00:01:15.680 real New York sports.
00:01:17.640 Hello, everybody.
00:01:25.440 Welcome back to the Gains for Girls podcast.
00:01:28.260 I have been waiting to talk about the news
00:01:30.560 that we are going to talk about today.
00:01:32.920 I posted some about it on social media,
00:01:35.000 but it was a really, really big deal
00:01:37.520 and foundational to this fight
00:01:39.880 that I personally have been fighting the past three years,
00:01:42.860 some much longer than me.
00:01:44.140 The guest that we have today has been right there alongside me
00:01:48.140 from the very, very beginning.
00:01:49.980 So excited to get into this news.
00:01:51.580 But before we do,
00:01:52.620 I want to tell you about today's sponsor.
00:01:54.980 It is Cozy Earth.
00:01:56.700 You've heard me talk about them before.
00:01:58.680 They're incredible.
00:01:59.700 I am so excited, truthfully,
00:02:01.900 to be now.
00:02:02.900 I'm 30 weeks pregnant, which is wild.
00:02:05.500 So that means travel is starting to slow down.
00:02:08.520 If you follow along,
00:02:10.080 I mean, I'm like here, there, everywhere,
00:02:11.880 all the time, sleeping in hotels.
00:02:13.420 But now I get to be home so much more,
00:02:16.580 which is just the best thing ever
00:02:17.840 because I get to sleep in my own bed.
00:02:19.640 And I have the best sheets on the entire planet
00:02:23.720 because they are Cozy Earth viscose sheets.
00:02:27.780 They're made from bamboo, from viscose.
00:02:30.600 They naturally wick away heat.
00:02:32.340 They naturally wick away any sort of moisture.
00:02:35.000 I sleep so, so incredibly great.
00:02:38.640 So you can check them out at CozyEarth.com.
00:02:41.500 You can use my code GAINS for 40% off.
00:02:44.080 They have a 100-night trial.
00:02:46.420 So if you don't like them,
00:02:47.300 which, take my word for it, you will.
00:02:49.660 You can return them.
00:02:50.900 I think there's a 10-year warranty.
00:02:52.620 You're not going to need that.
00:02:54.500 Also, so sweet,
00:02:55.680 they have Cozy Earth crib sheets
00:02:58.960 for the little baby girl.
00:03:01.020 So they sent some of those my way.
00:03:02.940 Again, so soft.
00:03:04.360 I have their pajamas.
00:03:06.060 Actually, I wish you could see.
00:03:07.240 We're filming this very early in the morning.
00:03:08.920 So I wish you could see my pajama pants right now
00:03:13.960 that I am wearing from Cozy Earth.
00:03:15.880 So again, CozyEarth.com,
00:03:17.160 code GAINS for 40% off.
00:03:20.620 We're talking about the news today
00:03:22.880 that came out as University of Pennsylvania.
00:03:26.620 Again, this has been one of the worst actors,
00:03:29.880 the ones that have allowed for Will Thomas,
00:03:33.080 Leah Thomas,
00:03:33.640 his participation on the women's team,
00:03:36.200 ultimately sparking this cultural revolution.
00:03:40.400 Maybe we should thank University of Pennsylvania.
00:03:42.120 I don't know for how they have lit a fire
00:03:44.900 underneath myself and, again, so many others.
00:03:48.680 But we're talking to Marshy Smith.
00:03:50.160 She's been on the show before.
00:03:51.220 She is a national champion
00:03:53.040 in the women's 200-yard backstroke in 2005.
00:03:57.380 So she's, of course, been very established
00:03:59.280 in her own athletic career.
00:04:00.820 Got involved in this fight after seeing the injustice
00:04:03.540 of what University of Pennsylvania,
00:04:05.560 the NCAA, the Ivy League,
00:04:08.240 other institutions allowed for.
00:04:10.700 Co-founded an organization called ICONS,
00:04:13.560 which stands for
00:04:14.420 International Council on Women's Sports.
00:04:18.600 They have been fantastic.
00:04:21.080 I think the most
00:04:21.980 really pivotal thing that they've been able to do
00:04:26.120 is put these lawsuits forward,
00:04:28.560 whether that's in terms of funding,
00:04:30.740 whether that's in terms of structure,
00:04:32.620 whatever it is.
00:04:33.960 One of the big ones that they have put forward
00:04:36.020 over the past year,
00:04:37.300 actually a little over a year at this point,
00:04:38.880 we filed back in March,
00:04:40.100 is the Gaines versus NCAA lawsuit.
00:04:44.800 Super fun, by the way,
00:04:46.280 to sue someone with such deep pockets.
00:04:49.380 But nonetheless,
00:04:50.240 I imagine we will be victorious
00:04:51.640 in this endeavor.
00:04:52.920 It's myself and 19 other plaintiffs,
00:04:57.660 19 other women,
00:04:58.700 female athletes who have been impacted
00:05:00.420 at the hands of the NCAA,
00:05:02.740 their discriminatory,
00:05:03.780 regressive, harmful policies.
00:05:06.180 So pushing forward there.
00:05:07.800 So keep watching to hear about the UPenn news,
00:05:10.600 our reaction to it,
00:05:11.640 to hear about how this news affects
00:05:13.560 the Gaines versus NCAA lawsuit.
00:05:16.500 Recent SCOTUS announcement,
00:05:18.560 they will be hearing a Title IX case,
00:05:20.100 and how you, as an everyday American,
00:05:23.180 maybe you're a mom,
00:05:24.060 maybe you're a dad,
00:05:25.160 maybe you're a female athlete yourself
00:05:26.560 watching this,
00:05:27.420 how you can get involved in this fight.
00:05:29.780 Check it out here,
00:05:30.720 this interview with Marshy Smith.
00:05:32.940 Well, Marshy,
00:05:33.860 thank you for joining
00:05:34.660 the Gaines for Girls podcast.
00:05:37.180 It is great to see you again.
00:05:38.980 I saw you not long ago
00:05:40.320 at the White House
00:05:41.100 surrounding all of this UPenn news
00:05:43.120 that we're going to get into.
00:05:44.200 But before we do that,
00:05:45.800 do you mind just telling us,
00:05:47.220 number one,
00:05:47.480 a little bit about yourself,
00:05:48.460 telling us about ICONS,
00:05:50.960 what it stands for,
00:05:52.020 and what you guys do?
00:05:54.400 Absolutely.
00:05:55.060 Thank you so much for having me again.
00:05:58.780 Yes, my name is Marshy Smith.
00:06:00.880 I am the co-founder
00:06:02.540 of the Independent Council on Women's Sports.
00:06:06.340 We are a network of female athletes,
00:06:11.140 their families, coaches, and supporters.
00:06:14.100 We have tens of thousands of members,
00:06:18.240 such as yourself,
00:06:19.540 who are passionate about protecting women's sports.
00:06:24.000 We advocate in a lot of different ways,
00:06:27.280 including media, social media,
00:06:30.660 but probably most profoundly
00:06:33.360 as legal advocates
00:06:36.040 defending female athletes
00:06:38.360 who want to fight back in court,
00:06:40.780 just like yourself
00:06:42.540 in the Gaines versus NCAA case.
