00:02:13.000 We will not embrace the ideas that have destroyed countries, destroyed lives, and we are going to fight for freedom on campuses across the country.

00:02:22.000 That's why we are here.

00:02:25.000 Brought to you by the Loan Experts I Trust, Andrew and Todd at Sierra Pacific Mortgage at AndrewandTodd.com.

00:02:34.000 It is a great day to be alive, especially if you are in the womb. 1.00

00:02:41.000 My whole life, I was told that the repeal and the overturning of Roe versus Wade was never going to happen.

00:02:50.000 These are small thinking people.

00:02:53.000 This is the conservative movement I grew up in.

00:02:55.000 I grew up in a Republican and conservative movement that would think very small and say, oh, no, that'd be too controversial.

00:03:03.000 You can't do that.

00:03:06.000 Well, today it's done.

00:03:08.000 Roe versus Wade has been overturned.

00:03:11.000 Now, regardless of your views on abortion, the judicial decision of Roe versus Wade itself was judicial activism at its worst.

00:03:21.000 It was legislating from the bench.

00:03:24.000 It was imposing new law without using the proper constitutional channels to do so.

00:03:30.000 But today, as we look at the repeal of Roe versus Wade, the overturning of Roe versus Wade, there is a deeper point that I want to make with you here that you're not going to hear on cable television.

00:03:41.000 The deeper point is this: anything we want to do is possible.

00:03:46.000 We can build the wall.

00:03:48.000 We can have deportations of illegals. 0.94

00:03:50.000 We can ban drag queens from being exposed to children in bars. 1.00

00:03:54.000 We can have the parents' party take back ownership in kids' education. 0.94

00:03:59.000 We can have medical freedom.

00:04:00.000 We can push back against the pharmaceutical industrial complex.

00:04:04.000 I was told my whole life overturning Roe versus Wade was impossible.

00:04:07.000 That is a lie.

00:04:09.000 It was a lie by small thinking conservatives that wanted to manage the decline of America.

00:04:16.000 In reality, it's really all about the will.

00:04:21.000 Now we know this.

00:04:23.000 We now know that the left is no longer able to determine or dictate the terms of engagement.

00:04:28.000 Now it's about whether we are willing to use our political power, our constituency, to take back the country.

00:04:39.000 For years, people would lecture me.

00:04:42.000 Charlie, we can't touch the abortion issue.

00:04:44.000 Charlie, it's too controversial.

00:04:47.000 And the opposite is true.

00:04:49.000 Every single person that told us that this issue was an untouchable issue are now the ones that are looking and they're saying, well, I never thought this would happen.

00:04:59.000 You're right.

00:04:59.000 You never thought it would because you don't think very big.

00:05:02.000 You have no creativity.

00:05:02.000 You have no imagination.

00:05:04.000 And the lesson from this is, yes, to celebrate the millions of people that will now be able to live thanks to the repealing of Roe versus Wade.

00:05:18.000 Praise God.

00:05:19.000 Thank you, God, and thank you to all the prayer warriors.

00:05:22.000 And yes, thank you to President Donald Trump.

00:05:26.000 This does not happen without a billionaire playboy from New York City.

00:05:34.000 And I say that jokingly because they used to call him.

00:05:36.000 He's a billionaire playboy. 0.99

00:05:38.000 We hate him. 0.99

00:05:39.000 Christians would say that. 0.87

00:05:40.000 He's lived a terrible life when in reality, Donald Trump, who's definitely lived a colorful life, a full life, has done more for the unborn than most pastors have ever done.

00:05:53.000 Went down the golden escalator, did what he said he was going to do, gave us Gorsuch, Kavanaugh, and Amy Coney Barrett.

00:05:58.000 Now millions of people will live because of that.

00:06:00.000 That is a moral victory for the West. 0.90

00:06:03.000 That is a moral victory for the world.

00:06:06.000 Donald Trump did what he said he was going to do.

00:06:08.000 He said, look, we'll send it back down to the states.

00:06:10.000 We'll see what happens.

00:06:12.000 But so many Christians and conservatives said, oh, I don't like Trump's tone. 0.97

00:06:17.000 We might not like his tone, but what a shallow and silly argument that was.

00:06:24.000 There's a lot of takeaways from this, but the biggest one that I want to kind of start our conversation today with as we have amazing experts and guests is we can do hard things.

00:06:37.000 We can do things that the media and the activists and the industrial complex tells us is impossible.

00:06:45.000 We need to shatter our preconceptions.

00:06:48.000 We need to reconsider our premise and we need to think bigger because if Roe versus Wade is now repealed, anything is possible.

00:06:56.000 It is done.

00:06:58.000 Roe versus Wade is repealed.

00:07:01.000 My whole life, I was told this is impossible and it is done.

00:07:05.000 Praise God.

00:07:06.000 Regardless of your opinions of abortion, this does not outlaw abortion.

00:07:11.000 This turns it back to the states.

00:07:13.000 It allows the states to decide.

00:07:16.000 I'm very pro-life, and I don't apologize for it.

00:07:19.000 I know we have people with all sorts of different opinions on the abortion issue in our audience.

00:07:24.000 That's fine.

00:07:25.000 I will go through why we are pro-life on this show.

