00:00:00.000 Hey everybody, today the Charlie Kirk show.
00:00:01.000 The choice.
00:00:02.000 Will we determine our disputes in the courts or with elections?
00:00:05.000 Democracy is not really what America is.
00:00:09.000 Obviously, we're a republic, but the people talking about democracy are willing to use the legal system to lock up political dissidents.
00:00:16.000 We talk about that.
00:00:17.000 Email us freedom at charliekirk.com and subscribe to our podcast.
00:00:20.000 Get involved with TurningPointUSA at tpusa.com.
00:00:24.000 That is tpusa.com.
00:00:26.000 Start a high school or college chapter today at tpusa.com.
00:00:30.000 Here we go.
00:00:30.000 Buckle up, everybody.
00:00:32.000 Charlie, what you've done is incredible here.
00:00:33.000 Maybe Charlie Kirk is on the college campuses.
00:00:35.000 I want you to know we are lucky to have Charlie Kirk.
00:00:39.000 Charlie Kirk's running the White House, folks.
00:00:42.000 I want to thank Charlie.
00:00:43.000 He's an incredible guy.
00:00:44.000 His spirit, his love of this country.
00:00:46.000 He's done an amazing job building one of the most powerful youth organizations ever created.
00:00:51.000 Turning point USA.
00:00:53.000 We will not embrace the ideas that have destroyed countries, destroyed lives, and we are going to fight for freedom on campuses across the country.
00:01:01.000 That's why we are here.
00:01:05.000 Brought to you by the Loan Experts I Trust, Andrew and Todd at Sierra Pacific Mortgage at AndrewandTodd.com.
00:01:13.000 The people that are running our society, the Marxists that have infiltrated our government, the FBI, the CIA, the Intel agencies, corporate America, the banks, and the tech companies, they had to make a choice.
00:01:26.000 They were waiting and waiting and waiting whether or not Donald Trump was going to run for the presidency.
00:01:32.000 Again, it looked like he was, or he was kind of half in and half out.
00:01:35.000 And as soon as Donald Trump really started to signal last summer, June of 2022, that he was going to run, the plan got dusted off.
00:01:45.000 The tabletop exercises of the people chattering in Martha's Vineyard to Aspen to Sun Valley, they said it's time.
00:01:53.000 They had to make a choice.
00:01:55.000 And the choice was very simple.
00:01:57.000 It's that this beautiful document, the greatest political document ever written in the United States Constitution, my handy-dandy Turning Point USA copy of our United States Constitution.
00:02:06.000 Put that aside.
00:02:07.000 Donald Trump is such an existential threat.
00:02:09.000 The movement that he has created of different ages, backgrounds, the muscular class, ordinary people, it must be stopped at all costs.
00:02:18.000 Ends justify the means, throw away any morals or values or virtues or precedent or history.
00:02:24.000 This guy is a threat, and what he brings to the country is a threat.
00:02:29.000 Threat to the banking cabal that deteriorates our currency, a threat to their open border agenda, a threat to the corporate leviathan that is strangling you, a threat to the great reset, as we call it time and time again.
00:02:46.000 They must stop him, and they had to make a choice.
00:02:49.000 Do we do what we did in 2020, which is barely sneak by mail-in ballots, Zuckerberg, Zuckerboxes, $400 million to Center for Technology and Civic Life, call the Hunter Biden laptop Russian disinformation a total lie that 50 Intel officials signed?
00:03:08.000 Do we do that again, or do we just reduce the risk?
00:03:14.000 In business, you do everything you possibly can to mitigate risk.
00:03:18.000 There's entire divisions to McKinsey and Deloitte that are in risk mitigation.
00:03:26.000 They have on their business card.
00:03:28.000 I am the vice president of risk mitigation at Goldman Sachs.
00:03:32.000 I am the senior director of risk mitigation.
00:03:36.000 They teach you in colleges how to mitigate risk.
00:03:40.000 And it's really not that simple.
00:03:41.000 You don't need to go to Harvard or Yale to figure it out or Stanford.
00:03:43.000 It's really simple.
00:03:44.000 You eliminate variables.
00:03:45.000 That's it.
00:03:47.000 For four years, you read a bunch of books.
00:03:49.000 And how do you eliminate risk or reduce risk?
00:03:51.000 You eliminate variables.
00:03:52.000 That's it.
00:03:53.000 So, therefore, they look at the problem of populism nationalism, the problem of flyover country having a voice, a problem of Hispanics and blacks coming in the Republican direction in a huge way.
00:04:07.000 And they say, how do we mitigate the risk?
00:04:08.000 And the architects of our society, the people that want to remain in charge and continue the plunder of you, continue the grooming of your children, continue the crime spree in America, they have a choice to make.
00:04:22.000 And the choice is very simple.