00:06:45.060 We have three lawsuits pending right now
00:06:48.900 where our legal counsel
00:06:50.200 are representing
00:06:52.280 almost two dozen
00:06:54.640 or over two dozen female athletes
00:06:56.660 in collegiate sports
00:06:58.620 against organizations
00:07:00.300 that have discriminated against them,
00:07:03.000 like the NCAA.
00:07:03.840 Well, you left out the part
00:07:07.760 where I said to explain yourself
00:07:09.360 a little bit about you personally,
00:07:11.500 which is very humble
00:07:12.520 and it speaks a lot about you,
00:07:14.000 but you yourself
00:07:14.860 are a national champion swimmer
00:07:17.260 from the University of Arizona.
00:07:18.740 So all that you've been able
00:07:19.760 to accomplish in your sport
00:07:21.040 and certainly beyond
00:07:22.220 working with the other co-founder
00:07:23.940 of Icons, Kim Jones,
00:07:25.180 who's also been on this show before,
00:07:27.300 you guys are just a force
00:07:29.000 to be reckoned with.
00:07:30.300 I have learned so much
00:07:31.800 from both of you
00:07:32.980 in terms of messaging,
00:07:34.660 how to talk about these issues,
00:07:35.980 how to communicate effectively.
00:07:38.940 So just incredibly
00:07:40.260 and eternally grateful
00:07:41.680 for both of you
00:07:43.140 and what you've been able to do,
00:07:44.360 especially on the legal front,
00:07:46.580 which leads me to, of course,
00:07:48.200 as I mentioned,
00:07:49.040 I saw you just a few weeks ago
00:07:51.220 at the White House
00:07:52.060 surrounding this news
00:07:53.800 that we had come out
00:07:54.640 of the Department of Education
00:07:55.700 about the University of Pennsylvania.
00:07:58.620 They were willing to sign
00:07:59.740 this resolution agreement.
00:08:01.860 Can you talk about
00:08:03.160 what this is,
00:08:04.080 what they agreed to,
00:08:05.360 and what this means
00:08:06.240 for women
00:08:07.280 and for the future
00:08:07.960 of women's sports?
00:08:10.580 First of all,
00:08:11.800 I was talking to Kim
00:08:14.400 and some of our
00:08:15.140 female athlete advocates
00:08:18.060 recently about the experience
00:08:20.460 and the general feeling
00:08:22.940 of being there
00:08:23.960 at the White House
00:08:24.800 with you
00:08:25.300 and so many of our friends
00:08:26.680 who we have forged relationships
00:08:28.920 over the last several years,
00:08:31.840 unfortunately,
00:08:32.660 under bad circumstances.
00:08:34.720 You know,
00:08:34.960 typically when we're
00:08:35.820 getting together,
00:08:36.860 we're protesting something
00:08:39.020 or demanding something.
00:08:41.720 And I felt like,
00:08:42.900 finally,
00:08:43.340 this is the first event
00:08:45.360 where we could go
00:08:46.960 and really celebrate
00:08:48.800 some good news.
00:08:51.700 So that was incredible
00:08:55.000 to be invited
00:08:55.820 to the White House
00:08:56.580 to be a part of that.
00:08:58.380 Secretary McMahon,
00:08:59.760 the Department of Education
00:09:00.980 have been just laser focused
00:09:03.420 on doing everything they can
00:09:05.940 really in a short amount of time
00:09:08.180 to keep women's sports female.
00:09:11.120 I have my short shirt on here.
00:09:13.600 And they're doing an incredible job.
00:09:16.480 And their announcement that day
00:09:19.420 was surrounding
00:09:20.300 the University of Pennsylvania.
00:09:23.380 Having brought them to the table,
00:09:26.640 I think in part
00:09:28.960 due to a couple different reasons,
00:09:31.400 it was not out of the goodness
00:09:33.400 of University of Pennsylvania's heart.
00:09:36.520 Of course,
00:09:37.620 they are the school
00:09:40.440 that had Leah Thomas compete
00:09:42.760 on their women's swim team
00:09:44.640 a few years ago.
00:09:46.480 won an NCAA women's title.
00:09:49.620 You were there.
00:09:51.260 Tied you in the 200 freestyle.
00:09:54.560 Really have been
00:09:56.140 a stick in the mud
00:09:57.600 in terms of taking
00:09:58.920 any sort of accountability
00:10:00.660 or doing anything
00:10:03.820 to suggest that their university
00:10:05.900 would protect women
00:10:06.980 moving forward.
00:10:08.420 And so recently,
00:10:10.800 we have helped
00:10:12.940 three Penn swimmers
00:10:14.980 sue the university,
00:10:17.380 Ivy League,
00:10:18.120 and NCAA
00:10:19.220 to try and hold them accountable
00:10:22.240 for what they've done.
00:10:23.760 And the Department of Education
00:10:25.240 took it 10 steps further
00:10:27.720 and launched an investigation
00:10:30.640 against the school
00:10:32.200 as well as,
00:10:34.080 you know,
00:10:35.320 in finding that they did violate
00:10:37.360 Title IX at the time
00:10:39.120 and continue to do so,
00:10:40.700 held their feet to the fire
00:10:42.840 with $175 million
00:10:45.940 in federal funding
00:10:47.560 and said,
00:10:49.060 you know,
00:10:49.480 you need to rectify
00:10:51.220 some of the harms
00:10:53.320 that have been done
00:10:54.960 and
00:10:55.680 really uphold the rights
00:10:59.140 of your female athletes
00:11:00.440 at your school.
00:11:01.340 And so part of this resolution
00:11:03.820 is
00:11:04.700 giving back
00:11:06.520 the records
00:11:07.200 on the University
00:11:08.600 of Pennsylvania books,
00:11:10.280 not beyond the school,
00:11:12.420 but just their own
00:11:13.560 record books,
00:11:15.180 erasing Leah Thomas'
00:11:17.280 name from the women's side,
00:11:19.300 as well as promising
00:11:20.520 to
00:11:21.200 not have men
00:11:23.200 participate on teams
00:11:24.780 moving forward
00:11:25.780 and issue
00:11:27.020 apologies
00:11:27.720 to
00:11:28.460 all the female
00:11:29.720 athletes
00:11:30.440 affected.
00:11:32.280 I don't,
00:11:33.280 I know that they've
00:11:34.080 sent letters
00:11:34.740 to the
00:11:35.960 swimmers
00:11:36.820 on their own team.
00:11:38.280 I don't know
00:11:38.680 if you've received
00:11:39.540 the letter,
00:11:40.140 we haven't talked
00:11:40.740 about this,
00:11:41.560 or any of the
00:11:42.560 opponents of Penn
00:11:44.140 during that season.
00:11:45.560 Sounds like
00:11:46.300 they haven't received
00:11:47.580 any apology,
00:11:50.120 but,
00:11:50.820 you know,
00:11:51.300 when,
00:11:51.620 when actually
00:11:52.800 reading line
00:11:53.640 for line
00:11:54.240 what they said,
00:11:55.500 it was disappointing.