00:07:27.000 But regardless of your opinions on abortion, it is a fact that Roe versus Wade was the worst of judicial activism, was the worst of the Warren and the Burger Court converging together to give us a ruling that overturned states' rights, that obliterated the 10th Amendment, and interfered with the ability for states to be able to protect the unborn.

00:07:55.000 We have someone right on the front lines that is doing incredible work.

00:08:01.000 He literally hosts a show at Turning Point USA for us called Front Lines with Drew Hernandez, and his clips right now are going viral.

00:08:07.000 He's right now at the Supreme Court to give us a live reaction of now, as again, in case you missed the news, Roe versus Wade is repealed.

00:08:16.000 It is overturned.

00:08:18.000 Thomas, Gorsuch, Elito, Kavanaugh, Amy Coney Barrett.

00:08:24.000 And is it true that John Roberts also sided with the majority?

00:08:27.000 Is that right?

00:08:28.000 Roberts concurred, which means he sided with the majority.

00:08:31.000 Is that right?

00:08:32.000 That's amazing.

00:08:33.000 In a six to three decision.

00:08:34.000 I actually am glad Roberts did that.

00:08:37.000 It makes it even more convincing.

00:08:39.000 Are we sure?

00:08:39.000 I thought so.

00:08:39.000 I read somewhere it's 5-4.

00:08:41.000 We'll get that in real time.

00:08:42.000 But first, I want to get to Drew Hernandez.

00:08:44.000 He's right outside of the Supreme Court building.

00:08:46.000 Please excuse the background noise, but it's important we hear from Drew.

00:08:50.000 Drew, what is the vibe on the ground right now?

00:08:52.000 You're right outside of the U.S. Supreme Court.

00:08:54.000 Well, Charlie, this is a historic moment in the United States of America worldwide, the overturning of Roe v. Wade.

00:09:00.000 We were able to capture both sides, both reactions in real time here on the ground when it was really announced the second it was announced.

00:09:10.000 On the pro-life side, there were obvious cheers, jubilation, people just celebrating because of this historic overturning to save the lives of babies.

00:09:18.000 Even though it'll go back down to the states, it's still moved forward.

00:09:21.000 It's still moved forward for the pro-life movement and for the pro-baby movement.

00:09:26.000 But then the other side immediately was triggered and erupted into tears, were crying, calling the court illegitimate right in front of the Supreme Court.

00:09:36.000 And just moments ago, I don't know if you've seen the video, Charlie, I just put it up maybe about five minutes ago.

00:09:41.000 Congresswoman AOC did come out here and joined the pro-abortion protesters and was literally accusing the Supreme Court's decision and the Supreme Court of being illegitimate themselves, a sitting U.S. Congresswoman out here doing that and calling for people to take to the streets. 0.73

00:09:56.000 That clip is going viral right now on Twitter, but this is, we're going to see what happens, Charlie.

00:10:00.000 I know you and I have been talking about for the past week and a half, I mean, for a while now, that we're going to see probably some violence tonight.

00:10:07.000 We know that James Revenge has been threatening a night of rage, a night of violence the night a decision like this was to be made.

00:10:14.000 Some Antifa accounts on Twitter have already been announcing they're going to be here tonight in front of the Supreme Court at 5 p.m.

00:10:19.000 But I wouldn't even only have eyes on DC.

00:10:22.000 I would have eyes on Los Angeles, Seattle, Portland, New York, across the United States, because like I said, this is huge.

00:10:28.000 It's historic.

00:10:29.000 Not only has America been watching Charlie, but the world has been watching.

00:10:32.000 Yeah, so Drew, talk a little bit about that.

00:10:33.000 First of all, we hope you remain safe and we pray that there's no violence and we pray there's nothing.

00:10:38.000 But are you seeing any inklings of that?

00:10:39.000 You said Antifa is going to be there in just a couple hours.

00:10:41.000 I mean, this is a shot heard around the world.

00:10:43.000 I pray we don't have Riots 2.0, but my fear is Seattle starts to burn or Portland starts to burn or New York, and then it's just going to kind of spiral out of control.

00:10:52.000 You covered the BLM Floyd riots better than almost anybody else.

00:10:56.000 Are you seeing similar type of language?

00:10:58.000 Are you seeing a kind of mob that could potentially get out of control?

00:11:01.000 Well, as of right now, it's just protesting.

00:11:03.000 Obviously, people on the pro-choice, pro-abortion side are pissed off for obvious reasons.

00:11:07.000 We haven't seen any violence yet, but we know, according to James Revenge and Antifa, they have been promoting a night of rage for the night of this decision.

00:11:16.000 We're obviously not there yet, but we're going to stay on this and we're going to see.

00:11:19.000 I'll be first on the scene to cover that.

00:11:22.000 If it does become right behavior, if it does become mass illegal, just riots in the streets.

00:11:27.000 But here's the thing, Charlie, is this is quote unquote the new normal.

00:11:30.000 Post-2020, I covered those race riots and it was the same playbook.

00:11:35.000 Something happened.

00:11:36.000 They had a political agenda on the far left.

00:11:38.000 The politicians took the streets, just like literally like AOC did today, calling for people to hit the streets, accusing the government of being illegitimate.

00:11:45.000 So we're going to see if that playbook unfolds again here in 2022, with now the current issue being their right to murder babies. 0.55

00:11:53.000 So I want to read this through.

00:11:54.000 This is from the Department of Homeland Security.

