00:27:47.040Now, this device, it can get up to 120 decibels, and there has since been a conviction, assault with a weapon, for another protester who used that electronic whistle on an MP.
00:28:01.820And that's the only time I've seen a consequence befall someone is when they've attacked a politician.

00:29:22.600blasted at close range that can cause a lot of physical pain it's not just sound um it is
00:29:29.480and the effects can last several days after um and you know on occasions where charges are laid
00:29:38.940for physical assaults um and that's few and far between there is the crown prosecutor who
00:29:47.420in my experience is quick to dismiss or withdraw, even without seeking victim input.
00:29:55.640So, you know, I've had cases where assault with a megaphone, my videographer has been
00:30:01.940spat on and called a slur. He's had his pants pulled down and his genitals exposed0.91

00:31:05.200are sympathetic to the causes that certain protesters purport to champion and as a result
00:31:14.880they're more forgiving? Is it that there is disregard for independent journalists generally
00:31:22.200and so no desire to protect us? Is it specific to us and to me? Because I'm also mindful that
00:31:30.300alongside all of this abuse um there has been an ongoing effort to besmirch me um that it has
00:31:38.820involved union leaders including public sector union leaders and of course crowns are public
00:31:47.020sector employees um so i i really you know am committed to seeing this through and if criminal
00:31:56.720recourse isn't going to manifest because, of course, victims don't have any real measure of
00:32:06.320control when there's a criminal prosecution. They're not parties to that. There's also civil
00:32:13.000courts. And that's something that I'm turning to more and more to try and discourage this sort of
00:32:20.240behavior you know it's all i'm thinking of was these physical attacks on you and the and the
00:32:28.040crown prosecutors showing no interest in and dropping the charges or not taking them in the
00:32:33.060first place i was in ottawa a few weeks ago for tamara leach's hearing on can she travel within0.96
00:32:39.600canada and to the states to work she's had a perfect record according her probation officer
00:32:45.680the government of ontario sent three prosecutors that day when i was testifying in in on behalf of
00:32:53.900three so i think that there's certain political causes that it's downright a vendetta and when
00:33:02.460it's antifa hassling you um yeah yeah but you've presented a lot of different possibilities of what
00:33:09.560it is and let's never forget that these that the at the end of the day the attorney general who
00:33:15.020decides about prosecutions is a partisan person and i am not impressed with ontario's attorney

00:36:57.740you know, resolved some matters to my satisfaction without having to go to trial.
00:37:05.200But at least as a plaintiff, you get to make that call. And so that's the course that I'm pursuing.
00:37:11.760It is very kind of specific to incidents where the behavior is egregious or it had
00:37:20.780ramifications or it was not properly dealt with through criminal courts and we're going to see
00:37:29.620them through to the end so whoever had the idea that it made sense or was a good idea to harass
00:37:38.660a journalist who also happens to be a lawyer it was not well thought out and and we're going to
00:37:45.480see consequences and hopefully set some precedent. Because I do think that I'm not special or unique
00:37:54.780in the sense that these tactics are used on others. And so if I have an opportunity to
00:38:02.200highlight, showcase, and seek accountability, that may help others down the line.

That's assault, by the way. She was criminally charged in connection with the incident, but the case was withdrawn. That makes me so mad.

00:38:40.620yet she spent 49 days in in jail and she has a house arrest now here's someone who blasted your
00:38:46.980eardrums badly enough that police charged her but then a prosecutor said yeah no we aren't going to
00:38:53.000proceed that makes me mad but you're taking a civil a civil case against them right yes and the
00:38:59.140real insult to injury is that the crown didn't even bother to let me know that was the outcome
00:39:04.920let alone seek information how are you what happened that's great so they didn't even
00:39:11.160engage you as the victim of this to even oh my god that's and once would be an issue but perhaps
00:39:20.260an oversight twice is maybe you know they're having a rough time in that office three four

00:39:36.000be the public system um of dealing with this right and so and i i've practiced criminal defense so i'm
00:39:44.560i'm sympathetic to the idea of diversion um which is where a charge can be withdrawn in exchange for
00:39:52.060an accused who maybe has no criminal record completing certain tasks right i'm sympathetic
00:39:57.700to that um but it shouldn't be a process that excludes victims entirely um and in all my years
00:40:05.000of practice i've never seen that happen so that's what has lit this fire under me um to
00:40:13.460do it myself sometimes i'm so glad you are you do it yourself and the fact that you are a practicing
00:40:19.880lawyer. There's a whole bunch of pluses to that, including you have the confidence to go to court.
00:40:26.940Going to court is a very scary thing for most people. Now you have a crowdfund and I chipped
