00:02:00.000 Many of the hostages were kept with supposed civilians in the Gaza Strip, giving the lie to the hard and fast distinction between Gaza's Hamas members and the civilian population.
00:02:09.000 But still, why can't the Israelis meet their Jew-hating terrorist enemies halfway?
00:02:14.000 Increasingly, this seems to be the logic of the Biden White House.
00:02:17.000 Although, to be clear, they aren't actually asking Israel to meet the Palestinians halfway, they're actually asking them to meet them about 80% of the way.
00:02:24.000 As Israel's offensive against Hamas renews in southern Gaza, the White House has now ratcheted up its absurd and continuous demands for Israel to do a, quote, better job protecting civilians, as though Israel is in the business of murdering civilians the same way Hamas is, or as though Israel isn't already taking insane precautions to avoid the killing of civilians.
00:02:41.000 Israel is actually taking more precautions to avoid civilian deaths than any army in modern history, as Ron Zermer, Israeli Minister of Strategic Affairs, pointed out over the weekend.
00:02:50.000 We saw the UNICEF director there in Tom Sufi Burrage's piece, and we heard Defense Secretary Lloyd Austin say that if that continues, this could be not only humanitarian disaster, but a strategic calamity for Israel.

00:03:03.000 Well, listen, we're doing everything we can to keep civilians out of harm's way.
00:03:07.000 I want the American people to understand this.
00:03:09.000 This war is not going on thousands of miles away.
00:03:12.000 It's going on literally hundreds of yards away, and it's going on at a time when rockets are flying into our country and we have people running to bomb shelters.
00:03:19.000 I think what the Israeli army has done in prosecuting this war is unprecedented in the history of warfare.
00:03:26.000 When you have an enemy right on your border, and you're doing everything to get the civilians of that enemy out of harm's way.
00:03:33.000 I don't think any other country, including the United States, I don't know if you ever faced a situation like this, would take such great care.
00:03:40.000 Yet Defense Secretary Lloyd Austin spent the weekend warning the Israelis that the government risks, quote, strategic defeat in Gaza, even if they win a, quote, tactical victory, because Palestinians, he said, might be driven into the arms of the enemy.

00:03:54.000 Israel can't get rid of Hamas without civilians dying, specifically because Hamas wants its own civilians to die.
00:04:01.000 If Israel does get rid of Hamas and civilians die, by Austin's logic, Israel will then suffer a strategic defeat.
00:04:07.000 And if Israel doesn't get rid of Hamas, Israel will suffer an actual defeat.
00:04:10.000 This is called a no-win scenario, and yet the White House seems eager to provide Israel with no-win scenarios lately.
00:04:16.000 Thus, the Biden administration is reportedly encouraging Israel to restore humanitarian aid into Gaza at the same levels as they did during the recent ceasefire.

00:04:26.000 First off, it removes all incentive for Hamas to come back to the table if the aid is something Hamas wants, since they steal it.
00:04:33.000 Giving them the aid while Hamas continues to hold hostages is ridiculous.

00:04:40.000 wants shipped into Gaza goes largely to Hamas.
00:04:43.000 Then, of course, the media lie about all of this, leading to awkward exchanges like this one between a Sky News reporter and a spokesperson for the IDF.

00:04:54.000 People don't have power to power up their mobile phones.

00:05:00.000 I mean, I think you and all of your viewers saw our hostages being paraded through the streets as they were released to Israel over those seven nights, and hundreds of Gazans holding their phones, videoing them.

00:06:15.000 It's also about what we need to do to recognize there must be some Plan for security for the region and I suspect as a plan develops it will take into account interim and then longer term.

