00:03:52.000And California politics, other than, say, maybe a city council race in a small town, that's not what we call retail politics.
00:04:06.000It's not a kind of environment, California, where you can go out, walk door to door, walk precincts, shake hands, show up at malls and shake hands, go to rotary clubs and do all that kind of stuff.
00:04:27.000I'm well familiar with how that works.
00:04:29.000When I ran for mayor back in 1992 in San Diego, I walked a good part of that.
00:04:36.000It's a big city, but I walked a good part of a lot of precincts there.
00:04:41.000You can't do that, though, in California once you go to, for example, the state assembly, state senate, congressional districts, and then lieutenant governor, governor, attorney general, secretary of state.
00:04:59.000The only way you win in California is by raising a ton of money.
00:05:06.000So you either got to be independently wealthy or you got to get it from special interests.
00:05:11.000And the special interests where the money is in California are all bad guys.
00:05:18.000They all want stuff that's contrary to the interests of the people of California.
00:05:24.000Silicon Valley is a big, big money pot these days, but you got the big developers that have ruined cities like Los Angeles with overdevelopment.
00:05:38.000And so Kamala's rise, and I think I'm better equipped to describe this than a lot of people because I was in California as she rose.
00:05:53.000And it was inexplicable to me at one level until I thought a little bit about it.
00:05:59.000So she starts with her connection with Willie Brown.
00:06:04.000And, you know, I'm not going into the sex stuff, okay?
00:06:10.000The problem with the Willie Brown connection with Kamala Harris is that in order for her to move up the political ladder, as she did when she got to be in law enforcement as a government official,
00:06:28.000was that Willie would come to her and say, hey, go soft on these folks.
00:06:35.000Or in some cases, go hard on these folks, right?
00:06:39.000And when Kamala was going soft on folks for Willie Brown, it was people who were well-heeled, who gave Willie Brown a lot of money so he could maintain his power structure.
00:06:52.000And they got their money by ripping off the poor people of California, okay?
00:06:59.000That's the fruit of the poisonous Kamala Harris tree.
00:07:07.000She's a young, attractive, rising star, person of color.
00:07:17.000Willie latches on to her, enjoys all the fruits of her labor, but most importantly, uses her as a pawn in his game to raise money, not just for himself in the assembly, but so he could pay for other races.
00:07:34.000And then they would be beholden to him and he could maintain his speakership, okay?
00:07:40.000And Willie Brown did tremendous, tremendous damage to the state of California.
00:07:44.000Just a thorn in the side of whoever tried to govern California.
00:07:56.000So as she moves up the ladder, Attorney General is the state office, the only way you win those races is by spending an S ton of money on TV ads, okay?
00:08:16.000But during her rise, during most of her rise, social media wasn't like an expenditure, right?
00:08:22.000It was radio and TV ads blanketing the state.
00:08:26.000And we're talking like tens and tens and tens of millions of dollars that you had to spend even for something like Attorney General, right?
00:08:35.000And so two things there become quickly evident.
00:08:40.000One is she's used to sucking on the teat of special interests to get that money, serving essentially the whims and wishes of the Silicon Valley interests, the big developers, whoever are screwing up the state.
00:09:00.000Even as she's making her bones as a prosecutor, putting young, proud black men in prison for selling nickel bags of pot, right?
00:09:12.000So, I mean, there's no public interest there.
00:09:17.000She goes soft on real criminals, big criminals, so that she gets the money she needs to advance up the ladder.
00:09:27.000So, I was, she wasn't on my radar screen when she was Attorney General, frankly.
00:09:34.000But when it came time for a Senate candidate, I was just like amazed.
00:09:44.000It's like there was no question that Kamala Harris was going to be the next senator from California when Boxer, I think it was Boxer, when Boxer went away.
00:10:18.000She positions herself so that she's the chosen one.
00:10:22.000She doesn't have to go out and debate anybody.
00:10:27.000So, she's never developed those skills.
00:10:31.000And everything that comes out of her mouth is canned.
00:10:35.000And she's good because she's in the land of Hollywood at running really slick commercials.
00:10:43.000And so, this is exactly what we're seeing now.
00:10:52.000This is unprecedented where the presidential candidate nominee for a major political party did not receive a single vote in the primary.
00:11:10.000She just got coronated, anointed, and it was a Barack Michelle Obama op.
00:11:18.000On Monday, we showed you a clip, and maybe we can get that back up too at some point if you can find it, of how Obama like openly boasts in an interview how,
00:11:29.000well, I don't need a third term, all I need to do is pick up a phone and tell who's ever in the oval what to do.
