00:03:37.000But I do think that there was some sort of a wink and a nod and a signal to get Bragg to, no matter how silly it is, get him processed, get him in, so that all of a sudden the Overton window has moved where it's now acceptable to go after Trump.

00:04:02.000Then Alvin Bragg gets us a little bit, gets the American public more prepared for the idea of this unprecedented banana republic action where you indict a former president on bogus charges.

00:04:39.000That's my working theory: they actually communicate in the public channels so that there's no FOIA or there's no way that they could ever be discovered.

00:04:55.000It was a Nate Silver thing where they discovered there was one of the early messenger services where hundreds of liberal journalists were all colluding essentially.

00:05:35.000And since we last spoke, we've had, you know, details leak out that she's looking at a RICO charge.
00:05:42.000Georgia has an interesting racketeering law.

00:06:04.000So, and so that's why I covered it so heavily yesterday and have been covering the, you know, the possibility or the potential of the Mark Meadows development.

00:07:34.000And so, Kane, let's just really take a moment here and realize how much has changed since January 1 of this year, where we knew we were going to be in for a wild year.
00:07:45.000Tucker is now going to be benched till 2025 if Fox News gets their way, according to Axios.

00:13:30.000So, so that's it, you know, Tom Fitton is another guy that they're trying to silence.
00:13:34.000So, let's get to Bannon really quick because I know your audience loves Bannon and loves Warhammer.
00:13:40.000So, I want people to know what this guy is going through.
00:13:42.000So, everyone remembers that the congressional subpoena case that he ignored and was prosecuted for, even though dozens of other people have ignored congressional subpoenas through the years and nothing happened to them.
00:13:55.000He was found guilty last fall, October.
00:13:58.000It was a four-month sentence, but it was delayed pending appeal.
00:14:01.000Well, Bannon's legal team made the appeal to the DC Circuit Court in early May, and DOJ officially responded last Friday, June 2nd, with their filing, denying, of course, everything that Bannon's team was saying.
00:14:17.000And so, people need to understand that whenever the DC Circuit Court decides to rule, it could be tomorrow, it could be a week from tomorrow, but they'll be calling Bannon and his lawyers in.
00:14:28.000And if they deny his appeal, Steve Bannon goes to jail immediately, right then.
00:14:47.000And then he also next May has to face charge in the state of New York on another fraudulent, ridiculous thing that they're throwing at him.
00:14:54.000And so, start to see the game that's being played.
00:14:57.000And again, a lot of these Republicans, Kane, though, in leadership, they just think that we're still in this policy debate.
00:15:06.000And I mean, you know, we look around on our show.
00:15:08.000We're like, wow, Tucker's gone for now and Bannon's going to jail.
00:15:12.000And they're like, okay, the forces are going in real time.
00:16:01.000And yeah, you know, the lawsuit, I can't remember if it was last week or this week, but the idea that they're trying to, you know, I have no good things to say about Project Veritas and its board members, and it really, really just pisses me off, to be honest.
00:16:16.000And so you look at the, if you were to kind of put together an all-star team of, okay, obviously Trump's on the All-Star team, but the All-Star team would say, you need Bannon, you need Tucker, you need O'Keefe.

