Summary

Presidents have traditionally served two terms, and the idea that a president can serve more than two terms in office is anathema to conservative ideologues has been around since the early 19th century. The idea of a president serving more than one term in office has long been a sore point for conservatives, and so did the 22nd Amendment, which was passed by Congress in order to prevent a president from running for re-election more than twice.

00:00:05.900 Trump and his allies can circumvent the Constitution or rewrite it?
00:00:10.880 Well, the 22nd Amendment is ironclad unless you are intent on strangling the entire meaning
00:00:17.480 and intent out of the 22nd Amendment. It's fairly clear that you can't be elected
00:00:23.240 to more than two terms of office as president. And the 12th Amendment also makes it clear
00:00:29.720 that you can't run for vice president and be ineligible for the presidency.
00:00:35.120 And so you really have to do a couple of things. One is that you would have to claim that somehow
00:00:40.660 being elected is different from serving. And that's entirely inconsistent with what
00:00:47.380 conservatives in Congress in the late 1940s were attempting to achieve with the 22nd Amendment.
00:00:55.060 And I think, again, you have to look at the history and tradition here,
00:00:59.060 that Americans have traditionally had presidents that served for two terms. FDR broke that. I think
00:01:06.800 I won't minimize the partisan motivations of Republicans in the 1940s to get this amendment
00:01:12.720 in place. And they certainly couched it in terms of being anti-authoritarian and pro-democracy.
00:01:18.800 But at the end of the day, everybody knows what this amendment was supposed to do. It was simply
00:01:23.400 supposed to keep somebody from running and serving more than two terms in office. And it's just simple
00:01:30.360 as that.
00:01:31.140 Can we just say that the Justice Department was not weaponized under the Biden administration?
00:01:37.920 There were Democrats and Republicans that faced the wrath of the Biden administration's Justice
00:01:42.260 Department. Like, the reason people were silent is because the president had credibly committed crimes.
00:01:49.240 And it seems incredulous that I have to say that, Lisa. It seems crazy. I feel insane. Calm me down.
00:01:55.840 I don't think I can calm you down on that. I think you're exactly right. The reality is that this
00:02:00.640 president, Donald Trump, was prosecuted based on substantial evidence of criminality. And the
00:02:07.100 Justice Department was not acting at the behest of Joe Biden, wasn't acting to prosecute him
00:02:12.700 politically, was prosecuting him because- If they were, they would have prosecuted him a little more
00:02:15.820 quicker. My progressive friends feel as though Merrick Garland dragged his feet a little too long.
00:02:20.520 I'm with you on that. I'm with you on that. And the fact is, is that this, this, we're in this
00:02:24.760 scenario where these facts are not perceived as facts because in part, this Supreme Court
00:02:29.780 exonerated Donald Trump, basically pardoned him and pardoned him prospectively. So now you have him
00:02:36.280 recreating history, recreating the facts and trying to assert in essence that he was politically
00:02:40.760 prosecuted while he himself is engaged in the most political prosecutions we've ever seen in the
00:02:45.160 history of our country.
00:02:45.960 I do think that there's an element of trolling, but as Susan says, you know, you look at the
00:02:50.280 east wing of the White House, it's hard to imagine that they wouldn't try to do whatever they want
00:02:55.920 to any norm or to any American tradition. And I think it's important to go back and to look at the
00:03:01.120 reason why the 22nd Amendment is in place. There was a tradition going back to George Washington
00:03:06.300 that presidents would serve two terms. And the reason for that was that we felt as if presidents hung
00:03:13.340 around longer than that, there, there would be corruption, there would be no check on corruption,
00:03:17.780 that the president himself would become an elective monarch. That was the phrase that people
00:03:23.840 used, the founders used to describe the threat of a president who stuck around for an extended period
00:03:30.060 of time. After the death of FTR, conservatives in Washington pushed for the 22nd Amendment because
00:03:38.000 they feared dangerous concentrations of power that resided in a president who stuck around for more
00:03:45.640 than two terms. And when you hear Steve Bannon talk about President Trump being an instrument of divine
00:03:52.520 will, it does sound as if he's describing him as, as a monarch. That's the way that people talked about
00:03:58.680 kings in Queens in the past. And that's a very un-American thing to talk about.
00:04:04.240 Do you think that China played a role at all in establishing peace between Cambodia and Thailand
00:04:09.880 in their recent conflict? Did China help in that process?
00:04:13.000 Well, they weren't involved. They weren't involved.

