00:02:26.000 The decision from the Colorado Supreme Court was this expected or was this a surprise?
00:02:32.000 You know, the crew and these other left-wing dark money groups have been bringing these 14th Amendment cases all over the country.
00:02:40.000 Until yesterday, no court in America had found any validity or any merit to any of them.
00:02:47.000 But Colorado Supreme Court did what they did.
00:02:51.000 I think in the history of the United States, this is one of the most egregiously wrong and certainly one of the most dangerous court opinions that has ever come out of the judiciary in this country.
00:03:03.000 So the argument that they're making is that Donald Trump violated the 14th Amendment, despite Donald Trump not even being indicted for anything regarding insurrection or rebellion.
00:03:14.000 This is a near 100-page legal opinion.
00:03:18.000 The most chilling part of this, Will, is that these are people that should know better.
00:03:23.000 These are the best educated, the best credentialed.
00:03:27.000 These are people that are writing as if they're an unhinged college freshman offended by someone not using their pronouns.
00:03:34.000 Yet they're supposed to be the sober guardian gatekeepers of legal decisions.
00:03:41.000 How did we get to a place where this happened?
00:03:45.000 And I think even these judges know what they did is crazy, which is why they stayed their own opinion pending Supreme Court review until January.
00:03:54.000 So they knew what they were doing posed a serious risk to the Republic.
00:03:59.000 And therefore, they stayed their own opinion.
00:04:01.000 That shows you how confident they are in their own legal reasoning.
00:04:04.000 But as you said, what they've done here is they've taken the insurrection clause of the 14th Amendment and they've said that through a summary state court proceeding, without the protections that due process provides in a normal trial context, without any of the evidentiary safeguards that you would see in a normal criminal trial, that they can just deem Trump to have been an insurrectionary and therefore they can keep him off the ballot in their state.
00:04:31.000 It's unprecedented in American history.
00:04:33.000 It finds no support in the Constitution, in the case law, analyzing this aspect of the 14th Amendment.
00:04:41.000 It is a totally lawless opinion.
00:04:43.000 I believe we're going to appeal it, and I believe that we're going to win decisively.
00:04:48.000 I want to play cut 27.
00:04:50.000 This is former Chief Criminal Division of SDNY Christy Greenberg, play cut 27.
00:04:57.000 Well, it is an interesting decision because the Colorado district judge, Sarah Wallace, last month, when she made her decision, she had a really puzzling decision where she found based on the evidence that Trump had engaged in insurrection, but essentially said, well, Section 3 of the 14th Amendment, it doesn't apply to presidents.
00:05:20.000 He's not an officer such that it applies to him, which was a really odd result.
00:05:27.000 So when that was appealed, I think a lot of people had been scratching their heads and thought the appeal was appropriate.
00:05:34.000 So it all comes down to this idea of insurrection or rebellion.
00:05:37.000 January 6th was, at the very worst, a mob that got out of control.
00:05:42.000 And more accurately, a federal agency and failed provocation campaign infiltrated with an unknown amount of people of the vast, vast majority of people that did nothing wrong and some people that got out of control.
00:05:55.000 So Will, what is the technical legal and definition of insurrection and rebellion?
00:06:00.000 Because it comes back to the 14th Amendment.
00:06:02.000 The 14th Amendment, that Part A, was obviously morally necessary to abolish slavery.
00:06:06.000 Part B, so broadly written, it floated to be used to kick Trump off the ballot to not abolish parts of the national debt.
00:06:14.000 In fact, where they were the debt ceiling, they said that Joe Biden could use the 14th Amendment.
00:06:19.000 Your reaction, Will Sharf.
00:06:21.000 Yeah, so there are a few things here, Charlie.
00:06:23.000 So Article 3 of the 14th Amendment is this insurrection clause.
00:06:28.000 But then you go down a couple, and in Article 5, you have a clause that says that Congress can act to enforce the provisions of the 14th Amendment.
00:06:38.000 And Congress did, in fact, pass a criminal statute barring insurrection.
00:06:43.000 That's a defined term in the federal criminal code.
00:06:46.000 President Trump has never even been indicted for the crime of insurrection, much less convicted of it.
00:06:53.000 He was impeached for some would say similar sorts of offenses and then acquitted by the Senate.
00:07:00.000 So the idea that a Colorado court in a summary proceeding, not even a full trial, could just go and find that President Trump committed insurrection and attempt to keep him off the ballot for that's crazy.
