00:00:16.080So, Peter, this decision, which was just rendered, is part of the court's emergency docket where
00:00:22.000the administration has gone repeatedly to the Supreme Court, as you know, to try and
00:00:26.480reinstate policies that it believes are important, oftentimes before a full process and the courts
00:00:32.800can play itself out. This one is no exception. And in particular here, the government has used
00:00:38.400a program called the Systematic Alien Verification for Entitlement System since the 1980s to verify
00:00:44.860who is and is not eligible to receive government benefits. In recent months, however, the
00:00:50.800administration has proposed using this save system to try and help states and localities verify the
00:00:56.980citizenship of people who want to register to vote. That is something that a lower court said
00:01:02.340was impermissible, that the DHS could not share this kind of data with states and localities to
00:01:08.880help in verifying citizenship of voters. Today, the Supreme Court granting this stay application
00:01:15.080from the government appears to have decided on a 6-3 basis that the administration can go ahead
00:01:20.780and do this, and that to enjoin it would have been an impermissible overreach with respect
00:01:26.660to the administration being able to implement a policy of its choosing.
00:01:30.120I'm still sorting through this, but according to our colleague, Fallon Gallagher, the split
00:01:35.0006-3 here falls along predictable ideological lines with the three liberal justices in dissent
00:01:41.900and the remainder of the justices joining in what's called a per curiam opinion or an
00:01:47.480unsigned opinion meaning no one justice is taking credit for this all six of them are in unity it
00:01:53.460appears here in granting this stay are they going to be willing to scream fraud and allow the
00:02:01.160president to undermine the trust in our election system and therefore our democracy because they
00:02:09.740lost i mean they know that their message is not popular right now they know it the polling shows
00:02:15.060it? Well, first of all, they have allowed Donald Trump to undermine confidence in our democracy
00:02:21.120and our election. So that's already happened, unfortunately, not only because of what Donald
00:02:26.400Trump did in becoming the first incoming president in American history to challenge and to refuse to
00:02:33.240accept the results of a legitimate election in which he lost. He and millions of his followers
00:02:37.820already went along with the biggest blow to the integrity of our election system you could
00:02:43.320possibly imagine. And by the way, Katie, they have made election denialism, in effect, a
00:02:51.480litmus test for employment in the upper levels of the Trump administration. So the entire
00:02:57.980administration has gone along with the biggest undermining of confidence in our elections that,
00:03:03.080you know, either of us could conceive of, number one. Number two, I think the conventional view
00:03:08.280here in Washington has been, well, if Democrats win by big enough margins, if it's, you know,
00:03:13.640just the actual blue wave that you're talking about, it will be too hard for Republicans to
00:03:18.580challenge it. But I would I would, you know, put a question mark there, because I think what we've
00:03:23.600seen with Trump is that even it not being a close call didn't stop him in the past. Remember,
00:03:29.920the 2020 election was not one of the closest presidential elections of our lifetime,
00:03:34.140not even anything like it. It was in 2000. That was a close election. 500 votes in one state.
00:03:42.000Florida decided the election. This wasn't a close election. So I think that you have to remain
00:03:47.960concerned, even if it is a pretty unequivocal result on election night, that Republicans may
00:03:54.100decide to proceed with some of Trump's plans to challenge elections or to refuse to seat
00:04:00.000individual victors in different states? I am worried about everyone else. I'm worried about
00:04:04.520the fact, and I want the two legal experts to talk about the core challenges afterwards.
