00:01:57.240 So this morning I wake up and I see a trend on X that Charlie Kirk's family has filed a notice of claim against the state of Utah,
00:02:05.400 also Utah Valley University Police Department, and more specifically, UVU Police Chief Jeffrey Long,
00:02:11.660 and former president of UVU, Astrid Tuminez,
00:02:15.540 and others that are presently, quote-unquote, presently unknown,
00:02:20.340 who were involved in the death of Charlie Kirk.
00:02:23.760 I don't know how they would be presently unknown, but okay, stick with me.
00:02:28.000 So to first explain to you why they would file a notice of a claim
00:02:32.140 rather than just filing a claim itself,
00:02:33.880 that's really just because of the law on the books.
00:02:36.420 It's a mandatory prerequisite for this kind of a lawsuit
00:02:39.340 that you first have to assert your intent to sue the government
00:02:43.540 so that the government has a chance to simply concede
00:02:46.920 and maybe settle it in the background,
00:02:49.020 thus not wasting any unnecessary state resources
00:02:51.540 with a prolonged legal process.

00:03:07.680 Because foremost, I have known since approximately last December that actually it was Charlie Kirk's parents who were encouraging Erica to file a wrongful death lawsuit against the state of Utah.

00:03:26.600 Now, I did not report on it because I tend to stay away from reporting on anything involving Charlie Kirk's parents because they're not public figures.
00:03:35.820 They never have aspired to be public figures. They did not usurp Charlie's very public position as the CEO and chairman of an organization that pulled in a quarter billion last year and therefore opened themselves up to fair criticism.
00:03:51.500 But now that fact is extremely relevant to present to the public that this was Charlie Kirk's parents who wanted Erica to do this.

00:04:30.040 which may have contributed to Charlie's death. Now, it was UVU themselves who commissioned
00:04:36.620 this independent review back in September of last year. I want you to check out this article,
00:04:42.120 jogging your memory here. It was published in the Associated Press on September 22nd, 2025,
00:04:48.640 Right. So this is 12 days after Charlie lost his life.
00:04:53.040 And it tells us in this article, Utah Valley University is launching an independent external review of the fatal shooting of prominent conservative activist Charlie Kirk on its campus earlier this month.
00:05:04.920 The university announced the move Monday in an effort to improve safety practices amid fallout over security lapses and the shattering of the serene image that the institution had cultivated.
00:05:15.640 Quote, we believe the findings of the comprehensive third party independent review of this targeted act of violence will offer valuable insights on how college campuses improve response and preparedness moving forward.
00:05:29.080 This is that was a quote from Astrid Munez, the school's president, said in an emailed statement, quote, we will integrate the findings into our efforts to strengthen and improve safety practices for UVU and all of Utah higher education, end quote.
00:05:43.860 Okay, so just 12 days after Charlie is hit, the university sought to examine all of those failures that were, by the way, immediately, and some failures which were eventually noted by the larger public.

00:06:04.320 I was told that its findings were going to be released on Friday.
00:06:07.960 I don't know if that's now going to be bumped.
00:06:10.540 And that the findings were actually going to be devastating to Turning Point USA, to their security apparatus, because obviously they would have been gathering communications.

00:07:08.020 this, right? A full year to pull this together and make it look, I don't know, like you might
00:07:13.220 have some reasonable claims. Now, remember, Charlie had a total of 12 security members that
00:07:20.280 he brought with him. 12 security members. That's massive for a college event. I've never seen this
00:07:25.580 in the history of me doing college campuses with Charlie, that 12 security people would have been
00:07:31.040 brought with him for a campus of this size, okay? And these are not police officers. These are
00:07:37.000 highly trained military, former Navy SEALs, former Marines, Army snipers, SWAT commanders
00:07:43.780 who worked for the highest levels of government. Actually, I'm going to show you this clip because

00:12:13.300 entitled UVU Charlie Kirk event.

