00:07:05.380 yeah jack well a couple interesting things that happened this morning as the jury asked the judge mershon
00:07:11.380 to reread some of the instructions to them one of the instructions that the jury asked to have reread
00:07:17.380 was this unconstitutional idea of there really goes in the flies in the face of unanimous consent
00:07:24.380 i rarely read but i think this is too important to actually paraphrase uh judge mershon said although you must conclude unanimously that the defendant violated new york state election law
00:07:35.380 you need not be unanimous on what those unlawful means are you may consider the following
00:07:41.380 federal elections violations falsification of other business records or three the violation of tax law
00:07:49.380 uh jack that flies right in the face of 800 years of jurisprudence uh and really unanimous consent when
00:07:58.380 you look at it and and that's a little bit of what we were talking about yesterday the fact that that was reread to the jury today i thought was fascinating
00:08:06.380 it kind of goes into that theory of hey they don't all need to say that he violated tax laws they don't need to all say that he violated
00:08:13.380 federal election laws or that he falsified business records a couple can say this a few more could say that
00:08:20.380 and a few could say that and they can get to get to guilty that totally flies in the face of unanimous consent
00:08:25.380 and hence is unconstitutional in terms of the rogue juror theory i do have another piece of information
00:08:31.380 that happened today at one point while they were reading back the testimony of michael cohen
00:08:37.380 what cohen testified happened at the trump tower meeting in august of 2015 that same juror who just
00:08:44.380 the other day while steinglass was giving his hours-long summation put his head in his hands
00:08:50.380 and i think that's the same juror that the trump team is looking at he ended up looking at president
00:08:55.380 trump was the only one who was looking at president trump it was not with a scowl on his face during
00:09:00.380 that testimony uh and there's a little nugget that uh we have from inside the courtroom
00:09:07.380 so that's the same individual this is that rogue juror that would let's let's not say the juror number

00:14:10.420 know the stronger the possibility grows for a hung jury but listen i think the the judge is going to use
00:14:15.900 any and all tactics available to him uh whether they you know break precedent or not whether they
00:14:21.840 break you know hundreds of years of uh common law tradition i don't think he cares i think he has one
00:14:27.320 goal in mind and that is to convict trump by any means necessary i mean this guy has absolutely no
00:14:32.240 respect for the law i mean he's about as corrupt of a judge as they come uh not even born in this
00:14:38.240 country you know born in columbia moves here now he's you know presiding over a case uh to potentially
00:14:44.020 jail the leader of the opposition the leading candidate for the president united states i mean
00:14:47.720 this entire thing is a farce and it may come down to just one or two jurors i think there's a strong
00:14:53.060 and distinct possibility of that i mean listen if you're you're assembling uh you know 12 uh jurors
00:14:58.460 you know new york still has between 25 to 33 percent of the population citywide is potentially
00:15:05.280 republican or at least votes republican occasionally whether for trump or otherwise obviously in manhattan
00:15:10.700 that number is even less uh but there's still a slight possibility you could get someone who's
00:15:16.240 sensible on that jury who's not willing to go along and be pressured uh into a conviction but i think this
00:15:22.440 theory is only going to hold water if this goes on uh the longer this goes on for it's certainly going
00:15:27.580 to have to go into next week i know the process uh to do that involves a lot of back and forth where the
00:15:33.220 judge uh constantly tries to get a verdict out of them they would really have to stay strong
00:15:37.920 uh and committed uh to push through all the pressure that they're probably under this juror is probably
00:15:43.140 under from the remaining uh you know uh set of jurors but listen we're going to hope for a miracle
00:15:48.240 here and uh for the future of our country now that being said you know the different scenarios if he's
00:15:55.740 acquitted i think that's probably the biggest surprise um also probably the longest shot right now
00:16:00.900 uh a hung jury or a holdout if it were anyone else other than trump i don't know that i would bet on it
00:16:06.840 but with trump you can you can you can always bet on the unexpected what's your sense though let's

00:16:42.660 fence but i don't think it's actually going to move the needle anyone who is planning to vote for trump

00:17:18.120 rikers i mean who knows what this judge is going to try to do uh right after uh you know a verdict