00:11:57.480 It wasn't a true
00:11:59.200 apology
00:12:00.480 to the swimmers
00:12:01.640 at all
00:12:02.540 to the standards
00:12:03.360 that they
00:12:04.020 deserve,
00:12:05.420 which is
00:12:06.300 one of the reasons
00:12:07.160 why
00:12:07.640 we are,
00:12:08.760 you know,
00:12:09.760 proceeding
00:12:10.280 with this lawsuit
00:12:11.880 that
00:12:12.380 actually
00:12:13.300 three Penn
00:12:15.120 swimmers
00:12:15.620 are going to be
00:12:17.340 at their first hearing
00:12:18.660 in Boston,
00:12:19.620 Massachusetts
00:12:20.240 against the
00:12:21.580 university
00:12:22.060 in just one week
00:12:23.220 on the 21st.
00:12:25.560 Fantastic.
00:12:27.040 So,
00:12:27.300 it continues,
00:12:28.520 the fight continues,
00:12:30.360 but the Department
00:12:31.520 of Education
00:12:32.240 has done
00:12:33.160 really a wonderful job,
00:12:35.140 and it was a day
00:12:35.920 of celebration
00:12:36.640 for sure
00:12:37.220 at the White House.
00:12:38.540 Yeah,
00:12:39.140 it's important
00:12:39.580 you mention,
00:12:40.500 like you said,
00:12:41.260 like the Trump
00:12:42.220 administration
00:12:42.640 has only been
00:12:43.740 in full effect
00:12:44.620 for what,
00:12:45.180 I mean,
00:12:45.480 six months now.
00:12:47.680 The wins
00:12:48.500 that we have seen,
00:12:49.400 especially on the
00:12:50.160 cultural front lines,
00:12:51.600 they've been
00:12:52.700 pretty monumental
00:12:53.520 in just a short
00:12:55.240 amount of time,
00:12:56.200 and I think
00:12:56.700 especially
00:12:57.100 any time
00:12:57.780 you're dealing
00:12:58.220 with the legalities
00:12:59.360 of things,
00:13:00.440 what I have learned
00:13:01.420 certainly from
00:13:02.060 the Gaines
00:13:02.460 versus NCAA
00:13:03.140 lawsuit,
00:13:03.940 it's a long
00:13:04.740 drawn-out process,
00:13:05.820 so fantastic
00:13:06.820 first steps,
00:13:08.280 but I mean,
00:13:08.740 is this really
00:13:09.760 adequate?
00:13:10.720 Is an apology,
00:13:12.480 is that enough
00:13:13.220 to right the wrongs
00:13:14.540 of the university?
00:13:15.520 And again,
00:13:16.260 this is,
00:13:16.860 what I want people
00:13:17.700 to realize is
00:13:18.620 this is one
00:13:19.720 of the biggest
00:13:20.420 perpetrators
00:13:21.200 in the abuse,
00:13:23.200 in the mistreatment,
00:13:24.340 in the emotional
00:13:25.280 blackmail of women.
00:13:27.040 They've come to the table,
00:13:28.420 as we've discussed,
00:13:29.820 they've issued
00:13:30.500 this half-hearted apology
00:13:32.160 on their record board.
00:13:33.820 They've already
00:13:34.360 removed his names.
00:13:35.180 I think he's still
00:13:35.820 a part of the relays,
00:13:36.820 which I would be
00:13:37.340 interested to see
00:13:38.300 how they're going
00:13:39.400 to treat that.
00:13:40.080 I think they've left
00:13:40.900 those relay records
00:13:41.800 still up there,
00:13:42.940 but on all the PDF documents
00:13:45.320 and online,
00:13:46.540 they still have
00:13:47.180 the asterisk
00:13:47.820 at the bottom saying,
00:13:49.200 you know,
00:13:49.420 worth noting
00:13:50.000 that Leah Thomas
00:13:51.000 competed in the 2021-2022
00:13:53.260 school year
00:13:54.520 and previously
00:13:55.300 held the records
00:13:56.180 in this,
00:13:56.680 this,
00:13:56.900 and this.
00:13:57.300 So,
00:13:58.100 is what the University
00:13:59.180 of Pennsylvania,
00:14:00.600 is what they've done
00:14:01.460 truly enough
00:14:02.260 to right their wrongs?
00:14:05.160 Unequivocally,
00:14:05.840 no.
00:14:06.740 I think it's easy
00:14:08.360 and what the NCAA
00:14:09.660 and these universities
00:14:11.400 want to do
00:14:12.520 is to say,
00:14:14.340 okay,
00:14:14.600 we've done
00:14:15.060 the absolute
00:14:15.660 bare minimum
00:14:16.340 of what you've
00:14:17.160 asked of us
00:14:17.940 and so you can
00:14:19.840 forget everything
00:14:20.740 that's been done
00:14:21.720 in the past.
00:14:22.680 I mean,
00:14:23.260 this is something
00:14:24.220 your experience
00:14:26.260 at one meet
00:14:27.720 has changed
00:14:29.100 the trajectory
00:14:29.820 of your entire life.
00:14:32.480 There are so many women
00:14:34.520 who have been
00:14:35.940 voiceless
00:14:36.540 across collegiate sports
00:14:38.700 that have been
00:14:40.440 suffering
00:14:40.960 and continue
00:14:41.800 to suffer
00:14:42.660 over what has
00:14:44.420 been done
00:14:45.940 to them
00:14:46.880 with a green light
00:14:49.780 from the NCAA
00:14:50.960 and their schools.
00:14:52.900 And so,
00:14:53.400 for Penn
00:14:53.940 to think
00:14:54.620 that,
00:14:55.440 oh,
00:14:56.040 we can just
00:14:56.560 sweep this
00:14:57.280 under the carpet
00:14:58.120 now,
00:14:58.960 we've erased
00:14:59.840 a few places
00:15:00.920 on the record board
00:15:01.960 where his name
00:15:02.700 was listed,
00:15:04.400 no harm,
00:15:05.080 no foul.
00:15:06.360 Absolutely not.
00:15:08.960 Women's rights
00:15:10.180 were denied.
00:15:12.060 Your right
00:15:12.720 to privacy
00:15:13.640 in the locker rooms,
00:15:15.260 fair competition,
00:15:16.620 an equal opportunity
00:15:17.680 to perform,
00:15:19.440 all of these things
00:15:21.260 were done
00:15:22.640 and accountability
00:15:25.320 needs to be
00:15:27.140 had
00:15:28.180 by not just
00:15:29.160 yourself,
00:15:29.840 but so many women
00:15:31.120 across the country
00:15:32.060 and so
00:15:33.200 they absolutely
00:15:34.180 need to do more.
00:15:36.000 Ivy League records
00:15:36.880 still exist
00:15:37.620 on the boards,
00:15:38.560 Harvard records,
00:15:40.340 Akron University
00:15:41.320 still has his name
00:15:42.520 on the record boards
00:15:43.520 and there are
00:15:44.720 many other sports
00:15:45.840 affected
00:15:46.340 and many other
00:15:47.360 schools
00:15:48.060 aside from
00:15:49.260 just Leah Thomas
00:15:50.520 over the past
00:15:52.180 few years
00:15:52.760 that need to
00:15:53.380 be rectified
00:15:54.060 as well.
00:15:55.580 So to be
00:15:55.940 very,
00:15:56.440 very clear,
00:15:57.360 the NCAA
00:15:57.940 still recognizes
00:15:59.460 Leah Thomas
00:16:00.780 as the national
00:16:02.300 champion
00:16:02.800 in the women's
00:16:03.820 500 freestyle.
00:16:05.980 Correct.
