00:00:44.040 how then can we speak up on something as simple as carbon taxes when we're on road trips, right?

00:01:46.420 Well, our next guest is at the forefront of this fight for free speech.
00:01:52.780 Lisa Bildy is the executive director.
00:01:55.900 She's the head of the Free Speech Union of Canada,
00:01:59.840 and she brings us an update on who can access the Internet,
00:02:04.940 who can speak up on social media,
00:02:06.660 and how this could affect your ability to express yourself.

00:02:12.720 Folks, if you're part of the freedom movement
00:02:15.260 or the push to have smaller, more accountable government in Canada, and you don't follow Lisa,
00:02:20.820 go fix that right now. Go follow her on X. She goes all over the place. She goes to really cool
00:02:25.400 conferences. She's right at the forefront of the fight for free expression. And she even goes to
00:02:30.540 parliamentary committee. I saw you really putting the boots to this issue of, okay, how do I describe
00:02:36.220 this? The push by governments to restrict access to social media to only people over the ages of
00:02:43.880 16. Now, to those of us who are parents of teenagers who don't want them rotting their
00:02:48.660 brains on TikTok and all that stuff, that can sound attractive. But my concern is that this
00:02:55.240 could be used by government to start restricting everybody's access to information and the ability
00:03:01.140 to communicate with each other. Where are we in Canada when it comes to that proposed law to
00:03:07.400 restrict social media access to people over the age of 16? Well, thanks, Chris. Yeah, it's very
00:03:13.480 concerning because as you rightly point out, legislation like this tends to get acceptance
00:03:19.420 because it does address a legitimate concern that people have. But that can often be a front for
00:03:25.540 bringing in more draconian laws that are needed. And I think that's what's happening here.
00:03:30.760 So Bill C-34 is currently at first reading. It's just past first reading. So now the parliament is
00:03:37.580 on break for the summer. When they come back, there'll be a second reading and then it will
00:03:41.620 be sent to a committee. I'm not sure which one yet. So there's still ample time for people to
00:03:46.500 make submissions to, um, you know, to, to their MP, but also to the committee once it's struck
00:03:51.800 and, uh, or once the, once they've been assigned this bill. Um, and then, you know, there'll be a
00:03:57.380 lot of debate about it in that process. And hopefully some of the worst elements, uh, which
00:04:02.560 is a large chunk of it will, will be gone. But, um, that, so there's a long process ahead still.
00:04:08.760 it will also have to go to the Senate. And then once it gets royal assent, one of the more
00:04:13.780 problematic aspects of this bill is that it sets up a digital safety commission, which isn't even
00:04:19.640 built yet, but it's going to have a lot of power, a lot of regulatory oversight over all the
00:04:26.220 platforms that it wants to have control over. And that hasn't even been set up yet. And I think
00:04:33.600 professor michael geist has been writing about this and noted i think some 50 odd decisions have
00:04:38.640 been left to regulations from in this bill which means it's going to be a while until everything
00:04:44.720 is up and running but there are a lot of things we can talk about now and be concerned about now
00:04:49.520 um what what i think i find interesting is i i was just at a an international conference free
00:04:55.280 speech union is an international organization and i was privileged enough to be at a conference that
00:05:00.480 included not just our group but other people concerned about freedom of expression around the
00:05:05.840 world this was just last month in london london england there were people there from czech republic
00:05:11.760 france germany romania hungary um uk new zealand australia many more i'm sure and it seems like
00:05:20.880 this is being rolled out or a form of this is being rolled out literally everywhere all around
00:05:26.560 the country at the same time. And that really struck me that it's not that these governments
00:05:31.600 have all suddenly decided that they care about kids. Frankly, I think we've seen evidence that
00:05:36.400 they don't care that much about kids. If you think about how many school teachers are allowed to
00:05:44.000 indoctrinate kids in the classroom on their ideologies and so on, and some of the graphic
00:05:49.040 things that are in our schools, to say suddenly that we're concerned about the kids seems a little
00:05:55.040 disingenuous to me that that's just my opinion but um we all should also note that it the like
00:06:02.160 the guise of safety or protection of children has often brought in very draconian things
00:06:06.480 in russia in 2012 they passed a law in their duma of um that was ostensibly to protect children from
00:06:14.480 online harms and it's turned into this huge um surveillance and control mechanism and that's the
00:06:20.880 risk with these kinds of things is that they don't just accomplish that one task, which is
00:06:26.380 keeping kids away from, um, sexually explicit content and things like that. Um, and legitimately,
00:06:32.340 you know, harmful things, but they go too far. So I understand parents' concern, and I think
00:06:39.420 it would be a better approach if they were given tools or taught how to use existing tools
00:06:44.600 to restrict their kids from access to certain types of things.
