Summary

The judge has spoken again, and it's not as good for Blake Lively. She wants all of the sealed evidence unsealed, and her team is fighting hard to keep it that way. 00:00:37.360 It's time for Tim's.
00:00:39.340 So he was there the entire time and he didn't notice anything.
00:00:45.140 Yeah, we've lost some talk.
00:00:50.060 Hi and welcome to Flossom Talk.
00:00:51.620 I'm Tianshti Floor, journalist, Hollywood truth teller, and your voice of reason in a town built on delusion.
00:00:58.060 So the judge has spoken again.
00:01:01.500 It wasn't as I expected, but I guess this is kind of good.
00:01:06.960 It is all about the evidence that Justin Baldoni filed last week,
00:01:11.640 where he added 275 attachments to his motion for summary judgment,
00:01:16.620 and 183 of those attachments were sealed.
00:01:21.200 And Blake Lively has been fighting like crazy to keep it that way.
00:01:25.960 She does not want you to see that evidence.
00:01:29.380 And now Sony has entered as well, and they sent a letter to the judge as well,
00:01:33.700 saying, please, please, please don't show this to anyone yet.
00:01:37.260 We need to make a plan here.
00:01:39.000 So the judge has responded.
00:01:41.520 Let's get into that.
00:01:42.700 But also we have to talk about how Jenny Slate was so offended by that comment by Justin Baldoni
00:01:50.360 when he said that her leather pants looked sexy.
00:01:53.000 Remember that?
00:01:54.220 Now someone shared this podcast with me where Jenny Slate speaks very comfortable about her bush
00:02:02.260 and also about how she feels about having bleep with her husband when there is a dog present in the room.
00:02:11.820 And I think we should talk about how Hasan Minhaj, who played Jenny Slate's husband in It Ends With Us,
00:02:18.880 why is he not involved in any of this drama?
00:02:23.420 Why is he the only cast member who didn't feel the pressure to pick a side?
00:02:28.600 Also, the fight goes on about these signal messages.
00:02:32.280 I spoke about them a few times before.
00:02:34.480 These are the text messages that Blake believe contains all the information she needs to prove her case.
00:02:42.120 So if you follow this case, you know that Baldoni's team had been accused of using something called auto-delete,
00:02:49.340 which means that as soon as you read a message on Signal, it gets deleted.
00:02:53.060 And Blake thinks this is evidence-spoiltation, and she wants to sanction all the defendants,
00:02:59.280 eight people that were part of using Signal in general.
00:03:04.200 And now Baldoni's team has offered all the declarations from Baldoni and the Wayfair team
00:03:10.780 talking about the Signal messages, and it doesn't look good for Blake.
00:03:15.120 Anyway, let's talk about all this new evidence that Baldoni filed last week
00:03:20.280 that I've been so excited to dig my teeth into, and then, yeah, it's not there yet.
00:03:27.140 I'm so sorry to say that we do not have more of that evidence unsealed at this moment.
00:03:34.600 As I said, Blake's team have been so desperate to keep this sealed,
00:03:39.500 and they told the judge that we don't have time to look through all of this.
00:03:42.720 It's a lot. It's overwhelming.
00:03:44.300 And they wanted another two and a half weeks to go through everything.
00:03:50.000 Now the judge said, I don't want to go through one by one of all this evidence
00:03:54.800 to decide if it's going to get sealed, unsealed.
00:03:58.020 I'm going to give all parties the same deadline for trying to convince me to seal
00:04:02.960 or to continue to seal some of this evidence.
00:04:06.840 That date is now December 19th,
00:04:10.400 which is basically the day Blake Lively filed her CRD complaint.
00:04:15.440 So big anniversary for Blake Lively.
00:04:17.800 The judge is not doing that to protect Blake in any way.
00:04:21.200 He's just doing it to avoid more mess.
00:04:24.820 What this means, though, is that we probably won't see a lot of that evidence being unsealed
00:04:31.500 until probably early or mid-January.
00:04:34.500 But everything will be unsealed.
00:04:37.640 The only reason why some parts maybe will be for attorneys' eyes only
00:04:42.460 is if it is some industry secret or something like that.
00:04:46.420 But everything that's related to this case will be open to the public.
00:04:52.640 The judge made it crystal clear that he wants the public to have access to all this evidence
00:04:57.720 before he makes any decision of the motion for summary judgment.
00:05:03.920 As much as I want the judge to just toss this out,
00:05:07.700 I really kind of hope that there will be a trial
00:05:11.380 because I feel like that is the best way for all these people to get vindicated.