00:04:24.000 Do we allow elections to continue or do we do this in the courts?
00:04:31.000 Do we just use the justice system and get this over with?
00:04:35.000 Hilariously, these are the very same people that lecture us about our democracy, our democracy, our democracy.
00:04:40.000 They don't care about any of it.
00:04:42.000 The hypocrisy or the self-contradiction is so clear, they don't care.
00:04:47.000 That's how big of a threat Donald Trump is and his whole movement is.
00:04:52.000 And it's not just about Trump.
00:04:53.000 I'm going to show you it is a Maoist playbook to go after anybody that fills a void or a role, whether it be the top satirists, journalists, communicators, or the rank in file, top down, bottom up, big squeeze.
00:05:10.000 This is the choice.
00:05:11.000 Knight of the long knives, there is no going back.
00:05:14.000 And the choice is clear.
00:05:15.000 We are not going to mess around with elections anymore.
00:05:18.000 Elections are a distraction.
00:05:19.000 Elections have too much risk.
00:05:22.000 If you spend time with these risk mitigation experts at Goldman Sachs or at Citibank, these are people that want you to be at home, masked and alone for the next two years because you might have a risk of catching COVID.
00:05:34.000 Think about that type of mentality.
00:05:36.000 Eliminate all variables.
00:05:38.000 Does not matter what the cost is.
00:05:39.000 And the biggest variable to their globalist great reset takeover remains the movement that Donald Trump is the spokesperson of.
00:05:48.000 He is the mascot.
00:05:49.000 He is the symbol.
00:05:50.000 He is the attack vector against the elites.
00:05:53.000 And he must be stopped at all costs.
00:05:55.000 So elections or courts for the defenders of democracy, elections are way too risky.
00:06:01.000 They'll be a last resort.
00:06:03.000 And they'll do the mail-in balloting, the signature stuff, but they're trying to get ahead of it.
00:06:08.000 They cannot allow the movement to ascend and build, ascend and build, ascend and build, because the smart Marxists know that Donald Trump was displaced from the presidency by a cheater, Joe Biden, his cabal, by 42,000 votes, and they are very afraid that they're not going to be able to do that again.
00:06:24.000 So that is exactly why they are going hyper aggressive.
00:06:29.000 They have mapped this all out.
00:06:30.000 They have backup plans.
00:06:32.000 They have insurance policies.
00:06:34.000 Yes, it is a conspiracy.
00:06:36.000 100%, but none dare call it a conspiracy because you don't want to be labeled the thing from the central intelligence agency, even though we have evidence after evidence that we have multi different actors and organizations, private, public, CIA, FBI, Google, Facebook, Zuckerberg, working in tandem.
00:06:57.000 If there ever was a conspiracy, this is certainly darn a conspiracy.
00:07:01.000 You got Jack Smith working with Fannie Willis.
00:07:03.000 You have Jack Smith working with the Michigan Attorney General.
00:07:07.000 You have Merrick Garland working with the tech companies.
00:07:10.000 I mean, how much more evidence do you need?
00:07:12.000 You have the White House saying, shut up those conservatives on social media, we being one of them.
00:07:16.000 And so the decision has been made.
00:07:19.000 Elections are too risky.
00:07:22.000 We have to do this the old-fashioned way.
00:07:25.000 The old-fashioned way is by force.
00:07:27.000 We have to do this with handcuffs, trials, rigged juries.
00:07:32.000 And this is the plan.
00:07:34.000 You having a voice, you being able to show up and participate in a fair and free election.
00:07:41.000 They have flashbacks to 2016.
00:07:45.000 They have flashbacks to screaming at the glass ceiling that was supposed to be broken by Hillary Clinton.
00:07:50.000 They're not going to risk that again.
00:07:52.000 The Democrats have gamed out 2024 while Republican primary candidates and the RNC is non-existent, worrying about who's going to show up to some debate, some vice presidential debate is what it's at now.
00:08:03.000 Not spending money on the infrastructure.
00:08:05.000 You are living through 2024.
00:08:07.000 You know, I got asked by a donor recently, and I'm about to spend some time with a lot of them tomorrow.
00:08:12.000 Some great people, some that are misguided, that's fine.
00:08:14.000 They say, Charlie, how do you think 2024 is going to play out?
00:08:17.000 I said, it's playing out right now.
00:08:18.000 It's all happening right now.
00:08:20.000 This is not a matter of the future.
00:08:22.000 You are living in the current.
00:08:23.000 It's the present.
00:08:24.000 The Democrats have a plan.
00:08:25.000 They've dusted it off.
00:08:26.000 They're going for it.
00:08:26.000 It is risky.
00:08:27.000 It's unprecedented.
00:08:28.000 We've never seen it before.
