00:04:36.000And to understand why, it's actually far less about Donald Trump than it is about who we are as Americans, as a people, as Americans as a people, like deep in our DNA is the revolutionaries who started this country.
00:04:53.000Every single signer, every signatory of the Declaration of Independence is a felon.
00:04:58.000Every one of them signed a document that said, I am a criminal now under the laws of the British Empire.
00:05:06.000Some founders of that founders and some signers of that document were tried and put in prison.
00:05:16.000The signers of the Declaration of Independence, who are memorialized and turned into monuments all throughout Washington, D.C. now, that that document itself, the felony document, the Declaration of Independence, is now encased in bulletproof glass and gold in the National Archives in a nuclear-proof bunker because we respect felons.

00:05:39.000And the revolutionaries changed the world.

00:07:45.000Every time that a leftist opens up George Conway, every time takes his pudgy little fingers and opens up his social media, he is fearful of seeing the next round of polling or the next round of donation numbers because they know what they've, what they've just done here is effectively, again, put Nelson Mandela in prison.

00:08:09.000You've given him the story that he needed to run on.
00:08:15.000He already had a great story, Donald Trump.
00:08:17.000No one's crystallized it better than you, Charlie, but this just adds a shocking and wonderful chapter to the story of Trump.
00:09:06.000So, Benny, my question is, why all of a sudden are they realizing what you and I have now known for a couple years?
00:09:14.000Yeah, so you were able to ring this like a bell a decade ago with the founding of Turning Point USA when you said what's happening in our college institutions will make its way to the halls of Congress and to the halls of the judiciary.
00:09:31.000The institutional rot began perhaps at the universities and in the nuclear epicenters of thought formation or lack thereof.
00:09:43.000And it was only a matter of time until you have a ruling like this, given the fact that the people who are educated in these institutions come out.
00:09:54.000And you saw what happened at Columbia University.
00:09:56.000You see what happens across the country.
00:10:01.000These institutions are designed to overthrow what made this country great in the first place.
00:10:09.000And so you're just seeing the end result.
00:10:11.000The end result is also Ilhan Omar AOC in Congress.
00:10:14.000You're seeing that decay every single day.
00:10:17.000But what I would say to the weak Republicans, you know, fast forwarding here, to the weak Republicans that want to mule today and send tweets and statements and go on cable TV and cry and strongly worded letters to the DOJ, I say to you, move aside.

00:10:47.000We're not going to abide by the old rules of the system.

00:15:45.000And you could launch an investigation on that.
00:16:10.000They believe that they live in an America that was painted by Norman Rockwell in the 1950s and some postcard, and that there are principles that still exist.
00:16:20.000The Marxist has no principles, just the pure pursuit of power.
00:16:25.000They'll celebrate putting Donald Trump in jail for what exactly.
00:16:29.000And I guess that's the thing that I just can't really square.
00:16:34.000They told their drooling audiences for years, Charlie, that Donald Trump was a terrorist or a Putin puppet or an insurrectionist.
00:16:44.000Yet the charges that you get him on are bookkeeping errors from 2017 that have run out the statute of limitations for some alleged affair in 2005.
00:17:04.000We can do that to Barack Obama, who summarily murdered an American teenager without a trial, violating his constitutional rights, obviously.
00:17:12.000And he did this in a foreign country, which means that there's no statute of limitations.
00:17:16.000So you could bring that in any federal district in the country.
00:17:22.000So just go to southern Indiana, to that federal district, and that Trump plus 50 district and charge Barack Obama with the summary murder of an American teenager on Mar-Alwaki in Yemen.
00:17:39.000And the wild thing, Charlie, is that these demons on the other side, the Clintons, the Bidens, the Obamas, they actually committed crimes, like real crimes, really heinous, heinous stuff.
00:17:50.000The Clinton Foundation, some of the worst things that have happened in human history have been have rolled through that foundation.
00:19:11.000This is something that Democrats do artificially, and it works.
00:19:15.000So the Democrats with the Mark Kelly campaign, when he was running for reelection in 2020 against Blake Masters, they spent a ton of money on this, where they have neighbors write postcards and little notes to their neighbors about the election.
00:19:29.000It is incredibly powerful, and it's something that I think this audience could own.
00:19:34.000I'm going to try to figure out a way where I can get an easy call to action with this.
00:19:38.000So, for example, you have all your neighbors' addresses and many of their names, or even the ones that are close to you.
00:19:44.000You could say, Hey, you know, dear Mr. Smith, I live a couple doors down.
00:19:47.000I just want to write you about the upcoming election.
00:20:36.000This is actually, I'd say, it's one of the better things that the left does.
00:20:39.000Like, they'll do these really bad things, like prosecute Trump, and then there always is going to be someone who basically finally has their crisis and comes out and says, Okay, guys, this is actually really bad.
00:20:51.000And so, that's what Hoenig is doing here.
00:20:54.000And what it all is, is this is clearly from a perspective of someone who doesn't like Trump, possibly even thinks Trump should be convicted of something.
00:21:01.000But Hoenig comes out and says, This case is bad, and it's even specifically a case made from scratch to get Trump.
00:21:11.000He says the New York, the Manhattan DA's office apparently internally calls it the zombie case because they had to get really creative to justify how they could charge this conduct from all the way back in 2016 because it normally had a two-year statute of limitations.
00:21:28.000So, they had to say, Well, it was a conspiracy to cover up other crimes, although they never charge those other crimes, and they're not even that specific about what the other crimes are.
00:21:38.000But he says it's actually a Frankenstein case, even more than a zombie one.
00:21:42.000He says it is cobbled together with ill-fitting parts into an ugly, awkward, but more or less functioning contraption that just might ultimately turn against its creator.
00:21:54.000He says Trump has a million viable reasons to appeal against this, and that even in New York, with all of its problems and all of its bias, he's going to have a decent shot at a reversal.
00:22:06.000Never mind what might happen if a federal court decided to get involved in this.
00:22:17.000The charges against Trump are so obscure and nearly entirely unprecedented.
00:22:22.000In fact, he says, no state prosecutor, not in New York, not in Wyoming, not anywhere, has ever used a federal election law as a predicate for a state crime against anyone for anything.
00:22:38.000And until now, that is what the New York Alvin Bragg's case was.
00:22:42.000His case was: he falsified his records, and as a result, he was conspiring to unlawfully change an election by breaking federal election law.
00:22:54.000No one has ever brought a case like this in American history against anyone.
00:23:00.000And he also points out the only actual charge they have is for falsifying business records, and that's almost never the only charge they bring in a case.
00:23:09.000It's just extremely obvious and has to be said over and over again.
00:23:13.000Set everything aside about concerns with the jury, concerns with the judge, concerns with procedure.
00:23:19.000This legal case is a case that only exists to be brought against Trump.
00:23:24.000It's never been brought against anyone else, and it probably never will be brought against anyone else.
00:23:29.000They'll come up with new bespoke charges to go against other Republicans.