And they can, you know, they can. Or they can have some bad years. And they don't want that. And we're going to have a very good meeting.

00:09:23.180 In addition, the spoil votes, which is something we've been driving with many of the people in Ireland, which is just to write something on the ballot to let them know what you think.

00:09:33.420 But don't vote for a candidate is anywhere from maybe 15 to 20 percent.

00:09:43.940 Another 60 percent of the country rejected all the candidates and just did not vote?
00:09:50.080 Does that mean we're going to be around two-thirds, 60 percent to maybe two-thirds of Irishmen are now standing against the political class in Ireland?

00:10:05.360 But it's overwhelmingly that voter turnout is extremely low, which is a key sign.
00:10:13.420 And then the spoil of the vote, as you indicated, is ranging in constituencies from lows of about 10 percent to highs of about 22 percent of the votes cast.
00:10:27.560 So it's indicating, of course, there's a tremendously significant result.
00:10:33.460 The Irish people are fed up with what they've had to endure from their government.
00:10:38.580 And this is a big step forward.
00:10:41.580 So nominally, the candidate – there's a hard left, a communist named Catherine Connolly, who's going to be declared the winner.
00:10:49.440 But the true indication and the true outcome of this election is the voice of the people saying that they reject what the Irish government, the Irish elite, have been doing.

00:11:03.660 It's a rejection of the establishment.
00:11:05.540 And it's a very important step forward in Ireland and should be seen as another development, just as we had in September, the Unite the Kingdom, Tommy Robinson's Unite the Kingdom in the UK, the remarks from the Japanese prime minister rejecting immigration and Trump's activities.

