00:00:25.880 Kellyanne, what do people need to know about the use of that tool
00:00:28.740 and whether it might be challenged?
00:00:31.040 Yeah, thank you so much for having me back on this morning.
00:00:33.860 It's certainly an interesting Monday for any company who's operating
00:00:37.900 in the United States, Canada, Mexico, and China,
00:00:40.580 or have supply chains in any one of those economies.
00:00:43.900 So, AIPA, right, this is the first time that a president has invoked tariffs
00:00:49.720 on the basis of a national emergency.
00:00:52.680 And AIPA is a national security authority.
00:00:55.240 It is different than 232 or Section 301, which supported the steel and aluminum tariffs
00:01:00.720 and the China tariffs.
00:01:01.740 Those had an investigation that made findings about the threat of imports
00:01:05.680 or discrimination or unfair trade practices.
00:01:08.980 This is about a pure emergency and national security issue,
00:01:12.880 which the president has identified as fentanyl and illegal immigration.
00:01:17.580 So, Kelly, when the national security threat is resolved,
00:01:19.720 what happens next?
00:01:20.760 Do the tariffs get lifted?
00:01:22.000 Well, presumably.
00:01:24.180 And if you look at the three executive orders that the president issued on Saturday,
00:01:28.720 the legal basis for expanding the national emergency
00:01:32.320 is the illicit flow of fentanyl and migration.
00:01:35.620 So, when those issues are addressed,
00:01:37.120 presumably the legal basis for sustaining the tariffs would no longer be there.
00:01:40.900 So, my expectation is that these are tariffs that are targeted
00:01:43.940 towards this national security issue,
00:01:45.900 and that as soon as Canada, Mexico, and China, and the United States
00:01:49.740 are able to agree on a resolution, that the tariffs would go away.
00:01:53.420 All right, Kevin, this is really interesting.
00:01:55.680 Just the idea that maybe there's something that could be negotiated.
00:02:00.460 Let me just make sure that I'm understanding this correctly from you.
00:02:02.820 There's something that could be negotiated in the next 24 hours,
00:02:06.680 in the next several days, that would mean the tariffs would either not be put on
00:02:13.240 or would come back if it were to satisfy President Trump's concerns
00:02:17.280 about what's happening at the border and the protections there that are taking this.
00:02:22.280 I mean, we're calling it a trade war because Canada has already said
00:02:26.420 that they're going to retaliate across the board with tariffs on alcohol,
00:02:32.540 coffee, clothing and shoes, furniture, household appliances, whiskeys, fruit from Florida,
00:02:39.040 all of these issues.
00:02:40.020 You're saying that this is really more of a negotiation to try and say,
00:02:43.280 no, we want more focus on the border, and if you give that to us, these go away?
00:02:47.540 You know, this is not what I'm saying.