00:11:56.000 The Department of Homeland Security has shared intelligence right now with the Catholic Church about a planned night of rage that has been threatened to be unleashed by pro-abortion groups if Roe versus Wade is overturned by the Supreme Court.

00:12:10.000 So if anyone listening right now is a Christian, more specifically part of the Catholic faith, which I am not, but I have great respect and great friends that are Catholic.

00:12:20.000 Just be very careful and make sure you have proper security precautions.

00:12:23.000 And Drew, I know you're going to be there all tonight and that you are going to be looking in great detail about what's happening here.

00:12:33.000 In closing, kind of just this moment as we see it, Drew, can you just reinforce, and I sent a little text to our thread this morning, how this is kind of shattering a lot of the small thinking conservatism.

00:12:46.000 You and I are both pro-life, but the broader point is we can do big and hard and impossible things.

00:12:51.000 You know, 10 years ago, I wouldn't have, many people would have thought this was possible.

00:12:56.000 Your thoughts, Drew.

00:12:58.000 Charlie, it's as simple as just doing it.

00:13:01.000 For decades, it seems like the right, Republicans, conservatives just always end up on defense, never on offense.

00:13:08.000 But right now, this is definitely an offensive move, pushing back on something evil and detrimental in our country.

00:13:15.000 This is what we need right now.

00:13:16.000 We need to continue to go on office, legislatively, push back on these people because they're evil, they're twisted, they're demonic, they're satanic, and there are ways of pushing back.

00:13:25.000 And it just comes down as simple as being courageous enough to just do it.

00:13:30.000 Even in the face of threats, even though the Supreme Court was threatened with the leak and they showed up to literally their houses, I heard that too.

00:13:37.000 They're still showing up in front of the justices' houses.

00:13:40.000 This is what America is, Charlie.

00:13:42.000 In the face of tyranny, threats, you do what is right for the sake of the country and truth.

00:13:47.000 That is so well said.

00:13:47.000 Amen.

00:13:48.000 Drew, thank you so much.

00:13:50.000 I just want to thank you for your commentary.

00:13:52.000 Stay safe and keep on using your journalism, your journalist instincts to expose what's happening there.

00:13:58.000 Drew Hernandez with Turning Point USA.

00:14:00.000 Drew, I don't know if you're even seeing this.

00:14:02.000 Your clips have already been seen millions of times.

00:14:04.000 They're everywhere.

00:14:05.000 Okay.

00:14:05.000 Keep it up.

00:14:06.000 Thank you, Drew.

00:14:07.000 Appreciate that.

00:14:08.000 Let's play some tape, actually, right from Drew Hernandez.

00:14:11.000 And I apologize from the background noise.

00:14:13.000 The audio is actually better than I thought.

00:14:14.000 He's literally right there on the steps of the Supreme Court.

00:14:18.000 Let's play cut 109, which is clip from Drew Hernandez.

00:14:22.000 Let's do 109 and 110 right after the one after the other, guys.

00:14:25.000 It's AOC in front of the Supreme Court.

00:14:28.000 Footage from Drew Hernandez, play cut 109.

00:14:31.000 ILEGIMET! 0.99

00:14:32.000 Yes, decision!

00:14:34.000 Illegitimate! 0.83

00:14:39.000 They're calling the Supreme Court illegitimate.

00:14:41.000 Interesting.

00:14:42.000 I thought you can't attack our Democrat institutions.

00:14:44.000 Democratic, play cut 110.

00:14:46.000 What the Supreme Court just did was that they chose to endanger the lives of all women and all birthing people in this country.

00:14:57.000 But not only that, they've chosen to strip rights from men, too. 0.91

00:15:02.000 That's it.

00:15:04.000 I can't.

00:15:04.000 I just, you had me until you said birthing people.

00:15:08.000 You deserve to lose.

00:15:09.000 You're done.

00:15:10.000 This is exactly why I'm glad.

00:15:12.000 One of the reasons why I'm glad Roe versus Wade is repealed.

00:15:15.000 You're an unserious person.

00:15:16.000 Anything you support, I must oppose.

00:15:18.000 You cannot tell me and conduct an interview and say, yes, you know, I'm really worried about the rights of women and birthing people. 1.00

00:15:24.000 You're done.

00:15:25.000 I immediately dismiss you. 0.91

00:15:26.000 You're an unserious person. 0.99

00:15:27.000 You can scream all you want. 0.97

00:15:28.000 You can mobilize to the streets.

00:15:30.000 Big fist.

00:15:32.000 Yeah, I really am really worried about birthing people. 1.00

00:15:35.000 What is a woman exactly, AOC? 1.00

00:15:38.000 The left simultaneously is telling us this is a war on women, and I can't tell you what a woman is. 0.97

00:15:43.000 Roe versus Wade is repealed.

00:15:44.000 The left is on defense.

00:15:45.000 We can do big, impossible, bold, ambitious things, regardless of your views on abortion.

00:15:50.000 This is a constitutional rights issue.

00:15:52.000 Who has the right to determine complex controversial issues?

00:15:56.000 Is it the Washington DC oligarchs, or is it a state-by-state issue?

00:16:01.000 That's really what this is about.

00:16:02.000 They're turning it into an abortion issue, which is fine. 0.98

00:16:05.000 I don't necessarily disagree with this, but this is the first step in what I believe is a constitutional reset.

