Summary

Supreme Court rules 9-0 that states can't randomly remove a presidential candidate from the ballot. Reaction from the far-left, including Colorado's Democratic Secretary of State, Jenna Griswold, says that democracy is at risk, and that the Supreme Court should have left Donald Trump on the ballot at all. I explain why this is a bad legal theory, and why it's a bad idea in the first place. I also explain why Congress should have the authority to act on this matter, not the state level. And I give my thoughts on whether or not this is good or bad news for democracy, and whether it's up to the American voters to save our democracy in November, or whether we'll just have to wait and see what happens in the election. I also talk about why I think this is not a good idea, and what it means for democracy in general, and how we need to prepare for the November election, which is a referendum on whether Donald Trump should be allowed to run for president again or not, and if we should vote for him or not. I don't know, but I think it's going to be a good one. Thank you for listening, and tweet me what you think! Transcript

00:00:00.000 Well, yesterday, the Supreme Court disappointed everyone on the far left by ruling 9-0 that actually states can't just randomly take presidential candidates off the ballot.
00:00:10.000 And they did so for a couple reasons, as we discussed yesterday.
00:00:13.000 They said that, first of all, states don't have the ability to remove federal candidates because federal candidates are candidates for federal office.
00:00:20.000 And second, they said that if you are going to define insurrection under the 14th Amendment, that has to be done by Congress, not by some rando at the state level.
00:00:27.000 Regardless of the rationale, the 9-0 decision has made people very, very, very angry on the left.
00:00:33.000 They believe that they understood the law, and by understood the law, they mean that they thought that they finally had Trump.
00:00:39.000 Every time they think they have Trump, it's like the ending of a Scooby-Doo cartoon.
00:00:44.000 Like, we unmasked him!
00:00:45.000 Oh no, we would have gotten away with it if it weren't for those darn kids!
00:00:48.000 And then Scooby-Doo goes RRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRR Likely nominee, foregone nominee, that the person who is currently leading Joe Biden by an outside the range of error amount in all the national polling.
00:01:17.000 So yesterday, the Colorado Secretary of State, the person who initiated this entire stupid process in the state of Colorado, a person named Jenna Griswold, she said that, well, you know, now that the Supreme Court has said that we can't just remove Donald Trump from the ballot, democracy is At threat.
00:01:32.000 I mean, democracy may in fact collapse because people might vote.
00:01:35.000 And I know what you're thinking to yourself, which is, hold up.
00:01:37.000 People might vote so democracy is at risk?
00:01:41.000 That is legitimately what people on the left think about Donald Trump.
00:01:43.000 Donald Trump might win, therefore democracy is at risk.
00:01:46.000 We have to stop you from voting because we have to save democracy.
00:01:49.000 Here was the Colorado Secretary of State yesterday.
00:01:52.000 First and foremost, I would say it's good that the court issued a decision.
00:01:57.000 Americans have been voting all across the nation in early voting in those Super Tuesday states, including here in Colorado.
00:02:05.000 And Coloradans and Americans deserve to know whether Trump is a qualified candidate.
00:02:11.000 My larger reaction is disappointment.
00:02:14.000 I do believe that states should be able, under our Constitution, to bar oath-breaking insurrectionists.
00:02:21.000 And ultimately, this decision leads open or leaves open the door for Congress to act to pass authorizing legislation.
00:02:29.000 But we know that Congress is a nearly non-functioning body.
00:02:34.000 So ultimately, it will be up to the American voters to save our democracy in November.
00:02:40.000 Oh no, the American voters might have to save our democracy.
00:02:42.000 You mean by voting?
00:02:44.000 Wow, I know, what a concept.
00:02:46.000 Now, the reality of the situation is this is a stupid legal theory in the first place.
00:02:51.000 It was put out there by some anti-Trump people on the right and a bunch of anti-Trump people on the left.
00:02:56.000 As the Wall Street Journal points out, the disqualification push against Trump was embraced by an ideological mix of legal scholars and Trump opponents.
00:03:03.000 It relied on Section 3 of the 14th Amendment, which was ratified after the Civil War and added several of the Union's objectives to the Constitution.
00:03:09.000 Among them was barring disloyal office holders from returning to power.
00:03:12.000 But the entire purpose there was that the federal government was going to stop the state from actually allowing on the ballot people who were insurrectionists, who were part of the Confederacy.
00:03:22.000 Maine had tried to jump on the Colorado bandwagon.
00:03:24.000 Illinois had tried to jump on the Colorado bandwagon and said the Supreme Court ruled 9-0 that this was a bunch of nonsense.
00:03:31.000 Now, when the Supreme Court rules 9-0 on an issue, there's a very, very high chance that This is just bad legal theory.
00:03:38.000 If this has been a 5-4 decision, even a 6-3 decision, you could see people on the left saying, well, you know, it's a conservative Supreme Court majority.
00:03:44.000 The problem for the left, of course, is that this was 9-0.
00:03:47.000 You had people like Ketanji Brown-Jackson voting the same way as Clarence Thomas on this particular case.
00:03:53.000 And this has led people like my old friend David French to write a piece in the New York Times lamenting the death of the Constitution.
00:03:59.000 I mean, when David is far to the left of Ketanji Brown Jackson on this issue, you know that people's brains have been boiled by the Trump of all of this.
00:04:08.000 He has an entire piece in the New York Times titled, The Supreme Court Just Erased Part of the Constitution.
00:04:14.000 No, they absolutely didn't.
00:04:15.000 It just requires an enabling act of Congress in order to define insurrection.
00:04:20.000 But again, the brain boiling was across the board.
00:04:23.000 Here are just some of the members of the media who were awash in tears yesterday.
00:04:30.000 We've learned that it was a 9-0 decision ruling that Donald Trump can be on the ballot in Colorado and other states.
00:04:37.000 I'm not confident that that will produce a result that's good for American democracy.
00:04:43.000 This is actually what I had been concerned about.
00:04:45.000 I had been concerned that should it go to the Supreme Court, they would rule this way.
00:04:50.000 I'd laugh if it weren't so sad.
00:04:52.000 My next guest says Donald Trump is still an oath-breaking insurrectionist.
00:04:55.000 Do you have confidence in the Supreme Court?
00:04:57.000 Do you think this court is partisan?
00:04:58.000 The court itself may have overstepped.
00:05:01.000 The court went way further than it needed to go.
00:05:04.000 Our colleague Melissa Murray has called this Supreme Court the YOLO court.
00:05:08.000 The criticism of the court is that they're playing interference.