00:06:50.520 But I think the responsibility ultimately should be on parents and not on governments,
00:06:54.500 because when we give governments the power to keep us safe, they are going to use it for other things.
00:07:00.400 And that is what's going to happen here.
00:07:02.820 So where are we at?
00:07:04.440 We're a long way from getting the final thing put into place here, the Digital Safety Commission.
00:07:10.920 But we do know from looking at other countries that have already gone down this path that this is not effectively going to help solve the problem that they purport it's going to solve.
00:07:21.340 In Australia, where they have, since I think 2023, had, for the same reasons, put in place a very similar regime of age verification and a digital safety commissioner there too.
00:07:33.420 They call her the e-safety commissioner.
00:07:35.380 They have essentially had no measurable success from this program.
00:07:40.920 something in the order of three quarters of kids are getting around the ban who should be affected
00:07:47.640 by it and then two-thirds have accounts that continue to exist on these platforms they haven't
00:07:53.160 been taken down so the kids are getting around it anyway and frankly it's it can be even more
00:07:59.480 dangerous because some of them may turn to sources and sites that are that are um you know on the
00:08:05.240 the dark web or whatever to try and get around it or find other ways of getting access using VPNs
00:08:11.700 and different things. So it's not an effective tool, but what it does, what it's done in Australia
00:08:16.460 and what it will do here is it will empower bureaucrats like the eSafety Commissioner in
00:08:21.460 Australia to regulate content for everybody, not just the kids. And once you have a system in place
00:08:28.040 that is designed to check ID for under 16s, well, of course, everybody's going to have to produce
00:08:34.340 their identification in some form to prove that they're not under 16. So it isn't just affecting
00:08:41.340 the kids, it affects every single user of the internet in Canada. There's so much here. Let's
00:08:48.420 start with people who I can kind of hear in the comments who are rightly playing devil's advocate
00:08:53.940 and questioning, that's very good to do, saying, okay, but you know, aren't you taking this too
00:08:59.280 far? Won't this just be protecting kids from online predators? Yada, yada. I will point out
00:09:05.460 an example. So it's hard to remember during lockdowns and stuff, but I remember distinctly
00:09:11.800 that the Taxpayers Federation, we were going after things like carbon taxes, as we do.
00:09:17.340 And then we found in a government report, the government wrote this report. It was recommending
00:09:23.580 to itself that it create a big pickup truck and SUV tax, a special tax on the sale of new SUVs
00:09:33.180 and pickup trucks. And this is back when Stéphane Guibault was a cabinet minister. We had them dead
00:09:38.480 to rights. It was right there in black and white. And they got on Twitter, online, the government's
00:09:44.560 ministers of the crown saying, oh, this is misinformation. This is disinformation. From an
00:09:51.080 advocacy group that's been around since 1990, like before the internet was even a sparkle in
00:09:55.860 the eye of anyone. So to have a minister of the crown saying publicly that something that we were
00:10:02.460 reporting, which was a fact, was disinformation or misinformation, then you start hearing these
00:10:08.060 buzzwords, Lisa, being bandied about with proposed legislation like this of, oh, we would be able to
00:10:14.920 root out and ban or fine misinformation or disinformation. Well, according to whom? Who
00:10:21.620 gets to decide what's misinformation and disinformation? The same government that didn't
00:10:26.320 want to hear about their pickup truck tax that they were thinking about? Like, and it's just
00:10:30.580 such an obvious, concrete example. And it can go so much further, so much faster. Look what
00:10:35.680 happened during the protest against the lockdowns when bank accounts were frozen, during the
00:10:40.880 Emergencies Act, like things can escalate quickly here. Is that your main concern? Is that they'll
00:10:47.380 create this entire government structure or framework of digital safety commissioners,
00:10:52.400 and then we'll all wind up not being able to speak our minds freely?