00:16:13.000 Today, the majority of children have been exposed to pornography by age 11.

00:16:16.000 Even though most of it is accidental, this exposure can have a disastrous consequence for their mental health and future well-being.

00:16:22.000 If you want to protect your child and set them up with a healthy relationship, you need Canopy.

00:16:26.000 Canopy is the most effective technology on the planet for blocking pornography.

00:16:30.000 Canopy's app uses artificial intelligence to identify and filter explicit content on every website.

00:16:35.000 It could be done so in milliseconds and is 99.9% accurate.

00:16:38.000 While other apps block entire pages, Canopy is the only tool that filters within websites, plucking out explicit images and videos before they appear.

00:16:45.000 Its image scanning technology also prevents users from taking and sending not-so-good things.

00:16:50.000 The internet is awash in pornography, but your kids don't have to see it.

00:16:53.000 Canopy.us slash protect.

00:16:55.000 It's phenomenal.

00:16:56.000 I've checked it out myself.

00:17:09.000 That's canopy.us slash protect.

00:17:11.000 Canopy.us slash protect.

00:17:16.000 It's total bedlam in front of the Supreme Court.

00:17:18.000 It's not anything that is violent.

00:17:20.000 I pray it remains that way.

00:17:23.000 The people are using very charged language.

00:17:25.000 In fact, let me read one of the tweets of somebody outside of the Supreme Court right now.

00:17:30.000 One of the speakers with a megaphone also called for an uprising similar for the one in 2020 in the wake of George Floyd's death.

00:17:37.000 Any sort of mainstream media sympathy that these activists might be getting, I think is going to shatter as soon as they continue to use language like this.

00:17:46.000 But from a legal analysis, we have the great Josh Hammer, Newsweek opinion editor and a constitutional expert to just walk us through what exactly this means.

00:17:55.000 Josh, welcome back to the program.

00:17:57.000 Tell our audience, does this outlaw abortion or does this send it back to the states?

00:18:03.000 Tell us specifically what is in this opinion.

00:18:07.000 So, Charlie, first of all, great to be with you on such a great day for the Constitution, a great day for the country, really a great day for the human species for the very simple reason that we will have more unborn, innocent human beings who will actually be able to live as human beings.

00:18:20.000 So it's just, it's a remarkable day for the country.

00:18:22.000 And on a day like this, Charlie, I think young pro-lifers like you and I just have to have a debt of gratitude, honestly, to the past 50 years of pro-life activists who got us.

00:18:30.000 That's such a good point.

00:18:31.000 Sorry to interrupt.

00:18:32.000 You're exactly right.

00:18:32.000 It's been a lot of prayer warriors and activists and grassroots folks and a lot of Jewish organizations, a lot of pro-life organizations, a lot of Catholic organizations.

00:18:41.000 Great point.

00:18:42.000 Continue, please.

00:18:43.000 Yeah, absolutely.

00:18:44.000 But on the legal points here, what this opinion does, it's very similar, honestly, to the draft leaked leak or the leaked draft majority opinion, I should say, that came out a month and a half ago at Politico.

00:18:54.000 I mean, what this does, it's literally the exact same breakdown.

00:18:57.000 So it's a Sam Alito written five justice majority.

00:19:00.000 The Chief Justice Roberts narrowly concurs in the judgment.

00:19:02.000 It's very similar, honestly.

00:19:04.000 I mean, the dissent rhetoric is pretty over the top, honestly.

00:19:08.000 We can get to that if we want to.

00:19:09.000 But all this does, Charlie, what this opinion does is it kicks it back to the states.

00:19:13.000 That's all it does, full stop, end of story.

00:19:15.000 In fact, Justice Kavanaugh, in his concurring opinion, I would argue it's actually a little virtue signally, to be honest with you.

00:19:21.000 He actually goes out of his way.

00:19:23.000 He goes above and beyond just to drill this point home.

00:19:26.000 He actually kind of tamps down the argument that I and others have made that the equal protection clause of the 14th Amendment actually does protect unborn life.

00:19:35.000 Justice Kavanaugh seems to very much disagree with that argument.

00:19:38.000 So those of us who have made that argument have our work cut out for us.

00:19:41.000 But all this opinion does today is it kicks it back to the state so Texas can do what it wants, California and New York can do it.

00:19:46.000 That's a moderate decision, isn't it, though, Josh?

00:19:48.000 I mean, this is not some sort of radical thing.

00:19:51.000 It's saying allow local government to be sovereign, right?

00:19:55.000 Yeah, it's literally the middle ground position, Charlie.

00:19:57.000 I mean, the position the court staked out here is the definitional moderate middle ground position.

00:20:02.000 It is the position that the Constitution is values neutral on the question of abortion.

00:20:06.000 Again, that's actually not my position.

00:20:07.000 Interestingly.

00:20:08.000 No, nor is it mine.

00:20:09.000 But yes, I agree.

00:20:11.000 But it's a remarkable and necessary first step to get us to where we want to go.

00:20:14.000 And for that reason, it obviously should be celebrated.

00:20:17.000 Yeah, and so, but the left is doing what the left does, and they're completely totally losing their mind.

00:20:22.000 And so I want to ask you kind of one little teaser question here.

00:20:26.000 Clarence Thomas submitted some form of a, I don't really understand the technical procedural aspect of this, saying, though, that we should reconsider the Oberfell decision.

