00:04:22.000 To put that in perspective, Joe Biden raised $50 million the entire month of last month.
00:04:27.000 But I think I'm getting ahead of myself here when I say this will be the biggest political backlash in American history.
00:04:36.000 And to understand why, it's actually far less about Donald Trump than it is about who we are as Americans, as a people, as Americans as a people, like deep in our DNA is the revolutionaries who started this country.
00:04:53.000 Every single signer, every signatory of the Declaration of Independence is a felon.
00:04:58.000 Every one of them signed a document that said, I am a criminal now under the laws of the British Empire.
00:05:06.000 Some founders of that founders and some signers of that document were tried and put in prison.

00:05:15.000 Some were executed.
00:05:16.000 The signers of the Declaration of Independence, who are memorialized and turned into monuments all throughout Washington, D.C. now, that that document itself, the felony document, the Declaration of Independence, is now encased in bulletproof glass and gold in the National Archives in a nuclear-proof bunker because we respect felons.

00:05:39.000 And the revolutionaries changed the world.
00:05:41.000 They're guaranteed persecution.
00:05:44.000 But through that persecution, whether it's an apostle or a prophet or Joan of Arc or Nelson Mandela or the signers of the Declaration of Independence, the felons, the criminals standing against evil tyrannical systems, they end up changing the world.

00:06:54.000 Professors from the University of Chicago, RFK campaign staffers saying now they're voting Trump.

00:07:04.000 The entire unified freedom movement saying this isn't the country that we want to live in.
00:07:10.000 And it's an important moment to take a step back and also realize that the sort of psychosexual orgasmic cringe display that we expected from the left isn't materializing, Charlie.

00:07:25.000 It's a little strange, isn't it?
00:07:27.000 Like, why aren't we seeing the celebrations in the streets and the ticker tape?
00:07:31.000 Because I think that they know they done effed up, Charlie.

00:07:42.000 And they are going, they are now shake.
00:07:45.000 Every time that a leftist opens up George Conway, every time takes his pudgy little fingers and opens up his social media, he is fearful of seeing the next round of polling or the next round of donation numbers because they know what they've, what they've just done here is effectively, again, put Nelson Mandela in prison.

00:08:55.000 Benny, we've known for quite some time that our institutions are rotten to the core.
00:08:59.000 And some people still yesterday said, I can't believe this.
00:09:02.000 This is so hard for me to believe.

00:09:06.000 So, Benny, my question is, why all of a sudden are they realizing what you and I have now known for a couple years?
00:09:14.000 Yeah, so you were able to ring this like a bell a decade ago with the founding of Turning Point USA when you said what's happening in our college institutions will make its way to the halls of Congress and to the halls of the judiciary.
00:09:31.000 The institutional rot began perhaps at the universities and in the nuclear epicenters of thought formation or lack thereof.
00:09:43.000 And it was only a matter of time until you have a ruling like this, given the fact that the people who are educated in these institutions come out.
00:09:54.000 And you saw what happened at Columbia University.
00:09:56.000 You see what happens across the country.
00:10:00.000 These aren't real institutions.
00:10:01.000 These institutions are designed to overthrow what made this country great in the first place.
00:10:09.000 And so you're just seeing the end result.
00:10:11.000 The end result is also Ilhan Omar AOC in Congress.
00:10:14.000 You're seeing that decay every single day.
00:10:17.000 But what I would say to the weak Republicans, you know, fast forwarding here, to the weak Republicans that want to mule today and send tweets and statements and go on cable TV and cry and strongly worded letters to the DOJ, I say to you, move aside.

00:10:45.000 We don't need you anymore.
00:10:47.000 We're not going to abide by the old rules of the system.

00:10:58.000 And the shocking reality is that the shocking reality is that Democrats, especially really powerful Democrats like the Clintons, the Obamas, and the Bidens, have done a lot of criminal things in red states.
00:11:14.000 Let's just take, for example, Jim Biden, who ran a Medicare fraud embezzlement scheme in the state of Florida, shut down like 20 different hospitals because of that collapse, putting little grandmothers and children that needed medical help on the streets here in Florida, causing major harm to the people of this great red state, getting filthy rich on it.