00:06:59.000 According to the Associated Press over the weekend, three commercial ships in the Red Sea were struck by ballistic missiles fired from Houthi-controlled Yemen on Sunday, and a U.S.
00:07:07.000 warship shot down three drones in self-defense during the hours-long assault, according to U.S.
00:07:11.000 military sources.
00:07:12.000 Responsibility for the attack was claimed by the Houthi rebels who are backed by Iran.
00:07:16.000 In a statement, CENTCOM said that the attacks, quote, represent a direct threat to international commerce and maritime security.
00:07:22.000 They have jeopardized the lives of international crews representing multiple countries around the world.
00:07:26.000 It said the three commercial ships and their crews are connected to 14 countries.
00:07:30.000 According to Central Command, the USS Kearney, which is a Navy destroyer, detected a ballistic missile fired from Houthi-controlled areas of Yemen at the Bahamas-flagged bulk carrier Unity Explorer.
00:07:40.000 The missile hit near the ship.
00:07:41.000 Shortly afterward, the Kearney shot down a drone headed its way, although it's not clear if the destroyer was the target.
00:07:45.000 The drone was also launched from Yemen.
00:07:47.000 About 30 minutes later, the Unity Explorer was hit by a missile.
00:07:51.000 And while responding to the distress call, the Kearney shot down another incoming drone.
00:07:56.000 Central Command said the Unity Explorer reported minor damage from the missile.
00:07:59.000 Two other commercial ships, the Panamanian-flagged Bulk Carriers No.

00:10:06.000 55% of Democrats think the United States should send more humanitarian aid to the Palestinians, you know, the same people whose government attacked Israel on October 7th and who are stealing all that aid, compared with just 12% who think more military aid should be sent to Israel in the middle of a war.

00:10:23.000 According to Axios, quote, Muslim American leaders from Michigan, Minnesota, Arizona, Wisconsin, Florida, Georgia, Nevada, and Pennsylvania are expected to meet in Dearborn, Michigan, which is absolutely ground zero for radical Islamism in the United States, to launch what they call, quote, an Abandon Biden campaign.

00:11:32.000 His aim is to get Americans to consider whether continued support of Israel is worth the bloodshed he promises.
00:11:37.000 Bin Laden told the interviewer, quote, So we tell the Americans as people, and we tell the mothers of soldiers and American mothers in general, that if they value their lives and the lives of their children, to find a nationalistic government that will look after their interests and not the interests of the Jews.

00:18:38.000 Because apparently, the menorah lighting, which was scheduled for the second Sunday's Art and Music Festival on December 10th in Williamsburg, said that it did not want to appear to choose sides in the Israel-Hamas conflict.
00:18:49.000 Now, you may say to yourself, wait, what does lighting up a menorah have to do with the Israel-Hamas conflict?
00:18:52.000 And the answer is, nothing.
00:18:54.000 But, again, the idea is that if you even light a menorah, you are choosing sides.
00:18:57.000 Which, by the way, actually is kind of honest, because, let's be real, that is what one side wants.
00:19:02.000 Everyone who would light a menorah they want dead or expelled, that's the goal.
00:19:06.000 The event organizer claimed a Hanukkah celebration would send a message the festival was quote supporting the killing bombing of thousands of men women and children.
00:19:14.000 And, um, they even went further.
00:19:15.000 They offered to reinstate the event if the event called for a ceasefire.
00:19:19.000 So if you mirror the political priors of the people who are anti-semitic, then they will allow you to do what, uh, they will allow you to light your menorah.
00:19:28.000 Which, by the way, is rather counter to the... It's basically the Hanukkah story all over again.
00:19:32.000 The Hanukkah story is about the Greeks basically saying to the Jews they can't light the menorah, and the Jews then leading a massive revolt to stop them from impinging on their religious freedom.

00:21:39.000 Meanwhile, Cornell students According to Mediaite, protesting against Israel and the university's involvement with companies that do business with Israel occupied a campus building on Friday, holding signs condemning the war in Gaza, chanting from the river to the sea, Palestine will be free, which of course is a genocidal slogan, and holding a mock trial of the university president when Martha Pollack for, quote, complicity in genocide.
00:22:01.000 Students with the Cornell Coalition for Mutual Liberation, again, this is the intersectional coalition, organized the protest, which joined many other student demonstrations against Israel with other groups on campus, like Students for Justice in Palestine, which of course is a radical front group.
00:22:14.000 The groups first held a die-in on Thursday on campus.
00:22:17.000 They advertised the event as a, quote, occupation, and then leading up to a mock trial.
00:22:22.000 And then finally, they ended up occupying school buildings, They disrupted studying.
00:22:27.000 They prompted complaints to the dean.
00:22:29.000 They delivered a list of demands.
00:22:31.000 That included that the university take a strong stance against, quote, doxing of students.
00:22:36.000 By doxing, they mean if you take part in a protest and you show your face, that's a form of doxing.
00:22:39.000 Nobody's sending their home addresses.
00:22:41.000 It's now doxing to point out that a person participated in a protest.
00:22:44.000 The group demanded the university divest from Israel and declared that school is implicated in breaches of international law.
00:22:51.000 And then they held a trial of the president of the university and found her guilty of genocide and apartheid.
00:22:57.000 Why?
00:22:58.000 Because Cornell has ties to engineering, aerospace, and other tech companies.
00:23:02.000 It would be very difficult, by the way, to divest from, you know, the Palestinians because there are no businesses that actually succeed from those particular areas, mainly because they are run by corrupt... corruptocrats.
00:23:14.000 So, um, that all went particularly well.
00:23:17.000 The administration may end up meeting with them.
00:23:19.000 Probably the administration will end up caving to them because this is what these administrations do.
00:23:22.000 That's exactly what happened over at Brown University.
00:23:25.000 On Monday night last, the Brown University president, Christina Paxson, spoke at a vigil honoring a Palestinian student who'd been wounded in a shooting in Vermont.