00:04:08.980I'm worried about election day. As you mentioned, Kash Patel has established election integrity
00:04:14.140units in every FBI, in every state, I believe. So you could have FBI agents going out to these
00:04:21.560places and saying, this person's an elite. We suspect, or we're launching a federal investigation
00:04:27.680that this person is a legal alien and do they grab just that ballot or more ballots this is all scary
00:04:33.480worst case scenario stuff but this is incredibly serious and what concerns me too about the supreme
00:04:38.380court is this just huge deference to the executive branch and you know the courts cannot in any way
00:04:44.820limit their effort to help the states who are primarily responsible for running elections but
00:04:50.880i am very worried about election day um and dhs agents as well this whole enterprise is about
00:04:57.340undermining the confidence of elections among Donald Trump's base so that he is empowered
00:05:03.420to do the kinds of things that they wanted to do in 2020, but that the Justice Department refused
00:05:07.980to do, which is take executive branch action to try to suggest that there is fraud, even though
00:05:13.620there's no real evidence of fraud. That's the real worry. That's what all the election groups
00:05:17.340are fundamentally worried about. And this is a bit of an information warfare exercise laying
00:05:22.600the groundwork for that to happen. It's quite clear that Secretary of Homeland Security Mark
00:05:27.000Wayne Mullen is one of the loudest and most supportive of Donald Trump's sycophants within
00:05:33.760the cabinet and is willing to do whatever is necessary to please his boss, just to make Donald
00:05:39.500Trump happy. And as Mark was pointing out, there is a clear intention on the part of this
00:05:44.840administration to do everything possible to be able to limit the number of people who may be
00:05:50.800eligible to vote, but who the Trump administration is trying to keep off of the electoral rolls.
00:05:56.920And so I'll leave it to Mark and other lawyers to assess the legality or the legal implications of this.
00:06:02.360But again, it's quite clear that this is just consistent with this trend that we've seen.
00:06:07.300And now we're less than 40 days before the midterm elections, that the Trump administration is going to use whatever tool or tactic or gimmick and to try to give its supporters,
00:06:16.920whether in the federal government or in the state and local offices, the tools or the excuses they can use in order to try to change the outcome of the vote.
00:06:24.640But also, I think the Supreme Court ruling is consistent with what we've seen from the conservative majority, which is to pay deference or to give Donald Trump as much support as possible in terms of his unitary executive powers and will, in fact, genuflect and allow him to go forward with this.
00:06:42.760So, again, I'm thinking about what still might be in store in terms of what this administration might try to do in order to affect the midterms.
00:06:50.000But it's clear that they can see the writing on the wall that the wave of anti-Trump and anti-Republican Party sentiment is going to be quite evident in the polls this November.
00:07:02.000So, again, I wouldn't be surprised if we're going to see more and more instances of the Trump administration trying, again, to illegally, unethically, in a very unprincipled and un-American way, affect the outcome of November's election.
00:07:16.720Friday, 25 September, year of our Lord, 2026, kind of a blockbuster decision this afternoon from the Supreme Court.
00:07:24.900Off the emergency docket, Jeff Clark joins us and Cleta Mitchell and others.
00:07:29.540We're going to start with Scott Pressler up in the Commonwealth of Pennsylvania.
00:07:33.820Scott, give us your thoughts and observations about what happened this afternoon, sir.
00:07:41.380Well, see, we just heard from very clueless people who aren't understanding that Donald Trump is not undermining the confidence of voters in our elections.
00:07:52.740there is no confidence in our elections because of decades of fraud within our constitutional
00:08:02.920republic. But today is a big victory for the American people. Again, this is what we've been
00:08:08.560trying to pass for the last year, the Save America Act with the SAVE database, the systematic alien
00:08:14.280verification for entitlements, which, by the way, HUD, Housing and Urban Development, uses as well.
00:08:21.900but the Democrats have no problem with other entities in our government using the same
00:08:26.480database just when it comes to voting. But let's unpack this for a second. Although voters are not
00:08:33.760going to be able to be purged because we're 90 days before election day, according to the NVRA,
00:08:40.660what I believe is happening is even more important because we're going to be able to get a list of
00:08:48.500ineligible, non-citizen, unlawful voters that if they vote this November and these secretaries of
00:08:57.380states are aware of these lists or the county election office officials are aware of these
00:09:04.560lists, the DHS and Harmeet Dillon, AAG of the Civil Rights of DOJ, has already publicly stated
00:09:11.460that anyone who knowingly allows a non-citizen to vote in the upcoming November election
00:09:19.500may be held criminally liable. So I believe this may be setting the stage that if and when
00:09:28.080ineligible voters vote this November, we will find out about every single person
00:09:34.380that has cast a fraudulent illegal ballot the nvra the 90 day because norm eisen these guys
00:09:42.740making a big deal about that is that absolutely ironclad we have plenty of time but we could do
00:09:47.120it uh through our through you know sophisticated computer techniques we have the ability to purge
00:09:52.820these roles what's stopping us it's not ironclad no i did read part of it steve that like for
00:09:59.580example, if a voter has passed away, unfortunately, I believe there are exceptions to the NVRA that
00:10:06.380they can still be removed from the voter rolls. So I know that Judge Sparkle and Mark Elias are
00:10:12.620crying in a corner somewhere at this very moment. And furthermore, I just posted before I came on
00:10:19.040your show, why is the United States allowing for foreign born judges to decide and interpret
00:10:27.640American law, but that's for another discussion. One other thing that I do want to point out,
00:10:33.700Steve, is here in the Commonwealth of Pennsylvania, we have been exposing non-citizens that have been
00:10:38.880summoned for jury duty, and those become a part of what's called the non-juror list.
