00:00:06.900 be dismissed. The U.S. District Judge concluded yesterday that the prosecutor who secured the
00:00:13.300 charges against them, interim U.S. Attorney Lindsay Halligan, was unlawfully appointed.
00:00:19.780 The Attorney General's authority to appoint an interim U.S. attorney lasts for a total of 120
00:00:27.220 days. The judge concluded that Halligan has been unlawfully serving since September 22nd.
00:00:36.180 Comey was indicted September 25th. James charged October 9th. Halligan is a former Trump aide and
00:00:44.640 personal lawyer with no prosecutorial experience. She secured the indictments of Comey and James
00:00:51.800 over objections from career prosecutors. Comey had pleaded not guilty to lying to Congress and
00:00:59.400 obstruction, while James pleaded not guilty to bank fraud. The indictments were dismissed without
00:01:06.240 prejudice, which means they could theoretically be refiled by a lawful prosecutor. But Comey's
00:01:13.280 attorney said in a statement that his reading of the ruling suggests the case cannot be refiled because
00:01:19.220 the five-year statute of limitations expired on September 30th. Attorney General Pam Bondi vowed
00:01:28.000 the Department of Justice would appeal the ruling. The appointments clause is more than a matter of
00:01:34.200 etiquette or protocol. It is among the significant structural safeguards of the constitutional scheme.
00:01:40.640 The clause not only serves as a bulwark against one branch, aggrandizing its power at the expense of
00:01:46.320 another, but also preserves another aspect of the Constitution's structural integrity by preventing
00:01:52.500 the diffusion of the appointment power. Translate that for me.
00:01:56.160 Oh, boy. Well, it was good. It was good, but put it in layman's terms for people.
00:02:01.000 Essentially, what Judge Curry is saying is that Congress has a role to play here, the courts have a
00:02:06.340 role to play here, and the executive branch has a role to play here. And the executive branch right now
00:02:10.500 is trying to do not only its own job, but the jobs of the other two branches by installing loyalists
00:02:15.820 without going through any of the normal legal process. There's a legal process in place that
00:02:20.840 the president is required by law to follow to appoint nominees to positions like U.S. attorney
00:02:26.940 Lindsay Halligan's role. It's in the Constitution that he has to consult the Senate and get their
00:02:32.640 approval for his nominees. He was not able to go through that process successfully to get Lindsay
00:02:38.920 Halligan appointed. He didn't actually even try. And as a result of that, he decided that he was
00:02:45.020 just going to install her in this workaround fashion, which is something that he has done
00:02:49.320 with U.S. attorneys around the country. This is not the first case where this has come up,
00:02:53.780 but it's the most high profile case where it's come up because Lindsay Halligan was put in this
00:02:58.380 role specifically for the purpose of prosecuting James Comey and Letitia James. And now that whole
00:03:04.540 strategy appears to be collapsing because it violates the Constitution, according to Judge
00:03:09.560 Curry. I think that we have we cannot forget that the only reason we are here, OK, the reason that
00:03:15.660 it would the things were brought in the first place is because Donald Trump wanted to go after James
00:03:21.540 Comey and A.G. James. He has talked extensively about the fact that he believes that they are criminals
00:03:28.560 and he believes they have something coming to them. The facts be damned here. And I think that
00:03:34.200 people have to understand that the president doesn't care about the law. He doesn't care
00:03:39.360 about process and protocol. He is trying to reengineer the federal government, specifically
00:03:45.000 the Justice Department, to serve his petty whims and grievances. That is it. That is what matters
00:03:51.500 to Donald Trump. Yeah, that's absolutely right. And I'd go a step further. He only doesn't he only
00:03:56.780 not doesn't care about the law. He actually takes pleasure in ignoring it. In other words, he probably
00:04:02.840 could have gotten, for example, approval to make changes to the East Wing, but he actually wanted
00:04:08.060 to just bulldoze it without approval. He probably could be bringing and winning some cases that they
00:04:15.280 are currently losing because he wants the theater of him not having to play by the rules. And in the
00:04:22.180 area of criminal prosecutions, it's at its most dangerous. When you and your colleagues made that
00:04:26.340 video, were there specific potentially illegal orders that you were thinking about that were
00:04:32.460 the sort of precipitating cause for you guys to get together and do that? Here's the thing, Rachel,
00:04:38.640 you don't want to wait for your kid to get hit by a car before you tell them to look both ways.
00:04:44.680 It's pretty simple. And if you go back to 2016, Donald Trump on a debate stage talking about,
00:04:50.940 you know, some action that he was going to take, he was reminded by the moderator that that would be
00:04:56.940 illegal, that the military wouldn't be able to follow those orders. And his response,
00:05:03.080 Donald Trump's response was the military would not refuse my orders. And then as president,
00:05:08.880 he talked about shooting people, citizens of this country in the legs, protesters. Now,
00:05:16.260 thankfully, Mark Esper, Mark Milley explained to him that that would be not, not be a good idea.
00:05:22.680 Now he's talking about the Insurrection Act, sending troops to more cities, using U.S. cities
00:05:29.380 and as training grounds and U.S. citizens for training of the United States military.
00:05:36.520 So, Rachel, we wanted to do something pretty simple here. We wanted to just remind folks that
00:05:42.940 they need to comply with the law and be reminded and also explain to members of the military that
00:05:50.120 we have their backs, that we know what's going on as part of our job, accountability over the federal
00:05:54.580 government. Chaos is going on right now. What impact is this having? Not so much on Donald Trump,
00:06:01.420 who said he's not running again, but on the Republican brand. It's just one thing after another,
00:06:07.480 one failure after another, one dismissal after another of these cases. Now they're going after
00:06:14.600 an American hero, Mark Kelly, with a guy like Pete Hegseth on the other side. Like this is,
00:06:21.900 again, I'm just baffled by the political moves they're making.