00:11:38.000Because remember, for Kamala to secure the nomination after Biden got his legs cut out from under him by Kamala and the press,
00:11:50.000it wasn't a sure thing that Kamala would get the nomination, but Barack came in and put the knife in Joe's heart and gave the thumbs up, as Michelle did, to Kamala, and that deal was done.
00:12:07.000And so, she's there as the anointed child, once again, like in California.
00:12:14.000She, you know, last time she ran for president, she had to drop out, she had 3% polling numbers.

00:29:14.000With the trouble that he's having with the now former, but as of an hour ago, current indictment, he now supersedes, he streamlines, and he tries to take that indictment further.
00:29:30.000I mean, it really is a smart move on Jack Smith's part.
00:29:34.000Whether it'll survive is unclear right now, but it is a slick move.
00:29:40.000Instead, the very first words of this are not Donald Trump was the 45th president of the United States, but it now says Donald Trump was a candidate for president in 2020.
00:29:49.000And it frames it in all of these instances as a candidate for office, as opposed to a president engaging in official conduct.
00:29:58.000I think it's clearly an effort to try to do more election interference from Jack Smith.
00:30:02.000He should be ashamed of himself, and it's one of the reasons why we have to win, because he should not be anywhere near power.

00:30:21.000This gambit, which CNN seems to think is a, quote, smart move, a slick move.
00:30:28.000You know, not smart or slick at all in my judgment.
00:30:38.000We have Jeff Clark in, and Jeff Clark, interestingly, plays a role.
00:30:47.000I guess, Jeff, you're the dog that didn't bark, at least in Jack Smith's mind, meaning that for somehow you've been taken out of the indictment so that they can do this ruse about how it was campaigning and not official because you were in the government at the time.
00:31:09.000Break this one down for me, Jeff, and on a scale of one to ten, how surprised were you by this?
00:31:22.000Look, quick word about what you just referred to about me, but I want to put the focus on this, you know, new dastardly act against President Trump to try to stop him from getting reelected by Jack Smith.
00:31:33.000But look, I was unindicted co-conspirator number four in this original indictment, and then I've been dropped out.
00:31:42.000And so that's caused a lot of speculation in the Xverse, the Twitterverse, that, oh, well, now I must be cooperating with Jack Smith.
00:31:50.000So let me just say and set the record straight, I don't think anybody in the war room posse or you, you know, thought that that was the case.
00:31:58.000But look, I am not cooperating with Jack Smith.
00:32:39.000So what Jack Smith is doing by taking you out of the loop is eliminating the argument that whatever President Trump was alleged to be doing had nothing to do with official business because you were part of the official team.
00:32:57.000So I did never even occurred to me that somehow this was you cooperating with him.
00:33:04.000That would never happen with Jeff Clark.
00:33:06.000So this was simply taking you out of the loop so that they could do this ruse about how somehow the president of the United States on January 6th, still 14 or 15 days out before he would turn the reins of power over, was somehow not president on that stage that day.
00:33:32.000It's a clear end run around the Supreme Court.
00:33:36.000It'd be interesting to see what the Supreme Court thinks about this kind of ruse.
00:33:42.000But what's disturbing to me, Jeff, about this, besides the fact that it's just kind of in your face, is that it's clear it's election interference to me.
00:33:52.000So tell me, tell the audience what his legal theory is and whether you think he's committed election interference, which would expose him to prosecution when President Trump gets elected.
00:34:12.000So first, Peter, a word on the surprise question you asked me.
00:34:18.000Look, I actually was surprised by this because he told the world, he told Judge Chutkin that he was consulting inside the Justice Department and that's why he needed some extra time.
00:34:28.000What he was really doing was he was, and grand jury processes are inherently secret, he was running a secret grand jury process.
00:34:35.000And what's amazing about that is, you know, the media, they watch the courthouse like hawks.
00:34:40.000They did not report at all that there was any possible new grand jury proceeding going on.
00:34:45.000So they allowed this idea of, well, he's just doing internal consultations to go forward.
00:34:50.000And then they surprised us with this thunderbolt yesterday of a new indictment.
00:34:54.000The new indictment doesn't surprise me as a tactic.
00:34:58.000I think that they, he would almost have to do that.
00:35:01.000But what surprises me is that he did not tell the judge in advance that I'm opening a new grand jury and I'm going to be issuing, you know, pursuing a superseding indictment and please put things on hold for that.
00:35:13.000How do, how do we know he didn't tell Chutkin?
00:35:16.000It's possible he told her behind the scenes, but that would be an ex parte contact and prosecutors shouldn't be doing that, Peter.
00:35:45.000I would argue that this is a case of election interference, even though election day is November 5th, which is more than 60 days out.