00:12:17.400 they tell us that in 2025, Turning Point USA planned its largest ever campus tour.
00:12:26.880 Immediately caught my eye, just that opening right there, because they're careful not to give a
00:12:31.440 precise date. Now, you may remember that there was a young woman who back in September and October
00:12:39.520 and November of last year was making noise, telling the public that this event came together
00:12:45.500 too quickly. Someone who has toured and gave you examples that normally five months in advance,
00:12:51.660 they begin planning. And that's for a lot of reasons. I worked as a speaker of this organization.
00:12:57.960 I've never seen an event planned like this. This one came together in a couple of weeks.
00:13:02.240 I said the fact that they even got approval for this event is crazy. And usually there's a long
00:13:07.860 waiting list of all the universities who want to host Charlie, want to host Candace, want to host
00:13:12.140 for the campus tour, they make that request the semester ahead. And then we assess and look through
00:13:18.340 and see how many of these that we can hit. Remarkably, this one came together in weeks.
00:13:23.900 And I said, this is weird. This is wrong. This is not how it works because usually the administration
00:13:28.800 gives Turning Point USA a hard time. There's so many things they're going to say you need.
00:13:34.080 Insurances, ambulances, this, that, blah, blah, blah, blah. So they need that long runway to prep
00:13:39.840 for these events, but this one granted immediately. We don't know who filed for it. And suddenly in a
00:13:45.640 couple of weeks, they're going to be promoting this. Okay. Now, despite this, they assert that
00:13:51.400 they pulled together this event, but they want to let you know, and this feels again, rather
00:13:55.380 narcissistic because the whole reason that Charlie started Turning Point USA was because there were
00:14:00.340 not conservative ideas expressed on college campuses. And they knew that there was never a
00:14:04.920 warm welcome. There's never a warm welcome. You go to these events to share ideas that you don't
00:14:09.680 typically find on liberal campuses. Yet they write here, through advocacy by the local chapter of
00:14:18.280 Turning Point USA on UVU's campus, Utah Valley University had the distinct honor of being the
00:14:25.120 first stop on the fall tour. And that honor came against a well-known backdrop of risk.
00:14:32.840 we pulled together this event, we picked you, and you were given a distinct honor that we
00:14:40.540 picked you. That's just, that's a lot of hubris coming from this filing, okay? Now, then it comes
00:14:47.060 and they tell us what all these risks are. They're like, well, didn't you know that President Trump,
00:14:50.940 there was a rooftop sniper? You should have known and assessed that we were coming and that this
00:14:55.720 could be a possibility. Don't you know that Congresswoman Nancy Pelosi's husband was brutally
00:15:00.660 attacked in their California home. Once we announced and awarded you this distinct honor
00:15:06.920 to host me, us, you should have immediately gone, oh, my, this is this are Nancy Pelosi's
00:15:14.820 husband was in his trunks and somebody came into the house. OK. OK. Page four is where they begin
00:15:23.480 spelling out the negligence that they are claiming took place here. And we're going to go through
00:15:29.240 this point by point, because I'm amazed by it, okay? So point one is they say that UVU police
00:15:38.380 did not conduct a meaningful risk assessment, and UVU parties did not have a security briefing
00:15:45.140 where the risks associated with unsecured rooftops, which we're going to talk about more later,
00:15:51.340 which had been identified and communicated to Chief Long, could be communicated to other
00:15:55.800 officers. Oh, here's my question. You know, some of that expertise you were paying for?
00:16:01.880 Did Charlie's team request this security brief? Are they, is UVU required by law to have a written
00:16:07.900 security plan submitted? Okay. If so, why didn't Charlie's extensive security team note that it
00:16:15.080 had not been submitted? What is he paying you for? Clause two, and I think that this is among
00:16:22.520 the craziest clause of all.
00:16:23.740 They're all crazy, but the clause two is pretty crazy.
00:16:26.600 They then moved to blame UVU for granting their request, okay?
00:16:32.660 And to be clear, it was not a request, it was a demand.
00:16:34.620 It was a demand, I am told, that was made on August 25th, 2025, for Charlie to be in

00:16:43.920 On August 25th, 2025, I'm telling you this, this is not in the filing, they had a Microsoft

00:16:50.680 This was an events committee meeting on Turning Point's side.

00:16:57.680 And on that call, I am told Macy Crofts insisted that the event take place in the amphitheater.
00:17:05.260 So you have UVU on the call and they say, no, you shouldn't do it in the amphitheater

00:18:11.840 They're not even arguing the point. They're not arguing anything. They're not suggesting they
00:18:16.160 didn't request it they're saying you gave us what we wanted and that my friend is your fault