00:05:11.000 Not since Bush v. Gore have we seen a court that's had this many opportunities to interfere in the election.
00:05:18.000 The other thing, stepping back, Ana, is that this is another example among many that are playing out right now of the Supreme Court playing a huge role in American elections.
00:05:30.000 Now, if you just watched those clips, you would assume this was a 5-4 decision in favor of President Trump.
00:05:35.000 It was 9-0.
00:05:36.000 That's how far outside the legal mainstream these theories were, and that's how far outside the norm the media are, our legacy media.
00:05:43.000 We'll get to more on this in just a moment.
00:05:45.000 First, financial experts thought we were in the clear.
00:05:47.000 While experts anticipated rate cuts from the Fed, inflation in the United States remains a significant economic concern.
00:05:53.000 Think about it.
00:05:54.000 The U.S.
00:05:54.000 is in the hole by $34 trillion, but we're going to continue to print money and borrow money.
00:05:59.000 Which means the prices that you pay every day are going to continue to rise.
00:06:02.000 So, we can either bury our heads in the sand, or we could, you know, do the smart thing that you do financially, which is diversify.
00:06:08.000 Diversify a portion of your savings into gold with Birch Gold Group.

00:06:38.000 Text Ben to 989898 right now.
00:06:40.000 Again, diversification, just a smart fiscal strategy.
00:06:42.000 Go check them out right now.
00:06:43.000 Text Ben to 989898 to get started.
00:06:46.000 For his part, here's Donald Trump thanking the Supreme Court for the decision.
00:06:51.000 I want to start by thanking the Supreme Court for its unanimous decision today.
00:06:56.000 It was a very important decision.
00:06:58.000 We're very well crafted.
00:07:00.000 And I think it will go a long way toward bringing our country together, which our country needs.
00:07:07.000 And they worked long, they worked hard, and frankly, they worked very quickly on something that will be spoken about 100 years from now and 200 years from now.
00:07:19.000 Extremely important.
00:07:22.000 Okay, fine.
00:07:22.000 It's kind of a normal statement from President Trump.
00:07:25.000 Now, as I say, it wasn't just the legacy media going nuts.
00:07:28.000 Members of the left were going totally insane.
00:07:30.000 I mean, truly crazy yesterday.
00:07:32.000 So, you always have to count on the geniuses over at The View to put in their two cents of stupidity.
00:07:37.000 Here's Whoopi Goldberg yesterday, very irritated by the Supreme Court of the United States, because as a graduate of Harvard Law School, as a long-standing constitutional jurisprudentialist, Whoopi Goldberg has thought, The thing that bothers me about this, and I know it's probably the right decision, but I don't like that we've normalized this man.
00:07:59.000 It has really irritated the poop out of me that we have normalized him and his bad behavior.
00:08:07.000 I get that the law says, listen, it would be really rough and it should be the Congress that makes these decisions.
00:08:14.000 And yet that's not how we've been acting.
00:08:17.000 We put, we keep saying state's laws.
00:08:19.000 We keep giving people the right to make these changes and then they make a change and they say, well, we don't want this.
00:08:25.000 And everybody says, well, no, of course we shouldn't want this.
00:08:28.000 Okay, no one knows what she's talking about.
00:08:31.000 Everyone just has terrible images now in their mind because of Whoopi Goldberg.
00:08:35.000 She wasn't the only one to have bathroom thought about this particular decision.
00:08:39.000 Keith Olbermann, I know he's been out in the wilderness for a while, but it is worthwhile remembering that Keith Olbermann was once a respected voice on MSNBC.
00:08:47.000 He had a very highly rated show on MSNBC, actually, if you go back about 15 years.
00:08:52.000 And again, it just demonstrates the revolving door between the asylum and MSNBC.
00:08:58.000 Or jail and MSNBC.
00:09:00.000 Or should be jail and MSNBC.
00:09:01.000 I mean, Al Sharpton has a show on MSNBC.
00:09:04.000 In any case, Keith Olbermann, who is just out of his mind at this point, he tweeted out, The Supreme Court has betrayed democracy.
00:09:11.000 Its members, including Jackson, Kagan, and Sotomayor, have proved themselves inept at reading comprehension.
00:09:16.000 And collectively, the court has shown itself to be corrupt and illegitimate.
00:09:21.000 It must be dissolved.
00:09:23.000 I've been working on that Olbermann impression for years.
00:09:27.000 He used to be funny when he was on ESPN.
00:09:30.000 And so he says that the court has to be dissolved because, of course, they are inept at reading comprehension.
00:09:35.000 But he, given his degree from the Cornell School of Agriculture, I'm not kidding, and his legal knowledge gained from years of shouting enfuego, Those aren't tears, fascist!
00:09:49.000 They're urine!
00:09:50.000 So somebody tweeted back at him, cry more 9-0.
00:09:54.000 And then he tweeted back something cryptic and odd.
00:09:57.000 Quote, those aren't tears fascist.
00:10:00.000 They're urine.
00:10:01.000 I'm sure you enjoy being bathed in it.
00:10:11.000 I don't even know.
00:10:13.000 Like, I'm confused.
00:10:14.000 The guy said to him, cry more, and then is he peeing on his own face?
00:10:19.000 Said those aren't tears, fascist, they're urine.
00:10:22.000 In his own eyes?
00:10:25.000 It's unbelievable.
00:10:25.000 We're now just doing scenes from, like, Happy Gilmore.
00:10:28.000 Remember when Shooter McGavin says to Happy Gilmore, I ate pieces of bleep like you for breakfast.
00:10:31.000 And then Happy Gilmore says, you ate pieces of bleep for breakfast?
00:10:35.000 This is where we are now.
00:10:37.000 Solid stuff there from Keith Olbermann.
00:10:38.000 He's peeing in his own eyes to fight Trump.
00:10:40.000 It's a strategy.
00:10:41.000 It's a strategy.
00:10:42.000 Meanwhile, the House Democrats are threatening that they're now going to try to pass a bill that would codify Trump's behavior as insurrection under the Constitution.
00:10:48.000 Good luck with that.
00:10:50.000 Representative Jamie Raskin said on Tuesday on CNN that the Supreme Court unanimously overturning that Colorado Supreme Court ruling means that the Congress has to take it up.
00:11:00.000 So Raskin said that he is going to actually now push with a number of my colleagues, including Debbie Wasserman Schultz and Eric Swalwell.
00:11:07.000 Yeah, he's the one who was stripping a Chinese spy to revive legislation that we had set up a process by which we could determine that someone who committed the insurrection is disqualified by Section 3 of the 14th Amendment.