00:05:17.400 And I think for Baldoni and for everyone to sit there on the stand
00:05:21.020 and tell their side of the story.
00:05:22.880 And selfishly enough, I really hope that's going to happen.
00:05:25.540 As I said, Sony just filed a letter to the judge asking the judge
00:05:30.340 to delay unsealing the portion of evidence that they're involved in.
00:05:36.060 So they're saying that Wayfarer just filed 26 documents
00:05:40.100 and 34 pages of Sony depositions in their summary judgment motion.
00:05:46.200 And some of the material is marked AEO, attorneys' eyes only.
00:05:50.880 And Sony says that, oh, we didn't know all of this was going to be filed
00:05:53.760 and we tried to reach out to Wayfarer.
00:05:55.880 They didn't respond to us.
00:05:57.360 Now, judge, please give up some more time here.
00:06:00.060 And I find it a little weird that they didn't know all of this was going to be filed
00:06:03.100 when they did actually sit down for depositions.
00:06:05.700 What were they thinking that we're going to use the depositions for?
00:06:08.320 So they know that they're important witnesses here.
00:06:11.400 But of course, they're freaking out about all this information coming out.
00:06:14.620 As we know from Justin's filings, Sony has been very involved here.
00:06:18.820 They know a lot of what's going on, the power struggle between Blake and Justin.
00:06:25.080 And they were just trying to keep the peace between them.
00:06:28.600 But we've only seen the evidence from Baldoni's side of his communication with Sony.
00:06:33.700 We haven't seen Blake's communication with Sony.
00:06:36.660 And that's what I think is going to be really interesting.
00:06:38.900 Because as we know from Justin's filings, Sony didn't really want to pick a side here.
00:06:43.380 But they felt a lot of pressure from Blake.
00:06:47.200 And they communicated that to Baldoni.
00:06:50.520 And we also have to remember, Sony had a representative present during that meeting
00:06:57.060 at Blake and Ryan's penthouse when Ryan was yelling at Justin for five or six hours straight
00:07:03.880 because he said that his wife felt fat shamed by him.
00:07:08.100 And she felt uncomfortable with things that he did on the set.
00:07:11.660 So Sony was there.
00:07:13.600 They were present at that meeting.
00:07:15.600 So I'm really curious to find out exactly what Ryan said to Justin.
00:07:21.380 Because we will find out.
00:07:23.420 We also don't know the story behind Tony Vincikira, the CEO of Sony,
00:07:29.700 who came out publicly and supported Blake after the premiere.
00:07:35.240 He said to Hollywood Reporter at the time,
00:07:37.960 Blake's passion and commitment to advancing the conversation around DV is commendable.
00:07:45.640 We love working with Blake and we want to do 12 more movies with her.
00:07:50.980 He has since retired, by the way.
00:07:53.280 But this is what he said to the press at the time.
00:07:56.740 Who knows what was behind that statement?
00:08:00.260 If he did this voluntarily or if someone maybe asked him to do that.
00:08:05.940 We will find that out too.
00:08:07.640 In a Hollywood Reporter article that was published in February this year,
00:08:11.880 they went to all the details of Sony's involvement.
00:08:17.140 And one of the things that they said is that what no one knew at the time was that Sony had,
00:08:23.100 for months, been playing the unintended role of mediator in what has erupted into the biggest uncivil war in recent Hollywood history.
00:08:33.160 And it says here that Vincikira's statement is just one of the numerous examples all along the way
00:08:38.540 where Sony seemingly attempted to support and appease Lively,
00:08:44.040 even as Baldoni's grip on the movie slowly but surely fell apart.
00:08:48.560 Sony, which declined to comment for this story,
00:08:52.600 appeared to have little choices but to make Lively its priority,
00:08:57.060 since she was vital to the film's marketing and release,
00:09:00.300 and Sony was aware of a possible troubled set.
00:09:03.780 So as we learned, Blake refused to promote the movie,
00:09:07.500 unless she got all the power, basically, and she used Sony.
00:09:12.600 She used Sony to pressure the Wayfair parties.
00:09:15.800 That is the route that she went, and she said to Sony that I can't speak to Wayfair parties about this
00:09:21.100 because I don't speak to them, and you have to make them do these things for me.
00:09:26.140 And also something we will hopefully find out is what happened during this phone call.