00:06:32.420 Kelly, going after James Comey, all the failures. As opposed to if you're a voter, what about me?

00:08:56.000 But Halligan, you know, being challenged, at least our prosecutions for Comey and for Letitia
00:09:01.960 James being roadblock. You can see from Mark Elias and their team, this is their main
00:09:07.440 driving force, that President Trump is giving illegitimate orders, President Trump is breaking
00:09:12.980 the law, President Trump is a fascist, he's a dictator, and he has to be stopped by any
00:09:17.760 means necessary. Julie Kelly, thoughts?
00:09:21.360 I mean, look, Steve, you and I have talked about this. This is a direct result of Republicans
00:09:29.560 in Congress doing nothing to rein in this rogue, out-of-control judicial branch, who is almost
00:09:39.260 on a weekly basis encroaching on the executive branch's authority, separation of powers. I mean,
00:09:47.020 to have a judge, and she's not the only judge who has said this, this Judge Curry, 77 years old,
00:09:53.480 plucked out of South Carolina by the chief judge, an Obama appointee, I believe, chief judge of that
00:10:02.260 circuit down there, to handle this case. So it took it out of the hands of the presiding judge
00:10:09.400 in both instances. So she was picked solely to do exactly what she just did. And that is make up
00:10:17.280 reasons why Lindsay Halligan's appointment was unlawful, and that judges have the right
00:10:24.840 to appoint a U.S. attorney in the district, in the circuit, where these same judges are
00:10:33.380 working. So you're going to have, so there's no tension between the two branches. So you're saying
00:10:38.720 that judges can appoint an executive branch position, a U.S. attorney, that completely violate
00:10:47.260 the separation of powers, and the will of the American people, who for one reason of many,
00:10:53.920 elected the president to stop this sort of lawfare. And these judges, who are so demonstrably rogue and
00:11:02.180 corrupt and partisan. So I think that everyone needs to keep pushing Republican leadership not to worry
00:11:12.740 about the war in Ukraine, not to worry about all this palace drama or congressmen who are upset
00:11:21.260 they're not getting enough respect from the president. Ridiculous. Just do your job. And one of them is to
00:11:27.920 protect the Constitution. That's actually a sworn duty. Protect the Constitution and the separation of
00:11:35.640 powers. So these judges stop trying to overtake the role of the president, whether it is appointing
00:11:43.700 U.S. attorneys or immigration law. So that's one thing that needs to happen.
00:11:51.920 Can we do that without, I mean, can this happen without Jim Jordan actually stepping up at judiciary?
00:11:59.600 And we've got to start firing back on this. We're just taking incoming, and there seems to be no
00:12:04.480 response. Does Jim Jordan, I mean, at a minimum, is it Boesburg that we have to impeach? Are there
00:12:09.440 other things that he could do right now? Because all President Trump, the President Trump's executive
00:12:14.340 branch in the Department of Justice is fighting a heroic fight at the Supreme Court level, but they're
00:12:20.200 just taking incoming nonstop. I mean, it's like Fort Apache, right? What can Jordan do, and what must
00:12:27.240 Jordan do, ma'am? They need to start impeachment proceedings. I mean, we've talked about this for
00:12:33.000 months. I've talked about it for years related to the D.C. Circuit Court. You have Jeb Boesburg
00:12:39.160 today, and this is what I'll be on speaking with you tonight. He has ordered a deadline of today
00:12:45.440 for the ACLU, which filed a lawsuit in the Alien Enemies Act that led to that infamous, what he called
00:12:52.720 oral order to return planes to the United States carrying illegal Venezuelans and the DOJ to submit
00:13:01.180 to him a potential witness list for contempt hearings that Boesburg will hold to try to again conclude
00:13:10.340 that the DOJ committed contempt of court when those planes were not returned. So, and we also know that
00:13:19.080 Jeb Boesburg, and I believe that we are going to find out more of these gag orders or non-disclosure
00:13:24.400 orders that he filed preventing cell phone companies from notifying sitting U.S. senators and members of the
00:13:34.300 House that Jack Smith had subpoenaed their phone records. So, not only were the phone records subpoenaed,
00:13:41.720 Jeb Boesburg stepped in and refused to allow these companies to notify their customers
00:13:48.140 sitting U.S. senators, that the government was taking their phone records. That is against the law.
00:13:55.780 It also violates the speech or debate clause of the Constitution. We saw this fight when the DOJ
00:14:01.700 seized the FBI, stole Representative Scott Perry's cell phone right out of his hand the day after the
00:14:07.360 Mar-a-Lago raid. So, what more, what else do they need before it is so clear that these judges, whether
00:14:16.120 it's Cameron Curry sitting in South Carolina, whether it's judges in Chicago, Maryland, California,
00:14:23.680 certainly Washington, they're all paying attention to the political climate here. They recognize and
00:14:29.820 understand that our Republican leadership in the House now almost a year into their reign of power,
00:14:37.360 have no plans to do anything to stop these judges or hold anyone accountable.

