00:05:57.000 So Matthew Colangelo is number three at the Department of Justice, and then he shows up for a local prosecutor job in the Manhattan DA's office.

00:07:34.000 The judge refused the testimony of an FEC official who would have testified that no federal election crime was committed.
00:07:42.000 The judge has instructed the jury that they don't even have to unanimously agree on the underlying felony the prosecution is alleging that Trump tried to conceal with hush money to reach a conviction.

00:07:56.000 The prosecution star witness, Michael Cohen, is on record saying he wants Trump in jail, in prison.
00:08:03.000 He's a convicted liar and was caught lying about a critical phone call on the stand in cross-examination.
00:08:10.000 What's alleged to have to happen, even if it was a crime, was all under the advice of counsel Michael Cohen, who is now the expert witness for the prosecution.

00:08:23.000 And I just want to reiterate the idiocy here.
00:08:27.000 I want to reiterate how damaging this is to our institutions.

00:08:34.000 This trial and this likely soon-to-be conviction discredits New York and the American legal system, not Donald Trump.

00:08:52.000 The jury instructions are finished.
00:08:54.000 Now the 34 charges against Trump are in the hands of a jury.

00:22:34.000 Any two or more persons that engage in a conspiracy to prevent or promote an election are guilty.
00:22:42.000 So, you know, there's a wide array of things the jury can do here.

00:22:52.000 And there'll be a verdict sheet handed to each juror and on each count.

00:23:12.000 So, and they wouldn't let Brad Smith come in, who used to run the FEC, who would have argued that this doesn't belong in state court, and the feds passed this up already.

00:23:26.000 There's going to be a 30 to 60 minute warning once a verdict is rendered or when the jury is ready to cast their verdict here.
00:23:36.000 And deliberations can take place together with the jury pool.

00:23:44.000 And if it doesn't happen by 4:30 today, they'll reconvene tomorrow morning.

00:26:24.000 So there's heinous crimes going on throughout the city.
00:26:27.000 And as Trump points out every day, all of these cops are here protecting this trial.
00:26:32.000 They should be out on the street and Bragg should be enforcing the law.
00:26:37.000 And Charlie, to that point, it's the amount of money that goes into this, the amount of money that goes into the injustice that's happening in the courtroom, the amount of security that has to be here for this nonsense while the streets are totally out of control.
00:26:50.000 And another point to that, the Democrats will say you hear Gavin Newsom in California say, oh, crime is down.
00:26:56.000 The problem is it's because they're not policing the crime.
00:26:58.000 They're not charging the crimes.
00:26:59.000 They're not actually holding the people accountable to the crimes.

00:27:03.000 It's the prosecutions that are down.
00:27:05.000 I would just add that felony assaults are up.

00:27:09.000 27,000 New Yorkers have been assaulted, felony, or misdemeanor-wise, just since January of this year.
00:27:16.000 And 540 women have been raped across New York City since January.
00:27:22.000 So it's extraordinary what's going on.
00:27:24.000 Yeah, but the focus of Alvin Bragg is a documents charge.
00:27:28.000 He can't even tell you what crime they're covering up.

00:27:33.000 And one thing in particular that this judge said that these jurors could do.
00:27:38.000 He just delivered what is being called really the pinnacle of all of this.
00:27:43.000 He said that there is no need to agree on what has occurred.
00:27:48.000 They can disagree on what the crime was among the three choices.
00:27:52.000 Thus, this means that they could split four, four, four, and the judge would still treat them unanimously.
00:27:59.000 What does that mean?
00:28:01.000 Yeah.
00:28:02.000 Well, it's really outrageous because in a normal criminal case, every statutory crime has what we call elements of the offense.
00:28:11.000 Like in a bank robbery case, it's, you know, you have to rob.
00:28:15.000 It's got to be a financial institution.
00:28:17.000 You have to show intent.
00:28:18.000 Those are the things the jury has to agree on unanimously that they were proved beyond a reasonable doubt.
00:28:25.000 Here, what we're doing is taking the element that actually makes this a felony.
00:28:31.000 Because remember, falsification of records is normally a misdemeanor in New York.
00:28:35.000 What makes it a felony is that you're concealing or committing another crime.
00:28:40.000 And here, the judge is telling them they don't have to agree about what the other crime is under circumstances where that not only is what makes this a felony, what makes it a four-year potential prison penalty rather than a year or less, but it's also what gets us into the courtroom.
00:28:59.000 Because if this had been a misdemeanor, the time to bring this case would have lapsed in 2019.
00:29:06.000 So, Ben, closing thoughts here.
00:29:08.000 This doesn't make any sense to me.
00:29:10.000 No, well, it does if your intent is not to actually adjudicate this properly to have justice.
00:29:16.000 Clearly, I think if we actually have justice in this system, if there is a conviction, it will be thrown out in appeal.

00:29:23.000 All they want is that word conviction so that they can do exactly what you said, Charlie, and delegitimize President Trump.