00:16:06.980 I have seen
00:16:07.720 headlines since
00:16:08.660 the Penn announcement
00:16:09.560 that his titles
00:16:10.800 and records
00:16:11.660 have been wiped.
00:16:13.300 That is not true.
00:16:15.380 The university's
00:16:17.100 record board
00:16:18.120 has been
00:16:19.260 rectified,
00:16:20.000 it looks like,
00:16:20.540 in individual
00:16:21.320 events,
00:16:23.200 but records
00:16:24.860 across the country
00:16:25.760 still stand
00:16:26.740 and his
00:16:29.340 titles
00:16:29.820 need to be
00:16:31.460 pulled back
00:16:32.300 and really
00:16:32.860 the only person,
00:16:33.920 the only org
00:16:34.580 that can do that
00:16:35.420 is the NCAA
00:16:36.320 itself
00:16:36.980 and that's
00:16:38.020 why you
00:16:38.960 and the many
00:16:40.420 female athletes
00:16:41.440 suing the NCAA
00:16:42.580 are trying
00:16:44.280 to get that
00:16:45.980 to happen
00:16:46.620 in court.
00:16:47.400 got it.
00:16:49.540 One of the
00:16:50.140 biggest pieces
00:16:50.760 of pushback
00:16:52.080 that I get
00:16:53.200 and certainly
00:16:53.820 that I have
00:16:54.440 received over
00:16:55.120 the past few
00:16:55.700 weeks following
00:16:56.760 this announcement
00:16:57.500 is people
00:16:58.760 from the other
00:16:59.800 side who agree
00:17:00.820 with the fact
00:17:01.540 or the assertion
00:17:02.540 that men should
00:17:03.100 be able to
00:17:03.640 compete in
00:17:04.060 women's sports.
00:17:04.940 They'll come to
00:17:05.660 my page and
00:17:06.260 they'll comment
00:17:06.740 something to the
00:17:07.780 effect of
00:17:08.320 congratulations,
00:17:09.680 you went from
00:17:10.160 fifth place to
00:17:10.900 fifth place.
00:17:12.060 Obviously,
00:17:12.820 Thomas and I,
00:17:13.420 when we competed
00:17:14.060 at that
00:17:14.820 national
00:17:15.140 championship
00:17:15.660 we tied
00:17:16.180 for fifth.
00:17:17.840 Granted,
00:17:18.360 what I think
00:17:18.880 a lot of
00:17:19.180 these people
00:17:19.480 don't realize
00:17:20.100 is number
00:17:20.500 one,
00:17:20.740 this is
00:17:20.980 fifth in
00:17:21.460 the country.
00:17:22.660 Number two,
00:17:23.380 I didn't go
00:17:23.840 my best time.
00:17:24.540 This wasn't
00:17:24.880 my best
00:17:25.220 performance.
00:17:25.800 I wasn't
00:17:26.100 on my A game.
00:17:26.940 Truthfully,
00:17:27.300 I think a lot
00:17:27.780 of that,
00:17:28.640 of course,
00:17:29.200 I mean,
00:17:29.480 swimming,
00:17:30.040 any sport,
00:17:30.580 there's a
00:17:30.820 huge physical
00:17:31.560 component to it,
00:17:32.460 but there's a
00:17:32.800 big mental
00:17:33.220 component to it
00:17:34.080 too.
00:17:35.040 I mean,
00:17:35.420 I think we
00:17:35.800 were kind of
00:17:36.180 just all over
00:17:36.660 the place.
00:17:37.100 Regardless,
00:17:38.060 we tied
00:17:38.400 for fifth.
00:17:39.120 So I'll have
00:17:39.740 people coming
00:17:40.200 to my page
00:17:40.960 saying,
00:17:41.340 you know,
00:17:41.840 you got
00:17:42.200 fifth place.
00:17:43.420 Can you
00:17:43.700 help me
00:17:44.180 eloquently
00:17:44.920 say that
00:17:46.920 this does
00:17:47.640 not matter?
00:17:48.740 Like,
00:17:48.940 they're kind
00:17:49.200 of proving
00:17:49.600 my point.
00:17:50.500 The point
00:17:51.000 we've all
00:17:51.380 been trying
00:17:51.700 to make,
00:17:52.020 it doesn't
00:17:52.380 matter what
00:17:52.880 place you
00:17:53.400 get.
00:17:54.580 The argument
00:17:55.440 here is,
00:17:56.140 do women
00:17:56.480 deserve equal
00:17:57.140 opportunity or
00:17:57.880 do they not?
00:17:58.900 So it sounds
00:17:59.460 like when you
00:17:59.920 have people
00:18:00.340 like Keith
00:18:00.780 Olbermann who
00:18:01.700 come to my
00:18:02.240 page to say
00:18:02.820 this,
00:18:03.100 it's like,
00:18:03.800 okay,
00:18:04.000 do you only
00:18:04.540 believe the
00:18:05.160 best women
00:18:05.960 deserve fair
00:18:07.140 competition or
00:18:08.440 do they not
00:18:09.120 too?
00:18:09.360 Like,
00:18:09.660 what is the
00:18:10.080 argument that
00:18:10.660 you're trying
00:18:11.000 to make
00:18:11.360 here?
00:18:11.700 Can you
00:18:11.960 help me
00:18:12.560 eloquently
00:18:13.020 put into
00:18:14.200 words that
00:18:14.880 it doesn't
00:18:15.460 matter what
00:18:16.160 place women
00:18:17.360 get,
00:18:17.880 they shouldn't
00:18:18.360 have to
00:18:18.660 compete against
00:18:19.180 men at
00:18:19.720 all?
00:18:21.980 I cannot
00:18:23.580 say anything
00:18:24.440 more eloquently
00:18:25.240 than you,
00:18:26.580 Riley,
00:18:27.040 but that
00:18:28.560 really just
00:18:29.680 absolutely
00:18:30.600 infuriates
00:18:32.440 me because
00:18:34.260 even the
00:18:37.160 least
00:18:38.900 talented,
00:18:39.560 least skilled
00:18:41.000 girl or
00:18:42.740 woman on
00:18:43.840 their women's
00:18:44.720 team deserves
00:18:46.200 that chance
00:18:48.000 to play.
00:18:49.880 So whether
00:18:51.240 or not a
00:18:52.180 male athlete
00:18:52.840 wins first
00:18:54.240 place or
00:18:55.440 just kicks
00:18:56.560 the very last
00:18:57.580 qualifier out
00:18:58.840 of the
00:18:59.140 competition,
00:18:59.760 it does not
00:19:01.400 matter.
00:19:02.500 Her spot
00:19:03.760 matters.
00:19:05.900 So when
00:19:06.740 I see,
00:19:07.740 you know,
00:19:08.780 champion
00:19:09.280 athletes like
00:19:11.180 Simone Biles
00:19:12.120 or Megan
00:19:13.660 Rapinoe
00:19:14.960 talk about,
00:19:15.920 well, I
00:19:16.220 wouldn't care
00:19:16.920 if a male
00:19:17.940 athlete was
00:19:18.860 competing with
00:19:19.720 me or it's
00:19:20.680 totally fine
00:19:21.440 with me.