00:07:13.000 One other point, if I can, Charlie, the trial court in this case actually made one correct decision, which was that this insurrection clause clearly on its face does not apply to presidents.
00:07:26.000 It specifically enumerates congressmen, presidential electors, and then has a catch-all phrase for officers of the United States.
00:07:34.000 Why name congressmen and not name presidents if your intent was to include presidents?
00:07:40.000 I think it's very clear that this provision does not apply to the president, cannot apply to President Trump.
00:07:47.000 There are so many legal irregularities and deficiencies with this Supreme Court judgment that I look forward to having this up on appeal in front of the Supreme Court.
00:07:58.000 That's going to be a very good day.
00:07:59.000 Are you confident 90%, 95% certainty that the United States Supreme Court will not let this stand and will blunt any other state measures that are trying to do this?
00:08:11.000 I certainly hope so, Charlie.
00:08:12.000 I believe that President Trump will be on the ballot in all 50 states come next November, and I believe he will be our next president.
00:08:19.000 I think the United States Supreme Court will do the right thing here.
00:08:22.000 And we look forward to having this case up before the.
00:08:24.000 Well, hold on, hold on.
00:08:25.000 Timeline's important.
00:08:27.000 I agree with you about November.
00:08:28.000 The primary, though, is also important.
00:08:30.000 Is this a way that they could try to prevent him from getting primary delegates?
00:08:33.000 The Colorado GOP is talking about going to a caucus system, writing people in.
00:08:38.000 This is scheduled to be heard in January.
00:08:40.000 Are they going to do an emergency?
00:08:42.000 What is it called?
00:08:42.000 A writ, right?
00:08:43.000 They're doing an emergency deal.
00:08:45.000 The Colorado Supreme Court stayed its own decision until January, giving us time, giving President Trump's legal team time to take this up to the Supreme Court and apply to the Supreme Court for a stay.
00:08:58.000 I don't want to predict exactly what the Supreme Court is going to do, but I think the idea that President Trump will be kept off the ballot in any state, that's just not going to fly.
00:09:08.000 It's outrageous.
00:09:08.000 So you mentioned something I want to emphasize, which is you said there are well-funded dark money nonprofits that are pushing this.
00:09:18.000 This is not some sort of grassroots deal.
00:09:21.000 This is not even driven by office holders.
00:09:23.000 Explain to our audience how left-wing billionaires and dark money groups sat in a room and they came up with several ideas of how to prevent Donald Trump from becoming president.
00:09:34.000 One of them was using the 14th Amendment for ballot access.
00:09:38.000 Who are these groups and who funds them?
00:09:40.000 The principal group involved in this effort is called CRU, C-R-E-W, which is a major left-wing group.
00:09:48.000 It plays generally in the politics space in a number of different ways, but that's sort of the lynchpin of this effort to file these frivolous 14th Amendment suits all over the country.
00:09:59.000 It's very important to note that these cases, as you said, are not just being brought by ordinary citizens or people who are concerned about whatever.
00:10:08.000 These are cases that are being brought as part of a concerted lawfare and election interference effort against President Trump.
00:10:17.000 It is egregiously wrong.
00:10:18.000 It is a violation of every democratic principle we have in this country, and it has to stop.
00:10:24.000 Otherwise, this republic's not going to last.
00:10:26.000 Will, you're very prudent.
00:10:29.000 You're very wise.
00:10:30.000 I don't want to, you never exaggerate.
00:10:32.000 If we don't get this right, do we have a country anymore?
00:10:36.000 I think at the point where any state court can just declare someone an insurrectionary and hold them off the ballot as a result, I think that cuts to the heart of our constitutional system of government that undermines our Republican form of government.
00:10:52.000 This is legitimately end-of-republic type stuff.
00:10:55.000 But I'll say the same thing about when you have a sitting president using the Department of Justice to politically prosecute his principal opponent, when you have DAs around the country bringing frivolous criminal lawsuits against the leading presidential contender of one of the major parties in America.
00:11:12.000 I mean, we are living in unprecedented times.
00:11:15.000 The left loves to talk about norms and the rule of law.
00:11:18.000 In the last three years, we have seen the left run roughshod over every constitutional norm we have and the rule of law itself.