00:10:44.700Well, I'm here to tell you that the DOJ just arrested non-citizens in Philadelphia,
00:10:51.400and this is breaking news that I haven't shared on any other program exclusively.
00:10:57.380I'm here to tell you that several of those people that were just arrested
00:11:01.000were on the non-jury list for Philadelphia County, Pennsylvania.0.96
00:11:08.220So the work that we are doing to expose non-citizen voting is coming to fruition.1.00
00:11:14.300And everything that we have said about non-citizens voting is truthful, is factual,0.93
00:11:21.400And that's why the Democrats are scared, because we are finally getting movement on this critical issue.0.97
00:11:28.320Scott, I know you stepped out of me to join us, so I want to be cautious of your time.
00:11:33.060I just want to make people understand that in situations where maybe the polling is not as strong as we had hoped, like places like Florida and others,
00:11:42.920your work and your leadership in this area of voter registration. The two million
00:11:48.700voter registration Delta positive we've got in Florida is waving some of the Democrats off.
00:11:55.040They see it's too big a hill to climb. That's why this voter registration move you've had is so
00:11:59.780important, sir. Thank you. And it tells a story. If we want the rest of the country to be successful,
00:12:08.320let's register voters like we did in Florida, but don't believe the polls. They told us Hillary
00:12:13.580Clinton would win, ladies and gentlemen, and the story was written. They told us in 2024 that Iowa
00:12:21.040was several points for Kamala Harris and Iowa was crushed and went for Donald J. Trump. The only
00:12:29.120poll that matters is on Tuesday, November 3rd, 2026. And I'll tell you that two of our candidates
00:16:30.120I think that the Supreme Court, at least the majority, felt that they had no choice.
00:16:35.300The governing law is, you know, so Congress cannot bind future Congresses.
00:16:43.140And so the 1996 law stands as the most recent law on this matter.
00:16:48.880And it says that no matter what other laws are made, that you cannot have illegals voting.
00:16:56.100And if people report that there are illegals voting, the federal government has to act on it.
00:17:02.500And that there is the law says in no way can you not participate in sort of reviewing these laws and finding out who is eligible to vote.
00:17:12.760or get benefits and so this is where we stand it wasn't signed but it was a 6-3 decision
00:17:19.140with brown writing the minority dissent hang up for one second neil stick right there because i
00:17:26.380want to also talk later in the show about uh what went down the last couple days on the chinese
00:17:30.420visit uh jeff clark this is your line of country what happened here and why did it take so long i
00:17:36.800mean this is part of the save america act i think this has been on the i think they went to the
00:17:41.000emergency docket a while ago. It just happened. And now Norm Eisen and everybody's yelling,
00:17:46.780well, they ruled, but it's too late with inside 90 days, which I happen to think is incorrect,
00:17:52.700but I'm no lawyer. Jeff Clark, the floor is yours, sir. Sure. Thanks, Steve, for having me on. Look,
00:17:58.640this is my line of country because when I was at OMB most recently, one of the things I was in
00:18:04.720charge of were things called SORNs, the system of record notifications. And that's what the
00:18:13.500Privacy Act generates. So, and that's one of the basis for the plaintiff's arguments here to try
00:18:18.180to stop the Trump executive order of sharing across agencies, especially social security and
00:18:25.380DHS immigration status information. So this is right in the heart of things I've done in the
00:18:30.920administration quite recently. Look, this is an easy decision by the Supreme Court, which is
00:18:36.140one reason why they did it as a procurium. It means that they're all unified, that they thought
00:18:42.200that this was quite simple. And I think Justice Ketanji Brown-Jackson's responses are quite weak
00:18:49.820to the Norm Eisen point and the point that Ketanji Brown-Jackson emphasized about the so-called 90-day
00:18:57.600moratorium that the states can't do about anything about this once you're inside 90 days.
