00:02:12.000 Congressman Roy, tell us again what is the SAVE Act?
00:02:15.000 Yeah, Charlie, great to be on the show.
00:02:18.000 Look, we set out a couple of months ago to make clear that we should ensure that only American citizens vote in American elections.
00:02:26.000 And people think, well, you know, gosh, wasn't that already unlawful?
00:02:30.000 Well, yeah, technically, we've had a law since the 90s that said, you know, it's criminal to vote in an election if you're a non-citizen.
00:02:39.000 But we also had barriers based on Supreme Court interpretation in federal law to states being able to enforce that.
00:02:45.000 So we fixed that in the SAVE Act, which I authored in the House, Mike Lee in the Senate.
00:02:51.000 I worked closely with the Speaker and others to get this done.
00:02:54.000 But we also went a step further.
00:02:55.000 We will require in federal elections, that in federal elections only, to respect federalism, but in federal elections, that states would check for
00:03:04.000 citizenship and for providing documentary proof of citizenship to register to vote.
00:03:09.000 We put in all sorts of safeguards to make sure nobody would be disenfranchised, trying
00:03:13.000 to balance the interests of enforcement, but also not being a burden for someone who shows
00:03:20.000 up and wants to vote.
00:03:21.000 So we allow for different ways to accomplish the goal.
00:03:24.000 But it's important to do it.
00:03:26.000 It's an 81% to 87% issue.
00:03:29.000 It passed yesterday.
00:03:30.000 Five Democrats voted for it.
00:03:32.000 That's the good news.
00:03:33.000 198 Democrats voted against it, and they're going to have to answer for that in November.
00:03:38.000 198 Democrats, by the way, including Ruben Gallego in Arizona, who is now trailing Carrie Lake in the latest poll.
00:03:46.000 I hope everyone's aware of that.
00:03:47.000 That's a separate issue, but Carrie Lake has come back.
00:03:51.000 She was like down 15 points.
00:03:52.000 She is now within the margin of error.
00:03:55.000 Congressman Roy, Elon Musk, the world's richest man, came out and said, failure to vote for this bill would be akin to treason.
00:04:04.000 That's a heavy word.
00:04:06.000 What is your reaction to that?
00:04:07.000 Well, I think Elon's been a great voice for what we need to do to preserve and protect our republic, and he gets it, frankly, more than a lot of Americans.
00:04:14.000 Frankly, I find that a lot of Eastern Europeans, a lot of people that understand why it's important for us to save and preserve a strong, sovereign, free country, they get it.
00:04:25.000 And he's not wrong That it is, I think, problematic and dangerous.
00:04:31.000 Not sure if I'd say treasonous, but you know, you could argue it.
00:04:34.000 It's certainly anti-American and against the rule of law to say that we should be having non-citizens vote in elections.
00:04:41.000 Now Democrats say, well, that's nonsense.
00:04:43.000 That's not what is happening.
00:04:44.000 That's not true.
00:04:46.000 We've got Oakland, San Francisco, New York, Washington, D.C., other Democrat-led jurisdictions that are purposely trying to register non-citizens to vote in state and local elections, and they say, don't worry, they won't vote in federal elections.
00:04:59.000 But we have evidence that across the country, people have been, and we've been registering people through Medicaid rolls, the DMV, and so now we're pushing back on that.
00:05:08.000 That's why this bill is so critically important.
00:05:09.000 So Elon is right that it is certainly un-American.
00:05:13.000 And you cannot say that you're for the rule of law or for sovereignty or for saving American elections and make sure they're secure if you voted against this bill.
00:05:20.000 You can't do it.
00:05:20.000 By the way, Colin Allred voted against this bill, who is running against Ted Cruz in Texas.
00:05:25.000 Yeah, well, Ted Cruz is running a great race.
00:05:27.000 We have his back 100%.
00:05:28.000 So, Congressman Roy, help me understand this.
00:05:30.000 And I'm going to ask you to speculate.
00:05:32.000 I know this is a hard question, and you're doing hero's work.
00:05:35.000 In Texas, Joe Biden has allowed hundreds of thousands, if not millions of people that are now in the interior of Texas that otherwise were not.
00:05:43.000 Now, it's important to note that while Texas is a border state, Joe Biden has been sending these guys all over the country, right?
00:05:49.000 And so, but Texas really feels the carnage more than almost any, I mean, Texas, New Mexico, Arizona, California, but really Arizona, Texas, as far as the human smuggling, the trafficking.