00:25:26.000You would read about prosecuting and then trying to incarcerate your political enemy.
00:25:30.000I mean, the way I put it in my column this morning, it kind of has the whiff of like medieval England.
00:25:35.000The king comes in, deposes his rival, and then vanquishes him by sending him to the Tower of London to rot for the rest of his life.
00:25:41.000But in America, you know, the land of the free and the home of the brave, like that America?
00:25:46.000Like the America, like where I went to law school and clerked for a federal appeals judge and speak at law schools across the country where I, you know, I worship the Constitution.
00:25:52.000I mean, this America, it is disgusting beyond words.
00:25:57.000And, you know, I guess when the four indictments dropped last year, Charlie, if you had asked me, you had asked me which of the four was the most dangerous to Trump, no way in the world I would have said that the New York case was the one that was actually going to do him in.
00:26:41.000This is so-called hush money payments for conduct, fraudulent bookkeeping that has a two-year statute of limitations, all about a one-night stand that allegedly happened.
00:26:51.000We don't even know that it happened, what, 18 years ago, back in 2006?
00:26:55.000It is an absolute freaking outrage of the highest proportions imaginable.
00:27:01.000And, you know, they have crossed the proverbial Rubicon so many times now, Charlie.
00:27:05.000I mean, they crossed it definitely when this indictment even dropped in the first place, the first ever indictment brought.
00:27:11.000They obviously crossed it way back in 2018 with the Brett Kavanaugh confirmation hearing and throwing out four to 5,000 years of norms of civilization, all innocent or proven guilty.
00:27:19.000How many Rubicons do they have to cross until our side, including my fellow lawyers, wake the heck up and realize what is happening in this country and realize that this neutral playing field, this idea of lady justice, of blindfolded justice, of liberal norms of neutrality, it's gone.
00:27:56.000I hate to drill you down away from the abstractions.
00:27:59.000What does that mean with specificity here?
00:28:01.000So we need to see DAs and attorneys general start engaging in equally high-profile politicized prosecutions.
00:28:09.000By the way, it doesn't bring me any joy to come on your show, Charlie, and openly advocate for politicized prosecutions.
00:28:16.000But the point is that if you want to restore some sense of neutrality, you have to make them feel the pain.
00:28:23.000I mean, it's the whole idea of mutually assured destruction.
00:28:25.000So for example, if you are a DA, let's say you're a 30 to 35 year old Republican DA in like the Texas panhandle in some very red jurisdiction, you want to make some inroads, you're ambitious, start filing some very creative prosecutions.
00:28:38.000Find some charge to bring Anthony Fauci and Deborah Burks down there.
00:28:58.000Immigration is by far the number one issue that the country should be deciding the 2024 election based on.
00:29:04.000You know, if you're a prosecutor down in Texas, in my state of Florida, Arizona, wherever, any state that has had a large illegal alien influx over the course of the Biden presidency, which is basically every state for that matter, actually, you know, and if you're a prosecutor, try to get some high-profile prosecution against a major open borders advocate who's maybe leading a human trafficking ring.
00:29:23.000Someone who would actually not just do legal damage, but the optics of that would actually try to rejuvenate our side, to give our side hope that we actually can come to the playing field and fight again.
00:29:33.000It's going to be a long slog back from the abyss, but you're going to have to.
00:30:02.000I mean, like, Charlie, you have to understand the milieu in which right-wing lawyers come from.
00:30:07.000I mean, I know because I'm one of them.
00:30:08.000And you basically exist in kind of this bubble in law school.
00:30:11.000Maybe it's changed since I graduated 80 years ago, but you exist in this bubble where you're liberal classmates and you, oh, you disagree about the law a little bit.
00:30:18.000We're going to go ahead and get drinks after class there.