00:08:30.000 But they have to eliminate threats.
00:08:32.000 And think about it.
00:08:33.000 It's not just Donald Trump.
00:08:34.000 They're trying to make examples across the board.
00:08:36.000 Douglas Mackey, a young man, faces a decade in prison for a joke.
00:08:42.000 It's always the mark of a totalitarian to lock up the humorists and the satirists.
00:08:47.000 If you dare make fun of the regime, gulag.
00:08:51.000 Stalin was famous for that.
00:08:53.000 The satirists, the humorists, the people that made cartoons, they were the first ones to the gulag.
00:08:59.000 So Douglas Mackey, an innocent young man, faces a decade in prison for a misapplication of the KKK Act in 1870s era law.
00:09:08.000 Steve Bannon, top political strategist and communication, let's just say armor-piercing shell for the conservative populist nationalist movement, faces four months in federal prison for quote-unquote contempt of Congress, even though Merrick Garland, Alejandro Mayorkis, and Mark Zuckerberg have all done their own form of contempt of Congress.
00:09:30.000 James O'Keefe, top political journalist under three current federal investigations, kicked out of his nonprofit, being sued in every single direction, sued by his former employer, investigated by state attorneys general.
00:09:43.000 Why?
00:09:44.000 Because James O'Keefe is an effective journalist.
00:09:47.000 These are the people that protect journalists at all costs.
00:09:51.000 Electors in Michigan, MAGA moms and MAGA grandmoms living off of Social Security and Medicare now have to go into debt into near bankruptcy to defend themselves because they signed a piece of paper that was never actually used as alternate electors based off the 1960 election, and they're trying to crush them.
00:10:09.000 This is the whole ballgame.
00:10:10.000 Elections are a distraction.
00:10:11.000 Elections are a risk for these people.
00:10:14.000 The stakes are too high.
00:10:15.000 We're going to talk about how we can counter it and the developments over the weekend, but they have made their choice.
00:10:20.000 They want nothing to do with elections.
00:10:22.000 They want this solved with handcuffs, subpoenas, rigged juries, and zip code justice.
00:10:30.000 All right, you've probably heard me.
00:10:31.000 It's actually now 25 pounds that I have lost.
00:10:35.000 And I'm sure some of you say, oh, Charlie, I've tried everything.
00:10:38.000 That was me.
00:10:39.000 You know, my first Zoom call with my PhD weight loss, I was kind of skeptical.
00:10:44.000 I was like, come on, guys.
00:10:46.000 All right.
00:10:46.000 I've heard this whole thing before.
00:10:49.000 And boy, was I wrong.
00:10:50.000 They know what they're doing, my PhD weight loss.
00:10:53.000 Look, this is 100% legit.
00:10:55.000 And people say, well, Charlie, you've lost so much weight.
00:10:57.000 And I say, yeah, my PhD weight loss.
00:10:59.000 Hello.
00:11:01.000 But look, they have a different approach.
00:11:02.000 And it's Dr. Ashley Lucas.
00:11:04.000 I text with her.
00:11:04.000 She's great.
00:11:05.000 She does a really, really good job.
00:11:07.000 25 pounds, I'll tell you.
00:11:09.000 And I have more energy and I'm healthier than ever before.
00:11:13.000 Here's why.
00:11:14.000 The program rids your body of the inflammation that is causing so many health problems.
00:11:19.000 If you look around today, America is the fattest it has ever been.
00:11:23.000 Our families, friends, and neighbors are dying of diabetes, heart disease, and Alzheimer's, now called T3 diabetes.
00:11:32.000 PhD has helped so many people who want to have a good active life, play with their grandkids, travel, hike to a waterfall, go for a bike ride, but their weight was holding them hostage.
00:11:42.000 They don't want any of you on experimental drugs for your brain degeneration from Alzheimer's or homebound with an oxygen tank for heart failure.
00:11:49.000 My PhD weight loss knows that losing weight is the best thing for overall health.
00:11:55.000 We are way too fat as a society.
00:11:57.000 And here's the thing: if you're listening to this and you say, boy, I'm a little overweight, it's perfectly fine.
00:12:02.000 Do something about it.
00:12:04.000 Use your free will, your agency.
00:12:06.000 Say, you know what?
00:12:07.000 I'm just not where I want to be.
00:12:09.000 This is an empowerment tool for you.
00:12:12.000 All of these things can be prevented.
00:12:14.000 You look at heart disease, the beast, you know, what they now call diabetes.
00:12:18.000 By the way, there's a great new book by Dr. Peter Atia about longevity.
00:12:22.000 You want to live long?
00:12:23.000 Lose weight.
00:12:25.000 Look, Dr. Ashley Lucas, she is the master of this, and she is the genius behind my PhD weight loss.