00:11:40.000 So now it should fall to Ashley Moody, who's the attorney general of this state and other DAs to take Jim Biden, Joe Biden's brother, drag his to the Everglades into a trumped plus 50 district.

00:11:59.000 I want a judge who donated to Trump and I want an entire jury of MAGA hats judging Jim Biden for his known crime of defrauding and embezzling against the people of Florida.

00:15:14.000 If you want to get after the Clintons, well, did you know, Charlie, that the Clinton Foundation has always and is to this very day operational out of Little Rock, Arkansas, and that Todd Blanch is a MAGA Republican who is in charge of the law in Arkansas.
00:15:38.000 He's the attorney general of the state of Arkansas, and that the governor of the state of Arkansas is Sarah Sanders.
00:15:45.000 And you could launch an investigation on that.

00:16:44.000 Yet the charges that you get him on are bookkeeping errors from 2017 that have run out the statute of limitations for some alleged affair in 2005.

00:17:04.000 We can do that to Barack Obama, who summarily murdered an American teenager without a trial, violating his constitutional rights, obviously.

00:17:22.000 So just go to southern Indiana, to that federal district, and that Trump plus 50 district and charge Barack Obama with the summary murder of an American teenager on Mar-Alwaki in Yemen.

00:17:39.000 And the wild thing, Charlie, is that these demons on the other side, the Clintons, the Bidens, the Obamas, they actually committed crimes, like real crimes, really heinous, heinous stuff.

00:19:38.000 So, for example, you have all your neighbors' addresses and many of their names, or even the ones that are close to you.

00:19:47.000 I just want to write you about the upcoming election.
00:19:49.000 You know, our country's falling apart, blah, blah, blah.

00:20:11.000 It is remarkable from The Intelligencer, which is one of their wrinkle publications.

00:20:22.000 Yeah, sure thing, Charlie.
00:20:23.000 So, this article is by Ellie Hoenig.
00:20:26.000 They're a legal contributor to CNN, Harvard law grad, long career, like left-leaning lawyer.
00:20:35.000 And it's one of those things.
00:20:36.000 This is actually, I'd say, it's one of the better things that the left does.
00:20:39.000 Like, they'll do these really bad things, like prosecute Trump, and then there always is going to be someone who basically finally has their crisis and comes out and says, Okay, guys, this is actually really bad.
00:20:50.000 We should not be doing this.
00:20:51.000 And so, that's what Hoenig is doing here.
00:20:54.000 And what it all is, is this is clearly from a perspective of someone who doesn't like Trump, possibly even thinks Trump should be convicted of something.
00:21:01.000 But Hoenig comes out and says, This case is bad, and it's even specifically a case made from scratch to get Trump.
00:21:11.000 He says the New York, the Manhattan DA's office apparently internally calls it the zombie case because they had to get really creative to justify how they could charge this conduct from all the way back in 2016 because it normally had a two-year statute of limitations.
00:21:28.000 So, they had to say, Well, it was a conspiracy to cover up other crimes, although they never charge those other crimes, and they're not even that specific about what the other crimes are.
00:21:38.000 But he says it's actually a Frankenstein case, even more than a zombie one.
00:21:42.000 He says it is cobbled together with ill-fitting parts into an ugly, awkward, but more or less functioning contraption that just might ultimately turn against its creator.
00:21:54.000 He says Trump has a million viable reasons to appeal against this, and that even in New York, with all of its problems and all of its bias, he's going to have a decent shot at a reversal.
00:22:06.000 Never mind what might happen if a federal court decided to get involved in this.
00:22:10.000 There's so many good lines in this.
00:22:12.000 Let's see.
00:22:14.000 Let me find it here.
00:22:17.000 The charges against Trump are so obscure and nearly entirely unprecedented.
00:22:22.000 In fact, he says, no state prosecutor, not in New York, not in Wyoming, not anywhere, has ever used a federal election law as a predicate for a state crime against anyone for anything.
00:22:38.000 And until now, that is what the New York Alvin Bragg's case was.
00:22:42.000 His case was: he falsified his records, and as a result, he was conspiring to unlawfully change an election by breaking federal election law.
00:22:54.000 No one has ever brought a case like this in American history against anyone.
00:23:00.000 And he also points out the only actual charge they have is for falsifying business records, and that's almost never the only charge they bring in a case.
00:23:09.000 It's just extremely obvious and has to be said over and over again.
00:23:13.000 Set everything aside about concerns with the jury, concerns with the judge, concerns with procedure.
00:23:19.000 This legal case is a case that only exists to be brought against Trump.
00:23:24.000 It's never been brought against anyone else, and it probably never will be brought against anyone else.
00:23:29.000 They'll come up with new bespoke charges to go against other Republicans.
00:23:34.000 And that just has to be driven home.
00:23:36.000 This case would not exist for any other person in America.