00:05:59.000 Do we believe that some of these people are now being registered to vote in Texas, potentially?
00:06:05.000 Well, certainly because federal law requires that these places where you have, for example, Medicaid rolls, and they require that the documentation be there, it's certainly a problem.
00:06:16.000 I know that the state leadership in Texas is doing what they can to ensure that that's not the case.
00:06:20.000 They've been working to clean the voter rolls.
00:06:23.000 The secretaries of state over the last two or three terms have been working to do that.
00:06:27.000 We can probably do more there.
00:06:29.000 I'd let the state leadership talk about that.
00:06:31.000 But we know that it's being attempted.
00:06:34.000 Right.
00:06:34.000 And we know that the paperwork by federal bureaucrats is put in front of people when they come forward.
00:06:39.000 So the state of Texas is having to fight that.
00:06:41.000 Just like, for example, Arizona has two different systems for voting, right?
00:06:46.000 They've got one system for state and federal and one state, I'm sorry, one system for state and local and one system for federal because of the federal law problem.
00:06:54.000 That's what our bill sets out to fix and then take it a step further to ensure that we're checking for citizenship.
00:07:00.000 This should be an absolute no-brainer, and in some ways we are a victim of our own model.
00:07:06.000 Because we have federalism and every state can do elections as they see fit, and we don't want the federal government to be overly involved in our elections, but it presents several problems here.
00:07:18.000 Do you think this has a chance of passing in the U.S.
00:07:22.000 Senate?
00:07:23.000 Well, look, I mean, this will depend on the leadership.
00:07:26.000 I know Mike Lee, who, you know, authored the bill in the Senate, he's one of the key leaders on it.
00:07:30.000 And he's working to make sure that we get maybe amendments or consent requests.
00:07:35.000 You might see a Federman or you might see somebody who's willing to break and go with us.
00:07:39.000 You know, you've got Kyrsten Sinema and others.
00:07:42.000 But remember that there is a legitimate federal role here.
00:07:45.000 The elections clause specifically says Congress has a role when you're talking about the time, place, and manner of congressional elections.
00:07:52.000 Secondly, we control, uniquely, naturalization.
00:07:56.000 Frankly, the court has probably said we control it more than maybe even constitutionally we do.
00:08:01.000 The point is, Congress has a unique role there.
00:08:03.000 And I would also point out, 15th Amendment, 19th, 24th, 26th, all talk about protecting the right of citizens to vote.
00:08:12.000 The Constitution contemplates that we have the power to do this.
00:08:15.000 We act it.
00:08:15.000 It's a good bill.
00:08:16.000 The Senate should take it up.
00:08:18.000 If Schumer won't do it, Republicans should find every way they can to force consideration and move to proceed to the bill and make sure we get a vote on this before the election.
00:08:27.000 So I'm going to ask you just some palace intrigue stuff, Chip.
00:08:31.000 The top priority right now in Congress doesn't seem to be anything legislative.
00:08:34.000 It seems as if your Democrat colleagues are hustling and bustling to find if they want to still have Joe Biden as their nominee.
00:08:42.000 Just as a guess, using hallway chatter and inside baseball, if Joe Biden was up against a secret ballot with Democrats within the House, how would he do?
00:08:53.000 Oh, secret ballot?
00:08:54.000 He would do very poorly.
00:08:56.000 I think Democrats very much see and observe that he should not be the nominee, frankly, that he shouldn't be the president.
00:09:05.000 They recognize that he's not all there.
00:09:07.000 But they are, I think, split and divided about how much to call it out.
00:09:11.000 I think now you've got now 10 Democrats who have called him out.
00:09:14.000 Nancy Pelosi was pretty circumspect yesterday.
00:09:17.000 I haven't seen any of her commentary today.
00:09:18.000 I think Hakeem Jeffries just did a press conference where he said that, oh, you know, I think he was trying to defend Biden.
00:09:25.000 Like they are torn and pulled apart on this.
00:09:27.000 And look, I personally believe we have an obligation as Republicans to keep pushing on this point because the leadership around the president, they're complicit.
00:09:37.000 They're not trying to say that you can have a president by committee.
00:09:40.000 You're a scholar of our founding and our history.
00:09:42.000 That's garbage.
00:09:43.000 We rejected that.
00:09:44.000 You can't say that, oh, he's got people around him, they can decide.
00:09:47.000 No, no.
00:09:48.000 He's the commander in chief.
00:09:49.000 We have a unitary executive.