00:10:57.040 Yeah, I mean, I think that can happen in a number of ways. One is that the powers can be expanded
00:11:02.000 once they're in place, and I think that is probably likely. Another is that essentially
00:11:08.940 the, right now they're not tasked to regulate misinformation and disinformation. They are
00:11:16.600 tasked to deal with harmful content. And so, but what is that? And there's a definition in the
00:11:22.620 legislation on what constitutes harmful content. It is quite broad, broader than it should be.
00:11:30.360 The, uh, the test that is used is whether, um, whether it, the harm harmful
00:11:36.680 contact, uh, is including, um, language that is intended to vilify, cause
00:11:41.840 vilification and detestation of a protected group under the human rights
00:11:45.200 code.
00:11:45.440 So certain people in certain groups, uh, uh, will have protection from
00:11:51.220 detestation and vilification.
00:11:53.400 But again, that language is extremely broad, subjective, uncertain in the
00:11:58.260 Supreme Court rulings that came up with that phrase, they also used the word extreme, but the
00:12:03.720 word extreme has been left out of the legislation, as it was in C9, and groups like ours and CCF and
00:12:10.420 JCCF all said, look, you can't water down the definition, and so they fixed it. But then they
00:12:16.520 turned around and put the same watered-down definition in this bill. So they want to regulate
00:12:21.220 harmful content, which we know is going to be a tool that will be used against content they don't
00:12:26.780 like. And we've seen a lot of very subjective and two-tier enforcement of different rules and
00:12:33.760 laws, and that is very likely going to happen. And then the other way that it can be a problem
00:12:39.520 is that because there's such an onerous fine and obligation on the platforms themselves,
00:12:46.720 which platforms, by the way, we don't know who this is going to apply to because that will come
00:12:51.500 out in the regulations later too. But those platforms will have an obligation, a duty of care
00:12:57.420 to remove harmful content. And are they going to understand what that definition means? Where the
00:13:04.020 line is? How carefully to parse the words? No, they're not. They're going to over-censor because
00:13:09.960 they're worried they're going to get hit with a huge multi-million dollar fine if they don't.
00:13:14.740 so it will affect people in many many ways um and uh and i think it's designed to
00:13:21.360 are we at risk c and what you're pointing out here has already happened in a sense
00:13:27.020 because of course when they brought in the online news act and what i would describe as a link tax
00:13:31.780 um when they tried saying hey facebook um anytime uh there's a news story that is posted on your
00:13:39.040 social media platform, we're going to charge you a fee. It was absolutely madness, in my opinion,
00:13:45.500 as a longtime journalist. It's like finding the paper boy for delivering your newspaper every
00:13:49.900 morning. But I digress. It really backfired on publishers, frankly. Facebook just decided to
00:13:56.680 take its ball and go home. It's like, no, we're not doing this. Google eventually played a little
00:14:00.940 bit. I will point out that trying to find news articles using the Google function now is
00:14:05.560 basically useless um but with with facebook specifically you can't post news still so here
00:14:13.640 we are in canada a g7 country ostensibly um and i can't post a news article aren't we at risk lisa
00:14:20.800 to your point as if we put on so many regulations and so many laws and so many rules where some
00:14:26.680 bureaucrat in gatineau is deciding what can and can't be posted on i don't know meta x youtube
00:14:33.580 what qualifies as a social media platform, what qualifies as sharing. Don't we run the risk of
00:14:39.260 these companies just saying, you know what, this isn't worth it. We're not going to offer this
00:14:43.300 access to Canadians. Right? Yeah, absolutely. I think that's a very likely scenario. And, 0.99
00:14:48.840 you know, and the other thing that I think we need to be cognizant of is, is the impact on
00:14:54.620 anonymity from this kind of legislation. And, you know, why is that important? Well,
00:14:59.300 you know even since the enlightenment days some of the leading thinkers advocated for an anonymity