00:12:59.000 And so, I want to talk timeline here because you're one of President Trump's lawyers.
00:13:03.000 What is the timeline of when you think Donald Trump will actually be in a courtroom for January 6th?
00:13:09.000 Documents, Georgia, Alvin Bragg.
00:13:12.000 What is your best guess?
00:13:13.000 Given the non-obviously privileged stuff, public opinion, when do you think he'll actually be standing trial for those four?
00:13:22.000 So, let's start with the DC case.
00:13:25.000 Judge Chutkin originally scheduled that for March to start the day before Super Tuesday.
00:13:32.000 Presently, because of our judicial or because of our presidential immunity motion, that case has been stayed.
00:13:39.000 Not just the trial, but all proceedings in that case have been stayed pending final resolution of our presidential immunity and double jeopardy motions.
00:13:48.000 Now, we have appealed that issue to the DC Circuit.
00:13:53.000 Jack Smith's team is attempting to bypass the DC Circuit and take that case straight to the Supreme Court, which we plan on opposing.
00:14:01.000 My view is that the Supreme Court will reject Smith's attempt, that we will have our day before the DC Circuit, that we will likely have an appeal before the on-bank DC circuit, the entire circuit sitting as one court.
00:14:16.000 And only at that point will the case make it to the Supreme Court, at which point the Supreme Court's own process probably takes a few to several months before we get a decision there.
00:14:26.000 Cut a long story short, on the presidential immunity issue alone, I think the chances of that case going to trial anytime soon are vanishingly small.
00:14:38.000 In addition to that, the Supreme Court took the Fisher case, which relates to the ability of the Department of Justice to prosecute January 6th protesters under the 1512 statute, obstruction of an official proceeding.
00:14:51.000 We expect an opinion from the Supreme Court in that case no sooner than this spring or summer, most likely in June.
00:14:59.000 That case directly implicates two of the charges in President Trump's DC case as well.
00:15:05.000 So, all in all, I think the chances of the DC case going to trial before the election are getting smaller by the day.
00:15:12.000 The documents case in Florida, as you know, that case involves millions and millions and millions of pages of discovery, including classified discovery that requires special handling.
00:15:24.000 It involves thousands of hours of videotape recordings.
00:15:28.000 The judge down there, Eileen Cannon, is a straight shooter.
00:15:32.000 I think she's a fair judge.
00:15:34.000 I think she will give the defense the time it needs to prepare a defense, which in that case is a lot of time.
00:15:40.000 Georgia, similarly, we're in front of a state court judge there who has not been rushing things.
00:15:46.000 It's another very, very complicated case.
00:15:49.000 I think he will give President Trump's defense team the right to adequately prepare a defense, to analyze the voluminous discovery in that case.
00:15:58.000 And I think the chances of that going to trial before the election are quite small.
00:16:02.000 The Bragg case is anyone's guess.
00:16:04.000 I will say that relative to the other three, it involves much more minor charges, basically misdemeanor bookkeeping charges that are being disguised as felonies.
00:16:16.000 I don't want to make a prediction there, but all in all, when you look at the entire portfolio of these criminal cases against President Trump, I believe that he will have the opportunity, as is his right, to campaign unmolested by this lawfare to be the next president of the United States of America.
00:16:34.000 I believe he's going to be able to campaign vigorously and effectively.
00:16:38.000 And based on the polling and every metric we have available, I believe President Trump is going to be elected next November.
00:16:44.000 And hopefully at that point, this unlawful campaign of lawfare will be at an end.
00:16:49.000 That was an amazing summary.
00:16:51.000 So just to kind of put a button on it, Will, you don't think outside.
00:16:55.000 I kind of went on a ramp.
00:16:56.000 No, it was great.

