After roughly four and a half hours of deliberations yesterday, the jury in Donald Trump s criminal hush money trial started back day two with the readback of witness testimony before returning to deliberate. They have to be unanimous that the falsification of business records was a felony, and that they also have to unanimous that Trump intended to conceal a conspiracy to promote his own election in 2016.

00:07:11.380to reread some of the instructions to them one of the instructions that the jury asked to have reread

00:07:24.380i rarely read but i think this is too important to actually paraphrase uh judge mershon said although you must conclude unanimously that the defendant violated new york state election law
00:07:35.380you need not be unanimous on what those unlawful means are you may consider the following
00:07:41.380federal elections violations falsification of other business records or three the violation of tax law
00:07:49.380uh jack that flies right in the face of 800 years of jurisprudence uh and really unanimous consent when
00:07:58.380you look at it and and that's a little bit of what we were talking about yesterday the fact that that was reread to the jury today i thought was fascinating
00:08:06.380it kind of goes into that theory of hey they don't all need to say that he violated tax laws they don't need to all say that he violated
00:08:13.380federal election laws or that he falsified business records a couple can say this a few more could say that
00:08:20.380and a few could say that and they can get to get to guilty that totally flies in the face of unanimous consent
00:08:25.380and hence is unconstitutional in terms of the rogue juror theory i do have another piece of information
00:08:31.380that happened today at one point while they were reading back the testimony of michael cohen
00:08:37.380what cohen testified happened at the trump tower meeting in august of 2015 that same juror who just
00:08:44.380the other day while steinglass was giving his hours-long summation put his head in his hands
00:08:50.380and i think that's the same juror that the trump team is looking at he ended up looking at president
00:08:55.380trump was the only one who was looking at president trump it was not with a scowl on his face during
00:09:00.380that testimony uh and there's a little nugget that uh we have from inside the courtroom
00:09:07.380so that's the same individual this is that rogue juror that would let's let's not say the juror number

00:09:56.980testimony of pecker comparing that with the testimony of the uh proclaimed by todd banch greatest liar of

00:10:11.580again that shows that at least there is some conflict in the jury box of course we don't know if that

00:15:16.240sensible on that jury who's not willing to go along and be pressured uh into a conviction but i think this
00:15:22.440theory is only going to hold water if this goes on uh the longer this goes on for it's certainly going
00:15:27.580to have to go into next week i know the process uh to do that involves a lot of back and forth where the
00:15:33.220judge uh constantly tries to get a verdict out of them they would really have to stay strong
00:15:37.920uh and committed uh to push through all the pressure that they're probably under this juror is probably
00:15:43.140under from the remaining uh you know uh set of jurors but listen we're going to hope for a miracle
00:15:48.240here and uh for the future of our country now that being said you know the different scenarios if he's
00:15:55.740acquitted i think that's probably the biggest surprise um also probably the longest shot right now
00:16:00.900uh a hung jury or a holdout if it were anyone else other than trump i don't know that i would bet on it

00:16:42.660fence but i don't think it's actually going to move the needle anyone who is planning to vote for trump

00:16:51.200civil case through all this nonsense you know i don't believe that there's really anyone that
00:16:55.400any statistical number of people a statistically significant number of people would view the outcome of
00:17:01.540of this trial in manhattan uh with a conviction and say oh i'm no longer voting for president trump

00:17:18.120rikers i mean who knows what this judge is going to try to do uh right after uh you know a verdict

00:17:28.060position we got to continue to hold the line and be diligent uh but this judge is such a loose cannon