00:11:17.000 So the question is whether Mike Johnson would allow us to bring this to the floor of the house.
00:11:20.000 I mean, the answer is no.
00:11:21.000 It's not going to happen.
00:11:23.000 But all of this demonstrates there is a wide gap that has now emerged in life between the radical left and reality.
00:11:30.000 And when even the moderate left or people who have a job, like, say, the radicals on the Supreme Court of the left who still have a job, which is to read text, like Sonia Sotomayor, who's a far left person, or Ketanji Brown-Jackson, a very far left person, or Elena Kagan, who's sort of on the moderate left.
00:11:45.000 Those three people voted in favor of the 9-0 decision here, and there's a complete disconnect between those people and the radical base.
00:11:51.000 And as we've been discussing, because it is the single most important factor in the upcoming 2024 election, Joe Biden has found himself enthralled to the radicals at the expense of the moderates.
00:12:02.000 And that is why he is losing.
00:12:03.000 He is bleeding support from the middle.
00:12:05.000 He's losing support among the base.
00:12:08.000 But the truth is that that support that he's losing among young people, for example, That is a marginal loss of support, considering that's a low-propensity voting group in the first place.
00:12:15.000 The people who are very high-propensity are independent, college-educated people who swing vote.
00:12:22.000 And those people are not looking at Joe Biden and seeing somebody who's on the same page that they are.
00:12:27.000 And so the more Joe Biden is enthralled to his radical left, and the further left that radical left moves, the worse it is for Joe Biden and the Democratic Party.
00:12:34.000 So how far left has the radical left moved?
00:12:37.000 They've moved so far left that now even Alexandra Ocasio-Cortez is not far left enough for them.
00:12:43.000 We'll get to more on this in just one moment.
00:12:45.000 First, Grand Canyon University.
00:12:47.000 It's a private Christian university in beautiful Phoenix, Arizona.
00:12:50.000 GCU believes that our creator has endowed us with certain unalienable rights, life, liberty, and the pursuit of happiness.
00:12:56.000 They believe in equal opportunities and that the American dream starts with purpose.
00:13:00.000 GCU equips you to serve others in ways that promote your flourishing.
00:13:03.000 creating a ripple effect of transformation for generations to come.
00:13:05.000 Whether you're pursuing a bachelor's, master's, or doctoral degree,
00:13:09.000 GCU's online on-campus hybrid learning environments, they're all designed to help you achieve your degree.
00:13:13.000 Find your purpose today at Grand Canyon University.
00:13:15.000 Private, Christian, affordable.
00:13:17.000 Visit gcu.edu.
00:13:18.000 That's gcu.edu.
00:13:20.000 So in what had to be the most amusing piece of video of the year,
00:13:25.000 Alexander Ocasio-Cortez went to see Dune II yesterday with her partner
00:13:32.000 and she was then chased down the street by fellow left-wing radicals who demanded
00:13:37.000 that she say the word genocide with regard to Israel's behavior in the Gaza Strip,
00:13:42.000 which obviously is not a genocide.
00:13:45.000 And she got very mad.
00:13:46.000 She got very, very angry, did Alexander Ocasio-Cortez.
00:13:50.000 Because the revolution always eats its own.
00:13:52.000 So shed a tear for the poor, working-class revolutionary who is now being beheaded by her own movement.
00:13:59.000 Here is Alexandria Ocasio-Cortez being confronted by people making good trouble against Alexandria Ocasio-Cortez.
00:14:07.000 You refuse to call it a genocide.
00:14:08.000 I need you to understand that this is not okay.
00:14:12.000 It's not okay that there's a genocide happening and you're not actively against it.
00:14:15.000 You're lying.
00:14:17.000 I'm lying?
00:14:18.000 You went on TV and avoided talking about it.
00:14:20.000 For those who can't see, she's walking down the escalator and she's being followed by activists.
00:14:28.000 We can't call it a genocide.
00:14:33.000 She stops to confront the activists.
00:14:35.000 She's starting to lose her temper.
00:14:37.000 You haven't been calling it a genocide.
00:14:39.000 Don't tell me I'm lying.
00:14:41.000 You've been to say it's a genocide.
00:14:43.000 Just say it.
00:14:45.000 Over 35,000 people are dead.
00:14:47.000 Are dead AOC.
00:14:49.000 You can't just say it for once.
00:14:51.000 Just say the word. That's it.
00:14:53.000 That's all we want you to say.
00:14:55.000 You're not angry about people confronting the public.
00:14:57.000 You can't call it genocide.
00:14:59.000 Over 35,000 people are dying.
00:15:01.000 They're still following her down the street.
00:15:03.000 Stop.
00:15:05.000 I'm pretty good.
00:15:07.000 And then her husband turns around and says stop.
00:15:12.000 Cut it and you're going to cut this and you're going to clip this so that it's completely out of context.
00:15:18.000 I already said that it was.
00:15:20.000 And y'all are just going to pretend that it wasn't over and over again.
00:15:22.000 It's f***ed up, man.
00:15:24.000 You're not helping these people.
00:15:25.000 And you're not helping them.
00:15:27.000 You refuse to.
00:15:27.000 You're not helping them.
00:15:31.000 You're not helping, she's so mad.
00:15:32.000 Oh man, maybe she'll break into a dance number now.
00:15:35.000 Alexander Ocasio-Cortez, your genius, leading light of the revolution inside Congress.
00:15:41.000 By the way, we should recall that it was AOC who back in 2020 tweeted the following, quote, the whole point of protesting is to make people uncomfortable.
00:15:48.000 Activists take that discomfort with the status quo and advocate for concrete policy changes.
00:15:51.000 Popular support often starts small and grows.
00:15:54.000 To folks who complain, protest demands make others uncomfortable.
00:15:57.000 That's the point.
00:15:59.000 Ooh!
00:15:59.000 Ooh!
00:16:00.000 She was such a spicy revolutionary until the point when she was confronted with her own revolutionary useful idiot cadre.
00:16:08.000 Again, that gap between normies and the far left is growing.
00:16:12.000 When AOC is now part of the intellectual dark web or something, like AOC has now been left behind.
00:16:19.000 She's in the moderate middle by the far left and Joe Biden is still chasing those activists down the sidewalk trying to pander to them while they are busy massaging the prostates of the members of Hamas.
00:16:27.000 No, good luck to all of you.
00:16:29.000 Good luck.
00:16:29.000 You're the ones who jumped in bed with the revolutionaries.
00:16:31.000 And now you're going to have to deal with that.
00:16:34.000 Again, it is amazing how the Democratic Party has moved so far to the left.