00:23:36.000 The president was interrupted by protesters calling for the university to divest from Israel, of course.
00:23:42.000 Now, what's amazing is that the university published the speech as written on the website.
00:23:46.000 That is not how the speech was delivered.
00:23:49.000 According to the version on the website, she was supposed to say, quote, At a faculty meeting last month, I said that every student, faculty, and staff member should be able to proudly wear a Star of David or Donna Cathia on the Brown campus or to cover their head with a hijab or yarmulke.
00:24:02.000 But after the pro-Hamas students began heckling her, that line changed to quote every student, faculty, and staff member should be able to proudly don a keffiyeh on the Brown campus or to cover their head with a hijab.
00:24:14.000 So, um, there goes the Star of David and the Keepa and the Amaca.
00:24:19.000 So, yep, caving to all the worst people.
00:24:22.000 Again, that is what the left does.

00:24:42.000 According to Yahoo News, Venezuelan electoral authorities on Sunday claimed that 95% of voters in a non-binding referendum approved of the nation's territorial claim on a huge chunk of neighboring oil-rich Guyana.
00:24:55.000 By the way, that sounds like an amazingly free and fair vote in a socialist tyranny when 95% of people approve.
00:25:03.000 Well, that is one of my favorite things, by the way, about these tyrants, is that they will hold the elections in an attempt to show that they are in fact not tyrannies, and then they will stack the results so much that it's like 95 to 5.
00:25:12.000 It's like, guys, if you're gonna hide the ball, like, hide the ball a little bit.
00:25:15.000 Say it was like 65 to 35 or something.
00:25:17.000 But no, it's 95 to 5 that they should go in, crush Guyana, and steal all of its oil.
00:25:23.000 Maduro, who is the corrupt tyrant of Venezuela, hailed what he called, quote, an overwhelming victory for the yes throughout Venezuela.
00:25:30.000 Quote, we have taken the first steps of a new historic stage in the struggle for what belongs to us to recover what the liberators left us.
00:25:37.000 The referendum naturally raised fears in Guyana and around the region about Venezuela's ultimate intentions over the contested territory.
00:25:44.000 Maduro hopes the outcome of the referendum will strengthen his nation's century-old claim to the oil-rich Essequibo territory governed by Guyana.
00:25:51.000 The defense minister, Vladimir Padrino, said, quote, Today is a day of ratification of national sovereignty.
00:25:55.000 The people have done it with flying colors.
00:25:58.000 About 10.5 million votes were cast, according to the president of the National Electoral Council, Elvis Amoroso.
00:26:04.000 But the tally stirred confusion because an opposition politician suggested that each voter cast a total of five votes, one for each question on the referendum related to Venezuela's claim.
00:26:13.000 Apparently, it was like two million people who turned out.
00:26:17.000 The Maduro government said it was not seeking justification to invade or annex the huge territory.
00:26:21.000 But, of course, the whole point is a threat.

00:26:24.000 I mean, what they are saying, basically, is, sure, we might invade.
00:26:27.000 I mean, we have an absolutely good claim to, you know, the territory of our neighbor, so we should just... maybe we'll grab it, or maybe he'll sign us a bribe.
00:26:36.000 This is the same sort of shtick that Kim Jong-un routinely does in North Korea.
00:26:40.000 He drops some sort of nuclear test weapon, and then he asks for the West to pay him, said he won't do a bad thing.
00:26:47.000 Venezuela has claimed the huge territory of Essequibo for decades, even though its 160,000 square kilometers represent more than two-thirds of Guyana, and its population of 125,000 is one-fifth of the entire population of Guyana.