00:12:32.000 So you can call them today at 864-644-1900.
00:12:37.000 That is 864-644-1900.
00:12:40.000 By the way, this is not like a sign up and you're automatically going to lose weight.
00:12:44.000 You got to do some work.
00:12:45.000 You got to apply yourself.
00:12:46.000 It's not a too good to be true thing.
00:12:47.000 But if you have motivation, they will channel that motivation towards a very positive, measurable, and real outcome.
00:12:58.000 Find them online at myphdweightloss.com.
00:13:03.000 Tell them Charlie Kirk sent you.
00:13:04.000 That is myphdweightloss.com.
00:13:08.000 PhD weight loss and nutrition, physician and dietician developed, individually delivered.
00:13:14.000 Again, I lost 25 pounds and I feel great.
00:13:16.000 If you think you've tried everything, you're wrong until you say you've tried my PhD weight loss.
00:13:22.000 They map you as a whole person.
00:13:24.000 It's not like, hey, just read this book.
00:13:25.000 No, no, no, no.
00:13:26.000 It's a deep dive.
00:13:27.000 It's personalized.
00:13:29.000 It's going to get results for you.
00:13:30.000 Myphdweightloss.com.
00:13:35.000 Okay, so over the weekend, Donald Trump posted on Truth Social: if you go after me, I'm coming after you.
00:13:41.000 Let's put it up.
00:13:43.000 No context, open for interpretation.
00:13:47.000 Now, here would be my non-lawyerly advice to Team Trump.
00:13:53.000 You have a terrible judge who is hyper-aggressive.
00:13:57.000 You have a DOJ that is not acting in good faith to uphold any sort of beacon of justice.
00:14:03.000 They want to shut you up ahead of this primary and ahead of 2024.
00:14:08.000 It's unfair.
00:14:09.000 It's wrong.
00:14:10.000 It's immoral and it's cheating.
00:14:12.000 But you have to understand that you're under current indictment with a judge that can sign a piece of paper and shut you up.
00:14:22.000 And there's very little you can do at that point.
00:14:25.000 I guess you could appeal or do a motion, but I don't even know how you would remove a gag order.
00:14:29.000 And you must remember, Roger Stone was gagged by a federal judge.
00:14:36.000 Roger Stone was not allowed to talk about anything political or his case.
00:14:41.000 And so President Trump writing this, if you go after me, I'm coming after you.
00:14:46.000 I didn't find anything wrong with it.
00:14:47.000 When I saw that, I was like, okay, he's talking politically.
00:14:49.000 That was my gut instinct.
00:14:51.000 I got back from my Sabbath and my Shabbos.
00:14:54.000 I looked at it.
00:14:54.000 I said, he's talking about some political thing.
00:14:58.000 That's how I interpret it.
00:14:59.000 No joke, no spin.
00:15:01.000 But the Department of Justice interpreted it completely differently, obviously, because this DOJ sitting around, the feral dogs, as Steve Bannon would say, waiting for any excuse to shut him up.
00:15:15.000 And so now there's in front of this judge, this Judge Chutkan or Chutkin, whatever, who is awful, by the way.
00:15:24.000 She's a vindictive, vengeful judge by all public reports, ridiculously harsh sentencing, harsh sentencing.
00:15:33.000 Joy Reed has a take on this that will just blow your mind, where she's like, it's demographic reality setting in, which is like, if you actually go to the depth of what Joy Reed is saying, she's effectively saying that we black people are going to get revenge on you white people.
00:15:48.000 That's not the point.
00:15:49.000 If I were to give any piece of advice to Team Trump, you legitimately could be silenced, but not legitimately.
00:16:01.000 That's not a fair way to say.
00:16:02.000 You could be.
00:16:02.000 It's not legitimate.
00:16:03.000 It's fake.
00:16:04.000 It's baseless by a judge that could derail your entire presidential campaign.
00:16:10.000 And DOJ is waiting for that excuse.
00:16:13.000 So if you kind of go to the plus and the negative, what is the upside of truthing?
00:16:18.000 If you go after me, I'm coming after you.
00:16:20.000 Very little upside.
00:16:21.000 The downside is that DOJ is going to spin that and say he's talking about the case.
00:16:26.000 Now, Donald Trump has come out and his attorney has said, no, no, no, I'm talking about Club for Growth and Koch Brothers.
00:16:31.000 By the way, that is protected speech.
00:16:33.000 It doesn't mention the case.
00:16:34.000 It doesn't mention the judge.
00:16:35.000 It doesn't mention any of it.
00:16:36.000 Now, mind you, to give you an idea of how unfair this judge is, there were four January 6th cases in where the prosecutors sought zero jail time.
00:16:48.000 Chutkin raised the bar of the prosecutor and said, no, I'm actually going to give them 14 days to 45 days.