00:19:02.900That's blown up for the same reasons that their arguments under the Privacy Act and under the
00:19:08.700Social Security Act's confidentiality provision is blown up, which is that there's just a clear
00:19:13.480provision in an immigration statute, which I call IRERA, but some people call IRERA.
00:19:20.840Whatever you call it, it's very clear. And the Supreme Court agreed, let me just read you the
00:19:26.120provision. I think people will understand. Notwithstanding any other provision of federal,
00:19:31.340state, or local law, a federal, state, or local government entity or official may not prohibit
00:19:37.300or in any way restrict any government entity or official from sending to or receiving from
00:19:43.340the DHS information regarding the citizenship or immigration status, lawful or unlawful,
00:19:50.900of any individual. So, Steve, that is any law. That is not just the Privacy Act. It isn't a
00:19:59.020block on sharing this immigration status information. That's not just the Social
00:20:03.420Security Act. It's not a bar on sharing that information. That's any law. And that includes
00:20:08.140the National Voter Registration Act, which imposes this so-called 90-day moratorium. So
00:20:13.920they're out of luck. And I don't see, even though the Supreme Court kind of punts that question a
00:20:20.400little bit because they've taken it up. In another case called Mi Familia Vota, I also get a kick out
00:20:27.140of these pro-immigration organizations that have names in Spanish when we're United States where
00:20:34.040people speak English. But put that aside as a sort of footnote point. Look, I just don't think
00:20:40.440there's any legal argument here. And the only thing that Ketanji Brown Jackson can really come
00:20:46.140up with is twofold. One is to say that this allows information sharing, but it's not information
00:20:58.500sharing that's been imposed by the executive branch. It's just imposed by law. And that's
00:21:05.280silly for reasons the opinion deconstructs. It's obvious that Congress wanted this information to
00:21:14.820be shared, and for this statute to override all of the other ones. And the second argument is,
00:21:21.440well, you know, these databases, like the Social Security database,
00:21:25.820NumaDent, I think it's called, is not kept entirely up to date. So there might be some
00:21:31.940people who just got naturalized. And then what happens with them if they're on the list as still
00:21:37.080being an illegal alien? Well, they'd have to come in and prove that they actually are now citizens.
00:21:42.660And if they don't respond timely enough, then they may get barred from voting. And my response to that is tough. You know, that it's reasonable to expect people who want to vote if they have, you know, a transitional immigration status that's not been fully digested into the system to come forth and prove that and to prove that on a timely basis, Steve.
00:22:04.100clark what i love about you most is that you're you're absolutely brilliant but you have a way
00:22:10.040of explaining this makes it accessible to people let me just take one more stab at this um this
00:22:16.500huge fight we had over save america one of the key provisions and this is why people are so furious
00:22:22.160at the senate and one of the reasons i think these senators are having a tough time getting
00:22:26.860traction uh in these elections what's about this whole thing about purging making sure illegal
00:22:32.280aliens or, you know, the foreign nationals that are here, they're not eligible to vote,
00:22:37.880cannot vote, particularly when we see Mandami, you know, what, 42% of New York City are foreign0.97
00:22:43.700born. You know, he wins overwhelmingly. People are absolutely, this is one of their number one
00:22:48.720priorities. With the Supreme Court's decision, because right now on MSNBC, they're all sitting
00:22:54.740there with the long face saying, oh, this just shows you a right wing court. This is Thomas
00:22:58.800court. This is Alito driving this. However, you know, Mark Elias and Norm Eisen are sitting there
00:23:04.740going, as bad as it is, it doesn't make any difference now, you know, maybe later, but not
00:23:11.340now because they can't, they're specifically, you know, outlawed or specifically prohibited
00:23:17.820from doing these, from taking their computer programs, going through it and purging these
00:23:22.580rolls now because it's within 90 days and you've got this NVRA regulation that upholds that.