00:27:05.000 And again, that's only happening... Would that be happening under, say, a President Trump?

00:27:09.000 Meanwhile, the situation in Ukraine continues to be very bad for the Ukrainians.
00:27:15.000 They tried an all-out frontal assault on dug-in positions.
00:27:19.000 It didn't work.
00:27:20.000 Now, according to Politico, NATO Secretary General Jens Stoltenberg warned the Western military lines should be ready for bad news from the Ukrainian front as Kiev continues to defend against Russia's all-out invasion.
00:27:31.000 Stoltenberg says wars develop in phases.
00:27:33.000 We should also be prepared for bad news.
00:27:35.000 His comments come as Western allies debate over ammo and financial aid for Ukraine and Moscow is boosting its troop levels.
00:27:41.000 Russian President Vladimir Putin signed a decree on Friday to increase the number of soldiers by 170,000 to a total of 1.3 million.
00:27:48.000 The lines really have not moved very much.
00:27:51.000 Stoltenberg is calling on NATO members to ramp up the production of ammunition.
00:27:56.000 Now The reason that Putin is doing that is because he assumes that the West is going to essentially leave Ukraine defenseless.
00:28:02.000 The West should not do that.
00:28:03.000 The West should provide Ukraine with what is necessary in order to defend its own territory while looking for an off-ramp.
00:28:08.000 This, by the way, has been true since about two months into the war because it was perfectly clear from the outset of the war that the military goal of pushing Russia completely out of Crimea or the Donbass was not going to succeed.
00:28:17.000 Russia had spent 10 years entrenching itself in these areas and absent providing Ukraine with like F-22s, nothing was going to change in these particular areas.
00:28:27.000 Okay, with that said, Russia is sensing weakness and they are pushing, and they are pushing very, very hard.
00:28:32.000 Meanwhile, the left is concerned with the things that we are almost concerned about, right?
00:28:35.000 I mean, like, we might be concerned about the world being on fire, but what the left is concerned about is fossil fuels.
00:28:40.000 Now, maybe you think that that's crazy.

00:28:43.000 But, for the left, You have to understand that the chief moral priority on Earth right now is deindustrialization and redistributionism.

00:28:58.000 They believe the world is on fire because we're not setting quote-unquote more of an example.

00:29:07.000 It's by taking green initiatives in order to curb our own economic growth.
00:29:11.000 Now, ironically, the result of that is going to be the impoverishment of many of the countries that require actual economic health.

00:29:20.000 Richer countries tend to fight each other less.
00:29:22.000 So, I guess the idea here is impoverish everyone and then the world will become more peaceful.

00:29:28.000 So, the UAE climate chief, Sultan Al-Jubeir, he said yesterday, That the fossil fuel phase-out, this thing that's being pushed by the entire international community, is like, this is really dumb and it's not going to work.

00:29:44.000 We do not, I'm not in any way signing up to any discussion that is alarmist.
00:29:48.000 I am here factual and I respect the science.
00:29:50.000 And there is no science out there or no scenario out there that says that the phase-out of fossil fuel is what's going to achieve 1.5.

00:30:09.000 It is essential, but we need to be real, serious, and pragmatic about it.

00:37:34.000 One, Pope Francis did take action against one of his biggest critics, according to The Blaze.
00:37:38.000 This is the second time this month Pope Francis punished an American prelate.
00:37:41.000 Pope Francis punished Cardinal Raymond Burke, 75-year-old canon lawyer from Wisconsin.
00:37:45.000 He revoked Burke's salary and his subsidized Vatican apartment.
00:37:49.000 He was living, like other cardinals in Rome, in his apartment for free.
00:37:52.000 He received a monthly stipend of about $5,000.
00:37:54.000 He said that he was taking action against Burke because he was a source of disunity, according to an anonymous participant, in a particular conversation on November 20th.
00:38:04.000 Another unnamed source said Francis punished Burke because he was using his privileges against the church.
00:38:08.000 Reports from earlier this week claim that the Pope said of Burke during the meeting, quote, Cardinal Burke is my enemy, so I take away his apartment and his salary.