00:16:56.000 So in an era where we have to be lectured by the Marxist left about prosecutorial overreach, over-sentencing, we have a judge that increases what the prosecutors actually want.
00:17:12.000 That is so rare.
00:17:13.000 Usually the judge undercuts prosecutors.
00:17:15.000 Usually a judge, 90% of the time, says, okay, you want two years.
00:17:18.000 I'll give them five months.
00:17:22.000 We have some of the most aggressive prosecutors ever on the January 6th cases, yet she wants them in jail even when they don't.
00:17:30.000 So let me just take a step back and let me give you my honest opinion.
00:17:33.000 The best chance that we have to beat this cabal is to win the 2024 election.
00:17:39.000 That's going to be very hard because Republicans, it's a clown car, it's a circus, they're wasting their money.
00:17:44.000 We've been totally infiltrated.
00:17:46.000 But if we do our job and we act obediently and by the grace of God, he comes in and effectuates a miracle, we got a shot.
00:17:53.000 I believe in the God of miracles.
00:17:54.000 That's not a joke.
00:17:55.000 It's not an exaggeration.
00:17:56.000 It's not sarcastic.
00:17:57.000 The media will make fun of me for saying that.
00:17:59.000 I believe in a God of miracles and I'm going to remain by that.
00:18:01.000 I believe 2016 had some miraculous components to it.
00:18:04.000 However, it does not help our cause or our case if Donald Trump receives a gag order.
00:18:11.000 So while I found nothing wrong with this truth, he has to play it ultra conservative at this point.
00:18:17.000 He has to.
00:18:18.000 We need Donald Trump to be able to speak.
00:18:20.000 If we lose that, I actually don't think it'll mean much for the presidential race.
00:18:25.000 I think he'll still win.
00:18:27.000 But it will not help us to be able to counter the narratives, to be able to build a political operation.
00:18:32.000 I find nothing wrong with what he truthed, but you cannot even give the regime an inch, a crumb, an iota of a reason.
00:18:39.000 Because do not be surprised if something happens today, something happens tomorrow, something happens later this week, where the regime, Judge Chatkin, signs a piece of paper gagging the leading candidates against the regime.
00:18:58.000 If you listen to my podcast for some time, you've heard me talk about these digestive enzymes called Mass Zymes from Buy Optimizers.

00:20:00.000 Okay, so let's play this out.
00:20:03.000 Let's say that Judge Chotkin, Chutkin, whatever, issues a gag order against Donald Trump and says you're not allowed to talk about the case.
00:20:11.000 And let's say then Donald Trump violates the gag order.
00:20:14.000 What can be done?
00:20:16.000 Well, very few people know this, but federal judges have arrest authority.
00:20:20.000 She could send federal agents to then go arrest Donald Trump and put him in jail, detain him, fine him, but probably jail him and say, we're done.
00:20:31.000 You're in jail now.
00:20:32.000 Or he could have another separate indictment that would be a hard case to win, another hard one to win, that could actually move very quickly of defying a gag order, which is against federal law.
00:20:46.000 So some of you are emailing us, freedom at charliekirk.com, and you're saying Donald Trump should absolutely, certainly ignore the gag order.
00:20:53.000 And by the way, I admit he said absolutely nothing wrong here.
00:20:57.000 Now, sure, you could appeal to another federal judge, maybe, but let's be very clear.
00:21:04.000 Can you gag a political candidate?
00:21:07.000 It's against the First Amendment.
00:21:10.000 Now, understand that the federal judges have far more power than people recognize or realize.
00:21:16.000 This judge could conceivably sign an order and say, Defendant Trump, you are now in pretrial detention for four months, no access to a phone.
00:21:27.000 Is it worth taking that risk?
00:21:29.000 Is it worth pushing the boundaries or the barriers to put Donald Trump in a prison cell with no access to phone to defy the gag order?
00:21:41.000 And by the way, its maximum penalty for contempt in federal court is six months.
00:21:46.000 But this judge has done all sorts of weird innovations in legal practice.
00:21:52.000 Is this the hill to die on?
00:21:54.000 That's an interesting question.
00:21:55.000 Some of you say right here, Charlie, Donald Trump should defy the gag order, make them arrest him.
00:22:01.000 They're not ready to put Donald Trump in prison.
00:22:04.000 Well, I think they are ready to put him in prison.
00:22:06.000 I think that the recent indictments show that.
00:22:09.000 It's worth asking and it's worth contemplating.
00:22:11.000 We'll find out.
00:22:12.000 I don't think, here's what I think is going to happen.
00:22:14.000 I think this judge is going to issue a very sternly, strongly worded final warning, basically saying, Defendant Trump, you keep this up.
00:22:23.000 I'm going to do a gag order.