00:15:05.940 because they they were trying to get around the censors of their day and john locke and ben
00:15:10.920 franklin and voltaire you know that it's a long-standing principle that you should be
00:15:16.320 allowed to publish not you know using a pseudonym or not your real name the governments hate that
00:15:22.280 they really want to have a this is i think part of the reason why they want to move towards having
00:15:27.900 more digital ID involved here. Well, this isn't a digital ID bill. This isn't an age verification
00:15:35.620 bill, okay? But it will lead there, right? That's the idea. So everybody is going to have to show 0.99
00:15:42.320 identification in order to use certain sites. It's going to chip away at the right of people
00:15:48.820 to be able to remain anonymous online. And more bills will come and more changes and amendments
00:15:54.420 and expansion will continue to occur. Once you cross the line that you really cannot be anonymous
00:16:00.480 anymore, you have to show who you are, that'll just continue. And that's what's happened in
00:16:05.620 China. They brought in something too to ensure that the public were only having things that
00:16:10.860 would support their socialist values. And then it was tied to your identification. And now you have
00:16:16.680 a whole social credit system. So, you know, you just have to be really careful because I don't
00:16:21.740 think we need I don't think we should trust that when our government says we're here to help we're
00:16:26.200 here to um to to keep you safe that that that really is the goal and uh and we need to be
00:16:33.240 mindful not to let them cross certain lines and so uh you know in Germany for example I was just
00:16:39.840 reading something about their chancellor saying complaining that there's any anonymity at all he
00:16:45.520 doesn't want any anonymity and they have been fining people for criticizing the government
00:16:50.020 for calling uh for for calling the government officials including mertz himself um i think he
00:16:58.200 was called fritz mertz or something that was that was the insult that got somebody that got somebody
00:17:03.480 in trouble i pulled that out lying fritz they call him a german facebook user was fine for calling
00:17:09.260 him a lying fritz and uh and and he has said i want to see real names on the internet i want to 0.89
00:17:14.720 who's speaking yeah well you can find them then for calling you a lying fritz so that's wow okay 0.91

00:19:08.800 was of a piece and and there's this like you know it sounds conspiratorial but there's like blob of
00:19:13.920 of bureaucrats and managerial types that just want to have control over what people can do in the
00:19:18.640 internet and and they're all doing this at the same time so i'm not saying that they're all uh
00:19:23.840 you know doing the exact same thing or following any particular path but but it is interesting
00:19:28.560 that so many are doing are bringing in similar legislation um around the same time and and
00:19:35.680 you know some have gone further like obviously we're not where where germany is but will we
00:19:40.800 get there and is this part of the pathway to getting there where people cannot criticize
00:19:45.200 the government anymore this legislation doesn't do that okay i just want to be clear but but the
00:19:49.840 puts it puts a framework in place where things the screws can get turned a little tire and tire
00:19:55.680 going forward so but we build it they will come is that right so why build it um we only have a
00:20:02.160 couple minutes left with you i know you're a very busy lady and thank you for that um lastly if
00:20:06.780 we're going to construct this digital safety commissioner office thing a that's bigger
00:20:13.520 government we don't need bigger government because bigger government um is lousy it gets up in your
00:20:19.000 grill it doesn't allow you to live your life freely it costs you a ton of money and it's usually
00:20:24.500 terrible at doing what it's supposed to do. Government usually couldn't organize a two-car
00:20:28.240 parade. So adding more government is not the solution here. What's their proposal? Is this
00:20:34.940 going to be some regulatory body? Do we get to elect the information and safety czar? Are they