00:23:29.740Are you saying that that is not the fact that we actually can purge these voter rolls and do it
00:23:36.640right now for the 3 November election, sir? Yes. If I were a state, I would do that because I would
00:23:44.820say the 90-day moratorium doesn't apply. I'm relying on the IRERA provision. It's 8 U.S.C.
00:23:52.0001343. The Supreme Court actually provides arguments under subsection A, subsection B,
00:23:58.200subsection C. I just covered with you the simplest textual argument under subsection A.
00:24:04.220And I would say, you know, notwithstanding any source of law means notwithstanding any source
00:24:08.620of law. And the NVRA, if you're trying to rely on that, is any source of law. And it's been
00:24:13.700overridden. It's been blocked out. The Latin phrase for a notwithstanding clause like that,
00:24:18.680which has always been historically interpreted broadly, is non-obstante, Steve. Actually,
00:24:24.160recently I've become an expert in these non-obstante clauses. And I think the argument
00:24:28.920here under this particular non-obstante clause is a lock. What else does this, what is the
00:24:37.660implication? I mean, it looks like the Supreme Court, this one on the emergency docket, does
00:24:42.560Does that imply that they're very focused on this issue and we just need to get stuff in front of them?
00:24:53.820And one of the other points that Justice Jackson makes that I think is particularly weak is she characterizes them as relying, I'm sorry, on two IRERA provisions, subsection A and subsection B.
00:25:08.420But they also relied on subsection three.

00:32:36.220The provision that has all these non-obstante clauses in it is 8 U.S.C. 1373. And I know your
00:32:44.280viewers are canny enough. They might look that up. So I wanted to correct it. So, you know,
00:32:49.480the way this works under the executive order is that it's not really a cram down from the president.
00:32:56.840it's a situation where he's ordered the agencies to make the information available.
00:33:03.920And so, you know, the Supreme Court has now paved the way for that. So if you want to get the
00:33:10.400information from DHS that shows that particular voters are not here legally, and therefore they
00:33:15.780cannot vote, even if they're on your voter rolls, that information, that door is open. But I think,
00:33:21.680you know uh it's probably going to disproportionately have an effect of making it harder to have the
00:33:27.280democrats uh you know steal elections using illegals votes in red states than in blue
00:33:32.800states because you know it's not like adrian fontes in arizona is going to be all hepped up about
00:33:39.040uh trying to get this information even though it's lawfully available to them
00:33:44.160it's the reason we got of uh andy biggs and the team out there got to win cleta mitchell
00:33:48.240you've been working this beat for a while give us your assessment today and more importantly how do
00:33:54.820we take action on this thing they've given us a flashing green to go purge these voter rolls
00:34:00.200with 39 days left how do we do it well two things steve uh number one dhs has just been waiting
00:34:08.960for this injunction to be lifted this ridiculous lawless injunction that was originally issued
00:34:15.640by Judge Sparkle in Maryland, who, by the way, was a, she's from Trinidad and Tobago,
00:34:24.020and she was a lawyer in the Biden DOJ Civil Rights Division. And then they put her on the
00:34:29.400federal bench in Maryland. And she issued this ridiculous ruling a few months ago saying that
00:34:35.060DHS didn't have any authority to provide citizenship status information with regard to
00:34:42.520voter rolls. Well, she ignored and her decision didn't even include, and I think that's why the0.52
00:34:48.100government will ultimately prevail, that federal law requires DHS to confirm the citizenship status
00:34:55.580of any individual upon the request of any local, state, or federal agency. So DHS went out a few
00:35:02.700months ago and they acquired all of the publicly available voter rolls from every state, from every
00:35:08.960state. So they have been running until this order, this injunction. DHS has been running the voter
00:35:16.560rolls, the publicly available voter rolls. And that's how they have identified all these tens
00:35:21.540of thousands of non-citizens on the voter rolls of various states. They've just been waiting for
00:35:27.760the injunction to be lifted. And I presume that they will start tonight running the rest of the
00:35:32.960voter rolls of all the states and then making that available to the states to take action.
00:35:37.780And now one of the things, so even the blue states are going to get the information whether they want it or not.