00:22:25.000 This truth social is not enough for me to gag you, but boy, I'm willing to gag you.
00:22:29.000 That is where I think she's going to come down.
00:22:32.000 Someone says, Charlie, can Trump get a gag order on Jack Smith?
00:22:35.000 No.
00:22:36.000 Of course, and this other person says, Charlie, this is all extremely one-sided.
00:22:39.000 Of course, it's extremely one-sided.
00:22:41.000 They control the government.
00:22:43.000 Could you imagine living in 1970s China?
00:22:46.000 This Mao guy is really one-sided.
00:22:48.000 We do not live in a free society anymore.
00:22:50.000 The government has unlimited resources.
00:22:52.000 They have favors.
00:22:53.000 They have friends.
00:22:54.000 They control the media.
00:22:55.000 They're all in on it.
00:22:56.000 So you're up against every power center, every single power center.
00:23:01.000 Let's play some pieces of tape here.
00:23:04.000 Cut seven, writer for The Atlantic Tom Nichols tells you why they're doing this.
00:23:09.000 Elections are too risky.
00:23:11.000 We cannot allow him to take power again.
00:23:14.000 That is why a majority of the Democrat Party is in support of these indictments.
00:23:19.000 They do not want to live through the horror show of another Donald Trump presidency.
00:23:23.000 And by the way, just to kind of push back against some of the people running against Donald Trump, Trump was a bad president.
00:23:29.000 If Trump was such a failed president, why are they doing everything they possibly can to prevent a second term of Trump?
00:23:36.000 If Trump was so ineffective, why are they going to such great levels and such great lengths to prevent him from having taking office as the 47th president of the United States, 45 and 47?
00:23:49.000 It's kind of strange, isn't it?
00:23:50.000 Play cut seven.
00:23:52.000 In the end, the voters are the people who have to take charge of the destiny of this country and decide that whatever our other disagreements about policies, that Donald Trump is a threat to the Republic and he can't be allowed near power again.
00:24:07.000 I think it's absolutely crucial that Trump is having to go to court and stand before a judge and answer for the things he did.
00:24:17.000 And I think it's important to point out that he did these things.
00:24:20.000 The only question is whether they are actually criminal in the judgment of a court of law.
00:24:27.000 Now, to give you an idea of how unfair Judge Chutkin is when dealing with conservatives, in the four January 6th cases in which prosecutors did not seek any jail time, Judge Chutkin still ordered jail time ranging from 14 days to 45 days.
00:24:42.000 Overall, one-third of January 6th defendants have received zero jail time.
00:24:47.000 But of the 38 defendants who Judge Chutkin has handled, all of them received jail or prison time.
00:24:54.000 The AP has described her as the number one punisher of January 6th defendants.
00:25:00.000 And now she only gave Trump's legal team one business day to respond to Jack Smith's proposed gag order, ignoring the standard 14-day rule to respond to motions.
00:25:10.000 There is no way that Donald Trump gets a fair trial in front of this activist judge.
00:25:15.000 Now, I want to hear from you, freedom at charliekirk.com.
00:25:18.000 Do you think that Donald Trump should be cautious of a gag order, or do you think he should just say, I don't care, this is the hill to die on?
00:25:27.000 Understand, it's a rigged game, and it's an interesting moral question, isn't it?
00:25:32.000 At what point do you just say, I'm not going to go along with this any longer?
00:25:36.000 My personal opinion, my personal opinion is you have one shot, all chips, Texas hold them all in, and it's about the election.
00:25:47.000 It's that simple.
00:25:48.000 You have to do whatever increases the likelihood of winning in November 2024.
00:25:55.000 You might be in the audience.
00:25:56.000 You might say, Charlie, it's rigged.
00:25:57.000 It's broken.
00:25:57.000 It's terrible.
00:25:58.000 If that's the case, then the all-in bet is going to fail.
00:26:01.000 But it really is the only solution to this.
00:26:06.000 The only way is through.
00:26:09.000 And yeah, it's going to be an improbable victory of every power center, almost every billionaire oligarch against the man who never should have become president.
00:26:19.000 And so I think you have to look at this prudently of what is the greatest fight that you want to pick.
00:26:27.000 Trump in jail could get him more support on a gag order or less.
00:26:32.000 It could actually give some of these other Republican candidates a chance to increase of support.
00:26:37.000 It also, in my opinion, wouldn't be very wise if we're trying to bring down the temperature to prevent another Fed surrection for January 6th.
00:26:44.000 That would not be a good option.
00:26:46.000 I think Donald Trump on the campaign trail is a good thing for our civil discourse or our narrative.
00:26:51.000 So some of you are saying, Charlie, ignore the gag order, go and let's play hardball.
00:26:57.000 Hmm.