00:16:57.000 Outside of Bragg, you don't think that any of the other three, Georgia Documents, J6, will be in trial before the election?
00:17:04.000 I think the closer we get to election, the tougher it's going to be for them to justify a rush trial.
00:17:11.000 And I think all of those cases, the timeline is stretching further and further out, not shortening.
00:17:16.000 D.C., I think if you'd asked us a couple of months ago, D.C. was the biggest risk.
00:17:21.000 There we have an absolute stay on proceedings.
00:17:23.000 And the Supreme Court taking Fisher directly implicates issues in that case.
00:17:28.000 I find it tough to see that getting to trial anytime soon.
00:17:31.000 This is great news, right, Will, because we don't want to have Trump's legal team rushed.
00:17:35.000 Obviously, we want to have an election, right?
00:17:37.000 Because so much of this is political.
00:17:39.000 And the question is, do they keep the charges if Trump wins?
00:17:42.000 All sorts of stuff.
00:17:43.000 This is great news.

00:18:48.000 I think that we need to talk about it more, detail it more.
00:18:50.000 Mike, am I thinking correctly that some of the lawfare plans are a little bit thwarted in recent weeks, especially with the Supreme Court looking at 1512, the Supreme Court potentially delaying.
00:19:07.000 They needed to try to get Donald Trump as a convicted felon before Election Day.
00:19:12.000 Is that likely to happen?
00:19:14.000 Well, it shouldn't happen.
00:19:15.000 And it's really going to depend on whether the Supreme Court grants Biden special counsel Jack Smith's extraordinary petition for cert before judgment, meaning the Supreme Court would bypass the federal court of appeals, in this case, the DC Circuit, and take a case of first impression on whether the President of the United States enjoys presidential immunity in the criminal context.
00:19:42.000 We know that judges get both civil and criminal immunity.
00:19:46.000 Members of Congress get civil and criminal immunity when they're dealing with their official acts.
00:19:51.000 The president gets civil immunity, but this is the first time with Jack Smith's indictment of a president.
00:19:57.000 This is the first time a former president, a president or former president has faced criminal charges based upon actions they took as the president of the United States.
00:20:07.000 In this case, whether January 6th was criminal, which it's not.
00:20:12.000 So the Supreme Court will need to decide whether they're going to take the case now or let it go through the normal process.
00:20:18.000 If they take the case now, which they should not do, Jack Smith and D.C. Obama judge Tanya Shucken may be able to railroad President Trump and violate his due process rights and try to convict him before the election.
00:20:32.000 If the Supreme Court does not take this case, if the Supreme Court says, let's wait for the D.C. circuit to decide, I don't think that Tanya Schutkin and Jack Smith will be able to get this January 6th trial in D.C. done before the election.
00:20:46.000 I mean, just Mike, you know, for those of us that, myself included, that don't know the way this, it's so not unusual.
00:20:53.000 It's grotesque to get a federal trial up in less than 12 months.
00:20:58.000 I mean, some federal trials take 36 months.
00:21:02.000 They could take 40 months.
00:21:04.000 Is that an exaggeration, Mike Davis?
00:21:06.000 Not at all.
00:21:07.000 Remember, they waited 30 months to bring these charges against President Trump, and they timed these trials for criminal trials, along with a civil fraud trial, back to back to back, along with these disqualification trials back to back to back in, you know, March.
00:21:24.000 It's just, it's March, it's May, it's March again.
00:21:27.000 It's, it's, you know, in August, it's insane what they're doing.
00:21:31.000 It's blatant election interference by Democrat prosecutors and Democrat judges and Democrat hellholes, right?
00:21:39.000 Like D.C., New York, and Atlanta.
00:21:41.000 And it is very obvious that they're trying to interfere in the election.
00:21:46.000 For example, on the January 6th case in D.C. with Jack Smith, there are like 13 million pages of documents and hundreds of witnesses.
00:21:55.000 Trump is supposed to prepare for that and go to trial in seven months while they have the January 6th defendants, the people who trespassed and paraded around the Capitol.
00:22:04.000 They had them in the D.C. gulag, you know, for many, many, many months preparing for their trial.
00:22:10.000 If you can't try someone for trespassing for more than a year, but you think you're going to try a former president and the leading presidential candidate for a, you know, a conspiracy on January 6th, and you're going to do that in seven months, that just shows you that this is blatant election interference.
00:22:28.000 And this is why the Supreme Court absolutely should not go along with Jack Smith's extraordinary request to speed this along.
00:22:36.000 This is huge news, everybody.
00:22:37.000 Again, of all the threats a month or two ago, it was almost certain that Donald Trump was going to be in some sort of a courtroom.
00:22:45.000 But, you know, people like you, Mike, and Will Scharf and many others have been filing motions, and it seems as if we're going to get past election day, which, by the way, even if you're a Democrat watching this show, which we have lots of Democrats that watch and we get their notes and I love it, you should want to have an election uninterrupted by trials.
00:23:02.000 I mean, give me a, I mean, just keep the election untampered with.
00:23:08.000 So I want to ask you, Mike, you are currently in Denver.
00:23:11.000 You're based out of Colorado.
00:23:12.000 These lunatics in the Colorado Supreme Court came out and they say Donald Trump's not allowed on the ballot.
00:23:18.000 Did you expect this and walk us through it?
00:23:21.000 Yeah, absolutely.
00:23:22.000 And what happened is you had these Democrat attorneys and these Democrat operatives and these fake Republicans bringing a election challenge in Colorado, an expedited challenge to disqualify President Trump from the Colorado primary ballot based upon January 6th.
00:23:40.000 They claim it was somehow an insurrection, right?
00:23:43.000 How many insurrectionists show up to a nation's capital unarmed, walk through velvet ropes, follow police direction, take selfies, and don't burn down the damn place?
00:23:52.000 January 6th was a lawful protest permitted by the National Park Service that devolved into a riot.

00:24:12.000 She got called out on this, so she found that there was an insurrection, but then she essentially head-faked and said that the 14th Amendment does not apply to the president of the United States, knowing that the seven justices, the seven Democrat-appointed justices on the Colorado Supreme Court would affirm her insurrection ruling and reverse her ruling under the 14th Amendment that the 14th Amendment doesn't apply to the president.

00:25:40.000 There's 155-year-old precedent from Chief Justice Samuel Chase after the Civil War.
00:25:46.000 If you want to disqualify under Section 3 of the 14th Amendment used to chase Confederate insurrectionists out of government, if you want to do that, Congress has to pass a federal criminal statute for insurrection or rebellion, which Congress did in 1869.

00:26:04.000 If you want to get rid of Trump for January 6th, Jack Smith would have to bring charges under that federal criminal statute for insurrection or rebellion or another prosecutor.

00:26:18.000 A federal jury finds him guilty unanimously with evidence beyond a reasonable doubt that federal trial judge would have to convict and that conviction would have to be upheld on appeal.
