00:04:18.640 So again, you have these, well, talk about partisan lawyers.

00:04:23.340 He has no idea what's happening in this case.

00:04:25.720 He has no idea how she conducts her business today by all reporting.

00:05:06.000 Smith was not a superior officer, that the DOJ routinely hires and retains other attorneys

00:05:14.900 attorneys to conduct investigations and handle prosecutions.

00:05:20.140 So this was, it's hard to tell, Steve, because I wasn't there and you're only relying on the

00:05:25.500 reporters who were there and what they choose to post.

00:05:36.600 But back to this continued criticism, demeaning Judge Cannon of people who are completely ignorant

00:05:56.720 indictment against a former president, that she does not have a responsibility for transparency

00:06:02.780 and a full vetting of all of the accusations that Jack Smith has made.

00:06:08.540 So Jack Smith is just allowed to make all of the accusations and his indictment all stand up there

00:06:15.040 and, you know, in June a year ago and explain this indictment and how Donald Trump threatened

00:06:21.040 our national security by hoarding national defense information at Mar-a-Lago.

00:06:26.000 And so he is supposed to be able to control the narrative, but the defense is supposed to, what,

00:06:32.500 have both hands tied behind their back.

00:06:34.760 That's what the Ty Cobb and Andrew Weissman, Rachel Maddow, all of these Democrats and state-run media,

00:06:41.920 state media, wants the American people to believe that somehow she is the villain to the rule of law 0.96

00:06:49.680 and fair judicial process instead of one of its most stalwart defenders, which she definitely is. 0.93

00:06:59.000 But, of course, today's hearing is only the beginning next week, and we can talk about this more hearing,

00:07:03.300 and then I'm assuming next month, the big bombshell series of hearings about that scope of prosecution motion

00:07:11.640 for more evidence that demonstrates collusion with the Biden White House, including his general counsel.

00:07:22.500 The real hearing on this, what you call the scope of prosecution,

00:07:27.300 was supposed to take place next week, I think, the 26, 27, 28.

00:07:31.840 That has now been pushed because of these motion schedules.

00:07:38.340 Well, I have to believe, considering the holiday and July,

00:07:41.580 and I'm sure that people have travel, vacation schedules, that she will be scheduling that series.

00:07:47.540 That was supposed to be three days of hearings, Steve, as you recall.

00:07:50.460 I broke that news on the War Room as she posted her motion vacating the trial date 0.58

00:07:54.600 and then setting these three days of hearings.

00:07:57.160 So I assume that will be mid to end of July.

00:08:00.680 But next week, we still have some interesting motions.

00:08:04.540 She will hear Jack Smith's argument for a gag order,

00:08:08.700 which would prohibit Donald Trump from criticizing law enforcement involved in the unprecedented armed raid of Mar-a-Lago,

00:08:15.980 but also the totality of the investigation.

00:08:19.500 So I will be there Monday to hear that.

00:08:21.620 But then Tuesday, two key defense motions will be argued.

00:08:26.520 One is the defense motion to suppress all of the evidence collected during the Mar-a-Lago raid

00:08:32.880 based on the unlawfulness of the application,

00:08:36.860 false claims made in the FBI's application for that warrant,

00:08:40.680 and FBI agents exceeding even the very broad scope of that warrant.

00:08:45.200 Furthermore, she is going to entertain,

00:08:48.540 and this was a big bombshell I covered back in the day as well,

00:08:52.060 and that was a former chief judge of the D.C. Circuit,

00:08:56.160 Daryl Howell, the Trump-gating Obama appointee,

00:08:59.620 that took the really rare step of piercing attorney-client privilege

00:09:03.860 between Donald Trump and Evan Corcoran,

00:09:06.780 claiming that there was evidence of a crime between the two of them.

00:09:10.600 He pierced that privilege, forcing Evan Corcoran to produce all of his records,

00:09:15.980 including recordings and notes,

00:09:18.520 turn all of that over to Jack Smith so they could help concoct this case.

00:09:24.140 And, of course, Donald Trump has filed a motion also to suppress any of that evidence,

00:09:30.120 any of Evan Corcoran's records, of course,

00:09:33.800 based on attorney-client privilege and Daryl Howell's ridiculous order to pierce that privilege.

00:09:45.820 If you think about it, just to put it into perspective,

00:09:47.800 you've got all those motions, and some of those are blockbusters,

00:09:50.600 plus next week you're going to have Fisher immunity.

00:09:55.580 Then he's sentenced to July 11th,

00:09:59.100 and then let's leave the debate aside because that's like politics.

00:10:02.920 I'm saying he's sentenced July 11th,

00:10:04.400 and they just had the gag order firestorm.

00:10:07.720 And then you come back later in July and do the scope of prosecution.

00:11:57.920 if it looks like they're going to kick this decision back

00:12:00.560 to either the D.C. appellate court or Judge Chutkin,

00:12:06.940 that former presidents are not immune from criminal prosecution,

00:12:10.160 and if they ask either court, the appellate or the district court,

00:12:14.680 to look at the indictment and figure out

00:12:17.200 which elements of the indictment would be covered

00:12:19.440 under presidential authority, obviously,

00:12:21.660 anything dealing with appointments to the Department of Justice would,

00:12:25.240 or what they believe are outside of the scope

00:12:28.220 of presidential authority,

00:12:30.280 you know, making calls to state election officials, etc.,

00:12:36.040 But that will restart activity in either the D.C. appellate

00:12:40.360 or, I believe, Judge Chutkin's courtroom.

00:12:44.080 So then Jack Smith is going to have to defend his indictment

00:12:53.320 but if the court says, no, that's not true,