00:26:58.000 They will send federal agents and arrest him and potentially put him in pre-trial detention at the very least at another indictment.
00:27:05.000 It's like a superseding MAGA indictment.
00:27:07.000 And the technical stuff is sometimes where they get you.
00:27:09.000 He might win on everything.
00:27:10.000 They'll say, oh, by the way, you stole this indictment when you ignored Judge Chotkin.
00:27:14.000 Now, understand, this judge is so radical, she was barely confirmed by the Senate, barely confirmed by the Senate.
00:27:22.000 But just your daily reminder that we don't have an opposition party in our country, just looking at the first glance, John Thune voted for this senator.
00:27:32.000 Roger Wicker voted for this senator while he was still a senator.
00:27:35.000 Richard Shelby voted for this senator.
00:27:37.000 Jeff Sessions voted to vote for this judge.
00:27:40.000 I'm sorry, not the senator.
00:27:41.000 For this judge.
00:27:42.000 Tim Scott voted for this judge.
00:27:45.000 And many other Republicans voted for this judge.
00:27:48.000 There was a cloture vote that was close.
00:27:50.000 Okay, so I guess it's a little misleading what I put up.
00:27:55.000 We'll get to that.
00:27:56.000 It's an interesting debate.
00:27:58.000 Should we even give power to a judge?
00:28:03.000 I say you're already in a rigged game.
00:28:06.000 Don't give them an excuse to gag you.
00:28:09.000 Don't give them an excuse.
00:28:11.000 That's where I'm at.
00:28:13.000 It's unfair.
00:28:15.000 You just have to delay.
00:28:16.000 I think the Trump legal strategy right now is just delay everything you possibly can.
00:28:21.000 The least drama possible.
00:28:22.000 Delay, delay, delay.
00:28:24.000 Because let's be perfectly honest.
00:28:26.000 Do you want it all there?
00:28:27.000 If Donald Trump does not win the 2024 election, it is a high likelihood he's going to go to federal prison.
00:28:33.000 It's zip code justice, rigged juries, ferocious prosecutors, and contemptuous judges.
00:28:39.000 Now, some people are saying these newest indictments could get overturned by the Supreme Court of the United States, but you know what probably will not get overturned?
00:28:48.000 A contempt order against a judge.
00:28:50.000 That stuff is pretty easy to prosecute.
00:28:52.000 Judge told you to do this, you do that, and you didn't do that.
00:28:56.000 And I want to just reiterate: Donald Trump truthed nothing wrong.
00:29:01.000 He truthed and said, if you come after me, I'm coming after you.
00:29:05.000 His explanation is that it was the Club for Growth and the Koch brothers who are spending tons of money against Donald Trump.
00:29:11.000 And Donald Trump is only ascendant in the polls.
00:29:13.000 He's only stronger than ever.
00:29:14.000 I get it.
00:29:15.000 I understand why.
00:29:16.000 I talk to, it's so interesting.
00:29:18.000 I get these phone calls every couple days.
00:29:21.000 Charlie, don't get it.
00:29:22.000 How is Donald Trump more popular?
00:29:26.000 My answer is almost always the same.
00:29:28.000 Go to East Palestine, go to a diner, and turn off your phone, and then tell me what you hear.
00:29:35.000 Aspen is not a good indicator of how the Republican Party is going to vote.
00:29:40.000 Not a good indicator.
00:29:44.000 I want to talk about ReliefFactor.com.
00:29:46.000 I want you guys to check out ReliefFactor.com, 100% drug-free, knee pain, back pain, joint pain, elbow pain.

00:30:16.000 Check it out right now: relieffactor.com, relieffactor.com.
00:30:22.000 Governor DeSantis with just a swing and a miss.
00:30:24.000 Oh, my goodness.
00:30:25.000 And I'll tell you why.
00:30:26.000 Play cut 22.
00:30:29.000 Yes or no, did Donald Trump lose the 2020 election?
00:30:33.000 Whoever puts their hand on the Bible on January 20th every four years is the winner.
00:30:38.000 Okay, but respectfully, you did not clearly answer that question.
00:30:42.000 And if you can't give a yes or no on whether or not Trump lost, then how.
00:30:48.000 Of course he lost.
00:30:50.000 Trump lost the 2020 election.
00:30:52.000 Joe Biden's the president.
00:30:54.000 But the issue is, I think what people in the media and elsewhere, they want to act like somehow this was just like the perfect election.
00:31:01.000 Governor DeSantis.
00:31:02.000 I'm pulling for you, man.
00:31:04.000 This is how you should have answered.
00:31:05.000 I'm like, oh my gosh, I'm watching this real time.
00:31:08.000 And I'm going to get hate mail for even showing compassion for DeSantis.
00:31:11.000 I am who I am because I really like the guy and I think he's a great governor.