00:16:37.000 So Michael Moore, who used to be seen for what he is a crazy left winger.
00:16:42.000 So Michael Moore, you'll recall in 2004, there was a big controversy.
00:16:45.000 If you remember this far back, I do because I covered politics then.
00:16:49.000 In 2004, there was a huge controversy at the Democratic National Convention because Michael Moore, who was a propagandist documentarian, was seated in a presidential box at the DNC with Jimmy Carter.
00:17:01.000 And that was controversial because Michael Moore's a nutcase.
00:17:04.000 Now Michael Moore has become one of the voices of the Democratic Party because that's how far left the Democratic Party has moved over time.
00:17:10.000 Again, you want to know why people like Joe Rogan and Elon Musk are now talking about voting Republican?
00:17:14.000 It's because the Democratic Party is now enthralled to people like Michael Moore.
00:17:18.000 Michael Moore, again, here he was yesterday talking about Israel and Gaza and suggesting that Joe Biden has to abandon Israel in order to win over his left flank.
00:17:27.000 Again, let's be real about this.
00:17:29.000 The broad spectrum of Americans are much more supportive of Israel than they are of Hamas.
00:17:34.000 But the Democratic Party is kind of split on the issue, which is wild since Hamas is a genocidal terror group that murders gay people, seeks to kill every Jew in sight, hates women, and all the rest.
00:17:43.000 Here is Michael Moore suggesting, falsely, that Joe Biden is enthralled to the authoritarian Bibi, which again, that's hilarious because Bibi is an elected official in a coalition government with his political opposition who visited Washington, D.C.
00:17:55.000 Benny Gonstad literally yesterday.
00:17:56.000 But here is Michael Moore, dolt, Do you think Donald Trump is the threat that he is and Joe Biden is gambling by aligning himself closely with Netanyahu at the risk of American democracy?
00:18:11.000 Absolutely.
00:18:12.000 And gambling by aligning himself with an authoritarian in Tel Aviv.
00:18:18.000 Somebody who is facing a number of felonious charges, who was supposed to stand trial this past fall, and that all got shoved aside because now there's a war.
00:18:29.000 And so we can't put our Prime Minister on trial.
00:18:32.000 Joe Biden, and I'm just, I plead with him.
00:18:37.000 Do not put Trump back in the White House.
00:18:41.000 I am not going to be able to go on enough shows on TV between now and the election to convince literally millions of young people that you gotta vote because Trump's a bad guy.
00:18:57.000 Michael Moore, by the way, is such an idiot that he literally says in the same interview that Israel should focus its ire not on radical Muslims who just murdered 1,200 of its citizens.
00:19:07.000 Instead, they should focus on the evils of Christians.
00:19:10.000 That's how out of touch these morons are.
00:19:13.000 According to my knowledge of history, the enemies of Israel who have been persecuted, the Israelis, the Jewish people of this world have been persecuted for 5,000 years.
00:19:24.000 But for the last 2,000 years, most of the persecution has come from white, European-centric Christians.
00:19:33.000 That's been your enemy.
00:19:35.000 No Palestinian helped to build Auschwitz.
00:19:37.000 No Palestinian stood on the docks of New York City when boatloads of Jewish refugees trying to escape the Holocaust came here to be protected by this country and were turned away at the docks in New York and sent back to Germany to die.
00:19:52.000 No Palestinian did that.
00:19:53.000 No Palestinian ran the Spanish Inquisition.
00:19:56.000 Your enemy is not the Palestinian people.
00:20:01.000 It is white, Christian, European people who have been slaughtering Jews for the last 2,000 years.
00:20:12.000 Okay, let me take that just one moment there.
00:20:16.000 I have to recover.
00:20:17.000 I'm going to say this in very considered fashion.
00:20:22.000 That's the stupidest f***ing thing I've ever heard in my entire life.
00:20:26.000 That's legitimately the stupidest thing I've ever heard in my entire life.
00:20:29.000 Yes, it turns out there was a lot of Christian antisemitism over the course of the last couple thousand years.
00:20:34.000 That does not forestall the fact that Palestinians crossed a border like a couple of months ago and murdered 1,200 Jews and still are holding 134 hostages, including six Americans.
00:20:48.000 The Palestinians in the West Bank and Gaza Strip overwhelmingly support Hamas.
00:20:54.000 That the greatest threat to Jews on planet Earth right now is Palestinians and their supporters.
00:20:58.000 That is just a fact.
00:21:00.000 There is no other... That's simply true.
00:21:04.000 It doesn't mean that every single Palestinian is a terrorist.
00:21:07.000 It doesn't mean that every single Palestinian wants to kill Jews.
00:21:10.000 It does mean that a huge number of Palestinians do want to kill Jews and a huge number of Palestinians support terrorism.
00:21:18.000 That does not mean that civilians should not be treated as civilians, but that happens to be a reality.
00:21:22.000 We'll get to more on this in just a moment.

00:22:22.000 Members FDIC.
00:22:23.000 Terms and conditions apply.
00:22:25.000 By the way, his history is just false also.
00:22:28.000 He's an idiot.
00:22:28.000 When he says, well, you know, it was during, yeah, I didn't see any Palestinians blocking immigration to New York.
00:22:32.000 No, it was Palestinians blocking immigration in British Mandate Palestine, you doof.
00:22:37.000 It was Palestinian Arabs who were rioting against British rule in 1937 after the Peel Commission recommended a partition plan that the Arabs rejected and the Jews accepted.
00:22:47.000 And then the Arabs rioted so much that the British Mandate barred all immigration into British Mandate Palestine by Jews, leaving millions of Jews stuck in Europe.
00:22:57.000 These people just don't know any history.
00:22:58.000 But again, it's these radical morons who are in charge of the Democratic Party.
00:23:02.000 It's amazing.
00:23:03.000 We should also point out that it's not just that radical idiots have taken control of one of the major parties in the United States or are increasingly taking control of that party.
00:23:11.000 It is also that you know who knows that these radical idiots are in control and is using these radical idiots?
00:23:16.000 The Islamists!
00:23:17.000 You know who Hamas's best friends are?
00:23:19.000 People like Eamon McGeldin on MSNBC.
00:23:23.000 Or Mehdi Hassan.
00:23:24.000 Or Michael Moore.
00:23:25.000 Or AOC.
00:23:26.000 People who do the propaganda work for them.
00:23:29.000 These are their favorites.
00:23:30.000 How do we know?
00:23:30.000 Well, here's an example.
00:23:32.000 Yesterday, the Houthi rebels.