00:09:51.000 He is supposed to make those decisions.
00:09:53.000 Secondly, the people around him are complicit in lying to the American people in one of the greatest cover-ups in history.
00:09:58.000 He is not mentally competent.
00:10:00.000 Jill Biden knows it.
00:10:02.000 Kamala Harris knows it.
00:10:03.000 All the Democrats know it, including Hakeem Jeffries, including Nancy Pelosi, Chuck Schumer, and all of the staff in the White House and his doctor.

00:10:13.000 We should force this fight.
00:10:14.000 This is something the American people need to know because it is scandalous what they've done lying to the American people.

00:11:54.000 Look, it's a long shot.
00:11:54.000 This is a body that's controlled by the Democrats.
00:11:57.000 Nonetheless, we've got to push ahead.
00:11:59.000 We can't say that because Democrats are in control of the Senate, we don't have to do everything possible, everything within our power to get this thing passed.
00:12:08.000 Because the fate of the Republic is on the line.
00:12:09.000 The significance of the vote is on the line.
00:12:13.000 You can't proceed to this election with Joe Biden just having let in an additional 10 million illegal aliens just since he's been president and pretend that nothing has changed.
00:12:25.000 And you can't leave the SAVE Act unpassed without creating the inevitability that a whole lot of non-citizens are going to be voting.
00:12:34.000 So I'm going to do everything I can.
00:12:35.000 I'm going to go to the Senate floor in a little while.
00:12:37.000 I'm going to call up the SAVE Act.
00:12:38.000 I'm going to ask that we proceed to it and pass it immediately.
00:12:42.000 We'll see how the Democrats respond.
00:12:45.000 If they shut me down today, I'll try it again very, very soon
00:12:50.000 and keep trying it as long as it takes.
00:12:54.000 And when the time comes, we might need to look at some creative options,
00:12:58.000 like attaching this to other pieces of legislation that must pass.
00:13:02.000 And if we can get enough Republicans to hold the line on that,
00:13:05.000 we might be able to stick them with it.
00:13:06.000 You know, it's interesting that one in 35 people in this country
00:13:11.000 were not here four years ago.
00:13:13.000 And this is a major influx into our country and Democrats seem largely either okay with it or not interested in fixing it.
00:13:22.000 What are exactly in the details of the SAVE Act?
00:13:25.000 Educate our audience so we know exactly what is in it.
00:13:28.000 Okay, so bottom line, it requires proof of citizenship when you register to vote.
00:13:34.000 If you're going to be eligible to vote in a federal election.
00:13:38.000 Under current law, you can register to vote simply by applying for a driver's license.
00:13:44.000 Now, Charlie, keep in mind, of the 30 million non-citizens in this country, literally every state issues driver's licenses to non-citizens.
00:13:56.000 And under the 1993 National Voter Registration Act, by filling out a little federal form that goes along with the driver's license
00:14:03.000 application.
00:14:04.000 All you have to do is check a box and sign your name. No documentation required. It's
00:14:09.000 on the honor system. You can register to vote, including in federal elections.
00:14:13.000 Now, a few years ago, the Supreme Court of the United States, and bad ruling in my view,
00:14:18.000 with the great dissent by my former boss, Justice Alito, the rest of the Supreme Court concluded
00:14:24.000 that the National Voter Registration Act actually prohibits the states from asking for proof of
00:14:29.000 citizenship when you fill those out.
00:14:32.000 So anyway, look, the SAVE Act closes that loophole by requiring proof of citizenship when you register to vote in a federal election.
00:14:39.000 It also provides things like penalties.
00:14:42.000 Penalties for what happens, criminal penalties, if you register an illegal alien to vote.
00:14:50.000 Now, the Democrats are opposing this, and I submit to you, Charlie, there is one and only one reason you could provide that would make logical sense as to why you would oppose this.
00:15:03.000 And the reason would be if you just want to make sure that non-citizens vote, perhaps because you want to influence the outcome of the election.
00:15:12.000 That's what we're dealing with here and that's why I'm so glad the House passed the SAVE Act yesterday and why I'm going to do everything I possibly can to get it passed in the Senate.
00:15:20.000 Who could possibly be against this?
00:15:23.000 Unless you have ulterior motives that are nakedly political, and they obviously are, what do you say to their argument?
00:15:31.000 This is already on the books.
00:15:33.000 It's already illegal for illegals to vote.
00:15:37.000 This is an unnecessary duplication.