00:09:31.720 As I say here on May 26, 2023,
00:09:35.400 Blake made a phone call to then-executive Angie Giannetti
00:09:40.000 and said that she was concerned about unwelcoming and inappropriate behavior
00:09:46.240 by Baldoni and the Wayfair CEO Jamie Heath on the sets.
00:09:50.980 Then Giannetti said to Blake,
00:09:52.740 you have to go to HR at the Wayfair to complain about things.
00:09:56.980 And Blake said, you know, they don't listen to me over there.
00:10:00.100 You have to take care of this.
00:10:01.980 Baldoni's team, on the other hand,
00:10:03.420 explains what happened in this conversation differently.
00:10:06.440 And someone here says, a source close to the matter actually,
00:10:10.840 says that Lively did not call Sony to complain about behavior on the set.
00:10:16.140 She called to complain about COVID protocols on the set.
00:10:22.000 She was worried about getting COVID.
00:10:23.740 As I'm sure Andrew Giannetti has been deposed already
00:10:27.240 and had to explain what that conversation was about.
00:10:31.520 Sony also pressured the Wayfair parties to sign that list of 17 demands.
00:10:37.040 And one of the demands in those 17 points
00:10:39.580 was that Sony agreed to send their representative,
00:10:42.860 Angie Giannetti, to the set
00:10:44.880 and to hire an A-list veteran producer
00:10:48.180 to aid Lively and represent the studio.
00:10:51.580 So Sony was there.
00:10:53.180 But as we know, Blake said that after that list was signed
00:10:57.040 and they came back to filming, she had no issues.
00:10:59.720 Also, Sony was, of course, informed and very involved
00:11:04.080 in the editing that Blake Lively took over for the movie
00:11:07.980 and her demands to hire her own editor.
00:11:11.660 And as we know, she reached out to Shane Reed,
00:11:14.160 who worked with Ryan Reynolds on Deadpool and Wolverine.
00:11:18.200 And she demanded that he would take over her cut of the movie.
00:11:21.800 And we also know that Blake's cut of the movie
00:11:24.700 had a lower score than Justin Baldoni's cut of the movie.
00:11:28.700 But still, Sony went for Blake's version of the film.
00:11:34.020 And I think that itself is so telling of how much power Blake had over Sony.
00:11:39.520 And the reason for that is one thing or one person.
00:11:43.680 And that is Ryan Reynolds.
00:11:45.240 Because Lively would never have gotten away with this kind of behavior
00:11:48.460 if she wasn't married to Ryan.
00:11:50.400 So bottom line here is Sony allowed all of this to happen.
00:11:53.680 They allowed Blake to get away with anything that she wanted.
00:11:56.540 And they publicly supported her.
00:11:59.500 And that's why I think this is going to be so interesting
00:12:02.420 to see all this evidence come out.
00:12:05.440 To see what Sony said behind Justin Baldoni's back.
00:12:09.040 And we also know that Sony really wanted Taylor Swift's song in the trailer.
00:12:13.860 And the only way to make that happen was to keep Blake happy.
00:12:18.720 So yeah, it's going to be very, very interesting
00:12:21.180 when all this explosive evidence is being unsealed
00:12:25.140 and we got to see what really went on behind the scenes.
00:12:29.120 But before we get into that explosive podcast with Jenny Slate,
00:12:32.820 I wanted to thank the two sponsors of this video,
00:12:36.260 Cornbread Hemp and Rula.
00:12:38.700 So when life gets a little bit crazy,
00:12:41.260 I love to have something help me unwind at night.

00:12:51.140 For me, CDB has become part of an evening ritual
00:12:54.140 when I feel stressed.
00:12:56.560 And that happens a lot.
00:12:58.220 So when my brain is racing,
00:13:00.100 trying to figure out what is going on
00:13:01.960 in all this crazy legal drama,
00:13:03.780 and I sit here and shoot all day,
00:13:05.820 and I edit,
00:13:06.880 and I'm trying to come up with new ideas,

00:15:44.520 Okay, so back to this Jenny Slate podcast.
00:15:47.280 Thank you so much, Mary-Kate, for pointing this out.
00:15:49.780 I find this so telling because, as you know,
00:15:52.860 Jenny Slate was so upset and so offended
00:15:54.680 when Justin Baldoni made a comment
00:15:57.200 about her black leather pants in the movie
00:16:01.040 or in a scene she was about to shoot
00:16:03.300 for It Ends With Us.
00:16:04.680 Now this podcast shows a side of Jenny Slate
00:16:08.100 that really proves that she is not a type
00:16:12.680 that would get offended by something like this.