00:19:22.640 You know,
00:19:23.500 these are some
00:19:24.520 of the highest,
00:19:25.720 most decorated
00:19:26.460 athletes in
00:19:27.240 their sport.
00:19:28.400 And so what I
00:19:29.080 want to ask
00:19:29.860 them is who
00:19:31.360 on your team,
00:19:32.440 who was the
00:19:33.580 least talented
00:19:34.540 player on
00:19:35.340 your team?
00:19:36.680 Would you
00:19:37.140 give up her
00:19:38.000 spot?
00:19:39.140 Can you
00:19:39.660 hand over
00:19:40.540 her position
00:19:41.820 and her
00:19:42.660 opportunity to
00:19:44.180 play?
00:19:44.720 Are you
00:19:45.080 willing to
00:19:45.600 do that?
00:19:46.220 Because that's
00:19:46.880 what we're
00:19:47.260 really asking.
00:19:49.140 And so
00:19:49.840 regardless of
00:19:51.080 a champion
00:19:51.940 in the 500
00:19:52.820 free, or I
00:19:53.900 think he got
00:19:54.440 eighth place
00:19:55.240 in the 100
00:19:56.400 free at the
00:19:57.180 NCAA, top
00:19:58.820 eight in
00:19:59.540 swimming at
00:20:00.580 the NCAA
00:20:01.860 championship
00:20:02.800 level is an
00:20:03.760 all-American
00:20:04.700 swimmer, top
00:20:06.360 eight swimmer
00:20:07.240 in the country
00:20:08.160 at the
00:20:08.740 fastest short
00:20:10.920 course swim
00:20:12.460 meet in the
00:20:13.320 world.
00:20:14.300 That is a
00:20:15.500 huge accomplishment.
00:20:17.280 To even be
00:20:18.360 there is amazing.
00:20:19.860 And Leah
00:20:20.340 Thomas denied
00:20:21.360 several women
00:20:22.420 that opportunity
00:20:23.240 in three events.
00:20:24.420 And that just
00:20:25.440 absolutely cannot
00:20:26.300 happen again.
00:20:26.980 Thank you.
00:20:30.580 It's such a
00:20:31.320 good point you
00:20:31.840 make in hearing
00:20:32.400 it kind of
00:20:32.840 framed like
00:20:33.440 that.
00:20:34.040 People like
00:20:35.000 Simone Biles
00:20:36.320 or Megan Rapinoe,
00:20:37.540 they don't get
00:20:37.920 to consent on
00:20:39.020 behalf of all
00:20:39.940 women, whether
00:20:41.140 that is on the
00:20:42.520 athletic field, any
00:20:43.820 athletic setting, or
00:20:44.700 whether that's in
00:20:45.200 the locker room.
00:20:45.780 I hear a lot of
00:20:46.320 women who say,
00:20:47.260 well, I don't
00:20:47.700 care if a man is
00:20:49.300 using my
00:20:49.760 restroom.
00:20:50.300 Well, guess
00:20:50.580 what?
00:20:51.220 You don't get
00:20:51.740 to consent on
00:20:52.880 behalf of all
00:20:53.940 women.
00:20:54.460 What a crazy,
00:20:55.860 narcissistic,
00:20:57.000 selfish thing to
00:20:57.840 think is that you
00:20:58.960 believe you get
00:21:00.120 to.
00:21:01.120 Absolutely not.
00:21:02.820 How do the
00:21:03.660 recent decisions
00:21:04.520 from the
00:21:05.680 University of
00:21:06.180 Pennsylvania,
00:21:07.160 again, this
00:21:07.600 resolution agreement
00:21:08.360 that was signed,
00:21:09.460 does that have
00:21:10.060 any effect on
00:21:11.100 the Gaines
00:21:11.540 versus NCAA
00:21:12.320 lawsuit?
00:21:13.080 Like, is any
00:21:13.960 precedent being
00:21:14.720 set for other
00:21:15.640 institutions,
00:21:16.740 whether it be
00:21:17.200 the NCAA,
00:21:18.460 whether it be
00:21:18.900 the IOC,
00:21:19.740 whether it be,
00:21:20.760 of course,
00:21:21.760 these your
00:21:22.620 usual bad
00:21:23.340 actors, people
00:21:24.060 like Gavin
00:21:24.620 Newsom, Governor
00:21:25.260 Mills in Maine,
00:21:26.460 does that set
00:21:27.000 any sort of
00:21:27.720 precedent in
00:21:28.580 terms of,
00:21:29.320 I guess,
00:21:30.740 the legal
00:21:31.380 world here?
00:21:33.700 I think it
00:21:34.860 signals to
00:21:35.700 other schools,
00:21:36.940 we better not
00:21:37.840 try this.
00:21:39.200 Definitely.
00:21:39.980 I think it's
00:21:41.380 generally good
00:21:43.300 because, again,
00:21:45.420 the most prolific
00:21:46.320 offender of
00:21:47.160 Title IX in
00:21:48.660 collegiate sports
00:21:49.560 has bent the
00:21:50.980 knee to some
00:21:51.820 respect.
00:21:52.980 But like we
00:21:53.900 talked about,
00:21:54.880 it's definitely
00:21:55.700 not enough.
00:21:56.740 And one of
00:21:57.920 the reasons
00:21:58.380 why, you
00:21:59.740 know, you're
00:22:00.300 fighting in
00:22:00.940 court,
00:22:02.080 Brooks Lusser
00:22:03.460 and female
00:22:04.400 athletes in
00:22:05.180 the West
00:22:05.560 Coast and
00:22:06.200 volleyball are
00:22:07.120 fighting in
00:22:07.820 court against
00:22:08.540 the Mountain
00:22:08.920 West Conference.
00:22:10.720 Penn girls are
00:22:11.520 fighting their
00:22:12.740 university in
00:22:13.520 the Ivy League
00:22:14.300 on the East
00:22:14.960 Coast.
00:22:15.380 the reason
00:22:16.620 these cases
00:22:17.860 must proceed
00:22:19.300 is because we
00:22:20.940 really need
00:22:21.520 long-standing
00:22:22.440 legal precedents
00:22:24.360 set to tell
00:22:26.380 every university
00:22:27.480 across the
00:22:28.120 country, you
00:22:29.100 absolutely cannot
00:22:30.200 violate Title IX
00:22:31.420 and discriminate
00:22:32.120 against women
00:22:33.040 regardless of
00:22:34.640 who's in the
00:22:35.440 Oval Office.
00:22:36.080 I feel really
00:22:38.760 secure for the
00:22:40.640 next three
00:22:41.800 years or so,
00:22:42.840 but we don't
00:22:43.440 know who's
00:22:44.020 coming next.
00:22:45.660 And for the
00:22:46.320 NCAA to,
00:22:48.060 you know,
00:22:48.560 say we're
00:22:49.320 going to
00:22:49.780 comply with
00:22:50.860 this executive
00:22:51.880 order, for
00:22:53.180 Penn to say
00:22:54.020 we're going to
00:22:54.740 bend the knee
00:22:55.320 because of
00:22:56.040 this administration,
00:22:58.300 that's good
00:22:59.580 for the short
00:23:00.320 term, but we
00:23:01.960 need legal
00:23:02.820 wins to
00:23:04.080 hold these
00:23:04.900 universities
00:23:05.560 to the
00:23:06.360 fire to
00:23:07.080 account moving
00:23:08.520 forward, red
00:23:10.000 states, blue
00:23:10.960 states, regardless
00:23:12.460 for the future
00:23:13.300 because you're
00:23:14.440 going to have a
00:23:14.960 daughter soon who
00:23:16.060 I anticipate will
00:23:17.820 be an incredible
00:23:18.580 athlete.
