00:01:28.960 a long time okay our religious liberty is at stake if we view same-sex marriage as a fundamental right
00:01:34.620 churches will not long be able to exercise their freedom of religion or there will be some tension
00:01:39.560 between freedom of religious expression our first amendment rights and the right of same-sex couples
00:01:44.540 to get married we have seen that tension uh a lot over the past few years and uh there was a line
00:01:51.380 by presidential candidate beto o'rourke that really just brought it home do you think religious
00:01:57.100 institutions uh like colleges churches charities should they lose their tax-exempt status if they
00:02:03.300 oppose same-sex marriage yes there can be no reward no benefit no tax break for anyone or any institution
00:02:12.600 any organization in america that denies the full human rights and the full civil rights of every
00:02:18.400 single one of us and so as president we're going to make that a priority and we are going to stop
00:02:23.100 those who are infringing upon the human rights of our fellow americans so this means that churches
00:02:28.240 synagogues mosques religious non-profits would lose tax exemption status which they currently enjoy
00:02:33.860 if they oppose same-sex marriage and he doesn't say uh discriminate against uh a gay couple or gay
00:02:41.120 people in hiring which also religious organizations are allowed to do but to um but just oppose same-sex
00:02:47.560 marriage in general so what does oppose actually mean does that mean uh that a church couldn't preach
00:02:52.980 against homosexuality does that mean refuse to perform same-sex weddings uh what does that mean
00:02:58.600 and how are they planning to accomplish it constitutionally uh since obergefell like i was saying earlier
00:03:04.880 christians have been asking how will this decision affect religious liberty which is not by definition just
00:03:10.920 a christian or a conservative value but a constitutional right if same-sex marriage
00:03:16.620 according to the court in 2015 is also now a right uh which one is going to have to give way when the
00:03:23.800 two come in conflict how will churches and religious organizations be able to legally avoid embracing it
00:03:30.400 uh the dissent in obergefell 2015 brought up these exact concerns these are not new concerns that people
00:03:36.480 are having the dissent knew that this was coming uh it probably has come more quickly than they thought
00:03:42.840 that it was going to it's only been four years since this decision um and they knew back then that this
00:03:48.820 battle was ahead so this is what chief justice john roberts wrote in his dissent in obergefell
00:03:54.220 hard questions arrive when people arise when people of faith exercise religion in ways that may seem to be seen
00:04:00.740 in conflict with a new right to same-sex marriage when for example a religious college provides married
00:04:06.700 student housing only to opposite-sex married couples or religious adoption agency declines to place children
00:04:12.380 with same-sex married couples indeed the solicitor general candidly acknowledged that the tax exemptions of
00:04:19.460 some religious institutions would be in question if they oppose same-sex marriage um there is little doubt that
00:04:27.640 these and similar questions will soon be before this court unfortunately he says people of faith can take no
00:04:35.120 comfort in the treatment they receive from the majority today clarence thomas then said this in his dissent
00:04:41.400 in our society marriage is not simply a governmental institution it is a religious institution as well today's
00:04:48.520 decision uh might change the former but it cannot change the latter it appears all but inevitable that the two will
00:04:55.240 come into conflict particularly as individuals and churches are confronted with demands to participate in
00:05:01.160 and endorse civil marriages between same-sex couples this is the problem with the government getting involved in
00:05:08.320 marriage at all um it was not originally a civil agreement marriage was a religious covenant it was a religious
00:05:17.280 uh association it was defined by the bible this is not something that is supposed to be defined by the
00:05:24.240 uh no matter where you stand though on same-sex marriage obergefell was a horribly decided case no
00:05:31.320 matter where you stand on it uh thomas articulates one of the reasons why i had the majority allowed the
00:05:36.720 definition of marriage to be left to the political process as the constitution requires the people could
00:05:42.280 have considered their religious liberty implications of deviating from the traditional definition as part of
00:05:47.660 their deliberative process instead the majority's decision short circuits that process with potentially
00:05:52.840 ruinous consequences for religious liberty and still the left said in 2015 oh calm down you religious
00:05:59.760 archaic christian bigots no one is bothering you this has nothing to do with you if you don't want gay
00:06:05.380 people to get married then just don't be gay yourself this doesn't affect you at all your precious
00:06:10.060 liberty is fine it has taken four years four years that's a short amount of time only four years for a
00:06:16.860 democratic candidate for the president of the united states to say outright that yes if a religious
00:06:21.640 organization opposes same-sex marriage just opposes it they will no longer have tax exemption status which
00:06:27.880 means effectively the organization is going to be punished punished by the government for not aligning
00:06:33.900 with its definition of marriage which of course is unconstitutional this is what they hope to do
00:06:39.640 um this is a a definition of marriage by the way that is only i've said this a few times now that is
00:06:47.260 only four years old this new definition as between a man and a man or a woman or a woman of marriage
00:06:54.640 is four years old as uh as opposed to the traditional definition of marriage which is thousands of years
00:07:01.480 old if christians who have held the same orthodox beliefs about marriage for millennia are being told that
00:07:08.380 if you don't right now hop onto this train of progressivism which less than five years ago
00:07:15.380 redefined marriage as something that it has never been defined as then you are in trouble
00:07:21.220 and lest you think this is just crazy bedo uh yelling into the wind remember remember that the equality act
00:07:29.680 which is the democrats darling legislation that will not pass through the republican-controlled senate
00:07:34.420 right now but is going to be uh it's going to be held on to it's going to be pushed until it is
00:07:40.740 passed i guarantee you um in the years to come basically affirms the direction that bedo is headed
00:07:46.100 episode 115 covers the equality act in full but let me remind you what the equality act actually does
00:07:52.980 it makes irrelevant any religious or conscience exemptions for doctors um under this bill a doctor is
00:07:58.660 required to perform same sex uh or same sex sex change surgery and provide hormone therapy even
00:08:05.620 to children uh now they can maybe find protection under the free exercise arguments or other conscience
00:08:11.020 objection legislation but that's really unsure under the equality act uh religious schools would be
00:08:16.600 regulated under this act even if they take no funding from the federal government meaning they could
00:08:21.880 not choose to uh not hire or fire a teacher for example who is in a gay relationship or who was
00:08:27.940 transitioning you might not agree what these religious schools views but christian schools
00:08:33.900 operate under the bible and the bible is clear about marriage and gender and so by regulating them by the
00:08:40.400 government regulating them you are forcing them to ignore and condone uh what the bible says is sin
00:08:47.240 that is the opposite of religious liberty that is tyranny you can see that whether you're a christian or not
00:08:52.600 uh there is a supreme court case employment division versus smith that held that religious dissenter
00:08:57.900 are subject to are uh subject to generally applicable laws which means under the equality act there would
00:09:03.860 be very little uh some but very little recourse uh for religious people who object to these laws
00:09:10.740 also under the equality act athletic teams would be forced to allow transgender boys and girls
00:09:16.380 to compete on athletic teams that correspond with their gender identity rather than their biological sex
00:09:22.660 the law actually says that individuals cannot be denied access to a locker room or dressing room
00:09:29.780 no matter their gender or their gender identity the act also says that sexual orientation and gender
00:09:36.520 identity are protected classes of people as race and sex already are the supreme court is currently
00:09:42.700 deliberating on a case that would make sexual orientation and gender identity protected classes
00:09:47.500 um this likely means that private places of employment and religious organizations and religious schools
00:09:54.500 will be prohibited from choosing not to hire someone based on their gender identity or sexual orientation
00:10:00.600 the reason why that is different than not hiring someone based on their race or sex which we would
00:10:06.460 consider immoral the reason it's different not to hire someone as a religious organization based on their
00:10:11.300 sexual orientation or gender identity is because there is a moral component to it
00:10:15.540 there is a biblical component to it because as i've already said god already set up what marriage was
00:10:22.440 god already set up what gender and sex was in the bible uh there is no question on that so if you
00:10:29.100 have a biblical worldview there would be a moral and biblical reason not to hire someone who is
00:10:34.180 transgender or not to hire someone who is in a same-sex relationship you don't have to agree with that
00:10:39.420 if you're not a christian or if you don't hold this worldview i don't expect you to agree with that
00:10:43.640 but people who do have that worldview should have the freedom to exercise their religion as they see
00:10:48.720 fit um and if you think this won't soon apply to the curriculum that's taught in these private schools
00:10:54.900 and these christian schools you are crazy i promise you that christian schools are not immune from this