00:23:34.000 And again, the Houthi slogan, just to remind everybody, the Houthi slogan is, quote, Allah is the greatest.
00:23:40.000 Death to America.
00:23:41.000 Death to Israel.
00:23:42.000 A curse upon the Jews.
00:23:43.000 Victory to Islam.
00:23:44.000 So, they're a bunch of nice people.
00:23:46.000 You know, probably just they're looking for decolonization, the Houthis.
00:23:49.000 An Iran-backed terror group.
00:23:52.000 Well, a senior Houthi leader, according to Politico, has now pitched that Britain's newest member of parliament, George Galloway, be an unlikely mediator in the current Middle East conflict.
00:24:01.000 Why should the new pro-Palestinian MP for Rockdale be a potential player in easing tensions?
00:24:06.000 Because he is an apex useful idiot.
00:24:12.000 It is George Galloway who once suggested that the state of Israel be completely dismantled He was actually kicked out of labor in 2003.
00:24:24.000 And he was kicked out of labor because he has called for the dismantling of what he called the Zionist state.
00:24:33.000 He walked out of a debate in 2013 after discovering that his opponent was an Israeli citizen.
00:24:38.000 He said, quote, I don't debate with Israelis.
00:24:41.000 He also met with Saddam Hussein.
00:24:43.000 He also suggested in 2012, by the way, that having sex with an unconscious woman, quote, quote, would be bad sexual etiquette, but not rape.
00:24:51.000 Solid guy.
00:24:52.000 And that's exactly who the Houthis want.
00:24:55.000 They also have their helpers, do the radical Islamists in the media.
00:24:59.000 According to GB News, the BBC has now been criticized after it failed in the most basic of journalistic practices because it used an IRGC reporter as an eyewitness source in reporting on Gaza.
00:25:10.000 And again, so much of the reporting in the Gaza Strip is eyewitness sources who work with or for Hamas.
00:25:15.000 This is just a fact.
00:25:18.000 If you can't get...
00:25:19.000 Just for the moment, imagine that you had an area that is so taken over by terrorism that you literally cannot ship in food aid and get it to civilians because terrorists are hijacking the food aid.
00:25:29.000 Now imagine they're getting information out from that same area.
00:25:31.000 Would you imagine that information is going to be freely trafficked?
00:25:34.000 Or do you think the terrorists are going to be controlling the flow of information?
00:25:37.000 The answer is pretty obvious.
00:25:39.000 Terrorists have been controlling the flow of information in the Gaza Strip for legitimately decades at this point.
00:25:43.000 And the entire legacy media just imbibes from that well.
00:25:47.000 The BBC so much so that the corporation used video and eyewitness accounts of a crowd rush incident in an aid convoy in Gaza And the segment included a report from one Mahmoud Awadaya, described as a journalist at the scene, who lied and said that Israeli troops deliberately shot people attempting to approach trucks of flour in the convoy.
00:26:06.000 He said, quote, Israelis purposefully fired the men.
00:26:08.000 They were trying to get near the trucks that had the flour.
00:26:10.000 They were fired at directly and preventing people to come near those killed.
00:26:15.000 There's only one problem, which is that Awadaya praised a terrorist attack in 2023, which killed seven Israelis.
00:26:23.000 And also happens to have a slew of pro-terrorist messaging and associations with figures like Khalil al-Battani, a senior member of the paramilitary group, Palestinian Islamic Jihad.
00:26:34.000 The same legacy media that will still print reports doubting whether there was mass rape at the Nova Music Festival on October 7th.
00:26:42.000 Those same media are the useful idiots of the radical Islamists, and they also happen to be the people who Joe Biden believes he's answerable to.
00:26:50.000 And that is why Joe Biden is, he is so far off the track of what the American people want from him.
00:26:56.000 He is so far off the track of what the American people want from him.
00:26:58.000 And they wanted moderation and decency.
00:27:00.000 And instead they got this radical garbage with a bumbling old fool at the top of the pile.
00:27:06.000 That's what they got.
00:27:06.000 We'll get to more on this in just one second.
00:27:08.000 First, let's be real.
00:27:10.000 French fries are the only good vegetable there is.
00:27:13.000 Unfortunately, they're not healthy.

00:28:15.000 Speaking of which, speaking of radical garbage with a bumbling old fool at the top, according to the Daily Wire, the Biden administration has now empowered a professional activist to travel the globe on the taxpayer dime to push transgenderism and gender ideology.
00:28:27.000 From Australia to Brazil, South Africa to Sweden, Jessica Stern travels across the world attending so-called Pride events as the State Department's Special Envoy to Advance the Human Rights of Lesbian, Gay, Bisexual, Transgender, Queer, and Intersex Persons.
00:28:39.000 Stern, who has boasted she is the highest-ranking lesbian woman in the Biden administration, is paid an annual salary of over $180,000 and tasked with promoting a far-left view on sex and gender, lobbying foreign governments, and assisting activist organizations.
00:28:52.000 She was appointed by Biden in September 2021.
00:28:55.000 Her work has gone largely unnoticed by the media as she bolsters the president's broader effort to leverage the might of the federal agencies and their bureaucracies in service of a far-left agenda.
00:29:04.000 She travels a special envoy, and they've taken her to at least 22 countries.
00:29:08.000 Including Argentina, Australia, Brazil, Botswana, Canada, Germany, Greece, India, Lithuania, Malaysia, Mauritius, Mexico, Nepal, the Netherlands, Panama, Peru, the Philippines, South Africa, Sweden, Switzerland, Thailand, and Vietnam.
00:29:19.000 By the way, I'm just going to point out here, how many of those countries are, of the countries that I just mentioned, how many of them are, you know, radical Muslim ruled?
00:29:29.000 I noticed there were zero in the Middle East.
00:29:31.000 I noticed that.
00:29:32.000 So she's happy to preach LGBT politics pretty much everywhere.
00:29:38.000 Except for where the Muslims are.
00:29:40.000 Malaysia is the only country in this list I believe that's Muslim.
00:29:46.000 That means having senior experts on LGBTQI rights.
00:29:51.000 So why is the Biden administration trotting around at taxpayer expense this lady to various gay pride parades around the globe?
00:29:59.000 Because the State Department says, quote, This is what American exceptionalism has come to mean.
00:30:02.000 American exceptionalism is not things like private property ownership.
00:30:05.000 non-binary and gender non-conforming persons around the world.
00:30:09.000 This is what American exceptionalism has come to mean.
00:30:12.000 American exceptionalism is not things like private property ownership.