00:23:19.880 I have a
00:23:20.800 daughter who's
00:23:21.560 just starting
00:23:22.420 sports right
00:23:23.180 now, and so
00:23:24.500 that's really who
00:23:25.380 we fight for.
00:23:26.580 You know, our
00:23:27.080 careers are over,
00:23:28.400 but the reason
00:23:29.860 we spend every
00:23:30.920 day talking
00:23:31.720 about this and
00:23:32.520 fighting for this
00:23:33.380 is for the next
00:23:34.660 generation of
00:23:35.560 girls.
00:23:37.740 Where do
00:23:38.420 things stand
00:23:39.040 right now with
00:23:39.560 the Gaines
00:23:39.920 versus NCAA
00:23:41.260 lawsuit?
00:23:42.460 And can you
00:23:42.860 explain, you
00:23:43.600 already have a
00:23:44.300 little bit, but
00:23:44.860 just how
00:23:46.980 crucial this
00:23:48.060 step is in
00:23:49.220 the fight to
00:23:49.660 protect women
00:23:50.220 and girls, in
00:23:51.340 sports and
00:23:51.840 beyond for that
00:23:52.500 matter?
00:23:54.140 Sure.
00:23:55.060 So the
00:23:56.960 Gaines versus
00:23:57.600 NCAA case was
00:23:58.920 filed last
00:24:00.240 March, so it's
00:24:01.500 already been over
00:24:02.380 a year, and
00:24:03.980 the legal
00:24:06.440 counsel and
00:24:07.160 the NCAA have
00:24:08.240 been going
00:24:09.360 back and
00:24:10.120 forth on
00:24:10.900 different
00:24:12.000 briefs and
00:24:13.340 things because
00:24:14.780 the NCAA is
00:24:16.760 still trying to
00:24:18.480 dismiss the
00:24:19.180 case.
00:24:20.180 So that's the
00:24:21.000 point where
00:24:21.760 we're approaching
00:24:23.460 the point where
00:24:24.780 the judge can
00:24:26.300 say, in all
00:24:27.100 three of these
00:24:27.680 cases, actually,
00:24:28.600 we're going to
00:24:30.100 dismiss, or
00:24:31.160 yes, there's
00:24:31.920 merit to
00:24:32.440 bring the
00:24:32.820 case, let's
00:24:33.520 have discovery,
00:24:34.540 let's see
00:24:35.320 what kind of
00:24:38.420 documents and
00:24:39.540 communications
00:24:40.360 have transpired
00:24:41.680 in the course
00:24:42.800 of that
00:24:43.380 season, and
00:24:45.580 move forward
00:24:46.380 to proceed
00:24:47.140 with the
00:24:48.040 actual case.
00:24:49.980 We are
00:24:50.340 confident in
00:24:51.120 all three that
00:24:51.860 that will
00:24:52.420 happen and
00:24:53.480 that all
00:24:54.120 three judges
00:24:54.800 will agree,
00:24:56.640 yes, there
00:24:57.960 is merit, we
00:24:58.760 need to
00:24:59.280 hear the
00:24:59.780 full case.
00:25:02.220 Recently, there's
00:25:03.720 been some
00:25:05.040 questions from
00:25:06.240 the judge,
00:25:06.860 posed from
00:25:07.420 the judge, in
00:25:09.200 the Gaines
00:25:09.640 versus NCAA
00:25:10.560 case about
00:25:12.360 hasn't the
00:25:14.420 policy changed,
00:25:16.740 rectified the
00:25:18.540 rules moving
00:25:19.500 forward?
00:25:20.540 Haven't they
00:25:21.200 already changed
00:25:22.200 the policy to
00:25:23.060 say men are
00:25:24.680 no longer
00:25:25.240 welcome on
00:25:25.860 women's teams?
00:25:26.680 that is
00:25:28.120 another myth
00:25:29.120 that has
00:25:30.820 been circulating
00:25:33.000 in the
00:25:33.920 public.
00:25:34.740 I think the
00:25:35.680 NCAA's
00:25:36.640 announcement of
00:25:37.580 the policy
00:25:38.100 change bars
00:25:39.380 men from
00:25:41.160 women's
00:25:41.900 competitions.
00:25:43.840 We did see
00:25:45.200 that Ithaca
00:25:45.920 College had
00:25:47.200 a male rower
00:25:48.060 participate
00:25:48.980 after the
00:25:49.860 policy change
00:25:50.860 that slipped
00:25:52.020 through the
00:25:52.420 cracks because
00:25:53.340 there is no
00:25:54.840 mechanism to
00:25:56.360 screen male
00:25:58.480 athletes in
00:25:59.380 women's sports
00:26:00.160 yet.
00:26:00.600 They said we're
00:26:01.620 not going to
00:26:02.080 allow this in
00:26:02.720 competition.
00:26:03.940 However, how
00:26:05.200 do they tell
00:26:06.260 other than
00:26:07.720 relying on a
00:26:08.700 changeable birth
00:26:09.620 certificate who
00:26:11.260 is male and
00:26:12.280 female?
00:26:13.020 That's one of
00:26:14.280 our arguments at
00:26:15.220 ICONS is we
00:26:17.100 really need to
00:26:17.880 have a
00:26:18.960 screening process
00:26:19.940 that ensures
00:26:21.780 that female
00:26:22.960 athletes are
00:26:23.720 not participating
00:26:25.200 on teams.
00:26:27.100 But beyond
00:26:27.840 just competition,
00:26:29.700 women's sports
00:26:30.560 teams in
00:26:31.120 college encompass
00:26:32.880 so much more.
00:26:33.940 The training,
00:26:35.420 the locker
00:26:36.460 rooms,
00:26:37.940 awards,
00:26:39.800 scholarships,
00:26:41.080 all of these
00:26:41.860 benefits are
00:26:43.100 still,
00:26:44.580 men are still
00:26:46.180 given access to
00:26:47.160 these things.
00:26:47.600 and we're
00:26:48.000 seeing them
00:26:48.620 across the
00:26:49.160 country.
00:26:50.000 In just the
00:26:50.600 past few
00:26:51.400 weeks,
00:26:52.340 we've been
00:26:52.980 approached by
00:26:53.760 a few
00:26:54.580 different teams
00:26:55.820 who have
00:26:56.960 experienced men
00:26:58.140 on their
00:26:58.700 Division III
00:26:59.560 women's teams
00:27:01.000 who are in
00:27:02.780 the locker
00:27:03.200 rooms who
00:27:03.960 are still
00:27:04.700 racking up
00:27:05.540 women's awards
00:27:06.480 but, you
00:27:07.540 know,
00:27:07.680 maybe racing
00:27:08.600 unattached on
00:27:10.060 the women's
00:27:10.680 teams.
00:27:11.860 Loopholes like
00:27:12.600 that, that
00:27:13.140 schools are
00:27:13.980 still,
00:27:14.760 you know,
00:27:17.480 kind of
00:27:17.880 barreling
00:27:19.180 through with
00:27:19.720 their ideology.
