00:02:51.000The apparent defense strategy here isn't to prove that Tyler Robinson didn't kill Charlie Kirk, but that he didn't intend to kill anyone else, and that therefore this should not be a death penalty case.
00:03:03.000Filing, Robinson's lawyers argued the state has failed to establish probable cause that the shooter knowingly created a great risk of death to another other than Charlie Kirk and himself.
00:03:19.000What stands out, so this just, you know as well as I do, this just dropped on us a couple hours ago as people noticed that this had been filed and started to read it.
00:03:28.000And what you look through, looking through it, is it's what they don't say.
00:03:34.000So this is the defense's filing against probable cause.
00:03:37.000So remember, we had the week long preliminary hearing.
00:03:40.000All of this is just to establish probable cause.
00:03:42.000We'll have this hearing on September 1st where the judge will hopefully.
00:03:46.000Finally, rule Do they have all the evidence to proceed to trial?
00:03:50.000So, this is a 41 page document where they're laying out their case on a whole bunch of things.
00:03:56.000And here's what is almost entirely missing from it is any effort to contest the core charge that Tyler Robinson committed murder on September 10th of last year.
00:04:08.000There is one page, basically one page out of 41 pages, concerns that.
00:04:13.000They complain that they have testimony from Lance Twiggs, which is what's used to support Robinson's confession, his posts on Discord, and they say this is bolstered by hearsay because Lance Twiggs didn't testify in court.
00:04:32.000That is the only time they're addressing evidence of murder.
00:04:37.000After that, it's page after page, all on either subsidiary crimes like witness tampering, or they're just trying to throw out the death penalty because you can't get a death penalty for murder unless there are aggravating factors.
00:04:51.000So in Utah, they've tried that he targeted Charlie over his political expression, and they've tried that he endangered other people at the scene.
00:04:59.000He endangered minors at the scene based on there being a big Crowd and he was firing at a long distance.
00:05:36.000And they bring in all these other cases where they say, if you're going to say he endangered other people, there should have been other people who were hit.
00:05:42.000There should have been many rounds fired.
00:05:44.000They fuss over, yeah, there were multiple rounds in the gun, but that doesn't prove anything.
00:05:51.000It just proves the gun could fire more shots.
00:05:53.000It doesn't mean they planned to endanger other people.
00:05:59.000There's absolutely nothing addressing the core facts that dominated the preliminary hearing.
00:06:06.000This is a person who basically allowed himself to turn himself in after his parents confronted him, after they identified him from footage.
00:06:14.000This is a person who confessed to his roommate that he did this and that he regretted doing it.
00:06:20.000This is a person caught repeatedly on camera on the campus when it's many hours away from where he lived.
00:06:26.000And they never, ever, ever address all of the DNA evidence linking him to the rifle, linking him to the screwdriver, linking him to the towel.
00:06:35.000They don't address those things because it seems that the defense attorneys.
00:06:41.000Yeah, no, and I just want to be really clear.
00:06:43.000And I checked with the attorneys this morning.
00:06:46.000They are not arguing against premeditated murder.
00:06:49.000And most people would assume that premeditated murder would warrant the death penalty.
00:06:54.000Well, in the state of Utah, as Blake mentioned, you need aggravating factors.
00:06:57.000So, what are those aggravating factors?
00:06:59.000That you could have endangered a minor, you could have endangered other people, that you did it because of political reasons, you know, think hate crime.
00:07:24.000So, other things that aren't in there, though, Blake, just to call it the elephant in the room, are so many of the conspiracy theories that have been rife on social media, right?
00:07:34.000So, for example, on page 22, one of the newest things that's percolating online from the Candace Owens crowd.
00:07:42.000Is that that wasn't really Tyler Robinson in the surveillance video?
00:07:46.000And that the fisheye effect, you know, when you actually adjust it for the fisheye effect, it's obviously somebody different than Tyler Robinson.
00:07:53.000Well, it turns out with a fisheye effect, the center of the image is usually pretty accurate.
00:08:06.000On page 22, it says The video evidence shows Mr. Robinson walking up and downstairs at UVU with a gait impaired by something long in his pant leg.
00:08:15.000The reasonable inference from the evidence provided is that it was a fully assembled.
00:08:21.000The presence of a screwdriver on the roof does not establish that the rifle was taken apart or put back together any more than it establishes the screwdriver was intended to take the rifle apart after.
00:08:30.000So they're quibbling over when the rifle was put together or taken apart and the presence of a screwdriver.
00:08:36.000They're not even arguing that he wasn't there.
00:08:40.000They're admitting that he was there and that the video evidence proves that he was there.
00:08:44.000So what's fascinating on multiple levels to me is they're, yeah, the bombshell is the big.
00:08:52.000E on the I chart, the headline is that they're not arguing that it wasn't him.
00:08:55.000They're arguing that he doesn't deserve the death penalty.
00:10:01.000So, the witness tampering is one of the secondary charges that was brought in this case.
00:10:06.000So, obviously, the most important one is capital murder, but they did charge Robinson as well with witness tampering because in his text exchanges with Lance Twiggs prior to turning himself in, he told him basically stay silent.
00:10:27.000And a secondary part of this is basically that when he tells him to get a lawyer, He's not telling them this, so to say, shut up, don't tell them what I did.
00:10:39.000He basically is just saying, for your own sake, you should just not talk to police.
00:10:45.000And they basically say this is an altruistic argument.
00:10:48.000You can't charge someone with witness tampering for telling them to exercise their constitutional rights.
00:10:54.000And so I guess Andrea is saying they probably have a good point on that one, and it's admittedly not the charge that we care about either.
00:11:02.000He basically just says, But I think what stands out about this is by making this argument, they are admitting Tyler Robinson was talking to Lance Twiggs.
00:11:12.000They literally are quoting themselves.
00:11:14.000They say, he, Mr. Robinson, says to Mr. Twiggs, I'm going to turn myself in willingly.
00:11:20.000One of my neighbors here is a deputy for the sheriff.
00:11:22.000We hope to keep things sort of quiet here.
00:11:43.000Don't take any interviews or make comments.
00:11:45.000So he's basically saying, I am going to turn myself in.
00:11:48.000I'm going to prison, but you should avoid talking to anyone and get a lawyer and try to remain silent.
00:11:54.000And so they just say that is advising him to use his rights, doesn't count as witness tampering.
00:12:00.000And I guess Andrea thinks they make a strong argument.
00:12:02.000But she is optimistic that the enhancers will stick around, which are the endangerment of others and the political motivations for going after Charlie.
00:12:12.000And again, it stands out what they don't address, for example.
00:12:17.000See anywhere in this document where they mention, for example, all the engravings that he made on his bullets, which are a strong indicator that he had a kind of political motivation of it.
00:12:26.000They don't really address the fact that he says, you know, I've had enough of his hate, that he was upset by Charlie's political advocacy.
00:12:35.000They very much want to make it seem like he, I guess, just wanted to kill Charlie because he was a celebrity, he was a famous person.
00:12:42.000They need something like that because if there's any political aspect to this, the state of Utah is able to make the case this is aggravated murder.
00:12:52.000And I do want to clarify one important thing.
00:12:56.000Our glorious Supreme Court is who's responsible for why you need these aggravating factors.
00:13:01.000It used to be any murder by default is eligible for the death penalty.
00:13:06.000Our glorious Supreme Court decades ago said, nope, you need these aggravating factors.
00:13:10.000But I do think it's worth highlighting here Utah would have a lot easier time with this if they had a law, and I think every red state should have a law.
00:13:19.000If you are doing public, Terrorism, which I think this would easily qualify as, that should be an aggravating factor unto itself.
00:13:25.000It's insane to me that anyone could go to a big public event with a rifle, assassinate the speaker, and have it not be aggravated murder.
00:14:36.000And then the defense says these statements by Mr. Robinson contextualize his altruistic advice to Mr. Twiggs to exercise his right under the Fifth Amendment to ask for a lawyer and stay silent.
00:14:47.000The facts do not support the state's allegation that this statement by Mr. Robinson was made with an intent to prevent an official proceeding or investigation.
00:14:58.000I actually happen to agree with Andrea here based on the evidence presented that witness tampering doesn't feel like that's what he was doing.
00:15:08.000He was sort of, it seems like, resigned to the fact that he was going to be going to prison and that this was going to be a massive federal investigation and state investigation.