00:20:36.000 Is that right?

00:20:37.000 Look, Obergefell, I mean, came out seven years ago.

00:20:39.000 It was obviously a terrible decision.

00:20:41.000 I mean, Obergefell was decided on substantive due process grounds, which was the exact same 14th Amendment doctrine that got us Griswold versus Connecticut back in the 1960s.

00:20:49.000 It got us Roe versus Wade. 0.51

00:20:51.000 It has been responsible for a lot of harm.

00:20:53.000 Justice Thomas, more than any justice on the current court, time and time again, the late Justice Scalia did the same thing, said that this is a completely illegitimate doctrine and we should just get rid of it.

00:21:03.000 Yes.

00:21:03.000 Now, having said that, I think O'Bergefell should be overturned, but I'm not particularly optimistic that they will do so for a host of different reasons.

00:21:12.000 The star decisis balancing test factors are probably a little different for those justices who've used star decisions a little more rigidly than I would or Justice Thomas would.

00:21:20.000 But Justice Thomas, because he's a man of profound principle and takes a very principled stance on star disis and substantive due process, he would go ahead and overturn Obergefell surely tomorrow if he had the opportunity.

00:21:31.000 And so this will now allow states to make their own decisions as it comes to Roe v. Wade.

00:21:36.000 Can you just remind our audience, Congress never passed a law that made abortion a right?

00:21:43.000 This was all judicial activism.

00:21:45.000 Explain.

00:21:46.000 This is actually right.

00:21:47.000 So, I mean, what the court did in the Roe versus Wade case in 1973 was they just fabricated out of full cloth a purported constitutional right to abort your unborn child.

00:21:47.000 This is exactly right.

00:21:56.000 It was never statutorily codified by Congress.

00:21:58.000 In fact, by the time the 14th Amendment was ratified in 1868, abortion was criminalized, Charlie, as you know, in every single state in the country.

00:22:05.000 This was totally contrary. 0.99

00:22:07.000 It was garbage. 0.98

00:22:08.000 Thank God it's been overturned. 0.96

00:22:09.000 Praise God.

00:22:10.000 Josh, thank you so much.

00:22:11.000 Wonderful commentary as always.

00:22:12.000 Really appreciate it.

00:22:13.000 Newsweek, opinion editor, also constitutional expert.

00:22:16.000 Great.

00:22:16.000 Thank you so much.

00:23:06.000 One of the reasons why the court felt comfortable making this decision is because for decades and for years, there have been prayer warriors, there have been people fasting, there have been people making arguments to at least move the Overton window, to move the cultural paradigm so that we can better understand when does life begin and what are we really fighting for?

00:23:35.000 As I talked about earlier, I want to make just sure I clarify some, I think someone misunderstood me, but I did not say that the Catholic Church was pro-abortion, the opposite.

00:23:44.000 He said the Catholic Church is very pro-life and that the pro-abortion groups are going to be trying to attack the Catholic Church.

00:23:50.000 And from the Catholic Church to other charities to pro-life groups and young warriors that were raised in a country where they were told Roe versus Wade can't be challenged.

00:24:02.000 And they made a career and they made a movement and they really focused on changing hearts and minds.

00:24:09.000 And one of those people is, I believe, one of the most articulate pro-life voices on the planet is Lila Rose from Live Action, who I am honored to have with us today to celebrate this ruling.

00:24:20.000 Lila, welcome back to the program.

00:24:22.000 Thanks, Charlie.

00:24:23.000 What a morning.

00:24:23.000 What a day.

00:24:24.000 It's incredible.

00:24:25.000 So what's your initial reaction?

00:24:28.000 And you've been in this pro-life fight for quite some time.

00:24:30.000 Speak a little bit to some of the kind of embedded cynicism that you probably encountered a decade or so ago, where people said Roe versus Wade could never be repealed.

00:24:40.000 Don't waste your time.

00:24:41.000 Your thoughts.

00:24:42.000 I mean, I've been involved in this movement for almost a decade and a half since I was a teenager, my entire adult teen life.

00:24:50.000 And yeah, when I first got started, you know, now Live Action is a global leader for education and we're working in every state in the country.

00:24:57.000 When I first got started, there were amazing people in the pro-life movement, you know, had gone before who trailblazed, but there was pessimism.

00:25:04.000 There was this idea that we are not going to ever really make it.

00:25:07.000 You know, we got to fight the good fight, but America is so pro-abortion that we can't really win.

00:25:13.000 We can't win.

00:25:14.000 And we are one huge step closer to winning complete legal protection for the pre-born today with the fall of Roe v. Wade. 0.85

00:25:23.000 Amen.

00:25:23.000 So this is a historic moment.

00:25:25.000 It's cause for celebration.

00:25:27.000 I mean, even today, Charlie, abortion clinics that were scheduled to kill children today are closed now in the state of Missouri, are closing in the state of Ohio, are closing in states across the country.

00:25:38.000 And next week and in the weeks to come, hundreds more pro-life laws that were stalled because of Roe v. Wade and because of KCB Planned Parenthood will now go into effect and save millions of future lives.

00:25:53.000 So we are just thrilled.

00:25:55.000 I mean, the reality is this is a step.

00:25:57.000 It's not total victory.

00:25:59.000 There needs to be profound cultural change that has to accompany the legal changes.

00:26:05.000 And in states like California, you know, I'm here in California.