00:24:59.000 I mean, you can insert your adjective of choice to describe where we are, and I'm not sure that there's a single word in the dictionary that quite adequately describes it.
00:25:06.000 I mean, you know, Charlie, my grandfather was in the newspaper industry when I was growing up, and I have all these fond memories of flipping through the newspaper when I was a kid.
00:25:13.000 And you would literally read about this overseas.
00:25:16.000 You know, you would read about some, you know, Eastern European country, a former iron curtain country, maybe a sub-Saharan African tin pot dictatorship, maybe some third world Islamist hellhole.
00:25:26.000 You would read about prosecuting and then trying to incarcerate your political enemy.
00:25:30.000 I mean, the way I put it in my column this morning, it kind of has the whiff of like medieval England.
00:25:35.000 The king comes in, deposes his rival, and then vanquishes him by sending him to the Tower of London to rot for the rest of his life.
00:25:41.000 But in America, you know, the land of the free and the home of the brave, like that America?
00:25:46.000 Like the America, like where I went to law school and clerked for a federal appeals judge and speak at law schools across the country where I, you know, I worship the Constitution.
00:25:52.000 I mean, this America, it is disgusting beyond words.
00:25:57.000 And, you know, I guess when the four indictments dropped last year, Charlie, if you had asked me, you had asked me which of the four was the most dangerous to Trump, no way in the world I would have said that the New York case was the one that was actually going to do him in.
00:26:09.000 Yes, it's New York City.
00:26:10.000 It's a terrible jury and whatnot here.
00:26:12.000 But this is also by far, by far, the most absolutely meritless and baseless of all of them.
00:26:19.000 Alvin Bragg's own predecessor, the equally left-wing Cy Vance Jr., looked into this.
00:26:24.000 He declined to bring charges.
00:26:25.000 The federal prosecutor's office under Biden, the SDNY, the Southern District of New York, they looked into this.
00:26:30.000 They declined to bring charges.
00:26:32.000 You know, this is not the big January 6th case that all of like the Democrat lawfare complex and the mainstream media is not that case.
00:26:40.000 That's Jack Smith's DC case.
00:26:41.000 This is so-called hush money payments for conduct, fraudulent bookkeeping that has a two-year statute of limitations, all about a one-night stand that allegedly happened.
00:26:51.000 We don't even know that it happened, what, 18 years ago, back in 2006?
00:26:55.000 It is an absolute freaking outrage of the highest proportions imaginable.
00:27:01.000 And, you know, they have crossed the proverbial Rubicon so many times now, Charlie.
00:27:05.000 I mean, they crossed it definitely when this indictment even dropped in the first place, the first ever indictment brought.
00:27:11.000 They obviously crossed it way back in 2018 with the Brett Kavanaugh confirmation hearing and throwing out four to 5,000 years of norms of civilization, all innocent or proven guilty.
00:27:19.000 How many Rubicons do they have to cross until our side, including my fellow lawyers, wake the heck up and realize what is happening in this country and realize that this neutral playing field, this idea of lady justice, of blindfolded justice, of liberal norms of neutrality, it's gone.
00:27:38.000 It is done right now.
00:27:40.000 And if you want to restore that, which is a noble and laudable goal, it's going to take some getting of our hands really dirty.
00:27:46.000 We're going to have to bloody up some notices.
00:27:49.000 What does that mean, Josh?
00:27:50.000 I mean, let's get into the details here.