00:30:15.000 It is not anything like free speech.
00:30:18.000 It is not limited government.
00:30:19.000 American exceptionalism apparently is LGBTQI minus divided by sign politics.
00:30:25.000 That is the most important thing that the Biden administration can be pushing at this point.
00:30:30.000 And again, this goes to one of the central problems between left and right today.
00:30:35.000 I think that it is fair to state that if you go back to, say, even the 1990s, there was a large crossover between what the left in this country wanted and what the right in this country wanted.
00:30:44.000 During the Clinton era, that's why you could get things done sometimes.
00:30:46.000 Because what people wanted, generally speaking, was a government that was limited in its intervention in daily life.
00:30:53.000 People still wanted solid families.
00:30:54.000 There was some arguing around the edges with regard to, say, things like benefits for same-sex couples, but there was no talk in the mid-1990s.
00:31:04.000 In fact, everybody was talking the opposite about gay marriage.
00:31:06.000 The idea was maybe civil unions, and civil unions were really just about granting legal rights like hospital visitation or rights in wills to gay couples.
00:31:17.000 But there was no idea of marriage as a substitution for gay couples for traditional marriage.
00:31:22.000 That was off the table in the 90s.
00:31:25.000 Even the left, at that point, with regard to abortion, for example, the Clinton line, was safe, legal, and rare.
00:31:30.000 There was still crossover in which people recognized that abortion was a great evil.
00:31:33.000 And now things have completely broken apart.
00:31:36.000 They've completely broken apart.
00:31:38.000 And because there is no common vision in the United States anymore of what even constitutes a good, that means that you will have administrations promoting around the globe things That are not agreed to by the vast majority of Americans.
00:31:51.000 Most Americans are not interested in paying envoys to go promote transgenderism in Malaysia.
00:31:56.000 This is not something we think of as a core American value, nor should we think of that as a core American value.
00:32:01.000 That is not what American exceptionalism is.
00:32:04.000 But for the left, it is.
00:32:05.000 And so they've redefined what it is to be a good American.
00:32:09.000 This is why you've seen so much ire in the United States.
00:32:12.000 Again, when you have a set of common values, even if they are broadly, broadly writ, even if there's a lot of play in the joints, but you still have those common values, you can have a country.
00:32:21.000 But when those fall away, then what exactly do you have left?
00:32:26.000 The answer is not much.
00:32:28.000 I mean, again, the fact is that this administration has decided that it is going to promote what it calls democracy, but not really, because it sort of depends on where you are in the world, whether they support the democracy or not.
00:32:41.000 Right now, the Biden administration is promoting a tyrannical Islamic government, the Palestinian Authority, and its aspirations.
00:32:49.000 Above the interests of an ally of the United States that happens to be Democratic Israel.
00:32:53.000 So when they talk about democracy, it's just everyone knows they don't really mean it.
00:32:57.000 So what exactly is the Biden administration pushing around?
00:32:59.000 They're not pushing property ownership.
00:33:01.000 They're not really pushing free markets.
00:33:03.000 Joe Biden is looking for global baseline taxes of 15%.
00:33:08.000 So, what exactly are those American exceptional values that Joe Biden is pushing?
00:33:11.000 He can't define them.
00:33:12.000 He's let the left define them for him.
00:33:14.000 And Americans don't like that leftist definition.
00:33:17.000 In just one second, we're gonna get to the most shocking story of the day.
00:33:20.000 This with regard to WPATH.
00:33:23.000 WPATH is the World Professional Association for Transgender Health.
00:33:27.000 That organization has been used as the basis for pretty much all trans propaganda in the United States for the last 10, 15 years?
00:33:34.000 We're gonna get to the corruption of that organization in just one moment.
00:33:37.000 First, Thursday night, join The Daily Wire backstage.
00:33:39.000 Matt Walsh, Michael Molls, Andrew Klavan, Jeremy Boring, and I, we all watch and react to the 2024 State of the Union live on Daily Wire Plus.
00:33:46.000 We will break down the State of the Union as it happens, and of course, we'll answer your questions.
00:33:49.000 It's an experience you will not find anywhere else.
00:33:51.000 You can watch it all live Thursday night, 8.30 p.m.
00:33:53.000 Eastern on the Daily Wire app and dailywire.com.
00:33:56.000 It should be exciting because we are all waiting to see if Joe Biden survives the evening.
00:34:00.000 Check us out at dailywire.com or on the Daily Wire app Thursday night, 830 p.m. Eastern.
00:34:05.000 Meanwhile, the biggest breaking news of the day is a piece from Gerald Posner in the New
00:34:11.000 Newly leaked files from the world's leading transgender health care organization reveal it is pushing hormonal and surgical transitions for minors, including stomach-wrenching experimental procedures designed to create sexless bodies that resemble department store mannequins.
00:34:24.000 The World Professional Association for Transgender Health documents demonstrate it's controlled by gender ideologues who push aside concerns about whether children and adolescents can consent to medical treatment that WPATH members privately acknowledge often have devastating and permanent side effects.
00:34:38.000 Yet the U.S.
00:34:38.000 government, American doctors, and prominent organizations nonetheless rely on WPATH guidelines for advice on treating our youth.
00:34:44.000 The files, jaw-dropping conversations from a WPATH internal messaging board, and a video of an identity evolution workshop panel were provided to journalist Michael Schellenberg who shared the documents with me.
00:34:54.000 Schellenberg's non-profit Environmental Progress will release a scathing summary report comparing WPATH promotion of the pseudoscientific surgical destruction of healthy genitals in vulnerable people to the mid-20th century use of lobotomies, the pseudoscientific surgical destruction of healthy brains.
00:35:09.000 When the organization adopted in 2022 its current standards of care, which is relied upon by the NIH, the WHO, and every major American medical and psychiatric association, it scrapped a draft chapter about ethics and removed minimum age requirements for children starting puberty blockers or undergoing sexual modification surgeries.
00:35:25.000 It had previously recommended 16 to start hormones and 17 for surgeries.
00:35:29.000 Not surprisingly, age comes up frequently in the WPATH files from concerns about whether a developmentally delayed 13-year-old can start on puberty blockers, to whether the growth of a 10-year-old girl will be stunted by hormones.
00:35:40.000 During one conversation, a member asked for advice about a 14-year-old patient, a boy who identified as a girl and had begun transitioning at 4.
00:35:46.000 The child insisted on a vaginoplasty, a surgery that removes the penis, testicles, and scrotum, and repositions tissue to create a non-functioning pseudo-vagina.
00:35:54.000 It requires a lifetime of dilation.