00:26:09.000 It is a dark place.

00:26:10.000 And the Supreme Court, you know, they did not enact full justice.

00:26:14.000 What they did this morning was a compromise.

00:26:16.000 I don't think a lot of people, especially on the pro-abortion side, acknowledge this, but this was a compromise with the abortion side because they did not abolish abortion nationwide.

00:26:27.000 They only said that now, if you are a red state, if you are a pro-life state, you can actually protect your children from the lethal violence of abortion.

00:26:34.000 So this is a victory, but it's not a complete victory.

00:26:38.000 You know, the Constitution is not silent on abortion.

00:26:40.000 There's this, I think, myth right now with the way that the court decided the overturning of Roe.

00:26:46.000 They sent it back to the states.

00:26:48.000 But the Constitution is very loud and clear on homicide, on the right to live.

00:26:54.000 And the 14th Amendment clearly states that no state shall deprive anyone of their right to live, of their life without due process.

00:27:04.000 And abortion is just that. 0.99

00:27:05.000 There's no due process for the child.

00:27:07.000 The 14th Amendment also promises to everyone equal protection under the law.

00:27:13.000 And that's not being granted for children in the womb who are the same moral status of a born child.

00:27:19.000 They're humans just like you and me.

00:27:20.000 That's not being granted in a state like California right now.

00:27:22.000 It won't be granted in a state like New York in the months and the years to come.

00:27:25.000 So our fight is just getting started.

00:27:27.000 The pro-life movement, we have a plan in place right now that we are passionately putting our shoulder to the plow.

00:27:33.000 And there's great hope ahead because lives are being saved today and many more lives will be saved in the future.

00:27:40.000 And that's well said.

00:27:41.000 It is a moderate and it's a prudent court decision.

00:27:45.000 It does take a lot of courage.

00:27:46.000 I don't want to discount that, especially with the rioting and with the people outside of their homes because of how the Overton window has been so moved in one direction.

00:27:54.000 But Congress has never passed a law codifying abortion.

00:27:58.000 It was a singular act of judicial activism and unfortunately a reclarifying one thanks to Justice Kennedy back in 92 with Planned Parenthood v. Casey, which upheld this.

00:28:10.000 But it took the courage of Thomas and Alito and Kavanaugh and Amy Coney Barrett and of Gorsuch.

00:28:17.000 And none of this would have been possible if it wasn't for Donald Trump.

00:28:20.000 It would have been three pro-abortion activists that would have been put on the U.S. Supreme Court if Hillary Ronham Clinton would have won in 2016. 1.00

00:28:27.000 And instead, he got three different choices.

00:28:30.000 I want to get your reaction to this clip here, cut 97, of someone on CNN crying, Lila.

00:28:36.000 They're very upset for today's ruling.

00:28:39.000 Play cut 97.

00:28:41.000 Just help folks who are at home understand how broad this goes.

00:28:45.000 Yeah, it's listen, it's a heartbreaking betrayal of half of the country.

00:28:49.000 Sorry, I'm getting, you know, watching the women there. 1.00

00:28:51.000 It's emotional.

00:28:53.000 It's a real problem.

00:28:55.000 So she's getting very emotional, but don't you think it should be the opposite?

00:28:58.000 I mean, what sort of moral paradigm are they operating from, Lila?

00:29:01.000 Yeah, I mean, Charlie, it makes me emotional that I think about the child, the little boy and girl that was going to be killed this morning at an abortion clinic, and now they're not.

00:29:09.000 And it makes me further emotional that there are people who are crying because some children get to live today instead of to die.

00:29:16.000 You know what that tells me?

00:29:17.000 That tells me our country is in spiritual trouble and that we have a sickness in our country and a woundedness.

00:29:23.000 And that's where our prayer comes in.

00:29:24.000 That's where our hope, our contagious love for life and God comes in and our fight comes in.

00:29:30.000 And we're just getting started.

00:29:31.000 You know, our movement, our pro-life movement, we're going to change this country upside completely, right side up, upside down, completely.

00:29:39.000 We're going to change it to a culture of life.

00:29:41.000 So join us.

00:29:42.000 Get involved.

00:29:42.000 Join us.

00:29:43.000 Pray.

00:29:44.000 Pray outside the abortion clinics that are still open in states like California.

00:29:47.000 Donate.

00:29:48.000 Educate.

00:29:48.000 Speak loudly and boldly in your churches.

00:29:50.000 Now's our moment.

00:29:51.000 We can change this nation and it will bring people closer to God.

00:29:54.000 And get on the right side of history.

00:29:55.000 We need a spiritual reset.

00:29:57.000 We need people to repent and to pray and to fast.

00:30:00.000 I've tweeted out this morning.

00:30:01.000 I encourage people to fast this weekend and pray.

00:30:04.000 There's going to be a lot of spiritual confusion in the next couple of days.

00:30:07.000 I truly believe that.

00:30:08.000 You cannot all of a sudden just go after kind of this sacred institution of the left and act as if you're not going to have all sorts of wild and chaotic and frenetic kind of decisions and language and action.

00:30:22.000 And so just in closing here, Lila, I want to just read this from Missouri and clarify what trigger laws are.

00:30:29.000 I have an interesting take on trigger laws.

00:30:31.000 I'd love your thoughts.

00:30:32.000 I'm supportive of them, but I'm a little more cynical than most people.