00:27:54.000 We got to measure twice and cut once.
00:27:55.000 What does that mean?
00:27:56.000 I hate to drill you down away from the abstractions.
00:27:59.000 What does that mean with specificity here?
00:28:01.000 So we need to see DAs and attorneys general start engaging in equally high-profile politicized prosecutions.
00:28:09.000 By the way, it doesn't bring me any joy to come on your show, Charlie, and openly advocate for politicized prosecutions.
00:28:16.000 But the point is that if you want to restore some sense of neutrality, you have to make them feel the pain.
00:28:23.000 I mean, it's the whole idea of mutually assured destruction.
00:28:25.000 So for example, if you are a DA, let's say you're a 30 to 35 year old Republican DA in like the Texas panhandle in some very red jurisdiction, you want to make some inroads, you're ambitious, start filing some very creative prosecutions.
00:28:38.000 Find some charge to bring Anthony Fauci and Deborah Burks down there.
00:28:42.000 What about Hunter Biden?
00:28:43.000 Well, his gun charge, his gun trial starts on Monday, and then his tax trial allegedly starts back in September.
00:28:49.000 But there's a lot of meat left on that bone.
00:28:51.000 I mean, no one's touched any of the FARA stuff, the Ukraine corruption, China, any of that.
00:28:54.000 There's a lot of meat left on Hunter Biden as well there.
00:28:57.000 How about immigration?
00:28:58.000 Immigration is by far the number one issue that the country should be deciding the 2024 election based on.
00:29:04.000 You know, if you're a prosecutor down in Texas, in my state of Florida, Arizona, wherever, any state that has had a large illegal alien influx over the course of the Biden presidency, which is basically every state for that matter, actually, you know, and if you're a prosecutor, try to get some high-profile prosecution against a major open borders advocate who's maybe leading a human trafficking ring.
00:29:23.000 Someone who would actually not just do legal damage, but the optics of that would actually try to rejuvenate our side, to give our side hope that we actually can come to the playing field and fight again.
00:29:33.000 It's going to be a long slog back from the abyss, but you're going to have to.