00:23:54.040 anti-discrimination law ought to be applied to all institutions but the idea that you're going to
00:23:58.240 strip churches of their tax-exempt status if they haven't found their way toward blessing same-sex
00:24:02.580 marriage i'm not sure uh he understood the implications of what he was saying i mean that means not only going to
00:24:09.420 war with churches but i would think with mosques and a lot of organizations that may not have the
00:24:14.240 same view of various religious principles that i do but also because of the separation of church and
00:24:18.740 state are acknowledged uh so if we want to talk about anti-discrimination law for school or organization
00:24:23.780 absolutely they should not be able to discriminate i'm not going to keep going on that so at first i was
00:24:29.240 thinking okay pete buddha judge good for him i think i would say this is part good for him at least he
00:24:33.820 understands politically that this is not very savvy uh to say that you're going to punish churches he
00:24:39.720 might be on the left side of the theological and the political aisle but he at least understands that
00:24:44.460 that's probably not the best way to go now do i think in practice he would advocate for something
00:24:49.080 like the equality act of course i do and do i think that he really cares too much about religious liberty
00:24:53.960 uh no i don't but he did bring up a good point about the separation of church and state and he actually
00:24:58.740 used it for once uh someone on the left used it in the right context the separation of church and
00:25:03.660 state first of all it's not in the constitution but it is a principle that is supposed to protect
00:25:08.520 the church from the state not the state from the church it's supposed to protect the church from the
00:25:13.360 state not the state from the church of course uh we have the first amendment that uh prohibits the
00:25:19.060 government from establishing a national religion but the separation of church and state was supposed to
00:25:24.820 protect the pulpit from the government saying what you can and can't say how you can and can't act
00:25:30.020 what you can and can't believe and he's right about that uh the separation of church and state is a
00:25:35.480 principle that is important not primarily for the state not primarily for the government it's not meant
00:25:40.580 to restrict religious people from believing what we want to believe but restricting the state from
00:25:45.920 infringing upon the rights of the church and that is what is at stake here the fact of the matter is
00:25:51.660 religious liberty and individual liberty is not a value that the left has they're not interested in
00:25:57.640 freedom they're not interested in liberty they're interested in control that is why they are advocating
00:26:02.420 now for socialism they would rather have forced equal mediocrity than unequal levels of wealth on
00:26:09.280 equal levels of success they want everything to be controlled in their minds they think that if they
00:26:14.280 can control everything if they can control all the variables then we will be in this equal utopia and

00:26:49.300 every totalitarian regime every socialist or communist country in the world or throughout history

00:27:06.420 exactly the path the democrats are forging and they don't care uh they they do not care marco rubio i
00:27:15.260 thought made a really good point when he explained on twitter that this is exactly why this is exactly why
00:27:23.680 so many people can't get on board with democrats there would be they they would win they would win every