00:35:43.620And I think and I hope that DHS will say they're not allowed to issue the list, but they're able to say, hey, California, you have X number of tens of thousands of noncitizens on your voter rolls.
00:35:55.000Now, how do we decide if we have a purged DHS list in the California loaded with foreign nationals that are not eligible to vote and illegal aliens, do we then go to court on the night of the election after the voting is being counted to say, hey, it's got to be the DHS list?
00:36:19.200well that that to be d to be determined but here's one of the other things that we can do
00:36:26.820in certain states let's take iowa for instance in iowa if a citizen files it look back up
00:36:35.400msnbc and those people are all saying well it can't nothing can be done because we're in the
00:36:39.880blackout period well that blackout period only applies to what the statute says is a systematic
00:36:47.000review and analysis of the voter rolls. That's not what this would be. This would not be some
00:36:54.520systematic review to try to deal with all the people who've moved and died. This would be a
00:37:01.120very targeted process. And it would also, there are states that have citizen challenge laws.
00:37:10.400Many states have that, where Iowa, for instance, can come in and these people have identified
00:37:16.020and if they can identify if they can get local uh county organization county election officials
00:37:22.860to just ask dhs run us the list it doesn't have to be at the state it could be at the county level
00:37:28.440citizens can have a big impact by going to their local county election offices who have the list
00:37:35.080they can get the data from dhs do it at the local level and citizens can demand that those names
00:37:41.320come off before the election. Now, that is an issue that is going to be decided by the Supreme
00:37:47.440Court this term, because, of course, the Ninth Circuit says you can't remove non-citizens during
00:37:55.080the blackout period. Other circuits have said, well, of course you can. They were never eligible
00:37:59.260in the first place. The Supreme Court is going to decide that. But in the meanwhile, most of the
00:38:05.000states want to follow the law. Most of the counties want to follow the law, not the big cities, but
00:38:10.780most of the counties. We can get a lot of this done now that the flow of information has been
00:38:16.360reopened. Does this take, does this take, you were the leader, you and Jenny Beth are trying
00:38:22.500to hammer through the Save America Act. And of course we were up with nights with you in the
00:38:26.440Senate. It didn't happen. Is this a big part of the Save America Act? Has the Supreme Court now
00:38:32.480given us a, explain that to the audience? Well, there are three parts of the Save America Act.
00:38:38.800one, to require proof of citizenship to register to vote, two, to require voter ID, and not just
00:38:47.200any old ID, not a utility bill, not a bank statement, but a proper government ID in order
00:38:54.700to vote, in order to cast a vote, whether you vote by mail or vote in person, you'd have to have
00:38:59.400an ID with a photo, et cetera. And the third component of the Save America Act was to require
00:39:06.380every jurisdiction to run its voter rolls against the same system at DHS. And what the left is upset
00:39:15.820about is that when President Trump came into office, secretaries of state around the country
00:39:21.560were asking DHS to make the system easier for them to use, to be able to have batch uploads of
00:39:29.320millions of records, because the states have millions of names on their voter rolls, and to
00:39:34.680get better data into the system, like the Social Security data, and into the system so as to better
00:39:41.520conform and confirm identity of those people who are in the data system. That's what the left is
00:39:47.740upset about. They don't want the system to work. They don't want states. States have been using it
00:39:53.260prior to President Trump's term. But the problem has been that it's been too clunky and not usable.
00:39:59.680He made it usable. That's what they're trying to stop. So it's a big part. This is a big part of the Save America Act.
00:40:08.360So do you anticipate that Secretary Mark Wayne Mullins and DHS are going to commence tonight to start to purge these voter rolls and go to these particularly blue states and say, hey, look, here's what reality is.
00:40:21.880Is that process going to start tonight and how long should it take?
00:40:24.540Well, remember, DHS doesn't have authority to do any removal.
00:40:30.200That is something that has to be done at the state and local level.
00:40:33.460But yes, DHS can start the process of identifying the non-citizens that are on the rolls.

00:51:24.340And so Obama sort of sulked for an hour and then eventually he had to climb to the back of the plane and go out that back tail.
00:51:31.560And so there are policy issues at play that are always going to be difficult, but at least we can rest assured that these two men get along.