00:30:35.000 And I'll tell you why.

00:30:36.000 So Missouri Attorney General Eric Schmidt has activated the state's Roe versus Wade trigger law.

00:30:41.000 With Roe overturned, the law authorizes the Attorney General to ban abortion by the stroke of a pen.

00:30:46.000 Missouri becomes the first state in the union to effectively end abortion.

00:30:49.000 Looks like texts do the same.

00:30:50.000 My cynical view is I think a lot of Republican politicians did this years ago as kind of a compromise, thinking that this would actually never come into law.

00:30:59.000 This is kind of like, oh, yeah, pass that thing in case Roe versus Wade gets overturned, whatever, you know, kind of as kind of a little intermediary step.

00:31:05.000 But hilariously, it's this, it's kind of the biblical principle where it's kind of irrelevant.

00:31:11.000 What's relevant is what you did, your thoughts.

00:31:14.000 I mean, if you're a lawmaker, pass a just law.

00:31:14.000 Yeah.

00:31:17.000 And trigger laws are, you know, waiting for the trigger of Roe v. Wade to be pulled as far as it's going to be overturned.

00:31:22.000 So now we can protect children.

00:31:23.000 And yeah, in 20 states, we're going to see legal protections for the pre-born that we didn't see before.

00:31:28.000 But look, listen, democracies, individual states, they do not have the right to decide who lives and dies, which innocent people live and die.

00:31:36.000 It's not about mob rule.

00:31:38.000 The might might makes right.

00:31:39.000 If you're stronger and in power, you get to decide whether the little ones, the most vulnerable in the womb, don't have legal protection.

00:31:45.000 So it shouldn't be up for states to decide in the first place, Charlie.

00:31:48.000 And that's the mistake that the court made this morning.

00:31:49.000 Again, we can celebrate a step forward and acknowledge that the logic behind the decision was still off.

00:31:55.000 It was a compromise with the pro-abortion side.

00:31:57.000 So there's still work to be done.

00:31:59.000 But listen, any law in any state that we can pass now, we need to pass.

00:32:03.000 And the trigger laws are huge, you know, already already set there, but there's still more work to be done because some states, exceptions, they're not completely abolishing abortion.

00:32:11.000 They're only banning it after, say, 15 weeks or 20 weeks.

00:32:14.000 Every child deserves life, every single one of them.

00:32:17.000 And we need to be working to support mothers and fathers too and building those networks of support while we fight for the lives of children.

00:32:23.000 Lila Rose, you're doing amazing work.

00:32:24.000 I'm a monthly donor to Live Action.

00:32:26.000 I encourage everyone else to do the same.

00:32:27.000 They are moving the cultural overton window on life.

00:32:30.000 And I agree.

00:32:31.000 Laws are one thing, but we need a total reset when it comes to life and the spiritual health of our country.

00:32:36.000 But praise God for the courage of these judges.

00:32:40.000 I agree with your interpretation, Lila, completely and totally.

00:32:43.000 But it is a step in the positive direction.

00:32:46.000 And overturning Roe was this kind of, there were so many cynics for years.

00:32:51.000 I was told it can't be done.

00:32:53.000 Stop talking about it.

00:32:54.000 Unrealistic.

00:32:55.000 Small thinking people, Lila.

00:32:57.000 And that's the other takeaway: we can do big, bold, and ambitious things.

00:33:00.000 Your thoughts?

00:33:01.000 Vision, If you have a vision for something, if you fight and pray with your whole heart towards it, anything is possible.

00:33:10.000 Anything is possible with God.

00:33:11.000 Nothing is lost.

00:33:12.000 So keep fighting, friends, and let's make this country 100% pro-life.

00:33:16.000 God bless you, Lila.

00:33:17.000 Live action.

00:33:17.000 I think it's liveaction.org, if not mistaken, right?

00:33:20.000 Thank you.

00:33:20.000 Thanks, Charlie.

00:33:20.000 Liveaction.org.

00:33:21.000 Thank you.

00:33:22.000 Thank you.

00:33:22.000 Everybody, email us your thoughts, freedom at charliekirk.com.

00:33:26.000 This needs to kind of, I think this is a great stimulus and a great shot in the arm in a good, in a very positive way about this broader parents movement, about showing up to school board meetings, caring about your children, protecting them in the womb.

00:33:39.000 This is something that I think is a now top to bottom, comprehensive moral movement about caring about the innocence of our children and the well-being of the country that we're handing down to them.

00:33:51.000 That's the other point that I'm really taking away from this, which is without, I'm enthusiastically pro-life, but I want this to be a broad movement where we're talking about all the other positive things we could do for the well-being of our children.

00:34:06.000 Better schools, push them back against CRT, no chemical castration. 0.99

00:34:10.000 And by the way, now that we have pro-life policies, trigger laws, praise God, in Missouri and Texas, this means more parents.

00:34:17.000 This means the parents' movement is going to grow.

00:34:19.000 And this also means, and I will say this, it's incumbent on those of us as Christians and those of us as conservatives.

00:34:25.000 We should and support pro-life laws, but we should also be there for moms that are now having children and they might be in financially unstable circumstances where they might not be able to have the same sort of access to support systems.

00:34:39.000 We need to be there to make it easier to be able to raise children.