00:38:17.000 I never used the word enemy or the pronoun my.
00:38:20.000 I simply announced the fact of the meeting of the disaster he had without giving specific explanations.

00:38:40.000 What he does, he issues these sort of vague exclamations about, say, LGBTQ issues inside the church, or say, about female priests.

00:38:51.000 He just makes really vague statements that seem to open the door.
00:38:53.000 And then when asked for clarification, he says, how dare you ask for clarification?

00:38:57.000 No, you weren't, or nobody would be asking the questions.

00:39:01.000 And then on the other hand, you've got the Pope calling for the elimination of fossil fuels.
00:39:05.000 Which, by the way, for a church that is seeking new adherence in the poorest parts of the world, it turns out that you know what they actually need?

00:39:13.000 I'm sorry to break it to the Pope and everybody else in the environmentalist corner, the single most efficient source of fuel on the planet remains fossil fuels.

00:40:43.000 Okay, meanwhile, closer to home, over the course of the last few days, the Congress expelled George Santos.
00:40:49.000 He currently faces 23 federal charges, including fraud and identity theft.
00:40:53.000 He has pled not guilty.
00:40:55.000 Before Friday's expulsion, which passed 3-11 to 1-14, only five people in history had been booted by the House.
00:41:00.000 Three were removed in 1861 because they actually served in the active Confederacy.
00:41:04.000 The other two, in 1980 and 2002, according to the Wall Street Journal, were convicted of serious crimes.
00:41:09.000 So, Congress moved to boot Santos because he's pretty obviously guilty of all this stuff.
00:41:13.000 However, setting a precedent of booting members before they've actually been convicted of a crime, that's going to open the door to a lot of things.
00:41:20.000 And once you start booting members based on the fact that they've been accused of a crime, welcome to Congress, where half of Congress is accused of a crime.
00:41:28.000 As the Wall Street Journal editorial board points out, said, it's no good to argue that Santos is a fabulous who fibbed his way into office.
00:41:34.000 How is that a distinction with other members of the Congress?
00:41:38.000 What's the rule now?
00:41:38.000 Shortly after Santos' ouster, Pennsylvania Senator John Fetterman renewed his call to eject Senator Bob Menendez.
00:41:43.000 If you're going to expel Santos, how can you allow somebody like Menendez to remain?
00:41:48.000 He said Menendez, I think, is a senator for Egypt.
00:41:51.000 Because that's the accusation, is that he was paid off by foreign countries.
00:41:55.000 So, yeah.
00:41:56.000 So it may now be that in Congress, an accusation is tantamount to a conviction.
00:42:01.000 And really that started with the anti-Trump movement.
00:42:03.000 Because again, the accusations against Trump based on Ukraine, based on Russia, and all the rest of this sort of stuff, were considered sufficient to push an impeachment inquiry into him.
00:42:11.000 And so now the accusation is going to be tantamount to the actual conviction.
00:42:15.000 So regardless of what you think of Santos, and I think he's a ridiculous figure, Almost as ridiculous as, you know, one-third of the rest of Congress.
00:42:21.000 But if the new standard is accused equals guilty, then welcome to Congress where there are like five people left.
00:42:27.000 And meanwhile, Donald Trump versus Joe Biden, that race continues to move forward.
00:42:34.000 House Democrats are realizing that Bidenomics is a giant fail.
00:42:37.000 According to Axios, House Democrats have rejected the White House's months-long campaign to sell Bidenomics.
00:42:42.000 They stopped pushing the term months ago.
00:42:44.000 The Democratic Congressional Campaign Committee and House Majority PAC, two key fundraising arms, are avoiding using the term Bidenomics on social media and press releases because they say the tagline is ineffective.
00:42:54.000 In a meeting this past summer, House Democrats stuck with people over politics rather than Bidenomics.
00:43:01.000 Apparently, according to Democratic sources, they're saying that Bidenomics presents a bunch of issues.
00:43:05.000 They say it's tone deaf because there are a bunch of people who don't like the economy.
00:43:09.000 One Democratic strategist said the biggest problem wasn't using Biden, but the term was too philosophical and required too much explanation.
00:43:15.000 So they're going to continue to push Bidenomics policies, they just won't use the catchphrase Bidenomics because they try and fail.
00:43:21.000 And there is some hilarity to that because the reason Bidenomics became a thing is because Obamanomics was a thing and Obama was personally popular.
00:43:29.000 So linking Barack Obama, a personally popular president, with his failing policies made the policies somewhat more popular.
00:43:35.000 Attaching Biden's name to his bad economic policies makes his bad economic policies worse for the American people.
00:43:41.000 So Democrats are running headlong from Joe Biden in the 2024 election, which is not a good sign for Joe Biden, which means the real hope for Democrats is not Joe Biden.
00:43:51.000 The real hope for Democrats is that somehow, someway, people show up to vote against Donald Trump.
00:43:55.000 That is a very dicey proposition.
00:43:58.000 They're basically making two separate arguments.
00:43:59.000 One is that Donald Trump will be a dictator.

