00:09:34.980 land trust like the nature conservancy have been pushing on landowners for a lot of years the

00:09:39.380 idea is how they sell it to the landowners is that if you enroll in a conservation easement

00:09:45.140 your then your land will never be developed and so landowners buy into this because they think oh

00:09:51.300 this means i can pass my land down i don't have to worry about it becoming subdivisions it can always

00:09:55.700 be in agriculture and that's what they're sold but the practicality of that of what really happens

00:10:01.700 with conservation easement is the development right is sold to the land trust they now own that asset

00:10:08.340 all the restrictions what you can and can't do on that land are now what the landowners have to live

00:10:14.740 with they're the ones that are told they can only have one house on the land uh they they can repair a

00:10:20.900 fence they can't build a new fence uh everything on the day that that conservation easement is signed

00:10:26.180 what's happening on that land that's the baseline that's what can continue and so you can do things

00:10:31.860 in the contract and write certain things in but you have to anticipate everything that you might want

00:10:36.980 to do on that land in perpetuity these conservation easements are signed in perpetuity meaning forever

00:10:43.460 so forever that land trust now owns the development rights which is arguably the most valuable part of

00:10:54.660 the billions how much they own in conservation easements worldwide so now that conservation easement

00:11:14.660 domain these people set these companies up does the landowner get paid get compensated either cash or

00:11:26.980 conservation easement the that development right that conservation easement can be enrolled in the

00:11:32.500 knack with or without the landowner's permission and it's going to be the land trust wow that is going to

00:11:40.020 reap the profits from that now a landowner can enroll in the knacks they can say hey i agree with this

00:11:46.420 concept i want to put my land in they can do that but um it's not it's going to be i think it's going to be

00:11:54.340 very difficult for a landowner to do that because what you have a knack has to be managed for its

00:12:00.100 sustainability so there there are only certain activities that now can be take place on the land

00:12:06.100 a knack is but if you get but hang on but if you get if you get cashed out if they give you cash or

00:12:10.820 they give you stock you've got to abide by it's like selling your company you've got to abide by

00:12:16.180 you know if you sell it somebody else owns it if you're still part of management you got to go along

00:12:20.740 with what the the guys put up the capital why is that any is is there a at the beginning of the

00:12:26.100 transaction you've got one you've got the easements or the eminent domain that's a whole different

00:12:30.580 deal with you just kind of come and take it and never really give you adequate compensation but i

00:12:35.540 imagine that's a pretty small percentage most of this has to be willing landowners throwing their

00:12:41.220 land in for some sort of compensation correct not necessarily no because what that's what's been

00:12:47.380 happening in our country for the past three years under the biden administration on the private

00:12:51.780 land in particular they have been selling the conservation programs to landowners so there's

00:12:55.860 a federal nexus on the land a lot of landowners are doing climate smart projects conservation easements

00:13:02.180 conservation conservation reserve programs on their land which is the federal government paying the

00:13:07.540 money to do these conservation practices that creates a federal nexus to the land and this is one of

00:13:13.220 the issues that senator ricketts uh raised in his letter signed with crapo and rich from idaho early

00:13:19.780 on in this back in october is are these lands that have these federal programs on it can they be enrolled

00:13:27.380 in a knack without the landowner's permission and of course sec hasn't responded to them that yet but when you

00:13:34.580 look at the definition that's the real danger here is landowners are going to be enrolled in this without

00:13:40.020 even knowing it without having a say in it and what happens once they do they no longer control their

00:13:46.420 land because this sec rule not only allows the enrollment of these assets into the knacks but then

00:13:53.940 it also gives management authority to the knacks over these lands so now translate that to our federal lands

00:14:02.420 so the rule very clearly says in exhibit three our national parks can be enrolled in these knacks

00:14:10.260 these natural asset companies and then it gives management authority to the natural asset companies over all the

00:14:17.380 assets held in the knack so now who is managing our federal lands and our parks

00:14:23.540 right but hang on a second let's yeah let's let's talk about if and i know this comment i just want to

00:14:32.580 make people were asking to go to the site frank and to make kind of make comments this is sec

00:14:38.180 how did the sec i mean this would have to be a massive federal law to allow the public lands

00:14:44.660 that are really essentially owned in kind of trust by the government for the american people

00:15:19.540 and go oh yeah we're going to get the sec to prove to sign up these companies and we're going to start

00:15:24.340 putting in uh glacier national park and yellowstone national park and some of these forests up in the

00:15:30.420 pacific northwest yeah we've argued that in our comments we have we've argued that we have the same

00:15:36.580 concerns but what what has happened is new york stock exchange which hold it margaret but are you saying

00:15:42.020 hang on hang on but are you saying i understand we're going to i understand your comment are you

00:15:45.860 saying actually the way this is structured right now that the biden regime can just once these once

00:15:51.940 the sec approves the the vessel or the structure of the financial part of this that they can then

00:15:58.180 without going to congress start start just putting in massive federal lands into these into these uh

00:16:43.380 they are prioritizing conservation as the priority use of the lands this is what this rule essentially

00:16:50.820 would do and in this new rule they are creating conservation leases so that an entity can go out and they can

00:16:58.260 uh secure a conservation lease on lands that today is being used for grazing mining oil and gas and

00:17:05.700 then once the conservation lease goes in that's all that can happen on that land and then that lease

00:17:10.980 can be enrolled in the nap but okay here's okay hang on here i realize you got the sec we're gonna give

00:17:17.460 comments the audience is only that you have this thing called the house of representatives the house

00:17:23.540 blm and all these guys come from an annual budget everything about those lands is kind of

00:17:28.100 micromanaged i mean congressmen in the west understand this in the inner mountain west and
