00:04:12.340 that the privilege of the writ of habeas corpus can be suspended in a time of invasion.

00:04:24.620 Wow. That was White House Deputy Chief of Staff Stephen Miller suggesting that the administration
00:04:31.180 would suspend habeas corpus if it disagrees with how the courts are ruling on immigration cases,
00:04:36.540 arguing the president alone has the authority to revoke this country's bedrock legal right.

00:04:42.520 Joining us now, I'm with NBC legal correspondent Lisa Rubin and NBC News Justice and Intelligence
00:04:46.780 correspondent Ken Delaneyan, and also Eli Stokuls, who's still with us.
00:04:50.900 Lisa, first off, define habeas corpus.
00:04:52.920 Habeas corpus is a form of asking for relief from a court where you're essentially asking
00:04:58.120 for a release of a body. Conventionally speaking, it just means that you're asking to be released
00:05:03.700 from custody. This is something that all sorts of people who've been caught up in immigration
00:05:08.780 proceedings have been asking for lately. Usually, you see it in the context of a prisoner who believes
00:05:13.700 that they've been wrongly convicted. After their conviction, they can ask for habeas relief.
00:05:18.160 But lately, we've been seeing it in cases like the Alien Enemies Act cases.
00:05:22.120 President Donald Trump fired the director of the U.S. Copyright Office, Shira Perlmutter.
00:05:26.920 Perlmutter was appointed by the former Librarian of Congress, Carla Hayden, in 2020.
00:05:31.500 Hayden was also fired just days prior.
00:05:34.140 Like Hayden, Perlmutter was also notified via email.
00:05:37.480 The director of the Copyright Office oversees six directories and 450 staff at the agency.
00:05:43.480 Representative Joe Morelli, the ranking member of the House Administration Committee,
00:05:47.060 blamed Perlmutter's firing on her recent report on using copyrighted material to train artificial
00:05:52.360 intelligence systems. According to Perlmutter, such a practice, quote, would undermine, rather
00:05:58.000 than further, the constitutional goals of copyright. Morelli said of Donald Trump's firing, quote,
00:06:03.160 It is surely no coincidence he acted less than a day after she refused to rubber stamp Elon Musk's
00:06:08.700 efforts to mine trolls of copyrighted works to train AI models. The union behind Canadian and
00:06:14.240 American musicians also issued a statement lamenting Perlmutter's firing. The union says, quote,
00:06:20.120 She understood what we all know to be true. Human creativity and authorship are the foundation
00:06:24.760 of copyright law. And for that, it appears she lost her job.
00:06:30.980 This is the primal scream of a dying regime. Pray for our enemies, because we're going medieval on
00:06:39.400 these people. I got a free shot. All these networks lying about the people. The people had a belly
00:06:46.480 full of it. I know you don't like hearing that. I know you try to do everything in the world to stop
00:06:50.400 that, but you're not going to stop it. It's going to happen. And where do people like that go to share

00:08:59.200 woke. She's gone. Then you get the head of the copyright, and then you start hearing,
00:09:03.580 hey, the tech bros have been all over this, and there's a reason. Explain to me why that last clip

00:09:13.380 call in the afternoon. We want to get your blood pressure up. We want to get you angry. We're showing
00:09:18.700 you what the Democrats are saying, just a complete, total nonsense. But the last clip was actually
00:09:25.100 very, very important. What in the hell is going on with this copyright, copyright protection,
00:09:30.800 and the head of copyright got turfed out, sir? So we've been fighting these trillion-dollar
00:09:37.120 big tech monopolists, Google, Amazon, Facebook, and Apple for five years at the Article III Project
00:09:44.200 and our sister organization, the Internet Accountability Project. And we have been very
00:09:49.880 successful in changing the politics, particularly on the right, on ending the big tech antitrust
00:09:57.600 amnesty that they've enjoyed for too long. And we have Andrew Ferguson as the FTC chairman. We have
00:10:05.040 Gail Slater leading the antitrust division. We have two very good antitrust law enforcers in the Trump
00:10:12.720 administration. And now where big tech is pivoting is on artificial intelligence. What they want to do
00:10:20.740 is they want to take every copyrighted work in the world and put it into their AI machines. And they
00:10:29.180 want their, they call it to teach the AI machines. But let me just give you an example of what this
00:10:35.500 means. And they want to do this without compensation. They just want to take all this copyrighted material,
00:10:40.420 put it into the AI machines. They want to call it fair use under the Copyright Act, which means
00:10:47.900 theft, essentially. And they want to do this under the guise of trying to compete against China.
00:10:54.440 Apparently, they want to steal like China so they can compete against China. They want to have slave
00:11:00.120 labor like China so they can compete against China. That's not how it works in America. But let me give
00:11:05.340 you an example. If I went onto this AI machine and said, give me a summary of every Bannon war room
00:11:14.640 hits by the Viceroy Mike Davis over the last six months. What this AI machine would do is go take
00:11:21.940 all this content from the war room. It would summarize Steve and my discussions over the last
00:11:27.260 six months. And then you have a very good idea of what we discussed. And you don't have to go click
00:11:33.620 on the link for the Bannon war room. That means that Bannon's war room has all their content used
00:11:39.800 by Meta or whoever the AI company is, Google. And then the war room doesn't get paid for the clicks.
00:11:46.980 The war room doesn't get paid for the advertisement. So what it will do is this will destroy conservative
00:11:54.780 media. Liberal media will always be good because you're always going to have China. You're always going
00:12:01.200 to have Soros propping up liberal media. Conservative media has to make money the old-fashioned way.
00:12:07.840 They have to do it through people clicking on their content and advertising, right? And if you don't
00:12:12.660 have people clicking on conservative content and getting the advertising, it's going to destroy
00:12:19.780 conservative media. Big tech tried to do this. They tried to go to the Justice Department
00:12:24.540 and get the Justice Department to say that stealing content for these AI machines is fair use. We
00:12:32.680 shut that down. They tried to take over the copyright office, right? The copyright office
00:12:40.000 at the Library of Congress has every copyrighted material in the world, right? And so now they want
00:12:46.220 to take over the copyright office and put in one of their big tech shills to run the copyright office,
00:12:51.680 one of their big tech shills to be the librarian of Congress and then have the copyright director
00:12:57.500 take over that. I think we're shutting that down now. Their next move is they've gone to Congress
00:13:04.560 and essentially they want to give these AI companies 10 years of amnesty from states where the states cannot
00:13:12.780 regulate them. The states can't bring any actions against them. Similar to what big tech did on Section 230,
00:13:20.680 immunity. So you have Section 230 immunity where they can't be sued for the content that they put
00:13:27.820 online, but they can profit off of it. And then they have antitrust amnesty. These trillion dollar
00:13:32.820 big tech companies are going to do whatever they can to steal as much content as they can from
00:13:39.440 creators. And then they're going to try to get as much amnesty as they can out of the Justice Department,
00:13:45.840 out of Congress, out of states, out of out of the copyright office, out of whatever. And that's
00:13:51.780 where this is so important that we're calling this out because obviously President Trump does not want
00:13:58.160 to kill every conservative media outlet in America by having copyrights. It's also it's also the other
00:14:04.300 copyright. We're going to talk about this. This is these guys are rapacious. They're rapacious. The
00:14:09.380 people it really hurts, too, is those of us who have not put up paywalls that have everything out for
00:14:14.260 free. And we and we and we have sponsors, we have advertisers, but it's kind of on a click basis.

00:21:50.860 called your home. The copyright is to show that, hey, this is their ownership of something they
00:21:57.460 created themselves. And then you can take distribution rights and estimate. For years,