00:31:11.000 Don't care.
00:31:14.000 He's destroying his political career.
00:31:16.000 Here's what he should have said.
00:31:17.000 Joe Biden cheated just like the Houston Astros.
00:31:21.000 They might have won the trophy, but everyone knows it's fake.
00:31:24.000 That's all he had to say.
00:31:25.000 Boom, one-liner.
00:31:27.000 It's true.
00:31:28.000 Instead, instead, you're seeing here that Ron DeSantis is number one donor.
00:31:33.000 Bigelow from Vegas is coming out and saying Ron DeSantis has to become more moderate.
00:31:37.000 And he even says in the article, he spoke to Ron DeSantis' campaign manager, encouraging them to try to be less extreme.
00:31:44.000 DeSantis, the biggest donor, warrants he stopped funding campaign if he doesn't becoming more moderate.
00:31:49.000 So he's just getting different advice from different places.
00:31:52.000 It's a disappointment.
00:31:53.000 I want to contrast that.
00:31:54.000 Boy, we have a lot to get to.
00:31:55.000 Just, I love this tone from Speaker Kevin McCarthy.
00:31:59.000 10 out of 10, 10 out of 10, A play cut 13.
00:32:04.000 I'm still saying the election 2020 was fraud.
00:32:07.000 There was fraudulent activity going on.
00:32:09.000 That Joe Biden didn't win.
00:32:09.000 Yeah.
00:32:11.000 Yeah.
00:32:12.000 And I could say the same thing that Hillary Clinton says about her election that she lost.
00:32:16.000 I can say the same thing about the DNC who said it about the 2016 race.
00:32:21.000 I can say the same thing about those in the Democratic Party from the leadership on down about George Bush not winning, that Al Gore did.
00:32:28.000 But were any of them prosecuted?
00:32:30.000 Were any of them put in jail?
00:32:32.000 Were any of them held with no response to be able to get out?
00:32:36.000 The answer is no.
00:32:38.000 Continues play cut 14.
00:32:40.000 So, yeah, you can raise that, that someone raised a question.
00:32:43.000 And you know, in America, you're entitled to raise a question.
00:32:46.000 You're entitled to question whether it was honest or not.
00:32:49.000 That's the uniqueness of the First Amendment.
00:32:52.000 That's the uniqueness of America.
00:32:54.000 You shouldn't be prosecuted for your thoughts.
00:32:54.000 But you know what?
00:32:57.000 And the difference here is when Hillary Clinton said it, nothing happened to her.
00:33:01.000 When they said it in Georgia's election, nothing happened to them either.
00:33:04.000 You know what?
00:33:05.000 When the DNC said it, nothing happened to them either.
00:33:07.000 So stop using government to go after people who politically disagree with you.
00:33:12.000 Love it.
00:33:13.000 I love it.
00:33:14.000 It's great.
00:33:15.000 For Speaker of the House, what a contrast to Paul Ryan, Dutless Wonder, John Boehner.
00:33:19.000 Love it.
00:33:20.000 Good job, Speaker McCarthy.
00:33:21.000 You deserve credit for that.
00:33:23.000 And I know our base agrees.
00:33:24.000 Contrast that with Ron DeSantis, who's just all over the place.
00:33:26.000 This is whatever.
00:33:27.000 All right.
00:33:28.000 Now I have to close out this hour with something that I don't love.
00:33:33.000 I don't love delighting in the suffering of others.
00:33:36.000 I also have this incredible tension.
00:33:39.000 I want America's sports teams to succeed.
00:33:42.000 I love this country.
00:33:44.000 I want us to succeed at every level.
00:33:46.000 I love rooting for America.
00:33:49.000 But how do you handle a sports team that has the American jersey, but it's been infiltrated by anti-American woke activists?
00:33:58.000 That is the U.S. women's national team.
00:34:01.000 And the top leader is Megan Rapino, who kneels during the national anthem, who by all public commentary hates the country.
00:34:10.000 She's the team captain.
00:34:12.000 She doesn't even sing the anthem, but I got to tell you, I suspended one of my rules.
00:34:17.000 I saw this and I said, boy, I'm glad they lost.
00:34:20.000 And I don't delight in that, but it's the way it is.
00:34:22.000 If you're going to be an anti-American activist and appropriate the American jersey like you're Miss Pro-America, when in reality, you are a left-wing social justice warrior, campus activist with your purple hair talking about how trans things and sports don't exist.
00:34:38.000 Well, guess what?
00:34:39.000 I'm glad you missed the kick and I could do better than you.
00:34:42.000 And I'm not very good at soccer at all.
00:34:43.000 Play cut two.
00:34:56.000 Smiles and chuckles.
00:34:58.000 They say this is her final national team match.