00:30:20.000This is kind of the whole idea of originalism as a jurisprudential philosophy.
00:30:24.000I mean, this whole idea that we're just going to give it a good faith and then the left is going to come in and somehow we're not going to get railroaded because their justices vote in a row every single time.
00:30:32.000And then all it takes is one of our guys to defect on so-called principled grounds and then we're screwed.
00:30:37.000So, I mean, the two sides are definitionally not equal.
00:30:40.000And until we structurally just change the way that young conservative law students, college students who are applying to law school, it starts there.
00:30:49.000Then it'll start to kind of trickle into the DAs and the AGs and people like that.
00:30:52.000But it's going to take a long time, I fear.
00:30:55.000Yeah, no, I think that's so well said.
00:31:02.000I think that the strategy has been really prudent and good to try to win back the courts and to try to recenter us away from the war in court and the burger courts that we saw.
00:31:12.000That was really what invigorated this whole multi-decade, multi-generation, generational constitutional nonprofit project.
00:31:22.000However, you have to be honest about the country you're living in.
00:31:28.000And if the institutions that you revere are no longer the institutions that you once revered, then you have to be honest.
00:31:36.000And I'm afraid there's a lot of delusion because I think people are afraid because it's not dissimilar to like the COVID vaccine or towards other limiting beliefs where people are like afraid that if that is not true, then like what else might not be true?
00:31:52.000And high society is the most attached to these limiting beliefs.
00:31:57.000I only use the COVID vaccine as just one thing.
00:31:59.000I don't mean to loop that in, but there are things in society where people are afraid to even discuss it because it might bring you to two, three, four, five steps beyond that.
00:32:08.000And you're like, I just, I can't process it because my entire world is going to fall apart.
00:32:12.000And for a lot of high society conservative lawyers, their entire life, their existence is built around the idea of the impenetrable and the honest American justice system.
00:32:25.000Well, I think that you really nailed it because, again, these lawyers who grew up in this milieu that I was describing earlier, you know, you want to get to the corridors of power.
00:32:35.000I mean, you still want to work in the elite law firms.
00:32:37.000You still want to work in the elite agencies in Washington, D.C. Maybe you want to be general counsel at a Fortune 500 company, something like that.
00:32:44.000And that necessarily is going to cloud your judgment insofar as you are not going to want to see your colleagues as an enemy who wants to throw you into a proverbial or perhaps even, God forbid, a literal gulag, right?
00:32:57.000I mean, it's going to cloud your judgment.
00:32:58.000You're not going to be able to see clearly when you still want to be friendly with these people or at least be amicable with them or have them as acquaintances.
00:33:06.000And, you know, I'm not saying that you should, you know, cut out everyone who does not agree with you or see eye to eye from your life, but you do have to be clear-eyed about the state of the prosecutorial apparatus in this country right now.
00:33:19.000You know, one of the greatest misconceptions that I've heard over the past 24 hours is, oh, it's just Trump.
00:34:49.000But the fact that I can think in my head, like literally individually, who those people are, that is itself the problem.
00:34:55.000And until we change the culture of the law schools, I just fear that we're not going to be able to kind of make inroads to do the sort of nose-bloodying that you and I know must be done.
00:35:05.000Yeah, I mean, this is where my crusade against college is at its weakest because you actually need elites.
00:35:13.000You need people that are getting their JDs and people that are becoming lawyers.
00:35:18.000When I say that college is a scam, I mean it, but we actually need people at the top of society.
00:35:34.000We need more class traitors is what we need.