00:20:43.020 appointed by the prime minister? What is that octopus going to look like if this bill went
00:20:48.740 through? Yeah, well, we don't know. That's part of the fun. Parliament should be
00:20:54.480 deciding all of these things uh in my view because we elect people to parliament to do that but no
00:21:00.080 all of these decisions about all the the details and the the scope of the powers and who's going
00:21:04.800 to be involved and how it's all going to be set up all of that is pushed to regulation so
00:21:08.800 a minister will decide uh down down the line all those those pieces it won't be the legislature
00:21:14.160 with its you know with with the oversight necessary to make sure that this doesn't
00:21:18.240 become something it shouldn't so um yes and once you and once you put systems like this in place
00:21:23.280 the the toothpaste is out of the tube essentially right and um it's really really hard to to rein
00:21:28.640 it all in and and and people become conditioned to it and and you know they uh well we all know
00:21:37.120 how 1984 ended you just come to love you're oppressive right so yeah i'm afraid i'm afraid
00:21:43.840 that once they get started down that cast it just won't be able to be turned back anymore
00:21:47.360 and people will to your point they'll start to self-censor they'll stop what you're saying in
00:21:53.660 midstream they won't post what they were thinking of posting they'll self-censor right they will
00:22:00.160 self-censor in conjunction with platforms over censoring in order to avoid fines um it will be
00:22:05.900 a much more restrictive environment for communication now again i'm not saying you can't criticize the
00:22:11.000 government that's not on the table i think we should continue to do so boldly and loudly as
00:22:16.160 want yeah we can but um but but just know that the path is being laid here so that it gets a lot
00:22:24.520 harder to do so how can people fight back i loved what you opened with and i'll close with that is
00:22:30.300 we do have some runway here and i just i encourage people i've worked in those offices okay if they
00:22:37.280 get a whole bunch of phone calls if they get a whole bunch of emails if they get a whole bunch
00:22:41.180 of people bending their ears when they're busy kissing babies and stuff over the summer at their
00:22:45.640 barbecues and whatnot, they will back off because politicians want your vote because they want to
00:22:52.620 get reelected and keep their jobs. So I just encourage people, I understand the black pilling, 1.00
00:22:59.100 I do it myself sometimes, but let's all grab the white pill sometimes of being able to speak for 0.84
00:23:05.060 ourselves. Lisa, what should people do right now as this legislation is in the incubation stage?

00:23:22.120 And, you know, we did make some changes on Bill C-9 when we fought back.
00:23:25.940 Now, the bill got passed and it got passed in a worse way
00:23:29.020 because of what the Senate added to it as well.

00:23:37.800 But the point is, there were a lot of even worse things in Bill C-9, and we did manage to get some things changed by being vocal and getting submissions out and so on.
00:23:47.640 So support your local civil liberty groups and try and encourage them as well to get submissions in and push back.
00:23:55.900 Because intelligent and reasoned submissions do attract the attention of the politicians.
00:24:03.960 Of course, the Liberal government has a majority and they can do essentially what they want.
00:24:08.560 But, you know, hopefully there'll be some pressure, some good, solid public pressure on this.
00:24:13.920 I think I would say to parents, too, look, yes, the Internet is a problem.

00:24:23.780 But don't give the government the ability to do something that isn't actually going to protect your kids.

00:24:32.660 You need to know what your kids are doing and you need to put the tools in place, parental
00:24:37.860 controls, et cetera.
00:24:38.720 If you've got young ones at home and monitor their screen time, you know, have that computer
00:24:43.340 in the living room, make sure you know what they're doing.
00:24:45.680 They don't have to have the latest devices at a young age.
00:24:48.320 And no, it's, it's, it's hard to be a parent today.

00:24:59.420 the government power to do something that isn't going to fix the problem anyway.
