. So not only is that a real problem for Jack Smith,
00:20:07.760 but then compounded by Judge Chutkin today finally admitting that the automatic appeal based on
00:20:15.580 immunity claims, and this is Donald Trump appealing Judge Chutkin's ruling that presidential immunity
00:20:23.040 does not apply to criminal prosecution, that Donald Trump is indeed subject to criminal prosecution,
00:20:29.640 automatically all the pretrial deadlines are stayed, as that makes its way through the appellate
00:20:35.940 process, which is why Jack Smith took the extraordinary step, as he called it this week,
00:20:42.120 seeking to bypass the appellate court and have the Supreme Court rule on this presidential immunity
00:20:47.900 issue right away. Either way, this is a disastrous day for special counsel Jack Smith and Judge Chutkin,
00:20:54.640 which means it is a great day for everyone else, even if it lasts a day. It is a great day for the
00:21:00.720 country, certainly for Donald Trump, but more importantly, the 300-plus January 6th defendants
00:21:07.340 who have had their lives destroyed by being unfairly charged and convicted of this felony count,
00:21:15.000 including Matthew Perna, who committed suicide after pleading guilty to the obstruction charge
00:21:21.180 and then found out that the DOJ was going to seek years in prison. The human wreckage in the wake
00:21:26.940 of what this DOJ has done with this obstruction count. It will take years to calculate, but this
00:21:32.080 will be, when the Supreme Court overturns how DOJ has used it, the most humiliating defeat and abuse
00:21:40.040 of power that this DOJ has ever experienced in its history.
00:21:47.220 They had to, just as a technical matter, they had to appeal Nichols because that's hanging out there
00:21:54.120 with one of the trial judges said, so weren't they, I know it's ironic, but they were kind of forced to
00:22:00.500 do that, right? They had to go appeal that to prove that everything else they had done with this charge
00:22:06.160 was correct. Am I wrong there? They probably could have. That's a good point, that if they would have
00:22:11.600 left it, then other courts would have pointed to Judge Nichols and not the appeal. You're correct.
00:22:17.260 They went back to Judge Nichols twice asking him to uphold this count. So let's not overlook him as a
00:22:24.020 hero here because all of his colleagues refused to dismiss this count. So you're right. He probably,
00:22:30.100 DOJ probably had no choice but to pursue this. But the fact that it is there on an appeal from DOJ
00:22:36.780 and not another defendant. Now, of course, there are other defendants who have been waiting to appeal
00:22:41.420 this count and conviction. But look, this is colliding with Jack Smith's trial calendar,
00:22:47.880 which is another reason why, what's his next move now?
00:22:52.740 But that's what I want to pull the camera back for people that are not lawyers who don't follow
00:22:56.400 this as closely. This issue of lawfare, and you've said this from the beginning and David said at this
00:23:01.100 beginning, the rush, the fanatical rush to get Trump. And every night on MSNBC, because we have to,
00:23:09.680 we cover these, you know, we follow these networks, CNN, BBC, MSNBC, just the glee in their eye,
00:23:16.800 Weissman and these guys every night foamed up about getting Trump. Monday's decision by Jack
00:23:23.160 Smith is very much tied to, because it's all about, they got to get that March 4th deadline,
00:23:29.240 the date. And every, even defense lawyer I know there are Democrats have told me, this is ridiculous.
00:23:35.140 You keep saying the 13 million pages of discovery. It's just, you can't, this thing would normally
00:23:41.680 be a year or two, a year or two off if he was a normal criminal defendant. Is this the week we
00:23:48.100 saw this happening that the reality set in that they're not going to be able to have a rush to
00:23:53.760 put Trump in prison before the election? It had to break at some point, Steve, because the trial
00:24:00.700 calendar was so unrealistic. And keep in mind, Judge Chutkin is the one who set the seven month
00:24:08.120 window between indictment and trial. That is about half the time of a normal January 6th case. You
00:24:16.720 have defendants who languished for two years waiting for their trials, waiting for their case to go to
00:24:22.340 trial. She is the one who pushed this. Then on top of that, Steve, she waited two months before she
00:24:28.280 issued her order related to the motion to dismiss on presidential immunity. They filed, Trump's team
00:24:34.500 filed that on October 5th. She didn't rule until December 1st. So she is the one responsible,