00:17:44.520 for today are proposals on how the court, meaning him, inquiry regarding a potential contempt
00:17:51.540 referral, criminal referral should proceed. This is what he's called it in hearing. This
00:17:57.120 is what he already found in April that there was probable cause, and that was vacated by the
00:18:02.120 pellet court. However, and this is another problem with these courts, they kicked it back
00:18:06.880 to him. He wasted no time resuming or restarting the contempt proceedings. What I think he's
00:18:14.740 trying to do is not only what he's been doing all along, but he's also trying to beat the
00:18:19.820 clock of the Fifth Circuit, which has the appeal right now pending of the overall legality of
00:18:27.520 the president's Alien Enemies Act proclamation. So he's rushing to get this done again, which
00:18:32.700 he already did within a month's time earlier this year, before the full appellate court in
00:18:38.320 the Fifth Circuit upholds the president's right to invoke that Alien Enemies Act proclamation
00:18:43.660 gets to the Supreme Court, where they very likely, the Trump administration will very likely get the
00:18:50.020 same sort of outcome. So I will be watching for these briefs that are going to be filed today.
00:18:55.860 We can talk about it tonight, but I want to get back real quickly to Judge Curry, and I posted this
00:19:00.140 on X, Julie underscore Kelly too, and Mike Davis can address this as well. He's probably already
00:19:05.740 caught this. She never acknowledges in either order that the president has nominated Lindsay Halligan to
00:19:13.960 be the permanent U.S. attorney in the Eastern District of Virginia. There is no vacancy. So what Judge
00:19:21.620 Curry did is pretend that there's a vacancy because the previous acting U.S. attorney,
00:19:25.900 his term had expired. He also was then pushed out for refusing to move forward with any investigation
00:19:32.780 into Jim Comey. But she never acknowledges that Lindsay Halligan's nomination is pending before the
00:19:39.540 Senate and has been since September 30th. So she's fabricating this idea that there's a vacancy
00:19:45.700 and that the judges have the right and the authority over the attorney general and the president
00:19:50.800 to decide who is going to sit in that U.S. attorney's office in the Eastern District of
00:19:56.560 Virginia. So obviously they're appealing this ruling, at least, and both were dismissed without
00:20:02.240 prejudice, which means that the indictments can be brought again. The Comey one's a little trickier.
00:20:07.340 I know Mike Davis has addressed this already with the statute of limitations. But this is the sort of mess
00:20:13.760 that the DOJ and Trump administration is dealing with on their own, while Congress sits and does
00:20:20.280 absolutely nothing to remedy this real constitutional crisis in our judiciary.
00:20:27.160 A hundred percent. And they know this to delay is to deny. They get this. They're having all these
00:20:35.600 delaying tactics and overwhelming DOJ with all of this to get to buy time, to get closer to the midterms,
00:20:42.000 to get closer to 28. They understand exactly what they're doing. This is the most sophisticated
00:20:47.920 part of the radical deep state democratic apparatus, is the legal, because the legal profession has been

00:21:50.000 and MSNBC yesterday, something like eight hours of coverage on this very topic. It was never brought
00:21:55.800 up that Halligan's actually been nominated. The fix is in on this, Mike. Lay out the battlefield of
00:22:03.720 exactly what's going on as they come after President Trump on his, this whole effort of
00:22:08.720 de-weaponization, sir.
00:22:10.880 There is overwhelming evidence that former FBI Director James Comey lied to Congress and obstructed
00:22:22.100 a Senate investigation related to his involvement in Crossfire Hurricane, the biggest scandal in
00:22:31.560 American history where Obama, Biden, Hillary, and so many other bad actors politicized and weaponized
00:22:39.140 intel agencies and law enforcement to take out their political enemy and to help their political ally.