00:34:44.000 If we are going to fight for pro-life legislation, which we are, if we're going to fight for the repeal of Roe versus Wade, we also need to have a culture of life so that a mom that now has a child in Missouri, that she's not just left alone to fend for herself with rising inflation and gas prices, but she will be nurtured by a culture of life that says, thank you for having that child.

00:35:05.000 We want to support you in every way possible.

00:35:08.000 The institutions are being challenged.

00:35:10.000 We've said this for quite a while.

00:35:12.000 The left does not follow Supreme Court precedent when they don't like it.

00:35:15.000 The Supreme Court, as warned by Alexander Hamilton and Thomas Jefferson, they said, how are we going to have enforcement of the Supreme Court?

00:35:23.000 It's built solely on trust.

00:35:25.000 Well, now that there's a decision that they don't like, they call it illegitimate.

00:35:29.000 But Maxine Waters, one of the leading Democrats in the House, has even, let's say, sharper language. 0.92

00:35:37.000 Play cut 115.

00:35:40.000 I see nothing yet.

00:35:42.000 Women are going to control their bodies no matter how they try and stop us. 1.00

00:35:48.000 To hell with the Supreme Court, we will defy them.

00:35:51.000 Blackwood will be up in throws.

00:35:54.000 We will be out by the thousands.

00:35:56.000 We will be out by the millions.

00:35:58.000 We're going to make sure that we fight by the right to control our body.

00:36:03.000 So, what is a woman, Maxine Waters? 1.00

00:36:06.000 That's my first question.

00:36:08.000 You ain't seen nothing yet.

00:36:10.000 That sounds like a threat.

00:36:11.000 She says openly, quote, we are going to defy the court.

00:36:18.000 She says that we should defy the Supreme Court.

00:36:21.000 Let's go to another cut here.

00:36:24.000 Cut 105.

00:36:24.000 Pelosi says, no, I don't respect a process that criminalizes a woman's right to her reproductive freedom.

00:36:31.000 It's funny.

00:36:32.000 Everyone who's pro-abortion seems to already be born.

00:36:35.000 Play Cut 105.

00:36:37.000 I'm about truth and honesty.

00:36:40.000 The inconsistency, the hypocrisy.

00:36:43.000 I don't respect that process on Roe v. Wade.

00:36:48.000 No, I don't respect a process that criminalizes a woman's right to her reproductive freedom.

00:36:55.000 Jay?

00:36:56.000 And they won't tell you even what a woman is. 0.91

00:37:01.000 But reproductive freedom. 0.99

00:37:04.000 Again, this brings it back down to the states.

00:37:06.000 It's not what she says it is at all, but life begins at conception.

00:37:09.000 It's that clear.

00:37:10.000 Life has a starting point.

00:37:14.000 And it must be honored and protected.

00:37:16.000 Life matters.

00:37:17.000 Life is not just a random collection of cells.

00:37:20.000 And it comes down to the question, and they have a different answer to this.

00:37:23.000 If I had a chance to ask AOC a question, she would laugh, laugh it out and say, what is a human being?

00:37:29.000 And she would laugh it off because she's never thought deeply about much of anything.

00:37:32.000 What is a human being?

00:37:33.000 Is a human being a collection of cells that came into existence by an accident?

00:37:40.000 Or is a human being designed?

00:37:42.000 Does a human being have a soul?

00:37:45.000 Is a human being a precious being that can differentiate not just between pain and pleasure, but right and wrong?

00:37:52.000 What is a human being?

00:37:54.000 As soon as you can understand that question, all of a sudden you realize, wow, a human being is something exceptional and special.

00:38:02.000 A human being is something worthy and necessary of moral protection.

00:38:07.000 And just like that, the left claims to know what a woman is again. 0.99

00:38:11.000 It's funny how that works.

00:38:12.000 All throughout Pride Month, they tell us birthing people can't that.

00:38:16.000 And as soon as Roe versus Wade gets overturned, they can't tell us what it is.

00:38:24.000 Steve says here, congratulations.

00:38:26.000 The one thing that will derail the midterms just happened.

00:38:30.000 You could have repealed the 19th Amendment first. 0.99

00:38:32.000 Oh, this crap. 1.00

00:38:33.000 Good plan to first spit in the face of every woman in the USA. 1.00

00:38:37.000 Hope it was worth it. 1.00

00:38:38.000 So Steve is a fool, obviously. 0.99

00:38:40.000 Thank you for being an emailer at freedom at charliekirk.com. 1.00

00:38:44.000 It's the opposite.

00:38:44.000 We're going to win bigger in the midterms because of this.

00:38:47.000 We're going to have more people, especially in the Hispanic community, which is overwhelmingly pro-life, by the way, be enthusiastic about voting for Republicans.

00:38:58.000 We can do big and possible things.

00:39:01.000 Lead, follow, or get out of the way.

00:39:06.000 The conservative movement that used to be let around, like that scene in pulp fiction.

00:39:13.000 And you know what I'm talking about, where Bruce Willis got kidnapped.

00:39:16.000 That's what the Republican Party used to be.

00:39:18.000 Things have changed.

00:39:20.000 We're in charge.

00:39:21.000 We're not taking it anymore.

00:39:25.000 Thank you so much for listening, everybody.

00:39:27.000 Email me your thoughts as always, freedom at charliekirk.com.

00:39:29.000 Thank you so much for listening.

00:39:30.000 God bless.