00:15:40.000 By that logic, Charlie, it would make no sense to have laws on the books requiring ID to prove your age eligibility when you buy beer, liquor, or cigarettes.
00:15:51.000 That's exactly right.
00:15:52.000 Look, it's already illegal to sell beer or cigarettes to children.
00:15:59.000 So why on earth would we need something like that provided?
00:16:02.000 That's where the argument goes.
00:16:03.000 In fact, to choose an argument more near and dear even than that to progressive Democrats,
00:16:10.000 Let's look at something like, say, I don't know, our laws governing background checks for the purchase of firearms.
00:16:17.000 It's already against the law under 18 U.S.C.
00:16:21.000 922g for a convicted felon to purchase or possess a firearm.
00:16:27.000 So why would we need a background check?
00:16:30.000 Their own logic collapses under its own weight.
00:16:33.000 Every one of the arguments that they throw out there, and that's the most substantive one they've used, I want to play a piece of tape here.
00:16:47.000 This is cut 112.
00:16:51.000 This is Representative Jennifer McClellan, a Democrat from Virginia, says requiring that only U.S.
00:16:58.000 citizens vote is the new version of Jim Crow.
00:17:01.000 These people are so unoriginal.
00:17:02.000 They're so shallow.
00:17:03.000 And honestly, this is so destructive.
00:17:05.000 Play cut 112.
00:17:07.000 This bill is essentially a poll tax because I am not aware of a single proof of citizenship document that does not cost an individual money to get it unless we are requiring every state to provide one for free and then it's on unfunded mandate.
00:17:23.000 This is the 2024 version of the Jim Crow poll tax and we should vote against it.
00:17:29.000 I mean, these people are so unoriginal.
00:17:32.000 I could write their talking points for them regardless.
00:17:35.000 I mean, we could have a bill that says, you know, happy 4th of July and they'll say it's Jim Crow 2.0.
00:17:41.000 Exactly.
00:17:42.000 Senator, what is your reaction?
00:17:43.000 Can I respond to her point?
00:17:44.000 Yeah, please.
00:17:45.000 Okay, so two points.
00:17:47.000 Number one, this is rich coming from the party of Jim Crow.
00:17:51.000 The party that literally put those things on the books.
00:17:55.000 They're now pushing back on us.
00:17:57.000 With that, this makes absolutely no sense.
00:18:00.000 And one of the reasons it makes no sense is that number two, under this bill, there's no finite list of ways that you can prove your citizenship.
00:18:12.000 Now, when you fill out an I-9, when any American starts new employment, they have to fill out an I-9.
00:18:21.000 And you've got only a couple of options.
00:18:23.000 You've got to provide a U.S.
00:18:24.000 passport, some combination of a U.S.
00:18:27.000 passport and or a U.S.
00:18:29.000 issued birth certificate.
00:18:30.000 Now, understanding that not every American may have it.
00:18:34.000 There may be some Americans who, for whatever reason, don't have, never had, or lost irretrievably a birth certificate or some other verifying documentation.
00:18:47.000 There's enough flexibility built into the law.
00:18:50.000 We made it so that somebody lacking those documents can still provide other means by which they can prove it.
00:18:57.000 People who can vouch for when and where they were born, there are other means by which you can prove it.
00:19:01.000 It doesn't cost the voter anything.
00:19:05.000 This is not a poll tax.
00:19:06.000 That is an absolute, flat-out lie.
00:19:09.000 And it's the kind of lie you would expect to see coming from the party of Jim Crow.
00:19:14.000 It's so harmful to political discourse and dialogue where everything harkens back to this.
00:19:21.000 Representative Summer Lee says that requiring only American citizens vote is a xenophobic attack.
00:19:30.000 It is under attack right now, right here, with this very bill.
00:19:35.000 Republicans want to throw up barriers because when people vote, they lose.
00:19:39.000 Let me be clear, they don't want you to vote.
00:19:42.000 They don't want to hear black voices, brown voices, LGBTQIA voices, young voices.
00:19:47.000 Our fundamental access to our democracy is being politicized.
00:19:51.000 And this xenophobic attack that we're debating today will make it harder for Americans to vote.
00:19:56.000 My Republican colleagues will claim that requiring IDs is a small ask, but nearly 30 million people lack a valid driver's license, and about 15 to 18 million adults don't have access to documents proving their birth or citizenship.
00:20:09.000 Americans don't need more obstacles.
00:20:12.000 It's already hard enough.
