00:00:34.020 And on a very personal level, I mean, these are torturous discussions with their family members about whether or not they have to leave the country to avoid being unconstitutionally and illegally detained.
00:00:46.320 I mean, people are actually worried about being thrown in jail or grabbed in some sort of extrajudicial detention.
00:00:53.260 And I think, you know, as crazy as this sounds in the United States of America, I think people should really consider that these are possibilities.

00:32:07.340 Pfizer also claimed that its COVID-19 vaccine protected against COVID-19 variants,
00:32:13.020 even though data available at the time showed Pfizer's vaccine was effective less than half the time against variants.

00:32:21.900 Pfizer urged Americans to get vaccinated in order to protect their loved ones,
00:32:27.100 clearly indicating a claim that Pfizer's COVID-19 vaccination stopped transmission of COVID-19.
00:32:32.600 Pfizer later admitted that it had never even studied transmission of it after its recipients received the vaccine and whether they could say it stopped transmission.

00:33:45.560 Attorney General Kobach, can you walk us through exactly what you're doing with Pfizer, sir?
00:33:51.640 Yeah, thanks, Steve.
00:33:52.740 The lawsuit is a suit brought under the Kansas Consumer Protection Act, and all 50 states have some variation of a state Consumer Protection Act, and it is a suit brought seeking civil monetary penalties, as well as damages, as well as injunctive relief against Pfizer for making deceptive and misleading statements in marketing its vaccine.
00:34:16.020 So when the federal government gave the vaccine manufacturers immunity during the pandemic, that gave them immunity from tort lawsuits, lawsuits that are based on injuries to a person who's then suing the company to recover money for those injuries.
00:34:30.480 But that federal immunity does not extend to making misleading statements in the marketplace to encourage consumers to use the product, in this case, the Pfizer vaccine.
00:34:42.500 And so that's what the basis of the suit is.
00:34:45.880 There's a lot of information in that 69-page complaint that I'm sure people can find online.
00:34:51.040 They can certainly go to the Kansas Attorney General's website to look at it.
00:34:56.780 It's been a while, right?
00:34:59.980 The pandemic is over, but it took a long time to get all the information necessary for this lawsuit.
00:35:06.920 Attorney General Kobach, and by the way, our team, Grace and Moe and the rest are going to push that out now, and we're going to get some summaries of it written by people and some explanations of it.
00:35:19.080 But in this marketing campaign, if you look on MSNBC, and you have all these things for the government.
00:35:24.460 They were giving money to social media companies and all this.
00:35:26.760 It gets very gnarly.
00:35:28.460 But you can't extract in this regard to Pfizer.
00:35:32.040 They were inextricably linked, and that's why we played the Rachel Maddow at the beginning.
00:35:35.280 They're inextricably linked, particularly with like the New York Times, MSNBC, CNN, every night, safe and effective, safe and effective, safe and effective.
00:35:43.740 And they allowed it to go on for month after month after month after month, and they demonized anybody that just came forward and said, well, hang on for a second.
00:35:52.500 Let's look at the science and look at the facts.
00:35:54.360 How do you handle that in this lawsuit?
00:35:57.640 How they actually effectuated the spreading of this, what turned out to be either, you could say, propaganda or lies, sir?
00:36:05.880 Well, that information goes to whether Pfizer knew what it was doing and whether it was intending to mislead the public.
00:36:14.260 So for this lawsuit, we need to show, sorry, not whether it knew what it was doing, but knew what the effects of the vaccine were based on scientific information available to Pfizer.
00:36:23.360 So, you know, to boil it down to its bare essence, this lawsuit is what did Pfizer know and what was Pfizer telling the public?
00:36:32.140 And if we can show that those two things did not match and that Pfizer was attempting to mislead in order to maximize sales, then we will have met our burden in this lawsuit.
00:36:44.680 So Pfizer's efforts to suppress information on social media go to whether Pfizer was attempting to mislead, and we allege that they certainly were.
00:36:54.780 Theoretically, if Pfizer, and let's say you show this as a fact with your evidence and things that you're going to pursue in the legal process on this, and you do, and you are able to prove that they knew it.
00:37:11.360 I mean, we've seen the records now, you know, our audience, 3,500 worked with Naomi Wolf and others to go through those, the Pfizer records that were released by that judge.
00:37:20.140 They were supposed to be sealed for 75 years and we got released.
00:37:23.560 If you prove that, is there any way to pierce the immunity they have if they knowingly and to get around the immunity on torts eventually?
00:37:32.600 Is there any way, and is there any way eventually to bring criminal charges against people that should be held accountable for what happened here?
00:37:40.820 You know, that's a great question.
00:37:43.020 I mean, there may be some legal doctrines that would allow us at a future stage to pierce that immunity, and there's no question that that immunity is going to be litigated in other cases because there are obviously many people who lost loved ones or who were previously injured.
00:38:00.420 But that's, you know, that immunity, we really don't have to pierce for this case.
00:38:05.760 Now, it may be that Pfizer will try to come to court and say, hey, our immunity extends to all the statements we made about our vaccine in the marketplace.
00:38:14.400 We will beat them on that claim if they try to make it.
00:38:16.820 But, you know, I think one of the things we see here is that, you know, the information that we use underlying our complaint, much of it came from the result of a FOIA lawsuit and litigation that you just described.
00:38:30.180 Our case will probably result in the discovery of additional information.
00:38:35.000 That's one of the first things that happens in a case like this is that the parties are allowed to seek documents from the opposing party.
00:38:41.960 So I anticipate that more information will continue to to come forward and be made public or at least be made available to the courts.
00:38:50.580 So, you know, I anticipate that things will continue to progress now.
00:38:56.360 Attorney General Kobach, you represent the heartland of this country, Kansas, and the great folks there.

00:39:08.360 But when somebody when attorney general like you representing the people of Kansas go after someone like Pfizer or try to, you know, not go after, but say, hey, you guys should be held accountable for this.
00:39:21.980 What kind of resources does Pfizer throw at the attorney general of Kansas and the people of Kansas?
00:39:27.480 Well, Pfizer is a very wealthy, very powerful corporation, and they have immense resources and they can hire, you know, battalions of lawyers to try to fight this.
00:39:40.700 But at the end of the day, it doesn't matter how good your attorney is and how much money you spend on multiple attorneys.

00:39:49.440 And I think the facts are not good for Pfizer in this litigation.
00:39:52.960 You know, the other and certainly the attorneys they can pay for a far outnumber the attorneys in my office.
