00:00:13.960Last March, Trump issued an executive order directing the Department of Homeland Security
00:00:18.260to create lists of eligible voters in each state, while also requiring the Postal Service
00:00:23.940to only deliver ballots to voters on those approved lists.
00:00:28.080The federal judge has since issued a nationwide block of that order in a case brought by voting rights groups.
00:00:33.860But yesterday, Democratic Senator Richard Blumenthal's office released a damning whistleblower report.
00:00:39.900It warns the technology developed by the Postal Service to carry out President Trump's executive order could, quote, derail the midterm elections,
00:00:48.460saying the technology has not been properly tested and it risks, quote, catastrophic failure if implemented.
00:00:54.620The whistleblower, who is described as a federal official with direct knowledge of the plan, claims the federal ballot mail portal would serve as a national database to verify voter information and could reject tens of thousands of ballots in a batch if a single barcode fails to scan.
00:01:12.720The official also warned millions of voters may not receive ballots on time or at all due to the, quote, slapdash rollout of the system, which reportedly was scheduled for completion by yesterday, September 1st.
00:01:25.040In response, the Postal Service confirmed it continues to work on the portal, but maintains it is complying with court orders because it's not yet using components that could invalidate ballots.
00:01:36.120But this becomes mission critical because of what's at stake here in terms of getting mail-in ballots to every American if they want them.
00:01:43.820What do you take from this whistleblower report that was sent to you?
00:01:47.260Well, first of all, Kate, thanks for having me.
00:01:49.420And thanks for highlighting the courage and fortitude of a whistleblower and whistleblower who brought this issue to our attention.
00:01:58.860And what's at stake here is really the right to vote.
00:02:01.080One third of all voters do it by mail.
00:02:04.380And this system is designed to fail. It is constructed to crash.
00:02:11.200It is sloppy, haphazard, hasty, which is negligent, but it is also intentional.
00:02:17.400You really think it's designed to fail? It's designed to not work? It's designed to keep people from voting?
00:02:22.940This system cannot be implemented consistent with the right to vote.
00:02:27.860It simply is impossible. We've talked to the IT experts and the whistleblower, in fact, is an IT person, a federal official.
00:02:38.880But the point here is that we need to safeguard the right to vote by stopping a system that is not just negligent, it is intentional.
00:02:51.960And I just want to emphasize, you said it, but another version of this is that the president gets to decide whether you, a viewer, can vote.
00:03:01.560And then you had the House speaker just at the top of the show saying, oh, no, no, Congress has no role in overseeing like how we wage war when you have Americans risking their lives, 50,000 of them.
00:03:10.840So it's just this theme of a stronger president of anything like this.
00:03:15.000Senator Blumenthal was very clear to me last night.
00:03:16.720He talked about how brave this whistleblower is and how nervous this person is about retaliation.
00:03:20.940But he said it's the system is just slapdash and sloppy. It's designed to fail. It's designed to not work properly and designed.
00:03:29.640You know, it seems to exclude people from voting. So it's extraordinary that this is happening.
00:03:34.540And again, there was a court order saying the administration should not carry out this project.
00:03:39.320And yet, according to the whistleblower, they're carrying it out again.
00:03:42.920The executive branch, the president ignoring the courts, a co-equal branch of government.
00:03:47.060And I'm sorry, I'm going to constantly talk about our democracy and this ideal, American ideal of three co-equal branches of government.
00:03:54.140Tonight, the plaintiffs working to protect the right to vote by mail have officially filed a brief opposing efforts to lift a block on Donald Trump's executive order.
00:04:04.260A hearing in the case is scheduled for Thursday, just one day before the first mail mail in ballots or mail ballots will be sent out.

00:05:31.900that read, ICE is not planning operations targeting polling locations.
00:05:39.980And if an active public safety threat endangered a polling location,
00:05:44.560they may be arrested as a result of that targeted enforcement action.
00:05:49.340So, David, combine that with your new reporting this morning on some pushback from Democrats
00:05:54.240to concerns about the Trump administration possibly sending armed federal agents
00:05:59.340or troops or ICE agents to polling places.
00:06:01.500As we should note, Mark Waid Mullen made that announcement yesterday while also saying there'd be a ramped up immigration enforcement here in New York City deemed Operation Rotten Apple.
00:06:10.540But I think many people are concerned this November that there's going to be a multifaceted push by the Trump administration to keep voters away.
00:06:18.840Yeah. So Senator Alyssa Slotkin of Michigan has been pushing this issue for months.
00:06:23.920And she first asked two people and was about active duty troops, Defense Secretary Pete Hegseth and the chairman of the Joint Chiefs of Staff, General Cain.
00:06:31.500A positive, positive thing is that Cain actually responded in writing.
00:06:35.940She asked for these letters months ago, and he's very explicit here in this letter that it is the role of the states to administer elections in this country
00:06:43.900and that there is no plans to send active duty U.S. soldiers to polling sites.
00:06:49.060It is illegal under federal law for active duty soldiers to go to polling places.
00:06:54.760On the other hand, Defense Secretary Hegseth has not answered, has not provided anything in writing the same pledge that, again, that was just made by the chairman of the Joint Chiefs of Staff.
00:07:04.320The last update just last night, Slotkin sent new letters to Mullen, who spoke about DHS and ICE agents saying pledge in writing they will not go to polling places,
00:07:14.140and also to FBI Director Cash Patel, Attorney General Todd Blanche, and also the commander of the National Guard.
00:07:20.040And so she's making this an issue, and I think it's the way Democrats are trying to put a marker out there, educate Americans, that it is federal law.

00:07:31.660No armed federal agent, no armed soldier can go to a polling place in this country that's against the law.
00:07:37.700So, Jim, regardless of what the court has said, the White House is claiming today in their response to the report that this is just software to carry out a new verification check.

And it's not showing up in the birth certificate records, which we have. So I'm telling you, the illegal, here, let me give a little bit more. The illegal population is probably somewhere around 14 or 15 million. It's fallen.
00:23:03.380But there are five or six million young children of illegal immigrants who are U.S. born who don't get counted in that estimate.
00:23:10.200We have legalized just by marrying an American, winning the visa lottery, getting asylum, maybe three to five million more people in recent decades.

00:23:39.480But legal immigration has added twice that, maybe 60 million.

Remember, every year we legalize one to 200,000 illegal immigrants because they marry an American. We grant asylum. That's a movement out. We do deport even before President Trump, who's clearly ramped it up, 100,000 people, very roughly 50 to 100,000 people, about 50,000 illegal immigrants die.0.98

00:25:19.880And it doesn't match all the demographic data we have, unless we don't know how many kids are in public school, which wouldn't make sense, unless we don't know how many people are being born in America, which we do know those things.0.53