00:18:42.820 I want to walk through what Judicial Watch has been accomplishing in regards to illegal aliens and their attempt to vote, sir.
00:18:53.480 Well, Judicial Watch has been cleaning up the voting rolls.
00:18:59.600 The federal law requires the states to take reasonable steps to clean up the rolls.
00:19:04.000 That means if someone is registered and moves away or dies or realizes they're not supposed to vote because they're an alien,
00:19:12.440 they're supposed to remove their names eventually.
00:19:15.160 And that has not been done across the country.
00:19:18.360 And we were the first group to begin enforcing this law privately, suing privately, to get the states to clean up.
00:19:26.220 And in the last few years, it's resulted in 5 million names being removed from the rolls.
00:19:33.440 I call it dirty names.
00:19:35.060 They're dirty election rolls that have been cleaned up.
00:19:38.380 California and L.A., they removed 1.2 million names thanks to a settlement.
00:19:43.180 In New York, we sued, Steve, we went in.
00:19:46.520 They sued almost immediately.
00:19:48.440 I mean, they settled almost immediately.
00:19:50.920 They've since removed almost a million names from the rolls in New York City.
00:19:55.460 We sued in California.
00:19:57.260 I mean, in Colorado, in Pennsylvania, in North Carolina, Kentucky.
00:20:02.520 They removed three-quarters of a million names thanks to a settlement and consent decree.
00:20:09.140 And it's just, in my view, the tip of the iceberg.
00:20:13.020 In Illinois, they're not removing names.
00:20:15.520 California, the rest of the state is a mess.
00:20:18.060 In Oregon, they virtually removed no names from their rolls, as the law requires.
00:20:24.880 And the law requires not much, which is, you know, if you don't vote in a federal election, they're supposed to send you a card.
00:20:30.340 And if you don't respond to the card or vote within two federal election cycles, meaning four or five years, they're supposed to remove your names.
00:20:39.540 They can't be bothered to do that.
00:20:41.840 And dirty election rolls are kind of a way, an inducement, and an opportunity for fraudsters because it's a lot of dirty names under who they could possibly vote.
00:20:54.580 And that's why federal law requires the states to clean them up.
00:20:57.760 And the Justice Department hasn't been doing any of this.
00:21:01.280 For years, Judicial Watch was the first one to do this comprehensively.
00:21:04.760 Now, Tom, the dirty, the voter rolls that have these illegal aliens on them are the predicate of how you steal elections.
00:21:17.960 This is why Democrats, because everything around them politically is about illegal aliens.
00:21:22.120 But what excuse, when you go in and have to, and Judicial Watch has to go in and take its resources and sue, what arguments do these states put up and the Democratic Party put up for keeping illegal aliens, people obviously not eligible to vote on the voter rolls, sir?
00:21:40.520 Well, there are no reasonable arguments.
00:21:43.620 They fight whether we have the right to sue.
00:21:47.040 And three courts have authorized our cases to go forward just in the last few months in Illinois, California, and Oregon.
00:21:56.300 I mean, I just told you, you know, L.A. County agreed to remove a million names, New York a million names.
00:22:04.720 They don't have an argument.
00:22:06.320 We essentially come in and catch them, and they say, we say, you haven't removed the records.
00:22:12.860 What's the reason?
00:22:14.540 And there is no legal reason, and they settle.
00:22:16.900 Illinois, for instance, they've got, let me look at the numbers here for Illinois, because people are going to be, because if there's one end of the total thing, and I'm sure you see this, about people who move away and they still get ballots despite them being moved away for 30 years.
00:22:33.740 In Illinois, or actually in California, they've got a fifth of its counties removed fewer, few or no registrations under this law.
00:22:49.960 19 counties failed to report any data regarding registrations removed because of the death of a voter.
00:22:56.140 However, Illinois informed the feds that 34 counties simply failed to report any data about removals.
00:23:04.560 So what we're talking about is millions of extra names on the rolls, despite our removing 5 million.
00:23:11.540 I'm guessing there's about 20 million plus extra names on the rolls right now.
00:23:16.560 And these are people who shouldn't be on the rolls.
00:23:19.540 And as I say, that's a pool for fraudsters to draw from.
00:23:23.580 Does it mean they're all voting illegally?
00:23:25.340 No.
00:23:26.140 Does it mean they're all fraud?
00:23:27.640 They're all legal votes?

00:23:29.380 It's just the opportunity is huge for fraudsters because of this problem.

00:24:58.220 What's the center of gravity of the current top-of-mind issues that you guys deal with every day over at Judicial Watch?
00:25:05.300 Well, you know, on the election thing, the other aspect of it is counting ballots that arrive after Election Day.
00:25:11.560 We were just in the Supreme Court two weeks ago making arguments.
00:25:16.500 And Illinois, they count ballots that arrive for up to two weeks after Election Day.
00:25:22.040 And the courts there said candidates don't have the right to sue.
00:25:25.200 So we're trying to get the Supreme Court to say, yeah, candidates can sue to chop an election from being stolen, which obviously was the big issue in 2020, as you know.
00:25:39.000 And in California, they count ballots that arrive for up to seven days after Election.
00:25:43.820 We found out there that there are two Democrats in the House because of ballots that were counted after Election Day.
00:25:51.680 And if I were in the House, I'd be asking, why is that the case?
00:25:55.040 We should be seeding the folks who lost due to this illicit vote counting.
00:26:01.640 Because federal law states, you've got to count the ballots on election, or you've got to count ballots that arrive by Election Day.
00:26:07.940 We have an Election Day, not an Election Week, not an Election Month.