00:16:15.200 That doesn't make any sense to me.
00:16:17.040 When you hear what she's talking about here
00:16:18.900 with one other woman and two men present,
00:16:21.920 she starts talking about how she likes
00:16:23.640 to style her private area.
00:16:25.720 I used to get, you know, major bikini wax
00:16:28.900 and now I'm like, no, that's not where I'm at.
00:16:31.020 You know, like I'm full bush in the front.
00:16:33.680 But I will say, one of my delights
00:16:36.180 is getting my ass crack waxed.
00:16:39.660 I love how it feels.
00:16:40.900 I love how it feels to have such a smooth butt crack.
00:16:44.940 Yeah, it feels so good.
00:16:46.280 Oh, you mean after, not like the actual experience of waxing.
00:16:47.580 But when it's happening, I'm just like-
00:16:49.380 Here it comes.
00:16:50.140 Whee!
00:16:50.820 Like there is something about it that I'm like-
00:16:52.560 It doesn't hurt.
00:16:52.840 Yeah, does that sound like a woman
00:16:54.580 that would get really offended and shocked
00:16:57.400 when someone calls your pants sexy?
00:17:00.300 I just find that really, really hard to believe.
00:17:04.780 Also, the conversation continued between these people
00:17:08.360 when they started talking about having blip in a room
00:17:12.320 when there is a dog present.
00:17:14.600 And Jenny Slate willingly offered her experiences
00:17:18.200 that she has with her husband
00:17:19.980 when there is a dog present.
00:17:22.780 Is anyone here upset with their dog in the room?
00:17:25.180 No.
00:17:26.240 Sometimes I don't have a choice.
00:17:27.840 There's nothing you can do.
00:17:29.120 Yeah.
00:17:29.740 And they're scratching at the door.
00:17:31.060 I know, that's the thing.
00:17:32.260 You close the door and it ruins it every time.
00:17:34.660 And that's-
00:17:35.020 I just don't think about it.
00:17:36.360 Yeah.
00:17:37.660 Yeah, I try to sneak it in when she's out.
00:17:39.600 When I'm in the zone, I'm in the zone.
00:17:42.680 Yeah.
00:17:42.880 What's going?
00:17:44.420 You know, when you go.
00:17:46.420 Finish complete.
00:17:47.680 Oh, when the train arrives at the station.
00:17:49.460 Yeah.
00:17:49.820 When you go.
00:17:50.760 When you go.
00:17:51.140 The story juice?
00:17:52.260 Yeah.
00:17:53.020 Yeah.
00:17:53.160 Does that sound like a woman to you
00:17:54.540 that would get really offended
00:17:56.080 by someone saying that their pants look sexy?
00:17:59.280 I just find that so hard to believe.
00:18:02.640 Yeah, it's the hypocrisy that really gets me in this case
00:18:05.500 that I find so frustrating.
00:18:07.660 And I wonder what really went on behind the scenes
00:18:10.800 of what Blake and Jenny Slate were discussing.
00:18:14.220 I would love to see her deposition as well
00:18:17.280 as we will get to see, thankfully,
00:18:19.960 so we know what really happened here.
00:18:21.920 Because the way they've been trying to portray Justin
00:18:24.600 as being a creep on the set,
00:18:26.020 it really doesn't make any sense.
00:18:29.440 And if that's really the most revealing evidence
00:18:31.860 that Jenny Slate has from Justin Baldoni on the set,
00:18:35.580 that just says it all.
00:18:37.140 As we know, which brings me to the next thing here,
00:18:41.020 is that Hasan Minhaj,
00:18:43.680 who played Jenny Slate's husband in the movie,
00:18:47.580 he never took sides.
00:18:49.040 And why is that?
00:18:51.740 Is it that Blake and Ryan didn't promise him anything?
00:18:54.900 If he took sides?
00:18:57.460 Or is it that he's a decent human being?
00:19:00.440 Or is it that he was actually telling the truth?
00:19:03.720 And he said, you know,
00:19:04.860 I don't have anything to add here
00:19:06.540 because I didn't see anything.
00:19:08.420 And that's exactly what he said in this interview
00:19:11.040 in People Magazine a while back.
00:19:13.200 He said, everybody was lovely.
00:19:16.980 I can't speak to other people's experiences,
00:19:19.600 but everybody was very professional and cool to me.
00:19:23.080 It was lovely and everybody was lovely.
00:19:26.140 And it is just as disillusioning for me
00:19:29.200 because I'm like, what happened?