00:44:02.000 Plus, they're making the argument that Donald Trump is a criminal.
00:44:05.000 The problem there for Trump is that he doesn't have to be a criminal to be convicted as a criminal in places like Washington, D.C.

00:45:29.000 The latest Messenger Harris X poll has Trump up 52 to 48 on Joe Biden in the polling average.
00:45:33.000 Trump is up almost two points, 47 to 45.3.
00:45:38.000 Biden has led in only two of the last maybe 10 polls.
00:45:41.000 These are very bad numbers for Joe Biden.
00:45:43.000 And again, it's not that his numbers have gone down.
00:45:45.000 They haven't.
00:45:45.000 They've been pretty stagnant.
00:45:47.000 In fact, they're a little bit up from where they were back in June.
00:45:50.000 The problem is that the numbers for Trump have risen pretty dramatically.
00:45:52.000 Why are those numbers rising?
00:45:53.000 Because Trump isn't in the news.
00:45:55.000 Well, Democrats have two ways of putting Trump back in the news.
00:45:57.000 That is their actual strategy.
00:45:58.000 One is, claim that Donald Trump is going to be a tyrant.
00:46:01.000 And the other is, criminal conviction.
00:46:04.000 Those are the two big plans.
00:46:05.000 So, on the Trump is a tyrant side, Robert Kagan, a Post Opinions contributing editor, has a piece over at the Washington Post called, A Trump Dictatorship Is Increasingly Inevitable.

00:46:20.000 No one thinks Trump is going to become dictator of America.
00:46:22.000 You know how you become dictator of America?
00:46:24.000 By taking control of the military.
00:46:25.000 Do you think the military is simply going to go along with Donald Trump's plans to completely subvert the Constitution of the United States?

00:46:37.000 And what's funny is that the elements of dictatorship that they suggest are all things that Democrats are currently doing.

00:46:45.000 Oh, you mean like Democrats have taken over the bureaucracy for like a hundred years?

00:46:53.000 Oh, you mean like Democrats have been trying to stack the courts for, you know, the last several generations?
00:46:58.000 You know, what exactly is it that Trump is going to do that's so insanely dictatorial?
00:47:03.000 Well, according to Robert Kagan, the next phase is about people falling in line.
00:47:09.000 He's talking about how Trump is going to pick up the nomination in all likelihood.
00:47:13.000 And then he says Trump will not only dominate his party, he will become the central focus of
00:47:16.000 everyone's attention. Even today, the news media can scarcely resist following Trump's every word
00:47:20.000 and action. Once he secures the nomination, he will loom over the country like a colossus,
00:47:25.000 his every word and gesture chronicled endlessly. So first of all, that was true of Obama as well.
00:47:30.000 But then the idea is going to be that once he takes power, something terrible is going to happen.
00:47:37.000 If Trump does win the election, he will immediately become the most powerful person ever to hold that office.
00:47:41.000 Not only will he wield the awesome powers of the American executive, but he will do so with the fewest constraints of any president, fewer even than in his own first term.
00:47:49.000 What limits those powers?
00:47:51.000 The most obvious answer is the institutions of justice, all of which Trump by his very election will have deviled, defied, and revealed as impotent.
00:47:58.000 A court system that could not control Trump as a private individual is not going to control him better when he's President of the United States and appointing his own Attorney General and all the other top officials at the Justice Department.
00:48:08.000 Are you kidding me?
00:48:09.000 So, in other words, because Trump is going to nominate his own AG, this makes him a dictator?
00:48:13.000 I would like to introduce you to Merrick Garland.
00:48:16.000 Or going all the way back to Clinton, Janet Reno.

