00:10:45.000 administrative state and how they would never become a majority in his lifetime okay and that was i think

00:10:50.000 in 2015 2016 he wrote this piece and a few short years later it's the it's gonna you know it's gonna

00:10:55.720 be the majority and and so that is the revolutionary effect that that that you know thomas has had

00:11:02.200 intellectually right on the court and then put in the sort of turbo charge of president trump with

00:11:07.220 those three appointments and that's why the left is going crazy people need to understand this they

00:20:02.940 and the late breakers a lot of people particularly more standard stock republicans that were done about

00:20:08.480 trump i said look at this list and they went and hey it's it's worked out because now and let's talk

00:20:18.440 walk to a couple of these cases and how important they are sure a presidential immunity uh one of the

00:20:23.220 biggest most historic of course the president has has immunity for his official acts it's never been

00:20:27.920 questioned before they haven't sued presidents they haven't tried to you know prosecute former

00:20:32.580 presidents uh in the past so that that one i i don't even i i i listened to the argument um you

00:20:39.740 know i i think the court will send it back down and then say what's official what's what's not but

00:20:45.000 again the left just like the four remember the 14th amendment case right to disqualify president trump

00:20:51.300 from the ballot was such an insane argument right but the left had like built it up that it was the

00:20:58.040 you know um slam dunk decision that it would be able to disqualify him and it was a nine zero decision

00:21:04.540 so i think you're going to see this court um you know on a lot of them hopefully there'll be

00:21:08.880 more than just six threes um or five fours but but larger majorities um the the january 6th you know

00:21:15.980 using this statute which was uh an enron related i actually did the enron investigations when i was up in

00:21:21.840 congress but the legislation that came out of that was about disrupting um obstructing

00:21:27.400 official proceedings by essentially destroying documents uh was what the statute is is what was

00:21:33.100 was was enacted to do they're using a statute and there's been other cases that jack smith has done

00:21:38.480 where um in the past where his his his theory has been overruled by the supreme court by nine zero

00:21:44.280 uh the mcdonald uh prosecution uh several years ago the former governor of of um of virginia so using a

00:21:51.680 statute to prosecute all of these people uh from january 6th that has no business being used in my

00:21:58.580 opinion i think the court again will will look at that statute and say this is not what it was for

00:22:03.900 and set aside all of those those uh those convictions uh or please um um uh the chevron deference

00:22:13.200 uh you know gigantic we've been talking about that a little bit this is something where what's grown

00:22:19.440 over the years steve is that congress doesn't like to make the hard choices so they pass these broad

00:22:25.040 statutes right and and then tell the the administrative agency the epa whatever the hhs whatever it is um

00:22:32.820 you write the reg and you have you know kind of and then enforce it and of course it's going to be

00:22:38.600 something that's much broader or much you know kind of going much further than the statute

00:22:43.020 and the this this chevron deference basically says if um we're going to rely on the agency's uh

00:22:51.300 interpretation of it and we're going to be subordinate to that the supreme court the supreme

00:22:55.440 court is the body that determines what the law says so they've inverted over the years to allow the

00:23:00.940 agency to determine what the law is um and we saw neil gorsuch with this great opinion i think in 2015

00:23:08.220 or so right before he was nominated where he showed that an agency had actually switched its

00:23:13.960 its interpretation of the statue after a court had ruled that it was wrong they they changed this the

00:23:21.280 the definition of this of the of the regulation to do what they were not allowed to do and it just

00:23:27.000 showed the inanity of turning all this over to the administrative state so i do think the court

00:23:32.280 will significantly cut back uh if not overrule completely hopefully they will but again with

00:23:37.800 these majorities um you know um i think they'll they'll strike that down really carve back chevron

00:23:44.420 deference um and then the the the government using uh their power to force social media platforms or

00:23:53.180 companies to to take things down uh and and again i think that's a that's a violation of the first

00:23:58.960 amendment uh and we're gonna you know hopefully we're gonna see the court rule in that regard too so

00:24:03.040 huge cases uh that are coming down this week that's why these attacks are going to happen