00:19:22.000And specifically, we have been highlighting the abuse of power by the Justice Department in targeting Trump on this records fakery that they made up and manufactured to justify a raid on his home and other abuses because we had been involved in a similar case where they took the Justice Department, the courts, and the archives took the exact opposite position to protect Bill Clinton.
00:19:49.000And so, as soon as this happened, we said, oh, well, isn't this interesting?
00:19:55.000The prior legal position of the Justice Department has been that a president who has documents after he leaves the Oval Office can't be questioned about them.
00:20:04.000They're presumptively personal, and no one can second-guess them.
00:20:08.000And that was the position of the Justice Department in court, and that was the position of the court that had the most persuasive case on this.
00:20:41.000It was two FBI agents, two young FBI agents, serving me a subpoena, evidently on this Mar-a-Lago records fiasco.
00:20:50.000But, you know, just before I went to the grand jury, ultimately, they said, oh, we want to talk to him for a few minutes on the election issues, the January 6th issue.
00:20:59.000And it turned out that was the bulk of the questioning.
00:21:01.000But in the end, Carly, it was a lot of noise signifying nothing.
00:21:06.000They argued with me for four hours, harassed me with questions, tried to intimidate me, and I wasn't intimidated.
00:21:13.000But it was an outrageous abuse of power and of the grand jury process to go after the number one critic of the Justice Department here, I say.
00:22:00.000And then all of a sudden, it turns out it was right in the middle of the whole Biden fiasco that was going on behind the scenes when he got where he got caught with documents.
00:22:08.000Remember, they hid that from us at the time.
00:22:11.000They said, oh, no, we're going to reassert a subpoena.
00:22:13.000You have to show up at the grand jury, which means you're right.
00:22:16.000I can't have my attorney with me at the grand jury.
00:22:39.000Is the attorney listening to the conversation or in the other room?
00:22:44.000Or is the attorney totally disconnected from it?
00:22:47.000I mean, I can say I want to go consult my attorney and they let me step out for a minute or two.
00:22:52.000No, but this is important because, Tom, we know what this is all about.
00:22:56.000We're not, you know, we're not trusting of these people.
00:23:00.000They wanted to try to have you misremember one thing and then they indict you for lying to a grand jury.
00:23:06.000Yeah, and you know, and you know that's the game.
00:23:11.000We spent most of the time arguing about politics and First Amendment protected activity, about the Clinton Sock drawer case, the case I referenced earlier, about electors and Democrats, you know, and I told them, and this is quite specific, I told them, by the way, there was a plan by Democrats to engage in civil insurrection if Trump won the election.
00:23:34.000And I was very much concerned about that and what the preparations were for that violence that we were signaling and planning.
00:23:41.000Indeed, I read in the New York Times that John Podesta had wargamed a scenario where states would secede from the union, left-wing states would secede from the union unless they got the electoral college results they wanted.
00:23:56.000And that's what I was concerned about.
00:23:58.000And I was wondering why no one had been investigating that.
00:24:03.000So, you know, that was evidence before the grand jury.
00:24:05.000Maybe they'll follow up on it, Charlie.
00:24:16.000Yeah, they only spent about an hour talking to me about this Mar-a-Lago fiasco and then three hours arguing with me about emails and tweets related to the election dispute.
00:24:29.000You know, as I'm talking to them about it, I'm like, first of all, why am I being questioned about my tweets?
00:24:36.000And other First Amendment protected activity.
00:25:07.000I'm like, I don't remember what his reaction was.
00:25:09.000I mean, he's, you know, my view is unless you're a monkey climbing up and down the roll of the walls, no one's really going to remember much of a reaction to comments you make.
00:25:19.000And then they said, well, you know, did you have lunch with him another time?
00:25:25.000I said, no, I did because I remembered what we ate, right?
00:25:30.000And oh, so you remember what you eat at lunch, but not how he reacted.
00:25:35.000And I thought, you know, this is just so outrageous.
00:25:38.000It's just so outrageous and so juvenile and petty, but also dangerous because they're, you know, suggesting you're, you know, having a false failure to remember in front of a grand jury, which would be a crime.
00:25:52.000So that's the game they were playing with the head of the country's number one government watchdog organization.
00:25:58.000It'd be like bringing in, to be clear, the head of the ACLU or the NAACP.
00:26:04.000But this Justice Department doesn't give a rat's tail.
00:26:08.000And we're now in the era of a regime, not an administration.
00:26:26.000Yeah, that's, you know, that's what the reporting is.
00:26:31.000You know, the problem that they have going back to the law, which I hope is supposed to apply, is that the analysis of the law prior to Trump had been that the president has deference as to how he handles records classified and presidential.
00:26:47.000And if he takes them with him, they're presumptively his and personal.
00:26:53.000So rather than try to deal with that, they're pretending, well, it's national defense information according to reports.
00:27:00.000And maybe they can get around it that way by saying he doesn't have prerogatives that he has related to classified information.
00:27:07.000And of course, that's just bunk, too, because all the records he had were initially covered by the Presidential Records Act.
00:27:13.000And if he designates them as presidential or personal, and that designation doesn't have to be official, it can be informal in the sense he just takes them and uses them.
00:27:23.000And in this case of the president, if he keeps them after he leaves office, they're presumptively personal.
00:27:29.000That covers any record the government has given him in the White House, including national defense information.
00:27:50.000I think they're going to indict him in Fulton County, too.
00:27:53.000And the left is hoping one of the three stick and he's forced to campaign from jail.
00:27:58.000I mean, this is a serious threat to our Republican form of government, Charles.
00:28:02.000And our friends here in Washington, I don't need to tell you, are whistling past the graveyard.
00:28:06.000Oh, yeah, whistling past the graveyard with this attack on our structure of government, our ability to govern ourselves, our right to select our own president and not have the offices of the Justice Department and the FBI be used by a political party to rig an election.
00:28:23.000And most republics, not most, I'd say a fair amount of Republicans in D.C. are thrilled about this.
00:28:27.000They're like, finally, we can get rid of this Trump guy.
00:29:17.000But it's not about his policies or whether he should be president or not.
00:29:22.000It's about whether or not is he going to be protected under our law or are all the rules going to be thrown out?
00:29:29.000And when you throw out all the rules because you hate Trump, it means the rules that govern us as a constitutional republic in terms of our structure of government.
00:29:37.000It means our core civil rights, including our First Amendment right to challenge an election and our participate in our system without fear of punishment, being thrown in jail.
00:29:49.000So all of those rules that are being abused against Trump, and I saw it firsthand, I'm a witness, I'm a victim.
00:29:56.000You know, if they're not protecting Trump, you think the rest of us are going to be safe?
00:30:14.000Okay, well, it's Pride Month, everybody.