00:27:21.240 So, we
00:27:21.880 need, we
00:27:22.600 need protections
00:27:23.400 beyond what
00:27:24.680 the NCAA
00:27:25.320 policy that
00:27:27.160 stands
00:27:27.960 protects.
00:27:30.120 So,
00:27:30.900 we're hoping
00:27:32.280 with these
00:27:32.880 cases that,
00:27:33.980 again, there's
00:27:34.560 long-standing
00:27:35.300 legal precedence
00:27:36.700 that, that
00:27:37.700 Title IX is
00:27:38.520 clear, that
00:27:39.240 it's for
00:27:39.960 female athletes
00:27:40.860 only, and
00:27:42.520 that the
00:27:44.100 NCAA really
00:27:45.300 needs to do
00:27:46.080 more in
00:27:46.740 their protection
00:27:47.360 of girls
00:27:48.040 long-term.
00:27:50.060 So, are
00:27:50.240 you telling
00:27:50.620 me the
00:27:51.320 headlines that
00:27:52.360 I read on
00:27:52.960 Facebook where
00:27:53.880 I have won
00:27:54.660 $50 million
00:27:55.620 because the
00:27:57.520 NCAA has
00:27:58.520 settled and
00:27:59.180 we've won
00:27:59.800 this lawsuit,
00:28:00.880 you're telling
00:28:01.420 me those
00:28:01.800 aren't true?
00:28:03.960 I wish they
00:28:05.060 were true
00:28:05.760 because...
00:28:06.520 Me too.
00:28:07.740 I've been
00:28:08.480 waiting for the
00:28:09.240 money to hit
00:28:09.760 my bank
00:28:10.200 account.
00:28:12.140 $50 million.
00:28:13.300 I think I
00:28:13.940 started seeing
00:28:15.180 those headlines
00:28:15.940 within a
00:28:17.200 month of the
00:28:18.060 lawsuit being
00:28:18.840 filed.
00:28:19.680 Yeah.
00:28:20.180 That would be
00:28:20.840 record speed
00:28:21.700 for any
00:28:22.700 legal case
00:28:23.540 to be
00:28:23.940 settled.
00:28:24.880 I saw one
00:28:25.600 the other
00:28:25.960 day that
00:28:26.720 said Riley
00:28:27.380 Gaines
00:28:28.000 sues Whoopi
00:28:29.680 Goldberg for
00:28:30.640 $8 million
00:28:31.460 defamation
00:28:32.960 suit.
00:28:33.560 I'm like,
00:28:33.860 oh, I
00:28:34.120 did?
00:28:35.200 When?
00:28:36.400 I hope I
00:28:36.840 win.
00:28:38.220 It's just
00:28:38.960 ridiculous,
00:28:39.400 these headlines.
00:28:40.540 But nonetheless,
00:28:42.180 they circulate
00:28:43.300 and people
00:28:43.680 believe them.
00:28:45.060 So,
00:28:45.400 important to
00:28:46.100 debunk those
00:28:46.920 now.
00:28:47.680 We also
00:28:47.980 just found
00:28:48.440 out that
00:28:48.960 the Supreme
00:28:50.020 Court will
00:28:51.380 be hearing
00:28:52.060 oral arguments
00:28:52.920 surrounding a
00:28:54.040 Title IX case.
00:28:55.580 I imagine
00:28:56.420 the votes are
00:28:57.540 there.
00:28:57.920 If I could
00:28:58.500 predict what's
00:28:59.380 going to
00:28:59.620 happen,
00:29:00.500 it would be
00:29:01.100 a 6-3
00:29:02.300 ruling with
00:29:03.520 a scathing
00:29:05.960 dissent
00:29:06.540 written by
00:29:07.500 the liberal
00:29:08.000 justices.
00:29:08.880 So,
00:29:09.200 what would
00:29:10.360 this ultimately
00:29:11.220 mean,
00:29:12.640 especially as
00:29:13.180 it pertains
00:29:13.620 to,
00:29:14.400 I mean,
00:29:14.580 of course,
00:29:14.880 the Supreme
00:29:15.540 Court is
00:29:15.900 like the
00:29:16.220 law of
00:29:16.780 the land.
00:29:18.800 We have
00:29:19.660 been waiting
00:29:20.160 for the
00:29:20.920 Supreme
00:29:21.260 Court to
00:29:21.900 take up a
00:29:22.420 women's
00:29:22.780 sports case
00:29:23.580 for a
00:29:24.480 long time.
00:29:25.920 So,
00:29:26.560 when I saw
00:29:27.480 that,
00:29:28.180 they're actually
00:29:29.060 going to hear
00:29:29.540 two cases
00:29:30.860 from Idaho
00:29:32.440 and West
00:29:33.880 Virginia.
00:29:35.260 And,
00:29:35.640 essentially,
00:29:36.380 both of
00:29:36.860 those are
00:29:37.920 asking the
00:29:38.860 Supreme
00:29:39.240 Court to
00:29:41.060 rule on
00:29:43.300 whether it's
00:29:44.320 constitutional for
00:29:45.660 states like
00:29:46.940 those two to
00:29:48.640 have state
00:29:49.960 laws on the
00:29:50.600 books that
00:29:51.640 protect women's
00:29:52.920 sports for
00:29:53.900 women only.
00:29:55.900 Right now,
00:29:56.460 I think we
00:29:57.220 were talking
00:29:57.660 about 27 or
00:29:58.760 28 states
00:29:59.940 have laws
00:30:00.900 that do
00:30:02.000 just that,
00:30:02.740 protect women
00:30:03.340 in sports.
00:30:04.500 However,
00:30:05.560 there is
00:30:06.640 limitations to
00:30:07.700 these two
00:30:08.160 cases.
00:30:08.780 So,
00:30:09.500 I anticipate
00:30:10.260 wins,
00:30:11.700 depending on
00:30:12.420 when our
00:30:13.620 babies are
00:30:14.240 born,
00:30:15.340 I anticipate
00:30:16.040 you and I
00:30:16.820 being outside
00:30:17.580 the Supreme
00:30:18.300 Court together
00:30:19.400 to support
00:30:21.480 the ADF
00:30:24.760 and all
00:30:26.040 the incredible
00:30:26.720 attorneys fighting
00:30:28.160 on behalf of
00:30:29.180 women and
00:30:30.040 girls.
00:30:31.640 But,
00:30:32.560 you know,
00:30:33.440 again,
00:30:34.100 they're limited
00:30:34.780 in the scope
00:30:35.580 of what that
00:30:36.400 decision will
00:30:37.680 entail.
00:30:38.640 And,
00:30:39.500 selfishly for
00:30:40.280 me,
00:30:40.740 I am not
00:30:41.400 in a red
00:30:41.900 state.
00:30:42.400 I am not
00:30:43.020 in one of
00:30:43.600 those 27
00:30:44.420 states.
00:30:45.260 And I
00:30:45.560 don't
00:30:45.800 anticipate
00:30:46.580 Nevada
00:30:48.180 passing a
00:30:49.560 state law
00:30:50.280 anytime soon
00:30:51.880 for my
00:30:52.480 daughter's
00:30:53.080 protection.