00:22:59.560 The Justice Department is controlled by these deep state actors who refuse to hold their own
00:23:08.740 accountable. Instead, they want to go after their political enemies, and that's exactly what happens
00:23:13.760 here. There's overwhelming evidence against James Comey. It's clear cuts, and we've seen this because
00:23:19.360 James Comey and his attorneys have filed several motions to try to kick this indictment against him,
00:23:26.680 and then Trump U.S. Attorney Lindsay Halligand has produced the evidence. She's shown the receipts,
00:23:33.440 and the evidence is overwhelming. She's done this three different times, and I'd like to ask this.
00:23:38.940 Why didn't the prior U.S. Attorney bring these charges when the evidence is so overwhelming? He was on a
00:23:45.660 120-day interim appointment, and he was covering up for James Comey. Whether it was cowardice or corruption,
00:23:53.640 there is overwhelming evidence against James Comey, and this prior acting or interim U.S.
00:24:00.000 attorney on a 120-day appointment refused to bring charges because he was probably a coward. I doubt he
00:24:05.780 was corrupt. He was a coward. And so what do you do? You get rid of that U.S. attorney who refuses
00:24:12.020 to follow the law, and the Attorney General has the absolute statutory power to do this. That's what
00:24:20.200 Attorney General Pam Bondi did by appointing Lindsay Halligand as the new interim U.S. attorney
00:24:26.860 for 120 days. And Lindsay, they pretend like because Lindsay's beautiful, the left and some of these
00:24:33.700 cocks on the right want to pretend like she's dumb. Well, she proved that she's very competent. She brought
00:24:39.340 the evidence. She secured this indictment against James Comey in the Eastern District of Virginia
00:24:46.460 with this grand jury that's stacked with partisan Democrats in the D.C. suburbs. And this grand jury
00:24:53.440 did not rubber stamp what she did. This grand jury did not bring the more serious perjury charge,
00:25:00.500 but the grand jury brought false statements charges and obstruction charges for what James Comey did.
00:25:06.600 And so what has happened here? You have this Obama chief judge of the Fourth Circuit Court of Appeals
00:25:14.700 who hand-selected this Clinton judge in South Carolina to come in, and the fix was clearly in. And the fix was
00:25:23.000 clearly in by reading the first sentence of this Clinton judge's order in both the Comey case where
00:25:30.980 this Clinton judge dismissed these indictments, along with the case against Big Tish James in New York
00:25:38.300 City, who's very credibly accused, charged of committing, lying to financial institutions and
00:25:45.400 committing bank fraud in relation to Big Tish James lying about this mortgage in Virginia as her second
00:25:53.460 home instead of an investment property to get a better interest rate, right? And so these charges are rock
00:26:00.440 solid, the evidence is overwhelming, and you have these Democrat operative judges going out of their
00:26:07.640 way to sabotage this by misreading two different statutes and misreading them in a way that doesn't
00:26:15.020 avoid a constitutional conflict. It creates a constitutional conflict. They're trying to say
00:26:21.200 that the attorney general only gets to have their pick as the interim for 120 days, and that's it.
00:26:27.680 And then the court gets to jump in and appoint their own Democrat operative as the interim U.S.
00:26:33.420 attorney, and there's nothing that the attorney general or the president can do about it. That
00:26:37.700 is a clear violation of the separation of powers. That's a clear violation of Article 2 of the
00:26:44.540 Constitution if these federal judges who are hand-selected by Democrat senators think they can
00:26:50.920 hand-select the U.S. attorney during Republican administrations and have puppet U.S. attorneys
00:26:57.780 who protect Democrats and then weaponize the Justice Department to go after Republicans. Hell no.
00:27:04.900 This is totally unacceptable. This is corruption by these judges, and it needs to be appealed.

00:37:57.860 they're also extremely dangerous. That certainly meets the impeachment standard and the House of
00:38:03.820 Representatives needs to move forward with impeachment, A.S., A.P. We need to put Jeb
00:38:08.980 Boesburg through this impeachment process. I don't care if we don't have two-thirds of the votes

00:50:46.300 some bones in his back. But his navigator, James Kelly Patterson, never surfaced in the prison
00:50:53.520 system. But Red survived six years of that. And so Long Island, you know, helped win World War II.