00:02:51.220 President Trump has said this is about the fentanyl crisis, right?
00:02:53.780 No, but so I don't know how somebody reads the executive order, if you're Canada,
00:02:58.420 and then comes back and says, oh, we're going to start a trade war.
00:03:01.360 We're saying we're really, really serious about going after fentanyl,
00:03:04.660 and President Trump means it.
00:03:06.280 And so there's all this fentanyl shipping across the borders.
00:03:09.540 There, in the past, have been caravans of people parading across our border,
00:03:14.820 carrying drugs and other things.
00:03:17.020 And the response of our neighbors has not been, hey, we're going to help you stop this problem.
00:03:21.860 It's go ahead and build a wall.
00:03:23.500 So imagine, Becky, if I had, like, all this stuff going on in my house next to yours
00:03:28.080 and all this stuff was leaking into your property, and then you say,
00:03:31.180 Kevin, you've got to stop all that crime in your place.
00:03:33.140 And I'm like, hey, you know what?
00:03:34.440 Becky, build a wall.
00:03:35.880 That's disrespectful.
00:03:37.300 And this is the attitude the president has towards what's going on right now.
00:03:41.480 He wants them to be respectful of the United States
00:03:44.180 and help solve the problem rather than feed it.
00:03:46.620 What is the chances that this gets resolved today
00:03:49.560 and there's an 11-hour agreement before midnight?
00:03:52.740 Well, there's always a chance, right?
00:03:54.680 I mean, this is a negotiation.
00:03:56.640 The United States is requesting something from all three countries.
00:04:00.620 And we have a call set up with Prime Minister Trudeau,
00:04:03.100 President Steinbaum today, with the president directly,
00:04:05.900 which I do think is a good sign, right?
00:04:07.940 These conversations have progressed to the top.
00:04:10.240 And what was striking to me on Saturday,
00:04:13.140 following the president's announcement
00:04:14.760 and the issuance of these executive orders,
00:04:17.240 was President Trudeau's press conference,
00:04:19.040 in which he said he had not had conversations with the president all week
00:04:22.760 about this specific issue.
00:04:24.580 So I do think that a call is trending in the right direction.
00:04:27.740 But whether or not what Canada and Mexico offer the United States
00:04:31.560 is enough will be a decision by the president and the president alone.
00:04:34.740 I haven't seen these figures myself say that something like only 40 pounds of fentanyl
00:04:38.640 was found at the Canadian border
00:04:41.480 versus a much huger position down in the south part of this border.
00:04:46.480 This is a way to get people to the table to say,
00:04:49.000 we are going to attack this and work with you.
00:04:51.000 And that would call off all of these tariffs that are going to be put in place?
00:04:55.640 President Trump will decide what he's going to call off and what he's not.
00:04:58.800 But he wants everybody at the table.
00:05:00.060 I think that's the confusion.
00:05:00.380 There's not a clear set of standards that say,
00:05:04.160 if you do X, Y, and Z, this won't happen.
00:05:06.700 Well, they clearly haven't done it in the past.
00:05:09.320 And the amount of organized crime in the fentanyl space in Canada
00:05:13.520 is also very disturbing.
00:05:15.300 And so it's not just a measure of like 40 pounds here and there.
00:05:18.680 The fact is the president has set a very clear guideline
00:05:21.020 for people to work with him collaborately.
00:05:23.540 These are some of our best trading partners and our best friends

00:05:36.360 I walked out of my hotel and they had an ambulance there
00:05:39.260 helping somebody who had OD'd, sadly, on fentanyl.
00:05:42.720 And then as I'm walking to my restaurant,
00:05:44.380 two people get in a fight with the cops over drugs
00:05:46.880 right there just in downtown Edmonton.
00:05:48.840 And this is just my one day when I'm staying there.
00:05:50.760 And the fact is that Canada is like San Francisco
00:05:52.700 and it's spreading to the U.S.
00:05:55.420 and it needs to stop.
00:05:56.420 And that's what the Canadian people want
00:05:57.780 and it's what the American people want, too.
00:05:59.180 So you think this goes on for only a couple of weeks?

00:06:31.260 So consumers necessarily are going to start to try to think about

00:06:38.380 and, you know, company cars that people drive, that's an issue.

00:06:46.240 You know, we're working on getting the final numbers
00:06:49.040 for the president's budget as we speak.
00:06:51.200 But I can tell you that the growth that we saw
00:06:54.380 in President Trump's first term pre-COVID
00:06:56.880 is looking like it's going to be a low number
00:06:59.980 compared to what we get when we run all of president policies
00:07:03.120 through the president's budget.
00:07:04.160 And again, I would ask people to do this.
00:07:06.740 And I've been very public about this on your show last fall,
00:07:11.680 that if you want to analyze the policy effect
00:07:13.640 of the Trump administration, you need to look at all of them
00:07:15.820 and not just take like a couple of papers
00:07:17.800 that say that tariffs are bad
00:07:18.940 and say that's the whole thing that's going to happen.
00:07:20.880 But if we model the whole thing,
00:07:22.420 that we're definitely getting growth
00:07:24.200 that, as the president said, looks like a golden age to us.

00:09:19.940 President Trump's philosophy is that this is a premium market
00:09:24.380 and you've got to get through the golden door.

00:09:27.200 Now he used, in this effort,
00:09:30.600 he used what's called the emergency authorization.
00:09:34.840 It was put in back in the time of Nixon.
00:09:36.680 And after Nixon, remember we talked about Nixon, the gold standard.
00:09:39.120 Nixon started throwing tariffs around and they wanted a little bit to control him.
00:09:44.100 So they had a set of criteria you had to have for it to call an emergency.
00:09:49.280 This is not the 301s and the 302s we used in the first term as they laid it there
00:09:54.500 to get the, to get to basically remember Alcoa and particularly U.S. Steel
00:09:58.820 to get the steel and aluminum tariffs.
