00:31:23.680 But then when you get into the little definitional aspects of the 14th Amendment and you look at other sections of the 14th Amendment, there are various arguments to be made.
00:31:31.880 And I think the most important one is this argument about due process, right, which is where has he been charged with an insurrection?
00:31:39.480 Who has decided?
00:31:40.740 In Colorado, they would say, well, it was a judge that resolved this question, et cetera.
00:31:45.520 But there are real legal arguments that Donald Trump has.
00:31:49.640 And because there's a menu of outs for the court, they're going to find one, I would think, that will say Donald Trump can remain on the ballot.
00:31:58.420 A far different case also coming, whether the president, former president, has immunity from criminal prosecution.

00:32:04.460 And that's a much more of a long shot argument.
00:32:06.560 The idea that the president of the United States has total immunity in his role as president, I can't see how the court would determine that.
00:32:15.420 And this is a nice way, by the way, if they want to take up both together to make it clear they're being fair, which is, no, the president doesn't have total immunity.

00:33:28.000 just decreeing that under Section 3 of the 14th Amendment that Trump cannot be on the Republican primary ballot in those states.
00:33:36.900 Now, they have stayed their orders once Trump files the appeal.
00:33:41.080 So Trump's going to go on the ballot on those states unless the Supreme Court rules quickly, which they're not going to do.
00:33:48.300 So the Supreme Court could try to dodge this and say that Trump's on the ballot.

00:33:57.720 But the problem is that these Democrat operatives are going to use these precedents, these egregiously wrong precedents in Colorado and Maine to try to knock President Trump off the ballot in swing states.
00:34:10.240 They fear that the only way they're going to stop President Trump, because the American people are supporting President Trump, according to every poll, he is going to beat Biden like a drum on November 5th, 2024.
00:34:23.160 Apparently, those two impeachments for nonsense, these four indictments for non-crimes, the two illegal gag orders, the trying to bankrupt Trump for non-fraud, that all backfired, as we've been predicting, Steve, since the Mar-a-Lago raid in August of 2022.

00:35:46.600 The president right now only has civil immunity because we've never had criminal charges against a president of the United States until the Democrats, including Joe Biden's White House brought – Joe Biden's White House and Justice Department brought four bogus indictments against Trump, right?
00:36:03.620 So now we have these cases where we have to decide whether the president has immunity for what he does within his official capacity as the president of the United States and under a Supreme Court president in the civil immunity context, the outer perimeter of his official capacity.
00:36:20.420 If judges have immunity both civil – civilly and criminally and members of Congress have immunity both civilly and criminally, why the hell wouldn't the president of the United States?
00:36:29.720 And why wouldn't the president of the United States have criminal immunity from prosecution for his official acts if he has civil immunity?
00:36:38.140 The whole point is that these government officials shouldn't have to fear that their successor is going to throw them in prison for doing their jobs.