00:24:10.000In terms of getting something done before this election, it's going to be tough.
00:24:13.000But I would much rather take our time, make sure that we have the committees instructed.
00:24:19.000And this is getting to budget wonkishness, but we need the committees that actually have pay for in them so we can address the massive fraud in Medicaid and these other areas.
00:24:29.000And the skinny package, we're not instructed those committees, so we wouldn't have had the adequate pay for.
00:24:34.000So now we can take our time, we can make our case.
00:24:37.000As budget chair, I'm going to be holding hearings on the reality of the fraud in Medicaid, the fraud in Medicare.
00:24:44.000Quite honestly, the fraud in Social Security.
00:24:55.000That'll take some congressional action to make sure we eliminate that.
00:24:59.000Senator, when you mentioned it's going to be tough to get it done before this election, I mean, if you're looking at the polling, if you're looking at the generic ballots, getting it done before this election feels pretty important.

00:28:00.000Often, but Milton Friedman says the only place inflation comes from is Washington, D.C., because only Washington, D.C. has a printing press for money.

00:29:07.000We have a message he said since many people have significant cytokine storms and fever after the second dose of the shot, this theoretically could be associated with miscarriage in the first trimester.

00:43:26.000We're going to stop these massive increases in utility rates over $2 billion in the last eight years.

00:43:44.000We want young people to have home ownership that's affordable once again, and that's reducing red tape, reducing taxes, and making sure that you have enough money at the end of the month that you can afford a mortgage and the American dream, which is a big part of it to own a home.
00:45:14.000All you young people out there, if you want more freedom, if you want more opportunity, if you want prosperity in the great state of Wisconsin, We're ready to deliver.

00:48:13.000So, I do think you're right that a lot of even Bernie Sanders, by the way, wouldn't get behind her.
00:48:17.000Said, I don't really know that race very well, which was, you know, Comrade Sanders' version of I don't like her that much and I don't want to be tied to her.
00:48:26.000So, the point is, you're right, but it is also interesting if you look at, so for example, Greg Price, friend of the show, he said, Francesca Hong, this is 225, says, Francesca Hong is somehow woefully underperforming in Madison, but massively overperforming in Milwaukee.
00:48:45.000So that is an interesting, it's completely bizarre.
00:48:48.000It's a totally fair view of what happened last night.
00:48:53.000And there were a lot of people that were texting me saying the establishment is up to it again.
00:51:28.000In a lot of rhetoric about equality, about wanting to uplift the masses.
00:51:33.000But what's really going on here is a lot of people who are angry that they aren't more prominent, angry that they aren't more famous, angry that they aren't more well compensated.
00:51:43.000And once they can get the opportunity to be in charge, whether it's literally holding power or just building up a giant pile of wealth, they're going to seize it and they will find ways to justify it.