00:48:34.000 The final constraint on presidents has been their own desire for a glittering legacy, but is that the way Trump thinks?

00:48:42.000 Will his presidency turn into a dictatorship, says Robert Kagan?
00:48:44.000 The odds are, again, pretty good.
00:48:46.000 What, what exactly, what the hell?

00:48:51.000 He says that his administration will be filled with people with enemies lists.
00:48:54.000 A determined cadre of vetted officials will see it as their sole presidentially authorized mission to root out those in the government who cannot be trusted.
00:49:01.000 Many will be fired.
00:49:02.000 Others will be subject to career-destroying investigations.
00:49:04.000 Again, like...
00:49:05.000 This is so tiresome and it's not going to hunt.
00:49:06.000 This dog is not going to hunt, which means that in the end, what Democrats are really relying upon is not scaring the hell out of you about Trump.
00:49:12.000 It's going to be criminal conviction.
00:49:13.000 The bad news for Trump is that criminal conviction is a high likelihood given the latest developments in Washington, D.C.
00:49:19.000 So Andy McCarthy over at National Review points out that over the weekend, Trump was dealt two defeats in Washington, D.C.
00:49:25.000 federal courts.
00:49:27.000 Judge Tanya Chutkin, who's presiding over the criminal case with regard to January 6, 2020, ruled that he is not immune from criminal prosecution.
00:49:34.000 Now, it was unlikely he was ever going to get a ruling in his favor, but it could determine the viability of Trump's 2024 presidential bid, according to McCarthy.
00:49:42.000 According to McCarthy, Chutkin's 48-page opinion rejected the former president's claims that the First Amendment barred his prosecution by the Biden Justice Department special counsel, Jack Smith.
00:49:53.000 Listen, he says, I've periodically spotlighted the immunity issue.
00:49:56.000 It's not that I thought Trump had much of a chance of prevailing.
00:49:58.000 He says, the immunity issue is critical for Trump because it is appealable pretrial and thus potentially a vehicle for delay.
00:50:04.000 And delay is Trump's main strategy, but that just got shot down.
00:50:06.000 So there is no delay.
00:50:08.000 He says, trials are not won by legal claims, which are argued outside the jury's presence.
00:50:12.000 Jury trials are won by factual evidence.
00:50:14.000 A good deal of the evidence against Trump is unsavory.
00:50:16.000 But, but it doesn't really matter because it's a DC jury.
00:50:21.000 He says that Trump recognizes he could be very well convicted in the federal election interference case.
00:50:26.000 He knows that recent polling, which showed him leading Biden on a number of battleground states, indicated a material slice of his support would fall away if convicted in one or more criminal cases.
00:50:37.000 He says that the delay tactic was Trump's best option, and now the delay tactic is probably going away.
00:50:43.000 He says he thinks that the appeal by Trump is probably going to be rejected by the Supreme Court.
00:50:49.000 He says, And let's say that he's convicted.
00:50:50.000 most is this, it is doubtful the former president and current
00:50:52.000 JP front runner will get the delay he seeks in his election interference case. He's very likely to be facing a criminal
00:50:57.000 trial in Washington running from March to May 2024. And defendants
00:51:02.000 are required to be in attendance throughout the entire federal
00:51:04.000 criminal trial. And let's say that he's convicted. He says that he thinks Chudkin would exercise a broad authority to
00:51:12.000 allow him to remain at liberty pending sentencing, which is about three months after travel, that means just that he
00:51:16.000 would be sentenced if convicted May, June, July, August.
00:51:19.000 So in August.
00:51:21.000 So as McCarthy says, if Trump were convicted and sentenced to a term of imprisonment, the default position of federal law would call for the revocation of bail and an order that he be remanded.
00:51:29.000 That presumption could be overcome only if Chutkan made a finding that Trump's appeal raised a substantial issue likely to result in reversal of the conviction, which is probably unlikely.
00:51:39.000 So we may enter the final days of the 2024 election with Trump actively in prison.
00:51:43.000 That is a thing that may actually happen now that Chutkan has basically rejected all arguments to the contrary.
00:51:49.000 That is the plan.
00:51:50.000 And so when Trump says this is election interference, he is certainly not wrong, at least when it comes to that DC case, which is a debacle.