00:35:56.000 Was he too young at 14?
00:35:58.000 Marcy Bowers, the WPATH president, said she continued, any age limit arbitrary, but she, air quotes, would not do
00:36:06.000 it.
00:36:06.000 Why? The tissue is too immature, dilation routine too critical.
00:36:09.000 In lay terms, that means that boys are too young.
00:36:12.000 They don't have enough penile tissue for the surgery.
00:36:15.000 And the surgeon has to harvest intestinal lining to build a fake vagina.
00:36:18.000 The highest profile patient of the person who is the president of WPATH is Jazz Jennings.
00:36:25.000 WPATH, unfortunately, has become the central organization in pushing quote-unquote transgender standards of care.
00:36:32.000 It's used by the federal government and they are totally full of crap.
00:36:36.000 This unfortunately is the reality of our medical establishment.
00:36:38.000 It's been amazing to see how every institution has discredited itself in this country over the course of the last 15 to 20 years.
00:36:45.000 It's totally insane.
00:36:46.000 The one institution you thought would not discredit itself is science, because after all, science is held to the scientific method.
00:36:51.000 You have a hypothesis.
00:36:52.000 You test it.
00:36:53.000 If the test doesn't work, then you go back to the drawing board.
00:36:56.000 But science has become an arbitrary tool of political professionals.
00:37:00.000 That's particularly true where the science is unclear.
00:37:03.000 So it used to be that the first rule was do no harm.
00:37:05.000 Now the first rule is do as much harm as possible so long as you can obfuscate the results for long enough.
00:37:11.000 That's what WPATH promotes.
00:37:13.000 The litany of transition surgery side effects did not stop WPATH, according to the New York Post, from endorsing far more radical nullification surgeries for patients who do not feel either male or female and identify only as non-binary.
00:37:25.000 Several dozen so-called degendering surgeries are designed to create a sexless, smooth cosmetic appearance that is unknown in nature.
00:37:32.000 There's even an experimental bigenital surgery that attempts to construct a second set of genitals.
00:37:38.000 WPath has enshrined this concept into its standard of care.
00:37:43.000 So, in other words, they want you to look like a Ken doll, or a Barbie doll, now.
00:37:48.000 And this is supposed to be standard of care.
00:37:52.000 Totally insane crap.
00:37:54.000 But, again, being pushed by the federal government.
00:37:57.000 Rachel Levine, the Assistant Secretary of Health, who is of course a biological man,
00:38:02.000 is a WPATH member and has lavished praise on the organization saying,
00:38:05.000 it assesses the full scale of the science and provides substantive, rigorously analyzed,
00:38:09.000 peer-reviewed recommendations to the medical community on how best to care for patients
00:38:12.000 who are transgender or gender non-binary. It's free of any agenda other than to ensure
00:38:16.000 that medical decisions are informed by science. That is a lie.
00:38:20.000 That is a lie.
00:38:21.000 But so much of what we are seeing promoted by the federal government these days is just lies designed to promote a radical and insane agenda.
00:38:29.000 And meanwhile, speaking of a radical and insane agenda, a federal appeals court has now correctly allowed Texas to put forward its own immigration law since the federal government won't do it.
00:38:41.000 According to CNN, a federal appeals court granted a temporary stay of a lower court's decision to block the enforcement of a controversial Texas immigration law.
00:38:49.000 The state government was going to implement Senate Bill 4, which would allow state law enforcement authorities to arrest and detain people they suspect of entering the country illegally.
00:38:57.000 So very much like in Arizona, Senate Bill 1070, back a decade ago, when Barack Obama was president.
00:39:05.000 Which allowed Arizona to arrest people for illegal immigration, and that was invalidated by the Supreme Court.
00:39:10.000 Well, now this is going up to the Supreme Court.
00:39:12.000 The Supreme Court has put it on hold at the moment, so we'll see how that is adjudicated.
00:39:17.000 It's the Biden administration, by the way, that's saying that Texas should not be allowed to arrest people for illegal immigration.
00:39:23.000 Which means they are actively intervening to even stop other authorities from fighting the problem of illegal immigration.
00:39:30.000 Meanwhile, the Biden administration continues to fib about all this.
00:39:32.000 John Kirby, who's the national security spokesperson, and really the de facto competent press secretary for the White House since Karine Jean-Pierre's terrible at her job.
00:39:39.000 He was on Fox News yesterday, suggesting that Biden has not disengaged from the Border Patrol, despite the fact that the prior head of the Border Patrol said he literally never had a conversation with either Biden or Kamala Harris.
00:39:49.000 Here's John Kirby.
00:39:51.000 How has he never spoken to, and you know what, we did some reporting on this earlier today.
00:39:56.000 Not only Raul Ortiz, the former chief of the Border Patrol, but the current chief of the Border Patrol, Chief Owens, who you pointed out he did meet with in Brownsville, but from what we can find out, they had never spoken before that.
00:40:12.000 How is that possible?
00:40:13.000 Well, the president's engaged with DHS.
00:40:17.000 He's engaged with leadership there.
00:40:18.000 But why not the Border Patrol?
00:40:20.000 He's engaged with the Border Patrol.
00:40:21.000 Martha, he was just down there at Brownsville meeting and talking to those folks directly and hearing from them about the situation on the ground.
00:40:27.000 But he never met with the former or current chief.
00:40:29.000 The current chief he just met, he's been president for three years, just met him the other day.
00:40:33.000 He, again, is engaged with everybody at DHS, including the Border Patrol, down there at Brownsville talking to them on the ground, hearing from them directly about what their concerns are.
00:40:44.000 Okay, well, the problem is nobody believes that.
00:40:47.000 Nobody believes that.
00:40:50.000 You know what Democrats should be doing?
00:40:51.000 They should now be imitating the example of John Fetterman in Pennsylvania.
00:40:55.000 He was elected, he almost did a reverse Biden.
00:40:57.000 So Biden was elected as a moderate and is governing as a radical.
00:40:59.000 John Fetterman was elected as a radical and is governing as a moderate.
00:41:02.000 So John Fetterman comes into office and he immediately starts pushing, for example, things like border control.
00:41:08.000 He starts suggesting that he is on Israel's side in its war against a genocidal terrorist group, Hamas.
00:41:14.000 And guess what?
00:41:15.000 His approval rating with Democrats in Pennsylvania is 76 to 7 in the latest Quinnipiac poll.
00:41:20.000 He's not afraid of his own base.
00:41:22.000 And that means that he's winning.
00:41:23.000 Because guess what?