00:19:31.280 Wait, what's going on?
00:19:33.780 Keep in mind that Hasan was actually in that bar scene.
00:19:38.740 You can see him standing very close to Justin and Jenny Slate
00:19:43.080 as in this scene,
00:19:44.680 they revealed that Jenny Slate was having a baby.
00:19:47.720 So he was there the entire time
00:19:50.700 and he didn't notice anything.
00:19:54.040 And this is the moment
00:19:55.640 that Blake Lively's team is pointing to
00:19:58.480 that there've been something
00:19:59.720 that got all the media to pick up
00:20:01.640 that I spoke about yesterday as well,
00:20:03.500 that in that moment,
00:20:05.600 Justin Baldoni was joking about missing SH training
00:20:09.220 and which I explained many times,
00:20:11.580 no one could hear what he was actually saying there.
00:20:14.000 And in Blake's own legal document,
00:20:16.600 she said that he actually said
00:20:18.280 that he missed the HR meeting,
00:20:21.500 which is very different than the SH training.
00:20:25.200 But that's what they decided to call the press.
00:20:27.280 As I said yesterday,
00:20:28.140 they want Justin to be associated with SH.
00:20:32.040 And that's why they told the press,
00:20:33.560 we know what he said in that moment.
00:20:35.340 And then when we hopefully,
00:20:37.260 at one point we'll hear the audio clearer,
00:20:39.820 which I think someone said the other day,
00:20:41.520 that Justin Baldoni is going to release the audio for that
00:20:45.480 because they were mic'd
00:20:46.720 so we can hear what he's actually saying.
00:20:48.980 So then we get to know if he joked
00:20:50.720 about missing the HR meeting,
00:20:53.180 which of course was really offensive
00:20:54.900 to everyone that was standing there,
00:20:56.600 except for Hassan,
00:20:57.580 who was standing in the middle of it
00:20:58.860 and didn't notice anything.
00:21:00.720 It's funny how all these Blake Lively supporters,
00:21:03.260 I saw Daily Mail did a story on it the other day,
00:21:06.620 and they said that people on Reddit were fuming
00:21:09.600 and saying that everyone on that set
00:21:12.260 was really upset and flustered
00:21:14.900 by the thing that was going on.
00:21:16.920 And then you're looking at the videotape
00:21:19.100 and you're like, no, no one's upset here.
00:21:21.100 And I think also Hassan is proof of that
00:21:23.840 because he said that everybody was lovely.
00:21:28.080 So this article that is from September of 2024
00:21:30.900 says that a source at the time told them
00:21:33.960 that all is not what it seems,
00:21:35.980 there's so much more to this story.
00:21:37.620 The principal cast and author Colin Hoover
00:21:40.260 will have nothing to do with Baldoni.
00:21:42.860 And remember what Brendan Sklenor said
00:21:45.060 at the time after Blake Lively had filed her lawsuit?
00:21:49.020 He said, vilifying the women
00:21:51.080 who put so much of their heart and soul
00:21:53.220 into making this film
00:21:54.180 because they believe so strongly in its message.
00:21:57.540 That's really funny looking back.
00:21:59.740 Seems counterproductive
00:22:01.300 and detracts from that what the film is about.
00:22:04.560 It is in fact the opposite of that point.
00:22:07.660 He wrote.
00:22:08.600 So he said that Blake Lively did such a great job
00:22:11.480 in pointing out what this movie is really about,
00:22:14.040 which was for her selling hair products and booze.
00:22:18.120 So yeah, as I said, I think it's really interesting
00:22:20.040 that Hassan actually came out and said,
00:22:22.560 it was so lovely.
00:22:23.460 I didn't notice anything.
00:22:24.940 Because if the set was as terrible
00:22:26.720 as Blake described it to be
00:22:28.780 and as Jenny Slate described it to be,
00:22:31.120 then why didn't he notice anything?
00:22:33.380 All right, you guys, that's it for me today.
00:22:35.240 I hope you enjoyed this episode
00:22:36.600 and I hope you're going to have a lovely weekend.
00:22:39.500 And hopefully we will know more next week about everything.
00:22:42.920 I feel there's new filings every day.
00:22:44.660 And even though we're not going to see
00:22:46.920 most of that evidence that was sealed
00:22:49.260 being unsealed until probably January next year,
00:22:53.180 we will continue to see more juicy stuff coming out.
00:22:56.500 I'm 100% certain of that.
00:22:58.100 So please stay tuned.