00:30:54.220 And,
00:30:54.640 you know,
00:30:55.580 California,
00:30:56.800 Minnesota,
00:30:57.800 Connecticut,
00:30:58.260 these are
00:30:58.920 blue states
00:30:59.780 that likely
00:31:01.060 will never
00:31:01.600 have such
00:31:02.720 state laws.
00:31:03.780 And so,
00:31:04.380 what more
00:31:05.360 can we do
00:31:06.360 beyond,
00:31:07.720 you know,
00:31:08.860 really fortifying
00:31:09.900 that states
00:31:10.600 can pass
00:31:11.480 these laws?
00:31:12.520 Well,
00:31:13.420 clarifying
00:31:14.760 Title IX,
00:31:16.040 because we
00:31:16.880 already have
00:31:17.500 an existing
00:31:18.100 federal law
00:31:19.080 that every
00:31:19.860 state should
00:31:20.440 be complying
00:31:21.180 with,
00:31:21.520 and getting
00:31:23.260 some legal
00:31:23.900 court wins
00:31:24.740 and,
00:31:25.340 you know,
00:31:26.240 our three
00:31:27.260 collegiate
00:31:27.900 cases,
00:31:28.360 as well as
00:31:29.180 the Sewell
00:31:29.600 case of
00:31:30.700 the Connecticut
00:31:31.320 high school
00:31:32.420 runners that
00:31:33.080 has been
00:31:33.780 ongoing for,
00:31:35.460 I want to
00:31:35.700 say,
00:31:35.940 over six
00:31:36.620 years.
00:31:37.420 Yeah,
00:31:37.620 six or
00:31:38.100 seven years
00:31:38.720 now.
00:31:39.460 All of
00:31:40.080 these cases
00:31:41.100 are really
00:31:42.960 important to
00:31:44.000 move forward
00:31:44.980 as well.
00:31:46.020 So,
00:31:46.220 we're hoping
00:31:46.680 now that
00:31:47.420 the Supreme
00:31:48.240 Court has
00:31:48.860 opened the
00:31:49.420 gates to
00:31:49.960 hearing women's
00:31:51.260 sports cases
00:31:52.080 that will
00:31:54.000 get some
00:31:54.540 of these
00:31:54.840 wins in
00:31:55.340 higher courts
00:31:56.140 for these
00:31:57.200 other cases
00:31:57.880 as well.
00:31:59.280 Yeah,
00:31:59.480 fantastic.
00:32:00.500 What else
00:32:01.060 is kind of
00:32:02.220 at the
00:32:02.720 forefront of
00:32:03.700 icons right
00:32:04.420 now?
00:32:05.520 I think
00:32:06.320 specifically,
00:32:07.120 like,
00:32:07.640 what can we
00:32:08.360 expect at
00:32:09.480 the Olympics?
00:32:10.640 Obviously,
00:32:11.220 they're in
00:32:11.660 the U.S.
00:32:12.660 It's on
00:32:13.080 U.S.
00:32:13.540 soil in
00:32:14.060 L.A.
00:32:14.400 in 2028.
00:32:15.640 Will we
00:32:16.140 see men
00:32:17.160 and women's
00:32:17.640 sports in
00:32:18.760 the 2028
00:32:19.440 Olympics?
00:32:19.800 It's a
00:32:22.420 possibility.
00:32:23.740 I know
00:32:24.580 President Trump
00:32:25.800 and the
00:32:26.360 administration
00:32:27.060 is firmly
00:32:28.600 opposed to
00:32:29.400 that.
00:32:30.180 There's a
00:32:30.840 lot of
00:32:31.120 work that
00:32:31.640 needs to
00:32:32.140 be done
00:32:32.740 because the
00:32:33.860 IOC,
00:32:34.680 the International
00:32:35.320 Olympic
00:32:35.740 Committee,
00:32:37.120 has not
00:32:38.640 passed any
00:32:40.340 guidelines or
00:32:41.800 rules that
00:32:42.860 bar men
00:32:43.920 at the
00:32:44.900 Olympic
00:32:45.340 level.
00:32:45.940 individual
00:32:47.260 sports have
00:32:48.680 done that
00:32:49.260 to a
00:32:49.660 degree.
00:32:50.820 So,
00:32:51.100 certain
00:32:51.340 sports like
00:32:52.100 world
00:32:52.380 athletics,
00:32:53.020 track and
00:32:53.400 field,
00:32:54.500 world
00:32:55.140 aquatics,
00:32:56.300 and swimming
00:32:56.880 in the
00:32:57.220 water sports,
00:32:58.600 and others
00:32:59.360 have passed
00:33:00.640 some
00:33:01.320 regulations
00:33:02.560 that really
00:33:03.560 limit that,
00:33:04.360 I think,
00:33:04.800 to men
00:33:06.620 who have
00:33:07.900 not,
00:33:08.960 quote-unquote,
00:33:09.640 transitioned or
00:33:10.820 been medicalized
00:33:11.860 prior to the
00:33:12.780 age of 12.
00:33:13.620 However,
00:33:16.380 most sports
00:33:17.220 are not
00:33:17.700 protected,
00:33:19.260 and therefore
00:33:20.380 we've seen
00:33:21.420 instances like
00:33:22.560 in boxing
00:33:23.160 where male
00:33:25.000 athletes have
00:33:26.380 snuck onto
00:33:27.920 the ring and
00:33:29.120 actually put
00:33:29.940 women in
00:33:31.220 lethal danger,
00:33:33.460 and so
00:33:34.480 far,
00:33:35.580 you know,
00:33:37.040 there is
00:33:37.620 still an
00:33:38.220 avenue for
00:33:38.840 them to
00:33:39.440 do that
00:33:39.960 in LA.
00:33:41.060 There is a
00:33:41.760 new IOC
00:33:42.360 president,
00:33:42.960 Kirstie
00:33:43.520 Coventry.
00:33:44.240 She was
00:33:44.780 actually a
00:33:45.300 competitor of
00:33:46.040 mine in
00:33:46.480 the 200
00:33:46.940 back in
00:33:48.440 the NCAA.
00:33:49.960 I am
00:33:50.860 hopeful that
00:33:52.940 she will
00:33:53.380 really take
00:33:54.000 this seriously
00:33:54.880 and change
00:33:56.320 some roles,
00:33:57.140 but we need
00:33:57.840 to continue
00:33:58.420 to apply
00:33:59.220 pressure at
00:34:00.160 the Olympic
00:34:00.640 level.
00:34:01.880 Education
00:34:02.440 is,
00:34:04.100 the fight
00:34:05.160 is in
00:34:05.540 full force,
00:34:06.360 but for
00:34:07.120 club,
00:34:07.700 Olympic,
00:34:08.300 and professional
00:34:09.020 sports,
00:34:09.860 we still have
00:34:10.720 a really long
00:34:11.400 way to go.
00:34:12.780 So we need
00:34:13.480 to continue
00:34:14.160 to rattle
00:34:15.220 the cages
00:34:15.820 and be
00:34:17.760 really vocal
00:34:18.480 about our
00:34:19.780 support of
00:34:20.800 our club
00:34:21.380 team athletes.
00:34:23.960 What's the
00:34:24.240 best way for
00:34:24.860 people to
00:34:25.600 get involved
00:34:26.680 to help
00:34:27.260 the cause,