00:29:57.000 Well, look, as someone who kind of, you know, I went to a top law school.
00:30:00.000 I was a federal society member.
00:30:01.000 I still am a federal society.
00:30:02.000 I mean, like, Charlie, you have to understand the milieu in which right-wing lawyers come from.
00:30:07.000 I mean, I know because I'm one of them.
00:30:08.000 And you basically exist in kind of this bubble in law school.
00:30:11.000 Maybe it's changed since I graduated 80 years ago, but you exist in this bubble where you're liberal classmates and you, oh, you disagree about the law a little bit.
00:30:18.000 We're going to go ahead and get drinks after class there.
00:30:20.000 This is kind of the whole idea of originalism as a jurisprudential philosophy.
00:30:24.000 I mean, this whole idea that we're just going to give it a good faith and then the left is going to come in and somehow we're not going to get railroaded because their justices vote in a row every single time.
00:30:32.000 And then all it takes is one of our guys to defect on so-called principled grounds and then we're screwed.
00:30:37.000 So, I mean, the two sides are definitionally not equal.
00:30:40.000 And until we structurally just change the way that young conservative law students, college students who are applying to law school, it starts there.
00:30:49.000 Then it'll start to kind of trickle into the DAs and the AGs and people like that.
00:30:52.000 But it's going to take a long time, I fear.
00:30:55.000 Yeah, no, I think that's so well said.
00:30:57.000 And it's, I know of what you speak.
00:31:00.000 And I like the Federalist Society.
00:31:02.000 I think that the strategy has been really prudent and good to try to win back the courts and to try to recenter us away from the war in court and the burger courts that we saw.
00:31:12.000 That was really what invigorated this whole multi-decade, multi-generation, generational constitutional nonprofit project.
00:31:20.000 And it's been terrific.
00:31:22.000 However, you have to be honest about the country you're living in.
00:31:28.000 And if the institutions that you revere are no longer the institutions that you once revered, then you have to be honest.
00:31:36.000 And I'm afraid there's a lot of delusion because I think people are afraid because it's not dissimilar to like the COVID vaccine or towards other limiting beliefs where people are like afraid that if that is not true, then like what else might not be true?
00:31:52.000 And high society is the most attached to these limiting beliefs.
00:31:57.000 I only use the COVID vaccine as just one thing.
00:31:59.000 I don't mean to loop that in, but there are things in society where people are afraid to even discuss it because it might bring you to two, three, four, five steps beyond that.
00:32:08.000 And you're like, I just, I can't process it because my entire world is going to fall apart.
00:32:12.000 And for a lot of high society conservative lawyers, their entire life, their existence is built around the idea of the impenetrable and the honest American justice system.
00:32:24.000 Guess what?
00:32:24.000 It's not.
00:32:25.000 Well, I think that you really nailed it because, again, these lawyers who grew up in this milieu that I was describing earlier, you know, you want to get to the corridors of power.
00:32:35.000 I mean, you still want to work in the elite law firms.
00:32:37.000 You still want to work in the elite agencies in Washington, D.C. Maybe you want to be general counsel at a Fortune 500 company, something like that.
00:32:44.000 And that necessarily is going to cloud your judgment insofar as you are not going to want to see your colleagues as an enemy who wants to throw you into a proverbial or perhaps even, God forbid, a literal gulag, right?
00:32:57.000 I mean, it's going to cloud your judgment.
00:32:58.000 You're not going to be able to see clearly when you still want to be friendly with these people or at least be amicable with them or have them as acquaintances.
00:33:06.000 And, you know, I'm not saying that you should, you know, cut out everyone who does not agree with you or see eye to eye from your life, but you do have to be clear-eyed about the state of the prosecutorial apparatus in this country right now.
00:33:19.000 You know, one of the greatest misconceptions that I've heard over the past 24 hours is, oh, it's just Trump.
00:33:25.000 You know, he's an infamous felon.
00:33:26.000 I mean, he was palling around with Roy Cohn decades ago and he was tented to the mafia.
00:33:31.000 It's just Trump.
00:33:32.000 No, it's actually not just Trump.
00:33:34.000 I mean, where have these people been living that they think it's just Trump?
00:33:37.000 I can go at least as far back as when the Obama administration started prosecuting the little sisters of the poor, nuns.
00:33:43.000 They sued nuns for failing to subsidize abortive fashions as part of Obamacare.
00:33:49.000 So this whole prosecute your political enemies thing at least started during the Obama administration.
00:33:54.000 But the Biden administration has obviously taken it to the next level.
00:33:56.000 We've seen pro-lifers who are being prosecuted under a ridiculous interpretation of the FACE Act.
00:34:01.000 Obviously, all the January 6 prisoners is John Eastman, my good friend, what's happened to him is beyond appalling, beyond the pale.
00:34:08.000 He's being disbarred in California, prosecuted in Georgia, Arizona.
00:34:12.000 I mean, the list just goes on and on at this point.
00:34:13.000 So this is not, this is not just about Trump.
00:34:17.000 This is like the new normal at this point within the bowels of Democratic Party and progressive liberal legal thinking.
00:34:24.000 So, you know, amidst that reality, again, I just have to ask, I mean, like, what more is it going to take?
00:34:31.000 And the problem when it comes to law schools, I guess one final thought on this.
00:34:36.000 You don't have a whole lot of lawyers who become law professors who see it.
00:34:40.000 There are very, very, very few law professors in America who have been openly critical of the Trump prosecutions.
00:34:46.000 I can name a few.
00:34:47.000 There are a laudable, noble few.
00:34:49.000 But the fact that I can think in my head, like literally individually, who those people are, that is itself the problem.
00:34:55.000 And until we change the culture of the law schools, I just fear that we're not going to be able to kind of make inroads to do the sort of nose-bloodying that you and I know must be done.
00:35:05.000 Yeah, I mean, this is where my crusade against college is at its weakest because you actually need elites.
00:35:13.000 You need people that are getting their JDs and people that are becoming lawyers.
00:35:18.000 When I say that college is a scam, I mean it, but we actually need people at the top of society.
00:35:22.000 Josh, plug your stuff.
00:35:24.000 Yeah, so just real quick in 10 seconds, Charlie, to your point about college scam.
00:35:27.000 We need class traitors.
00:35:28.000 People like Trump, Josh Hawley, JD Vance, who have the elite degrees, but then they're traitors to the ruling class.