00:41:25.000 Joe Biden doesn't need college students in Michigan to vote for him.
00:41:28.000 He needs moderates in Michigan to vote for him.
00:41:30.000 But he's not doing it.
00:41:32.000 Here's John Fetterman going off on the border.
00:41:35.000 At least I, as a Democrat, you know, am willing and eager to go stronger than the border deal that was here.
00:41:43.000 It might be actually appropriate, given the circumstance here at the border.
00:41:49.000 John Fetterman making the smart play, moving toward the center.
00:41:54.000 While the left is trying to proclaim that he's wildly unpopular, that is simply not true.
00:41:58.000 It is not true.
00:41:59.000 John Fetterman is one of the more popular figures in Pennsylvania politics at this point because he didn't do the dumb thing.
00:42:05.000 Joe Biden did the dumb thing.
00:42:06.000 He decided to steer way out to his left.
00:42:09.000 He's going to pay the price for that electorally.
00:42:11.000 There's a reason he is trailing in all the swing states.
00:42:13.000 There's a reason independents are turning toward Donald Trump.
00:42:16.000 Donald Trump has locked up 97% of the people who voted for him in 2024.
00:42:20.000 Joe Biden has locked up 83% of the people who voted for him in 2020.
00:42:25.000 Those numbers, not good enough for Joe Biden.
00:42:28.000 Meanwhile, speaking of radicals who can't get their own cities under control, New York has had increased crime. Why? Because they decided to
00:42:35.000 release people without bail.
00:42:37.000 Because that's the stupidest thing that you could possibly do with criminals. It turns out fighting
00:42:40.000 crime is actually super easy. You take criminals and you put them in a place where they can't harm
00:42:44.000 anyone else. Call it prison, for example. And then you just put them there and leave them there.
00:42:49.000 That's what you do with criminals.
00:42:50.000 And then they aren't in public harming other people.
00:42:53.000 I know.
00:42:54.000 This is like incredibly difficult stuff that no one can figure out except for every civilization in the history of humanity.
00:42:59.000 But we can figure it out.
00:43:01.000 It's a mystery wrapped in an enigma.
00:43:03.000 How do you solve crime?
00:43:04.000 Probably you should just take the criminals.
00:43:06.000 You should probably have them take a trip.
00:43:08.000 Quick trip down to the jail.
00:43:09.000 After like a day, probably release them back in.
00:43:11.000 Probably they've learned their lesson and it'll all be great.
00:43:14.000 According to the New York Post, remember when politicians were touting the success of bail reform?
00:43:17.000 Remember the meaningless and deceptive numbers they threw out?
00:43:20.000 New York City Comptroller Brad Lander claims in a report only 1% of people released on bail under bail reform are re-arrested for a violent felony while their case is pending and then State Senate Majority Leader Andrea Stewart-Cousins said the number was 2%.
00:43:31.000 Well, a new study of bail reform outside New York City in the suburbs and upstate prepared by John Jay College of Criminal Justice's Data Collaborative for Justice shows 66% of people released under bail reform who had a recent prior arrest were re-arrested within two years of their release.
00:43:48.000 67% of defendants who had a recent prior felony arrest in the past year who were released were also re-arrested within two years of their arraignment.
00:43:55.000 Almost half of those were re-arrested for a felony.
00:43:59.000 Wait, you mean that criminals do crime?
00:44:01.000 That's crazy.
00:44:02.000 I was told that criminals are victims of the system and that, after all, they shoplift because they need bread, in the words of that genius, Alexandra Ocasio-Cortez.
00:44:11.000 By the way, it's worth noting here that the center that wrote this study were vocal supporters of the bail reform laws from the very beginning.
00:44:21.000 Arrests outside New York City decreased from 184,000 in 2019 to 154,000 in 2022, even as crimes increased.
00:44:23.000 in 2019 to 154,000 in 2022, even as crimes increased.
00:44:28.000 In fact, there were 17,000 more crimes in 2022 than 2019, but 30,000 fewer arrests.
00:44:34.000 Well, I mean, there's a shock.
00:44:37.000 Again, amazing.
00:44:38.000 You mean when you release criminals onto the streets?
00:44:41.000 That that makes more... No, no!
00:44:43.000 California is doing the same thing.
00:44:45.000 According to the Wall Street Journal, what would happen if lawmakers reinvented the criminal justice system to target systemic racism instead of crime?
00:44:51.000 California is about to find out.
00:44:53.000 California passed a law in 2020 called the California Racial Justice Act, which means every felon serving time in the state prison and jail can now retroactively challenge his conviction and sentencing on the grounds of systemic bias.
00:45:04.000 So the prisoner doesn't need to show that the police officer, prosecutor, judge, or juror was racist.
00:45:09.000 All they have to demonstrate is that in the past, criminal suspects of his race were arrested, prosecuted, or sentenced more often or more severely than members of other racial groups.
00:45:19.000 So in other words, if you're a black felon in prison, you're going to be able to sue to lower your sentence based on systemic factors.
00:45:27.000 Now, every examination of sentencing is complicated by the realities, which is that sentencing differs by not only the crime, but the behavior during the crime for each and every person who's engaged in a crime.
00:45:40.000 And so simply taking a baseline of black people are sentenced for the same crimes longer than white people doesn't take into account any of the external factors.
00:45:48.000 Other crimes that were pled down.
00:45:49.000 Criminal histories of the suspect.
00:45:52.000 Behavior during the arrest.
00:45:55.000 In fact, comparing these two things is sort of like suggesting that women earn less than men on average in terms of salary, ignoring things like how many hours are worked or what jobs people are in.
00:46:06.000 As the Wall Street Journal points out, court testimony now sounds like a critical race studies course.
00:46:10.000 When a felon in San Francisco contested his arrest and prosecution for having a loaded handgun in his car, a race expert testified the arresting officer's use of the phrase high crime area demonstrated bias against people of color.
00:46:22.000 The appeals court allowed the felon's claim to proceed.
00:46:26.000 The same expert who testified this, by the way, also testified that whites are psychopaths whose behavior represents an underlying biologically transmitted proclivity.
00:46:35.000 This is according to Heather McDonald writing about all of this.
00:46:38.000 So I can't imagine why crime is going to go up in the state of California.
00:46:41.000 I can't imagine.
00:46:42.000 Again, pursue stupid policies, receive stupid consequences.
00:46:47.000 Alrighty, folks, coming up, we will be joined by Abigail Schreier.
00:46:49.000 She has a brand new book titled Bad Therapy, Why the Kids Aren't Growing Up.
00:46:52.000 It's fascinating and taboo.