00:18:26.480 um now i made it clear that so they went into this knowing that there would be no traffic control
00:18:33.580 uh like i said i don't even know why you would even have a ticketed event at that point if
00:18:37.940 anyone can just freely walk up and if they're going to insist upon that and then later copped
00:18:44.340 the fact that Charlie notified his security team the night before that he was worried that he was
00:18:48.820 going to be killed. Why didn't they cancel this event? Also, why didn't Charlie's security,
00:18:56.200 as another matter of fact, even if you said he really wants to be outside, why didn't they show
00:19:00.760 up before 9 a.m. the morning of September 10th? Because that's when they showed up. That's when
00:19:06.180 they first hit the ground, was at 9 a.m. the morning of the event, a couple of hours before
00:19:12.040 Charlie arrived. Leading up to that moment, the police were mostly in communication with the TPUSA
00:19:19.200 club. OK, a little bit of back forth texting, which we're going to get to. But the TPUSA club
00:19:24.160 is managing everything until 9 a.m. that morning. All of that just feels very wrong to me.
00:19:28.460 And yet they're going to say that it's the university's fault. OK, moving on to paragraph
00:19:37.100 three, which is on page five. This is when they are going to complain that they were only provided
00:19:47.300 with 25 percent of UVU's police force. OK, so you can see it says assigning only six campus
00:19:54.500 police officers to an outdoor event with thousands of attendees despite requests for additional
00:19:59.960 officers. And they say that the UVU parties assigned only six police officers to the outdoor
00:20:05.920 tour event that ultimately attracted approximately 3,000 attendees. On information and belief,
00:20:13.140 Chief Jeff Long requested approval from then-UVU President Astrid Tuminez to allocate more than
00:20:20.140 six officers, which represented only 25% of the UVU police force, but this request was denied.
00:20:26.240 Now, I don't like to be out here doing math, okay? I don't like to, it's not my thing,
00:20:31.740 it's not my go-to, but I did some. And I think that when you do the math on this, what Astrid
00:20:38.640 Tuminez did was the right thing to deny the request, okay? Because if they were given
00:20:45.680 on a purely mathematical basis, they were oversupplied with police officers. Let me
00:20:51.340 walk you through that. They say there are 3,000 attendees at this event. The campus itself, UVU,
00:20:57.720 has a total of 50,000 students, okay?
00:21:02.300 And a grand total of just 24 UVU police officers
00:21:06.860 that are available to cover those 50,000 students, okay?
00:21:12.420 The job of the UVU police force
00:21:14.560 is to make sure the campus is covered,
00:21:17.200 to make sure the students are safe.
00:21:19.880 They do not suddenly become employees of Turning Point USA

00:23:05.960 They followed Charlie to the car and then did not get into the car for some reason. Certainly did
00:23:11.680 not seem like security was trying to have him treated by these first responders. And who were
00:23:18.440 they? They were UVU's state certified emergency medical services. They were right beside the car
00:23:24.420 with medical bags in hand and Charlie's team chose to get into the vehicle and to move on
00:23:30.700 rather than to have him treated and stabilized right there or to find a place that they felt
00:23:35.540 was safe to have him stabilized. That whether or not that was a good decision by the security
00:23:40.520 is something that's up for debate. But what is not up for debate is that first responders were
00:23:45.820 actually on the scene. The filing is correct, though, in that bottom part when it says
00:23:51.280 that Mr. Kirk was transported to Timpanogos Regional Hospital in a private vehicle,
00:23:57.340 not an ambulance. Okay. Yeah, there was no ambulance on standby. And I would like to know
00:24:03.720 why. I have been trying to figure out why. I am positively shocked by this because at every
00:24:09.480 single event that I have done with Turning Point USA, there was an ambulance on standby. We
00:24:13.860 typically walked past the ambulance in, you know, wherever the security pulled up, you would pass by
00:24:19.480 the ambulance because their security cars would be right next to the ambulance. And I also want
00:24:24.580 to tell you that TPUSA distributed the security protocols to speakers. So we were aware of what
00:24:30.800 the most local hospital was. The shortest distance hospital was located. Here's the address. Here's
00:24:37.000 the security protocols, ambulance on standby. They made us aware of that. Suddenly now they're saying,
00:24:42.280 well, UVU didn't do it. Like they're just totally rinsing their hands of something that I know
00:24:47.200 they've always done. Paragraph four, moving on to that, is more of you didn't tell us no, right?

00:24:59.340 let's take a look at that. Now they are citing, for instance, that the UVU parties could have
00:25:05.940 created and maintained a secure perimeter around the event by constructing physical barriers with
00:25:12.200 limited points of ingress and egress where the number of attendees could be controlled and where

00:45:31.240 Nobody was arrested. The body cam footage did not capture the accident, so there's no reason to hold
00:45:36.460 on to it. What took place was that Tyler Robinson spoke to an officer and was handed a report
00:45:41.540 number, incident report number. Both drivers were made to exchange the insurance. That's
00:45:46.140 very typical. There was no ambulance. There was no paramedics. Nobody was pretending to
00:45:50.900 be hurt. This was beyond routine. So I found myself going, who ordered the footage and
00:45:59.140 held on to it for three years? That is the question. When there is not a dispute, there
00:46:04.000 is not a dispute. This is not going into the court system. You're not saying this happens and I'm
00:46:08.260 disputing it. Tyler Robinson was completely unknown in 2022. He was just 19 years old.
00:46:13.980 This recording was recorded by an officer in the St. George Police Department. You should also know
00:46:19.060 that fact. And there would have been no need to request the footage. By the way, even if you do
00:46:24.820 request the footage, they won't just grant it to you automatically. You can say, I am requesting