00:35:56.000It's also true that early voting starts within about less than 20 days.
00:36:03.000And by the time 60 days are over, the election is probably going to be decided because, I don't know, 60, 70% of the votes will have been cast.
00:36:39.000I think that it's contrary to the spirit of the Justice Department policy that you don't bring a case like this this close to an election.
00:36:46.000And you're right that now that we don't have a single election day in America anymore, and I think we should get back to that, we have all this high lead time mail-in voting.
00:36:56.000It's clear that he's interfering with people who are engaged in that early voting, and that's just unconscionable for somebody to do.
00:37:10.000He's not weighing anything else like an ordinary prosecutor would.
00:37:13.000We have many eminent prosecutors over time who've explained that the prosecutor can't just go after one man.
00:37:20.000He has to actually be looking at a crime and then try to find the culprits, and this is turning that system on its head.
00:37:26.000Now, you asked the question of could he face legal consequences?
00:37:30.000He could, but if they were brought against him, no doubt, ironically, a huge irony would be he would assert that he is immune, that he has absolute prosecutorial immunity.
00:37:40.000He wanted to deny that to President Trump, who is the chief prosecutor of the United States, after all, when he was president.
00:37:45.000But he would then, you know, seek that as his blanket to protect himself.
00:37:50.000So, interestingly, Peter, this now 11th Circuit appeal that's going on about the case coming out of Judge Cannon's court down in Florida will be very interesting,
00:37:59.000because if he has no authority because he is an improperly appointed official because he was not Senate-confirmed, then he may lose the protections of that immunity defense.
00:38:12.000When is that case likely to be settled?
00:38:17.000The briefing is going to occur through the fall, and I think probably an oral argument, you know, maybe at the earliest in December or something like that.
00:38:27.000It depends on how fast the 11th Circuit decides to proceed.
00:38:30.000Now, with respect to this new indictment, is it going to tie up more resources of the president?
00:38:40.000Is he going to have to be reporting to court and get arraigned and all that stuff again?
00:38:48.000I saw a cover filing that Jack Smith made yesterday, Peter.
00:38:52.000And in the cover filing, he said that, you know, he would agree to waive arraignment.
00:38:58.000I think there's going to be a whole heck of a lot of motions practice about this because he's framed a new indictment.
00:39:04.000I think, you know, President Trump is entitled to his lawyers will file a new motion to dismiss the indictment.
00:39:09.000That will get responded to and replied to, and then Judge Chetkin will have an oral argument.
00:39:15.000None of that really requires President Trump's presence.
00:39:18.000And then whatever she does, whether she says, oh, he, you know, I have to strip out parts of even this new indictment, or no, we're just going to go forward with this new indictment.
00:39:29.000President Trump will then be entitled to another interlocutory appeal, which means an appeal that interrupts the whole process.
00:39:36.000Judge Chetkin has to stop again and wait for first the D.C. Circuit and then potentially the Supreme Court to adjudicate that set of immunity defenses.
00:39:46.000So, Jack Smith is not a political consultant.
00:39:53.000He knows that the action he's taken is going to have an impact on the election.
00:40:05.000He himself doesn't know whether it will help Trump or hurt him because he's a lawyer, not a political consultant.
00:40:12.000Doesn't it have to be the case that he consulted with Kamala Harris and her political team, strategy team, before he did that?
00:40:23.000And if that is the case, is she not culpable as well and subject to possible prosecution?
00:40:30.000Look, we know, Peter, that Fannie Willis was consulting both with the White House counsel to President Biden, you know, and with the January 6 committee.
00:40:44.000So it's really inconceivable to me that Jack Smith does not have some kind of political feelers out there.
00:40:52.000And the idea that that he is even able to proceed.
00:40:56.000Right. It he is an inferior official at the Justice Department when it's convenient to him.
00:41:01.000He argues that while I'm under the attorney general supervision, while the attorney general is under President Biden's supervision.
00:41:08.000So Garland's got to know about this. Garland's got to know about this at a minimum.
00:41:12.000Oh, absolutely. And there's no way Garland if Garland knows about it.
00:41:17.000Kamala's got to know about it. I mean, Biden's out of the loop.
00:41:21.000I mean, he's he's in a basement again somewhere. This is Kamala's thing.
00:41:26.000I can't imagine Garland and Smith doing something contrary to what they think is Kamala's interest.
00:41:33.000So they're in on it together. Can we just can somebody just say that out loud in the legacy media, please?

00:41:45.000Sure. Look, this is a tactic that is a dagger at the heart of the Republic.
00:41:51.000This lawfare must end. There must be consequences for those who pursued it and who tried to disrupt the electoral process in the United States.
